What is the standard buying process and typically how long does it take from offer to completion?
Upon acceptance of a purchase offer, it is advisable for buyer and seller to sign a private pre-sale agreement, o¢en involving the purchaser making a down-payment. This agreement reserves the property for the purchaser, giving them time to carry out due diligence on the property and to prepare the closing formalities. The transfer of the property and the payment of the balance of the price is executed in a Purchase-Sale Deed signed before the Notary usually 1 to 3 months a¢er signature of the private agreement.
In order to purchase a property in Spain, what does a non-resident buyer need to get started?
He/she needs to have a non-resident identification number (“NIE”) and will also be required to open a non-resident bank account in Spain. If the purchaser is unable to come to Spain for the signature of any of the above documents, he/she will have to grant a Power of Attorney to ensure his/her representation on signature.
What are the taxes and fees relating to acquiring property in Spain?
The acquisition of a property in Spain can be subject to any of the following taxes: Transfer tax, Value Added Tax (VAT) and Stamp Duty.
Generally speaking, for the acquisition of a property from a private individual, Spanish Transfer Tax will be applied at a rate ranging between 8% and 10% of the purchase price, depending upon where the property is located. Spanish VAT will apply in most other cases.
Other fees applicable to real estate transactions are Notary fees and Land Registry Fees.

Are there any specific legal pitfalls that buyers need to be aware of?
It is always advisable to instruct a good independent lawyer to carry out the due diligence on the property. There are various issues that should be checked, including: (i) that the vendor has clear title ownership; (ii) that the property is free of charges (including mortgages), tenants and encumbrances of any kind and; (iii) that the property has the relevant license for living purposes. In addition, when buying refurbished properties, it is advisable to check that the works have been carried out in accordance with the applicable legal and planning regulations.
What are the ongoing taxes for non-resident property owners in Spain?
The ongoing taxes applicable to non-resident property owners are: Spanish non-residents Income Tax, Wealth Tax and Municipal Real Estate Tax.
Is there a capital gains liability when non-residents sell a property in Spain?
Yes. Capital gains are subject to the Spanish non-residents Income Tax at a rate of 21%. This tax liability might, in certain cases, be mitigated or even eliminated as a consequence of the application of Double Tax Treaties signed by Spain.
Is it advisable for a non-resident to complete a Will in Spain to cover their Spanish property?
This depends upon the nationality of the buyer and the applicable law in their home country. Buyers should seek specialist legal advice on this matter.

What is the concept of Rialto Living and how did it come about? We moved to Mallorca seven years ago and realized we wanted something to do, so decided to open a store with a mix of all the things we liked but could not find on the island. We wanted a relaxed, select, stylish mix of products, which offered something for everyone. To do this, we needed a large space, which in the centre of Palma is not easy. Eventually, we found an old theatre that had been turned into a cinema - Palma’s first, dating back to 1952. The cinema was called Rialto and had been closed for a couple of years. We kept the original name because everybody knew where it was located and added ‘Living’ to the name. What services and products do you offer?We sell clothing and accessories for men and women. We carefully select labels which you cannot find anywhere else on Mallorca, avoiding well known global brands. We also offer all sorts of artisan gi¢s as well as home décor
Rialto Living offers a unique lifestyle concept to the well-travelled fashion and design-orientated customer. Founded by Klass Kall and Barbara Bergman, Rialto Living opened its doors in 2007 in the former Rialto cinema in Palma Old Town. It offers approximately 800 square metres of fashion, furniture, gifts, art and a café.

We can provide home decoration projects including upholstering and curtains, made by our in-house seamstress. In addition we have a café where you can have breakfast, lunch, a¢ernoon tea and drinks. We also run an art gallery with monthly exhibitions featuring mainly local artists. How do you source your products and what is unique about them?We use our own designers for our sofas, armchairs, bed and bedding. We work with a local blacksmith who makes our tables, lamps and bed frames. We also go to various fairs to source products that fit into our concept. Who are Rialto Living’s typical clients?Today, given Spain’s challenging economic situation, most of our customers are tourists and Northern European second homeowners.
Why did you choose Mallorca as a base for Rialto Living?The quality of life on Mallorca is fantastic with easy access to the rest of Europe, great climate as well as being safe and peaceful. Rialto Living is based in a stunning building, can you tell us about about its background?The building is an old palace and they originally built a theatre (later a cinema) in the grounds. The entrance to the theatre/cinema is via a side door. Next year, we are expanding the store within the building on the ground floor as well as upstairs. Tell us about some of your favourite places on Mallorca and why? There are so many! The wide variation in a relatively small area is what makes it unique. You have rocks and sandy beaches, mountains and meadows. You can hike and bike and all the rest!

Where and when was Bastidas Architects founded?Bastidas Architects was founded in Artà in 1980 by a young international team, full of hope and aspirations. For many of us, it was a big change, as we had come from the city to work in a village. At the beginning we developed projects in the north-east of the island and then we expanded to include the whole of Mallorca, mainland Spain, Paris, Marrakech and New York.
How would you best describe your philosophy?My philosophy is based on respecting the environment, the simplicity of lines and the use of high-quality materials. For me, integration is more important than the ability to stand out. I like to achieve something balanced, in proportion and with clean lines. Some would call it elegance but I call it harmony.
Approximately how many projects have you worked on since its inception and has there been a project that you have particularly enjoyed working on?
Bastidas Architects is an architectural studio offering design, landscape gardening and Project Management. The company’s main objective is to create personalised designs combining maximum integration into natural surroundings and high levels of functionality. Sergi Bastidas has been working for over 30 years dedicating his own vision and sensibilities to every project.

Hundreds, but honestly I don’t keep a list of them all. I am lucky to have worked on a diverse range of projects including new constructions, refurbishments, family homes, apartment buildings, restaurants, offices, shops, all of which I love.
Why did you personally want to become an architect and who and what inspires you? Thanks to my father, who was indirectly related to the profession and who taught me that if you do a job, you should do it well and with passion. He taught me to channel my creativity because architecture is a mix of both imagination and discipline.
How would you characterize your style? Refined without being cold, with an emphasis on straight lines and symmetry. I especially appreciate high quality materials and I am careful to choose appropriate colours for warmth and personality.
Why did you choose Mallorca as a base? Initially I came to Mallorca because of my family history but the quality of life here helped me decide that I wanted to live here indefinitely. The island has such a variety of landscapes which are very stimulating for any architect. I have an affinity with the austerity of the Mallorcan character and I am also interested in the diversity of nationalities and cultures of the residents on the island.
When designing a property for Mallorca, what characteristics do you feel are important?It is important to integrate well with the surroundings so as to avoid some of the urban development disasters of the past. It should have a good orientation, maximizing the Mediterranean’s unique light, to be well insulated against the winter dampness and humidity of the coast and a good interpretation of the architectural and handcra¢ed traditions of the island so as to achieve both a contemporary and respectful project.
