Violation Description:

Failing to properly classify a material as a packing group I and listing the shipment on a shipping paper as a packing group II in violation of 49 C.F.R. §§171.2(a)(b)(e)(i) and 172.202(a)(4), 173.22(a)(1) and 173.121(a)(4).

Evidence Summary:

A total of eighteen different samples were collected and analyzed showing flash points less than 50 degrees F and boiling points ranging from 87.6-123.8 F (Exhibit 1 & 9).

Seven of the samples taken on 10/10/13 were entered on the shipping paper as having been classified as a packing group II flammable liquid. The analysis of the samples following were found to be mis-classified as a packing group II when the flashpoint and boiling point show the liquid as a packing group I material. The shipper was identified as Hess Corporation with three different carriers transporting the crude oil.

*Sample #16 was taken from Power Fuels, tractor unit 6546; shipping paper identifies the product as UN1267, Petroleum Crude Oil, 3, PG II and the shipper as Hess Corp 3038, Keene, ND (Exhibit 2). Analysis for sample #16 shows flash point less than 50 degrees F and boiling point at 92.1 degrees F (Exhibit 1).

*Sample #17 was taken from QC Energy Resources, trailer unit 533; shipping paper identifies the product as UN1267, Petroleum Crude Oil, 3, PG II and the shipper as Hess (Exhibit 3). Analysis for sample #17 shows flash point less than 50 degrees F and boiling point at 92.6 degrees F (Exhibit 1).

*Sample #18 was taken from QC Energy Resources, tractor unit GPT1; shipping paper identifies the product as UN1267, Petroleum Crude Oil, 3, PG II and the shipper as Hess Corp 3038, Keene, ND. (Exhibit 4). Analysis for sample #18 shows flash point less than 50 degrees F and boiling point at 91.9 degrees F (Exhibit 1).

*Sample #19 was taken from Power Fuels, tractor unit 6586; shipping paper identifies the product as UN1267, Petroleum Crude Oil, 3, PG II and the shipper as Hess (Exhibit 5). Analysis for sample #19 shows flash point less than 50 degrees F and boiling point at 89.0 degrees F (Exhibit 1).

*Sample #21 was taken from JBS Trucking, Inc., tractor unit 79; shipping paper identifies the product as UN1267, Petroleum Crude Oil, 3, PG II and the shipper as Hess Corporation, 10384 68th St. NW, Tioga, ND 58852-9420 (Exhibit 6). Analysis for sample #21 shows flash point less than 50 degrees F and boiling point at 88.9 degrees F (Exhibit 1).

*Sample #22 was taken from Power Fuels, tractor unit 6584; shipping paper identifies the product as UN1267, Petroleum Crude Oil, 3, PG II and the shipper as Hess Corp (Exhibit 7). Analysis for sample #22 shows flash point less than 50 degrees F and boiling point at 87.6 degrees F (Exhibit 1).

*Sample #23 was taken from Power Fuels, tractor unit 6517; shipping paper identifies the product as UN1267, Petroleum Crude Oil, 3, PG II and the shipper as Hess 3038 Tioga (Exhibit 8). Analysis for sample #23 shows flash point less than 50 degrees F and boiling point at 90.9 degrees F (Exhibit 1).

Referencing 49 C.F.R. §173.121(a)(1) chart shows that if the initial boiling point is less than 95 degrees F, the product is assigned PG I.

The probable violation observed: Incorrect classification as a packing group II material when testing indicates a packing group I and incorrect packing group listed on the shipping paper.

Violation Description:

Offering hazardous materials for transportation in commerce and failing to list the basic description in the required sequence on the shipping paper in violation of 49 C.F.R. §§ 171.2(a)(e) and 172.202(b).

Evidence Summary:

The evidence provided shows the sequence on each basic description is not in the proper sequence on the shipping paper for 6 shipments of UN1267, Petroleum Crude Oil, 3, PGII. The shipper lists the proper shipping name, class, UN number then packing group. The proper sequence is UN number, proper shipping name, class then packing group. (Exhibits 2-5 & 7-8)

Sample taken from tractor operated by Power Fuels (Exhibit 2, Sample 16) has proper shipping name listed on shipping paper as "Petroleum Crude Oil, 3, UN1267, PGII".

signed the chain of custody form and took possession of the cooler to include the sample tins.

6. A total of 12 samples were gathered in this manner at Hess Tioga Loading Facility. All of the samples were collected and handled in the exact same manner.

7. Sample #15 was taken from carrier MBI Energy Services Inc., truck #928, shipping paper identifies the product as UN1267, Petroleum Crude Oil, 3, PG II and the shipper as Marathon Oil Corporation, 3172 Highway 22 North, Dickinson, ND. Sample #24 was taken from carrier Fadeland Trucking LLC., truck #37, shipping paper identifies the product as UN1267, Petroleum Crude Oil, 3, PG II and the shipper as Marathon Oil Corporation, 3172 Highway 22 North, Dickinson, ND. Sample #25 was taken from carrier Fadeland Trucking LLC., truck #41, shipping paper identifies the product as UN1267, Petroleum Crude Oil, 3, PG II and the shipper as Marathon Oil Corporation, 3172 Highway 22 North, Dickinson, ND.

9. On October 9th, 2013, Investigators Fred Simmons and Terry Pollard along with Director Kip Wills were driving near Alexander, North Dakota on a public roadway. We observed Southern Energy Transportation semi cargo tank Unit 404 loading crude oil from a gathering tank located on the Gajewski 14-12H well, located at legal SW/SW Section 12, Township 151North and Range 102West. The cargo trailer was attached via hosing to an outlet piping system from the gathering tank located at that location. We identified ourselves to the truck driver and requested a sample of the oil. He stated that he had been loading for approximately fifteen minutes. There was a sampling spigot located near the connection between the cargo tank and the gathering tank. The unknown truck driver and I were able to place the sampling tin under the spigot and fill it approximately 3/4 full. I then placed a stopper on the sampling tin and screwed the lid on tightly. This was labeled as Sample 13. The shipping paper identifies the product as UN1267, Petroleum Crude

Oil, 3, PG III and the shipper as Whiting Oil & Gas Corporation, 528 21st St., Dickinson, ND. The sample was placed in a PHMSA cooler and covered with ice. It was delivered by me to the Intertek Laboratory in Mandan North Dakota on October 10th and Intertek Lab personnel signed for custody.

Failing to properly classify a material as a packing group I and listing the shipment on a shipping paper as a packing group II in violation of 49 C.F.R. §§171.2(a)(b)(e)(i) and 172.202(a)(4), 173.22(a)(1) and 173.121(a)(4).

Evidence Summary:

On 10/10/2013, crude oil samples were taken from three separate transports.

*Sample #15 was taken from carrier MBI Energy Services Inc., truck #928, shipping paper identifies the product as UN1267, Petroleum Crude Oil, 3, PG II and the shipper as Marathon Oil Corporation, 3172 Highway 22 North, Dickinson, ND. (Exhibit 1). Analysis data provided by Intertek for sample #15, submitted by PHMSA, is identified as ID 2013-NDMD-000053-008 and shows the flash point less than 50 degrees F and boiling point at 89.0 degrees F (Exhibit 4).

*Sample #24 was taken from carrier Fadeland Trucking LLC., truck #37, shipping paper identifies the product as UN1267, Petroleum Crude Oil, 3, PG II and the shipper as Marathon Oil Corporation, 3172 Highway 22 North, Dickinson, ND. (Exhibit 2). Analysis data provided by Intertek for sample #24, submitted by PHMSA, is identified as ID 2013-NDMD-000053-017 and shows the flash point less than 50 degrees F and boiling point at 91.6 degrees F (Exhibit 4).

*Sample #25 was taken from carrier Fadeland Trucking LLC., truck #41, shipping paper identifies the product as UN1267, Petroleum Crude Oil, 3, PG II and the shipper as Marathon Oil Corporation, 3172 Highway 22 North, Dickinson, ND. (Exhibit 3). Analysis data provided by Intertek for sample #15, submitted by PHMSA, is identified as ID 2013-NDMD-000053018 and shows the flash point less than 50 degrees F and boiling point at 92.1 degrees F (Exhibit 4).

Referencing 49 CFR, § 173.121(a)(1) chart shows that if the initial boiling point is less than 95 degrees F, the product is assigned PG I.

6. A total of 12 samples were gathered in this manner at Hess Tioga Loading Facility. All of the samples were collected and handled in the exact same manner.

Sample #15 was taken from carrier MBI Energy Services Inc., truck #928, shipping paper identifies the product as UN1267, Petroleum Crude Oil, 3, PG II and the shipper as Marathon Oil Corporation, 3172 Highway 22 North, Dickinson, ND. Sample #24 was taken from carrier Fadeland Trucking LLC., truck #37, shipping paper identifies the product as UN1267, Petroleum Crude Oil, 3, PG II and the shipper as Marathon Oil Corporation, 3172 Highway 22 North, Dickinson, ND. Sample #25 was taken from carrier Fadeland Trucking LLC., truck #41, shipping paper identifies the product as UN1267, Petroleum Crude Oil, 3, PG II and the shipper as Marathon Oil Corporation, 3172 Highway 22 North, Dickinson, ND.

Sample #22 was taken from Power Fuels, tractor unit 6584; shipping paper identifies the product as UN1267, Petroleum Crude Oil, 3, PG II and the shipper as Hess Corp. Sample #23 was taken from Power Fuels, tractor unit 6517; shipping paper identifies the product as UN1267, Petroleum Crude Oil, 3, PG II and the shipper as Hess 3038 Tioga, ND.

9. On October 9, 2013, Investigators Fred Simmons and Terry Pollard along with Director Kip Wills were driving near Alexander, North Dakota on a public roadway. We observed Southern Energy Transportation semi cargo tank Unit 404 loading crude oil from a gathering tank located on the Gajewski 14-12H well, located at legal SW/SW Section 12, Township 151North and Range 102West. The cargo trailer was attached via hosing to an outlet piping system from the gathering tank located at that location. We identified ourselves to the truck driver and requested a sample of the oil. He stated that he had been loading for approximately fifteen minutes. There was a sampling spigot located near the connection between the cargo tank and the gathering tank. The unknown truck driver and I were able to place the sampling tin under the spigot and fill it approximately 3/4 full. I then placed a stopper on the sampling tin and screwed the lid on tightly. This was labeled as Sample 13. The shipping paper identifies the product as UN1267, Petroleum Crude

Oil, 3, PG III and the shipper as Whiting Oil & Gas Corporation, 528 21st St., Dickinson, ND. The sample was placed in a PHMSA cooler and covered with ice. It was delivered by me to the Intertek Laboratory in Mandan North Dakota on October 10th and Intertek Lab personnel signed for custody.

Sample #21 was taken from JBS Trucking, Inc., tractor unit 79; shipping paper identifies the product as UN1267, Petroleum Crude Oil, 3, PG II and the shipper as Hess Corporation, 10384 68th St. NW, Tioga, ND 58852-9420. Sample #22 was taken from Power Fuels, tractor unit 6584; shipping paper identifies the product as UN1267, Petroleum Crude Oil, 3, PG II and the shipper as Hess Corp. Sample #23 was taken from Power Fuels, tractor unit 6517; shipping paper identifies the product as UN1267, Petroleum Crude Oil, 3, PG II and the shipper as Hess 3038 Tioga, ND.

9. On October 9, 2013, Investigators Fred Simmons and Terry Pollard along with Director Kip Wills were driving near Alexander, North Dakota on a public roadway. We observed Southern Energy Transportation semi cargo tank Unit 404 loading crude oil from a gathering tank located on the Gajewski 14-12H well, located at legal SW/SW Section 12, Township 151North and Range 102West. The cargo trailer was attached via hosing to an outlet piping system from the gathering tank located at that location. We identified ourselves to the truck driver and requested a sample of the oil. He stated that he had been loading for approximately fifteen minutes. There was a sampling spigot located near the connection between the cargo tank and the gathering tank. The unknown truck driver and I were able to place the sampling tin under the spigot and fill it approximately 3/4 full. I then placed a stopper on the sampling tin and screwed the lid on tightly. This was labeled as Sample 13. The shipping paper identifies the product as UN1267, Petroleum Crude

Oil, 3, PG III and the shipper as Whiting Oil & Gas Corporation, 528 21st St., Dickinson, ND. The sample was placed in a PHMSA cooler and covered with ice. It was delivered by me to the Intertek Laboratory in Mandan North Dakota on October 10th and Intertek Lab personnel signed for custody.
