“Passion” is defined by Wikipedia as a strong desire, compelling feeling, and enthusiasm for something. Having passion enables us to accomplish the extraordinary.

As we start the beginning of a new calendar year we tend to reflect on the past and plan for the future. We look to refocus our energy and life toward our family, health, career and personal interests. This is also a good time to reflect on how fortunate we are and think about how we can give back and help others in need. So, where does organized dentistry fall in this pursuit?

Organized dentistry allows us to come together as a unified group to formulate solutions for our profes-sional challenges. Currently, two of my greatest concerns facing our profession are: 1. How are we going to continue to generate interest in our field for the smartest and brightest when the cost of education is reaching $350,000 and up? 2. How are dentists going to successfully address the access to care issue without having outside interests developing a whole new model of providers?

I feel these two driving forces will have the greatest impact on our profession in the near future. Through involvement with organized dentistry our profes-sion and our practice can benefit. WLADS gives us a foundation and an outlet to support oral health in our community and our patients. Organized dentistry helps maintain a safe environment to practice dentist-ry and to be enthusiastic about the care we provide. My passion in dentistry has strengthened through the years with the relationships I have developed with my patients, colleagues and community. I look forward to being a part of carving the right path for our profes-sion through WLADS. I encourage and appreciate the input and help of our members.

tions were developed questioning the usage of the internet and ethical behavior. One was regarding the usage of social media and internet referral services for CDA dentists. The resolution was brought to the table by the Orange County Dental Society. They wanted CDA to evaluate social media and internet referral services to ensure fair business practices. They also resolved that CDA help by providing guidance and education on fair business practices using social media and internet referral services. Yelp, Google, Facebook and a variety of other internet referral services have had a positive and negative impact on dentists. A code of ethics for using these various sites has not been clearly defined. A problem that has presented on many sites like Yelp is that dentists that have been given negative reviews by someone who is not credible or lacks evidence to support their viewpoint have no resources to appropriately deal with the matter. Unfortunately, due to legal practices in place protecting sites such as Yelp and the people that use it, it is very difficult to fight back against these negative reviews. The hope is that CDA can create an avenue for dentists that have been negatively

affected by patients who are not credible in their remarks. CDA does have various webinars and continuing education services in place to help dentists deal with a bad review. An-other avenue is talking to TDIC managers or reputation man-agement services. That is, until the ethics for online usage with social media and internet referral services have been clearly de-fined. Dentists are first exposed to ethics in dentistry during their dental school experience. Following school, we have the option to reinforce our knowledge and decision making

abilities through CE courses and articles. Be-ing that we are health care providers it is ex-pected that we maintain and follow clear ethical principles. Often times, the lines between what is seen as ethical business may get blurry. This has become even more evident through the usage of technology and the internet. Dentists are being exposed to a variety of new ways to market themselves and their practice. Unfor-tunately, this has lead to new dilemmas in the profession on ethical business techniques that need to be exposed and solved for future prac-titioners. At the CDA House of Delegates this year held in Newport Beach, CA a couple of new resolu-

Less than a month into 2013 and high-income earners have already taken three significant hits to their bottom line. The legislative scramble to avoid the Fiscal Cliff produced the American Taxpayer Relief Act, resulting in any-thing but relief for thousands of small businesses. Meanwhile, the continued implementation of Obama Care means a whopping new surtax on success-ful professionals. Not to be outdone at the federal level, the voters of Cali-fornia recently passed Proposition 30, ensuring the state’s piece of an ever-shrinking pie. The start of 2013 makes 2012 look like the “good ole’ days.”

Triple Threat — The Fiscal Cliff, “Obama Care” and Prop 30

If you’re not planning to sell your practice or relocate in the near future, you may think to yourself, Why worry? But what if you own several dental practices? What if you do want to retire in the near future? What happens if there is an unexpected need to sell your practice and relocate? What if 2013 is a record year for profits for your business? All of these scenarios could mean thousands of dollars in ad-ditional taxes. Through a variety of circumstances, you could be a high income earner with a target on your back and your wallet. The latest tax hikes for 2013 are going to affect your bottom-line at a level unseen since the tax increases of 1993. The ongoing political and national conversations center around whether or not the economy is ready. Your private and professional conversations need to center around whether or not you are ready.

On the evening of January 1, 2013, the House passed the American Taxpayer Relief Act of 2012, joining the Senate to resolve the tax side of the so-called “Fiscal Cliff”. This act increases taxes to a new 39.6% top marginal tax bracket that applies to taxable income over $400,000 for individuals and $450,000 for married couples filing jointly (“MFJ”). In ad-dition, long term capital gain rates as well as qualified divi-dends also increased to 20% for taxpayers in this new 39.6% bracket. Although $400,000 and $450,000 may appear to be large numbers, an experienced dental professional will likely be earning anywhere from $130,000 to $210,000, with earn-ings typically higher for owners. Once spousal income, invest-ment returns and rental income are factored in, taxable income could quickly surpass these thresholds.

Further, the new Patient Protection and Affordable Care Act, also known as “Obama Care,” has a much lower threshold coming online in 2013. The act applies a 3.8% Medicare surtax on investment income, which is classified as the lesser of net investment income or the amount of modified adjusted gross income (“MAGI”) exceeding $200,000 for individuals or $250,000 for MFJ. Investment income includes interest, dividends, capital gains, non-qualified annuity distributions, rents, and royalties. This surtax would have a large impact on a dentist who plans to sell their practice or home. An owner could easily find that their capital gains tax increased from last year’s 15% to 23.8% - a 58% increase!

Finally, Proposition 30, recently approved by the voters of Califor-nia, comes with another increase for high-income taxpayers. Prop 30 created three new income tax brackets, increasing tax rates by as much as 3% over the current maximum rate of 9.3%. The higher tax brackets apply to single taxpayers beginning with taxable income greater than $250,000, married taxpayers and registered domestic partners who file jointly with taxable income greater than $500,000 and head of house-holds with taxable income greater than $340,000. This act is retroac-tive to January 1, 2012 so those who sold property and/or a practice this past year now find themselves owing money for an asset they no longer hold.

You are obligated to make reasonable arrangements for the emergency care of your patients of record. A charge of patient abandonment may result from a failure to make reasonable arrangements. Examples of reasonable arrangements include: Before leaving on an extended vaca-tion or absence from the practice, arrange for emergency coverage with one or more colleagues. Notify your patients in advance and provide your colleagues’ contact infor-mation. For times when your office is closed, leave an outgoing message on your tele-phone answering system that provides instructions on how a patient can contact you or a colleague who is providing emer-gency coverage. If using an answering service, instruct the operator to collect in-formation from the patient that includes full name, date seen by the dentist, complaint, and a telephone number. You should have a method of verifying patients of record, or verifying patients of colleagues for whom you are providing emergency coverage.Patients Not of Record: When consulted in an emergency by a patient not of record, you are obligated to make reasonable arrangements for emergency care of that patient. Consulting with a patient for the first time in an emergency does not make the individual a patient of record.For those patients who do not have a den-tist, WLADS has a referral service. What do your patients, staff, colleagues, friends, and family all have in com-mon? They are all connected together through you on social media! The term “social media” describes the countless online platforms that connect hundreds of millions of users on a daily basis all around the world. Once a strictly personal platform, social media now ties your business to you and your staff personally. The ease of information flow and “anytime-anywhere” has blurred the boundaries between business and personal lives. While social me-dia can be a powerful tool for promoting your business, you should be aware of the potential ethical issues that can arise. Care must be taken to protect patient privacy and ensure that comments made about other dentists are fair and reasonable.

Ethics of Social Media:Patient privacy and justifiable comments

Section 1.E of the CDA Code of Ethics states, “Dentists are obliged to safeguard the confidentiality of patient records.” Make sure you have a social media policy in place and all employees are trained on it. Incidents, patients, cases, etc., should never be discussed using social media unless explicit written consent is obtained and all HIPAA policies are followed. As a general recommendation, keep your pro-fessional and personal lives as separate as possible and assume everyone will be able to see all of your postings, tweets, and other online activity.

Section 10.C of the CDA Code of Ethics states, “A dentist has the right to make fair comments with respect to dental health subjects, including dentists and the quality of dental care delivered… However, it is unethical to publish… comments on such subjects if the dentist does so without having sufficient information that would justify a reasonable dentist to believe the comments to be true.” Remember that actions online and posted content can negatively affect your reputation among patients and colleagues

and can undermine public trust in the dental profession. Making personal comments about patients or colleagues is especially inap-propriate.

We are inviting all golfers of the Western Los Angeles Dental Society (and their friends, relatives, and staff members) to come out and join us for a fun day of golf and camaraderie!!! The tournament format is scramble foursome. Form your “Awesome Foursome” for first, second and third place prizes. If you do not have your own foursome, we will find you a team to join! Just let us know your approximate skill level - handicap.

The fee includes breakfast, lunch, and LOTS OF RAFFLE PRIZES!!!
