Advice & GuidanceWe are regularly approached by our retained clients to answer queries and offer advice and guidance on various issues. Once

again we have included a couple of this month’s queries…

Q&A - must we plan, do, check, act?Q. We’ve been told that to comply with the Management of Health and Safety at Work Regulations 1999 we must follow a “plan, do, check, act” approach to health and safety management. Is this correct?

A. You’re under no explicit duty to follow this approach. However, as the HSE identifies in its guidance document Plan, Do, Check, Act, An introduction to managing for health and safety (INDG275) http://www.hse.gov.uk/pubns/indg275.pdf, doing so makes it easier to meet legal requirements.

This approach advocates incorporating health and safety into your general management systems rather than just treating it as a stand-alone issue. An examination of the health and safety issues associated with a task both at the planning stages and continuing throughout the job is what is required.

For example, if you had a work at height project you shouldn’t plan access arrangements and only then run it past the safety manager, who might tell you to start again. Instead, plans should address how to safely access the work area from the outset.

Tip. This approach is worthy of serious consideration. When safety planning has been factored in from the earliest stages of a job, the whole project is likely to run more smoothly, and with reduced risks there are benefits for health and safety, efficient project management and the bottom line.

You’re under no explicit duty to follow this approach, however doing so should reduce risks and make compliance easier. It does this by encouraging those planning work to factor in safety considerations from the start right through to the end of a project.

RESPIRATORY PROTECTION

Q&A - do we need to “fit test” masks?Q. Do we need to use a face fit testing service for paper dust masks? The type we use are loose fitting facepieces, and, as we understand it, we don’t have to face fit these masks. Is this correct?

A. According to the HSE, the performance of loose fitting masks relies on sufficient airflow through the facepiece and is therefore less dependent on a tight fit to the face. Therefore, it does not require fit testing.

However, you should still ensure that any respiratory protection supplied is of the correct size to fit the wearer so that they are adequately protected and as with all Personal Protective Equipment (PPE), have given the user adequate information, instruction and training on how to use, check, store and maintain the produce and how to report any defects.

Note. A fit test is a procedure which identifies whether a seal is made between the skin and the mask. These are only required for tight fitting masks.

to do what you want?

You’ve a greater chance if they know and owe you. In other words:1. Know – they have a good relationship with you –

they know, like and trust you; and

2. Owe – they feel in your debt, so want to reciprocate

So, to ensure they know you…• Spend time with them – face-to-face, wherever

possible

• Speak regularly. If you’re the sort of person who only remembers to contact someone when you need them, insert a recurring diary entry, reminding you to call them when you don’t

• Ask them questions, to learn more about them. And when you do this, remember to remain silent whilst they’re answering

… And ensure they owe you:• Provide value every time you meet them…

• …and do so without asking for anything in return (or they won’t owe you!)

• The definition of ‘value’?. So, things like: inviting them to an event, introducing them to someone, teaching them something, saving them time, making them look good, etc.

In my experience, as you read this, you’ll probably realise you fall into one of three camps – someone who:

1. Doesn’t focus on the know or the owe

2. Does focus on them, because you see the benefits to you in doing so – ‘if I do this, I’ll get something back one day’); or

3. Does focus on them, because…well, it feels the right thing to do

Which of these three is best? Well, that depends on your viewpoint. But if you’re #2 or #3 – such that they know and owe you – you’ll find it easier to persuade than if you’re a #1.
