LOCAL GOVERNMENT ACT 1995

City of Mandurah

FENCING AMENDMENT LOCAL LAW 2015

Under the powers conferred by the Local Government Act 1995 and under all other powers enabling it, the Council of the City of Mandurah resolved on 23 February 2016 to make the following local law.

1. Citation

This local law may be cited as the City of Mandurah Fencing Amendment Local Law 2015.

2. Commencement

The local law comes into operation 14 days after the date of its publication in the Government Gazette.

3. Principal Local Law

In this local law, the City of Mandurah Fencing Local Law 2015 published in the Government Gazette No. 107 of 14 July 2015 is referred to as the principal local law.

4. Clause 1.2 amended

In clause 1.2, delete the definition of “street setback area” and insert the following definition—

primary street setback area means the area between the building line of a lot and the front boundary of that lot;

5. Clause 2.1 amended

In clause 2.1(3)(a), delete the words “street setback area” and insert in their place the words “building line”.

6. Clause 3.1 amended

In clause—

(a) 3.1(2), delete the words “front setback line” and insert in their place the words “building line”; and

(b) 3.1(3), delete the words “front setback line” and insert in their place the words “primary street setback area”.

7. Clause 5.1 amended

In clause 5.1, delete the words “or maintain”.

8. Clause 7.1 amended

Delete clause 7.1(c) and replace it with—

(c) be capable of being rendered inoperable during the hours of business operations, if any, on the lot where it is erected; and

9. Clause 8.3 amended

In clause 8.3(3), delete the word “licence”.

10. Schedule 1

(a) in paragraph (a)(iv) of Schedule 1, delete the words “the relevant AS/NZS” and insert in their place the words “AS 3660.1:2014 Termite management—New building work (as amended)”; and

(b) replace the term “street setback area” with “primary street setback area” in each of the three instances it occurs.

11. Terms used throughout the principal local law

Wherever the terms “commercial lot”, “industrial lot, “residential lot”, “rural lot” and “rural residential lot” are used within the local law, substitute with “Commercial

Made by the Governor in Executive Council.

1. Citation These regulations are the Betting Control Amendment

Regulations (No. 2) 2016.

2. Commencement

These regulations come into operation as follows — (a) regulations 1 and 2 — on the day on which these

regulations are published in the Gazette; (b) the rest of the regulations — on the day after that day.

3. Regulations amended

These regulations amend the Betting Control Regulations 1978.

4. Regulation 81 amended

Delete regulation 81(2).

Acting pursuant to the powers conferred by Regulation 48A of the Navigable Waters Regulations 1958, I hereby cancel Notice TR401 as published in the Government Gazette on 5 April 2002 and Notice MH404 (1)(a)(6)(i) as published in the Government Gazette on 25 October 1991 and set aside the following area of water for the purpose of water skiing—

EXMOUTH GULF: All those waters of Exmouth Gulf within 2 nautical miles of the shore and (i) south of a line through 21°49.867′S, 114°10.356′E and 21°50.809′S, 114°12.393′E (approximately 50 metres south of the Bundegi boat ramp); and (ii) north of a line through 22°15.739′S, 114°07.950′E and 22°15.739′S, 114°10.950′E (due east from Heron Point); and (iii) excluding the Bundegi Sanctuary Zone; and (iv) excluding the waters adjacent the Exmouth Boat Harbour bounded by a line from 21°57.476′S, 114°08.451′E (on the southern breakwater) to 21°57.519′S, 114°08.583′E (approximately 615 metres east south easterly); thence to 21°57.519′S, 114°08.583′E (approximately 60 metres northerly); thence to 21°57.495′S, 114°08.616′E (approximately 315 metres west north westerly); thence to 21°57.484′S, 114°08.632′E (approximately 30 metres north easterly on the northern breakwater). All coordinates based on GDA94.

Providing however—

(1) That all water skiing activities are prohibited in waters less than 1.5 metres in depth. Mariners are responsible to ensure minimum depths prior to undertaking any water ski activities.

(2) The direction of all water skiing activities shall be in an anti-clockwise direction and water skiing is only permitted within the daylight hours of sunrise to sunset.

4.2.2 With the exception of minor boundary realignments, the amalgamation of two lots abutting an existing corner lot will be permitted at the higher density of R30, for the purpose of development and/or re-subdivision. The amalgamation of more than two lots abutting an existing corner lot is not consistent with the intent of the provisions of the Scheme; therefore the R-Code depicted on the Scheme map shall apply to the amalgamated lot.

General description

The Minister for Planning has granted approval to the declaration of a planning control area over land to be protected for the future primary regional road reservation for the Armadale Road deviation (section between Knock Place and Solomon Road, Jandakot), as shown on Western Australian Planning Commission (WAPC) plan number 1.7415.

Purpose

The purpose of the planning control area is to—

protect the future Primary Regional Road reservation for the Armadale Road deviation from adverse development outcomes,

facilitate improved land use and transport planning within Cockburn Central; and

allow for the final road design and land requirements to be confirmed prior to a Metropolitan Region Scheme amendment being initiated.

The WAPC considers that the planning control area is required over the whole of the land to ensure that no development occurs on this land which might prejudice this purpose until it may be reserved for future primary regional road reservation in the Metropolitan Region Scheme.

Duration and effects

The declaration remains in effect for a period of five years from the date of publication of this notice in the Government Gazette or until revoked by the WAPC with approval by the Minister, whichever is the sooner.

A person shall not commence and carry out development in a planning control area without the prior approval of the WAPC. The penalty for failure to comply with this requirement is $200,000 and, in the case of a continuing offence, a further fine of $25,000 for each day during which the offence continues.

Compensation is payable in respect of land injuriously affected by this declaration, and land so affected may be acquired by the WAPC in the same circumstances and in the same manner as if the land had been reserved in the Metropolitan Region Scheme for a public purpose.
