History has proven that free people are capable of extraordinary things—but many current laws hold South Dakotans back from truly thriving. That’s why our growing network of activists across the state are fighting every day to make the Mount Rushmore State a better place to live, work, and raise a family. Policymakers are working to remove barriers that make it more difficult for South Dakotans to achieve their full potential. To advance principles related to this cause, we are using cutting edge tools and technology to educate, recruit, and mobilize citizens in support of improving the lives of all South Dakotans. With our 2019 Legislative Scorecard, we aim to enhance transparency and help involve your voice in the legislative process.

The South Dakota Plumbing Commission recently decided that property owners were not eligible to perform plumbing work on their properties without first acquiring a plumbing license. This bill fixed that interpretation and removed unnecessary red tape that required property owners to have an occupational license to perform plumbing work on their own properties.

Higher education provides a unique forum for students to freely and productively engage with a range of ideas—education that enables a thoughtful and diverse society. This bill protects these unique environments on our college campuses and protects the free speech rights of students in South Dakota.

SB 96 | EXPAND TAX CREDIT FOR EDUCATIONAL CHOICE SCHOLARSHIPSPRIME SPONSOR: Sen. Lee Schoenbeck — HOUSE PRIME: Rep. Jon Hansen — AFP’S POSITION: SUPPORT — OUTCOME: SIGNED INTO LAW

Educational freedom allows students to get the education that best meets their needs. This bill expands the South Dakota Partners in Education (PIE) tax credit scholarship program to allow the credit to apply to 100% of the contribution and allow for quarterly reporting. This helps ensure students, regardless of income or ZIP code, have access to an education that helps them learn and thrive.

HB 1265 | CLARIFIES CURRENT SALES TAX REDUCTION LANGUAGEPRIME SPONSOR: Rep. Chris Karr — AFP’S POSITION: SUPPORT — OUTCOME: DEFEATED

In a previous legislative session, South Dakota lawmakers raised the state’s sales tax from 4% to 4.5%, with a deal in place to reduce the rate by 0.1% for every $20 million received in online sales tax revenue. This bill would have clarified the requirement by including an automatic trigger if government revenue grew by a specified amount, ensuring that there will be automatic sales tax relief for South Dakotans.

Presumptive probation allows low-level offenders to rehabilitate their lives without adding to our overcrowded prison populations. This bill would have repealed that reform and erected barriers to reentry for those individuals who have already paid their debt to society.

SB 65 | ALLOW COUNTIES TO IMPOSE A TAX TO FUND LAW ENFORCEMENT FACILITIESPRIME SPONSOR: Sen. Al Novstrup — AFP’S POSITION: OPPOSED — OUTCOME: DEFEATED

South Dakotans have a big enough tax burden as it is. This bill would have given counties free reign to tax their residents to build new facilities.

SB 86 | REPEALS AND REPLACES THE SALES TAX REDUCTION WITH WEAKER LANGUAGE PRIME SPONSOR: Sen. Jeff Partridge — AFP’S POSITION: OPPOSED — OUTCOME: DEFEATED

Previous legislation regarding the increased sales tax included a deal that would automatically include a reduction of 0.1% in the sales tax for every $20 million in online sales tax revenue. This legislation would have discarded that language, removing the mechanism that guaranteed automatic tax relief for South Dakotans.
