1. General Provisions

(1) Program Duration and Graduation Requirements: Program duration and

graduation requirements for National Taiwan University, National Taiwan Normal

University, National Taiwan University of Science and Technology, National

Yunlin University of Science and Technology, National Formosa University,

National Ilan University, National Taiwan Ocean University, Chinese Culture

University, Tamkang University, Chung Yuan Christian University, and Yuan Ze

University (they will hereafter be cited within the text as "the 11 Universities"). In

addition, student requirements for admission to undergraduate programs are

equivalent to those pertaining to the second year of senior high schools in the

Republic of China or graduating students in the same level and type of school

overseas or in Hong Kong and Macau, with additional credit requirements outside

the credits required for graduation to be stipulated by each University.

(2) Application Requirements:

A. Overseas Chinese, Hong Kong and Macau students: Students who have

graduated or are graduating from senior high school who never been approved

studying in Taiwan and meet the following requirements may submit an

application for admission to the Eleven Universities.

(a) Overseas Chinese students refers to overseas Chinese who were born

abroad and have continued to live overseas until the present time, or

overseas Chinese who have lived overseas continually for the last six

years or more, and have obtained a permanent or long-term residence

permit from the foreign country of residence. However, applicants for

courses in medicine and dentistry at the university level must have a

continuous residence period of more than 8 years. The aforementioned

“overseas” refers to countries or territories aside from the Mainland

Area, Hong Kong, and Macau. Residents of Hong Kong or Macau who

have obtained permanent residence certificates for Hong Kong or

Macau and have lived overseas continually for the last six years or more

may apply to study in Taiwan. However, applicants for the study of

medicine or dentistry at the university level must fulfill eight years of

continuous residency. The aforementioned “overseas” refers to countries

(b) Applicants shall meet the requirements under the “Regulations

Regarding Study and Counseling Assistance for Overseas Chinese

Students in Taiwan” and the “Measures for Hong Kong and Macau

Residents Studying in Taiwan” Please refer to the said regulation in

Appendix 1 and Appendix 2.

B. International Degree Students: International Degree Students who meet the

following requirements are only eligible to apply for National Taiwan

University which is expected to open admission quotas at the maximum of 150

students:

(a) Nationality: An individual of foreign nationality who has never held the status of

an Overseas Chinese students on the date of application and who complied with

the "Regulations Regarding International Students Undertaking Studies in

Taiwan" (Appendix 3) of the Ministry of Education (MOE).

(b) Qualifications: International Students with a high school diploma are eligible to

apply for undergraduate programs.

(3) Application Procedures

Prior to application, schools are invited to recommend applicants for admission

to the Eleven Universities following internal review. There is no limit on the

number of applications. The responsible person at the senior high school enters

the personal data of applicants online and coordinates with the students to

upload relevant materials. When it is confirmed that there are no errors in the

uploaded materials, print out the form for personal records.

A. Application Period: From Thursday, August 1, 2019, 9am to Friday, October 4,

2019, 5pm.

C. Only online applications shall be accepted. Please first complete the online

application and upload all the relevant documents before the deadline. Hard copy

applications/documents will not be accepted.

D. Except for the photo which shall be uploaded in JPG format, it is recommended

that all the required documents shall be uploaded in PDF files. If there are any

audio or video files, please upload them to a website first and provide the web

link and password to access the files. Please upload the files individually; only

one file for each field is accepted. If applicants have multiple files for a

particular field, the applicants will need to combine them into one file first

before uploading. The merged file shall not be larger than 10MB. All the schools

shall confirm the internal review and upload the required documents for the

applicants before the deadline.

E. The School Coordinators can re-upload or update the documents any time before

confirming the submission. Once confirmed submission, revisions may not be

requested for any reason. Please go through the documents carefully before

confirming the submission.

(4) Application Notes and Regulations

A. The school representatives are responsible to recommend the candidates for

admission to the 11 Universities and carry out all the online application

procedures for them. Application by an individual candidate will not be

accepted.

B. Once the application documents confirmed submission online, any submission of

additional materials, replacement of documents or an update is not allowed

regardless of whether the application deadline has passed or not.

D. According to “Regulations Regarding Study and Counseling Assistance for

Overseas Chinese Students in Taiwan” and "Measures for Hong Kong and Macau

Residents Studying in Taiwan", a partial of personal information for each applicant

will be sent to the following units for acquiring his/her arrival-departure records in

order to have Student Eligibility Check for overseas Chinese, Hong Kong or

Macau students: “University Entrance Committee for Overseas Chinese Students”,

“Ministry of Education”, “National Immigration Agency” and “Overseas

Community Affairs Council”.

E. For Applicants who have already registered or been admitted, if following a

review by the Overseas Community Affairs Council or the Ministry of Education,

the applicant is found to not satisfy the requirements for overseas Chinese students

of Hong Kong and Macau or the regulations of the Ministry of Education’s

“International Students Undertaking Studies in Taiwan,” or if any of the submitted

documents are found to be inaccurate, forged, used under false pretenses, or

altered, or if the applicant’s academic qualifications are found to be invalid, then

the application or admission qualifications shall be revoked, the student will be

expelled from the university, or the graduate qualifications and diplomas from the

Eleven Universities will be revoked, and no proof of academic qualifications or

attainment will be issued.

(5) Required Materials and Documents

Applicants must upload the following required documents to the online

application system. If it is not Chinese or English from Item A to D, please

provide translation versions verified by the R.O.C. overseas office in the

countries of study or by a recommendation unit designated by the Overseas

Community Affairs Council, R.O.C..

A. Proof for Country of Overseas Residence: Applicants applying as overseas

Chinese students or international degree students shall submit one of the

following copies as proof of identity: a copy of their Overseas Compatriot

Identity Certificate, a copy of passport of their country of overseas residence, a

copy of their R.O.C. passport or a copy of Overseas Compatriot Identity

Endorsement in their overseas residence.

Applicants applying as Hong Kong and Macau students shall submit proof of

their permanent residence in Hong Kong or Macau. For Hong Kong and Macau

Applicants who are born in Mainland China, the copy of the profile page shown

on your Mainland Travel Permit for Hong Kong and Macau Residents is

additionally required for application.

B. School Enrollment Certificate or the Degree/Graduation Diploma:

Applicants graduating in the current year shall upload the school enrollment

certificate of the current semester stamped by the academic affairs division

of the senior high school. The graduated shall upload the senior high school

degree/graduation diploma.

Note: Admitted applicants shall have their graduation certificate verified by the

nearest R.O.C. representative office or verified by a recommendation unit

designated by the Overseas Community Affairs Council and submit the verified

graduation certificate on the registration day. Failure to do so will result in the

cancellation of the admission offer.

C. Full Transcript of Records of High School

(a) The full transcript of records shall include grades for each subject, the overall

average grade for each semester, class rank, and percentage class rank for the

fourth and fifth years of high school (or the first and second years of senior

high school) for a total of four semesters.

(b) The full transcript of records shall be issued by the school and must be

stamped by the school's Academic Affairs Division.

D. Official Transcript of National Entrance Examination or International

Baccalaureate Grade: Applicants who have participated in National Entrance

Examination or International Baccalaureate Diploma Programme (IBDP) shall

submit its official transcripts. The categories of these transcripts include the

Hong Kong Diploma of Secondary Education, the Hong Kong Advanced Level

Examination, the Hong Kong Certificate of Education Examination, the Malaysia

Unified Examination Certificate, the Malaysian Higher School Certificate

(STPM), the Malaysian Certificate of Education (SPM), SAT, A Level, and IBDP.

E. Teacher Recommendation Letters: Recommendation Letters shall be written in

Chinese or English by applicants’ teachers. Teacher recommendations should be

honest appraisals of a student's academic performance and intellectual promise,

primarily conveying the teacher's classroom experience with the student, which

can provide a university an idea of how the student is likely to perform

academically. The sample of Teacher Recommendation Letter can be

F. Personal Statement: To be written in Chinese or English only.

G. Study Plan: To be written in Chinese or English only.

H. Chinese Proficiency Certificate: It is recommended to submit the Chinese

Proficiency Certificate as a proof that you have sufficient language ability of

learning Chinese-taught programs. Certificates such as Chinese Proficiency Test

Scores, Proof of having studied Chinese courses or Self-Statement written in

Chinese shall be submitted. Applicants who can submit the Chinese Proficiency

Certificates may be for early review.

I. Photograph: A close-up color shot (or in black and white) of the head and

shoulders (no hats) within the last 6 months. Please upload in JPG format. The

dimensions should be: width of 1.5 in., height of 2 in. The photo should be in

grayscale (black and white) or high-resolution color. The image width x height

pixels should be at least 450×600 pixels. The scan resolution should be between

300 and 500 dpi.

J. Affidavit for Eligibility of Overseas Chinese Students: Please print out, sign

and upload the signed copy back to the system (Appendix 5).

K. Confirmation for Eligibility of Hong Kong and Macau Students: After

completing the confirmation, Hong Kong and Macau students should scan a copy

into a PDF format and upload it to the application system (Appendix 6).

L. Declaration and Authorization Form of International Degree Students at

National Taiwan University: Applicants who apply for international degree

programs at National Taiwan University shall fill in this form and upload the

form to the application system in PDF format (Appendix 7).

M. Other Application Materials: Other materials that may be beneficial for review,

including competition prizes, community involvement, acting as a student leader,

or admission to other outstanding universities. If the materials are not Chinese or

English, please provide translation versions and stamped by the school's

Academic Affairs Division.

recommendation code and password (The default password will be the student’s

date of birth (YYYYMMDD)). After logging in, students should select payment,

which will bring up the payment page. To confirm that the payment has been

C. Application fees are not refundable in any circumstances, including incomplete

applications, withdrawal of application, unmet eligibility criteria, erroneous

payments, or repeat payments.

D. Failure to pay application fees will render the application invalid.

(7) Release of Results

A. Provisional announcement of admitted and waitlisted students: From

Tuesday, November 26, 2019, 12pm after the Ministry of Education and the

Overseas Community Affairs Council have approved the qualifications of

Hong Kong and Macau students and overseas Chinese students, the list of

admitted students will be announced. The expected date of announcement is

Thursday, January 23, 2020.

B. Method of Announcement: Published on the National Taiwan University website.

C. Students should check results following their release to enable provisionally

admitted (or waitlisted) students to complete online registration on time. Students

who do not complete registration on time may not request remedial action based

on the fact that they did not receive a notification letter or a notice.

(8) Online Registration

A. Provisionally admitted or waitlisted students should complete online

registration between 12pm on Tuesday, November 26, 2019 and 12pm on

Tuesday, December 3, 2019. Please log in at the following website address to

indicate whether you are willing to accept the admissions offer or register for

B. If provisionally admitted or waitlisted students fail to register according to the

appropriate regulations or register late, the provisional admission qualifications

of admitted students shall be revoked and waitlisted students shall be removed

from the waitlist. Subsequently, make-up registrations shall not be allowed for

any reason.

C. All students provisionally admitted and waitlisted under this Paragraph have a

specified department for admission. According to the results of the admission, if

students with provisional admission surrender their place prior to the conclusion

of the period for waitlist substitutions, they should be substituted by waitlisted

students according to the rules established by each university for the admission of

waitlisted students to departments. However, in the case of National Taiwan

University of Science and Technology, if provisionally admitted students

surrender their admissions qualifications, they should be substituted in order by

the waitlisted students that can be provisionally admitted to the particular

D. The period for the notification of provisional admission of waitlisted students

following substitution lasts until 5pm on Friday, December 6, 2019. After the

end of this period, there will be no further substitution of places by waitlisted

students.

E. Following the registration of provisionally admitted or the admission of

provisionally waitlisted students, it is not possible to participate in admission

by placement organized by the academic year by the University Entrance

Committee for Overseas Chinese Students.

(9) Regulations for Arrival in Taiwan and Enrollment

A. Foreign passport holders should prepare the following documents to apply to the

Republic of China overseas mission for a Residence Visa, and then to the

National Immigration Agency of the Ministry of Interior in the place of residence

within fifteen days of entry for an Alien Resident Certificate: a passport (with at

least six months’ validity), two 2-inch color full-face photos taken within the last

six months, visa application form (please visit the website of the Bureau of

Consular Affairs at the Ministry of Foreign Affairs: http://www.boca.gov.tw.

Select Visa/On-line application forms/General Visa Application, complete all of

the information required and then download the form to print and sign), the

Admission by Placement Notification, Enrollment Approval, a health

examination certificate provided by a qualified foreign hospital accredited by the

Centers for Disease Control of the Ministry of Health and Welfare or Republic of

China overseas mission in the foreign country of residence (for items to be

examined, please refer to the website of the Centers for Disease Control, Ministry

of Health and Welfare: http://www.cdc.gov.tw/. Select Health Topics/Alien

Workers Health/Items Required for Health Certificate for Residence in Taiwan),

and other relevant documents required by the Republic of China overseas

mission.

B. Overseas citizens without household registration in Taiwan who wish to apply for

residence in Taiwan should gather the following documents in the foreign

country of residence:

a. Application form (one photo should be submitted in the same format as the

National Identification Card).

b. Proof of identity in the foreign country of residence or place of residence.

c. A passport of the Republic of China or other documents demonstrating

possession of Republic of China nationality.

d. A national police record certificate for the foreign country of residence or

place of residence (applicants under 20 years old are exempt).

e. Health examination certificate within the past three months provided by a

qualified foreign hospital accredited by the Centers for Disease Control of the

f. Applicants born in the Mainland Area should attach a certificate authenticated

by the Straits Exchange Foundation confirming that the applicant does not

have household registration in the Mainland Area and does not hold a passport

issued by the Mainland Area.

g. If another person is acting as an agent, a power of attorney should be attached.

h. If the applicant is a minor, the written consent of both parents should be

attached. If the applicant’s parents are divorced, the written consent of the

parent with custody rights or obligations should be attached.

i. Applicants who are lawfully present in the country (who entered on an R.O.C.

passport) should attach an entry permit.

j. For other relevant supporting documents, please refer to the website of National

Immigration Agency of the Ministry of the Interior:

Apply to the Republic of China overseas mission for approval from the National

Immigration Agency of the Ministry of the Interior (“National Immigration

Agency” hereinafter) for a single-entry permit and copy of resident certificate for

Taiwan, and within fifteen days following entry into the country, take the copy of

the Taiwan resident certificate to the National Immigration Agency to replace it

with an Alien Resident Certificate. Individuals who have already entered the

country (territory) should prepare all of the necessary documents above as well as

the proof of entry permit, and apply to the National Immigration Agency for an

Alien Resident Certificate. However, for persons under the age of 14, the Alien

Resident Certificate may be collected by a legal agent or registered post.

C. For individuals who originally held household registration in Taiwan, and have

applied to move-out from their registered household, but have not surrendered

their Republic of China nationality or identity status in Taiwan, and use a

Republic of China passport or Entry Permit for entry, apply to the Household

Registration Office of the original place of household registration to move-in

their registration if they are living at their original place of household registration,

or apply to the Household Registration Office nearest their place of residence to

move-in their registration if they are not living at their original place of

household registration.

If the individual desires to create a separate household registration when moving

in, the house tax statement for the most recent period, proof of house ownership,

and other relevant documents should be provided. If the individual desires to

move into another household, the Household Certificate for that household, the

original National Identification Card, the Household Certificate, a photograph

taken within the last two years that satisfies regulations (for photograph

regulations for the new type of National Identification Card, refer to the website

of the Department of Household Registration, Ministry of the Interior:

http://www.ris.gov.tw), and a stamp (or signature) should be provided to the

Household Registration Office nearest the original place of household registration

or the current place of residence to complete move-in registration and collect the

new type of National Identification Card.

D. Students from Hong Kong and Macau can apply Entry Permit through Online

Application of National Immigration Agency. Once the permit issued, the

students can print out the document as entry permit when entering Taiwan. Please

note that students must carry the hardcopy of NTU Admission Letter upon

enrollment day, and NTU Admission Letter will be an important document when

applying for Alien Residence Certificate during your study in Taiwan. Please

Each school uses its own selection process to recommend graduating

or already graduated students. Schools are not limited on the number

of students that they recommend. Each student may select two

choices.

The recommending schools should endeavor to provide evidence of

the qualities of the students and submit the teacher’s recommendation

letter. The responsible person at the senior high school of the

recommended student should upload documents to the application

system for review prior to the deadline, including the certificate of

Academic Affairs Division for registration and aggregation:

When the quota for the number of admissions has been reached, the

review team will determine the order of admitted and waitlisted

students. In principle, first preference applicants are given priority.

new students to review. Admitted students should attend the University in

person on the enrollment date to complete enrollment according to the

regulations. Students who fail to complete enrollment on time will not be

b. Identity verification at registration (to be returned following registration):

(a) Examination of original identity documents (identity card or passport) or

original Republic of China passport and Overseas Chinese Identity

Certificate.

(b) Submit original senior high school academic degree/graduation diploma

and original senior high school transcripts authenticated by the Republic

of China overseas mission or units designated by the Overseas

Community Affairs Council.

c. Students admitted to undergraduate programs from schools overseas or in

Hong Kong and Macau at the equivalent level to the second year of Senior

High School in the Republic of China should take an extra 12 credits to

graduate from the department.

d. Admission does not guarantee that a visa will be granted, and visa applications

must be approved by the Republic of China overseas mission.

e. Prior to enrollment, new undergraduate students at the University are required

to undergo a general physical examination. The items for examination and

timing will be determined by the Health Center. The notification for the health

examination will also be announced on the National Taiwan University New

Students and Transfer Students Network prior to the end of June 2020 for new

students to review.

f. In Article 48 of the National Taiwan University Academic Regulations,

“Students enrolled at the University from the 2013 academic year who are

enrolled in two or more undergraduate programs at the same time”

should be expelled from the University. Students must ensure that they do

not violate this rule.

g. If it is discovered that admitted students do not meet the requirements for

enrollment, or that submitted documents or certificates (including degree

certificates, transcripts, extracurricular activities, or other relevant certificates)

are forged, falsified, used under false pretenses, used fraudulently, inaccurate,

or altered, the University shall revoke the eligibility for admission or expel

students who are already enrolled. Students shall be liable for legal

consequences, and no proof of studies shall be issued. If this is discovered

after the student has graduated from the University, aside from repealing the

student's graduation certificate, an announcement shall be made revoking the

student’s legibility for graduation. Following enrollment, if departments have

requirements for taking certain courses, students should select courses

according to these regulations.

h. To select courses, students shall follow program requirements under NTU

Regulations after enrolling to NTU.

i. If it is believed that this entrance examination as conducted by the University

has harmed the rights of students, a written complaint must be submitted to the

University’s Admissions Committee within thirty days of the release of the

results. The Admissions Committee should provide a formal response within

one month of receipt of the complaint, and where necessary should form an ad

hoc working group for impartial investigation. If students are dissatisfied with

the outcome of the appeal to the Admissions Committee, they may seek an

administrative remedy in accordance with the law.

j. Issues not covered by the Guide will be handled according to relevant

University regulations or by a decision of the Admissions Committee.

D. Tuition Fees and Dormitory Accommodation

a. Tuition Fees: After the credit fees and tuition fees for the University for the

2020 academic year have received approval from the Ministry of Education,

they shall be posted on the University’s Tuition Fees website. The credit fees

and tuition fees for the 2019 academic year are shown on the following

b. Dormitory Accommodation: For undergraduate student dormitories, the

University only offers four-person rooms, with fees of around

NT$7,900–10,300 per semester (each academic year has two semesters).

C. Enrollment and Other Matters

d. After enrollment, students should meet the graduation qualifications according

to the criteria set by the faculties and degree programs.

e. If admitted students are not found to be eligible, or their submitted documents

or certificates (including degree certificates, transcripts, extracurricular

activities, or any relevant certificates) are found to be untruthful, the

University shall revoke the eligibility for admission or expel students who are

C. Registration for Enrollment and Other Matters

a. In July 2020, the University will issue guidance for the enrollment of new

students. Students should attend the University to complete enrollment

procedures according to the set dates and relevant regulations.

b. At enrollment, the student's original passport (or National Identification Card),

original senior high school academic degree/graduation diploma, and original

senior high school transcripts authenticated by the Republic of China overseas

mission or units designated by the Overseas Community Affairs Council

should be inspected.

must be approved by the Republic of China overseas mission.

d. If admitted students are found to have submitted forged, fraudulent, or falsified

authenticated by the Republic of China overseas mission or verified by

units designated by the Overseas Community Affairs Council, as well as

d. If it is discovered that admitted students do not meet the requirements for

enrollment, or that the submitted documents are forged, fraudulent, or altered, the

admission status will be revoked. Students who have already enrolled shall have

g. Following enrollment, students should take courses according to each

department’s requirements, pass foreign language proficiency tests, or meet

other requirements in order to be qualified for graduation.

h. If it is discovered that admitted students do not meet the requirements for

enrollment, or that submitted documents or certificates (including degree

certificates, transcripts, extracurricular activities, or other relevant certificates)

are forged, falsified, used under false pretenses, used fraudulently, inaccurate, or

altered, the University shall revoke the eligibility for admission or expel

students who are already enrolled. Students shall be liable for all legal

consequences, and no proof of studies shall be issued. If this is discovered after

the student has graduated from the University, aside from repealing the student's

graduation certificate, an announcement shall be made revoking the student’s

legibility for graduation.

taught in the evenings or on weekends.

e. After enrollment, admitted students should follow the related regulations of the

Ministry of Education and the University’s Academic Regulations for study and

student status.

Visa applications should be made according to the regulations of the Republic

of China Overseas Mission.

g. Following approval for admission, during the enrollment procedures, new

C. Measures for Admissions Disputes

If candidates have concerns about the admissions process, they should make a

written complaint stating the facts and reasons within 15 days from the receipt of

notification, attaching relevant documents and evidence. Complaints will not be

accepted if they are not submitted within this time period. The Admissions

Committee shall formally reply within one month after receiving the complaint.

When necessary, an ad hoc group should be formed to investigate and handle the

case fairly and inform the complainant of administrative remedy procedures. The

procedures for handling disputes concerning student admissions should follow the

Appendix 1: Regulations Regarding Study and Counseling Assistance for Overseas Chinese

Students in Taiwan

Article 1

These Regulations have been formulated in accordance with the provisions of Paragraph 3

of Article 25 of the University Act, Paragraph 1 of Article 32 of the Junior College Law,

Paragraph 1 of Article 41 of the Senior High School Education Act, and Paragraph 3 of

Article 6 of the Primary and Junior High School Act.

Article 2

In these Regulations, the term "overseas Chinese student" refers to a student of Chinese

descent who has come to Taiwan to study, who was born and lived overseas until the

present time, or who has been living overseas for six or more consecutive years in the

immediate past and obtained permanent or long-term residency status overseas. Please note

that a minimum of eight consecutive years of overseas residency is required if the person is

applying to study in a university department of medicine, dentistry, or Chinese medicine in

Taiwan.

A person’s overseas Chinese student status must be validated by the Overseas Compatriots

Affairs Commission (OCAC).

An overseas Chinese student who received assistance applying to study in Taiwan

who studied for less than one year and then returned to their country of residence because

they discontinued their studies for some reason or forfeited their student status may lodge

another application to return to Taiwan to study, but only one such re-application is

permitted.However, if an educational institution in Taiwan where an overseas Chinese

student was studying considers their academic performance or conduct was

unsatisfactory, or if the student seriously violated its regulations or was sentenced in

criminal case proceedings, and therefore in accordance with the provisions of the

regulations governing student awards and penaltieshad to discontinue their studies or

forfeited their status as a registered student, the student is not permitted to re-apply to study

in Taiwan.

An overseas Chinese student is not permitted to change their status of being an overseas

Chinese student while they are studying in Taiwan, unless permitted to do under the

provisions of some other ordinance.

Article 3

The term "overseas” used in Paragraph 1 of the previous article refers to countries or

regions other than Taiwan, mainland China, Macau, and Hong Kong.

The consecutive years of overseas residency referred to in Paragraph 1 of the previous

article means calendar years in each of which an overseas Chinese student has not spent

more than 120 days in Taiwan. When calculating the number of consecutive years spent

overseas, if the initial or final year of the period is not a complete calendar year, any time

spent in Taiwan in the initial or final year must not exceed 120 days. However, time that a

person has spent in Taiwan is not subject to this restriction and is not counted when

calculating how long they were in Taiwan in a particular year if in that period of time the

overseas Chinese student has:

1. attended an overseas youth technical training course conducted by the OCAC or a

technical professional training program accredited by the central competent education

administration authority;

2. attended an activity held by the OCAC or by a government agency and recognized by the

OCAC, or taken a Chinese language course provided by a Chinese language education

institute which has been approved by the governing authority to recruit students overseas,

and has spent a total period of less than two years undertaking such activities or courses;

3. spent a total period of less than two years in Taiwan as an exchange student;

4. spent a total period of less than two years undertaking an internship that they came to

Taiwan to undertake with the approval of the designated central competent authority;

5. returned to Taiwan to do military service and has been enlisted and served;

6. stayed in Taiwan because they were unable to return to their country of residence because

of war, some natural disaster, or a major outbreak of some infectious disease; or

7. stayed in Taiwan because they were unable to return to their country of residence because

of some other matter that the student was not responsible for and they have documentary

evidence of this.

Documentary evidence of the having obtained permanent or long-term residency status

overseas referred to in the first paragraph of the previous article may include proof of

having citizenship or permanent residency in the applicant’s country of residence, or having

a Republic of China passport which officially records the person’s overseas Chinese status.

Article 4

The standard way to calculate the period of continuous residency overseas referred to in

Paragraph 1 of Article 2 is to calculate from the final date that overseas students can apply

in the current year designated in the admission guidelines for overseas students. This does

not apply, however, to applicants whose period of continuous residency overseas must be

calculated using August 31 of the year of the application to meet the requirements set out in

Article 2 and Article 3.

An overseas Chinese student who makes an application to study in Taiwan, in accordance

with the proviso set out in the previous paragraph shall complete and submit a written

declaration regarding their overseas residency before their application may then be

processed. After they have been allocated a place at an educational institution in Taiwan in

the OCAC shall review their actual residency circumstances in the period between the final

date for enrollment and August 31 of the same year. If the period spent overseas does not

satisfy the provisions of Article 2 and Article 3, then the student shall have their enrollment

eligibility revoked.

If an overseas Chinese student who independently returned to Taiwan makes an application

in accordance with the provisions of Paragraph 1 of Article 9, the length of

continuous residency overseas referred to in Paragraph 1 of Article 2 is calculated from the

date of their most recent arrival in Taiwan. People who independently undertook studying in

Taiwan and are applying for assistance with procedures to arrange an admission in

accordance with Paragraph 5 of Article 9, the period of overseas residency is calculated

from the date of their most recent arrival in Taiwan since beginning their independently

arranged study.

Article 5

Overseas Chinese students may apply to come to Taiwan to study at educational institutions

at all levels in accordance with these Regulations, and they may apply to study, or

independentlytransfer into or advance to a professional degree program offered by a

domestic university in collaboration with a foreign university, that has been approved on a

case by case basis by the central competent education administrative authority, and for

which the universities have specific administrative mechanisms in place. They may not,

however, apply to study any recurrent or continuing education bachelor’s degree program or

in-service master’s degree program at any cram school, college (institute) of continuing

education, or in distance learning mode at any university, college, or junior college, or any

other program which is only taught in the evening or during vacations.

Overseas Chinese students who have already obtained legal resident status in Taiwan for

non-study related purposes are not subject to the restriction set out in the proviso in

the previous paragraph.

Overseas Chinese students who are in breach of the proviso in Paragraph 1 shall have their

registration as a current student cancelled and not be awarded any certification whatsoever

regarding their related academic undertakings. If such a breach is discovered after

graduation, the educational institution shall revoke the former student’s eligibility to

graduate and shall require any degree already awarded to be returned and shall rescind it.

The educational institutions referred to in the proviso in Paragraph 1 shall state clearly in

their student admission guidelines that overseas Chinese students are not permitted to enroll.

Article 6

Overseas Chinese students shall submit the forms and documents listed below to apply to

study in Taiwan to a Republic of China overseas mission, an office designated by the

OCAC, or to a university authorized to independently recruit overseas Chinese students,

during the annual recruitment period:

1. Student application form.

2. Academic credentials and transcripts:

(1) Academic credentials issued by a foreign educational institution: Proof of the highest

level of education at an overseas educational institution or documentary evidence of

having equivalent academic ability and transcripts (documents in languages other than

Chinese or English shall have a Chinese or English translation attached) shall be

authenticated by an overseas mission or an office designated by the OCAC. However,

academic credentials issued by a campus or branch of a foreign educational institution it

has established in the Mainland Area shall be notarized by a notary public there and

authenticated by an authority established or designated by the Executive Yuan, or by a

private organization commissioned by the Executive Yuan.

(2) Academic credentials from the Mainland Area: shall be handled in accordance with the

provisions of the Regulations Regarding the Assessment and Recognition of Academic

Credentials for Mainland Area.

(3) Academic credentials from Hong Kong SAR and Macau: shall be handled in accordance

with the provisions of the Regulations Governing the Examination and Recognition of

Educational Qualifications from Hong Kong and Macau.

(4) Academic credentials issued by Overseas Taiwan Schools and schools for Taiwan

business people in the Mainland Area are equivalent to academic credentials issued by an

educational institution of the same-level in Taiwan.

3. Documentary evidence of permanent or long-term residency overseas.

4. Statement of purpose. This is not required for applications to universities authorized to

independently recruit overseas Chinese students.

5. Any other documents which are required by the educational institution that is being

applied to.

The academic credentials and transcript referred to in Subparagraph 2 above are not

required for an application for admission to the first semester of the first-grade at an

elementary school.

Application documents submitted for an overseas Chinese student to study at an elementary

school, a junior high school, senior secondary school, or junior college shall include a

document of agreement to being the student’s guardian in Taiwan, notarized by a notary

public in Taiwan, as well as the documents listed in each subparagraph of Paragraph 1. This

is not required, however, for an applicant who has reached their age of majority or if an

exemption has been approved by the OCAC.

The guardian in Taiwan referred to in the previous paragraph shall possess a valid Republic

of China passport, and submit a criminal clearance certificate issued by the police

authority, and an income tax inventory for the most recent year checked and issued by a

taxation organization itemizing personal taxable income from all sources of at least $500,

000 NTD. A person is restricted to being the guardian of one overseas Chinese student only.

An overseas Chinese student who submits any certificate or document that is found to be

counterfeit, or contain false or misleading information, or that has been altered in some way

shall have their enrollment eligibility revoked. If the student has already registered and

begun classes, their registration as a current student shall be cancelled and they will not be

awarded any certification whatsoever regarding their related academic undertakings. If any

such forgery is first discovered after a student has already graduated, the educational

institution shall revoke the former student’s eligibility to graduate and shall require any

degree already awarded to be returned and shall rescind it.

Article 6-1

Universities which independently recruit and admit overseas Chinese student to their

institution to study at each program year level shall draw up their own admission regulations,

submit these to the central competent education administrative authority for approval, and

then formulate a set of admission guidelines for overseas Chinese students that outline

details of the programs that may admit them, the maximum length of time in which each

program must be completed, the admission quotas, application eligibility requirements,

reviewing and screening methods, and any other related regulations.

Universities which establish programs exclusively for overseas Chinese students as part of

an international academic cooperation program or to meet some other special need shall

apply to the central competent education administrative authority for appraisal and

ratification of such programs in accordance with the Standards for Student Admission

Quotas and Resources at Institutions of Higher Education.

Article 7

In accordance with the provisions of Paragraph 1 of Article 6, overseas offices are

responsible for initially handling overseas Chinese students’ applications to study in Taiwan

and after verifying an applicant’s identity and checking all the forms and documentation

submitted shall immediately forward the documents to the OCAC for assessment.

In accordance with Paragraph 1 of Article 6, offices designated by the OCAC that initially

handle an overseas Chinese student’s applications to study in Taiwan after verifying an

applicant’s identity and checking all the forms and documentation submitted shall

immediately forward the documents to an overseas mission to check and forward them to

the OCAC for assessment.

The OCAC shall examine the application form(s) and documents and add comments, then

send the application documents to the appropriate authority among those listed below to

undertake further checking and ratification and assign the student a place in an educational

institution:

1. For applications to public elementary schools: documents are sent to the local competent

education administrative authority.

2. For applications to public junior high schools, senior secondary schools, or junior

colleges: the documents are sent to the central competent education administrative

authority. However,students applying to study a general course at a public senior

secondary school are restricted to attending the National Overseas Chinese Senior High

School (NOCSH).

3. For applications to universities (including graduate schools) or the Division of

Preparatory Programs for Overseas Chinese Students at National Taiwan Normal

University (abbreviated below to “NTNU Division of Preparatory Programs for Overseas

Chinese Students”) apart from those governed by the provisions of Paragraph 5: the

documents are sent to the University Entrance Committee For Overseas Chinese Students

to handle.

The University Entrance Committee for Overseas Chinese Students referred to in

Subparagraph 3 of the previous paragraph refers to the committee jointly formed by all

universities and colleges in Taiwan to handle the recruitment and placement of overseas

Chinese students.

Any university that handles an application from an overseas Chinese student to study in

Taiwan in accordance with Paragraph 1 of Article 6 shall examine and verify the form(s)

and documents and then immediately forward them to the OCAC to verify the applicant’s

overseas Chinese student status. Applicants with a valid overseas Chinese student status

who pass the review or screening process of the respective university or tertiary college will

be issued an admission notice by the university or tertiary college.

If any doubt or concern arises regarding an office designated by the OCAC when the

university referred to in the previous paragraph is handling and examining an application

from an overseas Chinese student, the university may ask the OCAC to assist by

investigating to ascertain the situation.

Article 8

When the central competent education administrative authority or the University Entrance

Committee for Overseas Chinese Students receives overseas Chinese students study

application forms and documents forwarded from the OCAC, it shall check the documents

and assign students a place in an educational institution for which the applicant has the

academic credentials, in accordance with their aspirations, results, and the number of places

available at each educational institution, and shall notify the educational institution and the

OCAC. The applicants will be notified of the results by the OCAC. However, if a university

admission (including to a graduate program) is being handled by the University Entrance

Committee For Overseas Chinese Students the applicant shall first apply to the university to

be admitted. The university will review and approve their application, after which the

University Entrance Committee For Overseas Chinese Students will then review their

application and allocate them a place.

If the number of applications from a particular overseas country or region exceeds the set

quota a selection procession may be held to select the best students for admission.

If it is considered essential, an additional skills technique examination may be conducted by

the educational institutions for applicants assigned to a department of music, arts, physical

education, or other discipline that requires technical skills. An applicant who does not pass

such an additional skills technique examination will be assigned to another educational

institution or department by the central competent education administrative authority or by

the University Entrance Committee for Overseas Chinese Students.

Article 9

A student in any of the categories listed immediately below, who satisfies the provisions of

Articles 2 and 3, and who returned to Taiwan independently and plans to enroll in

an elementary school, junior high school, senior secondary school, or junior college may

apply to the OCAC within 90 days from the day after they arrive in Taiwan and submit all

the documents specified in the subparagraphs of Paragraph 1 of Article 6. The OCAC will

examine the documents then forward their application to the appropriate competent

education administrative authority which will check and ratify the documents and assign the

student a place in an educational institution in light of their actual circumstances and assign

them to an educational institution to be admitted to. The proof of their highest level of

education at any overseas educational institution shall be authenticated by an overseas office.

However, students applying to undertake ageneral course at a public senior secondary

school are restricted to attending the NOCSH:

1. A student who has legal residence status in Taiwan.

2. A student who has permitted to enter the country with a visa for a limited period and has

stayed for 60 days or more, and their visa does not bear a visa issuing agency remark

indicatingthat the visa cannot be extended or is subject to some other restriction.

A person who has a visa for a limited period stay and has been in Taiwan less than 60

days, or who has a visa which bears a visa issuing agency remark indicating that the

visa cannot be extended or is subject to some other restriction, and was permitted to enter

the country may apply to the Bureau of Consular Affairs of the Ministry of Foreign Affairs

or one of its subsidiaryoffices in Taiwan before their current visa expires to have it

changed into a visa for a stay of 60 days or more that does not bear a remark indicating that

the visa cannot be extended or is subject to some other restriction, on the basis of

documentary evidence of their overseas Chinese student status issued by the OCAC and on

study being their reason for wanting to stay in Taiwan, after which they may apply to be

assigned and admitted to an educational institution in accordance with the provisions of the

preceding paragraph.

The competent authority referred to in Paragraph 1 that checks and ratifies documents and

assigns students a place in an educational institution shall do so, mutatis mutandis, in

accordance with the provisions of Subparagraphs 1 and 2 of Paragraph 3 of Article 7.

If a student makes an application in accordance with the provisions of Paragraph 1 when it

is already more than one-third of the way into a semester, the educational institution being

applied to may give them a ‘provisional’ admission status and assign them to an appropriate

grade level. This ‘provisional’ status is valid for up to one year, and their student

registration shall be confirmed if they pass the examinations. If, however, a student is

applying more than one-third of the way into a semester to attend a vocational high

school, a vocational division of a general senior high school, a vocational

program at a comprehensive senior high school, or a junior college they shall be assigned

to an educational institution to begin their studies in the nextacademic year.

An overseas Chinese student who satisfies the requirements set out in Articles 2 and

3 and independently enrolls in an educational institution within 90 days from the day after

they arrive in Taiwan may go to apply to the OCAC and apply for assistance to undertake

the procedures to be formally assigned there (i.e. with overseas Chinese status) and they will

be assigned to the year of the program into which they independently enrolled on their

return to Taiwan.

Overseas Chinese students who were assigned to a junior high school by the

central competent education administrative authority may apply during their junior high

school graduation year for a place in a senior secondary school, or a five-year program at a

junior college. However, students applying to undertake a public senior secondary

school general course are restricted to attending the NOCSH.

The preferential treatment when taking an examination to advance to the next level of

education referred to in Paragraph 1 of Article 10 does not apply to the applications referred

to in the previous paragraph.

Students who are applying to attend a private educational institution in accordance with the

provisions of Paragraph 1 and Paragraph 6 shall first obtain a letter of agreement from the

educational institution.

Article 10

In the year that they graduate, overseas Chinese students studying in Taiwan at an

educational institution at junior high school level or higher in accordance with the

provisions of Article 6 or of the previous article will be given preferential treatment when

they are entering the next level of their education that year, in accordance with the

provisions below. The admission quota for these students is in addition to and does not

affect the admission quotas already approved for the respective educational institutions,

departments, or sections by the competent education administrative authority at each level:

1. For senior secondary schools, or five-year programs at a junior college:

(1) Students applying for non exam-based admission shall have 25 % added to their total

accumulated score to be used for over-quota comparison and ranking procedures.

(2) Students applying for admission through a selection procedure shall have 25% added to

their score.

2. 4-year or two-year programs at an institute of technology or two-year programs at junior

colleges:

(1) Students applying for admission by registering to be assigned a place shall have 25 %

added to their score. Applicants whose scores are below the minimum required to enroll

in a 4-year program in any department of an institute of technology may attend the NTNU

Division of Preparatory Programs for Overseas Chinese Students which prescribes its

admission standards.

(2) Each educational institution shall exercise its own discretion regarding preferential

treatment for overseas Chinese students applying for admission through avenues other

than registration and being assigned there.

3. Universities:

(1) Students applying for admission by examination shall have their examination results

increased by 25 %. Those with scores below the minimum required for admission to a

particular department may enroll in the NTNU Division of Preparatory Programs for

Overseas Chinese Students. The admission standards shall be stipulated by the NTNU

Division of Preparatory Programs for Overseas Chinese Students.

(2) Each university shall exercise its own discretion regarding preferential treatment for

overseas Chinese students who apply for admission through avenues other than taking an

examination and then being assigned there.

Ranking for over-quota places is undertaken after the preferential increasing of the total

score referred to in Item 1 in Subparagraph 1 of the previous paragraph; the scores obtained

after preferential increases are made in accordance with Item 2 of Subparagraph 1,

Subparagraph 2, or Subparagraph 3 shall satisfy the admission requirements to be ranked.

The over-quota admission places referred to in Paragraph 1 is an additional two percent of

the approved admission quota. When this is being calculated, any fraction shall be

unconditionally rounded up to the next integer. If, however, two or more applicants have the

same score after preferentially increasing their total score or the accumulated score or other

ranking measures, then the number of over-quota admission places is not subject to the two

percent limit.

Overseas Chinese students can only receive the preferential treatment referred

to in Paragraph 1 available when they are entering the next level of their education once

and in their graduation year. They will not be given preferential treatment for examinations

into any subsequent study program.

Article 11

The actual number of places available for overseas Chinese students to be admitted to an

educational institution of any level in accordance with the provisions of Article 6, Article 9,

the previous article, and/or Article 14, shall be governed by the following provisions.

1. Admissions to universities and 2-year junior college programs: in principle, the actual

number of places available for overseas Chinese students shall be limited to an additional

ten percent above the institution’s admission quota approved for that academic year. A

university or junior college applying to recruit more than an additional ten percent shall

submit a report of the planned increment (including associated quality control strategy and

supportive measures) to the central competent education administrative authority for

approval.

2. Five-year junior college programs and schools at senior secondary level and below: may

admit up to an additional ten percent above the institution’s admission quota approved for

that academic year.

The quota restrictions for admission of overseas Chinese students stipulated in the previous

paragraph do not apply to educational institutions which have been approved on a case by

case basis by the central competent education administrative authority that primarily admit

overseas Chinese students, and do not apply to professional degree programs offered by a

domestic university in collaboration with a foreign university that have been approved by

the central competent education administrative authority on a case by case basis.

Universities and tertiary colleges may admit overseas Chinese students to partly or fully

take up any places at their institution available to local students within the approved

admission quota for that academic year which remain vacant.

Article 12

An overseas Chinese student may apply to the authority that assigned them to a particular

educational institution to be re-assigned to another before they register and begin their

studies.Only one such change is permitted. Applicants originally assigned to a university are

restricted to being re-assigned to the NTNU Division of Preparatory Programs for Overseas

Chinese Students. Applicants originally assigned to a five-year program at a junior

college or to a senior secondary school are restricted to being re-assigned to the National

Overseas Chinese Senior High School (NOCHS).

An overseas Chinese student who received assistance to be assigned to an educational

institution to study in Taiwan will not be given preferential treatment if they undertake an

examination to transfer to another. If a student finds that the course is different from their

original expectations or they have difficulty adapting to the study demands, the educational

institution where they were first enrolled will do its best to help the student transfer to

another department or section.

Article 13

The NTNU Division of Preparatory Programs for Overseas Chinese Students shall submit a

list of the names of each overseas Chinese student who has completed a preparatory

program there with satisfactory results, their final results, their university study application

forms, their university (department) preference list, and any other documents required by

any university to which they are applying to the University Entrance Committee for

Overseas Chinese Students which will determine which university each student will be

assigned to.

Article 14

An overseas Chinese student who has been awarded a bachelor’s degree or higher degree

from a university in Taiwan who may apply for a graduate program at master’s degree level

or higher by submitting their graduation certificate(s) from the university in Taiwan or other

documentation required to qualify them to take an entrance exam, transcripts for each year

of their previous studies, student application form(s), a statement of purpose, and any other

documents specified by the graduate school to which they are applying to the University

Entrance Committee for Overseas Chinese Students during the annual recruitment period.

The University Entrance Committee for Overseas Chinese Students shall forward the

application to the graduate school to which the applicant would like to be admitted for its

review and approval and if approval is given then formally assign the applicant a place

there.

A student who has been assigned a place in accordance with the previous paragraph and has

registered for admission is not permitted to then file an application for another program at

an equivalent level in accordance with the provisions of the previous paragraph.

An overseas Chinese student who independently applies to take the entrance exam to be

admitted to a graduate school shall be dealt with in accordance with the admission standards

that apply to local students in Taiwan.

Article 15

After being approved and given a place at an educational institution, an overseas Chinese

student shall register at the educational institution before classes for the academic year

begin. The OCAC will plan and arrange the reception of overseas Chinese students and their

accommodation.

Article 16

The study-related fees that overseas Chinese students shall be charged are set out below;

other costs during their time studying are also each student’s responsibility.

1. Students at elementary or junior high school: The school they are attending shall charge

overseas Chinese students the same standard tuition and fees that it charges domestic

students.

2. Students at senior secondary school: The school they are attending shall charge overseas

Chinese students the same standard tuition and fees that it charges domestic students. This

does not, however, apply to any student whose tuition and fees are waived in accordance

with the provisions of Article 56 of the Senior High School Education Act.

3. Students undertaking the first three years of a five-year program at a junior college: The

college or division they are attending shall charge overseas Chinese students the same

standard tuition and fees that it charges domestic students. This does not, however, apply

to any student whose tuition and fees are waived in accordance in accordance with the

Article 44 of the Junior College Law.

4. Students undertaking the last two years of a five-year program at a junior college, or

undertaking a two-year program at a junior college, or any university program: The

college or division they are attending shall charge overseas Chinese students the same

standard tuition and fees that it charges domestic students

In principle, an overseas Chinese student will be housed in an on-campus student dormitory.

If the educational institution the student will attend does not provide dormitory

accommodation, or if there are no dormitory vacancies available, the educational institution

and the student’s guardian in Taiwan shall help to resolve their accommodation needs.

Article 17

Each educational institution shall formulate a plan for implementing counseling and

remedial classes for its overseas Chinese students, and a budget itemizing associated cost

allocations, and submit these to the competent education administrative authority by January

31 each year for review and approval.

Each educational institution shall submit a report of the counseling and remedial classes

implemented over the whole year and the associated income and expenditure to the

competent education administrative authority by December 31 each year for review and

approval.

Article 18

Each educational institution shall regularly hold orientation lectures for newly enrolled

overseas Chinese students; and provide specific counselling and guidance; guidance

regarding transferring to another department (section); academic assistance; and remedial

classes, lectures, or training during the winter or summer recess; and extra-curricular

activities for the overseas Chinese students.

Each educational institution shall provide programs providing academic assistance in the

subject area concerned to any overseas Chinese student whose proficiency in Mandarin

Chinese or some other basic academic subject is relatively low.

An overseas Chinese student who has enrolled in a university and then has difficulties

adjusting to their studies may undertake a deferral of their studies there before registration

for the second semester of the same academic year begins. The college or university will

apply for the student to transfer to the NTNU Division of Preparatory Programs for

Overseas Chinese for study counseling and guidance, if the student has received counseling

from the college or university and agrees to this arrangement. The costs payable for the

period spent receiving guidance shall be governed by the fee standards set by the

NTNU Division of Preparatory Programs for Overseas Chinese. After completing this study

counseling and guidance, the student shall return to their original college or university and

resume their studies. Any courses taken during the period away are not permitted to be

counted toward or waived against the credits required for graduation.

Article 19

The approval and issuing of bursaries for financially disadvantaged overseas Chinese

students, and scholarships for outstanding overseas Chinese students, will be organized by

the central competent education administrative authority.

Injury and medical insurance, part-time work or study assistance subsidies, and the approval

and issuing of awards to overseas Chinese students for academic excellence shall be

organized by the OCAC.

Article 20

The central competent education administrative authority and the OCAC shall plan and

organize counseling and assistance, workshops, and social events for overseas Chinese

students nationwide.

If it is considered necessary, the central competent education administrative authority may

visit the educational institutions where overseas Chinese students are studying in

conjunction with the relevant authority.

Article 21

Before recent overseas Chinese student graduates leave Taiwan to return to their countries,

the OCAC may arrange a talk or supply information about finding employment there

The OCAC and schools, colleges, and universities from which overseas Chinese students

have graduated shall maintain close and supportive contact with their former students after

they return to their country of residence.

Article 22

By November 30 each year, schools, colleges, and universities with overseas Chinese

students shall submit a list of the new overseas Chinese students who have registered and a

separate list of those who have failed to register to the Bureau of Consular Affairs of the

Ministry of Foreign Affairs, the National Immigration Agency of the Ministry of the Interior,

the OCAC and the central competent education administrative authority. Each school,

college, and university shall report the overseas Chinese students there who have graduated,

suspended or discontinued their studies, independently made a transfer or changed their

program, or who have forfeited their student status.

If a student referred to in the previous paragraph has household registration in Taiwan, the

local government of the special municipality, county, or city where the household is

registered shall also be notified. Male students who are of military service age shall be

subject to the relevant provisions of the Act of Military Service System from January 1 of

the year in which they turn 19.

Colleges and universities which enroll overseas Chinese students shall log-in and

register details of overseas Chinese student admissions and changes to current student

registrations in the overseas Chinese student data management system specified by

the central competent education administrative authority and shall undertake the reporting

requirements set out inParagraph 1.

Article 22-1

If an investigation verifies that an overseas Chinese student has violated the provisions of

the Employment Services Act, their school, college, or university or the appropriate

competent authority shall immediately handle the matter in accordance with the regulations.

If a school, college, or university does not handle a matter in accordance with the previous

paragraph, depending on the circumstances, the appropriate competent education

administration authority may also adjust the overseas Chinese student enrollment quota for

that school, college, or university.

Article 23

An overseas Chinese student who has graduated, or has discontinued or suspended their

studies for the maximum allowable period, and who is not continuing to pursue studies will

lose their status as an overseas Chinese student. However, an overseas Chinese student who

has just graduated from a university in Taiwan and been given approval by the central

competent education administrative authority to do an internship through their university

may extend their overseas Chinese student status for a maximum period of one year after

graduation, after which time their student status will be cancelled.

An overseas Chinese student whose student status has been cancelled will have their

overseas Chinese student status reinstated if they resume their studies at a higher level,

transfer to another educational institution, or resume studies that they had discontinued.

Article 23-1

If an overseas Chinese student of foreign nationality who is eligible for permanent residence

in Hong Kong or Macau, who has never had household registration in Taiwan, and who has

been living in Hong Kong, Macau, or elsewhere overseas for six years or more consecutive

years in the immediate past is applying for admission to a university, their study and

counseling assistance matters may be handled, mutatis mutandis, in accordance with the

provisions of these regulations until any amendment to any law(s) pertaining to these

matters comes into effect. Please note that a minimum of eight consecutive years of

overseas residency is required if the person is applying to study in a university department

of medicine, dentistry, or Chinese medicine in Taiwan.

Article 24-1

Amendments to the provisions of Article 7, Articles 9 to 12, and Article 16 of these

Regulations were promulgated on August 23, 2013 and shall be applicable to students

enrolling from the 2014 school year onwards.

Article 25

These Regulations shall take effect on the date of promulgation.

Amendments to these Regulations were promulgated on August 23, 2013 and shall be

implemented from September 1, 2013.

Appendix 2: Measures for Hong Kong and Macau Residents Studying in Taiwan

Article 1

These measures are established in accordance with Article 19 of the Laws and Regulations Regarding Hong Kong and Macau Affairs and Paragraph 1 of Article 32 of the Junior College Act.

Article 2

Residents of Hong Kong or Macau who have obtained permanent resident documents in Hong Kong or Macau and have resided overseas continually for the most recent six years or more may apply to study in Taiwan. However, applicants for the study of medicine, dentistry, or Chinese medicine at the university level must fulfill eight years of continuous residency.

Article 3

“Overseas” in the preceding article refers to countries or regions outside Taiwan.

During the period of continuous residence in overseas by Hong Kong and Macau residents, no more than 120 days each year may be spent in Taiwan. However, the following situations are not subject to this limitation:

1. The individual is called up to military service in Taiwan.

2. The individual is an exchange student, with less than two years as the total period of exchange.

3. The individual is attending a study program at Chinese teaching institutes established by universities and colleges in Taiwan, with less than two years as the total period of study.

4. The individual has been pregnant for more than seven months or has given birth or had a miscarriage within the past two months.

5. The individual is suffering from an illness where forced deportation may endanger his/her life.

6. The individual, who has a spouse, lineal blood relative, collateral blood relative within the third degree, or a marriage blood relative who has household registration within Taiwan, is hospitalized or deceased within Taiwan due to serious illness or critical injuries.

7. The individual has faced natural disaster or other unavoidable incidents.

8. The individual is attending technical training classes for overseas youth organized by the Overseas Community Affairs Council of the Republic of China or technical training classes organized by the central government’s competent authorities, with less than two years as the total length of training.

9. The individual has embarked on an internship in Taiwan which has been approved by a competent authority authorized by the central government.

10. Other force majeure factors.

For applicants who meet one of the qualifications in the preceding Paragraph and have relevant supporting documents, the period of stay in Taiwan is not included in the calculation of the length of residence in overseas.

When the starting year for continuous residence in overseas is not a complete calendar year, for the purpose of calculating the time period for that year, the period of time spent in Taiwan shall also be included.

Article 4

For Hong Kong and Macau residents who apply to study in Taiwan, the calculation of the period of continuous residence in overseas in Article 2 is based on the current academic year application deadline for Hong Kong and Macau students stipulated in the Admissions Guide. However, when the number of years of continuous residence has reached the requirements of Article 2 by August 31 in the year of application, this limitation does not apply.

Applicants applying based on the above provision should complete an affidavit for their application to be accepted. Following admission, the competent educational authorities should review the applicant’s actual residence situation from the application deadline to August 31 of the same year. If the period of residence in overseas does not satisfy the previous two regulations at this time, the admission qualifications should be revoked. For Hong Kong and Macau residents who apply voluntarily for admission by placement under Item 1 of Article 6 for admission places, the period of continuous residence in overseas is calculated from the date of visit to Taiwan that is closest to the application date. For applicants’ make-up admission by placement in Taiwan, the period of continuous residence is calculated from the date of visit to Taiwan that is closest to the date of voluntary enrollment.

Article 5

Hong Kong and Macau residents who apply to study at each level of the educational institution in Taiwan on the basis of these measures may apply for admission, voluntary transfer, or progression to an educational institution that is in partnership with domestic or foreign universities, has been approved on a case-by-case basis by the Ministry of Education, and offers degree programs with specific administrative mechanisms. These do not include supplementary educational institutions, open universities, recurrent education extension undergraduate programs organized by vocational schools, in-service master’s programs, and other programs only taught in the evenings or on weekends.

Hong Kong and Macau residents who come to Taiwan to study on the basis of these measures and who obtain legal residence status in Taiwan for reasons other than study are not limited by the regulations in the preceding item.

Students who are in breach of the regulation in the first Paragraph shall have their student status revoked and no proof of study shall be issued. If this is discovered following graduation, the educational institution shall revoke graduation qualifications and recover or revoke the graduation certificate.

Educational institutions subject to the regulation in the first Paragraph should clearly state in their Admissions Guide that they are not permitted to recruit students from Hong Kong and Macau.

Article 6

Hong Kong and Macau residents who meet the regulations in Article 2 and Article 3, have reached school age in Taiwan, and also have legal residency in Taiwan may apply for admission by placement according to the following regulations within ninety days of the day following arrival in Taiwan:

1. For students attending elementary school or junior school, an application should be made to the local educational authorities.

2. For students attending senior high schools, junior colleges, or specialized five-year colleges established by universities, the application should be made to the Ministry of Education. However, applicants from general public senior high schools are limited to the National Overseas Chinese Senior High School.

The following items should be submitted with applications under the preceding Paragraph:

1. Application form.

2. Academic documents and transcripts:

(1) Education in Hong Kong or Macau: Highest educational qualification and transcripts from an educational institution in Hong Kong or Macau, to be handled according to the Regulations Governing the Examination and Recognition of Educational Qualifications from Hong Kong and Macau.

(2) Education in the Mainland Area: Highest educational qualifications and transcripts from an educational institution in the Mainland Area are subject to, mutatis mutandis, the Measures for the Recognition of Academic Qualifications from the Mainland Area.

(3) Education in Foreign Educational Institution: Highest educational qualification and transcripts from foreign educational institution should be authenticated by the Republic of China Overseas Mission. When they are written in a language other than Chinese or English, a translation into Chinese or English should also be provided for authentication. After the original version is authenticated, a notary public in Taiwan should authenticate the translated version. However, foreign educational qualifications where the educational institution or campus is located in the Mainland Area should be notified by a notary office in the mainland area, and then authenticated by an agency established or designated by the Executive Yuan or a private organization commissioned by the Executive Yuan.

(4) Educational qualifications from overseas Taiwan schools and Taiwan schools in the Mainland Area are equivalent to educational institutions of the same level in Taiwan.

3. Hong Kong or Macau passport or permanent resident documents.

4. Original documents for continuous residence in overseas.

5. Order of preferences.

6. Alien Resident Certificate for Taiwan of the Republic of China or transcript of household registration issued within the past six months.

7. Other documents as required by the recruiting educational institution.

8. Applicants for private school should first obtain a letter of agreement from the educational institution of intended study.

The academic documents and transcripts in Subparagraph 2 of the preceding Paragraph need not be submitted for students enrolling in the First Semester of the First Grade of elementary school.

When the date of an application in accordance with the First Subparagraph has already passed one-third of the class time for a semester, the educational institution receiving the application may place the student in a suitable grade to audit the class. The period of auditing may not exceed one year. After the educational institution has confirmed the student’s passing grades, it should confirm student status. However, applicants for vocational high schools, vocational study established by ordinary high schools, specialist programs at comprehensive high schools, junior colleges, or specialized five-year colleges established by universities should apply for admission by placement at the start of the next year.

For students who did not apply within the period stipulated in the first Paragraph and enroll at an educational institution within ninety days of the day following arrival in Taiwan, an application should be made to the educational authorities to make up the admission by placement procedures, with the Grade at the year of the present arrival in Taiwan established as the Grade for enrollment.

Students who apply for admission by placement according to the first Paragraph and wish to continue their studies after graduation should apply according to the various measures for student enrollment in Taiwan.

Article 7

Hong Kong and Macau residents who meet the regulations in Article 2 and Article 3 may apply to visit Taiwan to study at the university level or above, or at the Division of Preparatory Programs for Overseas Chinese Students at National Taiwan Normal University.

1. Apply to the University Entrance Committee for Overseas Chinese Students or its designated agency for admission by placement.

2. Apply to a university that has been approved for independent recruitment of Hong Kong and Macau students.

The following items should be submitted with applications under the preceding Paragraph:

1. Application form.

2. Academic documents and transcripts:

(1) Education in Hong Kong or Macau: Highest diploma and transcripts from educational institution in Hong Kong or Macau, to be handled according to the Regulations Governing the Examination and Recognition of Educational Qualifications from Hong Kong and Macau.

(2) Education in the Mainland Area: Highest educational qualifications and transcripts from an educational institution in the Mainland Area are subject to, mutatis mutandis, the Measures for the Recognition of Academic Qualifications from the Mainland Area.

(3) Education in Foreign School: Highest educational qualifications and transcripts from foreign schools (when they are written in a language other than Chinese or English, a Chinese or English translation should be provided), to be handled according to the Regulations Regarding the Assessment and Recognition of Foreign Academic Credentials for Institutions of Higher Education. However, foreign educational qualifications where the educational institution or campus is located in the Mainland Areas should be notified by a notary office in the Mainland Area, and then authenticated by an agency established or designated by the Executive Yuan or a private organization commissioned by the Executive Yuan.

(4) Educational qualifications from overseas Taiwan schools and Taiwan schools in the Mainland Area are equivalent to schools of the same level in Taiwan.

(5) The Standards for Recognition of Equivalent Educational Levels for University Admission are applicable to applicants with equivalent educational levels applying to universities.

3. Hong Kong or Macau passport or permanent resident documents.

4. Original documents for continuous residence in overseas.

5. Order of preferences; however, applicants under the Second Subparagraph of the preceding Paragraph are exempt from this requirement.

7. Other documents as required by the Admissions Guide.

The University Entrance Committee for Overseas Chinese Students mentioned in the First Paragraph is an organization established by universities for the joint recruitment and admission by placement of Hong Kong and Macau students.

The educational authorities at various levels, the University Entrance Committee for Overseas Chinese Students, and the universities should carry out confirmation of the enrollment qualifications of Hong Kong and Macau residents according to the First Paragraph of the preceding Article. If necessary, the educational institutions or related bodies may be appointed or commissioned for this task.

Applicants for admission by placement or make-up admission by placement according to the preceding Article may not subsequently apply under the regulations in the First Paragraph for admission.

If students studying in Taiwan based on the regulations in the First Paragraph of the preceding Article voluntarily withdraw from their studies for any reason, if they have been in Taiwan for less than one year, they may reapply for a maximum of one time to study in Taiwan.

Article 8

Universities that independently recruit Hong Kong and Macau students at each level according to the regulations in Paragraph 1 and Paragraph 2 of the preceding Article should draw up admission regulations, and following submission of the regulations to the Ministry of Education for approval, they should establish an Admissions Guide for Hong Kong and Macau students, a list of departments, duration of studies, student admission quotas, admission methods, and other appropriate regulations.

If universities create special classes for Hong Kong and Macau students due to international academic cooperation programs or other special needs, these should be consistent with the regulations for “Development Size and Resource Conditions for Schools at the Junior College Level and Higher” and submitted to the Ministry of Education for approval.

Universities that receive applications from students in Taiwan according to Paragraph 1 and Paragraph 2 of the preceding Article should submit the following materials to the Ministry of Education for review of Hong Kong and Macau status:

1. Admissions Guide.

2. Application form.

3. Hong Kong or Macau passport or permanent resident documents.

4. Original documents for continuous residence in overseas.

5. Where the regulation in Paragraph 1 of Article 4 applies, an affidavit should be completed according to Paragraph 2 of the same Article.

6. List of applicants for the independent admission of Hong Kong and Macau students by each university.

Chapter 9

Following receipt of application forms from Hong Kong and Macau residents for admission to the Division of Preparatory Programs for Overseas Chinese Students at National Taiwan Normal University or an educational institution at the university level or above, the University Entrance Committee for Overseas Chinese Students or its appointed authority, the University Entrance Committee for Overseas Chinese Students, should approve the admission by placement according to the preferences of applicants, grades, and quota for each educational institution and notify the educational institutions receiving admission by placement and the applicants. However, applicants to graduate school should first pass a review by the educational institution receiving the application before approval of the admission by placement.

For Hong Kong and Macau residents who are placed in music, art, sport, or other arts-related departments, graduate schools, or divisions, the educational institution may also require technical examinations according to actual needs. When technical performance does not reach the required standard, the Ministry of Education or University Entrance Committee for Overseas Chinese Students should place the applicant in a different graduate school, department, or division.

Article 10

Hong Kong and Macau residents who are admitted by placement according to the preceding Article may apply to the body that approved the admission by placement to change the placement to the Division of Preparatory Programs for Overseas Chinese Students at National Taiwan Normal University or the National Overseas Chinese Senior High School, but a maximum of one such application may be made. Residents of Hong Kong and Macau who study in Taiwan through admission by placement shall not receive any advantages if sitting transfer examinations. For students whose choices have been established as not suitable or who are facing difficulties in learning or adapting, the educational institution will provide assistance for their transfer to another graduate school, department, or division. If Hong Kong and Macau residents receive a failing conduct grade or are expelled due to a criminal case, they may not reapply for admission through these Measures and may not transfer their studies to another educational institution.

Article 11

For Hong Kong and Macau students who study at the Division of Preparatory Programs for Overseas Chinese Students at National Taiwan Normal University, when the period of study is completed and graduation qualifications are satisfied, the Division of Preparatory Programs for Overseas Chinese Students at National Taiwan Normal University should inspect the grade list, application form, order of preferences, and other documents as required by the recruiting educational institution, and send them to the University Entrance Committee for Overseas Chinese Students for approval of admission by placement to universities.

Article 12

Hong Kong and Macau students who receive an undergraduate degree or higher in Taiwan should submit the graduation certificate of the university in Taiwan, or the certificates, academic transcripts, application forms, order of preferences, and other documents required by the recruiting educational institution for admissions qualification, and apply to the University Entrance Committee for Overseas Chinese Students for admission by placement to master’s programs or above. The University Entrance Committee for Overseas Chinese Students should request a review by the educational institution applied for according to the order of preferences, and then approve the admission by placement. Approval of admission by placement may take place a maximum of one time. Students who apply to master’s programs of their own volition should be subject to the same admission standards as students from Taiwan.

Students who are admitted by placement and have already enrolled according to the preceding Paragraph may not make an application for the same-level program according to the preceding Subparagraph.

Article 13

Educational institution at all levels who admit Hong Kong and Macau students according to Article 6, Article 7, Article 11, and the preceding Article must use an additional quota method. The additional quota is combined with the ratio calculation in Article 11 of the Regulations Regarding Study and Counseling Assistance for Overseas Chinese Students in Taiwan. However, degree programs involving cooperation between domestic and foreign

universities and which have been approved on a case-by-case basis by the Ministry of Education are not subject to this limitation.

Article 14:

Hong Kong and Macau residents who forge, falsify, or use under false pretenses any submitted documents will have their admissions qualifications revoked. Students who have already enrolled shall have their student status revoked and no proof of study shall be issued; if this is discovered following graduation, the educational institution should revoke graduation qualifications and recover or revoke the graduation certificate.

Article 15

For student counseling of the residents of Hong Kong and Macau who come to Taiwan to study on the basis of these measures, Article 150–Article 21 of the Regulations Regarding Study and Counseling Assistance for Overseas Chinese Students in Taiwan shall be applied, mutatis mutandis.

Article 16

Prior to November 30 of each year, the educational institution where Hong Kong and Macau students are studying should produce separate lists of already enrolled new students and those who did not report for enrollment, which should be reported to the National Immigration Agency of the Ministry of the Interior and the educational authorities at various levels. The educational institution where Hong Kong and Macau students are studying should immediately report the graduation, leave of absence, withdrawal, voluntary transfer, or loss of student status.

For students in the preceding Paragraph who hold household registration in Taiwan and have reached military age, from January 1 of the year they reach 19, they are subject to the relevant provisions of the Act of Military Service System. Universities and colleges in the first paragraph should register enrollment and change of student status for Hong Kong and Macau students in an overseas Chinese students’ data management system designated by the Ministry of Education and handle notification of the provisions in the First Paragraph.

Article 17

When Hong Kong and Macau students graduate, withdraw, or have expired leave of absence, and do not continue their studies, their status as Hong Kong and Macau students in Taiwan should be terminated. However, for internships arranged by the educational institution following graduation and approved by the Ministry of Education, the student identity of Hong Kong and Macau students may be extended for a maximum of one year following graduation.

After the student status of Hong Kong and Macau students is terminated, following continued studies, transfer of studies, or a resumption of studies, student status will be reinstated.

Article 18

If students are shown to be in breach of the Employment Service Act, the educational institution or relevant authorities should deal with it according to regulations.

If the educational institution does not deal with the problem according to the above regulation, the educational authorities at various levels may adjust their admissions quota according to the actual situation.

Article 19:

For Hong Kong and Macau residents employed in Taiwan, their children should apply to enroll in schools for foreign nationals and their attached kindergartens based on the relevant regulations for the children of foreign nationals, mutatis mutandis.

Article 20

These measures are effective from the date of promulgation.

Appendix 3: Regulations Regarding International Students Undertaking Studies in Taiwan

Article 1

These Regulations are formulated in accordance with the provisions of Article 25, Paragraph

3 of the University Act, Article 32, Paragraph 1 of the Junior College Act, Article 41,

Paragraph 1 of the Senior High School Education Act, and Article 6, Paragraph 3 of the

Primary and Junior High School Act.

Article 2

A person of foreign nationality who has never held Republic of China (“R.O.C.”)

nationality and who does not have overseas Chinese student status at the time of their

application is permitted to apply for admission to an educational institution, in accordance

with these Regulations.

A person of foreign nationality who meets the following requirements and who in the

immediate past has resided overseas continuously for at least six years is also permitted to

apply for admission to an educational institution, in accordance with these Regulations.

However, a person who plans to apply to study in a university department of medicine,

dentistry, or Chinese medicine must have resided overseas continuously for at least eight

years.

1.A person who at the time of their application also holds dual R.O.C. nationality shall have

never had household registration in Taiwan.

2.A person who before the time of their application also held dual R.O.C. nationality but no

longer does at the time of their application shall have renounced their R.O.C.

nationality with the approval of the Ministry of the Interior on a date at least eight full years

before making their application.

3.The persons referred to in the preceding two subparagraphs must have never previously

undertaken studies in Taiwan as an overseas Chinese student nor have accepted a placement

by the University Entrance Committee for Overseas Chinese Students in the current

academic year

A foreign national who was selected by a foreign government, organization, or school to

study in Taiwan in accordance with the Education Cooperation Framework Agreement, and

who has never had household registration in Taiwan may be given exemption from the

restrictions set out in the preceding two paragraphs if the competent education

administrative authority gives approval.

The periods of six years and eight years stipulated in Paragraph 2 shall be calculated using

the starting date of the semester (February 1, or August 1) as the end date of the period.

The term “overseas” used in Paragraph 2 refers to countries or regions other than the

Mainland Area, Hong Kong, and Macau; the term “reside overseas continuously” means

that an international student has stayed in Taiwan for no more than a total of 120 days in

each calendar year. When calculating the number of consecutive years spent overseas, if the

initial or final year of the period is not a complete calendar year, any time spent in Taiwan

in the initial or final year must not exceed 120 days. However, time that a person has spent

in Taiwan is not subject to this restriction and it is not counted when calculating how long

they were in Taiwan in a particular year if the person has documentary proof that they:

1.Attended an overseas youth training course organized by the Overseas Compatriot Affairs

Council or a technical professional training program accredited by the Ministry of

Education;

2. spent a total period of less than two years undertaking Chinese language classes at a

Chinese language center at a university or tertiary college which has Ministry of Education

approval to recruit students overseas;

3. spent a total period of less than two years in Taiwan as an exchange student; or

4. spent a total period of less than two years undertaking an internship that they came to

Taiwan to undertake with the approval of the designated central

competent authority;

A person who held both foreign and R.O.C. nationalities and applied for annulment of their

R.O.C. nationality before the date of effect of the February 1, 2011 amendment to these

Regulations may apply for admission as an international student in accordance with the

provisions in place before the amendment and is not subject to the restrictions set out in

Paragraph 2.

Article 3

An applicant of foreign nationality, who is eligible for permanent residence in Hong Kong

or Macau, who has never had household registration in Taiwan, and who at the time of their

application has resided in Hong Kong, Macau, or elsewhere overseas continuously for at

least six years may apply for admission in accordance with the provisions of these

Regulations. However, a person who plans to apply to study in a university department of

medicine, dentistry, or Chinese medicine must have resided overseas continuously for at

least eight years.

The term “resided [ …] continuously” in the preceding paragraph means that a person did

not spend more than a total of 120 days in Taiwan in each calendar year. However, this

restriction does not apply if a person can present documentary proof that any of the

circumstances listed in Paragraph 5, Subparagraphs 1 to 4 of the previous article apply. The

time that they spent in Taiwan in the ways listed is not counted when calculating the period

of continuous residence referred to in the previous paragraph.

A person who was formerly from the Mainland Area and who has foreign nationality and

has have never had household registration in Taiwan, and who at the time of their

application has resided overseas continuously for at least six years may apply for admission

to an educational institution, in accordance with the provisions of these Regulations.

However, a person who plans to apply to study in a university department of medicine,

dentistry, or Chinese medicine must have resided overseas continuously for at least eight

years.

The term “resided [ …] continuously” in the preceding paragraph means that a person did

not spend more than a total of 120 days in Taiwan in each calendar year. However, this

restriction does not apply if a person can present documentary proof that any of the

circumstances listed in Paragraph 5, Subparagraphs 1 to 4 of the previous article apply. The

time that they spent in Taiwan in the ways listed is not counted when calculating the period

that they resided continuously overseas referred to in the previous paragraph.

The periods of six years and eight years stipulated in Paragraph 1 and in Paragraph 3 shall

be calculated using the starting date of the semester (February 1, or August 1) as the end

date of the period.

The definition of “overseas” given in Paragraph 5 of the previous article also applies,

mutatis mutandis, to Paragraphs 1 to 4.

Article 4

An international student applying to study at an educational institution in Taiwan in

accordance with the provisions of the two previous articles is limited to only applying once

[English note: a person may apply to more than one educational institution, but if one of

these applications is successful and they then study in Taiwan, they cannot subsequently

apply to study at another educational institution for a course at that level]. After completing

the course of study at the educational institution to which they applied, unless the student is

applying for admission to a program for a master’s degree or a higher degree, which may be

handled by each university in accordance with its regulations, if the students wants to

continue studying in Taiwan, their application shall be handled in the same manner as the

admission procedures for domestic students.

Article 5

In principle, the actual number of places available for international students to be admitted

to universities and two-year programs at junior colleges (hereunder referred to as

“universities and tertiary colleges”) is limited to an additional ten percent above the

institution’s admission quota approved for that academic year by the Ministry of Education,

and that number shall be incorporated into the total admission quota and reported to the

Ministry of Education for approval. A university or junior college applying to recruit more

than an additional ten percent shall submit a report of the planned increment (including

associated quality control strategy and supportive measures) to the Ministry of Education

for approval. Degree programs offered by collaborating domestic and foreign universities

that have been approved on a case by case basis by the Ministry of Education are not subject

to this restriction.

The actual number of international students that may be admitted to a five-year program at a

junior college, or to a senior secondary school, junior high school, or an elementary school

is limited up to an additional ten percent above the institution’s admission quota for that

academic year that was approved by the competent education administrative authority, and

that number shall be included in the total number of students admitted for that academic

year and be reported to the competent education administrative authority for approval.

Universities and tertiary colleges may admit international students to take up places at their

institution available to local students within the approved admission quota for that academic

year which remain vacant.

The admission quotas referred to in Paragraph 1 and Paragraph 2 do not include

international students who are not officially registered as a current student.

Article 6

A university or tertiary college that recruits and admits international students shall formulate

its own admission regulations and make these public after they have been approved by the

Ministry of Education, and formulate a set of international student admission guidelines that

outline details of the degree programs that admit international students, the length of time in

which each program must be completed, admission quotas, admission eligibility

requirements, reviewing and screening methods, and any other related regulations.

Article 7

International students applying for admission to a university or tertiary college shall submit

the following documents and apply directly to the university or college during its designated

application period, and applicants who pass the review or screening process will be issued

an admission notice:

1. An enrollment application form

2. Academic credentials:

(1) Academic credentials from the Mainland Area: shall be handled in accordance with the

provisions of the Regulations Regarding the Assessment and Recognition of Academic

Credentials for Mainland Area.

(2) Academic credentials from Hong Kong or Macau: shall be handled in accordance with

the provisions of the Regulations Governing the Examination and Recognition of

Educational Qualifications from Hong Kong and Macau.

(3) Academic credentials from other areas:

A. Academic credentials issued by an Overseas Taiwan School or a school for

Taiwan business people in the Mainland Area shall be regarded as equivalent to academic

credentials issued by an educational institution of the same level in Taiwan.

B. Academic credentials from overseas other than those referred to the preceding two

items shall be handled in accordance with the provisions of the Regulations Regarding the

Assessment and Recognition of Foreign Academic Credentials for Institutions of Higher

Education. However, academic credentials issued by a campus or branch that a foreign

educational institution has established in the Mainland Area by a foreign educational

institution shall be notarized by a notary public there and authenticated by

an agency established or designated by the Executive Yuan, or by a

private organization commissioned by the Executive Yuan.

3. Proof of applicant’s having sufficient funds to live on while studying in Taiwan, or proof

of having a full scholarship or grant provided by a government, university, college, or

private organization.

4. Other documents required by the educational institution being applied to.

When an educational institution reviews an international student’s admission application, if

any of the documents specified in Subparagraphs 2 and 4 of the preceding paragraph have

not been authenticated by an overseas mission, or by an agency established

or designated by the Executive Yuan, or by a private organization commissioned by the

Executive Yuan, and the educational institution has any doubts about them, it may request

authentication by an overseas agency If documents that have already been authenticated

raise any doubts, the educational institution may request examination of the documents.

Article 7-1

An international student who submits any certificate or document as part of their application

for admission to an educational institution that is found to be forged, fabricated, or that has

been altered in some way shall have their enrollment eligibility revoked. If the student has

already registered and begun classes, their registration as a current student shall be cancelled

and they will not be awarded any certification whatsoever regarding their related academic

undertakings. If any such circumstances are first discovered after a student has already

graduated, the educational institution shall revoke the former student’s eligibility to

graduate and shall require any degree already awarded to be returned and shall rescind it.

Article 8

An international student who has completed a bachelor’s degree or a higher degree in

Taiwan and is applying to be admitted to do a master’s degree program or a higher degree

may submit copies of their graduation certificate from a university or tertiary college in

Taiwan and transcripts for each year of their studies and apply in accordance with the

provisions of Article 7 and is not subject to the provisions of Article 7, Paragraph 1, Item 2.

An international student who has graduated from a private elementary or secondary school

for international residents in Taiwan, or from a bilingual division (program) affiliated to a

domestic senior secondary school, or from a program teaching a foreign curriculum that is

offered by a division of a domestic private elementary school, junior high school or senior

secondary school may submit copies of their graduation certificate and transcripts for each

year and apply for admission in accordance with the provisions of Article 7 and is not

subject to the provisions of Article 4, or of Article 7, Paragraph 1, Subparagraph 2.

Article 9

A university or tertiary college that admits international students shall promptly register

details of the following into the international student data management information system

designated by the Ministry of Education: the international students admitted and registered,

any transfer, deferral or abandonment of studies, and any change to or loss of student status.

Article 10

An international student is not permitted to apply to study any recurrent or continuing

education bachelor’s degree program or in-service master’s degree program, or any other

program which is only taught in the evening or during vacations, at a university or tertiary

college in Taiwan. However, an international student who already has legitimate resident

status or who is undertaking a program approved on a case by case basis by the Ministry of

Education is not subject to this restriction.

Article 11

An international student who reports to register at a university or tertiary college, a five-year

program at a junior college, or a senior secondary school, junior high school, or an

elementary school before it is already one-third of the way into the first semester of the

current academic year shall be registered for the first semester. If it is already more than

one-third of the way into the first semester, the international student shall register for the

second semester or the next academic year. However, this restriction does not apply if

each competent education administrative authority has some provision that overrides it..

Article 12

An international student who with Ministry of Education approval is undertaking an

internship after graduating from a university in Taiwan may have their international student

status extended for up to one year after their graduation.

An international student who has been permitted to undertake initial household registration,

resident registration, naturalization, or restoration of R.O.C. nationality procedures during

the course of their studies in Taiwan will forfeit their international student status and shall

be dismissed by their educational institution.

An international student who is dismissed from a university or tertiary college after

admission as a result of unsatisfactory conduct, or poor academic performance, or a

conviction in criminal case proceedings is not permitted to re-apply for admission to an

educational institution under these Regulations.

Each university or tertiary college shall formulate its own regulations regarding transfers of

international students, incorporate these into its admission regulations, and submit these to

the Ministry of Education for approval. However, an international student who has been

dismissed by the educational institution that admitted the student as a result of

unsatisfactory conduct or of a conviction in criminal case proceedings is not permitted to

transfer to another university or tertiary college.

Article 13

A university or tertiary college may sign an education cooperation agreement with a foreign

educational institution and recruit and admit international exchange students, provided that

this does not affect normal teaching. A university or tertiary college may also apply, mutatis

mutandis, its own international student admission regulations to accept suitable international

students as non-degree students.

With approval from each competent education administrative authority, senior secondary

schools, junior high schools, and elementary schools may recruit international students for

short-term periods of study in Taiwan of one year or less.

Article 14

Educational institutions at all levels that establish programs exclusively for international

students as part of an international academic cooperation program or to meet some other

special need shall do so in accordance with the regulations governing overall scale of and

resources for development of an educational institution at their level, and the competent

education administrative authority will forward details of such programs for appraisal and

approval by the Ministry of Education.

Article 15

In order to provide incentive awards for outstanding international students who are studying

at universities and tertiary colleges in Taiwan, the Ministry of Education may set up

international student scholarships or may subsidize universities and tertiary colleges to do

so.

To encourage international students to come and study in Taiwan, universities and tertiary

colleges may allocate funds to set up scholarships or financial study assistance to

international students.

Article 16

Universities and tertiary colleges shall designate units or personnel to be responsible for

handling international student admission applications, counselling, and liaison matters.

These units or personnel shall also boost the arrangement of homestay accommodation for

international students, and of assistance for them to learn Mandarin Chinese and about

Taiwan culture in order to better enhance their understanding of Taiwan.

At different times each academic year, universities and tertiary colleges shall organize

counselling activities for international students or accelerate campus internationalization, to

help to foster exchanges and interactions between local students and international students.

Article 17

A five-year program at a junior college, or a senior secondary school, junior high school, or

an elementary school that admits international students shall, apart from complying with the

provisions of Article 20 when handling applications from international students who have

legitimate resident status in Taiwan, prepare an international student recruitment plan and

submit the plan to the competent education administrative authority for approval no later

than November 30 each year, before recruitment may begin. The competent education

administrative authorities at the municipality, county, and city levels shall submit their

approved lists of the approved quotas for each educational institution in their jurisdiction to

the Ministry of Education no later than December 31 each year for future reference.

The plan referred to in the preceding paragraph shall include the establishment of a

dedicated unit responsible for international students, planning to increase Chinese language

and culture courses, and measures for arranging accommodation for international students.

When necessary, the categories of countries and quotas for the admission of international

students referred to in Paragraph 1 may be stipulated by the Ministry of Education in

consultation with the Ministry of the Interior, and the Ministry of Foreign Affairs.

Article 18

Unless otherwise specified in Article 20, an international student applying for admission to

a five-year program at a junior college, or a senior secondary school, junior high school, or

an elementary school shall directly apply to the junior college or school during its

designated admission period and submit the following documents. If an applicant passes the

review or screening process, the junior college or school will issue an admission notice.

1. An enrollment application form.

2. Academic credentials:

(1) Academic credentials from the Mainland Area: shall be handled in accordance with the

provisions of the Regulations Regarding the Assessment and Recognition of Academic

Credentials for Mainland Area.

(2) Academic credentials from Hong Kong or Macau: shall be handled in accordance with

the provisions of the Regulations Governing the Examination and Recognition of

Educational Qualifications from Hong Kong and Macau.

(3) Academic credentials from other areas:

A. Academic credentials issued by an Overseas Taiwan School or a school for

Taiwan business people in the Mainland Area shall be regarded as equivalent to academic

credentials issued by an educational institution of the same level in Taiwan.

B. Academic credentials from overseas other than those referred to the preceding two items

shall be handled in accordance with the relevant provisions of the applicable Ministry of

Education regulations governing the assessment and recognition of international students’

academic credentials and records. Academic credentials issued by a campus or branch of a

foreign educational institution which it has established in the Mainland Area shall be

notarized by a notary public office there and authenticated by an authority established or

designated by the Executive Yuan, or by a private organization commissioned by the

Executive Yuan.

3. Proof of applicant’s having sufficient funds to live on while studying in Taiwan.

4. Documentary evidence of the eligibility of a guardian in Taiwan.

5. A power of attorney from the student’s parents or other legal representative, which has

been authenticated by an overseas mission, appointing the guardian in Taiwan.

6. A letter of agreement from the guardian in Taiwan which has been notarized by a notary

public in Taiwan.

7. Any other documents required by the school, college, or university.

The academic credentials stipulated in Subparagraph 2 of the preceding paragraph are not

required to be submitted for an application to be admitted for the first semester of the first

grade of elementary school.

Adult international students are not required to submit the documents stipulated in

Paragraph 1, Subparagraphs 4 to 6.

When a junior college, or school is reviewing an international student’s admission

application, if any of the documents specified in Paragraph 1, Subparagraphs 2, 3, and 7

have not been authenticated by an overseas mission, or by an agency established

or designated by the Executive Yuan, or by a private organization commissioned by the

Executive Yuan, and the junior college or school has any doubts about them, it may request

authentication by an overseas agency. If documents that have already been authenticated

raise any doubts, the junior college or school may request examination of the documents.

Article 19

The guardian in Taiwan referred to in the preceding article shall be an R.O.C. citizen who

has household registration in Taiwan and shall submit a PoliceCriminal Record Certificate,

and an income tax inventory for the most recent year checked and issued by a taxation

organization itemizing personal taxable income from all sources of at least TWD 900,000.

A person who satisfies the requirements prescribed in the preceding paragraph may serve as

the guardian in Taiwan of only one international student. However, a school principal, or

the chair of the board of directors of an incorporated school or a board member may act as

the guardian in Taiwan of up to five international students.

Article 20

An international student who has legitimate resident status in Taiwan and is applying to

study a five-year program at a junior college, or at a senior secondary school, junior high

school, or an elementary school shall submit the following documents and apply directly to

the junior college or school, and report to register there if their application is approved:

1. An enrollment application form;

2. A photocopy of a legitimate resident permit;

3. Academic credentials:

(1) Academic credentials from the Mainland Area: shall be handled in accordance with the

provisions of the Regulations Regarding the Assessment and Recognition of Academic

Credentials for Mainland Area.

(2) Academic credentials from Hong Kong or Macau: shall be handled in accordance with

the provisions of the Regulations Governing the Examination and Recognition of

Educational Qualifications from Hong Kong and Macau.

(3) Academic credentials from other areas:

A. Academic credentials issued by an Overseas Taiwan School or a school for

Taiwan business people in the Mainland Area shall be regarded as equivalent to academic

credentials issued by an educational institution of the same level in Taiwan.

B. Academic credentials from overseas other than those referred to the preceding two items

shall be handled in accordance with the relevant provisions of the applicable Ministry of

Education regulations governing the assessment and recognition of international students’

academic credentials and records. Academic credentials issued by a campus or branch of a

foreign educational institution which it has established in the Mainland Area shall be

notarized by a notary public office there and authenticated by an authority established or

designated by the Executive Yuan, or by a private organization commissioned by the

Executive Yuan.

The academic credentials stipulated in Subparagraph 3 of the preceding paragraph are not

required for an application for admission to the first semester of first grade at an elementary

school.

When a junior college, or school is reviewing an international student’s admission

application, if any of the documents specified in Paragraph 1, Subparagraph 3 have not been

authenticated by an overseas mission, or by an agency established or designated by the

Executive Yuan, or by a private organization commissioned by the Executive Yuan, and the

junior college or school has any doubts about them, it may request authentication by an

overseas agency. If documents that have already been authenticated raise any doubts, the

junior college or school may request examination of the documents.

After the admission of the international students referred to in Paragraph 1, a senior

secondary school, junior high school, or an elementary school shall submit a list of their

details to the competent education administrative authority for future reference.

If a senior secondary school, junior high school, or an elementary school cannot admit the

international student referred to in Paragraph 1 applying to study there because the school

has already filled its admission quota, the student may apply to the competent education

administrative authority for a transfer to be admitted to a school that has a vacancy.

A senior secondary school, junior high school, or an elementary school may assign

the international student referred to in Paragraph 1 applying to study there to an appropriate

grade level or give them a ‘provisional’ admission status, based on their results during the

screening process. This ‘provisional’ status is valid for up to one year, and their student

registration shall be confirmed if they pass the examinations.

Article 20-1

If a chaotic war situation, major disaster, or major epidemic occurs in the country of an

international student, and educational institutions in the region become unable to operate

normally as a result, that student’s admission to senior secondary school or junior college

may be given special consideration on a case by case basis, if details of those circumstances

have been assessed and submitted by an R.O.C. overseas mission or by the embassy,

consular office or authorized representative office of the student’s country in Taiwan, and

then confirmed by the Ministry of Education in conjunction with the Ministry of Foreign

Affairs, and the National Immigration Agency of the Ministry of the Interior.

In principle, the additional student admission quota referred to in the previous paragraph for

students given special consideration on a case by case basis shall be one percent of the total

student recruitment quota approved for that school or junior college.

Article 21

The tuition related fees that international students in Taiwan shall pay are determined as

stipulated below:

1.Students who have been admitted to study in Taiwan in accordance with the provisions of

the previous two articles, or who have received a MOFA Taiwan Scholarship following

recommendation by an overseas mission, or who have the status of permanent residents in

Taiwan shall pay tuition and other fees in accordance with the standard fees that their

educational institution applies to domestic students.

2. Students admitted to an educational institution in Taiwan in accordance with an education

cooperation agreement shall pay their tuition and other fees as specified in the agreement.

3. If an international student is not covered by the provisions of either of the preceding two

subparagraphs, an educational institution may charge the student based on the standard

tuition and other fees for international students that it has determined, and these are not

permitted to be lower than the fees levied by other private educational institutions at the

same level.

A student who was admitted to an educational institution in Taiwan before the date of effect

of the February 1, 2011 amendment to these Regulations shall pay tuition and other for this

stage of education fees in accordance with the pre-amendment provisions.

Article 22

When a new international student registers, they shall submit proof of being covered by a

medical and injury insurance policy which is valid for at least six months from the date that

they entered Taiwan. Current students shall present documentary proof that they have joined

Taiwan’s National Health Insurance Plan.

If the proof of insurance referred to in the previous paragraph was issued in a foreign

country it shall be authenticated by an overseas mission.

Article 23

If an investigation verifies that an international student has violated the provisions of the

Employment Services Act, their educational institution, or the appropriate competent

authority shall immediately handle the matter in accordance with the regulations.

Article 24

If an international student defers or abandons their studies, or if there is any change to or

loss of their student status, their educational institution shall notify the Bureau of Consular

Affairs of the Ministry of the Foreign Affairs, the service center(s) of the National

Immigration Agency of the Ministry of the Interior where their educational institution is

located, and send copies of these notifications to the Ministry of Education.

Article 25

If it is considered necessary, the competent education administration authority may visit

educational institutions that admit international students. Any institution found in violation

of the provisions of these Regulations shall be dealt with in accordance with the provisions

of the applicable laws and regulations.

If an educational institution is not acting in accordance with the provisions of Article 23,

depending on the circumstances, the appropriate competent education administration

authority may also adjust the international student enrollment quotas for that educational

institution.

Article 26

The provisions of Article 7, Paragraph 4, Subparagraphs 1, 3, and 4, and of Articles 9, 15,

16, 22, and 24 also apply, mutatis mutandis, to the application procedures, scholarships and

subsidies, supervision and guidance, absences from one quarter or more of the total

scheduled class hours of a semester, and the reporting of changes to or loss of student status

for international students who come to Taiwan to study Mandarin at a Chinese Language

Centers affiliated with a university or tertiary college in Taiwan.

Article 27

The format of the forms referred to in Article 7, Paragraph 1, Subparagraph 1; in Article 18,

Paragraph 1, Subparagraph 1; and in Article 20, Paragraph 1, Subparagraph 1 shall be

determined by each educational institution. The format of the forms referred to in Article 18,

Paragraph 1, Subparagraphs 5 and 6 shall be prescribed by the Ministry of Education.

Article 28

These Regulations shall take effect on August 1, 2012.

The amendments to these Regulations shall take effect on the date of promulgation, with the

exception of the amendments promulgated on December 24, 2012 which shall take effect on

January 1, 2013, and the amendments promulgated on August 23, 2013 which shall take

effect on September 1, 2013.
