Just hope I can still drive at 95 when I have saved up enough to retire. You know the market crashing, financial institutions failing, the announcement of layoffs by almost all the larger companies, has left very few Americans untouched. Fuel prices are on a teeter totter, I would hate to be selling airline tickets that were for 6 months down the road. No wonder these guys are having financial problems.

OK let’s go one step forward, the failure of the financial institutions which cost the American tax payers $ 700,000,000,000.00. That is a lot of zeroes. Enough so that our grandchildren will be paying down our debt. That is just wrong. No wonder America is in a financial mess, our leaders are teaching the taxpayers how to do their financing. Why is it that no one saw this coming? How many people now have to put off retirement because of it? If I were a gambling man, I would have to bet that this helped sustain our social security funds a while longer. Why is it that when the above funds are given to companies to help them through their financial problems, and when these funds were spent foolishly, why can’t these individuals be held liable for it? The elections this November should be……. interesting. At the national level, the choices between candidates’ positions are stark, which many believe will split the country or change its direction on many various points. From social issues to economic philosophies, supporters of the winning candidate will undoubtedly sense vindication. However, the bigger picture might show a pendulum swinging side to side, but perhaps not as widely as people believe.

Not awfully long ago, the Republicans controlled the White House, House of Representatives and Senate. After a brief stint of this, voters had had enough. The pendulum did that swing-thing, and pending the outcome of this Tuesday’s election, the Democrats may be on the verge of controlling all three lawmaking components. Which tells me one thing is for certain – the pendulum is probably about to do its thing again.

Many writers have recently put ideas on the American voter. The general consensus is that the American voter is in the center. Some say Center-right, some say center-left. I might suggest somewhere in between, and that the American voters have more in common with each other than they allow themselves to believe.

I’m usually surprised by the separation of the support for diverging points of view. But utterly shocked by the number of people who would gladly change their support, if we can merely move the discussion to something else. In other words, just make a decision and be done with it. Sometimes, I believe this is the majority that both sides spend millions trying to lure to their side.

I often wonder what makes someone so adamant about supporting a candidate. After

listening to Howard Stern’s street interviews of voters, how can you not be?

Especially in an election like this year’s, it’s next to impossible to limit votes on the basis of a single issue only. But the fact remains that housing is one of the biggest issues in any camp. Of course, housing is critical to SIBA members. The impact of housing hits SIBA members first and most directly. It’s our livelihood, and source of income.

But housing is also important to everyone. Sure, locally it generates jobs and expands the tax base. The ripple-effects of a strong housing market is incredible. These dollars, maybe more than any other, practically turn themselves over within a community.

For the national market, housing is THE engine that can fire up the economy. Not too many years ago, housing was the only strong component of the economy. And it carried almost all others through their respective slumps.

The SIBA PAC, on behalf of the builders, subcontractors and suppliers, has been effective in building relationships with those who make decisions involving the building industry. Equally as important is that the SIBA PAC has made candidates more aware of the impact of housing on the local economy, and the staggering number of paid employees represented by the Association alone. Our hope is that the message on housing carries through into everyone’s elected term as issues arise. And there is never a small issue when it comes to the upfront cost of a new house.

I would like to thank all the candidates who attended SIBA’s Candidates Night. We had a good evening with a remarkable number of people running for office. I hope they all got the chance to meet and greet Builders and Associates.

Finally, I need to thank all those who ran for office. I’ve been close to more than one campaign, not as a candidate myself, but I can attest how engrossing a campaign is to your personal life. So thank you to everyone who has put their lives on hold long enough so that we can have a choice in the people who help make decision about policies and regulations. For the candidates, it’s a steady diet of chicken dinners and time away from home, in exchange for getting criticized in

public. Not such an easy thing. To give you an idea of how engrossing

a campaign is, we should thank their spouses and children too.

Good luck to all of the candidates. SIBA and its members stand ready to work with you.

HOW diStRiBUtiON

SUMMARYEligible Home builders who were

members and owners of the Home Owners Warranty Insurance Company (HOW) are set to receive a distribution of their capital contributions made to HOW before the company was placed in receivership by the state of Virginia. Notices of claims have been mailed to builders.

Former HOW builders need to know about the details of the potential claims they have to capital contributions and an ultimate surplus distribution. ARE YOU ELiGiBLE?

The Receiver has published detailed criteria for builders to be eligible. Essentially, though, you had to be a HOW builder when HOW was put into receivership in 1994, or had been a HOW builder for at least 5 consecutive years and left HOW shortly before HOW went into receivership. The details are set forth in the Order Approving Plans of Liquidation dated June 13, 2005.HOW dO i FiLE A CLAiM?

You must file a proof of claim with the Receiver. Those builders deemed eligible by the Receiver should have received a notice from the Receiver. The Receiver is working off lists of builders that date back to the last year of HOW’s operation (1994-1995).WHEN iS tHE PROOF OF CLAiM dUE? January 12, 2008.WHAt iF i didN’t GEt NOtiCE FROM tHE RECEiVER?

If you did not receive a notice of proof of claim, then either the Receiver does not believe you are eligible, or the Receiver mailed the notice to your former address. The Receiver is using a mailing address from 1995. Builders who don’t get notice,

SiBA OFFERS COdE SEMiNARLast Call for CEU’s?

Need credit hours to renew your license? SIBA has them!

SIBA is offering a code seminar on Wednesday, December 17 from 3:00 – 6:00 pm. The class will cover the Indiana Residential Code, with Indiana Amendments. Attendees can learn the most updated code changes, as well as any new interpretations that will facilitate code enforcement.

The instructor for the class is Ben Miller, Evansville-Vanderburgh Building Inspector. Miller has taught classes in different areas of the State of Indiana.

The seminar is pending approval by the Construction & Roofing Licensing Board, which meets in November. Once approved, this could be the last chance for licensed contractors to earn continued education credits for the 2009 license renewals. Each licensed contractor is required to attend 3 hours of Continued Education, and submit a certificate at the time of renewing their respective licenses.

FALL tOUR dELiVERS tRAFFiC, BUYERS

Home builders who entered a home in the Fall Tour are happily reporting buyers seem to be returning to new homes. In its third year, the new program that puts homes on public display is designed to draw potential buyers to subdivisions and newly built homes.

During the 2-weekend event, most builders agreed the Fall Tour generated more traffic at their homes than a typical Open House event. Traffic was up!

One builder reported on Saturday, he had a minimum of one couple viewing their home during all hours of the Fall Tour. On Sunday, he had at least 2 couples visiting during all hours.

Another SIBA builder said he had suspended his regular advertising during the Fall Tour to gauge the traffic. He reported a slow start on the first day, but credited the Tour for a steady stream of later visitors, some with strong interest in purchasing.

A portion of the visitors at the Fall Tour were looking for entertainment purposes. But a majority of the visitors were described by builders as buyers. One builder may have said it best, “My visitors are going to buy something. It might not be from me, but they’re going to buy something.”

The Fall Tour already included Saturdays, but has grown into a two-weekend event. Fortunately, the weather on both weekends was outstanding. Although this sometimes creates competition for outdoors events, it worked well for people who were actually shopping for a new home to buy.

Surveys are being emailed to Fall Tour builders, the comments received will be put to good use by the Fall Tour committee. Comments will become improvements.

SIBA also thanks the Evansville Area Association of Realtors for being the major sponsor for the Fall Tour. The EAAR logo was placed on the map, as well as links to EAAR’s website.

Overall, it’s important for SIBA builders to compare Fall Tour traffic to that of a typical Open House. In this light, the return is proving the entry to be a smart investment for home builders. Sometimes the Fall Tour is unfairly compared to the Parade of Homes, but there’s only one Parade of Homes and it’s in June!

With the strong backing of the nation’s home builders, the U.S. House of Representatives on Oct. 3 by a vote of 263 to 171 approved an economic rescue plan aimed at stabilizing and restoring confidence in worldwide financial and credit markets.

Out of concern that turmoil in the financial markets was severely curtailing the flow of credit for housing and other business sectors and that the global economy was teetering on the brink of catastrophe, the leadership of NAHB on Sept. 24 called on Congress to pass the Emergency Economic Stabilization Act of 2008 “as soon as possible.”

In conjunction with the call to action, which was unanimously adopted at a special session during NAHB’s fall board of directors meeting in San Diego, all 235,000 members of the association were urged to immediately contact their congressional delegations and ask them to pass the plan without delay. The board formally voted in support of the legislative effort at its official meeting on Sept. 26.

Last week’s House action came two days after the Senate approved the measure by a margin of 74 to 25. The bill was then quickly signed into law by President Bush.

“This legislation was absolutely essential to prevent a collapse in our financial system that would have inflicted devastating damage to our nation’s economy,” said NAHB Chairman Sandy Dunn. “Hopefully, this will set the stage for rebuilding confidence, restoring the availability of credit for businesses and consumers, and reversing the downward spiral in home prices and rising foreclosures that are root causes of today’s financial turmoil,” she said.

“We will continue to work with lawmakers on both sides of the aisle to take whatever other steps are necessary to put housing and the economy back on track,” Dunn added.

The legislation will allow the U.S. Treasury to purchase troubled mortgage assets that have been weighing heavily on the balance sheets of financial institutions, a process that will help recapitalize them and

restore the flow of credit. The Treasury will hold those assets until conditions improve and then resell them.

The bill also contains other NAHB priorities, including a one-year “patch” of the Alternative Minimum Tax and extension of several business tax breaks, including the 45L credit for new, energy-efficient homes that is due to expire at year-end.

The measure also contains a provision to temporarily increase federal deposit insurance on bank and credit union accounts to $250,000, up from $100,000.

NAHB Chief Economis t David Seiders told the board that there is more than a 50% chance that the economy will lapse into a recession.

Seiders predicted that the long decline in new home sales is in the process of reaching a bottom that will be followed by growth in 2009 that should put new residential construction on a slow, upward path.

The ultimate objective now, he said, is to stabilize home prices and the foreclosure rate. “There is a lot to be fixed here,” he said, “but it is not a doomsday scenario.”

Seiders noted that with Fannie Mae and Freddie Mac now recognized as being fully

backed by the U.S. government and the FHA market growing rapidly there are “large, strong, reliable sources of home mortgage credit” available to help restore the housing market, and regulators will hopefully roll back some of the mortgage underwriting standards that have cut off many prospective home buyers from the credit they need.

“Once we turn the corner” on the housing downturn, he said, “the longer-term outlook is terrific.”

Also on hand to provide some words of encouragement to the NAHB board was Irish ambassador John Bruton, Ireland’s former prime minister and the current head of the European Union delegation to the U.S.

“Credit is about belief, and what the U.S. needs is an injection of confidence,” Bruton said. He predicted that the U.S. will experience “a certain amount of pain or deferred pleasure” to solve its current financial problems.

In its drive to publicize its position on the economic rescue plan and the urgent need for congressional action, NAHB was widely represented in the news media.

In the first two days following the endorsement of the call to action in San Diego, NAHB Executive Vice President and CEO Jerry Howard was interviewed by Reuters, Bloomberg, The Wall Street Journal, CNN Money and Finance &

Commerce Magazine.In addition, NAHB arranged for ABC

Nightly News to interview a builder member in Kansas City to discuss his local housing market as well as the need for Congress to enact the rescue plan.

In the days approaching the decisive House vote, NAHB, along with the U.S. Chamber of Commerce, the National Association of Realtors®, the National Federation of Independent Business and other business groups ran a full-page ad in the Oct. 1 issue of The Washington Post encouraging citizens to call their lawmakers and ask them to pass the rescue plan. The same ad ran in the Oct. 2 editions of USA Today, The Wall Street Journal, The New York Times, the Los Angeles Times, the Chicago Tribune, the Orlando Sentinel, Roll Call, Politico and The Hill.

As leaders in Washington continued to deliberate over the bill, NAHB members e-mailed and phoned their congressional delegations at www.capitolconnect.com/builderlink and the NAHB toll-free legislative hotline, respectively, citing the need for the rescue plan and urging Congress to “act this week to bring stability to the financial markets.”

FALL CLASSiC SWiNGS FOR AFFORdABLE HOUSiNGEven as housing is suffering its most

challenging times, SIBA members came out in October to give a boost to the SIBA BUILD PAC. Plenty of teams and sponsors helped make the 9th annual Fall Classic a successful fundraiser for the SIBA BUILD PAC.

Golfers and sponsors alike are fully aware of the importance of affordable housing in our community. Many companies are directly involved with the housing market. And even more are affected indirectly. A single no-growth law could crush a housing market by driving costs skyward.

The SIBA BUILD PAC helps relay the importance of affordable housing to lawmakers. The Trustees meet and discuss the various local and statewide issues. They provide information and solutions for extending infrastructure and growing the community in ways that are desirable by the community and its people. It’s important to identify which candidates would appreciate growth and development, and which ones don’t.

Fundraisers, like the Fall Classic, help the SIBA BUILD PAC provide assistance to candidates who would make wise decisions for housing and the community.

This spring, the U.S. Environmental Protection Agency (EPA) issued a new rule for renovators and maintenance professionals that work in housing, child-care facilities and schools built prior to 1978 regarding lead-based paint hazards. The rule, titled "Renovation, Repair and Painting Program," requires that contractors and maintenance professionals be certified; that employees be trained; and follow protective work practice standards. The rule does not impact minor interior jobs that disturb six square feet or less of lead-based paint in a room or minor exterior jobs that disturb twenty square feet or less of lead-based paint (window replacement work is excluded). The EPA rule prohibits certain work practices and applies to renovation, repair or painting activities and becomes fully effective April 2010.

Homeowner Education RequirementsThe rule starts at addressing pre-

renovation education by requiring each contractor to distribute EPA's lead pamphlet titled Renovate Right (replacing current pamphlet Protect Your Family from Lead in Your Home) to the owner and occupants before renovation begins beginning December 2008. Renovators will be required to obtain confirmation that the owner, adult representative, or occupants (if applicable) received the lead pamphlet and must be retained on record for three years.

Renovator training and Firm Requirements

The rule states that in order to become a certified renovator an individual must

successfully complete an eight hour initial renovator training course offered by an accredited training provider. The course completion certificate serves as proof of certification. If a renovator has successfully completed an accredited lead abatement worker or supervisor course, EPA, Department of Housing and Urban Development (HUD), or EPA/HUD model renovation training course, a refresher course lasting four hours will be needed to receive certification. The rule requires that renovators must be re-certified every five years by completing a refresher training course provided by an accredited training provider. Training programs can submit curriculum and request for accreditation from EPA beginning April 2009. Training will begin October 2009 with renovators certified by April 2010.

Firms who receive compensation for renovation activities must apply/submit to EPA a completed application and submit a fee beginning October 2009. EPA will approve, deny, declare incomplete, etc within 90 days. EPA may request additional information from applicants which must be provided to EPA within 30 days. A firm certified must be re-certified every five years by completing a required form and pay a fee amount.

Under the rule, firms must be certified and renovators must be trained unless the firm obtained a signed statement from the owner that the renovation will occur in the owners residence; no child under 6 resides

there; no woman who is pregnant resides there; the housing is not a child-occupied facility; and the owner acknowledges that the renovation firm will not be required to use the work practices contained in the rule.

requirements contained in the rule, several of which include: prohibition of using open-flame burning and use of power tools without HEPA exhaust control; work-area containment to prevent dust and debris from leaving the work area; and clean up followed by a verification procedure to minimize exposure to lead-based paint hazards. The rule requires the renovator to wipe the work area with a wet disposable cloth and utilize a cleaning verification card to see if the area passes this inspection. If the area does not pass inspection, the renovator must re-clean areas with another disposable cloth and if it fails again, wait until the area has dried completely or one hour and wipe the area with a dry disposable cleaning cloth.

The rule stipulates documents must be retained for three years after the renovation takes place. Documents required to be kept include: reports certifying that lead-based paint is not present; records relating to the distribution of the Renovate Right pamphlet; the waiver signed and dated if applicable; and a document that displays compliance with the rule (sample documents are available on the EPA Web site.)

The SIBA Officers for 2009 have been elected directly by the board. Now up for election are the Builder and Associate and Remodeler representatives to the board. Positions on the SIBA board have always been 2-year terms, staggered such that only about half of the directors are elected each year. Therefore some of the directors will be completing the second year of the term during 2008, and are not up for election.

AdministrationEPA will be responsible for administering

and enforcing requirements in the rule unless a state submits an application to administer and enforce the rule. In addition to allowing states to administer the rule, it also allows states to make the program more stringent than the federal requirements.

The Indiana State Department of Health has been administering the lead program per a Memorandum of Understanding with the Indiana Department of Environmental Management with intent to seek legislation during the upcoming legislative session to permanently transfer the program. Preliminary signals from the State Department of Health indicate an interest to submit an application for running the program with possible changes to make the program more stringent but details have not been disclosed.

I encourage all renovators to visit www.epa.gov/lead or IBA's Web site at www.buildindiana.org for the complete rule language as well as other important documents such as the Renovate Right pamphlet. IBA will monitor any proposed changes to the rule from the State Department of Health and provide updates. to worry about is that I pick a bank that has money in it. Here we have slaps on the hand, if that even occurs.

Here is another one for you. Before you take any money out of my wages, ask me if I want to pay for it first, or take a vote first. America should get down to the basics and take care of America until we are firmly on our own two feet. Run this country on the morals and rules set for us in the constitution, by the very men and women that gave their lives to found it. If you don’t like it get the hell out.

A lot of people I talk to believe what I said above but they remain quiet about it. We can no longer do nothing. Get out and vote, and let our elected officials know how you feel. If you don’t, sit in the corner and keep your mouth shut, for you had your chance. You know all the gloom and doom above sounds bad but unless you are a quitter this market correction will make us all stronger.

Just thank God for what is going right in your life. I want to share with you a true story of one of my employees. Like most of us, when he and his new bride of a little better than a year, started out, they did not have all the money they needed, and did not think of the unthinkable. One day his wife Misty noticed a red spot that appeared to be growing, and eventually had it checked out. A brown recluse left them fighting an endless infection. After it appeared to have gone away, it reappeared with a vengeance. Once again in the hospital fighting a staph infection and scaring the hell out of everyone. Well it appeared to be beaten again, and back to work she went. Feeling bad she went home, ended up calling 911, passed out, and ended up in the hospital. Donald, her husband, got a phone call while working to get home, an ambulance was at his house. When he got there she was already at the hospital. Once he got to the hospital they were already trying to revive her. He never got to tell her good bye. She was 26. Now just maybe we should count our blessings, and if you would, say a prayer for the both of them.
