Guarding the gates: the expanding liability of gatekeepers of insolvent entitiesAs enterprise values declined during the global recession, creditors and insolvency administrators have attempted to supplement their recoveries from new and deeper pockets, such as lawyers, accountants, bankers and company directors. This multi-jurisdictional panel will discuss the theories and practicalities of bringing claims against these so-called ‘gatekeepers’. The session will also address the impact of these claims on the restructuring process and the circumstances under which the insolvency administrator, rather than creditors, can prosecute the claims.

Hacienda de los Morales, established in 1526 as a silkworm factory, exemplifies traditional Spanish colonial architecture with its huge arches and cracked plaster walls. Until the mid-20th century it was the private residence of several prominent Mexican families. The great painters Jose Maria Velasco, German Gedovius, Daniel Thomas Egerton and Conrad W Chapman used the Hacienda and its landscape in various works. Today it offers visitors a magnificent international restaurant in a traditional Mexican atmosphere.

Those who buy debt in the public markets have been vilified, while the holders of sovereign debt say they are merely trying to collect what they are rightfully owed, regardless of the nature of the borrower. The Franz Mayer Museum opened in 1986 to house, display and maintain Latin America’s largest collection of decorative arts. The collection was amassed by stockbroker and financial professional Franz Mayer, who collected fine artworks, books, furniture, ceramics, textiles and many other types of decorative items. Much of the collection comes from Mexico and other Latin American countries with items dating from the 15th to 20th centuries. The silver collection is one of the most important in Mexico. The museum is housed in the historic centre of Mexico City in the former San Juan de Dios monastery and hospital, an 18th-century structure built on the site of the original 16th century hospital that was destroyed in a fire.

Arbitration and cross-border insolvency: a 21st century global insolvency toolkitFor decades arbitration has been used as a method of resolving large global commercial disputes. It is perceived to be less expensive than litigation and to bridge effectively the vagaries of national judicial systems, with different rules, concepts of the rule of law and procedural anomalies such as fact-finding and years to trial. Arbitration has not historically been part of the insolvency professional’s toolkit – but should it be? This panel of experts, including leaders in the field with ‘hands-on’ experience in third party dispute resolution and adjudication of large, complex cross-border insolvency cases, will discuss the use of arbitration in insolvency proceedings and in the negotiation of sovereign debt workouts.

Update on the new Mexican insolvency legislationMexico’s Ley de Concursos Mercantiles was first enacted in 2000 and amended in 2007. Several major cases were filed under the LCM including the notorious cross-border cases of Vitro and Mexicana de Aviacion. The issues played out in these cases provided the impetus for amendments to the LCM in January 2014. The panel of noted Mexican insolvency practitioners will discuss the significant cases which gave rise to these changes and the newly revised legislation which will foster an efficient and effective insolvency system for the protection of estate assets as well as the rights of creditors and debtors.

made available seven days prior to the conference, your registration form
must be received by 11 May at the latest.
Mobile delegate search application
Delegates are now able to use the mobile delegate search. This application
has been developed to aid networking by giving delegates instant access
to an up-to-date list of their fellow attendees, and comes with the added
benefit of a built-in messaging service. All registered delegates with an

Registration confirmation
All documentation regarding your attendance at the conference can now
be obtained from the IBA website. Upon receipt of your payment for the
conference a confirmation email will be sent containing instructions on
how to download the documents. Registration confirmation will not be
distributed by post.

No deductions or withholdings
All fees payable to us by you in accordance with the terms contained in
this ‘Information’ section shall be paid free and clear of all deductions or
withholdings whatsoever.
If any deductions or withholdings are required by law to be made from any
fees payable to us by you under the terms contained in this ‘Information’
section you shall pay such sum as will, after the deduction or withholding
has been made, leave us with the same amount as we would have been
entitled to receive in the absence of any such requirement to make a
deduction or withholding.
If we obtain the benefit of any tax credit or other relief by reference to any
such deductions or withholdings, then we shall repay to you such amount
as, after such repayment has been made, will leave us in no worse position
than we would have been had no such deductions or withholdings been
required.
Conference sell-outs
The IBA places its conference in venues of a suitable size for the event;
however there are times when our conferences may sell out. Should this
happen, prospective delegates will be informed and a waiting list will
operate. The waiting list will function on a ‘first come, first served’ basis,
subject to receiving registered delegate cancellations. The IBA will not be
liable for any travel or accommodation expenses incurred by an individual
who travels to the conference without a confirmed place at the event.
Continuing Professional Development/Continuing Legal Education
For conference delegates from jurisdictions where CPD/CLE is mandatory, the IBA will provide a Certificate of Attendance for the conference. Subject to CPD/CLE requirements, this can be used by conference delegates to obtain the relevant number of hours’ accreditation.
A CPD/CLE Certificate of Attendance is available to conference delegates on request. Please ask at the IBA conference registration desk for information on how to obtain the certificate.
The organisers may at any time, with or without giving notice, in their absolute discretion and without giving any reason, cancel or postpone the conference, change its venue or any of the other published particulars, or withdraw any invitation to attend. In any case, neither the organisers nor any of their officers, employees, agents, members or representatives shall be liable for any loss, liability, damage or expense suffered or incurred by any person, nor will they return any money paid to them in connection with the conference unless they are satisfied not only that the money in question remains under their control but also that the person who paid it has been unfairly prejudiced (as to which, decision shall be in their sole and unfettered discretion and, when announced, final and conclusive).
Cancellation of registration
If cancellation is received in writing at the IBA office by 10 April, fees will
be refunded less a 25 per cent administration charge. We regret that no
refunds can be made after this date. Registrations received after 10 April
will not be eligible for any refund of registration fees.
Provided you have cancelled your registration to attend an IBA conference
in accordance with the terms of the ‘cancellation of registration’
clause included in the ‘Information’ section of the relevant conference
programme, you must then confirm to us in writing at the IBA office as
soon as possible but in no event later than one year (12 calendar months)
from the date of any such conference all necessary details to enable any
reimbursement owed to you to be paid. We regret that no refunds will be
made after the date that is one year (12 calendar months) after the date of
the relevant conference.
Travel arrangements and visas
Participants are responsible for making their own travel arrangements. It
is recommended that you check your visa requirements with your local
embassy or consulate. We are unable to dispatch visa invitation
letters to support your visa application prior to receipt of your
registration form and full payment of registration fees.

Weather
The climate in Mexico City in mid-May is characterised by essentially
constant daily high temperatures, with daily highs around 27°C (80°F)
throughout the month, exceeding 30°C (86°F) or dropping below 23°C
(73°F) only one day in ten.

Benito Juarez International Airport (MEX) – located 15km (9.3 miles) east
of Mexico City downtown.

Taxi
The best form of transport available from the Benito Juarez International
Airport is taxi. For your safety, we recommend you only use the taxi
services authorised by this airport. The journey costs around US$60 plus
a ten per cent tip. It takes approximately 40 minutes. The St Regis Hotel
offers pick-up service at US$96 and drop off at US$43 (both paid in cash).
The hotel charges ten per cent if charged to the room.
Please note that any reservation made after 10 April will be subject to
availability and cannot be guaranteed at the special IBA rate.
Cancellation and no-show policy
Cancellations received after 10 April and ‘no shows’ will be charged the
group rate plus applicable taxes for the total nights contracted.
Please note that in the event of any cancellations or no-shows, rooms will
be charged to the individual guest’s credit card given at the time of the
booking.
Delegates are responsible for making accommodation reservations
and entering into an agreement with the hotel regarding credit card
guarantees, cancellation/no-show terms and conditions, and room rates
(should these differ from the special IBA rate). The IBA cannot accept

The International Bar Association (IBA), established in 1947, is
the world’s leading organisation of international legal practitioners,
bar associations and law societies. The IBA influences the
development of international law reform and shapes the future of
the legal profession throughout the world. It has a membership of
more than 50,000 individual lawyers and 206 bar associations and
law societies spanning all continents, and has considerable expertise
in providing assistance to the global legal community.
Grouped into two divisions – the Legal Practice Division and the
Public and Professional Interest Division – the IBA covers all
practice areas and professional interests, providing members with
access to leading experts and up-to-date information. Through the
various committees of the divisions, the IBA enables an interchange
of information and views among its members as to laws,
practices and professional responsibilities relating to the practice
of business law around the globe. Additionally, the IBA’s high-
quality publications and world-class conferences provide unrivalled
professional development and network-building opportunities for
international legal practitioners and professional associates.
The IBA’s Bar Issues Commission provides an invaluable forum for
IBA member organisations to discuss all matters relating to law at
an international level.
The IBA’s Human Rights Institute works across the Association
to promote, protect and enforce human rights under a just rule of
law, and to preserve the independence of the judiciary and the legal
profession worldwide.

Insolvency Section overview
The Section on Insolvency is the most prominent international
association of lawyers interested in insolvency and creditors’ rights
law. Members are encouraged to participate actively in the Section’s
work both at its semi-annual conferences and, throughout the year,
through the work of its Subcommittees and through articles in the
Section’s Journal.
The Section serves as an Official Observer to the UNCITRAL Working
Group on Insolvency Law, which it has assisted in developing the
UNCITRAL Model Law on Cross-Border Insolvency and with which it
is currently working to identify areas for harmonisation of domestic
insolvency laws, aimed at ensuring certainty and effectiveness in
cross-border trade and other financial transactions. The Section
works closely, on these and other efforts, with other multinational
institutions concerned with insolvency, such as the World Bank,
the International Monetary Fund, the Asian Development Bank
and the Group of Thirty, as well as with organisations of insolvency
practitioners such as INSOL International, the Association of
European Insolvency Practitioners and national insolvency specialist
organisations.
The role of the Insolvency Section is also to coordinate the activities
of the Insolvency Subcommittees.
Twice yearly, the Section on Insolvency sponsors substantive
educational sessions on the most cutting-edge issues in insolvency
and creditors’ rights, drawing speakers from its members as well
as from government, business and industry, the judiciary and
academia. In conjunction with these sessions the Section sponsors
a networking dinner which has become legend for exceptional
ambience, cuisine and camaraderie.
Latin American Regional Forum overview
The Latin American Regional Forum covers all countries in Latin
America as well as Mexico, Puerto Rico and Spanish-speaking areas
of the Caribbean. The Forum provides a focus for all activities in
the region. The group organises sessions at IBA Conferences and in
particular has been instrumental in ensuring that a Latin American
perspective is addressed during relevant special sessions. The Forum
is closely affiliated with the North American Regional Forum as the
regions are geographically proximate and share many issues.
