Koziol’s 40-p age complaint,f iled in U.S. Distri ct Court on Nov. 10, chronicl es seven years of legal proceed ings and judicial decisions related to an ongoing custody battle with his ex-wife. It names 25 defenda nts, including the State of New York, the New York Unified Court System and Oneida County – and 24 causes of action. In the f irst cause of action alone, Koziol requests $25 million in damages for alleged denia l of due process. He claims the state’s handling of his custody proceeding s amounted to “acts of psychologic al torture … fraud and the exploitation of innocent children” “(The defendants) systematically destroyed productive parent-child relationships that required no state intervention and compelled the victim father and his children to pay for the processes that produced the damage left behind,” he wrote. Koziol, who is known f or handling civi l rights cases, has been an outspoken critic of the way custody and child supp ort cases are handled under the current system. His law license previously was suspended indefini tely after the state App ellate Division, Fourth Department , ruled earlier this  year that he had not made any child suppor t payments as ordered by Oneida County Family Court And more recently, the state appell ate court found him guilty of “profess ional misconduct ” in connecti on with his representati on of five clients. The new suit reiterate s his claim that he is being retaliated agains t by the court system for his criticisms. Other causes of action named in the latest suit include violation of parental rights, unlawful search and seizure, breach of contrac t, cruel and unusual punishment and tyranny. He also has requested a temporary restrain ing order that would reinstate his law license and prevent the state from enforcing child support collection or seizing his assets until the lawsuit had been adjudicated. U.S. District Court Judge David Hurd denied that request on Nov. 15, accordi ng to court documents. The case originally was assigned to U.S. District Court Judge Norman Mordue, but was reassigned to Hurd on Nov. 12.  A spokeswoman for the state Office of Court Administ ration said the state does not comment on pending litigati on. Oneida County Attorney Linda Dillon said the county is being represent ed by private attorney Bart Gorman for this matter. Gorman could not be reached Thursday. In late October, Koziol also filed a notice of claim against Oneid a County and the Town of New Hartford after police seized  vehicles from his New Hartford home using a warrant for his Genesee Street office in Utica.Those claims are included in the current lawsuit. Suspended attorney Leon Koziol f iled a $25 million civil rights lawsuit in federal court recently that lists the entire

state court system as a defendant.

Koziol’s 40-page complaint,f iled in U.S. District Court on Nov. 10, chronicles seven years of legal proceedings and judicial

decisions related to an ongoing custody battle with his ex-wife.

It names 25 defendants, including the State of New York, the New York Unified Court System and Oneida County – and 24

causes of action.

In the f irst cause of action alone, Koziol requests $25 million in damages for alleged denial of due process. He claims the state’s

handling of his custody proceedings amounted to “acts of psychological torture … fraud and the exploitation of innocent

I hope he wins. In New York State the women in divorce have ALL the rights nomatter what!. It may be hard to believe, but there are good fathers out there that want to be a part of thier childs lives, and the ex-wives are so vindictive and self centered that they maks sure ev eryone suffers, including the children, whojust become a pawn in thier games. what i say 1 day agoReport Abuse

It is true there ar e good father's out there whodese rve custody over t he mother, and if they are able to prove their case in court it does happen, I know of many times when a father has received primary custody, however, to say you hope he wins, after this 'good father' ignored a court order to SUPPORT his children, youmay be mistaken! My ex wife had two other 'baby daddys' after me. She does not work and just collect child support from all of us. She dumps the kids off to us ever y chance shegets. I was shocked when I heard she wanted to have even another child by someone else. This is disgusting and the court system needs t o be balanced out andgive us fathers a fair deal. It will take an act of congress for her to lose those kids even though my 15y r old tells me her mother has her babysit 7 kids while shegoes bar hopping.
