6. Compliance with Council Standards All design and construction for the development must be in accordance with Council’s

Policies, Engineering Design Guidelines, Standard Drawings and Standard Construction Specifications.

7. Damage

The developer is responsible for the repair of any damage that is caused to Council’s

infrastructure as a result of the construction works associated with the proposed development. The developer must make any damage safe and then notify Council immediately. Council will make the decision as to who will carry out the rectification works and the timing for the completion of those works.

8. Stormwater Drainage

Stormwater from the site (including roofwater) shall be collected within the property

boundaries and discharged to Council’s existing stormwater system in Eimeo Esplanade.

9. Ponding and Diversion of Stormwater

Ponding of stormwater resulting from the development must not occur on adjacent

sites and stormwater formerly flowing onto the site must not be diverted onto other sites. The site shall be graded so that it is free draining.

10. Existing Services - Water and Sewer

The proposed development must connect to the existing reticulated water and sewer

services provided to the subject site.

11. Live Connections Council’s Water and Waste Services Department is to carry out all water connection and live sewer work at the developer’s expense.

12. Existing First Aid Demountable

The existing first aid room located within the demountable is to be removed from the site.

ASSESSMENT MANAGER’S ADVICE

1. Local Laws

The approved development must also comply with Council’s current Local Laws under the Local Government Act 2009.

2. Hours of Work It is the applicant/owner’s responsibility to ensure compliance with Section 440R of

the Environmental Protection Act 1994, which prohibits any construction, building and earthworks activities likely to cause audible noise (including the entry and departure of heavy vehicles) between the hours of 6:30pm and 6:30am from Monday to Saturday and at all times on Sundays or Public Holidays.

3. Dust Control It is the applicant/owner’s responsibility to ensure compliance with Section 319

General Environmental Duty of the Environmental Protection Act 1994, which prohibits unlawful environmental nuisance caused by dust, ash, fumes, light, odour or smoke beyond the boundaries of the property during all stages of the development including earthworks and construction.

4. Sedimentation Control It is the applicant/owner’s responsibility to ensure compliance with Chapter 8, Part 3C

of the Environmental Protection Act 1994 to prevent soil erosion and contamination of the stormwater drainage system and waterways.

5. Noise During Construction and Noise in General

It is the applicant/owner’s responsibility to ensure compliance with Chapter 8, Part 3B of the Environmental Protection Act 1994.

6. General Safety of Public During Construction It is the principal contractor’s responsibility to ensure compliance with Section 19 (2)

of the Work Health and Safety Act 2011. Section 19 (2) states that a person conducting a business or undertaking must ensure that the health and safety of other persons is not put at risk from work carried out as part of the conduct of the business or undertaking.

It is the responsibility of the person in control of the workplace to ensure compliance with Section 20 (2) of the Work Health and Safety Act 2011. Sections 20 (2) states that the person in control of the workplace is obliged to ensure that the means of entering and exiting the workplace and anything arising from the workplace are without risks to the health and safety of any person.

2.7. ALL FORMED EXPOSED EDGES AND RE-ENTRANT CORNERS SHALL BECHAMFERED OR FILLETED 20mm.

2.8. CONCRETE COVER TO ALL REINFORCEMENT (INCLUDING FITMENTS)SHALL BE AS FOLLOWS UNO:

2.9. CONCRETE SHALL BE COMPACTED BY MEANS OF APPROVED HIGHFREQUENCY MECHANICAL VIBRATORS OF THE IMMERSION TYPE WITHA MINIMUM FREQUENCY OF 120Hz AND WITH SUFFICIENT ENERGYOUTPUT TO ENSURE COMPLETE COMPACTION OF ALL PARTS OF THECONCRETE SECTION.

2.11. CONCRETE FINISHES SHALL BE IN ACCORDANCE WITH THESPECIFICATION. WHERE NOT SPECIFIED OR SHOWN OTHERWISE ONTHE DRAWING CONCRETE FINISHES SHALL BE AS FOLLOWS:

- EXPOSED TRAFFICABLE SURFACES SHALL BE BROOM FINISHED.- THE TOPS OF ALL PLINTHS AND PEDESTALS WHICH ARE TO

SUPPORT BASE PLATES SHALL BE SCABBLED WITH A SURFACEROUGHNESS OF ±2 mm.

4. MISCELLANEOUS

4.4. STARTER BARS TO BE INSTALLED IN EXISTING CONCRETE SHALL BERAMSET CHEMSET REO 502 ANCHORS USING HOT DIP GALVANISED NBARS UNO.

4.5. CAST-IN FERRULES SHALL BE REID STAINLESS STEEL ELEPHANTFERRULES COMPLETE WITH RECOMMENDED CROSS BAR ANDSTAINLESS STEEL BOLTS.

4.8. FOR SUSPENDED FLOORS CONSTRUCTED USING PRECAST CONCRETEFORMWORK, THE INTERFACE BETWEEN EDGES OF SUPPORTINGSTEELWORK AND SOFFIT OF PRECAST CONCRETE FORMWORK SHALLBE SEALED WITH 10x10 GRANOR NEOPRENE SPONGE OAE.

4.9. FOR SUSPENDED FLOORS CONSTRUCTED USING CAST INSITUCONCRETE, THE INTERFACE BETWEEN EDGES OF SUPPORTINGSTEELWORK AND SOFFIT OF CONCRETE FLOOR SHALL BE SEALEDWITH A POLYURETHANE BASED SEALANT (SIKAFLEX OAE).

4.10. FOR CONCRETE CAST AGAINST THE GROUND (INCLUDING BLINDINGCONCRETE), THE MINIMUM ALLOWABLE BEARING CAPACITY OF THEFOUNDATION MATERIAL SHALL BE 150 kPa UNO WHERE INSTRUCTED BYTHE OWNER'S REPRESENTATIVE, UNSUITABLE MATERIAL SHALL BEREMOVED AND REPLACED WITH APPROVED SELECT FILL TO ACHIEVETHIS REQUIREMENT. THE FOUNDATION MATERIAL SHALL BE INSPECTEDBY A QUALIFIED GEOTECHNICAL ENGINEER AND APPROVED BY THEOWNER'S REPRESENTATIVE PRIOR TO ANY REINFORCEMENT ORCONCRETE BEING PLACED.

5. BLOCKWORK NOTES

5.1. ALL WORKMANSHIP AND MATERIALS SHALL BE IN ACCORDANCE WITHTHE CURRENT EDITION OF AS 3700.

5.2. ALL BLOCKWORK SHALL HAVE A MINIMUM CHARACTERISTICUNCONFINED COMPRESSIVE STRENGTH OF 15 MPa AT 28 DAYS UNOAND SHALL BE LAID USING CEMENT MORTAR CLASS M4 IN THEPROPORTIONS 1:4 (GB OR GP CEMENT:SAND) WITH A METHYLCELLULOSE WATER THICKENER.

5.3. THE USE OF OTHER ADDITIVES SHALL BE SUBJECT TO PRIORAPPROVAL OF THE ENGINEER.

5.4. ALL BLOCKWORK SHALL HAVE EVERY REINFORCED CORE GROUTFILLED. EXTERNAL BUILDING WALLS SHALL HAVE ALL CORES GROUTFILLED. CLEAN OUT BLOCKS SHALL BE PROVIDED AT THE BOTTOM OFEACH LIFT IN EVERY CORE TO BE FILLED. CORES SHALL BE CLEANEDAND WET DOWN PRIOR TO GROUTING.

5.5. MAXIMUM HEIGHT OF LIFT FOR CORE FILLING SHALL BE 1.2m.

5.6. GROUT FOR CORE FILLING AND IN PILASTERS, LINTELS AND BONDBEAMS SHALL HAVE A CHARACTERISTIC COMPRESSIVE STRENGTH OF20 MPa AT 28 DAYS, MAXIMUM AGGREGATE SIZE 10 AND SLUMP OF 230.

SAFETY NOTES1. THE DESIGNER HAS PREPARED A SAFETY IN DESIGN (SID) RISK REGISTER IN

ACCORDANCE WITH OCCUPATIONAL HEALTH AND SAFETY LEGISLATION. A COPY OFTHE SID RISK REGISTER IS PROVIDED IN THE CONTRACT DOCUMENTS. THE REGISTERSUMMARISES SOME OF THE MAIN HAZARDS WHICH ARE INTRINSIC TO THE DESIGN. IT ISNOT INTENDED TO COVER CONSTRUCTION RISKS OR OTHER RISKS ASSOCIATED WITHTHE PROJECT. THE CONTRACTOR SHALL TAKE NOTE OF THE RISKS IDENTIFIED IN THESID RISK REGISTER AND ACTION THOSE ITEMS NOTED AS BEING THE CONTRACTORSRESPONSIBILITY.

GENERAL STRUCTURAL NOTES

1. THESE DRAWINGS SHALL BE READ IN CONJUNCTION WITH THE SPECIFICATION. ALLDISCREPANCIES SHALL BE REFERRED TO THE ENGINEER FOR CLARIFICATION PRIOR TOCOMMENCING WORK.

2. REFER TO DRGS A1-000001 TO A1-000007 FOR TYPICAL DETAILS WHICH SHALL APPLY INTHE ABSENCE OF ANY EXPLICIT DETAILS ON DESIGN DRAWINGS.

3. WORKMANSHIP AND MATERIALS SHALL BE IN ACCORDANCE WITH THE SPECIFICATION,RELEVANT CURRENT AUSTRALIAN STANDARDS AND STATUTORY REGULATIONS EXCEPTWHERE VARIED BY THE CONTRACT DOCUMENTS.

4. ALL DIMENSIONS ARE IN MILLIMETRES. ALL CO-ORDINATES, CHAINAGES AND REDUCEDLEVELS ARE IN METRES UNO.

10. ANY MATERIAL NOT FULLY SPECIFIED AND WHICH THE CONTRACTOR PROPOSES TOUSE IN THE WORKS SHALL COMPLY WITH RELEVANT AUSTRALIAN STANDARD (ORINTERNATIONAL STANDARD IN THE ABSENCE OF SUCH A STANDARD) AND BE SUITABLEFOR ITS INTENDED PURPOSE AND ENVIRONMENT. DETAILS OF SUCH PRODUCTS SHALLBE SUBMITTED TO THE ENGINEER FOR APPROVAL.

11. SEALANT USED AS PART OF THE PERMANENT WORKS SHALL BE A POLYURETHANEBASED SEALANT (SIKAFLEX 221 OAE) UNO.

12. ALL MATERIALS SHALL BE USED IN ACCORDANCE WITH THE MANUFACTORERSRECOMMENDATIONS.

13. THE CONTRACTOR SHALL BE RESPONSIBLE FOR THE LOCATION, IDENTIFICATION ANDPROTECTION OF ALL SERVICES AS REQUIRED.

Sustainable Planning Act Appeals Chapter 7 Part 1 Planning and Environment Court: Division 8 – Appeals to court relating to development applications 461 Appeals by Applicants 1) An applicant for a development application may appeal to the court against any of the following - (a) the refusal, or the refusal in part, of the development application; (b) any condition of a development approval, another matter stated in a development approval and the identification or inclusion of a code under section 242; (c) the decision to give a preliminary approval when a development permit was applied for; (d) the length of a period mentioned in section 341; (e) a deemed refusal of the development application. (2) An appeal under subsection (1)(a), (b), (c), or (d) must be started within 20 business days (the applicant’s appeal period) after- (a) if a decision notice or negotiated decision notice is given-the day the decision notice or negotiated decision notice is given to the applicant; or (b) otherwise-the day a decision notice was required to be given to the applicant. 462 Appeals by submitters – General (1) A submitter for a development application may appeal to the court only against- (a) the part of the approval relating to the assessment manager’s decision about any part of the application requiring impact assessment under section 314; or (b) the part of the approval relating to the assessment manager’s decision under section 327 (2) To the extent an appeal may be made under subsection (1), the appeal may be against 1 or more of the following- (a) the giving of a development approval; (b) any provision of the approval including- (i) a condition of, or lack of condition for, the approval; or (ii) the length of a period mentioned in section 341 for the approval. 463 Additional and extended appeal rights for submitters for particular development applications (1) This section applies to a development application to which chapter 9, part 7 applies. (2) A submitter of a properly made submission for the application may appeal to the court about a referral agency’s response made by a prescribed concurrence agency for the application. (3) However, the submitter may only appeal against a referral agency’s response to the extent it relates to- (a) if the prescribed concurrence agency is the chief executive (fisheries)-development that is- (i) a material change of use of premises for aquaculture; or (ii) operational work that is the removal, damage or destruction of a marine plant. (4) Despite section 462(1), the submitter may appeal against the following matters for the application even if the matters relate to code assessment- (a) a decision about a matter mentioned in section 462(2) if it is a decision of the chief executive (fisheries); (b) a referral agency’s response mentioned in subsection (2) 464 Appeals by advice agency submitters (1) Subsection (2) applies if an advice agency, in its response for an application, told the assessment manager to treat the response as a properly made submission. (2) The advice agency may, within the limits of its jurisdiction, appeal to the court about- (a) any part of the approval relating to the assessment manager’s decision about any part of the application requiring impact assessment under section 314; or (b) any part of the approval relating to the assessment manager’s decision under section 327.
