This is the Seventh Cycle Report for the building at 530 Park Avenue, New York City. In the previous report the building was filed as SAFE WITH A REPAIR AND MAINTENANCE PROGRAM (SWARMP). Built circa 1941 (70 years)
The fac;ade is composite brick masonry with punched window openings. The lower floors are trimmed in limestone. There are setbacks at the following floors: 17, 18 & 19 on the street elevations; floors 14, 15, 17, 18 & 19 on the interior elevations. The East Elevation of the building fronts on Park Avenue; the North elevation fronts on 61 st Street. All other fac;ades front on interior lot lines. Appurtenances include railings at setbacks and through-wall AC units.
D. Description of Revisions Since Previous Critical Examination
A "Sixth Cycle" critical examination of the exterior walls and appurtenances in conformance with New York City Local Law 11/98 (i.e., Section 27-129 of the New York City Building Code) was filed on September 19, 2007 by Thorton-Tomasetti, Inc with a "SWARMP" designation. No "Unsafe" conditions were noted. SWARMP conditions were as follows:
• Several corroded steel lintels at the 12th floor • One chipped slate window sill on the 13th floor
A fac;ade maintenance and repair project on floors three (3) through twenty (20) has recently been completed under permit job # 120444518. All SWARMP conditions noted in the previous report have been repaired. Enlargement of some existing window openings on floors three (3) through twerity (20) is being completed under permit job #120408326 and #120036807. The lower two floors are being over-clad; this work is ongoing under permit job #120609948. See Attachment 4.
E. Examination Procedures
The overall visual inspection of all facades consisted of an examination of the exterior walls and appurtenances aided by the use of binoculars as well as close-up inspections during the course of the ongoing fac;ade maintenance project. The examinations were performed from the street, from the various setback roof levels, from the Main Roof level of the building itself as well as from contractor's scaffolds. One dedicated scaffold-based examination for this critical examination was performed on May 09,2011 on the East facing Park Avenue elevation for the height of the building. The drop ran from the 19th floor roof level to the top of the sidewalk bridge at the 2nd floor. Refer to Attachment 2 for a plan showing this drop location - Drawing A-101. On November 29,2011 the QEWI performed the final physical inspection completing the critical examination.

Field Procedures and Analysis Methodology:
The inspection was a non-destructive visual assessment targeting visible suspect ACM. Limited bulk sampling conducted in support of other asbestos inspections at this Site by Airtek have been referenced and made part of this report. Bulk sampling and inspections referenced in this report were conducted according to the following protocols:
Guidelines used for inspections were established by the Environmental Protection Agency (EPA) in the Guidance for Controlling Asbestos Containing Materials in Buildings, Office of Pesticides and Toxic Substances, DOC #560/5-85-024 and 40 CFR Part 763.
Field information was organized as per Homogeneous Area (HA). A HA is defined as a suspect material of similar age, appearance, function and texture. Each material was grouped together as a specific HA, sampled and then assessed for condition.
Bulk samples of suspect ACM were analyzed by Polarized Light Microscopy (PLM) with dispersion staining, as described in 40 CFR Part 763 and the National Emissions Standard for Hazardous Air Pollutants (NESHAPS). The New York State Department of Health has recently revised the PLM Stratified Point Counting Method. The new method, "Polarized Light Microscopy Methods for Identifying and Quantitating Asbestos in Bulk Samples" can be found as item 198.1 in the ELAP Certification manual.
The State of New York ELAP has determined that analysis of Non-friable, Organically Bound Materials (NOB) are not reliably performed by PLM. Therefore, if PLM analysis of a NOB yields a negative result, it must be further confirmed by Transmission Electron Microscopy (TEM).
All samples were initially analyzed by PLM. Samples which produced a negative PLM result and which are classified as a NOB were then re-analyzed utilizing the TEM methodology.

2.0 SCOPE OF WORK:
The following areas were visually inspected for suspect ACM:
All 125 residential units were accessed for visual inspection, with the exception of the eight apartments noted in the visual inspection results tables included in Appendix A to this report. In addition, all six professional offices were inspected. Common areas including the lobby, cellar and hallways, were visually inspected. The inspection was non-destructive in nature. No exploratory demolition was performed to investigate or detect the presence of ACM in interstitial spaces (i.e., within pipe chases and walls).
The inspection was characterized by a close visual inspection of all accessible areas. Suspect materials were inventoried for quantity, condition and friability. Airtek used its own ACM inspection and testing results conducted for construction support purposes to inform our determination of areas and materials to inspect. Materials examined included all suspect ACM materials visible in the accessible residential units, professional offices and common areas.
Asbestos bulk sampling data generated by Airtek was reviewed in support of this report and has been included in this report.
3.0 SUMMARY OF AIRTEK ENVIRONMENTAL INSPECTION RESULTS:
The visual asbestos inspection conducted from 10/12/10 through 10/15/10 and on 11/24/10 involved a thorough visual examination of the accessible areas noted in the tables included in Appendix A. The tables in Appendix A summarize the location, quantity and condition of accessible suspect ACM, and provide recommendations for management of the noted materials.
Bulk sampling performed on the dates noted in Section 1.0 above and laboratory analysis by Airtek andlor its sub-contract laboratories confirmed the presence of asbestos in the amount greater than 1 % within some materials in the building, and confirmed the absence of asbestos in other materials. The tested materials are listed below, and detailed sample data for ACM materials are tabulated in Table B-1 in Appendix B. Detailed sample data for non-ACM materials are tabulated in table B-2 in Appendix B.
Confirmed ACM:
The following materials have been tested and confirmed to be ACM. See Table B-1 in Appendix B for sampling and location details:
1. Pipe Insulation on steam and domestic water lines located primarily in inaccessible pipe chases and radiator run-outs, and below bathroom floors 2. Original Window Caulk on the original window frames. Upper floor frames are enclosed within the aluminum cladding of the current window system. Caulk is accessible at basement windows with no cladding. 3. Vinyl Asbestos Tile and Adhesive Mastic under carpet in the corridors of the residential floors and the service hallway of the ground floor; 4. Vinyl Cove Base and Adhesive Mastic in the corridors of the residential floors; 5. Insulation within Fire-Rated Doors in the building corridors; 6. Brown Expansion Joint Caulk (lower layer) at front entry to the building; 7. Spandrel Beam Waterproofing enclosed within the facades of the building; 8. Flashing Tar on Penthouse Roof.

Non-Suspect ACM Materials:
"Non-suspect ACMs" are materials that have no history of having been manufactured with asbestos as an ingredient. They include, for example, metals, glass, rubber, modem plastics, etc. These materials do not require sampling. The determination of what is a "Non-suspect" material is made by the certified Asbestos Investigatorllnspector.
Suspect ACM:
Per NYC-DEP Title 15, Subchapter 1 all "Building Materials" are to be treated as "Suspect ACM," until tested negative. NYC DEP defines "Building Materials" to mean any and all materials listed as Presumed Asbestos Containing Materials (PACM) and Suspect Miscellaneous ACM in NYSDOL ICR 56, Subpart 5, including but not limited to interior and exterior finishes, eqUipment, plaster, roofing, flooring, caulking, sealants, tiles, insulation, and mortar and refractory bricks used in the construction of boilers.
Any "Suspect ACM" in any other part of the building that has neither been confirmed non-ACM via bulk sampling and analysis, nor via homogenous area material sampling and analysis must be assumed to be ACM and treated as such until tested.
4.0 CONCLUSIONS AND RECOMMENDATIONS:
Asbestos-containing materials which may be affected by construction or renovation work have been positively identified at various locations throughout the building. Immediate action items, if any, are identified in the tables included in Appendix A.
Options for asbestos management include the following:
1. Asbestos Operations & Maintenance Program (O&M Program):
An O&M Program is a documented set of inspection management and maintenance protocols that is designed to allow ACM material to be managed in place until such time as the ACM is removed and disposed.
2. Encapsulation:
Encapsulation is a procedure intended to stabilize friable ACM materials by the application of a penetrating or bridging sealant. The application of an encapsulant is considered and ACM abatement action and must be executed by certified professionals according to all applicable laws and regulations.
3. Enclosure:
Enclosure is the process of building an air-tight structure around ACM materials to prevent their disturbance. Enclosure is like-wise considered and ACM abatement action, and must be executed by certified professionals according to all applicable laws and regulations.

4. Removal:
Removal is the actual removal and disposal of the ACM material, and the cleaning of the ACM material's substrate. ACM removal is considered and ACM abatement action and must be executed by certified professionals according to all applicable laws and regulations.
In the event that the identified ACM or un-tested suspect ACM is to be disturbed by any proposed work, proper asbestos abatement procedures shall be implemented prior to the commencement of such work. All asbestos abatement work shall be performed in accordance with all applicable Federal, State and Local rules and regulations. The abatement project shall be filed with all agencies having jurisdiction over the project, such as US EPA, NYSDOL and NYCDEP. A licensed abatement contractor must perform the removal of all friable and non-friable ACM.
This asbestos inspection report was prepared solely for inclusion in a condominium conversion offering plan for the property located at 530 Park Avenue, New York, NY. If proposed work should change, additional sampling and inspection may be necessary prior to commencement of any proposed work.
To assure that the removal of the aforementioned ACM is properly and effectively carried out, the following recommendations are proposed by Airtek:
A. Develop and implement a schedule that outlines the time frame for removal of ACM. B. Develop complete and concise specifications to effectively deal with removal of the ACM.
These specifications should be developed to comply with all applicable Federal, State and Local regulations.
C. Retain the service of an independent testing laboratory to monitor the air for possible asbestos contamination before, during and after the removal work. Retain all documentation and correspondence from the removal contractor, the testing laboratory and related items in a permanent record.
5.0 AREAS NOT ACCESSIBLE:
Airtek gained access to all areas that were made accessible and all materials that were observable and accessible to the survey personnel. The eight inaccessible residential units are noted in the tables in Appendix A.
6.0 REPORT CERTIFICATIONS and LIMITATIONS:
Airtek certifies that the information contained herein is based on the physical and visual inspections conducted by Airtek and data collected during the inspections and from asbestos inspection reports prepared by Airtek at other times in support of other construction-related tasks.
Airtek conducted this inspection based on information provided by the client. This information, to the extent it was relied on by Airtek, is assumed to be correct and complete. Airtek is not responsible for the quality or content of information from the client. This inspection was conducted only for the specific purpose noted in Section 1.0 above. The information contained in this report should not be used for any other purpose except where the information is determined by a qualified professional to be applicable to that other purpose.

Airtek uses trained and certified inspectors in attempting to locate and quantify materials potentially containing asbestos. Airtek does not warrant that all ACM has been identified. It is possible that additional materials containing asbestos were not identified because they were not visible or accessible to the inspector at the time of the inspection.
