County of Franklin ) Monday, March 23, 2020 Order IN THE MATTER OF ADOPTING LIMITS ON PLACES OF PUBLIC ACCOMMODATION WHEREAS, on March, 17, 2020, the County Com- mission of the County of Franklin, Missouri, adopted Commission Order 2020-123 declaring a State of Emergen- cy in the County of Franklin, Missouri, effective 6:00 p.m. on March 17, 2020, and re- maining in effect until 12:00 noon on April 17, 2020; and WHEREAS, the spread of infectious diseases poses a significant risk to the health, safety and well-being of the people of the County of Franklin, Missouri; and WHEREAS, measures to limit the spread of this virus may place a strain upon the resources of citizens, busi- nesses, municipalities, and the County of Franklin, Mis- souri; and WHEREAS, the Franklin County Health Department (“DPH”) has been closely monitoring an outbreak of respiratory illness caused by COVID-19; and WHEREAS, COVID-19 is considered an infectious, con- tagious, communicable, and dangerous disease for pur- poses of Sections 192.020-1, 192.139, & 193.300, RSMo., 19 CSR 20-20.020, and other state and local laws; and WHEREAS, this order serves to limit the spread of COVID-19 in Franklin County and to limit the spread of such disease with- in Franklin County; and WHEREAS, the County Commission of the County of Franklin, Missouri, has the authority pursuant to the provisions of state law including, but not limited to, Section 192.300 RSMo. to make and promulgate orders, rules or regulations, respectively as will tend to enhance the public health and prevent the entrance of infectious, contagious, com- municable or dangerous diseases into the County of Franklin, Missouri; and WHEREAS, after the promulgation and adop- tion of such orders, rules or regulations by the County Commission of the County of Franklin, Missouri, the County Commission shall make and enter an order or record declaring such orders, rules or regulations to be printed and available for dis- tribution to the public in the Office of the County Clerk, and shall require a copy of such order to be published in some newspaper in the County in three successive weeks, not later than thirty days after the entry of such order, rule or regulation; and WHEREAS, to limit the spread of COVID-19, to pro- tect the public health, and to provide essential protections to the people of the County of Franklin, Missouri, it is reasonable and necessary to impose limited and tempo- rary restrictions on the use of certain places of public ac- commodation. IT IS THEREFORE OR- DERED, beginning imme- diately, all places of public accommodation shall insti- tute appropriate health and safety protections including social distancing techniques (e.g., requiring people to be at least six (6) feet apart; reduc- ing the number of employees, customers, or other people present; reducing face-to-face contact; using phone calls, virtual meetings, and drop- offs/curbside pickups rather than in-person contact). IT IS FURTHER OR- DERED, beginning at 12:01 A.M. on March 24, 2020, the following places of public ac- commodation are closed to ingress, egress, use, and oc- cupancy by members of the public: a. Golf Courses; b. Barbers and Barber Establishments, as those terms are defined in Section 328.010 RSMo.; c. Cosmetologists, Class CH - hairdressers, Class MO - manicurists, Class CA - hairdressers and manicur- ists, Class E estheticians, cosmetology establishments, hair braiders, hairdressers, manicurists, schools of cos- metology or schools of mani- curing, all as defined in Sec- tion 329.010 RSMo.; d. Movie Theaters, de- fined as a theater where movies are shown for public entertainment; e. Concert Halls, defined as a public building for the performance of concerts; f. Gymnasiums; and g. Exercise studios and fitness studios, defined as a building or property where specific gym equipment and other various types of exer- cise classes are offered for people of all ages and abili- ties to exercise or use gym equipment to improve or maintain their health; and h. 17, 2020, the County Com-mission of the County of Franklin, Missouri, adopted Commission Order 2020-123 declaring a State of Emergency in the County of Franklin, Missouri, effective 6:00 p.m. on March 17, 2020, and remaining in effect until 12:00 noon on April 17, 2020; and

WHEREAS, on March 23, 2020 the County Com-mission of the County of Franklin, Missouri, adopted Commission Order 2020-128 ordering certain businesses to close effective 12:01 a.m. on March 24, 2020; and

WHEREAS, the spread of infectious diseases poses a significant risk to the health, safety and well-being of the people of the County of Franklin, Missouri; and

WHEREAS, measures to limit the spread of this virus may place a strain upon the resources of citizens, busi-nesses, municipalities, and the County of Franklin, Mis-souri, and

WHEREAS, the Franklin County Health Department (“DPH”) has been closely monitoring an outbreak of respiratory illness caused by COVID-19; and

WHEREAS, COVID-19 is considered an infectious, con-tagious, communicable, and dangerous disease for pur-poses of Sections 192.020-1, 192.139, & 193.300, RSMo., 19 CSR 20-20.020, and other state and local laws; and

WHEREAS, this order serves to limit the spread of COVID-19 in Franklin County and to limit the spread of such disease with-in Franklin County; and

WHEREAS, the County Commission of the County of Franklin, Missouri, has the authority pursuant to the provisions of state law including, but not limited to, Section 192.300 RSMo. to make and promulgate orders, rules or regulations, respectively as will tend to enhance the public health and prevent the entrance of infectious, contagious, com-municable or dangerous diseases into the County of Franklin, Missouri; and

WHEREAS, after the promulgation and adop-tion of such orders, rules or regulations by the County Commission of the County of Franklin, Missouri, the County Commission shall make and enter an order or record declaring such orders, rules or regulations to be printed and available for dis-tribution to the public in the Office of the County Clerk, and shall require a copy of such order to be published in some newspaper in the County in three successive

weeks, not later than thirty days after the entry of such order, rule or regulation; and

WHEREAS, to limit the spread of COVID-19, to pro-tect the public health, and to provide essential protections to the people of the County of FRANKLIN, Missouri, it is reasonable and necessary to impose limited and tempo-rary restrictions on the use of certain additional places of public accommodation.

IT IS THEREFORE OR-DERED, beginning imme-diately, all places of public accommodation shall insti-tute appropriate health and safety protections including social distancing techniques (e.g., requiring people to be at least six (6) feet apart; reducing the number of em-ployees, customers, or other people present; reducing face-to-face contact; using phone calls, virtual meet-ings, and drop-offs/curbside pickups rather than in-per-son contact).

IT IS FURTHER OR-DERED, beginning at 12:01 A.M. on March 24, 2020, the following places of public ac-commodation are closed to ingress, egress, use, and oc-cupancy by members of the public:

a. Tanning Facilities, de-fined as any location, place, area, structure, or business which provides persons ac-cess to any tanning device for a fee, membership dues, or any other form of compen-sation, or where the body is sprayed with a product con-taining chemicals that react with the skin to produce an artificial suntan; and

b. Martial Arts Facili-ties, defined as any location, place, area, structure or business which provides any form of full-contact martial arts including, but not lim-ited to, full-contact kungfu, full-contact tae kwon do, or any form of martial arts, mixed martial arts, combat or self-defense;

c. Kickboxing Facilities, defined as any location, place, area, structure or business which provides any form of kickboxing in which contestants are allowed to use any form of boxing and are also allowed to use any part of the fist, foot, or leg, with or without shin guards or protective gear, or any combination thereof to de-liver strikes above the waist and which does not consti-tute mixed martial arts as defined by this section;

d. Mixed Martial Arts Fa-cilities, defined as any loca-tion, place, area, structure or business which provides any form of martial arts or self-defense conducted on a full-contact basis and where other combative techniques or tactics are allowed in com-petition including, but not limited to, kicking, striking, chokeholds, boxing, wres-tling, kickboxing, grappling, or joint manipulation;

e. Any location, place, area, structure or business which provides “body pierc-ing,” “branding,” or “tattoos,” as those terms are defined in Section 324.520 RSMo.; and

f. Bowling establishments and skating rinks.
