Dear Fellow Conservatives,
We are pleased to present the American Conservative Union Foundation’s ratings for the 2016 meeting of the Florida Legislature. Like our Congressional Ratings, our State Ratings reflect how elected officials view the role of government in an individual's life. The Florida legislators with the highest scores voted most consistently with the ideals articulated in the U.S. Constitution: limited and transparent government, individual rights, personal responsibility, and lasting cultural values.
In 2015, ACU Foundation was proud to make history by being the first organization to rate every single state legislature across the full spectrum of issues, helping each voter understand how his or her state ranks among the rest.
Ultimately, we are trying to help people understand what conservatism is and how it improves the lives of everyday Americans. Conservatism is the political philosophy that sovereignty resides in the person. We think that understanding this idea is essential if Americans are to successfully govern themselves again.
Working with our policy centers and fellows, the ACU Foundation engages in deep policy analysis to help create our annual state scorecards. We have enhanced the vote descriptions this year to show this effort more clearly.
By examining all 50 of our State Ratings, we can see which states have most effectively promoted conservative solutions and which have struggled. Our ratings also help identify legislators who have courageously fought against liberal majorities. We hope that this guide helps you learn how well, or poorly, your legislators work to preserve the values we share.

SELECTING THE VOTES
ACU researched and selected a range of bills before the Florida Legislature that determine a member’s adherence to conserva-tive principles. We selected bills that focus on Ronald Reagan’s philosophy of the “three-legged stool”: 1) fiscal and economic: taxes, budgets, regulation, spending, healthcare, and property; 2) social and cultural: 2nd amendment, religion, life, welfare, and education; and 3) government integrity: voting, individual liberty, privacy, and transparency. This wide range of issues are designed to give citizens an accurate assessment that conveys which of Florida’s elected leaders best defend the principles of a free society: Life, Liberty and Property.

AMERICAN CONSERVATIVE UNION FOUNDATION’S 2016 Ratings of Florida
1. SB 344 Stand Your Ground. This bill restores the original intent of the “Stand Your Ground” law and shifts the burden of proof to the prosecution on the issue of self-defense. Court rulings have forced defendants to prove they acted in self-defense. ACU supports the right of an individual to act in self-defense and supported this bill. The Senate passed the bill on January 28, 2016 by a vote of 24-12.
2. HB 43 Religious Freedom. This bill gives churches the ability to refuse to perform same sex marriages, ceremonies, or receptions. ACU believes in the constitutional right to practice religion and supported this bill. The Senate passed the bill on March 3, 2016 by a vote of 23-15.
3. HB 1181 Intellectual Property Rights. This bill amends the current Florida law covering patent “demand letters” to modify provisions that made it difficult for legitimate patent holders to protect their intellectual property rights. The bill also eliminates a provision so that a patent holder no longer has to post a bond when seeking to protect his property. Research based on the ACU Foundation’s Family Prosperity Index shows that expanded entrepreneurship promotes economic growth, allowing families to prosper. ACU supports a strong patent system that encourages innovation and inventors and supported this bill. The Senate passed the bill on March 4, 2016 by a vote of 38-0.
4. SB 126 Government Transparency. This bill exempts from public record and meeting requirements any unsolicited proposals for public-private partnership projects when the project pertains to public facilities and infrastructure. ACU supports transparency in government, which includes proposals submitted to the government to receive taxpayer funds, and opposed this bill. The Senate passed the bill on March 4, 2016 by vote of 30-4.
5. HB 1411 Taxpayer Funding of Abortion. This bill makes reforms to the current abortion laws and prohibits taxpayer funds from going to organizations that perform abortions, such as Planned Parenthood, unless those organizations only perform abortions in the case of rape, incest or to save the life of the mother. ACU Foundation’s Center for Human Dignity engages heavily on these issues and believes abortion is a human tragedy, supports restrictions on the practice and ACU supported this bill. The Senate passed the bill on March 9, 2016 by a vote of 25-15.
6. HB 7029 Omnibus Education Bill. This 160 page bill combines many bills into one, including sweeping changes to Florida’s laws covering regular and charter schools. It strengthens school choice by allowing parents to place their children in any school that has not reached capacity and requires a transfer process so parents can request their child be placed in a different classroom. The bill also reforms the charter school laws to add accountability, while at the same time making capital funding more available. While this bill increases regulations on charter schools, ACU supports this bill as a step in the right direction for school choice. The Senate passed the bill on March 11, 2016 by a vote of 29-10.
7. HB 7099 Tax Cuts. This bill provides for numerous tax reductions, including a permanent tax exemption for manufacturing machinery and equipment, reduces the aviation fuel tax, and creates a three day “back to school sales tax holiday” in August, among other reductions. Although the bill provides much less tax relief than proposed by the Governor, ACU supports tax relief and supported this bill as a step in the right direction. The Senate passed the bill on March 11, 2016 by a vote of 35-4.

1. HB 191 Fracking Regulations. This bill establishes a regulatory framework allowing hydraulic fracturing to pump oil and natural gas in Florida. The bill also prohibits local governments from banning fracking. ACU supports all forms of energy and supported this bill. The House passed the bill on January 27, 2016 by a vote of 73-45.
2. HB 163 Open Carry. This bill allows someone with a concealed carry permit to carry the firearm openly. Currently it is a criminal offense to carry a weapon openly, even if the weapon is inadvertently visible. ACU supports the founders’ belief in the Second Amendment and supported this bill. The House passed the bill on February 3, 2016 by a vote of 80-38.
3. HB 4001 Campus Carry. This bill removes the ban on those who have a concealed carry permit from carrying concealed firearms on college and university campuses for protection. ACU supports the founders’ belief in the Second Amendment and supported this bill. The House passed the bill on February 3, 2016 by a vote of 80-37.
4. HB 675 Detention of Illegal Immigrants. This bill requires local governments to detain those people known to be illegal immigrants. The bill also allows the families of those killed by illegal immigrants to sue the local government if those illegal immigrants are released into the community. Furthermore, it allows the Governor to remove local officials who do not move to repeal so-called “sanctuary city” laws. ACU opposes “sanctuary city” policies, supports enforcing the nation’s immigration laws and supported this bill. The House passed the bill on February 3, 2016 by a vote of 80-38.
5. HB 5001 Pafford Amendment Defunding Planned Parenthood. The Pafford amendment to this appropriations bill removes a section that prevents taxpayer funding of Planned Parenthood. ACU Foundation’s Center for Human Dignity engages heavily on these issues and believes abortion is a human tragedy and opposes taxpayer funding of organizations that perform abortions, and opposed this amendment. The House defeated the amendment on February 10, 2016 by a vote of 36-72.
6. HB 669 School Choice. Although only covering public schools, this bill allows parents to choose any public school in the state for their child as long as there is space available and allows parents to request their child be transferred to another teacher. The bill also increases government transparency by allowing parents to get information on the per-pupil spending at their child’s school and authorizing additional audits of school spending. ACU supports parental control over education and increased government transparency and supported this bill. The House passed the bill on February 18, 2016 by a vote of 79-34.
7. HB 1155 Taxpayer Funding of Lawsuits. This bill prohibits using Florida School Board Association taxpayer funds from being used to sue the state. The bill also increases taxpayer accountability by requiring annual state audits and financial reports by the “membership organizations” that use taxpayer funds. ACU supports reforms that increase government transparency and supported this bill. The House passed the bill on February 18, 2015 by a vote of 78-36.
8. HB 1325 Corporate Subsidies. This bill creates the Florida Enterprise Fund to administer $250 million that would be given to businesses chosen by the government as “incentives” to create more jobs. ACU opposes these programs that interfere with the free market and favor one business over another and opposed this bill. The House passed the bill on February 24, 2016 by a vote of 79-39.

This bill makes reforms to the current abortion laws and prohibits taxpayer funds from going to organizations that perform abortions, such as Planned Parenthood, unless those organizations only perform abortions in the case of rape, incest or to save the life of the mother. ACU Foundation’s Center for Human Dignity engages heavily on these issues and believes abortion is a human tragedy, supports restrictions on the practice and ACU supported this bill. The House passed the bill on March 9, 2016 by a vote of 76-40.
13. HB 4027 Red Light Cameras. This bill prohibits the use of automated red light cameras to detect drivers who fails to stop at a traffic signal as of July 2019. ACU opposes automated traffic cameras that are primarily designed to increase revenue, rather than increase safety, and supported this bill. The House passed the bill on March 9, 2016 by a vote of 83-33.
