Although I fully recognize the difficulties surrounding nuclear waste storage and the need for a safe location, I am concerned about several aspects of the proposal. First, although a temporary storage facility is an appealing idea, in reality, the facility is unlikely to remain temporary. Once nuclear waste has been stored there, the incentive to situate a long-term storage facility would dissipate. I am concerned that this prospect has not been taken into account in the consideration of this site. Second, such a temporary site would necesitate additional transportation of high level nuclear waste. I realize that in some cases, waste must be transported. However, the addition of a temporary storage facility inserts an extra leg into the trip the waste must make on the way to permanent disposal. I am writing to express my concern regarding the Private Fuel Storage L.L.C. (PFS)license application with the U.S. Nuclear Regulatory Commission to build and operate acommercial, centralized, away-from-reactor, high level nuclear waste storage facility on the SkullValley Band of Goshute Indian Reservation, Utah. Although I fully recognize the difficultiessurrounding nuclear waste storage and the need for a safe location, I am concerned about severalaspects of the proposal.

The City of Green River, Wyoming, is concerned over the lack of notification from theNuclear Regulatory Commission regarding the transportation of high-level nuclear waste through ourcommunity to the proposed Skull Valley, Utah, facility.

Although we understand that the Skull Valley site is being proposed as a "temporary' storagefacility, nuclear waste will still be transported through our community by rail for years to come.

While our Volunteer Fire Department has an excellent hazards material team, we do not havethe equipment needed to handle an accident involving nuclear waste and the cleanup of such accidentscan cost upwards in the billions of dollars.

We would ask that careful consideration be given to this proposal and that a public hearing beheld in our community informing our citizens as to the health and safety issues.

Our citizens deservereasonable public accessibility to the DEIS, Draft Environmental Impact Statement (a 500 pagetechnical document). The public and the business community need extended time to reviewthe DEIS, bring public awareness to the Issues, and create dialogue for citizens questions.This licensing process has failed to disclose pertinent Information regarding emergencypreparedness, risk factors on the transportation corridors and financial information needed toassure stability for this long-term nuclear waste facility. This information Is needed to furtherUtah's position regarding the citizen's health, welfare and safety. If Utah cannot be providedthis information, the NRC must deny licensing of this facility. I support the 'No ActionAltematvea.

Dear Judge Paul Bollwerk:

I am a seriously concerned resident of Utah in opposition to the Goshute Skull ValleyNuclear Waste Storage Facility. I got involved in this with the realization that I need toparticipate along with our esteemed representatives to try and help prevent this fromhappening-or at the least to demand that the nuclear Regulatory Commission extend thepublic comment period for a minimum of 6 months. There were many residents ofMorgan-who really knew very little facts concerning this serious issue-and manyothers who feel like they can not make a difference. That is when I wrote this followingletter to the editor, and it was published in both local newspapers. There were 215residents mostly from Morgan who stopped by to sign petitions within the last 2weeks.. .there are more who are still wanting to sign, but we are out of time. Enclosed isa copy of the signed petitions, and the letter to the editor.

I don't like admitting to the whole community that sometimes I hide my head in the sandon important issues that hit my panic button. Quite some time ago--I partially heardsomething about Utah being considered for the site of the nations nuclear waste storagefacility somewhere out by Tooele. I dismissed the idea thinking that we had enoughpotential problems just with the nerve gas facility in our back yards (with a moderatewind).. .and tried to optimistically assume Utah would never let this happen. Part ofhaving my head buried means that I do not read the big city newspapers, and onlyoccasionally--half way listen to the news. It helps this ostrich to be more positive aboutthings. Last week a fax came to the real estate office where I work as an assistant officemanager--about the nuclear waste issue. It sounded to me as if Govemor Levitt's effortsalong with the Citizens Against Radioactive Waste In Utah (honorary board memberslike Govemor Norman Bangerter, Mayer Ted Wilson, etc ... ) were at a dead end andabout out of time. What really got my attention was when I read that about 92% of all thenations nuclear waste is generated east of the Colorado River, and that one of the mainroutes by rail would be right through our beautiful little valley on the way to the GoshuteIndian Reservation. There are numerous things that come to mind instantly... most of uslive maybe a quarter mile at most from those tracks-what about derailment, how safe,etc... The biggest thing that bothers me is that it seems like the people that generatenuclear waste should be responsible for storing it, or consider other means of energy.The Citizens Against Radioactive Waste In Utah were asking any concerned UtahCitizens to get a voice with them in opposition to this, or at least to have more time toevaluate this sensitive issue. If anyone would like to sign a petition to let theseindependent energy companies know we are not it favor of this, and that we would likemore answers to their plans-please look for a petition during the next few weeks at

different locations. There will be a petition at Nebco for anyone doing business there orpassing by, also in the lobby of the post office, and at times there will be a table set up atthe Jubilee market or petitions left on the bulletin boards. Mr. Scott Flanders,

I was raised in Skull Valley, Tooele County, Utah and lived in the County for 18 Years. In May of 1945 1deposited two fingers on my right hand to Dugway due to the Air Force's failure to clean up a test site.I have friends and relatives who lived in the area when the Army killed 6600 sheep due to what they calleda 'noxious weed'. Even sheep are not stupid enough to eat weeds which will kill them. A movie called"Ragew was filmed about this incident.

In 1996, I was diagnosed with prostate cancer. No known member of my family on either side was everdiagnosed with cancer. During the war, the Enola Gay crew trained at Wendover and the ground crew wasstationed at Delle where I lived. How much junk was spread around then?

As you can see, I have had plenty of exposure to every type of junk that the government has placed inTooele County. Whether my cancer was caused by this exposure is open to conjecture, but the windsfrom Nevada don't blow only over St. George. I have eaten a lot of dust that blew up from the south overDelle.

I went to school with some of the members of the Goshute tribe and admittedly they are poverty stricken.However, the normal approach in this country is to do things that effect the maximum number of peoplefor good. Moving spent nuclear rods into Utah over our roads and railways does not compute for themaximum good let alone storing them for what will probably be forever as the word "temporary" usuallymeans permanent in government speak. Remember all the "temporary" taxes?

Furthermore, Tooele County is already the most toxic county in the USA. Why must we have the crapfrom the East shipped in too? What is there about the people in the East that they think it is ok for theirjunk to be deposited in my state? Is this more persecution of the Mormons?

Last, but not least, I find myself working almost daily in Tooele County as a Realtor. Can you imagine howdifficult it is to sell property in Tooele County when there is an almost daily spew of TV and newspaperarticles about all the junk that is currently in the county?They say that any leak from the incinerator is dissipated with a few feet of the stack and that the emissionsfrom Magcorp are dissipated within 10 miles. Dissipated to where? The air? The water?

My wife and I have 13 children, 33 grandchildren, 2 great grandchildren, hundreds of extended relatives,friends and neighbors who will be directly effected by the proposed storage of the rods. I must protest asstrongly as possible this transfer which benefits the people who are responsible for the creation of therods, benefits those who enjoyed nuclear power and doesn't do one dang bit of good for the citizens of mystate.

I will carefully consider any reasonable response.

Dear Judge Bollwerk-

We are writing to protest the proposed plan by Private Fuel Storage to "temporarily"store high level nuclear waste fuel rods on the Goshute Reservation in Skull Valley inUtah. We wish to express in the strongest possible terms that this proposal should not beapproved.

Understanding that the fuel rods must be stored somewhere, we feel in Utah's westdesert, we have already accepted more than our share of hazardous waste. The areacurrently houses two chemical weapons incinerators, two hazardous waste landfills,a radioactive waste landfill, the nation's largest toxic air polluter (MagCorp) and amassive bombing range about the size of Rhode Island. Enough is enough!

We feel that the Draft Environmental Impact Statement does not adequately address thefollowing concerns:

1. Earthquake and seismic evaluations are excluded from the DEIS. What wouldhappen to these hazardous waste products if an earthquake (a Utah reality) wereto strike the area?

2. Wildfire danger, including fires sparked by train operations in Skull Valley, hasreceived inadequate evaluation. We are told that Tooele County (the location ofSkull Valley Reservation) has only a volunteer fire department and the closestteam qualified to respond in the event of such a disaster would be in California.What would be happening to the citizens of Utah before such a team arrived, andonce it did, what damage would-we already be exposed to?

3. The storage casks are not designed for long-term storage, yet they would be housedin Utah for at least 40 years. What if the Yucca Mountain, Nevada permanentrepository fails to open? Severe scientific problems have been found with theYucca Mountain site, and even if it were to open, its capacity cannot containall the high-level waste that would exist. Could wastes remain in Utah becausethere is no place else to take them? We oppose both short-term storage and thelikelihood of this becoming long-term.

4. Impacts of transportation accidents and the equipment and costs needed to respond

are not adequately considered. It is not enough to simply say that there has neverbeen an accident before.

5. PFS' financial responsibility and liability are not addressed. As a limited liabilitycorporation, PFS and the eight nuclear utility member companies forming it wouldnot be held financially liable for any problems that might develop at the Skull Valleydump site. If PFS and its member companies are so confident in the safety of theirproposal, why are they so reluctant to back it up with financial assurance?

The bottom line is the proposed site would affect all of us in the Salt Lake Valley and notonly the Goshute Indian people whose land it would be located on. Why should we allaccept the risks and worry of this facility when only the Goshutes who are desperate formoney are willing. We have already been "down wind" of more than our share ofhazardous waste facilities, and both leaders and citizens are strongly opposed. Iftemporary storage is so safe, then high level nuclear waste, generated in another part ofthe country, can stay where it is. There is no reason dry cask storage cannot be used atthe reactor sites where the waste is currently located, thus eliminating the possibility oftransportation accidents.

We have the Tooele Arms Depot in whichthousands of active ammunitions are stored; the USArmy's chemical weapons incinerator and now thisproposal for storage of highly radioactive nuclearwaste that was not even generated by the citizens ofUtah. We have not had reasonable public access to theDraft Environmental Impact Statement. We needextended time to review it and bring public awarenessto this issues. I oppose the opening of the Goshute Skull Valley Nuclear waste storage facility. This issuebears enormous significance and will negatively impact the state of Utah. Our citizens deservereasonable public accessibility to the DEIS, Draft Environmental Impact Statement (a 500 pagetechnical document). The public and the business community need extended time to reviewthe DEIS, bring public awareness to the issues, and create dialogue for citizens questions.This licensing process has failed to disclose pertinent information regarding emergencypreparedness, risk factors on the transportation corridors and financial information needed toassure stability for this long-term nuclear waste facility. This information is needed to furtherUtah's position regarding the citizen's health, welfare and safety. If Utah cannot be providedthis information, the NRC must deny licensing of this facility. I support the 'No ActionAlternatve".

I urge you to extend the public comment period for a rnimimum of six months

Dear Judge Bollwerk:

As Mayor of North Ogden City, I am writing to you to express my concerns on the proposeddevelopment of a high-level nuclear waste storage facility in Skull Valley, Utah.

The spent nuclear fuel that would be transported through our community as well as others en route toSkull Valley is the most irradiated substance on earth and is dangerously radioactive for thousands ofyears, and the potentially unprecedented risks for a potentially long period of time, is unacceptable.The future of our children and their children, and their children must not be risked even on a"temporary" basis.

Our city is north of the proposed sight, and the potential threat to the health and safety of ourcommunity is such, that I am imploring you to consider more public hearings and further dialogue onthis issue, not only in our community but in any community along any of the transportation routes.

The fact remains that the farther you have to transport such material, the higher the risks. The risk ofdamage to the casks and causing contamination is higher, the condition of the railway tracks is notthe greatest, not to mention the easier accessability transportation would give to terrorists. These arejust a few of the risks that concern our community.

This is a letter of protest to establishing a nuclear wastedump on the Goshute Reservation or any other site in thestate of Utah.

Reasons for not locating a nuclear waste dump on the GoshuteReservation are as follow:Tn case of an accident public health consequences would bedevastating, especially to infants, children and pregnantwomen. People could not evacuate fast enough to escape rad-iation exposure.

The proposed site is in a seismic zone.

Waste shipped by train or truck pose a real possibilty oftrain de-railments or truck accidents.

Property values along nuclear waste transport routes woulddecline because of the devastating consequences of an acc-ident. Property values within 50 miles of the site could decline.

The stigma of having the largest nuclear waste dump in theworld would be economically harmful to Utah and the SaltLake City area.

Neither homeowners insurance nor health insurance coversproblems caused by radioactive waste accidents.
