COMPLAINT FOR DECLARATORY AND INJUNCTIVE RELIEFPlaintiffs, for
their Complaint for Declaratory and Injunctive Relief, state:
I NATURE OF THE ACTION1 Plaintiffs bring this action to
challenge the constitutionality of Arkansas s
laws excluding same-gender couples from marriage and forbidding
recognition oflegitimate same-gender marriages entered into in
other states. Arkansas Constitution,Amendment 83; Ark. Code Ann.
9-11-208; and Ark. Code Ann. 9-11-107(b).
2 Plaintiffs seek a declaration that Amendment 83 and the
referencedstatutes violate the right to equal protection and due
process of law under theFourteenth Amendment to the United States
Constitution. Plaintiffs also seek aninjunction prohibiting the
State of Arkansas, and all political subdivisions thereof,
fromenforcing Amendment 83 or the referenced statutes. Declaratory
relief is sought under
