Dear Sir/Madam, Re: Request to renew Special Rate and Charge for Greensborough Town Centre As you may be aware a Special Rate and Charge scheme to collectively market and promote Greensborough Town Centre has been operating for the last 14 Years. The current 5 year program expires 30 June 2012. Council has received a request from the Greensborough Chamber of Commerce to commence the statutory process to declare a new special rate and charge for another 5 year program commencing 1 July 2012 to 30 June 2017. The purpose of this letter is to advise you of this request and inform you that Council will be formally proceeding with the statutory process to recommence the scheme over the coming months. The current program raises approximately $105,000 per annum collectively from the commercially rated properties located in the Town Centre. The Town Centre includes properties in Grimshaw Street, Main Street, Flintoff Street and Hailes Street East including the businesses located within the Greensborough Plaza. The amount raised from the rate and charge is currently matched by Council to provide a total budget of approximately $210,000 annually for the purposes of marketing, business development and physical beautification of the Greensborough Town Centre. Attached is a document from the Greensborough Chamber of Commerce which provides more specific information regarding the achievements associated with the scheme over the past five years. The Greensborough Chamber of Commerce have been working over the last 6 months to develop a new 5 year business plan which sets out the future key actions and directions for the Town Centre and a guide on how the special rate and charge funds will be expended. This has now been finalised and a copy can be obtained by contacting Centre Manager, Noella Jacobs on 0403 502 348. The Chamber of Commerce is proposing that the Special Rate and Charge for the next 5 years be increased to collect approximately $134,000 per annum and it would be structured as follows;

Primary Benefit Area – Properties outside the Greensborough Plaza Includes- Main Street, Grimshaw Street, Flintoff Street and Hailes Street East. Approximately $113,000 levied from the above properties collectively per annum. This to be calculated based on a rate in dollar of the commercial value of the property, with a minimum amount payable by each property of $250 per annum. Secondary Benefit Area – Properties located inside the Greensborough Plaza complex and managed by Lend Lease. Balance of approximately $21,000 being levied through a flat charge of $100 per property per annum The Chamber of Commerce informs us that they have consulted with the businesses across the Town Centre including representatives from the Plaza and there has been opportunity for feedback on the previous scheme as well as input into future priorities. PROPOSED DECLARATION The Greensborough Town Centre Special Rate and Charge Scheme

1. The Banyule City Council (Council) proposes to declare a combination of a

Special Rate and Charge (Special Rate and Charge) under section 163(1) of

the Local Government Act 1989 (Act) for the purposes of defraying expenses

to be incurred by Council in providing funds to the incorporated body known

and operating as the Greensborough Chamber of Commerce (Chamber of

Commerce), which funds, subject always to the approval, direction and control

of Council, are to be used for the purposes of the appointment of a part time

professional Centre Manager, promotional, advertising, marketing, business

development and other incidental expenses as approved by Council and

agreed to from time to time between Council and the Chamber of Commerce,

all of which are associated with the encouragement of commerce, retail and

professional activity and employment in the Greensborough Town Centre

(Precinct or Scheme).

2. The criteria which form the basis of the proposed declaration of Special Rate

and Charge are the ownership and the capital improved value of rateable land

used, or reasonably capable of being used, for commercial, retail or

professional purposes, which rateable land is situated within the geographical

area in which the properties described in paragraphs 6 and 7 of this proposed

declaration are included and, further, the classification of those properties as

receiving either a “primary” or a “secondary” special benefit, having regard to

the nature and characteristics of the properties and businesses included in

each of the two areas.

3. In proposing the declaration of Special Rate and Charge, Council is performing

functions and exercising powers in relation to the peace, order and good

government of the municipal district of the City of Banyule, in particular the

encouragement of commerce, retail activity and employment opportunities

within the area for which the proposed Special Rate and Charge is to be

declared.

4. The total cost of the performance of the function and the exercise of the power

the proposed Special Rate and Charge is to be declared) and also the total

amount of the Special Rate and Charge to be levied by Council is referrable to

an amount of $134,100, which amount, it is proposed, will be levied in each

year of the Scheme and which in total will raise an amount of $670,500 over

the 5 year period of the Scheme.

5. The period for which the proposed Special Rate and Charge is to be declared

and is to remain in force is a period of 5 years commencing on 1 July 2012 and

ending on 30 June 2017.

6. The area for which the proposed Special Rate and Charge is to be declared is

all of the land referred to as the Precinct, as identified and shown on the plan

set out in the schedule forming a part of this proposed declaration (being

Schedule 1).

7. The land in relation to which the proposed Special Rate and Charge is to be

declared is all that rateable land described in the listing of rateable properties

set out in the schedule forming a part of this proposed declaration (being

Schedule 2).

8. The contributions to the proposed Special Rate and Charge, based on relevant

property classifications in relation to “primary” and “secondary” special benefit,

will be declared and assessed in accordance with the Special Rate and Charge

amounts set out alongside each property in the schedule forming a part of this

proposed declaration (being Schedule 2). Properties included in the “primary”

special benefit area have been assessed based on the capital improved value

of each property multiplied by an amount of 0.061971, combined with a

minimum charge of $250 in each year. Properties included in the “secondary”

special benefit area will be liable or required to pay a flat charge of $100 in

each year.

9. The proposed Special Rate and Charge will be levied by Council sending a

Notice of Levy in the prescribed form annually to the person who is liable to pay

the Special Rate and Charge, which will require that the Special Rate and

Charge must be paid in the following manner -

(a) by one annual payment to be paid in full by the due date fixed by Council

in the notice, which will be a date not less than 30 days after the date of

issue of the notice; or

(b) by four instalments, to be paid by the dates which are fixed by the Council

in the notice.

10. Council will consider cases of financial and other hardship, and may reconsider

other payment options for the Special Rate and Charge.

11. Council considers that there will be a special benefit to the persons required to

pay the Special Rate and Charge because there will be a benefit to those

persons that is over and above, or greater than, the benefit that is available to

persons who are not subject to the proposed Special Rate and Charge, and

directly and indirectly as a result of the expenditure proposed by the Special

Rate and Charge, the viability of the Precinct as a business, commercial, retail

and professional area, and the value and the use, occupation and enjoyment of

the properties and the businesses included in the Special Rate and Charge

Scheme area will be maintained or enhanced through increased economic

activity.

12. Council further considers, and formally determines for the purposes of sections

163(2)(a), (2A) and (2B) of the Act, that the estimated proportion of the total

benefits of the Scheme to which the performance of the function and the

exercise of the power relates (including all special benefits and community

benefits) that will accrue as special benefits to all of the persons who are liable

to pay the Special Rate and Charge is in a ratio of 1:1 (or 100%). This is on the

basis that, in the opinion of Council, all of the services and activities to be

provided from the expenditure of the proposed Special Rate and Charge are

marketing, promotion and advertising related and will accordingly only benefit

the owners and occupiers of those properties and businesses included in the

Scheme that are used, or reasonably capable of being used, for retail,

commercial or professional purposes.

PROPOSED DECLARATION The Macleod Village Shopping Centre Special Charge Scheme

1. The Banyule City Council (Council) proposes to declare a Special Charge

(Special Charge) under section 163 (1) of the Local Government Act 1989

(Act) for the purposes of defraying expenses to be incurred by Council in

providing funds to the incorporated body known and operating as the Macleod

Village Traders’ Association Incorporated (Traders’ Association), which funds,

subject always to the approval, direction and control of Council, are to be used

for the purposes of the appointment of a part time marketing coordinator,

promotional, advertising, marketing, business development and other incidental

expenses as approved by Council and agreed to from time to time between

Council and the Traders’ Association, all of which are associated with the

encouragement of commerce, retail and professional activity and employment

in The Macleod Village Shopping Village Precinct (Precinct or Scheme).

2. The criteria which form the basis of the proposed declaration of Special Charge

are the ownership of rateable land used, or reasonably capable of being used,

for commercial, retail or professional purposes, which rateable land is situated

within the geographical area in which the properties described in paragraphs 6

and 7 of this proposed declaration are included and, further, the classification of

those properties as receiving a “primary” or a “secondary” special benefit.

3. In proposing the declaration of Special Charge, Council is performing functions

and exercising powers in relation to the peace, order and good government of

the municipal district of the City of Banyule, in particular the encouragement of

commerce, retail activity and employment opportunities within the area for

which the proposed Special Charge is to be declared.

4. The total cost of the performance of the function and the exercise of the power

by Council (in relation to activities associated with the encouragement of

commerce, retail activity and employment opportunities in the area for which

the proposed Special Charge is to be declared) and also the total amount of the

Special Charge to be levied by Council is referrable to an amount of $19,650,

which amount, it is proposed, will be levied in each year of the Scheme and

which in total will raise an amount of $98,250 over the 5 year period of the

Scheme.

5. The period for which the proposed Special Charge is to be declared and is to

remain in force is a period of 5 years commencing on 1 July 2012 and ending

on 30 June 2017.

6. The area for which the proposed Special Charge is to be declared is all of the

land referred to as the Precinct, as identified and shown on the plan set out in

the schedule forming a part of this proposed declaration (being Schedule 1).

7. The land in relation to which the proposed Special Charge is to be declared is

all that rateable land described in the listing of rateable properties set out in the

schedule forming a part of this proposed declaration (being Schedule 2).

8. The contributions to the proposed Special Charge, based on relevant property

classifications in relation to “primary” and “secondary” special benefit, will be

declared and assessed in accordance with the Special Charge amounts set out

alongside each property in the schedule forming a part of this proposed

declaration (being Schedule 2). Properties included in the “primary” special

benefit area will be liable or required to pay $480 per year. Properties in the

“secondary” special benefit area will be liable or required to pay $375 per year.

9. The proposed Special Charge will be levied by Council sending a Notice of

Levy in the prescribed form annually to the person who is liable to pay the

Special Charge, which will require that the Special Charge must be paid in the

following manner -

(a) by one annual payment to be paid in full by the due date fixed by Council

in the notice, which will be a date not less than 30 days after the date of

issue of the notice; or

(b) by four instalments, to be paid by the dates which are fixed by the Council

in the notice.

10. Council will consider cases of financial and other hardship, and may reconsider

other payment options for the Special Charge.

11. Council considers that there will be a special benefit to the persons required to

pay the Special Charge because there will be a benefit to those persons that is

over and above, or greater than, the benefit that is available to persons who are

not subject to the proposed Special Charge, and directly and indirectly as a

result of the expenditure proposed by the Special Charge, the viability of the

Precinct as a business, commercial, retail and professional area, and the value

and the use, occupation and enjoyment of the properties and the businesses

included in the Special Charge Scheme area will be maintained or enhanced

through increased economic activity.

12. Council further considers, and formally determines for the purposes of sections

163(2)(a), (2A) and (2B) of the Act, that the estimated proportion of the total

benefits of the Scheme to which the performance of the function and the

exercise of the power relates (including all special benefits and community

benefits) that will accrue as special benefits to all of the persons who are liable

to pay the Special Charge is in a ratio of 1:1 (or 100%). This is on the basis

that, in the opinion of Council, all of the services and activities to be provided

from the expenditure of the proposed Special Charge are marketing, promotion

and advertising related and will accordingly only benefit the owners and

occupiers of those properties and businesses included in the Scheme that are

used, or reasonably capable of being used, for retail, commercial or

professional purposes.

The Macleod Village Traders’ Association (“Traders’ Association”) has formally requested that Council renew the current Special Charge for a further 5 year period, commencing on 1 July 2012. The information obtained by the Traders’ Association was then used to assist in the development of a draft Business Plan for the Macleod Village. Based on this review, consultation and initial indication of support, Council resolved, on 21 May, of its intention to declare a Special Charge for the Macleod Village in accordance with section 163 of the Local Government Act 1989 (“Act”). A copy of the Council report in relation to this matter can be viewed on Council’s website on www.banyule.vic.gov.au or by contacting Council’s Economic Development Unit on 9457 9813. The special charge – an investment fund to facilitate effective business and marketing activities The re-establishment of the Special Charge, raising $19,650 per annum over the next five years, will be a partnership between the business operators, property owners and the Council in order to proactively encourage commerce and business activity within the Macleod Village Precinct. Council considers that this will enable the entire retail precinct to be strongly positioned through joint promotion, marketing

and business development activities. A Special Charge can play a critical role in helping to fund these activities. How is the amount proposed per property calculated? Council has a total of eleven shopping strips with Special Rate or Special Charge Schemes in place, with varying models for calculating the levied rates and charges. The proposed model for the Macleod Village is a flat charge of $480 per annum for each property located in the primary benefit area and $375 per annum for each property located in the secondary benefit area. Council believes that the property which you own or occupy (together with all of the properties included in the Scheme) will derive a ‘special benefit’ from the expenditure of the Special Charge funds. If Council proceeds to declare the Special Charge, each person liable to pay the Special Charge will receive a levy notice to pay the amount of the Special Charge each year over a period of five years (this is in addition to the normal Council General Rates and Charges). Council funding contribution Special Rate and Special Charge Schemes operate in many shopping strips throughout Melbourne. Banyule City Council is one of the few Councils that provide a significant contribution to the amount collected. If this Special Charge Scheme is successfully declared, Council will contribute $18,400 to the $19,650 raised from the Scheme to provide a total annual budget of $38,050 The funding contribution provided by the Council enables the Traders’ Association (with Council’s assistance) to address a number of other budget items such as beautification, safety and security, maintenance and streetscape improvements.

What will the money be spent on? The expenditure of the proceeds of the Special Charge will be guided by the Macleod Village 2012 - 2017 Business Plan, which is currently in draft format and in the process of being finalised. The Business Plan identifies strategic directions for the entire Precinct and initiatives include: • Redesign the Macleod Village website to include an online business directory, the

annual calendar of special promotional events as well as a further development of Facebook facilities

• Further develop the Macleod Village brand highlighting the points of attractiveness and difference and create an awareness campaign around this

• Develop and implement an awareness campaign about the Macleod Village ‘brand’

• Continue to develop Macleod Village merchandise, for example; shopping lists and re-useable shopping bags

• Continue to develop marketing links with sporting and other community organisations that are connected with Macleod, and engage in cross-marketing activities

• Develop a annual calendar of events that highlights distinctive aspects of the centre – food, lifestyle and health

• Continue to facilitate training and motivational programs to address issues such as shop presentation, signage, visual merchandising, and customer service

• Encourage stronger communication, joint customer databases and cross-marketing (e.g., exchange of gift vouchers) among businesses. Promote the cross-marketing initiatives

• Continue to lobby Council and VicRoads for the establishment of large new signs on major roads and at other key locations

• Continue to run a graffiti removal program in the centre • Facilitate further security cameras in the centre • Continue to produce the “Village Vibes” trader’s newsletter on a monthly basis Who manages the special charge funds collected? The Traders’ Association has been appointed by the Council to administer the proceeds of the Special Charge. Council requires the Traders’ Association to have a high level of financial and management accountability of the funds. This will include requirements such as the submission of an annual plan at the beginning of each year, quarterly reports and an audited financial report at the conclusion of each year. Additionally, the Traders’ Association will be required to enter into a funding agreement with the Council to confirm that the Traders’ Association will, at all times, be acting in an administrative capacity only on behalf of the Council and only in accordance with the requirements and purposes for which the Special Charge Scheme has been declared. Who will pay the special charge? The owner of a property is primarily liable to pay the Special Charge. However, many landlords have leasing arrangements which allow the Special Charge to be passed on to the tenant (for example, if the tenant is responsible for all out-goings). The decision about who is ultimately liable to pay the Special Charge is a matter between the landlord and the tenant under the terms of any lease arrangements. Council wants you to be fully informed I have enclosed for your information a copy of the Public Notice of Intention to Declare the Special Charge that appeared in the “Banyule and Nillumbik Weekly” on 29 May 2012. The Public Notice outlines the purposes for which the Special Charge is being raised and the manner in which it will be collected. Furthermore, Council has written to all property owners and tenants in the Macleod Village and has provided them with a copy of the Public Notice. It is important that you tell Council how you feel about this proposal now Council would like to hear from as many persons as possible in relation to this proposal, so that it is able to make an informed decision about whether or not to declare the Special Charge. You can tell Council how you feel about the proposal by making a submission under sections 163A and 223 of the Act and/or an objection under section 163B of the Act in relation to the proposal. You can make a written submission or objection to the Council Please make your submission and/or objection in relation to the proposed declaration of the Special Charge in writing and lodge it with the Council by Monday, 2 July
