Chapter 260. Zoning
Article XI. M-1 Manufacturing District, Limited
§ 260-91. Purpose.
The purpose of this article is to establish and preserve areas for limited manufacturing and related uses of such a nature that do not create serious problems of compatibility with other land uses and to make provisions for certain kinds of manufacturing uses which are most appropriate located as neighbors of manufacturing uses or which are necessary to serve the immediate needs of people in these areas.
§ 260-92. Permitted uses.
In the M-1 District, the following uses are permitted by right:
Airports and airport-related services.
Automobile service stations, automobile sales, trailer coach sales, service garages, autosales lots, automobile assembling, auto body shops, painting, upholstery reconditioning,vehicle repair or overhauling, tire retreading or recapping, welding shops and the like.
Blacksmith and machine shops.
Bottling works and bookbinding.
Building materials storage, lumberyards and lumber mills.
Business identi cation signs, when erected and maintained in accordance with theprovisions of Article XVII appearing herein entitled "Signs."
Carpenter, cabinetmaking, furniture repair and upholstery, electrician, metalworking,tinsmith, plumbing, gas, steam or hot-water tting shops.
Contractors' equipment, sales, service and storage.
Distribution plants, parcel delivery and service industries.
Electrical, optical and textile manufacturing.
Freight and trucking terminals.
Hospitals.
Kennels.
Laboratories and lithographing.
Laundries, cleaning, dyeing and carpet and rug cleaning.

Manufacturing, compounding, processing or treatment of such products as bakerygoods, candy, cosmetics, dairy products, drugs, pharmaceuticals and food products,except sh and meat products, sauerkraut, vinegar, yeast and the rendering or re ningof fat and oils.

Printing and newspaper publishing.
Public and private recreational uses and activities, such as parks, day camps, picnicgrounds, golf courses, boat launching and swimming areas, hiking and horseback ridingtrails, wildlife and nature preserves, game farms, sh hatcheries and shing areas.
Public utility transmission and distribution facilities, including substations, waterpumping stations and reservoirs.
Railway or bus passenger stations and telegraph or express o ces.
Wholesale businesses, warehouses and cold storage plants; however, no warehouse andno wholesale business shall be permitted to store, handle or receive any hazardousmaterials or hazardous chemicals, including but not limited to corrosive liquids,
ammable solids, oxidizing materials, poisonous gas and radioactive material [exceptmanufactured articles such as instruments or electronic apparatus whose gammaradiation is less than 10 milliroentgen in 24 hours, highly toxic material or unstable(reactive) chemicals], and any existing business constituting a nonconforming use shallbe permitted to expand in area no more than 25% at such location as it is found to belawfully in existence.
All uses similar to the above and not otherwise prohibited by law.

§ 260-93. Special exception uses.
In the M-1 District, the following uses are permitted by special exception:

Adult-oriented business, as de ned in Article II herein in accordance with Subsection B.
Other uses which, in the opinion of the Zoning Hearing Board, are of the same generalcharacter as uses set forth in Article XI, § 260-92, and which will not be detrimental tothe intended purpose of this chapter.
Wind energy facility in accordance with § 260-203.
Communication antennas, towers etc., in accordance with § 260-193.
A special exception shall be approved for an adult-oriented business only if the followingconditions are met:
The property shall not be located within 300 feet of a residential district, as measuredfrom lot line to residential district boundary, or within 100 feet of any propertycontaining a dwelling, as measured from lot line to lot line.
The property shall not be located within 300 feet of the lot or property line of anyreligious structure, school, day-care facility, library or public park, as measured from lotline to lot line.
The property shall not be located within 1,000 feet of another adult-oriented business,as measured from lot line to lot line.
There shall be no display of adult-oriented materials that can be seen from the exteriorof the building.
The Zoning Hearing Board shall review and approve all exterior signs for compatibilitywith adjacent uses.
No adult-oriented business or activity may change to another type of adult-orientedbusiness or activity except upon application to and approval by the Zoning HearingBoard of such change as a special exception.
No unlawful sexual activity or conduct shall be performed or permitted.
No person under 18 years of age will be permitted to enter the business.
§ 260-94. Use limitations.
The uses permitted in §§ 260-92 and 260-93 are permitted only on the condition that they arenot obnoxious or o ensive by reason of the emission of odor, dust, smoke, noise, gas, vibration,illumination, refuse matter or water-carried waste.
§ 260-95. Height restrictions.
The height of a principal building shall be not greater than 35 feet.
§ 260-96. Yards.
Each lot shall have front, side and rear yards of not less than the depth or width indicatedbelow:
Front yard depth: 30 feet.
Two side yards, 10 feet in width, each side of a principal building, provided that any lot adjoining a residential district shall have a side yard of width not less than the

minimum width required in the adjoining residential district. No side yard shall berequired where two or more manufacturing uses abut side to side and a writtenagreement between the adjoining property owners is provided. However, in no caseshall party walls be permitted between properties of separate ownership.
Rear yard depth: 30 feet.
As a special exception, front, side and rear yards may be modi ed by appeal to the ZoningHearing Board.
§ 260-97. Lot coverage.
The building coverage ratio shall not exceed 60%.
The total coverage ratio shall not exceed 90%.
A minimum of 10% of the lot shall be prepared and maintained as green space, containinggrass or other ground cover and appropriate shrubbery or similar plantings. Thisrequirement shall be met for all new development and at the time of any substantialimprovement or redevelopment.
§ 260-98. O -street parking.
Parking shall be provided in accordance with the provisions of Article XVI.
