APPLICANT’S RESPONSIBILITY

The burden of proof for an applicable hardship and justification of proposal lies with the

applicant. The applicant or the applicant’s agent must be present at the meeting. Failure to

appear at the meeting is grounds for denial of the variance request.

CHAPTER 20.90.010, BOARD OF ADJUSTMENT, AUTHORITY

A board of adjustment is established as authorized by §76-2-321 through §76-2-328, MCA. The

board of adjustment is responsible for conducting public hearings and making decisions in

accordance with the procedures of this zoning ordinance and state law.

BOARD OF ADJUSTMENT HAS THE AUTHORITY TO REVIEW:

1. Variance Requests (Section 20.85.090)

2. Appeals of Administrative Decisions (Section 20.85.100)

3. Special Exceptions (Section 20.75.090) and Sign Variances (Section 20.75.130)

VARIANCE APPROVAL

An approved zoning variance will lapse and have no further effect 2 years after it is granted by

the board of adjustment or 2 years after a final court order is issued (if the variance is the subject

of litigation), unless all of the following occur:

a) a building permit has been issued (if required);

b) a zoning compliance permit has been issued; and

c) a final certificate of zoning compliance has been issued.

Meadow Hill Middle School

Dear Members of the Board of Adjustments,

MCPS has authorized Bonds for the renovation and addition to Meadow Hill Middle School. The

intent of this letter is to provide a description of the project and outline the purpose of the

request for a Board of Adjustment hearing.

The 6-8th grade Meadow Hill Middle School (MHMS) site is within the R5.4 Residential District. The

site is located between 24th Street and Reserve Street where an address is provided (4210 S

Reserve St). A bus lane is located on the south side of the site, and the north side of the site abuts

residential property.

The current school is approx. 67,560 sf with an 8,000 sf. temporary annex building located

immediately east of the school. The new addition will consist of a gym to the northeast side of

the building, expanded commons, and administration spaces to the west side of the building.

Portions of the existing building will be renovated to accommodate classrooms currently located

within the annex. The addition will be approx. 17,240 sf. and the annex building will be removed.

The addition increases the building square footage by approx. 20%, however the number of

current employees will not increase.

The following items are intended to be developed and will not meet the current zoning

regulations. We request your consideration of the following exceptions:

1. 20.60.020 – Required Motor Vehicle Parking

To meet the current zoning requirements, the parking lot design would need to increase

the parking capacity by 40 parking spaces. Currently, additional parking is located on

the streets adjacent to the site along 24th St. and Reserve St. There are currently 50

spaces along 24th St. and 22 spaces along Reserve St., which will remain.

2. 20.65.040 – Interior Parking Lot Landscaping

There will not be at least 10% landscaping within the parking lot and not all landscape

islands will be provided. The landscaping within the parking lot will be provided to the

extent possible.

3. 20.65.050 – Perimeter Parking Lot Landscaping

A continuous buffer of berms, plantings, walls or fences, at a height of 36 inches will not

be provided. A street frontage landscaping area, at a depth of 20 ft. will not be

provided, because it would eliminate most of the parking lot and drop off lane.

4. 20.75.100 – Signs in Residential and Open Space/Public Districts

A new sign will be placed on the new west entry, off Reserve St. The sign will use letters to

identify Meadow Hill Middle School. The total area will be greater than 12 sq. ft. as

required for zoning in R5.4 districts.

A dynamic display will be provided in our R5.4 zoning district. The dynamic display will

meet all other requirements as stated in section 20.75.070F.

The proposed site and parking lot design improves daily use for students and staff. The design

implements ADA access, allows a parent drop off zone adjacent to the sidewalk, provides a

crosswalk to the front entry from Reserve St., provides a curb along Reserve St. sidewalk and the

parking lot, and provides a sidewalk on the north side of the parking lot to tie into the sidewalk

on Reserve St. The overall design provides better circulation and increases the safety of students

and staff.
