August was a busy month. The A&M Region 2 Refresher Seminar was held on August 4 & 5, 2016. It was a well-attended seminar. Chapter 74’s topic next year will be Relocation. Alex Gale, Vice President, will be the moderator for this session.

This year’s “Hot Topics in Eminent Domain” Seminar will be held on September 9, 2016 in San Marcos. It is filling up fast. So, if you are interested in attending, please fill out the attached registration form and e-mail it to Joyce Labus with Chapter 39.

The Region 2 Spring Forum will be held in Tulsa on April 5 – 7, 2017 at the Hard Rock Casino and Hotel. The 2018 Spring Forum will be held in San Antonio and the 2019 Spring Forum will be held in Austin. The Region is trying something new with the forums. The Region is looking to hold an industry symposium along with the forum. In 2019, Austin will host the Transportation symposium along with the spring conference. More information will come the closer we are to the forum, but the initial plan would be to hold the symposium one day, hold a course the next, with the Region forum on the third day.

It is with great sadness that I inform our chapter that our puppet master has passed away. Starting in 2005 at the Internation-al Conference, Chapter 74 donated to the silent auction a puppet in the likeness of the outgoing International President. The past several years, our puppet master fought a courageous battle with cancer. This past year, when she was feeling okay, she was able to make the next four years of our International Presidents. So, I am happy to say that Chapter 74’s legacy will con-tinue for another 3 years, after which, we will need to find some other fun thing to continue on. Thank you Randy Williams for this idea and taking the realm during its tenure.

To follow is an outline for who has voting rights within our chapter:

All Committee Chairs – the Chairs are single individuals. For example, on the Education committee, Matthew Eckmann has the voting right of the three individuals on the committee. Subsurface Utility Engineering

Subsurface Utility Engineering (SUE) has been described as an engineering practice that consists of determining the presence, attributes, and location of underground utilities; and quantifying the risks associated with appropriate quality levels. SUE mapping is the basis for utility coordination, utility relocation design, estimates and the implementation of accommodation policies.

Utility Engineering in the Transportation Field takes on a new role as engineers must find a good equilibrium with needs of the utility companies/customers and the needs of the transportation department and the travelling public. The goal of the engineer is to protect the safety, design, construction, operation of the highway facility while being a good steward of public funds. The Utility Engineer must be qualified and knowledgeable about criteria for both the roadway design and utility standards. The goal of any project is to have minimum impacts on the travelling public, the utility company and the custom-ers the utility serves. Thus, sharing limited space within public right of way necessitates an open approach and expertise as a transportation project is designed and built.

Utility Engineers use tools such as a Conflict Matrix or 3D Analysis that will identify potential conflicts between exist­ing utilities and proposed transportation improvements in the roadway, drainage, environmental and struc­tural features. At this stage the engineer must determine if design revisions are feasible, otherwise it can potentially lead to cost and time overruns. In some cases, the State Accommodation Rules allows low risk facilities to remain in place while the transporta-tion features in certain corridors are enhanced. If the conflicts cannot be avoided, the Engineer will work closely with the utility companies to prepare a Utility Layout that will assign all utilities a new location and assure no conflicts will occur with the proposed roadway improvements or other utility facilities. The engineer and utility company have to ensure adequate clearances for maintenance operations. The Utility Engineer reviews each utility’s plans for UAR compliance and to substan-tiate that the proposed highway facilities do not conflict with the Utility Layout; while maintaining compliance with FHWA and local traffic standards, Storm Water Pollution Prevention Plan (SW3P), backfill specifications/installation requirements and applicable industry requirements.

While attempting to avoid or minimize utility conflicts the Utility Engineer may coordinate with the Roadway Engineer to modify highway design to avoid as many conflicts as possible. This can include using adjusting grades, alignments, drainage plans, adding retaining walls, adjusting guard rail, moving bents, to totally eliminate the need to relocate a utility. The Utility Engineer will also coordinate with the utility company to determine if de-energizing lines for a short duration, use of spot-ters for cranes during construction, or protecting in place with encasement or concrete slabs would eliminate the need for relocation. Other options such as joint trenching or conduits may reduce the constraints in a narrow right of way, joint bidding with the transportation project may reduce schedule and construction issues, or temporary relocations may be the best way to maintain service for the utility customers during the transportation project.

While Utility Coordinators assist in preparing agreements, scheduling meetings and general coordination of activities, the Utility Engineer has the professional responsibility of protecting the traveling public, meeting the needs of the Utility compa-nies , utility customers and adding a value engineering solutions to the Transportation Project.

Utilities have been an overlooked component in the highway construction process and have been the cause of thousands of days of delay and millions of dollars in costs. The use and implementation of Utility Engineering in advanced stages of the project will help eliminate these issues and benefit all stakeholders.

Course Instructor: John F. Reed, SR/WA, R/W-RAC, R/W-URAC recently retired after 25 years of service with the Texas Department of Transportation, and has founded Compliant Relocation Services. LLC located in Round Rock, Texas. Prior to his retirement, John served as the Relocation Assistance / Valuation Administrator for the Texas Department of Transportation, Right of Way Division in Austin, Texas. During his 25 years with TxDOT, he worked in the relocation assistance and acquisition field developing and implementing policies/procedures. During this time, he also developed an in-house relocation training program for District personnel, served as LPA coordinator to the Districts, supervised the appraisal staff and worked closely with FHWA/NHI/TTI in compliance review, and developing classes and video presentations. John is a current member of the International Professional Development Committee past-member of the International Relocation Assistance Committee, certified as an IRWA Instructor in 2003 and the President of Chapter 74 for 2008. Tuition Refund Policy: Written notification of intent to cancel registration must be received via email by both the Course Coordinator and IRWA Headquarters Education Staff ([email protected] ) prior to the class start date in order to be eligible for a tuition refund. A full tuition refund will be issued if notice is received 15 days or more prior to the class start date; a 75% refund will be issued if notice is received less than 15 days prior to the class start date, and no refund will be issued for notice received on or after the class start date.

Course Instructor: Randy Williams, SR/WA, MAI, FRICS is the Managing Director for Integra Realty Resources Austin, Austin Texas. He holds the SR/WA, MAI, and FRICS designations. Mr. Williams' experience in real estate appraisal/valuation and consulting since 1977 includes among others, appraisal and management in the real estate banking industry and appraisal, testimony, and appraisal review in private practice. Recent experience is concentrated in major urban/suburban development and eminent domain in central Texas. Valuations have been performed on various properties including, but not limited to, neighborhood and community shopping centers, apartments complexes, single and multi-tenanted industrial buildings, low to high rise office buildings, mixed used facilities, vacant land for different uses and condemnation and right-of-way. Clients served include accountants, investment firms, law firms, lenders, private and public agencies. Valuations and market studies have been done on proposed partially completed, renovated, and existing structures. Eminent domain experience includes SH 130 and SH 45. Mr. Williams was the lead appraiser for Segments 3-6 on SH 130 and coordinated four Integra offices (including Austin) that worked on this project. Mr. Williams is also a certified instructor for the IRWA and has taught IRWA courses in Beijing, China and Johannesburg, South Africa as well as in the United States.
