At the quadripartite luncheon,_West.German StateSecretary Carstens summarized the EEG position onthe Berlin Pass question.‘ These views had-not asyet been communicated to Brandt or the West Berlin‘

Senat, he said. (1) Even in the light of the_conecessions granted, the Christmas Pass agreement;"

.represented a net_advantage for West Berlin, principallywith respect to the humanitarian advantages for

West Berliners who had begun to feel the effectsof isolation.' (2) A new Pass agreement was~

.desirable, under certain "suitable circumstances:"a) The Inter—Zonal Trade (IZT)-Treuhandste11e-or.

the Red Cross should act as the channel for'new.

negotiations.- The FRG did_not indicate whetherthey would permit the resumption of the Kbrber;

Wendt channel. ~h) An initial effort should bemade to have East Berliners granted freedom of

movement to West Berlin. .Though "probably,.not achievable," this would make a good public

impression. c) Permits should be granted on thebasis of an application submitted through the'

East Berlin attorney Wolfgang Vogel advised the US,mission that Jean Frederick Loba, a US_c1tizen■ 'imprisoned in East Germany since 1962, would be

;released on 30 April. ‘(Loba was a graduate studentat West Berlin's_Free University at the time of_

_his arrest in June 1962, On 26 October 1962,.he«

was tried in camera by an East German court for‘ 'allegedly helping four East Germans escape to

.West Berlin, and sentenced to,2 1/2 years at hard.labor).‘ Press reports indicated that Loba wasthe only remaining US civilian known to be in anEast German jail;

An East German newscast attacked the "Bonn ultras":whose actions "deprived the West Berliners ofpasses at Easter," and claimed that the Bonn Govern—ment was attempting to take the Pass negotiatiOnsout of the hands of the west Berlin Senat. Thereport stated that the "frontier" for which passeswere to be issued was betWeen the GDR and west Ber-lin, and therefore the discussions should concernthe Senat and not the FRG.

The Mission reported additional details of the GDRmeasures to require foreign registered vehiclesentering EaSt Germany to obtain special liabilityinsurances: 1) The insurance is not required ofofficial Allied vehicles, vehicles travelling on

_Allied orders, or West German/West Berlin registeredcars; 2) Foreign cars carrying the "InternationalGreen Card" are still required to buy GDR insurance(this may be waived if the insurance company inquestion has an agreement with the GDR StateInsurance Company); 3) The insurance is valid for

one transit only, but includes a "stay in the GDRcapital city;" 4) The insurance covers only damageto East German vehicles or injury to East Germanresidents, with no limit of liability stated; 5)

Soviet Defense Minister Rodion Malinovsky arrivedat Schoenefeld airport with a Soviet militarydelegation for a ten-day visit to East Germany.- He

was met by the East German Minister of Defense,.Heinz Hoffmann, and the GSFG Commander, General

Yakubovsky.

The Embassy Bonn suggested that the USMLM beinStructed to make a further approach to SERBconcerning return of the RB-66 Wreckage. ‘In the_Embassy's view, it would establish an_unfortunate

precedent of the RB—66 incident were cIOSed with—out the return of the plane or at least permissiOn,to confirm throu h inspection that the wreckage isnot retrievable. ' “

The Virginia Food Dealers: Association will make

a tour of_food industries in Eastern Europe from8 to 29 April, possibly including a stopover inEast Berlin, the State Department reported.‘ The24—member delegation will be in Berlin from 9 to11 April, ”' ‘

At_a meeting betWeen the chief USMLM and the chiefSERB, the following matters.were considered: 1)

The chief USMLM replied to the 24 March SERB state—ment on alleged American traffic violations inEast Berlin. The US reply indicated that the properchannel for discussion Of this subject was betweenAmbassadors. The chief SERB reported that he couldnot'see how this applied, since "american Headquarters

can give_the command to stop these violations which

cause unneCessary sharpening Of the situation." TheBerlianission commented that the Soviet statement,although it did not repudiate the Ambassador'sauthority to discuss the subject, was still thefirmest indication to date that Soviet Headquartersintended to assert their competence in this field.2) The chief USMLM inquired again about arrangementsfor evacuation of_the wreckage of the RB-66. TheSoviet officer replied that he had received no 'instructions but would pass on the inquiry tophis headquarters. 3) The chief SERB mentionedthat the US request regarding curtains on MLMvehicles was under consideration, and that thequestion would be eft open pending a "Justdecision." on 2_May for a two-day stay in West Berlin.

Additional information provided by the EmbassyBonn revealed that the new French Controller inBASC had not departed from established procedures,and had not given altitudes and changes for localflights to the Soviet Element. The French Controllerhad, however, expressed his belief that the Sovietsshould be informed of the purpose of local flightsin the Berlin Control Zone (BCZ). The Embassypointed out that it was_specifica11y decided inthe Berlin Air Coordinating Committee in 1963that no data should be passed to the Soviets be andthat required by quadripartite agreement.

A West Berlin Senat official informed the Missionthat the 1 April meeting between FRG Vice ChancellorMende and Federal Affairs Senator Schuetz produced

no concrete results. Mende reportedly claimed that

a decision on how to proceed in the pass negotiations

was_up to the West German cabinet, and eXplainedthat his recent statement proposing that the Passtalks be shifted to IZT channels actually referred

\to a long range concept for development of theIZT office into an enlarged agency for East/WestGerman problems.‘ The Senat official confirmedreports that if the Bonn/Senat consultations on

_the Senat's 18 March proposals for the Pass negoti—ations-were not completed in time, the Senatwould postpone the 8 April Kbrber-Wendt meeting.

A West Berlin Senat official informed the US Missionthat the 1 April meeting between FRG Vice ChancellorMende and Federal Affairs Senator Schuetz producedno concrete results; as a consequence, the 8 AprilKorber-Wendt talks on the Berlin Pass question couldbe postpOned if Bonn/Senat consultations were notcompleted by that date. The West Berlin Senat informed the Allied Missionsthat general guidelines had been agreed upon withthe.FRG for the Kbrber—Wendt pass talks on 8 April.The Senat spokesman noted that Brandt, Albertz,

Schuetz, Bahr, Spangenberg, and Kbrber planned toconfer on 6 April to determine whether these guide-lines provided an adequate basis for the new roundof negotiations, or whether the instructions would"doom the talks to a stalemate at the outset."Brandt, according to the spokesman, had_attempted

' unsucceszully to insert a statement-into theinstructi0ns to Kbrber which would imply thatEast Berlin officials might be permitted into WestBerlin for official contacts; in any-case, Brandt

. . .' The guidelines established for the talksgenerally followed the FRG Cabinet position outlinedto the Bonn Embassy on 1 April. They also establishedthe order of the proposals Kbrber was to make: 1)to point out that Senat proposals of 24 January werestill valid; 2) to inquire how East Germans Viewthat prOposal; 3) to indicate that he would signagreement immediately if East Germany acceptedthe Senat formula; 4) in the event of rejectionof the proposals, or amendments offered, Kbrber

was to suggest that arrangements should be reachedimmediately for hardship cases, so that West Ber-liners had at least the same access to East Berlin

as the West Germans; 5) if this move was rejected,Kbrber would suggest that visits in hardship casesbe arranged travel agencies, the Red Cross, or thePest Office.in West Berlin; 6) his final move wouldbe to suggest engagement of the International RedCross to arrange hardship visits, leaving open thequestion of presence of East Germaaned Crossofficials in West Berlin. At the conclusion of}the discussion, Korber was instructed to state that

The Westhermaanbreign Office requested that US '~Military authorities cOntact Soviet military :

representatives in East Germany in order to explain‘the status of the "tracked Vehic1e" rererred to in_the 28 February Bundesbahn telegram. Noting that

a somewhat similar incident had occurred in August1963, the‘Embassy Bonn'suggested'that the West Ger--

man Bundesbahn initiate a new reguest to the EastGerman authorities, and, it this request wererefused, US authorities would then have a clearbasis upon Which to contact the Soviets. -TheForeign Office spokesman indicated that the Bundes-bahn office in Hannover would send a new request

_to the East-German ReichsbathoffiCe in magdeburg

on 4 April. In the event the request is rejected,the Embassy recommended that the US PrpVost

.Marshal at Helmstedt made-an oral protest to the_Soviet check oint commander,-following the precedentof 1963. ' “ '

East German border guards opened fire on two EastBerlin bicycle-riders who approached too close to2the Wall, AP reported. One of the men was hit andthe other apparently fled into the Soviet sector‘and got away. ’

The US ground radar Sites TELEGRAM and-KILIDEER, in-West Germany, experienced an electrical pewer

failure during the early monring, and were in-operative for nearly two hours. The south air

corridOr was_closed to all military trafficfrom 04452 to 05292, and the air defense system-

returned to normal status at 06222. '

A Neues Deutschland editorial noted that the PEG

and West Berlin Senat had agreed on a joint approach

to the pass issue, and interpreted this to mean.that the Senat had "committed itself to submit now

and in the future to Bonn interference." The ’

editorial repeated East German claims that Bonn

was not concerned with the pass issue, and stated

that "if the Senat adopts the Bonn line, it runs

a great risk of spoiling-its negotiation success."

The Bonn Embassy reported that a draft reply to the

Soviet note of 19 March concerning international

flights to Berlin had been agreed upon by the Bonn

group. The reply rejected any suggestion that there

was anything "illegal" about Allied use of the

corridors, and stated: "The agreements establishing

the Berlin air corridors recognize the right or

access of the three Western Powers to that city

without any restriction other than the observation

of flight rules and air safety regulations, and;

in partiCular, without any restriction as to the

origin or destination of flights. The 1945 documents

cited in the Soviet Government’s note are concerned

with other proposals which quite clearly do not

affect in any way the use of the three corridors..."

The draft reply pointed out, finally, that flights

which the Soviets characterized as "international"

have been carried out frequently for several yearswith the full knowledge of the Soviet Government.

Reuters reported that East Germany had apparently

ceased jamming broadcasts by the BBC German language

service and RIAS, Berlin; While further confirmation

from BBC was not forthcoming, RIAS reported that

there had been no change in jamming of medium wavebroadcasts, which RIAS transmits on three_frequencies.

The one High Frequency (short wave) channel utilized'

by RIAS encountered selective jamming.in the past;

ihis had apparently ceased during the daylight hours.

Three members of a British MP patrol left their

vehicle in West Berlin at 13lOZ and attempted towalk to the Erlengrund exclave, which lies acrossEast German territory. East German border guards

reportedly fired five warning shots and took the

patrol into custOdy. The British Mission in

Berlin reported that an informal meeting was held

with East German authOrities, who gave assurancethat the men would be returned at an unspecified

time. At 17302, the British patrol_was handed

back unharmed to UK authOrities.. Press reports

of the.incident noted that patrols do not normally

Gerhard Dengler, deputy chairman of the Bureau of

the Presidium of the National Council, explained

why East German citizens were not permitted to travel

to West Germany. The Bonn GOVernment, he declared,

denies the existence of the GDR, and refuses torecognize East German passports; consequently,

GDR citizens are "without rights in West Germany,they are completely exposed to the arbitrariness

of police and justice." West Germany has attemptedto subject all GDR citizens to West German laws, and
