MARQUETTE COUNTY PLANNING COMMISSION

MINUTES

MARCH 7, 2018

1. Call to Order: The regular meeting of the Marquette County Planning Commission was called to order by Commissioner

Kaiser at 7:00 p.m.

2. Roll Call: Commissioners present: Benjamin Banfield, Charles Bergdahl, Ken Kaiser, Mike Touchinski, Emily Leach and Bob

Struck. Commissioner Alholm was not in attendance. Staff present: Thyra Karlstrom and Jen Sides.

3. Approval of the Minutes: Commissioner Kaiser requested that the information contained in “11 c.” be moved and included

as part of item “12. Public Comment.” A motion was made by Commissioner Bergdahl, supported by Commissioner

Struck to approve the February 7, 2018 regular meeting minutes as modified. The motion carried unanimously.

4. Public Comment: None.

5. Approval of Agenda: A motion was made by Commissioner Touchinski, seconded by Commissioner Banfield to approve

the agenda as presented. The motion carried unanimously.

6. Public Hearing: None.

7. Communications: Commissioner Banfield motioned, supported by Commissioner Touchinski to file the communications.

The motion carried unanimously.

8. Monthly Reports: Commissioner Touchinski asked for an update regarding clarification of the monthly reports as was

requested at the February meeting. Ms. Karlstrom relayed that Commissioner Alholm was going to follow up on that

item, further stating that an update will be available at the April meeting when she returns. It was the consensus of the

Commissioners to accept and file the January 2018 monthly reports.

9. Old Business: Commissioner Struck motioned, seconded by Commissioner Banfield to file old business. Motion carried

unanimously.

10. New Business:

a. City of Marquette Solid Waste Management: Letter of Consistency – The City of Marquette submitted a request

for determination of consistency with the Marquette County Solid Waste Plan. The City proposed to relocate its

current rubbish drop-off site from Wright Street to a property known as the Flink Farm near the intersection of

Pioneer Road and South McClellan Avenue (M-553). After review of the criteria staff recommended that a letter

of consistency be prepared and the Commission Chair be authorized to sign. Commissioner Touchinski

motioned, seconded by Commissioner Leach to follow staff recommendations. The motion passed unanimously.

b. 2019 Capital Improvement Program – The Michigan Planning Enabling Act, Act 33 of 2008, Section 65(l)

makes provisions for a Capital Improvements Program of public structures and improvements. The Marquette

County Planning staff receives capital project requests from all department heads to develop a list of capital

improvement projects. The Planning Commission reviews the staff compiled project rankings and upon approval

of the final list will recommend it for adoption by the Marquette County Board for the 2019 Annual Budget.

Commissioner Bergdahl motioned, supported by Commissioner Banfield to follow staff recommendations to

adopt the ranking criteria as presented for the 2019 Capital Improvement Program. The motion passed

unanimously. Ms. Karlstrom further suggested that it may be beneficial for the Chair to attend the meeting in

June when administration considers projects. She will keep Commissioner Kaiser updated on when the meeting

will take place.

c. Master Plan Discussion – With the hiring of a new County Planner, the Master Plan Subcommittee can resume

their meeting schedule. Commissioner Kaiser requested a volunteer to fill the vacant seat on the Committee.

Commissioner Leach volunteered and Commissioner Kaiser appointed her to the seat. Ms. Karlstrom presented

a map of possible sub regions for the Committee to review and focus on by division. A discussion ensued and

additional land groupings and sub regions were suggested.

11. Announcements:

a. Commissioner Touchinski announced that his trip to Poland is going to take place earlier than previously

thought. He will now be gone from May 31st to June 24th 2018.

b. Commissioner Struck relayed that the Sawyer Community Alliance is working to refurbish two of their

ballfields. In the process of holding meetings regarding those upgrades local and regional Lions Clubs have

expressed interest in developing a major sports complex around the fields. Commissioner Struck informed that

he will keep the Planning Commission updated as talks regarding the complex progress.

c. Ms. Karlstrom announced they are applying for a Land and Water Conservation Fund Grant to put in a floating

dock system in the Big Bay Harbor. If successful it will almost double the number of slips available for boaters.

d. Ms. Karlstrom spoke of the Recreation Passport Grant to redo the roof and the ceiling of the pavilion at Perkin’s

Park. It will also be used to update the fish cleaning station and for repair some of the utility infrastructure.

e. Commissioner Leach announced that the Superior Watershed Partnership is currently hiring for seasonal

conservation crews.

12. Public Comment: None.

13. Adjournment: Commissioner Bergdahl motioned, seconded by Commissioner Banfield to adjourn the meeting. The

motion carried unanimously. Commissioner Kaiser adjourned the meeting at 7:42 p.m.

Re: Chocolay Township Text Amendments

AUTHORITY

Pursuant to Section 125.3307 of the Michigan Zoning Enabling Act, Chocolay Township has submitted

proposed amendments to the Marquette County Planning Commission for review and comment.

PROCEDURE

The Chocolay Township Planning Commission held a public hearing on 03/19/2018. The public hearing

notifications procedures complied with the Act.

AMENDMENT

There are multiple text amendments being proposed. The proposed amendments are as follows:

Several administrative amendments including

o updates to existing definitions;

o changing references from Township Comprehensive Plan to Master Plan;

o minor revisions to Site Plan Review procedural requirements.

Add definitions for ‘Hospital’ and ‘Rental Dwelling’.

Add rental dwellings as a Permitted Principal Use in the Single Family Residential, High Density

Residential, Multi-Family Residential, Waterfront Residential, Commercial, and

Agriculture/Forestry zoning districts.

STAFF COMMENTS

The proposed text amendment lumps all rentals, regardless of term, into one definition. The proposed

amendment further allows all rentals as permitted principal uses in many districts. While it is important

that municipal units are permissive of rentals, it should be noted that allowing all rentals as permitted

principal uses would take away the Township’s ability to apply conditions that might otherwise be

suitable under a special use permit. The Chocolay Township Master Plan references allowing short term

rentals as a special use in the Waterfront District. The Master Plan should be consulted when

addressing rentals within the Township. The Plan also references needing a definition for short term

rental. Staff would advise differentiating short-term rentals from other rentals. It is also advisable to

create rental ordinances to accompany these zoning ordinance changes.

Other text amendments appear to be administrative in nature as standard updates.

STAFF RECOMMENDATION

Staff recommends that the Marquette County Planning Commission NOT support the Rental Dwelling

component of the proposed text amendments and forward staff and any commission comments to the

Chocolay Township Board and Planning Commission.
