Dear Mr. Arnett: City Staff have provided the following information in response to your questions about the Lafayette Street Pedestrian Overpass and Marsalli Park: The Overpass maintenance is done on Mondays and alternate Thursdays/Fridays; typically 4 trash bags are collected per visit; There is minor graffiti cleaned up at each visit and graffiti in hard to reach areas is done monthly. Currently due to an upcoming painting project , some graffiti has accumulated. Specific costs are not available per location on the graffiti costs but the overall maintenance for the Overcross is approximately $14,000 per year. Regarding Marsalli Park,, it is cleaned on a daily basis around 8am Monday through Friday and variable times on the weekend. Usually there are two cans of garbage. Because the park is open to view on three sides, graffiti is minimal. Although the specifics of some of your questions are not readily available,I hope this information is responsive to you.

That said, the site is, like many other older properties in the City, covered by a nonconforming status that still allows commercial use of the property so long as the use is not intensified under the commercial zoning allowances. The market, with or without an ABC license, is already a permitted use in the commercial zone district, so the City does not consider it intensification of use, by definition. If it were a proposed restaurant serving alcoholic beverages, it would be subject to use permit review by the City, in which case parking would be a germane issue. Our nonconforming status determination may or may not enter into the ABC's consideration one way or the other; I don't know if they are permitted or precluded from taking a shortage of parking into account. However, my expectation is that they will be concerned with conditions and effects more closely or directly associated with sales and consumption of alcohol. If the neighborhood is concerned about market patrons who purchase liquor loitering in the parking areas of the site, that would be worth mentioning to the ABC in your statement. Kevin Kevin L. I can't seem to find a copy of ABC Form 128, for verification of protests, anywhere on the ABC web site. Would you be able to send me an electronic one or tell me where to obtain one? Some of the people who signed the petition would like to verify their protests now.

Also, there were diagrams and photographs that accompanied my original protest. Any idea what happened to them? They aren't mentioned in your report.
