The realities …
There are almost as many different definitions of
fraud as there are African writers:
“Fraud is the unlawful, intentional making of
misrepresentation which causes actual prejudice
to another or holds potential prejudice to
another” Dr CR Botha
What is fraud?

All of the following elements of the fraud need to be proved simultaneously in court
➢ PREJUDICE - means potential or actual prejudice
➢ MISREPRESENTATION - behaviour (like nodding your head)
- omission (not to do something)
- actual misrepresenting a fact
➢ UNLAWFULNESS - act or omission was unlawful in terms of South
African law
➢ CASUALITY - potential prejudice sufficient - casual connection
lost its relevance
➢ CRIMINAL INTENT - intention to deceive is not an intention to defraud
What are the elements of fraud?

Classification System, also known as
the Fraud Tree.
✓ There are three primary categories of
occupational fraud:
