Repeal and Interpretation.

1. This A c t m a y be cited as the " Whar fage and Tonnage R a t e s Ac t , 1 9 0 1 , " and is divided in to P a r t s and Divisions, as follows':—

2 . ( 1 ) The Acts ment ioned in t he Ei rs t Schedule to th is A c t are to t he e x t e n t the re in expressed hereby repealed.

( 2 ) Al l persons appointed unde r t he Ac t he reby repealed and ho ld ing office a t t he t ime of t he pass ing of th i s A c t shal l be deemed to have been appointed hereunder .

( 3 ) Al l regula t ions made u n d e r t h e au thor i ty of t he A c t hereby repealed and be ing in force a t t he t i m e of t h e pass ing of this A c t shall be deemed to have been made unde r t he au thor i ty of th is Ac t .

3. I n this Act , unless t he con tex t or sub jec t -mat te r otherwise indicates or requ i res ,—

" publ ic wharf " means t he Circular Q u a y and the Queen ' s W h a r f a t t h e P o r t of Sydney, and any wharf in N e w Sou th W a l e s appointed a publ ic or legal wharf unde r a n y A c t r egu la t i ng t he C u s t o m s ;

" p r i v a t e sufferance w h a r f " means any whar f for which a suffer­ance is or has been granted in pu r suance of any such Ac t as aforesaid for t h e l and ing of goods subject to t he p a y m e n t of Customs dut ies ; " w h a r f i n g e r "

" wharfinger " means t he owner or lessee of a p r iva te sufferance wharf, or the agen t of ei ther .

4. This Ac t shall he construed subject to tiro provisions of t h e Sydney H a r b o u r Trus t Ac t , 1900.

P A R T I I .

R A T E S .

D I V I S I O N 1.— Wharfage rates.

5. U p o n the l and ing on any publ ic wharf or pr ivate sufferance wharf of any goods, merchandise , packages , or art icles enumera t ed or ment ioned in the Second Schedule hereto, the re m a y be levied rates to be t e rmed " I n w a r d W h a r f a g e R a t e s , " not exceeding t h e respect ive rates contained in t he said schedule.

Provided t h a t all goods a r r iv ing from any of t h e Aus t ra las ian Colonies or N e w Zealand, landed on any publ ic wharf and en te red a t t h e Customs-house for t r ansh ipmen t , shall be e x e m p t from a n y whar fage rates chargeable u n d e r th is Ac t .

6. I n respect of any goods, merchandise , packages , or art icles laden, whe the r in to vessels, l ighters , or boats , from any publ ic or p r iva te sufferance wharf, ra tes , to be te rmed " Ou tward Whar fage R a t e s , " m a y be levied in accordance wi th t h e scale specified in t he Second Schedule hereto for ou tward wharfage ra tes .

7. Eve ry vessel unde r two hund red and forty tons registered tonnage , and every l ighter , shall pay, for each day or port ion of a day du r ing which she occupies a be r th for loading only a t any publ ic or pr ivate sufferance wharf, a wharfage ra te of t en shi l l ings.

D I V I S I O N 2.—Tonnage rates.

8. (1) R a t e s may be levied upon vessels d ischarging the i r inward cargoes at any pub l i c wharf or pr ivate sufferance wharf as follows :—

(a) upon every such vessel fully laden and d ischarging the whole of her cargo, a ra te of one fa r th ing per ton per d iem,

(&) u p o n every such vessel fully laden discharging a port ion only of her cargo, and on every such vessel par t ly laden discharging the whole or a port ion of her cargo, a ra te of one ha l f -penny per ton per diem,

for every day or p a r t of a day t h a t such vessel occupies a be r th a t any such wharf. (2)

( 2 ) (a) E v e r y such vessel fully laden and discharging t h e whole of he r cargo shall he al lowed free lay days in accordance wi th t h e scale in t he Thi rd Schedule here to , du r ing which lay days she shall be exem pt from the p a y m e n t of tonnage ra tes .

(b) Eve ry such vessel pa r t ly laden or d ischarging a por t ion only of her inward cargo shall only be al lowed free lay days in accordance wi th t h e propor t ion which t h e a m o u n t of cargo she discharges bears to her gross registered tonnage where t h e vessel is a s team vessel, a n d to fifteen-tenths of her ne t registered tonnage where t h e vessel is a sai l ing vessel.

(c) N o ra te shal l be leviable unde r th i s section un t i l t h e free lay days have expired.

9. A n y vessel of two h u n d r e d and forty tons regis tered tonnage or upwards , occupying a b e r t h for loading only a t any publ ic wharf or pr iva te sufferance wharf, shall pay for each day she occupies such ber th , ra tes as follows :—

(a) for t h e first twenty-five days from the da te of occupat ion, a ra te not exceeding one half-penny per ton per d a y ;

(b) after t he expirat ion of such twenty-five days ,half t he above r a t e . 10. N o clearance shal l be g ran ted for a n y vessel l iable to t h e

p a y m e n t of t onnage ra tes a t any publ ic wharf wi th in t he m e a n i n g of this Act , unless a receipt for t he p a y m e n t of such ra tes , s igned by t h e proper officer or person, is presented to t h e Collector or other proper officer of cus toms.

D I V I S I O N 3 .—Leases of rates.

11. The Governor m a y demise and let to f a rm by publ ic auct ion, in such m a n n e r a n d subject to such bonds wi th or w i thou t suret ies and to such covenants and condit ions as t he Treasurer may t h i n k tit, t h e wharfage a n d t o n n a g e ra tes payable a t any publ ic wharf or a t a n y defined por t ion of such wharf for any t e r m not exceeding five years .

12. The lessee unde r any such lease may levy, demand , and recover t h e wharfage and tonnage ra tes prescr ibed by th is Act , subject to all exempt ions contained in th is A c t or in t he Schedules here to .

N o such ra tes shall exceed t h e scales prescribed by th is A c t or specified in t h e Second Schedule.

13. (1) D u r i n g such t e rm as t h e said rates or any p a r t thereof are so leased as aforesaid to any person whomsoever , t h e lessee thereof m a y nomina te and appoint such o the r person as he t h i n k s necessary by wr i t i ng unde r his hand to collect, demand , and t a k e such ra tes so demised, leased, a n d farmed.

( 2 ) A n y such person so appointed may use all lawful means for the recovery of such rates in case of n o n - p a y m e n t or evasion as such lessee himself could do by law, and m a y appoin t such persons as he m a y t h i n k necessary by wr i t ing u n d e r his h a n d as wharfingers or o ther servants . ( 3 )

( 3 ) Eve ry such lessee shall he ansAverable for the conduct of every person appointed by h i m as aforesaid, and shall be l iable for every such person 's neglect , misconduct , or breach of any law or regula t ion respect ing such rates as fully to all i n t en t s and purposes as if such lessee had personal ly been gui l ty of t he same.

P A R T I I I .

GOODS ON W I I A R E S .

14. (1) The mas te r of any vessel which occupies a ber th at any pub l i c wharf or p r iva te sufferance wharf for t he purpose of d ischarging inward cargo m a y deliver to t he consignee, impor ter , or his agent , any goods so to be discharged wi thou t moles ta t ion or in terference b y t h e collector or wharfinger, or by any person whomsoever , and wi thou t any charge o ther t h a n t h e respective rates au thor ised by th is Act .

(2) All impor ters and consignees, the i r agents and servants , shal l , du r ing cus tom-house hours for t he discharge of such vessel, have free access to and from the ship 's side whils t so d ischarging for the purpose of t a k i n g delivery o.f a n y such goods.

15. If any goods are landed on any publ ic wharf or pr iva te sufferance wharf, and are no t removed theref rom before the expi ra t ion of for ty-eight hours thereafter , t he collector, if t he Avharf is a publ ic wharf, or t h e wharfinger, if t h e wharf is a p r iva te sufferance wharf, m a y remove and store t h e said goods in the K i n g ' s or any bonded or free warehouse a t t he risk and cost of t h e consignee or impor te r thereof, subject to any lien by the owner, mas te r , or a g e n t of t he vessel for freight or charges which may be payable on such goods.

P A R T I V .

M I S C E L L A N E O U S M A T T E E S .

16. (1) F o r t he purposes of this Ac t t h e regis tered tonnage of any vessel shal l be de te rmined in accordance wi th t he provisions of t he I m p e r i a l A c t t h e M e r c h a n t Sh ipping Act , 1891 , and t h e Schedules the re to and a n y enac tmen t s a m e n d i n g the same ; b u t for ascer ta ining t h e t onnage ra tes leviable u n d e r th is Ac t upon s team vessels, t he gross tonnage measu remen t shal l be deemed to be t he tonnage of such vessels.

(2) The la tes t publ ica t ion of Lloyd ' s Regis te r shal l be evidence of t he n e t and gross tonnage of all vessels mentioned the re in .

17.

17. N o t w i t h s t a n d i n g a n y t h i n g in th is A c t contained, t h e Governor may abolish a l toge ther or reduce the scale of whar fage or t onnage rates prescribed by th is A c t and leviable t h e r e u n d e r a t any publ ic wharf, whenever in his opinion i t is to t h e publ ic in teres t so to do.

18. Subject to t h e provisions of th i s Ac t , t h e Governor m a y frame regula t ions for t he fol lowing purposes :—

(a) t h e b e r t h i n g of vessels a t a publ ic wha r f ; (b) t h e removal of vessels from a publ ic wharf ; (c) t h e discharging of cargo and loading thereof on or from a n y

pub l i c wha r f ; (d) t he s torage or removal of goods, merchandise , packages, and

art icles discharged on or laden from any publ ic whar f ; (e) t h e leasing of any publ ic wharf ; and (f) for prescr ibing penal t ies , no t exceeding in a n y case t h e

s u m of t w e n t y pounds , for t h e cont ravent ion of any such regulat ion, and for d i rec t ing t h e mode of the i r recovery arid enforcement . Eve ry such p e n a l t y m a y be denned by a m i n i m u m as well as a m a x i m u m l imit .

A l l such regula t ions shall , upon notification in t h e Gazet te , have t h e force of l a w ; and shall be laid before P a r l i a m e n t w i th in fourteen days after such notification if P a r l i a m e n t is t h e n in session, a n d if no t t h e n wi th in fourteen days after t he commencemen t of t h e n e x t ensuing session.
