4765-20-02 Qualifications for a firefighter certificate.

(A) An applicant for a firefighter certificate shall be at least eighteen years of age.

(B)(A) In addition to the requirement set forth in paragraph (A) of this rule, an An applicantfor a volunteer firefighter certificate shall satisfy all the following requirements to beeligible for certification:

(1) Shall be at least eighteen years of age.

(1)(2) Shall successfully complete the following federal emergency managementagency training courses:

(a) "National Incident Management System Course IS-700";

(b) "National Incident Management System Course ICS-100" or the onlineequivalent.

(2)(3) Shall successfully complete a volunteer firefighter training course througha chartered program, and receive a certificate of course completion at thevolunteer firefighter level.

(3)(4) Shall pass the knowledge and practical skills examinationsexamination as setforth in rule 4765-20-06 of the Administrative Code within one hundred eightydays of volunteer firefighter training course completion.

(5) Shall pass the knowledge examination as set forth in rule 4765-20-06 of theAdministrative Code within one hundred eighty days of volunteer firefightertraining course completion.

(4)(6) Shall submit a completed "Firefighter, Fire Safety Inspector, or HazardRecognition Officer Initial Application" within ninety days of passing theknowledge examination.

(B) The requirements listed in paragraphs (A)(2) to (A)(4) shall be successfully completedto be eligible to sit for the knowledge examination.

(C) The requirements listed in paragraphs (B)(1)(A)(2) to (B)(3)(A)(5) of this rule shall besuccessfully completed prior to submission of a completed "Firefighter, Fire SafetyInspector, or Hazard Recognition Officer Initial Application."

(D) In addition to the requirement set forth in paragraph (A) of this rule, an An applicant fora firefighter I or firefighter II certificate shall satisfy all of the following requirementsto be eligible for certification:

(1) Shall be at least eighteen years of age.

(2)(3) Shall successfully complete a firefighter I or firefighter II training coursethrough a chartered program and receive a certificate of course completion atthe level for which the certificate of firefighter training is sought;

(4) Shall successfully complete an emergency vehicle operations course meeting thefollowing:

(a) The course training shall consist of a minimum of sixteen hours, includinga minimum of eight hours classroom and a minimum of six hours hands-on driving;

(b) The course training shall be consistent with the intent of "NFPA 1002" and"NFPA 1451" and shall meet the course objectives as approved by theexecutive director, with advice and counsel of the committee;

(c) The training shall meet the course objectives as set forth in the "EmergencyVehicle Operations Course Packet" approved by the executive director,with advice and counsel of the committee.

(3) Shall meet the objectives as set forth in "Emergency Vehicle Operations CourseObjectives" as approved by the executive director, with advice and counsel ofthe committee, and meeting the following:

(a) The course shall consist of a minimum of sixteen hours;

(b) The course shall be consistent with the intent of "NFPA 1002" and "NFPA1451" and shall meet the course objectives as approved by the executivedirector, with advice and counsel of the committee;

(4)(5) Shall successfully complete hazardous materials awareness and operationslevel training in accordance with the following:

(a) The training shall consist of a minimum of twenty-four hours;

(b) The training shall meet the mission-specific competencies specified in"NFPA 1072" as required by "NFPA 1001";

(c) The training shall meet the course objectives as set forth in the "HazardousMaterials Awareness and Operations Course ObjectivesPacket" approvedby the executive director, with advice and counsel of the committee;

(5)(6) Shall successfully complete emergency medical care training in accordancewith the following:

(a) The training shall consist of a minimum of eight hours;

(b) The training shall meet the performance capabilities specified in "NFPA1001" chapter 4.31.

(6)(7) Shall pass the knowledge and practical skills examinationsexamination as setforth in rule 4765-20-06 of the Administrative Code within one hundred eightydays of firefighter I or firefighter II training course completion;

(8) Shall pass the knowledge examination as set forth in rule 4765-20-06 ofthe Administrative Code within one hundred eighty days of firefighter I orfirefighter II training course completion;

(7)(9) Shall submit a completed "Firefighter, Fire Safety Inspector, or HazardRecognition Officer Initial Application" within ninety days of passing theknowledge examination;

(E) The requirements listed in paragraphs (D)(1)(2) to (D)(6) of this rule shall becompleted prior to submission of a completed "Firefighter, Fire Safety Inspector, orHazard Recognition Officer Initial Application":shall be successfully completed tobe eligible to sit for the knowledge examination.

(F) The requirements listed in paragraphs (D)(2) to (D)(7) of this rule shall be successfullycompleted prior to submission of a completed "Firefighter, Fire Safety Inspector, orHazard Recognition Officer Initial Application."

(F)(G) In addition to the requirements set forth in paragraphs (A) to (E)(F) of this rule, asapplicable, an applicant for firefighter:

(1) Shall not have been convicted of any of the following:

(a) Any felony;

(b) A misdemeanor committed in the course of practice;

(c) A misdemeanor involving moral turpitude.

(2) Shall not have committed fraud, misrepresentation, or material deception inapplying for or obtaining a certificate issued under section 4765.55 of theRevised Code and this chapter.

(3) Shall not have been previously revoked or denied a certificate by the executivedirector or the licensing organization in another state.

(G)(H) In deciding whether to grant a firefighter certificate, the executive director, with theadvice and counsel of the committee, has the following options:

(1) The executive director shall issue a firefighter certificate to an applicant whomeets all of the requirements listed in paragraphs (A) to (F)(G) of this rule, asapplicable;

(2) The executive director shall refuse to grant a firefighter certificate to an applicantwho fails to meet one or more of the requirements listed in paragraphs (A) to(E)(F) of this rule, as applicable;

(3) The executive director may grant, refuse to grant, or restrict a firefighter certificateto an applicant who meets the requirements listed in paragraphs (A) to (E)(F)of this rule, as applicable, but fails to meet one or more of the requirementslisted in paragraph (F)(G) of this rule.

(H)(I) Credit shall be given for successful completion of the emergency vehicle operationscourse specified in paragraph (D) of this rule if all of the following are met:

(1) The training is recognized by the program director of a chartered program;

(2) The training meets or exceeds sixteen hoursThe training is consistent with thecourse requirements set forth in paragraph (D)(4) of this rule and;

(3) The training meets the current course objectives as approved by the executivedirector; and

(4)(3) The training was completed not more than twelve months prior to the firefightertraining course start date.

(I)(J) Credit may be given for successful completion of hazardous materials awareness andoperations level training specified in paragraph (D) of this rule if all of the followingare met:

(1) The training is recognized by the program director of a chartered program; and

(2) The training meets or exceeds twenty-four hours;The training is consistent withthe course requirements set forth in paragraph (D)(5) of this rule.

(3) The training meets the "Hazardous Materials Awareness and Operations CourseObjectives" approved by the executive director.

(J)(K) Credit shall be given for successful completion of hazardous materials awarenessand operations level training specified in paragraph (D) of this rule if the training wascompleted as part of an Ohio firefighter I training course.

(K)(L) Credit shall be given for successful completion of emergency medical care trainingas set forth in paragraph (D) of this rule if the training meets or exceeds eight hoursand any of the following apply:

(1) The training resulted in certification as an Ohio emergency medical responder;

(2) The training resulted in certification as an Ohio emergency medical technician;

(3) The training resulted in certification as an Ohio advanced emergency medicaltechnician;

(3)(4) The training resulted in certification as an Ohio paramedic.

(L)(M) No person shall hold a firefighter certificate at more than one level.

(M)(N) A firefighter certificate issued pursuant to this rule shall be issued in accordancewith the certification cycles and pro-rated renewal requirements set forth in rule4765-20-16 of the Administrative Code.

4765-20-03 Qualifications for a fire safety inspector or hazard recognitionofficer certificate.


(A) An applicant for a fire safety inspector certificate shall satisfy the followingrequirements:

(2) Shall possess a current and valid firefighter certificate that is in good standing;

(3) Shall successfully complete a fire safety inspector training course through achartered program and receive a certificate of course completion;

(4) Shall pass the knowledge and practical skills examinations as set forth in rule4765-20-06 of the Administrative Code within one hundred eighty days of firesafety inspector course completion;

(5) Shall submit a completed "Firefighter, Fire Safety Inspector, or HazardRecognition Officer Initial Application" within ninety days of passing theknowledge examination.

(B) An applicant for a hazard recognition officer certificate shall satisfy the followingrequirements:

(1) Shall be at least eighteen years of age;


(3) Shall successfully complete a hazard recognition officer training course througha chartered program, and receive a certificate of course completion;

(4) Shall pass the knowledge and practical skills examinationexaminations as set forthin rule 4765-20-06 of the Administrative Code within ninetyone hundred eightydays of hazard recognition officer training course completion;

(5) Shall submit a completed "Firefighter, Fire Safety Inspector, or HazardRecognition Officer Initial Application" within ninety days of passing theknowledge examination;

(C) In addition to the requirements set forth in paragraph (A) or (B) of this rule an applicantfor fire safety inspector or hazard recognition officer shall successfully complete thefollowing federal emergency management agency training courses:

(1) "National Incident Management System Course IS-700";

(2) "National Incident Management System Course ICS-100" or online equivalent.

(D)(C) In addition to the requirements set forth in paragraph (A) to (C)(B) of this rule anapplicant for fire safety inspector or hazard recognition officer:


(a) Any felony;



(2) Shall not have committed fraud, misrepresentation, or material deception inapplying for, or obtaining a certificate issued under section 4765.55 of theRevised Code and this chapter.

(E)(D) In deciding whether to grant a fire safety inspector certificate, the executive directorhas the following options:

(2) The executive director shall refuse to grant a certificate of fire safety inspectortraining to an applicant who fails to meet one or more of the requirements listedin paragraph (A), (C) or (D) of this rule;

(3) The executive director may grant, refuse to grant, or restrict a certificate of firesafety inspector training to an applicant who meets the requirements listed inparagraphsparagraph (A) and (C) of this rule, but fails to meet one or more ofthe requirements listed in paragraph (D)(C) of this rule.

(F)(E) In deciding whether to grant a hazard recognition officer certificate, the executivedirector has the following options:

(1) The executive director shall issue a hazard recognition officer certificate oftraining to an applicant who meets all of the requirements listed in paragraphs(B), (C), and (D)(C) of this rule;

(2) The executive director shall refuse to grant a hazard recognition officer certificateof training to an applicant who fails to meet one or more of the requirementslisted in paragraph (B), (C), or (D) of this rule;

(3) The executive director may grant, refuse to grant, or restrict a hazard recognitionofficer certificate of training to an applicant who meets the requirements listedin paragraphsparagraph (B) and (C) of this rule, but fails to meet one or moreof the requirements listed in paragraph (D)(C) of this rule.

(G)(F) A fire safety inspector or hazard recognition officer certificate issued pursuant to thisrule shall be issued in accordance with the certification cycles and pro-rated renewalrequirements set forth in rule 4765-20-16 of the Administrative Code.

4765-20-06 Firefighter, fire safety inspector, and hazard recognition officerexaminations.

(A) The initial examinations required for a firefighter certificate shall consist of aknowledge examination and a practical skills examination as approved by theexecutive director, with the advice and counsel of the committee.

(1) The knowledge examination for a firefighter certificate shall meet the following:

(a) The knowledge examination shall be taken at the level of firefightercertification sought;

(b) A passing score of at least seventy per cent on the knowledge examinationis required for certification;

(c) The knowledge examination required for certification shall be passed withinthree attempts;

(d) If the applicant is unable to pass the knowledge examination within threeattempts, the applicant shall complete a new course of instruction asset forth in Chapter 4765-24 of the Administrative Code and meet allcriteria for a firefighter certificate as provided in rule 4765-20-02 of theAdministrative Code.

(2) The practical skills examination shall consist of skills testing applicable to thelevel of firefighter certificate sought and shall meet the following:

(a) The practical skills examination shall be administered by a charteredprogram;

(b) The practical skills examination shall be evaluated by a practical skillsevaluator;

(c) The practical skills examination shall be based on a pass or fail gradingsystem;

(d) The applicant shall pass each skill in its entirety. Failure to pass any portionof a tested skill requires re-testing of the entire skill.

(e) A maximum of three attempts per skill is permitted, with no more than twoattempts occurring on the same day;

(f) If the applicant is unable to pass the practical skills examination withinthree attempts, the applicant shall complete a new course of instructionas set forth in Chapter 4765-24 of the Administrative Code and meet all

(3) An applicant shall successfully pass the practical skills examination as set forthin paragraph (A)(2) of this rule prior to attempting the knowledge examinationas set forth in paragraph (A)(1) of this rule.

(B) The reinstatement examinations required for a firefighter certificate shall consist ofa knowledge examination and a practical skills examination as approved by theexecutive director, with the advice and counsel of the committee. Time lines forreinstatement requirements for a firefighter certificate are set forth in rule 4765-20-08of the Administrative Code.

(1) The knowledge examination for reinstatement of a firefighter certificate shall meetthe following:

(a) The knowledge examination shall be taken at the level of firefightercertification sought;

(b) A passing score of at least seventy per cent on the knowledge examinationis required for certification;

(c) The knowledge examination required for reinstatement shall be passedwithin three attempts;

(d) If the applicant is unable to pass the knowledge examination within threeattempts, the applicant shall complete a new course of instruction asset forth in Chapter 4765-24 of the Administrative Code and meet allcriteria for a firefighter certificate as provided in rule 4765-20-02 of theAdministrative Code.

(2) The practical skills examination for reinstatement of a firefighter certificate shallconsist of skills testing applicable to the reinstatement level sought and shallmeet the following:


(b) The practical skills examination shall be evaluated by a practical skillsevaluator;

(b) The knowledge examination for fire safety inspector shall be passed withinthree attempts;

(c) If the applicant is unable to pass the knowledge examination within threeattempts, the applicant shall complete a new course of instruction forfire safety inspector as set forth in rule 4765-24-14 of the AdministrativeCode and meet all criteria for a certificate of fire safety inspector trainingas provided in rule 4765-20-03 of the Administrative Code.

(2) The practical skills examination for fire safety inspector shall meet the following:


(b) The practical skills examination shall be evaluated by:

(i) A fire safety inspector instructor trained as a practical skills evaluator;or

(ii) A fire safety inspector who is also a fire instructor trained as apractical skills evaluator, when a fire safety inspector instructor isnot available;

(f) If the applicant is unable to pass the practical skills examination, theapplicant shall complete a new course of instruction for fire safetyinspector as set forth in rule 4765-24-14 of the Administrative Code andmeet all criteria for the fire safety inspector certificate as provided in rule4765-20-03 of the Administrative Code.

(D) The reinstatement examination required for a fire safety inspector certificate shallconsist of a knowledge examination and practical skills examination as approved bythe executive director, with the advice and counsel of the committee.

(1) A passing score of at least seventy per cent on the knowledge examination isrequired for certification.

(2) The knowledge examination required for fire safety inspector shall be passedwithin three attempts.

(3) If the applicant is unable to pass the knowledge examination within three attempts,the applicant shall complete a new course of instruction for fire safety inspectoras set forth in rule 4765-24-14 of the Administrative Code and meet all criteriafor a fire safety inspector certificate as provided in rule 4765-20-03 of theAdministrative Code.

(E) The initial examinations required for a hazard recognition officer certificate shall consistof a knowledge examination and a practical skills examination as approved by theexecutive director, with the advice and counsel of the committee. The

(1) The knowledge examination for a hazard recognition officer certificate shall meetthe following:

(1)(a) A passing score of at least seventy percent on the knowledge examinationis required for certification;

(2)(b) The knowledge examination for hazard recognition officer shall bepassed within three attempts;

(3)(c) If the applicant is unable to pass the knowledge examination withinthree attempts, the applicant shall complete a new course of instructionfor hazard recognition officer as set forth in rule 4765-24-14 of theAdministrative Code and meet all criteria for a certificate of hazardrecognition officer as provided in rule 4765-20-03 of the AdministrativeCode.

(2) The practical skills examination for hazard recognition officer shall meet thefollowing:


(b) The practical skills examination shall be evaluated by:

(i) A fire safety inspector instructor trained as a practical skills evaluator;or

(ii) A fire safety inspector who is also a fire instructor trained as apractical skills evaluator, when a fire safety inspector instructor isnot available;




(f) If the applicant is unable to pass the practical skills examination,the applicant shall complete a new course of instruction for hazardrecognition officer as set forth in rule 4765-24-14 of the AdministrativeCode and meet all criteria for the fire safety inspector certificate asprovided in rule 4765-20-03 of the Administrative Code.

4765-20-08 Reinstatement of a firefighter, fire safety inspector, or hazardrecognition officer certificate.


(A) A firefighter, fire safety inspector, or hazard recognition officer certificate shall expireon its expiration date if the certificate holder fails to renew such certificate.

(B) In order to reinstate a firefighter certificate that has expired, or becomes invalid due toa voluntary surrender, an applicant shall meet all of the following requirements:

(1) The applicant shall meet all qualifications for a firefighter certificate as set forthin rule 4765-20-02 of the Administrative Code;

(2) The applicant shall have previously held a firefighter certificate for the levelof certification sought and the applicant was in good standing at the time thecertificate expired or was voluntarily surrendered;

(3) The applicant shall have been in good standing at the time the certificate expiredor was voluntarily surrendered;

(3)(4) The applicant shall meet the requirements as set forth in paragraphs (C), (D),andor (E) of this rule, as applicable.

(4)(5) The applicant shall submit a completed "Firefighter, Fire Safety Inspector, and/or Hazard Recognition Officer Reinstatement Application."

(C) The executive director shall reinstate a firefighter certificate that has expired, orbecomes invalid due to a voluntary surrender, for nonot latermore than than ninetydays from the expiration date or date of surrender, if the applicant meets therequirements set forth in paragraph (B) of this rule and all of the followingrequirements:

(1) The applicant submits an application fee of seventy-five dollars;

(2) The applicant provides documentation to the division that all continuing educationrequirements as set forth in Chapter 4765-20 of the Administrative Code weremet for the last certification cycle prior to the certificate's expiration date or dateof surrender. If the continuing education requirements have not been completedprior to expiration date or date of surrender, the applicant is not eligible forreinstatement under this paragraph.

(D) The executive director shall reinstate a firefighter certificate that has expired, orbecomes invalid due to a voluntary surrender, for nonot latermore than than eighteen

months from the expiration date or date of surrender, if the applicant meets therequirements set forth in paragraph (B) of this rule and all of the followingrequirements:


(2) The applicant provides documentation to the division that all continuing educationrequirements as set forth in Chapter 4765-20 of the Administrative Code weremet for the last certification cycle. Continuing education need not be completedprior to the certificate's expiration date or date of surrender, but shall becompleted at time of application;

(3) The applicant passes the knowledge examination, at the level of certificationsought, as set forth in rule 4765-20-06 of the Administrative Code.

(E) The executive director shall reinstate a firefighter certificate that has expired, orbecomes invalid due to voluntary surrender, for more than eighteen months, but nonotlatermore than thirty-six months from the expiration date or date of surrender, if theapplicant meets the requirements set forth in paragraph (B) of this rule and all of thefollowing requirements:


(2) The applicant provides documentation to the division that all continuing educationrequirements as set forth in Chapter 4765-20 of the Administrative Code weremet for the last certification cycle. Continuing education need not be completedprior to the certificate's expiration date, but shall be completed at time ofapplication;

(3) The applicant passes the knowledge examination, at the level of certificationsought, as set forth in rule 4765-20-06 of the Administrative Code;

(4) The applicant passes the practical skills examination as set forth in rule4765-20-06 of the Administrative Code.

(F) If a firefighter certificate has expired, or becomes invalid due to voluntary surrender, formore than thirty-six months or longer from the expiration date or date of surrender,the applicant is not eligible for reinstatement. The applicant shall complete a newcourse of instruction and meet all qualifications for a certificate of firefighter trainingas provided in rule 4765-20-02 of the Administrative Code.

(G) In order to reinstate a fire safety inspector certificate that has expired, or becomesinvalid due to a voluntary surrender, an applicant shall meet all of the followingrequirements:

(1) Except for the requirement to possess a current and valid firefighter certificate,the applicant shall meet all qualifications for a fire safety inspector certificate,as set forth in rule 4765-20-03 of the Administrative Code;

(2) The applicant shall have previously held a fire safety inspector certificate andthe applicant was in good standing at the time the certificate expired or wasvoluntarily surrendered;


(3)(4) The applicant shall meet requirements as set forth in paragraph (H), (I), or (J)of this rule, as applicable;


(H) The executive director shall reinstate a fire safety inspector certificate that has expired,or becomes invalid due to voluntary surrender, for not latermore than ninety daysfrom expiration date or date of surrender, if the applicant meets the requirements setforth in paragraph (G) of this rule and all of the following requirements:


(2) The applicant provides documentation to the division that all continuing educationrequirements as set forth in Chapter 4765-20 of the Administrative Code weremet for the last certification cycle prior to the certificate's expiration date or dateof surrender. If the continuing education requirements have not been completedprior to expiration date, the applicant is not eligible for reinstatement under thisparagraph.

(I) The executive director shall reinstate a fire safety inspector certificate that has expired,or becomes invalid due to a voluntary surrender, for not more than eighteen monthsfrom expiration date, if the applicant meets the requirements set forth in paragraph(G) of this rule and all of the following requirements:


(2) The applicant provides documentation to the division that all continuing educationrequirements as set forth in Chapter 4765-20 of the Administrative Code weremet for the last certification cycle. Continuing education need not be completedprior to the certificate's expiration date, but shall be completed at time ofapplication;

(3) The applicant passes the knowledge examination as set forth in rule 4765-20-06of the Administrative Code.

(J) The executive director shall reinstate a fire safety inspector certificate that has expired,or becomes invalid due to voluntary surrender, for more than eighteen months, butlessnot more than thirty-six months from the expiration date or date of surrender, ifthe applicant meets the requirements set forth in paragraph (G) of this rule and all ofthe following requirements, within such time period:





(K) If a fire safety inspector certificate has expired, or becomes invalid due to voluntarysurrender, for more than thirty-six months or longer from the expiration date or date ofsurrender, the applicant is not eligible for reinstatement. The applicant shall completea new course of instruction and meet all qualifications for a fire safety inspectorcertificate as set forth in rule 4765-20-03 of the Administrative Code.

(L) In order to reinstate a hazard recognition officer certificate that has expired, or becomesinvalid due to a voluntary surrender, an applicant shall meet all of the followingrequirements:

(1) Except for the requirement to possess a current and valid firefighter certificate,the applicant shall meet all qualifications for a hazard recognition officercertificate, as outlined in rule 4765-20-03 of the Administrative Code;

(2) The applicant shall have previously held a hazard recognition officer certificate;and the applicant was in good standing at the time the certificate expired or wasvoluntarily surrendered;

(3)(4) The applicant shall meet requirements as outlined in paragraphs (M), or (N),or (O) of this rule, as applicable;


(M) The executive director shall reinstate a hazard recognition officer certificate that hasexpired, or becomes invalid due to voluntary surrender, for not more than eighteenmonthsninety days from the expiration date or date of surrender, if the applicantmeets the requirements set forth in paragraph (L) of this rule and all of the followingrequirements, within such time period:


(2) The applicant provides documentation to the division that all continuing educationrequirements as set forth in Chapter 4765-20 of the Administrative Code weremet for the last certification cycle prior to the certificate's expiration date or dateof surrender. ContinuingIf the continuing education need requirements have notbebeen completed prior to the certificate's expiration date or date of surrender,but shall be completed at time of application, the applicant is not eligible forreinstatement under this paragraph.;

(N) The executive director shall reinstate a hazard recognition officer certificate that hasexpired, or becomes invalid due to voluntary surrender, for not more than eighteenmonths from expiration date, but less than thirty-six months from the expiration dateor date of surrender, if the applicant meets the requirements set forth in paragraph (L)of this rule and all of the following requirements, within such time period:




(O) If a hazard recognition officer certificate has expired or becomes invalid due tovoluntary surrender, for thirty-six months or longer from the expiration date or date ofsurrender, the applicant is not eligible for reinstatement. The applicant shall completea new course of instruction and meet all qualifications for a hazard recognition officercertificate as provided in rule 4765-20-03 of the Administrative Code.The executive

director shall reinstate a hazard recognition officer certificate that has expired, orbecomes invalid due to voluntary surrender, for more than eighteen months, but notmore than thirty-six months from the expiration date or date of surrender, if theapplicant meets the requirements set forth in paragraph (L) of this rule and all of thefollowing requirements:



(3) The applicant passes the knowledge examination as set forth in rule 4765-20-06of the Administrative Code


(P) If a hazard recognition officer certificate has expired or becomes invalid due tovoluntary surrender, for more than thirty-six months from the expiration date ordate of surrender, the applicant is not eligible for reinstatement. The applicantshall complete a new course of instruction and meet all qualifications for a hazardrecognition officer certificate as set forth in rule 4765-20-03 of the AdministrativeCode.

(P)(Q) A firefighter, fire safety inspector, or hazard recognition officer applicant shall meetall requirements for eligibility prior to taking any examination.

(Q)(R) A firefighter or fire safety inspector applicant who is eligible for reinstatement is noteligible to apply for certification by reciprocity at or below the level of the expiredcertificate.

(R)(S) A firefighter applicant who qualifies for reinstatement is eligible to be reinstatedonly at the level previously held by such applicant.

(S)(T) A fire safety inspector applicant who qualifies for reinstatement is eligible to bereinstated at the fire safety inspector or hazard recognition officer level.

(T)(U) The applicant's course of fire service training shall be significantly similar to thecurrent curriculum requirements as set forth in Chapter 4765-24 of the AdministrativeCode for the level sought. If the training is not significantly similar to the current

curriculum, the applicant shall complete additional coursework in the areas ofdeficiency through a chartered program.

(U)(V) A firefighter, fire safety inspector, or hazard recognition officer certificate issuedpursuant to this rule shall be issued in accordance with the certification cycles and pro-rated renewal requirements set forth in rule 4765-20-16 of the Administrative Code.

4765-20-09 Reinstatement of a revoked firefighter, fire safety inspector, orhazard recognition officer certificate.


(A) The executive director may reinstate a firefighter certificate that has been previouslyrevoked, in accordance with the parameters set forth in this rule. In order to beconsidered for reinstatement, the applicant shall meet the following requirements:

(1) The applicant shall pass the knowledge examination at the level of firefightercertification previously held, within three attempts. If the applicant is unable topass the examination within three attempts, the applicant shall complete a newcourse of instruction and apply for a new certificate of firefighter training asset forth in rule 4765-20-02 of the Administrative Code;

(2) The applicant shall submit an application fee of seventy-five dollars;

(3) The applicant shall provide documentation of completion of continuing educationrelated to fire service training:

(a) Eighteen hours per year of continuing education required for each year thecertification was revoked, prorated as set forth in rule 4765-20-16 of theAdministrative Code;

(b) Continuing education shall be approved by the applicant’s fire chief or aprogram director;

(4) The applicant shall meet all qualifications for a firefighter certificate as set forthin paragraph (F) of rule 4765-20-02 of the Administrative Code;

(5) The applicant shall have previously held a firefighter certificate issued undersection 4765.55 of the Revised Code and rule 4765-20-02 of the AdministrativeCode, for the level of certification sought;

(6) The applicant shall have completed a course of training that is significantly similarto the current curriculum requirements as set forth in Chapter 4765-24 of theAdministrative Code for the level of certification sought. If the training is notsignificantly similar to the current curriculum, the applicant shall completeadditional coursework in the areas of deficiency through a chartered program;

(7) The applicant shall submit a completed "Firefighter, Fire Safety Inspector, and/or Hazard Recognition Officer Reinstatement Application."

(B) The executive director may reinstate a fire safety inspector certificate that has beenpreviously revoked, in accordance with the parameters set forth in this rule. In order tobe considered for reinstatement, the applicant shall meet the following requirements:

(1) The applicant shall pass the knowledge examination for fire safety inspector,within three attempts. If the applicant is unable to pass the examination withinthree attempts, the applicant shall complete a new course of instruction andapply for a new certificate of fire safety inspector training as set forth in rule4765-20-03 of the Administrative Code;


(3) The applicant shall provide documentation of completion of continuing educationrelated to fire safety inspector training:

(a) Eight hours per year of continuing education required for each year thecertification was revoked, prorated in accordance with rule 4765-20-16of the Administrative Code;

(b) Continuing education shall be approved by the applicant’s fire chief or aprogram director;

(4) The applicant shall meet all qualifications for a fire safety inspector certificate asset forth in paragraph (D) of rule 4765-20-03 of the Administrative Code;

(5) The applicant shall have previously held a fire safety inspector certificateissued under section 4765.55 of the Revised Code and rule 4765-20-03 of theAdministrative Code;

(6) The applicant shall have completed a course of training that is significantly similarto the current curriculum requirements as set forth in Chapter 4765-24 of theAdministrative Code. If the training is not significantly similar to the currentcurriculum, the applicant shall complete additional coursework in the areas ofdeficiency through a chartered program;


(C) The executive director may reinstate a hazard recognition officer certificate that hasbeen previously revoked, in accordance with the parameters set forth in this rule.In order to be considered for reinstatement, the applicant shall meet the followingrequirements:

(1) The applicant shall pass the knowledge examination for hazard recognitionofficer, within three attempts. If the applicant is unable to pass the examinationwithin three attempts, the applicant shall complete a new course of instructionand apply for a new certificate of hazard recognition officer training under asset forth in rule 4765-20- 03 of the Administrative Code;


(3) The applicant shall provide documentation of completion of continuing educationrelated to hazard recognition officer training:

(a) Two hours per year of continuing education required for each year thecertification was revoked, prorated in accordance with rule 4765-20-16of the Administrative Code;

(b) Continuing education shall be approved by the applicant's fire chief or aprogram director;

(4) The applicant shall meet all qualifications for a hazard recognition officercertificate as set forth in paragraph (E) of rule 4765-20-03 of the AdministrativeCode;

(5) The applicant shall have previously held a fire safety inspector or hazardrecognition officer certificate issued under section 4765.55 of the Revised Codeand rule 4765-20-03 of the Administrative Code;

(6) The applicant shall have completed a course of training that is significantly similarto the current curriculum requirements as set forth in Chapter 4765-24 of theAdministrative Code. If the training is not significantly similar to the currentcurriculum, the applicant shall complete additional coursework in the areas ofdeficiency through a chartered program


(D) A fire safety inspector applicant who qualifies for reinstatement is eligible to bereinstated at the fire safety inspector or hazard recognition officer level.

(E) In order to be eligible for reinstatement of a revoked firefighter, fire safety inspector,or hazard recognition officer certificate, the applicant's certificate shall have beenrevoked by the executive director for at least one year from the date on which theexecutive director's order revoking the certificate was journalized, but no more thanthirty-six months. If the applicant's certificate has been revoked for more than thirty-six months, such applicant shall complete a new training course and apply for a new

firefighter or fire safety inspector certificate in accordance with rule 4765-20-02 or4765-20-03 of the Administrative Code.

(F) The executive director shall not reinstate a firefighter, fire safety inspector, or hazardrecognition officer certificate if the applicant's certificate was permanently revoked.

(G) In addition to meeting the requirements set forth in this rule, the executive director maytake into consideration other relevant factors when determining whether to grant arequest for reinstatement. These factors include, but are not limited to the following:

(1) The nature and severity of the acts that resulted in the revocation of the applicant'scertificate;

(2) The time that has elapsed since the revocation;

(3) Additional convictions or violations of the Revised Code occurring after therevocation of the certificate;

(4) Any evidencedocumentation of rehabilitation, including but not limited to,appropriate treatment or counseling, which the applicant shall submitdocumentation to the executive director;

(5) Evidence of additional education or training, which the applicant shall submit tothe executive director;

(6) Compliance with previous executive director orders or consent agreements;

(7) Compliance with court ordered sentencing;

(8) Employment history, including compliance with any departmental discipline,which the applicant may submit to the executive director.

(H) A firefighter or fire safety inspector certificate issued pursuant to this rule shall beissued in accordance with the certification cycles and pro-rated renewal requirementsset forth in rule 4765-20-16 of the Administrative Code.

4765-20-10 Firefighter certification by reciprocity.


(A) For purposes of granting reciprocity, the executive director may review firefighterlicensing or certification requirements and firefighter training standards from anotherstate, the District of Columbia, a United States territory, any branch of the UnitedStates military, or other firefighter training program approved by the executivedirector to identify those requirements and standards that are substantially similarto the curriculum and certification standards as set forth in Chapter 4765-24 of theAdministrative Code and this chapter.

(B) In accordance with section 5903.03 of the Revised Code, the division shall considersubstantially similar military experience, education, and training when determiningwhether an applicant who is a veteran or member of the armed forces has met all orpart of the requirements for a certificate. An applicant who is a veteran or member ofthe armed forces shall provide all relevant documentation demonstrating his or hermilitary experience, education, and training to assist the division in its determination.

(C) The executive director shall issueTo be eligible to receive a firefighter certificatethrough reciprocity pursuant to section 4765.55 of the Revised Code and this chapter,to an applicant who holds a current and valid firefighter certificate or license,that is in good standing, from another state, the District of Columbia, or a UnitedStates territory provided that the applicant meets shall meet all of the followingqualifications:

(1) The applicant is at least eighteen years of age;

(2) The applicant shall have successfully completed the following federal emergencymanagement agency training courses:



(3) The applicant shall have successfully completed a structured firefighter trainingcourse in another state, the District of Columbia, a United States territory,or other fire training program approved by the executive director that issubstantially similar to the training standards and curriculum as set forth inChapter 4765-24 of the Administrative Code. The training course shall havemet all of the following:

(a) The training course shall have included traditional classroom and practicalskills training in the subject areas identified in the Ohio firefightercurriculum as set forth in Chapter 4765-24 of the Administrative Code;

(b) The training course shall have required the applicant to pass one or morewritten and practical skills examinations that test knowledge, skills, andability to provide firefighter services;

(c) The training course shall have been was significantly similar to the currentcurriculum requirements for the level of certification sought;

(d) The training course shall have been was completed in the last thirty-sixmonths or the applicant shall have been was active with a fire departmentwithin the last thirty-six months.

(4) The applicant shall meet the objectives as set forth in "Emergency VehicleOperations Course Objectives" as approved by the executive director, withadvice and counsel of the committee, and meeting the following:successfullycompleted an emergency vehicle operations course consistent with thecourse requirements set forth in paragraph (D)(3) of rule 4765-20-02 of theAdministrative Code.

(a) The course shall have consisted of a minimum of sixteen hours;

(b) The course shall have been consistent with the intent of "NFPA 1002" and"NFPA 1451" and shall have met the course objectives as approved bythe executive director, with advice and counsel of the committee.

(5) The applicant shall have successfully completed hazardous materials awarenessand operations level training in accordance with the following: consistent withthe course requirements set forth in paragraph (D)(4) of rule 4765-20-02 of theAdministrative Code.

(a) The training shall have consisted of a minimum of twenty-four hours;

(b) The training shall have met the mission-specific competencies specified in"NFPA 1072" as required by "NFPA 1001";

(c) The training shall have met the objectives as set forth in the "HazardousMaterials Awareness and Operations Course Objectives" approved by theexecutive director, with advice and counsel of the committee;

(6) The applicant for firefighter requesting certification through reciprocity submitsa completed "Firefighter Reciprocity Packet" including documentation that allrequirements as specified in paragraph (C) of this rule have been met.

(D) The executive director shall issue To be eligible to receive a firefighter certificatethrough reciprocity pursuant to section 4765.55 of the Revised Code and this chapter,to an applicant who received a firefighter training course from any branch of theUnited States military, provided that the applicant meets shall meet all of thefollowing qualifications:

(1) The applicant shall have successfully completed the following federal emergencymanagement agency training courses:



(2) The applicant shall have successfully completed a structured firefighter trainingcourse in any branch of the United States military that is equal to orexceedssubstantially similar to the training standards and curriculum as set forthin Chapter 4765-24 of the Administrative Code. The training course shall havemet all of the following requirements:

(a) The training course shall have included traditional classroom and practicalskills training in the subject areas identified in the Ohio firefightercurriculum as set forth in Chapter 4765-24 of the Administrative Code;

(b) The training course shall have required the applicant to pass one or morewritten and practical skills examinations that test knowledge, skills, andability to provide firefighter services;

(c) The training course shall have been was significantly similar to the currentcurriculum requirements for the level of certification sought;

(d) The training course was completed in the last thirty-six months; or theapplicant was on active duty with a fire department within the last thirty-six months.

(3) An applicant that completed a structured training course in the United Statesmilitary shall submit documentation indicating:

(a) The training course was completed in the last thirty-six months; or

(b) The applicant was on active duty with a fire department within the last thirty-six months.

(4)(3) The applicant shall meet the objectives as set forth in "Emergency VehicleOperations Course Objectives" as approved by the executive director, withadvice and counsel of the committee, and meeting the following:successfullycompleted an emergency vehicle operations course consistent with thecourse requirements set forth in paragraph (D)(3) of rule 4765-20-02 of theAdministrative Code.

(a) The course shall have consisted of a minimum of sixteen hours;

(b) The course shall have been consistent with the intent of "NFPA 1002" and"NFPA 1451" and shall have met the course objectives as approved bythe executive director, with advice and counsel of the committee.

(5)(4) The applicant shall have successfully completed hazardous materialsawareness and operations level training in accordance with thefollowing:consistent with the course requirements set forth in paragraph (D)(4)of rule 4765-20-02 of the Administrative Code.

(a) The training shall have consisted of a minimum of twenty-four hours;

(b) The training shall have met the mission-specific competencies specified in"NFPA 1072" as required by "NFPA 1001";

(c) The training shall have met the objectives as set forth in the "HazardousMaterials Awareness and Operations Course Objectives" approved by theexecutive director, with advice and counsel of the committee;

(6)(5) The applicant for firefighter requesting certification through reciprocitysubmits a completed "Firefighter Reciprocity Packet" including documentationthat all requirements as specified in this paragraph (D) of this rule have beenmet.

(E) Upon compliance with all requirements for certification in paragraph (C) or (D) of thisrule, the applicant will be issued a letter of authorization to test by the division.

(1) Within twelve months after the applicant is approved for testing and the divisionissues a letter of authorization to test, the applicant shall pass the practical skillsexamination and the knowledge examination, as set forth in rule 4765-20-06of the Administrative Code, at the level of certification sought. An applicantwho fails to pass the practical skills and knowledge examinations within twelve

months of the issuance of the letter of authorization to test shall complete a newcourse of instruction at the level of certification sought.

(2) Practical skills and written examinations may be waived for applicantssuccessfully completing training that meets the requirements of this rulethrough the United States Militarymilitary within the last thirty-six months.

(F) The applicant shall submit a completed “Firefighter ReciprocityApplication”"Firefighter Reciprocity Application" within ninety days of passing thepractical skills examination and the knowledge examination. An applicant who failsto submit a completed "Firefighter Reciprocity Application" within the ninety daysshall complete a new course of instruction at the level of certification sought.

(G) In addition to the requirements set forth in paragraphs (C) to (F) of this rule, asapplicable, an applicant for firefighter:


(a) Any felony;





(H) In deciding whether to grant a firefighter certificate, the executive director, with theadvice and counsel of the committee, has the following options:

(1) The executive director shall issue a firefighter certificate to an applicant whomeets all of the requirements listed in paragraphs (C) or (D), (E), (F), and (G)or (D), (E), (F) and (G) of this rule;

(2) The executive director shall refuse to grant a firefighter certificate to an applicantwho fails to meet one or more of the requirements listed in paragraphs (C) or(D), (E), and (F) or (D), (E), and (F) of this rule, as applicable;

(3) The executive director may grant, refuse to grant, or restrict a firefighter certificateto an applicant who meets the requirements listed in paragraphs (C) or (D), (E),

and (F) or (D), (E), and (F) of this rule, but fails to meet one or more of therequirements listed in paragraph (G) of this rule.

(I) An applicant who is eligible for reinstatement is not eligible to apply for certificationby reciprocity at or below the level of the expired certificate.

4765-20-12 Fire safety inspector and hazard recognition officer continuingeducation.

(A) An applicant who wishes to renew a fire safety inspector certificate shall havecompletedcomplete twenty-four hours of continuing education training for thecertification within the three year certification cycle as set forth in this rule.

(B) Fire safety inspector continuing education requirements shall be approved by theapplicant's fire chief or a program director of a chartered program and shall includeany combination of the following training:

(1) The theory of fire code enforcement;

(2) Enforcement of fire codes;

(3) Life safety systemsystems of buildingbuildings and uses;

(4) The safe use and maintenance of facilities, buildings, and uses which are subjectto the state of Ohio fire code;

(5) The safe handling of materials which pose a fire hazard;

(6) Fire code administration;

(7) Legal method of code enforcement;

(8) Legal rights of landlords and tenants under federal, state, and local laws;

(9) The application, installation, use, and interpretation of the NFPA standards;

(10) Other training directly related to performance of fire safety inspection duties.

(C) An applicant who wishes to renew a hazard recognition officer certificate shall completesix hours of continuing education training within the three year certification cycle asset forth in this rule.

(D) Hazard recognition officer continuing education requirements shall be approved by theapplicant's fire chief or a program director of a chartered program and shall includeany combination of the following training:

(1) Means of egress;

(2) Flammable and combustible liquids storage, use, and handling;

(3) Combustible waste material handling and storage;

(4) Open flames requirements and restrictions;

(5) Hazards to firefighters;

(6) Fire protection system access and clearances;

(7) Fire separation integrity including fire doors and fire walls;

(8) Commercial cooking hazards;

(9) Basic electrical equipment and wiring hazards; and

(10) Other training directly related to performance of hazard recognition officerduties.

(E) If a new fire code is adopted by the state of Ohio, a fire safety inspector and hazardrecognition officer shall attend continuing education of not less than four hoursrelated to the new fire code. The continuing education shall be completed withinsix months of the adoption of the new fire code. The fire safety inspector shallmaintain documentation of completion of this update. These four hours may becounted towards the requirements set forth in paragraph (A) of this rule.

(F)(E) Fire safety inspector and hazard recognition officer continuing education shall beprovided by or under the auspices of institutions of higher education, recognizedstate agencies, chartered training programs, fire schools, fire training academies, or afire department operated by federal, state, county, or local government, or non-profitorganizations.

(F) Continuing education shall be approved by a program director of a chartered programor by the applicant's fire chief.

(G) If a new fire code is adopted by the state of Ohio, a fire safety inspector and hazardrecognition officer shall attend continuing education of not less than four hoursrelated to the new fire code. The continuing education shall be completed within sixmonths of the adoption of the new fire code. The fire safety inspector and hazardrecognition officer shall maintain documentation of completion of this update.

(1) The four hours shall be completed in accordance with paragraphs (E) and (F) ofthis rule; and

(2) The four hours may be counted towards the requirements set forth in paragraphs(A) and (C) of this rule.

(G)(H) Routine duties such as responding to emergencies, performing station duties andvehicle maintenance, conducting fire safety inspections, participating in civic events,and other daily or weekly job duties shall not be credited toward fire safety inspectorandor hazard recognition officer continuing education.

(H)(I) No applicant shall receive credit for more than twelve hours of continuing educationtraining in any one calendar day.

(I)(J) No applicant shall receive continuing education credit for the identical online trainingclass, taken more than once per calendar year.

(J)(K) Extension of time to complete fire safety inspector or hazard recognition officercontinuing education shall be permitted as set forth in rule 4765-20-13 of theAdministrative Code.

(K) Extension of time to complete hazard recognition officer continuing education is notpermitted.

(L) Credit for continuing education received during the period of an extension, up to andincluding the date the renewal application is submitted, shall not be used as credit forcontinuing education in the subsequent certification cycle.

(M) The holder of a fire safety inspector or hazard recognition officer certificate shallmaintain records of continuing education required by this rule for the current andprevious certification cycles.

(1) Such records shall include the course title, date, hours claimed, and who providedthe training.

(2) Upon request, documentation shall be provided to the division within the timeparameters set forth by the executive director.

(N) For the purpose of continuing education approval, fire chief means a certified firefighterwho has been designated as the head of a fire department or private firefightingbrigade.

(O) Military provisions related to fire safety inspector and hazard recognition officercontinuing education:

(1) The division shall consider relevant education, training, or service completed bythe certificate holder as a member of the armed forces in determining whetherthe certificate holder has fulfilled required continuing education.

(2) In accordance with section 5903.12 of the Revised Code and this chapter of theAdministrative Code, a certificate holder who has served on active duty duringthe current or prior certification cycle may request an extension of time tocomplete the current continuing education as set forth in rule 4765-20-13 of theAdministrative Code.

(3) All provisions of paragraph (O) of this rule shall apply to any certificate holderwho is the spouse of a person who has served on active duty when that serviceresulted in the certificate holder's absence from this state.

(P) An applicant for renewal who has a fire safety inspector or hazard recognitionofficer certification cycle that is less than thirty-six months shall complete thepro-rated continuing education requirements as set forth in rule 4765-20-16 of theAdministrative Code.

4765-20-16 Firefighter, fire safety inspector, or hazard recognition officercertification cycles and continuing education requirements.

(A) This rule shall apply to individuals applying for initial certification and certificationthrough reciprocity or reinstatement of a firefighter, fire safety inspector, or hazardrecognition officer certificate.

(B) A firefighter certificate shall expire on the individual's date of birth in the third year,except as provided in paragraph (C) of this rule. In order to be eligible to renewthe firefighter certificate, the individual shall complete continuing education, inaccordance with rule 4765-20-11 of the Administrative Code, for a reduced amountof hours according to the length of the certification cycle.

(C) A firefighter certificate issued to an individual who also holds a current EMS providercertificate to practice, as defined in rule 4765-25-014765-1-01 of the AdministrativeCode, shall expire on the same date as the EMS provider's certificate to practice. Inorder to be eligible to renew the firefighter certificate, the individual shall completecontinuing education, in accordance with rule 4765-20-11 of the AdministrativeCode, for the following reduced hours and certification cycle:

(1) Less than twelve months, no continuing education is required;

(2) Twelve months but less than twenty-four months, eighteen hours of continuingeducation is required;

(3) Twenty-four months but less than thirty-six months, thirty-six hours of continuingeducation is required;

(4) Thirty-six months or more, fifty-four hours of continuing education is required.

(D) Except as provided in paragraph (E) of this rule, a fire safety inspector certificateshall expire on the same date as the individual's firefighter certification, or on theindividual's date of birth in the third year if the individual does not possess acurrent firefighter certificate. In order to be eligible to renew the fire safety inspectorcertificate, the individual shall complete continuing education, in accordance withrule 4765-20-12 of the Administrative Code, for a reduced amount of hours accordingto the length of the certification cycle.

(E) A fire safety inspector certificate issued to an individual who also holds a current EMSprovider certificate to practice, but does not hold a firefighter certificate, shall expireon the same date as the EMS provider's certificate to practice. In order to be eligibleto renew the fire safety inspector certificate, the individual shall complete continuingeducation, in accordance with rule 4765-20-12 of the Administrative Code, for thefollowing reduced hours and certification cycle:

(2) Twelve months but less than twenty-four months, teneight hours of continuingeducation is required;

(3) Twenty-four months but less than thirty-six months, sixteen hours of continuingeducation is required;

(3)(4) Thirty-six months or more, thirtytwenty-four hours of continuing education isrequired.

(F) A hazard recognition officer certificate shall expire on the same date as the individual'sfirefighter certification, or on the individual's date of birth in the third year if theindividual does not possess a current firefighter certificate. In order to be eligibleto renew the hazard recognition officer certificate, the individual shall completecontinuing education, in accordance with rule 4765-20-12 of the AdministrativeCode, for a reduced amount of hours according to the length of the certification cycle.


(2) Twelve months but less than twenty-four months, two hours of continuingeducation is required;

(3) Twenty-four months but less than thirty-six months, four hours of continuingeducation is required;

(4) Thirty-six months or more, six hours of continuing education is required.

(G) Once a mutual expiration date is established for all EMS and fire certificates, allcertificates will be issued a three-year certification cycle and shall expire on theindividual's date of birth in the third year.

(H) Once a mutual expiration date is established for all EMS and fire certificates, theexpiration date will not be changed and any newly obtained certificate will beassigned the current expiration date in accordance with this rule and a shortenedcertification cycle for the newly issued certificate.

4765-21-03 Qualifications for an instructor certificate.


(A) An applicant for a fire instructor certificate shall meet all the following requirements:

(1) In the preceding seven years, an applicant shall have been certified for at leastfive years as a firefighter;


(3) Shall pass the fire instructor knowledge examination as set forth in paragraph (A)of rule -4765-21-05 of the Administrative Code. The fire instructor knowledgeexamination shall be taken within one year prior to admission intothe start ofa fire instructor course;

(4) Shall complete a fire instructor training course consisting of a minimum of sixtyhours as set forth in paragraph (A) of rule 4765-24-15 of the AdministrativeCode;

(5) Shall pass the instructional methods examination, as set forth in rule 4765-21-05of the Administrative Code;

(6) Shall comply with the requirements for a firefighter certificate as set forth inparagraph (F) of rule 4765-20-02 of the Administrative Code;

(7) Shall submit a completed "Fire, Assistant Fire, or Fire Safety Inspector InstructorInitial Application" no later than two years after passing the fire instructorknowledge examination.

(B) An applicant for an assistant fire instructor certificate shall meet all the followingrequirements:

(1) In the preceding seven years, an applicant shall have been certified for at leastfive years as a firefighter; and


(3) Shall pass the fire instructor knowledge examination as set forth in paragraph (E)of rule 4765-21-05 of the Administrative Code. The fire instructor knowledgeexamination shall be completed within one year of prior to completingrequirements as set forth in paragraphs (B)(5) to (B)(7)(8) of this rule.

(4) Shall comply with the requirements for a firefighter certificate as set forth inparagraph (F) of rule 4765-20-02 of the Administrative Code;

(5) Shall complete the four hour fire service training module "Fire Service TrainingModule" incorporated in the "Ohio Fire and EMS Instructor Curriculum";

(6) Shall complete the four hour live fire training awareness module "Live FireTraining Awareness Module" incorporated in the "Ohio Fire and EMSInstructor Curriculum";

(7) Shall complete ten hours of supervised teaching:

(a) In the presence of a fire instructor trainer and under the auspices of achartered program; and

(b) Including a minimum of six hours of classroom lecture and a maximum offour hours of practical skills instruction.

(8) Shall submit a completed "Fire, Assistant Fire, or Fire Safety Inspector InstructorInitial Application"Application." no later than two years after passing the fireinstructor knowledge examination.

(C) For those certified as a fire instructor or assistant fire instructor between April 7, 2014,through December 31, 2017, the holder of a fire instructor or assistant fire instructorcertificate, who wishes to provide instruction in any live fire training evolutionsrequired for certification as a firefighter, shall successfully complete the "Live FireTraining OperationsTraining-Operations Level Course" through a chartered programin order to be eligible for certification.

(1) The "Live Fire Training OperationsTraining-Operations Level Course" shallconsist of a minimum of twenty-four hours as set forth in paragraph (H)(C) ofrule 4765-24-15 of the Administrative Code.

(2) Credit may be given for successful completion of a substantially similar live firetraining operations course when approved by the executive director.

(3) Fire instructors and assistant fire instructors who wish to provide instruction inlive fire training evolution shall submit a completed "Live Fire Instructor InitialApplication" no later than September 1, 2020.

(D) Effective January 1, 2018, the holder of a fire instructor or assistant fire instructorcertificate, who wishes to provide instruction in any live fire training evolutionsrequired for certification as a firefighter, shall meet the following requirements:

(1) Applicants shall complete the "Live Fire Training OperationsTraining-OperationsLevel Course" through a chartered program except that credit may be givenfor successful completion of a substantially similar live fire training operationscourse when approved by the executive director;

(2) Applicants shall complete the job performance requirements set forth in the "LiveFire Training Operations Job Performance Requirement Check-Off Packet.""under the auspices of a chartered program within twelve months of completionof the "Live Fire Training Operations Course";

(a) The job performance requirements shall be completed under the auspicesof a chartered program;

(b) The job performance requirements shall be completed within twelve monthsof completion of the "Live Fire Training-Operations Level Course";

(3) Applicants shall submit a completed "Live Fire Instructor Initial Application"within ninety days after completion of the job performance requirements setforth in the "Live Fire Training Operations Job Performance RequirementCheck-Off Packet."

(E) Effective January 1, 2021, no person shall provide instruction in live fire trainingevolutions required for certification as a firefighter without possessing a live fireinstructor certificate:

(1) The training shall be obtained as set forth in paragraph (C) or (D) of this rule;

(2) The holder of a certificate to teach may be eligible for certification as a live fireinstructor through exemption as specified in paragraph (F) of this rule.

(F) A holder of a current and valid fire instructor or assistant fire instructor certificate onApril 6, 2014, who wishes to provide instruction in any live fire training coursesshall be exempt from the requirements set forth in paragraphs (C) and (D) of this ruleprovided:

(1) The fire instructor or assistant fire instructor certificate does not expire andbecome subject to the reinstatement process for a fire instructor or assistant fireinstructor certificate; and

(2) The fire instructor or assistant fire instructor submits a "Live Fire Instructor InitialApplication" no later than December 31, 2020.

(G) An applicant for a live fire instructor certificate shall meet all of the followingrequirements:

(1) Shall possess a current and valid fire instructor or assistant fire instructorcertificate that is in good standing;

(2) Shall meet the appropriate live fire instructor requirements as set forth inparagraphs (C) to (F) of this rule;

(3) Shall submit a completed "Live Fire Instructor Initial Application."

(H) An applicant who fails to meet the time frames as set forth in paragraphs (C), (D), and(F) of this rule is not eligible to receive a live fire training certificate. The applicantshall complete a new course of instruction and meet all qualifications for a live fireinstructor as provided in this rule.

(I) An applicant for a fire safety inspector instructor certificate shall meet all of thefollowing requirements:

(1) In the preceding seven years, an applicant shall have been certified for at leastfive years as a fire safety inspector; and

(2) Shall possess a current and valid fire safety inspector certificate that is in goodstanding;

(3) Shall pass the fire safety instructor inspector instructor knowledge examinationas set forth in paragraph (C) of rule 4765-21-05 of the Administrative Code.The fire instructor knowledge examination shall be taken within one year priorto admission intothe start of a fire safety inspector instructor course;

(4) Shall complete a fire safety inspector instructor training course consisting of aminimum of sixty hours as set forth in paragraph (A) of rule 4765-24-16 of theAdministrative Code;

(5) Shall pass the instructional methods examination, as set forth in paragraph (C) ofrule 4765-21-05 of the Administrative Code;

(6) Shall comply with the requirements for a fire safety inspector certificate as setforth in paragraph (D) of rule 4765-20-03 of the Administrative Code.

(7) Shall submit a completed "Fire, Assistant Fire, or Fire Safety Inspector InstructorInitial Application" no later than two years after passing the fire safety inspectorinstructor knowledge examination.

(J) If an applicant does not complete all requirements for a fire instructor or fire safetyinspector instructor certificate within two years of passing the fire safety inspectorinstructor knowledge examination, the applicant shall complete all requirements of

this chapter to be eligible for certification.is unable to complete all requirementsfor a fire instructor or fire safety inspector instructor certificate within two years ofpassing the fire instructor or fire safety inspector instructor knowledge examination,the applicant shall complete a new fire instructor or fire safety inspector instructortraining course and meet all criteria for a fire instructor or fire safety inspectorinstructor as set forth in this rule.

(K) An individual holding an instructor certificate shall immediately relinquish suchcertificate under the following circumstances:

(1) A fire instructor certificate or assistant fire instructor certificate shall relinquishtheir instructor certificate if their be relinquished if the holder's firefightercertificate is revoked or surrendered;

(2) A fire safety inspector instructor certificate shall be relinquish relinquished iftheir instructor the holder's certificate if their fire safety inspector certificate isrevoked or surrendered.;

(3) A live fire instructor certificate shall relinquish their live fire instructor certificateif their be relinquished if the holder's fire instructor certificate or assistant fireinstructor certificate is revoked or surrendered.

(L) A fire instructor, assistant fire instructor, live fire instructor, or fire safety inspectorinstructor training certificate issued pursuant to this rule shall be issued in accordancewith the certification cycles and pro-rated renewal requirements set forth in rule4765-21-15 of the Administrative Code.

4765-21-05 Fire instructor, assistant fire instructor, and fire safety inspectorinstructor examinations.

(A) The initial examinations required for a fire instructor certificate shall consist of aknowledge examination and instructional methods examination as approved by theexecutive director, with the advice and counsel of the committee.

(1) The knowledge examination for fire instructor shall meet the following:

(a) The knowledge examination shall be taken within one year prior toadmission intothe start of a fire instructor course;

(b) The knowledge examination shall be taken at the firefighter II level;

(c) A passing score of at least eighty per cent on the knowledge examination isrequired for admission into a fire instructor course;

(d) If an applicant is unable to pass the knowledge examination within threeattempts, the applicant shall wait for a time period of six monthsand complete a new firefighter I and II training course as set forthin rule 4765-24-13 of the Administrative Code before attempting theexamination again.

(2) The instructional methods examination shall meet the following:

(a) A passing score of at least seventy per cent on the instructional methodsexamination is required for certification;

(b) The instructional methods examination required for certification shall bepassed within three attempts;

(c) If an applicant is unable to pass the instructional methods examinationwithin three attempts, the applicant shall complete a new fire instructortraining course as set forth in rule 4765-24-15 of the Administrative Codeand meet all criteria for a fire instructor as set forth in rule 4765-21-03of the Administrative Code.

(B) The reinstatement examination required for a fire instructor certificate shall consist ofthe instructional methods examination as approved by the executive director, withthe advice and counsel of the committee.

(1) A passing score of at least seventy per cent on the instructional methodsexamination is required for reinstatement.

(2) The instructional methods examination required for certification shall be passedwithin three attempts.

(3) If an applicant is unable to pass the examination within three attempts, theapplicant shall complete a new fire instructor training course as set forth in rule4765-24-15 of the Administrative Code and meet all criteria for a fire instructoras set forth in rule 4765-21-03 of the Administrative Code.

(C) The initial examinations required for a fire safety inspector instructor certificateshall consist of a knowledge examination and instructional methods examination asapproved by the executive director, with the advice and counsel of the committee.

(1) The knowledge examination for fire safety inspector instructor shall meet thefollowing:

(a) The knowledge examination shall be taken within one year prior toadmission intothe start of a fire safety inspector instructor course;

(b) The knowledge examination shall be taken at the fire safety inspector level;

(c) A passing score of at least eighty per cent on the knowledge examination isrequired for admission into a fire safety inspector instructor course;

(d) If an applicant is unable to pass the knowledge examination within threeattempts, the applicant shall wait for a time period of six monthsand complete a new fire safety inspector training course as set forthin rule 4765-24-14 of the Administrative Code before attempting theexamination again.

(2) The instructional methods examination shall meet the following:

(a) A passing score of at least seventy per cent on the instructional methodsexamination is required for certification;

(b) The instructional methods examination required for certification shall bepassed within three attempts;

(c) If an applicant is unable to pass the examination within three attempts, theapplicant shall complete a new fire safety inspector instructor trainingcourse as set forth in rule 4765-24-16 of the Administrative Code andmeet all criteria for a fire instructor as set forth in rule 4765-21-03 of theAdministrative Code.

(D) The reinstatement examination required for a fire safety inspector instructor certificateshall consist of an instructional methods examination as approved by the executivedirector, with the advice and counsel of the committee.

(1) A passing score of at least seventy per cent on the instructional methodsexamination is required for certification.

(2) The instructional methods examination required for certification shall be passedwithin three attempts.

(3) If an applicant is unable to pass the examination within three attempts, theapplicant shall complete a new fire safety inspector instructor training courseas set forth in rule 4765-24-16 of the Administrative Code and meet all criteriafor a fire instructor as set forth in rule 4765-21-03 of the Administrative Code.

(E) The initial examination required for assistant fire instructor shall consist of a knowledgeexamination as approved by the executive director, with the advice and counsel ofthe committee.

(1) The knowledge examination shall be taken prior to and within one year ofcompleting requirements as set forth in paragraphs (B)(5) to (B)(7)(8) of rule4765-21-03 of the Administrative Code.

(2) The knowledge examination for assistant fire instructor shall be taken at thefirefighter I or firefighter II level.

(a) Applicants certified as a volunteer firefighter or firefighter I shall take theexamination at the firefighter I level;

(b) Applicants certified as a firefighter II shall take the examination at thefirefighter II level.

(3) A passing score of at least seventy per cent on the knowledge examination isrequired for certification.

(4) If an applicant is unable to pass the knowledge examination within three attempts,the applicant shall wait for a time period of six months and complete a newfirefighter I and II training course as set forth in rule 4765-24-13 of theAdministrative Code before attempting the examination again.

(a) An applicant certified as a volunteer firefighter or firefighter I shall take thefirefighter I course as set forth in rule 4765-24-11 of the AdministrativeCode;

(b) An applicant certified as a firefighter II shall take the firefighter I and IIcourse as set forth in rule 4765-24-13 of the Administrative Code.

(F) An applicant may be approved to use the results of a recently completed fire instructorfirefighter or fire safety inspector knowledge examination in lieu of taking the fireinstructor or fire safety inspector instructor knowledge examination if:

(1) The request is submitted in writing to the executive director;

(2) The examination was completed within the last twelve monthsone year prior tothe start of the fire instructor or fire safety inspector instructor course;

(3) The examination was taken at the firefighter IIappropriate level;

(4) An examination score of at least eighty per cent was obtained.

(G) The request to use the results of a recently completed fire instructorfirefighter orfire safety inspector knowledge examination in lieu of taking the fire instructorknowledge examination must be approved by the executive director prior to the startof the course.

4765-21-07 Reinstatement of a fire instructor, assistant fire instructor, livefire instructor, or fire safety inspector instructor certificate toteach.


(A) A fire instructor, assistant fire instructor, live fire instructor, or fire safety inspectorinstructor certificate shall expire on its expiration date, if the applicant fails to renewsuch certificate on or before the expiration date of the certificate.

(B) The executive director shall reinstate a fire instructor, live fire instructor, or fire safetyinspector instructor certificate that has expired, or becomes invalid due to a voluntarysurrender, in accordance with the parameters set forth in this rule.

(C) An assistant fire instructor that fails to renew the certificate by the expiration date isnot eligible for reinstatement. The applicant shall apply as a new applicant pursuantto rule 4765-21-04 of the Administrative Code.

(D) In order to be eligible to reinstate a fire instructor certificate that has expired, or becomesinvalid due to a voluntary surrender, an applicant, in addition to the requirements setforth in paragraphs (E) to (H) of this rule, as applicable, shall meet all of the followingrequirements:

(1) In the preceding seven years, the applicant shall have been certified for at leastfive years as a firefighter;

(2) The applicant shall possess a current and valid firefighter certificate that is in goodstanding and:

(a) Shall not have been convicted of any of the following:

(i) Any felony;

(ii) A misdemeanor committed in the course of practice;

(iii) A misdemeanor involving moral turpitude.

(b) Shall not have committed fraud, misrepresentation, or material deceptionin applying for, or obtaining a certificate issued under section 4765.55 ofthe Revised Code and this chapter.

(3) The applicant shall have previously held a fire instructor training certificate thatwas in good standing at the time the certificate expired or was voluntarilysurrendered;

(4) The applicant shall submit a completed "Fire, Fire Safety Inspector, and/or LiveFire Instructor Reinstatement Application."

(E) The executive director shall reinstate a fire instructor certificate that has expired, orbecome invalid due to a voluntary surrender, for no later than ninety days from theexpiration date or date of surrender, if the applicant meets all requirements as set forthin paragraph (D) of this rule and all of the following requirements:

(1) The applicant provides documentation to the division that all continuingeducation and instructional requirements as set forth in rule 4765-21-06 ofthe Administrative Code were met for the last certification cycle prior to thecertificate's expiration date or date of surrender. If the continuing education andinstructional requirements were not completed prior to expiration date or dateof surrender, the applicant is not eligible for reinstatement under this paragraph;



(F) The executive director shall reinstate a fire instructor certificate that has expired, orbecome invalid due to a voluntary surrender, for no later than six months from theexpiration date or date of surrender, if the applicant meets all requirements as set forthin paragraph (D) of this rule and all of the following requirements:

(1) The applicant passes an instructional methods examination, as set forth in rule4765-21-05 of the Administrative Code;



(G) The executive director shall reinstate a fire instructor certificate that has expired, orbecome invalid due to a voluntary surrender, for more than six months, but no laterthan one year from the expiration date or date of surrender, if the applicant meetsall requirements as set forth in paragraph (D) of this rule and all of the followingrequirements:


(2) The applicant completes ten hours of supervised teaching:

(a) In the presence of a fire safety inspector instructor trainer and under theauspices of a chartered program; and




(H) The executive director shall reinstate a fire instructor certificate that has expired, orbecome invalid due to a voluntary surrender, for more than a year but less thantwo years from the expiration date or date of surrender, if the applicant meets allrequirements as set forth in paragraph (D) of this rule and all of the followingrequirements:





(3) The applicant completes eight hours of instruction, as set forth in paragraphs (A)(2) to (A)(3) of rule 4765-24-15 of the Administrative Code, through a charteredprogram, as follows:

(a) Completion of the four hour fire service training module "Fire ServiceTraining Module"incorporated in the "Ohio Fire and EMS InstructorCurriculum";

(b) Completion of the four hour live fire training awareness module "Live FireTraining Awareness Module"incorporated in the "Ohio Fire and EMSInstructor Curriculum";

(I) If a fire instructor certificate has been expired, or become invalid due to voluntarysurrender, for two years or more from the expiration date or date of surrender, theapplicant shall complete a new fire instructor course and meet all requirements for afire instructor certificate as outlined in rule 4765-21-03 of the Administrative Code.

(J) In order to reinstate a fire safety inspector instructor certificate that has expiredor becomes invalid due to voluntary surrender, an applicant, in addition to therequirements set forth in paragraphs (K) to (N) of this rule, as applicable, shall meetall of the following requirements:

(1) In the preceding seven years, the applicant shall have been certified for at leastfive years as a fire safety inspector;

(2) The applicant shall possess a current and valid fire safety inspector certificate thatis in good standing and:


(i) Any felony;




(3) The applicant shall have previously held a fire safety inspector instructorcertificate that was in good standing at the time the certificate expired or wasvoluntarily surrendered.;


(K) The executive director shall reinstate a fire safety inspector instructor certificate that hasexpired, or become invalid due to a voluntary surrender, for no later than ninety daysfrom the expiration date or date of surrender, if the applicant meets all requirementsas set forth in paragraph (J) of this rule and all of the following:

(1) The applicant provides documentation to the division that all continuingeducation and instructional requirements as set forth in rule 4765-21-06 ofthe Administrative Code were met for the last certification cycle prior tothe certificate's expiration date. If the continuing education and instructional

requirements were not completed prior to expiration date, the applicant is noteligible for reinstatement under this paragraph.



(L) The executive director shall reinstate a fire safety inspector instructor certificate that hasexpired, or become invalid due to a voluntary surrender, for no later than six monthsfrom the expiration date or date of surrender, if the applicant meets all requirementsas set forth in paragraph (K) of this rule and all of the following:




(M) The executive director shall reinstate a fire safety inspector instructor certificate thathas expired, or become invalid due to a voluntary surrender, for more than sixmonths, but no later than one year from the expiration date or date of surrender, ifthe applicant meets all requirements as set forth in paragraph (K) of this rule and allof the following:

(N) The executive director may reinstate a fire safety inspector instructor training certificatethat has expired, or become invalid due to a voluntary surrender, for more than ayear but less than two years from the expiration date or date of surrender, if theapplicant meets all requirements as set forth in paragraph (K) of this rule and all ofthe following:





(3) The applicant completes the eight hour fire safety inspector training module"FireSafety Inspector Training Module" incorporated in the "Ohio Fire and EMSInstructor Curriculum";



(O) If a fire safety inspector instructor certificate has been expired or become invalid dueto voluntary surrender, for two years or more from the expiration date or date ofsurrender, the applicant shall complete a new fire safety inspector instructor courseand meet all requirements for a fire safety inspector instructor certificate as set forthin rule 4765-21-03 of the Administrative Code.

(P) In order to be eligible to reinstate a live fire instructor certificate that has expired,or becomes invalid due to a voluntary surrender, an applicant shall meet all of thefollowing requirements:

(1) In the preceding seven years, the applicant shall have been certified for at leastfive years as a fire instructor or assistant fire instructor;

(2) The applicant shall possess a current and valid fire instructor or assistant fireinstructor certificate that is in good standing and:

(i) Any felony;




(3) The applicant shall have previously held a live fire instructor certificate that was ingood standing at the time the certificate expired or was voluntarily surrendered;



(Q) If a live fire instructor certificate has been expired or become invalid due to voluntarysurrender, for two years or more from the expiration date or date of surrender, theapplicant shall complete a new "Live Fire Training OperationsTraining-OperationsLevel Course" and meet all requirements for a live fire instructor certificate as setforth in rule 4765-21-03 of the Administrative Code.

(R) A holder of a current and valid fire instructor certificate exempt from live fire trainingoperations course requirements as set forth in rule 4765-21-03 of the AdministrativeCode, shall no longer be exempt from the requirements to complete the "Live FireTraining OperationsTraining-Operations Level Course" and the "Live Fire TrainingOperations Job Performance Requirement Check-Off" if the fire instructor certificatehas become subject to the reinstatement processand the job performance requirementsset forth in the "Live Fire Training Operations Job Performance Requirement Check-Off Packet" if the fire instructor certificate has become subject to the reinstatementprocess.

(S) If a fire instructor who held a live fire instructor certificate that was in good standing atthe time of expiration or voluntary surrender is reinstated by the executive director,the live fire instructor certificate shall automatically be reinstated if the certificate hasbeen expired or surrendered for a period of less than two years.

(T) An applicant seeking reinstatement of a fire instructor certificate that has been expiredor become invalid due to voluntary surrender for two years or more, who wishes toprovide instruction in any live fire training courses under the auspices of a charteredprogram, shall successfully complete the "Live Fire Training OperationsTraining-Operations Level Course" through a chartered program. Credit may be given for

completion of a substantially similar live fire training operations course whenapproved by the executive director.

(U) In order for a fire instructor, live fire instructor, or fire safety inspector instructorcertificate to be reinstated, the fire instructor, live fire instructor, or fire safetyinspector instructor training course completed by the applicant shall be substantiallysimilar to the current curriculum requirements. If such training is not substantiallysimilar to the current curriculum, the applicant shall complete additional course workin the areas of deficiency through a chartered program.

(V) If an applicant's certification cycle was less than thirty-six months, the applicant shallcomplete the pro-rated renewal requirements as set forth in rule 4765-21-15 of theAdministrative Code.

(6) The applicant shall complete the eight hour fire safety inspector trainingmodule"Fire Safety Inspector Training Module" incorporated in the "Ohio Fireand EMS Instructor Curriculum";

(D) In order for a fire instructor or a fire safety inspector instructor certificate to bereinstated, the training course completed by the applicant shall be substantially similarto the current curriculum requirements. If such training is not substantially similarto the current curriculum, the applicant shall complete additional coursework in theareas of deficiency through a chartered program.

(E) The executive director may reinstate a live fire instructor certificate that was revokedat the time of fire instructor certificate revocation, upon reinstatement of the fireinstructor certification. The live fire instructor certificate shall have been in goodstanding at the time of revocation of the fire instructor certificate. Reinstatement shalltake into account factors listed in paragraph (F) of this rule.

(F) In addition to meeting the requirements set forth in this rule, the executive director maytake into consideration other relevant factors when determining whether to grant arequest for reinstatement. These factors include, but are not limited to the following:

(1) The nature and severity of the acts that resulted in the revocation of the applicant'scertificate;

(2) The time that has elapsed since the revocation;

(3) Additional convictions or violations of the Revised Code occurring after therevocation of the certificate;

(4) Any evidencedocumentation of rehabilitation, including but not limited to,appropriate treatment or counseling, which the applicant shall submitdocumentation to the executive director;

(5) Evidence of additional education or training, which the applicant shall submit tothe executive director;

(6) Compliance with previous executive director orders or consent agreements;

(7) Compliance with court ordered sentencing;

(8) Employment history, including compliance with any departmental discipline,which the applicant may submit to the executive director.

(G) The executive director shall not reinstate a certificate to teach, if either of the followingapply:

(1) The applicant's certificate to teach was permanently revoked by the executivedirector;

(2) The applicant's certificate to teach has been revoked for more than two years. Suchapplicant shall complete a new training course and apply for a new certificateof fire service instructor training under rule 4765-21-03 of the AdministrativeCode.

(H) An assistant fire instructor that has been revoked is not eligible for reinstatement.The applicant shall apply as a new applicant pursuant to rule 4765-21-04 of theAdministrative Code.

(I) A certificate to teach issued pursuant to this rule shall be issued in accordance with thecertification cycles and pro-rated renewal requirements set forth in rule 4765-21-15of the Administrative Code.

4765-21-09 Reciprocity for fire instructor.


(A) For purposes of granting reciprocity, the executive director may review firefighterinstructor licensing or certification requirements and firefighter instructor trainingstandards from another state, the District of Columbia, a United States territory,any branch of the United States military, or, other fire instructor training programapproved by the executive director, to identify those requirements and standardsthat are substantially similar to the curriculum and certification standards set forthin section 4765.55 of the Revised Code and Chapters 4765-21 and 4765-24 of theAdministrative Code.

(B) The executive director shall issue a fire instructor certificate by reciprocity pursuantto section 4765.55 of the Revised Code and Chapter 4765-21 of the Administrativecode to an applicant who possesses a current and valid certificate or license to teachfire training, that is in good standing, from another state, the District of Columbia,or a United States territory provided that the applicant meets all of the followingqualifications:

(1) The applicant submits a completed "Fire Instructor Reciprocity Packet";

(2) The applicant submits documentation to the division demonstrating that theapplicant has completed a structured course of instruction in another state, theDistrict of Columbia, a United States territory, or other firefighter instructortraining program approved by the executive director that is substantially similarto the training standards and curriculum requirements set forth in paragraph (A)(1) of rule 4765-24-15 of the Administrative Code;

(3) The applicant possesses a current firefighter certificate issued under section4765.55 of the Revised Code and rule 4765-20-02 of the Administrative Codethat is in good standing;

(4) In the preceding seven years, the applicant has at least five years of experience asa certified firefighter. Experience as a firefighter in another state, the District ofColumbia, a United States territory, or any branch of the United States militarymay be used to fulfill this requirement;

(5) Shall pass the fire instructor knowledge examination as set forth in rule4765-21-05 of the Administrative Code. The fire instructor knowledge

(1) The applicant submits a completed "Fire Instructor Reciprocity Packet";

(2) The applicant submits documentation to the division demonstrating that theapplicant completed a structured course of instruction in the United Statesmilitary that is substantially similar to the training standards and curriculumrequirements as set forth in paragraph (A)(1) of rule 4765-24-15 of theAdministrative Code;

(3) The applicant possesses a current firefighter certificate issued under section4765.55 of the Revised Code and rule 4765-20-02 of the Administrative Codethat is in good standing;

(4) In the preceding seven years, the applicant has at least five years of experience asa certified firefighter. Experience as a firefighter in another state, the District ofColumbia, a United States territory, or any branch of the United States militarymay be used to fulfill this requirement, as approved by the program director;

(5) Shall pass the fire instructor knowledge examination as set forth in rule4765-21-05 of the Administrative Code. The fire instructor knowledgeexamination shall be completed in the twelve months preceding admission intothe fire instructor course.

(6) The applicant passes the instructional methods examination, as set forth in rule4765-21-05 of the Administrative Code;

(F) If an applicant is eligible for reinstatement as set forth in rule 4765-21-07 and rule4765-21-08 of the Administrative Code, then that applicant is not eligible to be issueda certificate under this rule.

(G) For an application to be considered complete:

(1) The application shall be filled out in the manner as specified;

(2) All required documentation shall be provided;

(3) Requirements set forth in paragraphs (B) and (C) of this rule shall be completedwithin twelve months.

(1) The applicant successfully completed a structured course of instruction inanother state, the District of Columbia, a United States territory, or otherfirefighter instructor training program approved by the executive director thatis substantially similar to the training standards and curriculum requirementsset forth in paragraph (A)(1) of rule 4765-24-15 of the Administrative Code;

(2) The applicant shall possess a current firefighter certificate issued under section4765.55 of the Revised Code and rule 4765-20-02 of the Administrative Codethat is in good standing;

(3) In the preceding seven years, the applicant has at least five years of experience asa certified firefighter. Experience as a firefighter in another state, the District ofColumbia, a United States territory, or any branch of the United States militarymay be used to fulfill this requirement;

(C) The applicant for a fire instructor requesting certification through reciprocity shallsubmit a completed "Fire Instructor Reciprocity Packet" including documentationthat all requirements as specified in paragraphs (B)(1) to (B)(3) of this rule have beenmet.

(D) Upon compliance with all requirements for certification in paragraphs (B) and (C) ofthis rule, the applicant will be issued a letter of authorization to test by the division.

(E) Within twelve months after the applicant is approved for testing and the division issuesa letter of authorization to test, the applicant shall:

(1) Pass the fire instructor knowledge examination as set forth in paragraph (A) ofrule 4765-21-05 of the Administrative Code;

(2) Pass the instructional methods examination as set forth in paragraph (A) of rule4765-21-05 of the Administrative Code;

(3) Complete all of the following requirements:

(a) The four hour "Fire Service Training Module";

(b) The four hour "Live Fire Training Awareness Module";

(4) Complete ten hours of supervised teaching:

(a) The supervised teaching shall be completed in the presence of a fireinstructor trainer and under the auspices of a chartered program;

(b) The supervised teaching shall include a minimum of six hours of classroomlecture and a maximum of four hours of practical skills instruction

(c) The supervised teaching may not occur until the student has completed thetwo four-hour modules as set forth in paragraph (E)(3) of this rule.

(F) An applicant that fails to complete the requirements set forth in paragraph (E) of thisrule within the twelve month time frame shall complete a new course of instruction.

(G) After completing the requirements set forth in paragraph (E) of this rule, the applicantshall submit a completed "Fire Instructor Reciprocity Application" within ninetydays. An applicant that fails to submit a completed "Fire Instructor ReciprocityApplication" within ninety days shall complete a new course of instruction.

(H) In addition to the requirements set forth in paragraphs (B) to (G) of this rule, theapplicant:


(a) Any felony;

(I) If an applicant possesses a certificate from the international fire service accreditationcongress or national board on fire service professional qualifications that meets theperformance objectives for fire instructor II set forth in "NFPA 1041," the applicantwill be deemed to have met the requirements set forth in paragraph (B) of this rule.

(J) An applicant who has previously held a certificate to teach as a fire instructor in Ohioor another state, the District of Columbia, a United States territory, or any branch ofthe United States military, which was previously revoked by the executive director orlicensing agency of this state or another state, the District of Columbia, a United Statesterritory, or any branch of the United States military, is not eligible for reciprocity.

(K) If an applicant is eligible for reinstatement as set forth in rule 4765-21-07 and rule4765-21-08 of the Administrative Code, then that applicant is not eligible to be issueda certificate under this rule.

(L) For an application to be considered complete:

(1) The application shall be filled out in the manner as specified;

(2) All required documentation shall be provided;

(3) The application shall be submitted within ninety days of completion of therequirements set forth in paragraph (G) of this rule.

(M) A fire instructor certificate issued pursuant to this rule shall be issued in accordancewith the certification cycles and pro-rated renewal requirements set forth in rule4765-21-15 of the Administrative Code.

4765-22-01 Professional standards of conduct for firefighter, fire safetyinspector, or hazard recognition officer certificate holders.

(A) A person issued a firefighter, fire safety inspector, or hazard recognition officercertificate shall not discriminate in the provision of fire services on the basis of age,race, color, religion, gender, sexual orientation, or national origin.

(B) A person issued a firefighter, fire safety inspector, or hazard recognition officercertificate shall not misrepresent the person's professional qualifications orcredentials.

(C) A person issued a firefighter, fire safety inspector, or hazard recognition officercertificate shall accurately document and maintain records of all approved continuingeducation courses the certificate holder completes in accordance with Chapter4765-20 of the Administrative Code. Upon request, documentation shall be providedto the division within the time parameters as set forth by the executive director withadvice and counsel of the committee.

(D) A person issued a firefighter, fire safety inspector, or hazard recognition officercertificate who is disciplined for violations of Chapter 4765. of the Revised Codeand the rules promulgated thereunder shall report the discipline to any and all firerelated employers.

(E) A person issued a certificate to practice shall report to the division as soon as practicableany knowledge of a violation of Chapter 4765. of the Revised Code or the rulespromulgated thereunder.

(D)(F) A person issued a firefighter, fire safety inspector, or hazard recognition officercertificate who is convicted of any criminal offense, other than a minor traffic offense,shall comply with the following:

(1) Within fourteen days of the final sentencing of such offense, the certificate holdershall provide written notification of the conviction to the division;

(2) Within sixty days of the final sentencing of such offense, the certificate holdershall provide the division with all of the following:

(a) A certified copy of the judgment entry from the court in which the convictionoccurred;

(b) A certified copy of the police or law enforcement agency report, ifapplicable;

(c) A bureau of criminal identification and investigation (BCI&I) civilianbackground check.

(3) Documentation required in paragraph (D)(2)(F) of this rule shall be acquired andsubmitted at the certificate holder's expense.

(E)(G) A person issued a firefighter, fire safety inspector, or hazard recognition officercertificate shall not commit fraud, misrepresentation, or material deception, or submitfalse or misleading information in any of the following:

(1) Applying for or obtaining a firefighter, fire safety inspector, or hazard recognitionofficer certificate;

(2) Renewing a firefighter, fire safety inspector, or hazard recognition officercertificate;

(3) Responding to audits conducted by the division or executive director;

(4) Responding to or complying with any other official request from the division orthe executive director.

4765-22-02 Professional standards of conduct for fire, assistant fire, live fire,and fire safety inspector instructors.


(A) An instructor shall not discriminate in the provision of firefighter, fire safety inspector,hazard recognition officer, or instructor training courses on the basis of age, race,color, religion, gender, sexual orientation, or national origin.

(B) An instructor shall provide instruction in accordance with the curriculum, objectives,and standards as set forth in section 4765.55 of the Revised Code, and Chapters4765-20 to 4765-25 of the Administrative Code.

(C) An instructor shall provide instruction in accordance with the policies and proceduresestablished by the chartered program through which the instructor is employed oraffiliated.

(D) An instructor shall not provide instruction in any course that is above the instructor'scertificate level.

(E) An instructor shall not evaluate practical skills examinations unless the instructor hassuccessfully completed the "Practical Skills Evaluator Training Course."

(F) An instructor shall not be permitted to evaluate practical skills examinations thatare above the level of the instructor's firefighter, or fire safety inspector, or hazardrecognition officer certificate.

(G) An instructor shall not misrepresent the instructor's professional qualifications orcredentials.

(H) An instructor shall not commit fraud, misrepresentation, or deception in conductinga firefighter, fire safety inspector, hazard recognition officer, or instructor trainingcourse.

(I) An instructor shall not commit fraud, misrepresentation, or deception in order to obtaina fire certificate to teach.

(J) An instructor shall accurately document and maintain records of all requirements forrenewal of the instructor's certificate to teach in accordance with Chapter 4765-21of the Administrative Code, as applicable. Upon request, the certificate holder shallprovide the division with documentation within the time parameters as set forth bythe executive director with advice and counsel of the committee.

(K) A fire instructor, assistant fire instructor, and live fire instructor shall maintain a currentfirefighter certificate. If an instructor fails to maintain a current firefighter certificate,the instructor is not permitted to instruct in any firefighter courses.

(L) A fire safety inspector instructor shall maintain a current fire safety inspector certificate.If an instructor fails to maintain a current fire safety inspector certificate, the instructoris not permitted to instruct in any fire safety inspector courses.

(M) An instructor is not permitted to instruct in any hazard recognition officer coursesunless the instructor holds a fire safety inspector certificate and one of the following:

(1) Fire safety inspector instructor certificate; or

(2) Fire instructor certificate.

(N) A live fire instructor shall maintain a current fire instructor or assistant fire instructorcertificate. If an instructor fails to maintain a current fire instructor or assistant fireinstructor certificate, the instructor is not permitted to instruct in any live fire trainingevolutions.

(O) An instructor shall obtain approval from a chartered program prior to teaching anycourses under the auspices of the chartered program.

(P) An instructor shall surrender all documentation of course files to the sponsoringchartered program no later than ninety days after the final day of the course.

(Q) An instructor shall not aid, assist, or help any student gain an unfair advantage on anyportions of a firefighter, fire safety inspector, hazard recognition officer, or instructorcourse or on any examinations.

(R) An instructor shall not proctor or be present during the state written examinations unlessthe individual is sitting for the examination as part of the course requirements.

(S) An instructor shall consistently demonstrate a standard of knowledge and competencythat meets or exceeds the minimal level required under the individual's certificate toteach.

(T) An instructor shall report in writing to the division, as soon as practicable, any suspicionor knowledge of a violation of this chapter or any potential compromise of theexamination process.

(U) In addition to meeting the professional standards of conduct in this rule, an instructorshall also remain in compliance with the standards of conduct for a firefighter,

fire safety inspector, or hazard recognition officer certificate as set forth in rule4765-22-01 of the Administrative Code.

(V) A person issued a firefighter instructor, assistant fire instructor, live fire instructor, orfire safety inspector instructor certificate who is disciplined for violations of Chapter4765. of the Revised Code and the rules promulgated thereunder shall report thediscipline to any and all fire related employers.

(V)(W) A person issued a firefighter instructor, assistant fire instructor, live fireinstructor, or fire safety inspector instructor certificate shall not commit fraud,misrepresentation, or material deception, or submit false or misleading informationin any of the following:

(1) Applying for or obtaining a firefighter instructor or fire safety inspector instructorcertificate;

(2) Renewing a firefighter instructor or fire safety inspector instructor certificate;

(3) Responding to audits conducted by the division or executive director;

(4) Responding to or complying with any other official request from the division orthe executive director.

4765-23-01 Fire service investigation process.

(A) All complaints filed with the division shall be in writing. The division willnot investigate anonymous complaints, unless the complaints pertain to theknowledge examinations, instructional methods examinations, or practical skillsexaminations.The division shall investigate all complaints on behalf of the firefighterand fire safety inspector training committee and in accordance with section 4765.101of the Revised Code.

(B) Based on the findings of a completed investigation, the executive director, with adviceand counsel of the committee, may initiate disciplinary proceedings in accordancewith Chapter 119. of the Revised Code.

(C) If the executive director, with advice and counsel of the committee, determines that nofurther action on a complaint is warranted, then the case will be closed accordingly.Affected parties will be notified in accordance with law.

(D) No member of the committee who participates in an investigation shall participate infurther adjudication of the case.

(E) The division shall conduct investigations in such a manner as to protect patientconfidentiality.

4765-23-03 Fire service report of administrative actions.

(A) When the executive director takes admnistrativeadministrative action against afirefighter, fire safety inspector, hazard recognition officer, fire instructor, assistantfire instructor, live fire instructor, or fire safety inspector instructor certificate or firecharter, the division shall advise:

(1) The person against whom such action is taken;

(2) The certificate holder's employer, if known;

(3) Any state or public agencies for which such notice is appropriate.

(B) All administrative actions issued by the executive director may be published in thedivision of EMS newsletter or on the division's website.

(C) The division may compile on an annual basis a report detailing the complaints received,investigations conducted, and administrative actions taken.

4765-24-02 Classification of firefighter, fire safety inspector, and instructortraining courses.


(A) The executive director, with the advice and counsel of the committee, shall issue acharter to a training institution that meets the requirements of rule 4765-24-03 ofthe Administrative Code. Classifications are issued, permitting chartered traininginstitutions to teach specific courses, in accordance with the following:

(1) The executive director may authorize chartered programs to teach post-secondarytraining courses at one or more of the following classifications:

(a) Volunteer firefighter;

(b) Firefighter I;

(c) Firefighter II;

(d) Fire safety inspector;

(e) Hazard recognition officer;

(f) Fire instructor;

(g) Fire safety inspector instructor;

(h) Live fire instructor.

(2) In order to hold a hazard recognition officer classification, a chartered programshall hold a fire safety inspector classification.

(3) In order to hold a live fire instructor classification, a chartered program shall holda fire instructor classification.

(4) The executive director may authorize chartered programs holding a firefighter IIclassification to teach the firefighter I course or the firefighter I and II courseas set forth in rules 4765-24-11 and 4765-24-13 of the Administrative Codein secondary school public safety training programs provided that all of thefollowing are met:

(a) The delivery of a firefighter I course or firefighter I and II course in asecondary school public safety training program was included in the

(b) The firefighter I course or firefighter I and II course meets all requirementsas set forth in rule 4765-24-03 of the Administrative Code;

(c) The firefighter I course or firefighter I and II course curriculum is as setforth in rule 4765-24-11 or rule 4765-24-13 of the Administrative Code,as applicable;

(d) The program utilizes individuals who hold a current and valid certificate toteach in accordance with Chapter 4765-21 of the Administrative Code inaccordance with the following:

(i) Instructors for the firefighter I course shall hold a certificate to teachat or above the firefighter I classification level.

(ii) Instructors for the firefighter I and II course shall hold a certificate toteach at the firefighter II classification level.

(e) The delivery of a firefighter I course or firefighter I and II course has beenauthorized by the chartered program's authorizing official.

(5) In order to apply for an additional classification during the charter cycle, achartered program shall submit a written request to the executive director.

(a) The request shall include documentation required to support the additionalclassification.

(b) Additional classifications issued by the executive director shall expire onthe chartered program's current expiration date.

(B) The executive director shall grant a volunteer firefighter classification to a charteredprogram that:

(1) Meets all requirements as set forth in rule 4765-24-03 of the Administrative Code;

(2) Provides the curriculum as set forth in rule 4765-24-09 of the AdministrativeCode;

(3) Utilizes individuals who hold a current and valid certificate to teach in accordancewith Chapter 4765-21 of the Administrative Code at or above the volunteerfirefighter classification level;

(4) Has authorization from its authorizing official to provide a firefighter trainingcourse at the volunteer firefighter classification level.

(C) The executive director shall grant a firefighter I classification to a chartered programthat:



(3) Utilizes individuals who hold a current and valid certificate to teach in accordancewith Chapter 4765-21 of the Administrative Code at or above the firefighter Iclassification level;

(4) Has authorization from its authorizing official to provide a firefighter trainingcourse at the firefighter I classification level.

(D) The executive director shall grant a firefighter II classification to a chartered programthat:



(3) Utilizes individuals who hold a current and valid certificate to teach inaccordance with Chapter 4765-21 of the Administrative Code at the firefighterII classification level;

(4) Has authorization from its authorizing official to provide a firefighter trainingcourse at the firefighter II classification level.

(E) The executive director shall grant a fire safety inspector classification to a charteredprogram that:

(a) Each instructor shall hold a current and valid fire safety inspector certificatein accordance with Chapter 4765-20 of the Administrative Code.

(b) Each instructor shall hold a current and valid fire instructor or fire safetyinspector instructor certificate in accordance with Chapter 4765-21 of theAdministrative Code.

(c) Each hazard recognition officer course instructor shall be activelyfunctioning as a fire safety inspector and instructor.

(5) Has authorization from its authorizing official to provide a hazard recognitionofficer training course.

(G) The executive director shall grant a fire instructor classification to teach fire instructorand assistant fire instructor training courses to a chartered program that:



(3) Utilizes individuals who hold a current and valid fire instructor certificate inaccordance with Chapter 4765-21 of the Administrative Code;

(4) Has authorization from its authorizing official to provide fire instructor andassistant fire instructor training courses within the fire instructor classificationlevel;

(5) Utilizes individuals who hold a current and valid fire instructor certificate to teachin accordance with Chapter 4765-21 of the Administrative Code.

(H) The executive director shall grant a live fire instructor classification to a charteredprogram that:



(3) Holds a fire instructor classification;

(4) Utilizes instructors in accordance with the following:

(a) Each instructor shall hold a current and valid fire instructor or assistantfire instructor certificate in accordance with Chapter 4765-21 of theAdministrative Code.

(b) Each instructor providing instruction in any live fire training evolutionsshall meet the live fire instructor requirements set forth in paragraphs (C),(D), (E), and (F) of rule 4765-21-03 of the Administrative Code.

(c) Each instructor shall be appointed by the program director as a live fireinstructor trainer.

(5) Has authorization from its authorizing official to provide live fire instructortraining courses.

(I) The executive director shall grant a fire safety inspector instructor classification to achartered program that:



(3) Utilizes individuals who hold a current and valid fire safety inspector certificatein accordance with Chapter 4765-20 of the Administrative Code;

(4) Utilizes individuals who hold a current and valid fire safety inspector instructorcertificate in accordance with Chapter 4765-21 of the Administrative Code;

(5) Has authorization from its authorizing official to provide an instructor trainingcourse at the fire safety inspector instructor classification level.

(J) A chartered program may voluntarily surrender its charter, or any classification bysubmitting a request to the executive director.

(1) Such request to surrender shall be in writing;

(2) Such surrender is subject to the executive director’s approval;

(3) A surrender approved by the executive director becomes effective upon the dateof approval.

(K) If a chartered program is under investigation by the division, acceptance of surrenderis at the discretion of the executive director.

(L) A chartered program shall maintain all documentation required in rule 4765-24-03 ofthe Administrative Code for the duration of the current cycle and one previous chartercycle. Voluntary surrender does not alleviate a chartered program of this requirement.

4765-24-03 Qualifications for a fire charter.


(A) The executive director, with advice and counsel of the committee, shall issue acharter to provide firefighter, fire safety inspector, hazard recognition officer, andinstructor courses, in accordance with the classifications set forth in rule 4765-24-02of the Administrative Code, to a training institution that satisfies all the followingrequirements:

(1) Submits a completed "Fire Charter Application" to the division;

(2) Possesses a good reputation, as defined in rule 4765-25-01 of the AdministrativeCode;

(3) Has an authorizing official with a good reputation who assumes ultimateresponsibility for all aspects of the program;

(4) Offers firefighter, fire safety inspector, hazard recognition officer, and instructorcourses that satisfy the curriculum requirements as set forth in this chapter;

(5) Establishes an advisory committee that shall meet at least one time each year basedon the charter cycle and includes a minimum of five individuals consistingof the program director, fire chiefs, instructors, and others from the firecommunity;

(6) Utilizes individuals who hold a valid and current certificate to teach in accordancewith Chapter 4765-21 of the Administrative Code;

(a) Instructors shall be employed or contracted by the chartered program; and

(b) Instructors shall only teach courses at or below the level of an instructor'sfire training certificate.

(7) Has a sufficient number of fire instructors to ensure that the ratio of students toinstructors does not exceed five to one during all practical skills instruction orevaluation;

(8) For all approved classifications, possesses, or has access through current andvalid affiliation agreements, to equipment, apparatus, burn facilities, props,and supplies that are necessary to instruct and test all course performanceobjectives, meet current standards, and are in a sufficient quantity for thenumber of students and instructors participating in each course:

(a) EquipmentEnsures all equipment, burn facilities, and apparatus shallbeare inspected and maintained in accordance with manufacturers'recommendations;

(b) EquipmentEnsures all, burn facilities and apparatus shall beare incompliance with applicable NFPA standards, including but not limited to:

(i) Personal protective clothing shall be inspected, maintained, and testedin accordance with applicable requirements of "NFPA 1851";

(ii) Self-contained breathing apparatus shall be inspected, maintained,and tested in accordance with applicable requirements of "NFPA1852";

(iii) Fire apparatus, fire pumps, and aerial devices shall be inspected,maintained, and tested in accordance with applicable requirementsof "NFPA 1911";

(iv) Live burn facilities shall be constructed, inspected, and maintainedin accordance with applicable requirements of "NFPA 1403";

(v) Fire hose shall be inspected and tested in accordance with applicablerequirements of "NFPA 1962";

(vi) Fire extinguishers shall be inspected and tested in accordance withapplicable requirements of "NFPA 10";

(vii) Ground ladders shall be inspected and service tested in accordancewith applicable requirements of "NFPA 1932";

(9) Has sufficient classroom and laboratory facilities to accommodate the number ofstudents participating in each course;

(10) Has a computer lab, or has access to a computer lab through an affiliationagreement, that meets the requirements as set forth in rule 4765-24-20 of theAdministrative Code;

(11) Has comprehensive current publications, media resources, and electronicresources relating to fire services, as well as the minimum curriculum forfirefighter, fire safety inspector, hazard recognition officer, and instructorcourses as established under section 4765.55 of the Revised Code and thischapter;

(12) Has and maintains one fixed geographic location within the boundaries of thestate of Ohio where a chartered program is operated and where training isconducted, including an office in a fixed geographic location where records aremaintained. Such location shall not consist of a house trailer, residence, tent,temporary stand, rooming house, apartment, post office box, or in a room ina hotel or motel;

(13) Provides classroom environments that are safe, sanitary, and conducive tolearning;

(14) Possesses financial resources that are sufficient for the operation of the programin the manner set forth in the application for a charter;

(15) Has written policies approved by its advisory committee and made available toeach student that include all of the following:

(a) Methodology used in determining grades;

(b) Methodology used to document missed hours and record makeupprocedures for completing all course hours;

(c) Criteria for successful completion of the training course;

(d) Grounds for dismissal from the course;

(e) Disciplinary and grievance procedures including mechanism for appeals;

(f) Procedures for voluntary student withdrawals from the course;

(g) Procedures for refunding tuition payments;

(h) Admission requirements;

(i) Requirements or restrictions regarding student attire;

(j) Costs associated with the training course, including tuition, materials, andfees;

(k) Information regarding course schedules, content, and objectives;

(l) Prohibition against discrimination towards students on the basis of race,color, religion, gender, sexual orientation, age, or national origin;

(m) Prohibition against students being assigned emergency response dutiesduring scheduled classroom instruction or practical training during

firefighter, fire safety inspector, hazard recognition officer, or instructortraining;

(n) Procedures for reporting accidents and injuries sustained during a course;

(o) Procedures for conducting live fire training that meet the current edition of"NFPA 1403";

(p) Procedures to follow during extreme weather conditions;

(q) Requirements that equipment, apparatus, burn facilities, props, and suppliesmeet the current editions of NFPA as required in paragraph (A)(8) of thisrule;

(r) Security parameters that protect the students' financial and personalinformation in accordance with state and federal laws;

(s) Healthcare services available to students by or through the charteredprogram.

(B) In addition to the requirements set forth in paragraph (A) of this rule, a traininginstitution issued a charter under section 4765.55 of the Revised Code and this chaptershall:

(1) Conduct at least one course at each authorized classification level per cycle.

(a) Conducting a firefighter course at the highest approved classification levelfulfills the requirement to teach firefighter courses at lower classificationlevels.

(b) Conducting a fire safety inspector course fulfills the requirement to teach ahazard recognition officer course.

(2) Submit each course request to the division for approval at least fourteen daysprior to the start of each course to include the following: course type, start date,location, lead instructor, skills coordinator, and class schedule with topics andstudent contact hours;

(3) Assure compliance with examination administration requirements as specified inrules 4765-24-20 and 4765-24-21 of the Administrative Code;

(4) Require each student enrolled in a firefighter, fire safety inspector, hazardrecognition officer, fire instructor, fire safety inspector instructor, or live fire

instructor course to have course materials that meet the course objectives as setforth in this chapter of the Administrative Code;

(5) Require student attendance in accordance with the following:

(a) Attendance is required in all firefighter, fire safety inspector, hazardrecognition officer, and instructor courses;

(b) All absences from a scheduled class shall be documented;

(c) Any absences from a scheduled class shall be made up and accuratelydocumented in a manner approved by the program director.

(6) Keep accurate attendance records for each course in a manner acceptable to theprogram director;

(7) Complete accident and injury reports required for all accidents or injuriesoccurring during a training course, regardless of hospitalization;

(7)(8) Provide regular evaluations of student performance and achievementthroughout each course including written and practical skills examinations asset forth in rules 4765-24-20 and 4765-24-21 of the Administrative Code andperformance objective check-off sheets as approved by the executive director;

(9) Use performance objective check-off sheets approved by the executive directorto document completion of course objectives;

(8)(10) Issue a Ensure each student meets all course completion requirements prior toissuance of a certificate of course completion to each student who successfullypasses all course components and completes the training course administeredby the chartered program;

(9)(11) Following the completion of each course, the instructor shall give all courserecords as set forth in this rule to the program director, who shall review therecords to ensure each student meets all course requirements prior to issuanceof Issue a certificate of course completion to each student who meets all coursecompletion requirements;

(10)(12) Require that all students are notified of the process and time lines forobtaining a firefighter, fire safety inspector, hazard recognition officer, orinstructor certificate issued by the executive director pursuant to section4765.55 of the Revised Code and Chapters 4765-20 and 4765-21 of theAdministrative Code;

(11)(13) Require each student to conduct written evaluations of instructorperformance for each course;

(12)(14) Require the program director to conduct written evaluations of eachinstructor’sinstructor's performance for at least one course per charter cyclewithin each classification taught using the following guidelines;

(a) Evaluating an instructor teaching a firefighter course at the highest levelfulfills the requirement to evaluate an instructor at the lower classificationlevels.

(b) The program director may delegate instructor evaluations to a fire instructortrainer as long as the program director approves the evaluation.

(13)(15) Conduct written evaluations of the courses including content of each course;

(14)(16) Allow access by the division to student firefighter, fire safety inspector,hazard recognition officer, and instructor training records to verify successfulcompletion of all certification requirements as set forth in Chapters 4765-20,4765-21, and this chapter of the Administrative Code;

(15)(17) Allow the division to review instructor records in order to verify compliancein accordance with Chapter 4765-21 of the Administrative Code;

(16)(18) Allow the division to review program materials and monitor the testingprocesses utilized by the chartered program;

(17)(19) Allow site inspections by the division;

(18)(20) Maintain written or electronic documentation of compliance with thischapter, for all courses required for state certification including, but not limitedto, firefighter, fire safety inspector, hazard recognition officer, and instructor.The following information for each class, as appropriate per classification, shallappear for the previous and current charter cycle:;

(21) The following information for each class, as appropriate per classification, shallbe required documentation:

(a) Lesson plans, course schedules, course locations, and policies in compliancewith this chapter;

(b) Evaluations of instructors' and students' performance;

(c) Attendance records for each course conducted by the charteredprogram showing completion of required hours and course objectivesdemonstrating completion of required hours;

(d) Accident and injury reports;

(e) Objective Completed check-off sheets documenting that each student metrequired course objectives;

(f) Documentation of current and valid student and instructor certificatesincluding, but not limited to, firefighter, fire safety inspector, hazardrecognition officer, and instructor certificates, as applicable;

(g) Affiliation agreements as set forth in this rule;

(h) Documentation of compliance with admission requirements for all coursesrequired for state certification including, but not limited to, firefighter,fire safety inspector, hazard recognition officer, and instructor courses;

(i) The minutes of advisory committee meetings including an agenda,discussion of issues, and attendance record for each meeting that isconducted in accordance with this rule;

(j) Documentation of compliance with "NFPA 1403" on live fire training toinclude, but not limited to:

(i) Burn facility inspection records;

(ii) Burn facility maintenance records;

(iii) Burn building floor plans;

(iv) Burn facility site plans;

(v) Pre-burn and post-burn procedures;

(vi) Student prerequisites;

(vii) Instructor, student, support personnel, and apparatus assignments, toinclude rest and rehabilitation, for each evolution;

(viii) Written learning objectives for all evolutions;

(k) Documentation of student completion of "National Incident ManagementSystem Course IS-700" and "National Incident Management SystemCourse ICS-100" or the online equivalent;

(l) Documentation of student completion of an approved emergency vehicleoperations course;

(m) Documentation of student completion of an approved hazardous materialsawareness and operations course;

(n) Documentation of completion of "Courage to be Safe: Sixteen Life SafetyInitiatives Course";

(o) Documentation of student completion of minimum emergency medical careperformance capabilities as required by "NFPA 1001," chapter 41;

(p) State knowledge and practical skills examination documentation for eachstudent;

(q) Compliance with all written policies and procedures.

(C) In addition to the requirements set forth in paragraphs (A) and (B) of this rule, atraining institution issued a charter under section 4765.55 of the Revised Code andthis chapter, during the charter cycle for each classification held, shall meet one ofthe following:

(1) At least eighty per cent of the training program’s students who take the writtenportion of the initial certification examination shall receive a passing score; or

(2)(1) At leastNot less than sixty-five per cent of the training program’'s students whotake the written portion of the initial certification examination shall receive apassing score on their first attempt to pass the examination., or

(2) Not less than eighty per cent of the training program's students who take thewritten portion of the initial certification examination shall receive a passingscore.

(D) Every twenty-four months the executive director shall review the passing percentagerequirement established in this rule to determine whether the requirement needs tobe amended.

(E) Secondary school public safety programs shall complete all curricula requirements forfirefighter I or firefighter I and II as set forth in rules 4765-24-11 and 4765-24-13 ofthe Administrative Code, as applicable.

(F) The authorizing official of a training institution shall serve as the program directorunless the authorizing official designates a program director with a good reputationwho assumes responsibility for program oversight.

(1) The program director shall ensure compliance with this chapter and all rules andlaws applicable to the administration of all firefighter, fire safety inspector,hazard recognition officer, and instructor courses;

(2) The designation of a program director does not alleviate the authorizing officialof the responsibility for compliance with this chapter and all rules and lawsapplicable to the administration of all firefighter, fire safety inspector, hazardrecognition officer, and instructor courses.

(G) In the event of charter or classification expiration, voluntary surrender, or revocation,the chartered program shall maintain all documentation required in this rule forthe cycle in which the classification expired, was surrendered, or revoked, plus theprevious cycle.

(H)(G) A charter issued under section 4765.55 of the Revised Code and this chapter shallbe valid for three years and may be renewed according to guidelines established inrule 4765-24-05 of the Administrative Code.

(I)(H) A chartered program shall maintain all documentation required in this rule for theduration of the current cycle and onetwo previous charter cyclecycles. Revocationor voluntary surrender of a charter does not alleviate a chartered program of thisrequirement. In the event of charter or classification expiration, voluntary surrender,or revocation, the chartered program shall maintain all documentation required in thisrule for six years from the date the expiration, voluntary surrender, or revocation.

(J)(I) If a chartered program is utilizing a location outside of the state of Ohio, the charteredprogram shall comply with this chapter of the Administrative Code and any applicablelaw, rules, or regulations in that state.

4765-24-05 Renewal of a fire charter.

[Comment: For dates and availability of material incorporated by reference in this rule seesee rule 4765-25-02 of the Administrative Code.]

(A) The executive director shall make the "Fire Charter Application" available to eachchartered program seeking renewal.

(1) The application shall be made available no later than ninety days prior to thecurrent charter's expiration date.

(2) The application for renewal shall clearly indicate the date by which it shall becompleted and received by the division.

(B) An application to renew a charter shall be received by the division no later than thethirtieth day prior to the expiration date of the current charter cycle.

(C) A chartered fire training institution may continue to conduct courses within approvedclassifications beyond the expiration date of the charter if the charter has submitteda completed "Fire Charter Application" to the division no later than the thirtieth dayprior to the expiration date. Approval to continue to conduct courses is dependent onthe program remaining in good standing and may continue until the charter renewalprocess is complete.

(D) The executive director shall renew a fire charter that meets the following requirements:

(1) Submits a completed "Fire Charter Application" to the division no later than thethirtieth day prior to the expiration date of the current charter cycle.

(2) Demonstrates compliance with the requirements as set forth in section 4765.55 ofthe Revised Code and rule 4765-24-03 of the Administrative Code;

(3) Has conducted at least one course at each authorized classification level in themost recent charter cycle.

(a) Conducting a firefighter course at the highest approved classification levelfulfills the requirement to teach firefighter courses at lower classificationlevels.

(b) Conducting a fire safety inspector course fulfills the requirement to teach ahazard recognition officer course.

(4) During the charter cycle, for each classification held, the training program metone of the following:

(a) Not less than sixty-five per cent of the training program's students whotook the written portion of the initial certification examination receiveda passing score on their first attempt to pass the examination; or

(b) Not less than eighty per cent of the training program's students who took thewritten portion of the initial certification examination received a passingscore within three attempts.

(E) Failure to submit an application by the expiration date of the charter shall result inexpiration of the charter. An institution with an expired charter: shall not conductfirefighter, fire safety inspector, hazard recognition officer, or instructor courses.

(1) Shall not conduct firefighter, fire safety inspector, hazard recognition officer, orinstructor courses;

(2)(F) Shall maintain written or electronic documentation of compliance with thischapter, for all firefighter, fire safety inspector, hazard recognition officer, andinstructor training courses for six years from the date of expiration.Documentationrequirements:

(1) A chartered program shall maintain all documentation required in this rule forthe duration of the current cycle and two previous charter cycles. Revocationor voluntary surrender of a charter does not alleviate a chartered program ofthis requirement.

(2) In the event of charter or classification voluntary surrender or revocation, thechartered program shall maintain all documentation required in this rule for sixyears from the date of the voluntary surrender or revocation.

(F)(G) An institution with an expired charter that wishes to conduct firefighter, fire safetyinspector, hazard recognition officer, or instructor courses shall reinstate as set forthin rule 4765-24-07 of the Administrative Code.

(G)(H) The division may conduct site inspections in order to determine whether a charteredprogram remains in compliance with the requirements of this chapter.

4765-24-06 Notification to executive director.


(A) Each chartered program shall provide written notice to the executive director no laterthan ten days after a change in any of the following:

(1) Mailing address;

(2) Program director or contact information;

(3) Authorizing official or contact information;

(4) Test proctors;

(5) Email address;

(6) Instructor trainers;

(7) Lead instructor;

(7)(8) Textbook publisher or version for each course.

(B) Prior to implementation, each chartered program shall submit a written request to,and receive approval from, the executive director of proposed changes in any of thefollowing:

(1) Fixed geographic location where the chartered program is operatedoperating andtraining is conducted, including the office where records are maintained;

(2) Live fire training facilities;

(3) Offsite locations;

(4) Affiliation agreements;

(5) "Written Testing Agreement," when it involves a change in location, facilities,program director, or authorizing official;

(6) Program-specific course objectives or check-off sheets;

(7) Program name;

(8) Volunteer firefighter course curriculum.

4765-24-09 Volunteer firefighter course.


(A) A training course for a volunteer firefighter certification shall consist of thirty-six hoursof training:

(1) The course shall meet the volunteer firefighter course objectives approved by theexecutive director, with advice and counsel of the committee as provided in the"Volunteer Firefighter Certification RequirementsCourse Packet."

(2) The volunteer firefighter course curriculum shall be approved by the executivedirector prior to delivery.

(B) A chartered fire training program shall use the "Volunteer Firefighter CourseObjectives Check-Off Sheet Packet" and "Volunteer Firefighter Practical SkillsSheetsExamination Packet" approved by the executive director with advice andcounsel of the committee, when conducting a volunteer firefighter training course.

(C) A chartered program shall admit only those individuals who meet the followingrequirements into a volunteer firefighter course:

(1) Individuals shallShall be at least eighteen years of age, except that a charteredprogram may admit a student who is seventeen years old into a post-secondaryvolunteer firefighter course provided that the student has graduated or isenrolled in the twelfth or final grade in a secondary school program;

(2) Individuals shallShall meet all admission requirements established by thechartered program.

(D) Volunteer firefighter course instructors shall be appointed by the program director inaccordance with the following:

(1) Each instructor shall hold a current and valid firefighter certificate in accordancewith Chapter 4765-20 of the Administrative Code.

(2) Each instructor shall hold a current and valid fire or assistant fire instructorcertificate in accordance with Chapter 4765-21 of the Administrative Code.

(E) The training requirements listed in paragraph (A) of this rule shall commence and endwithin a consecutive twelve month period.

(1) A minimum of ninety-six hours that meets the general knowledge requirements,general skill requirements, and the job performance requirements specified in"NFPA 1001" for firefighter I, as set forth in the firefighter I course objectivesapproved by the executive director, with advice and counsel of the committeeas provided in the "Firefighter I Transition Certification RequirementsCoursePacket";

(2) A minimum of twenty-four hours of hazardous materials awareness andoperations level training that meets the mission-specific competencies specifiedin "NFPA 1072" as required by "NFPA 1001," and the objectives as set forth inthe "Hazardous Materials Awareness and Operations Course ObjectivesPacket"approved by the executive director, with advice and counsel of the committee;

(3) "Courage to be Safe: Sixteen Life Safety Initiatives Course" totaling at least fourhours.

(B) The "Firefighter I Transition Training Course Objectives & Recommended HoursGuideCourse Packet," approved by the executive director, with advice and counselof the committee, shall be used as a guide when delivering firefighter I transitioncourses.

(C) A chartered fire training program may reorganize or add to the program-specific courseobjectives and objective check-off sheets to align with the program's course schedule.

(1) All program-specific course objectives and objective check-off sheets shall meetall of the requirements as outlined in the firefighter I course objectives providedin the "Firefighter I Certification RequirementsTransition Course Packet";

(2) Program-specific course objectives and objective check-off sheets shall beapproved by the executive director prior to implementation;

(3) A chartered program that chooses to reorganize or add to the program-specificcourse objectives and objective check-off sheets shall provide a cross referenceto the firefighter I course objectives provided in the "Firefighter I CertificationRequirementsTransition Course Packet" to assist with program review.

(D) A chartered fire training program shall use the firefighter I practical skills sheetsapproved by the executive director, with advice and counsel of the committee, whenconducting practical skills testing for state certification.

(E) A chartered program shall admit only those individuals who meet the followingrequirements into a firefighter I transition course:

(1) Individuals shallShall be at least eighteen years of age;

(2) Individuals shallShall hold a current and valid volunteer firefighter certificate, ingood standing;

(3) Individuals shallShall meet "NFPA 1001" chapter 41 entrance requirements;


(F) Firefighter I transition course instructors shall be appointed by the program director inaccordance with the following:

(1) Each instructor shall hold a current and valid firefighter I or firefighter IIcertificate in accordance with Chapter 4765-20 of the Administrative Code.

(2) Each instructor shall hold a current and valid fire instructor or assistantfire instructor certificate in accordance with Chapter 4765-21 of the OhioAdministrative Code.

(G) The training requirements listed in paragraph (A) of this rule shall commence and endwithin a consecutive twelve-month period.

(H) Prior to being permitted to participate in live fire training evolutions, students shallmeet the minimum student prerequisites to participate in live fire training evolutionsin accordance with "NFPA 1403" chapter 4.

(3) Individuals shallShall demonstrate a pre-determined level of cognitive proficiencyby one of the following methods:

(a) Through successful completion of a cognitive-based pre-admissionassessment or test such as the ACT, SAT, Work Keys, Compass,Accuplacer, TABE, or equivalent;

(b) Through achievement of a minimum high school or college GPA asdetermined by the charter program to be an appropriate indicator forsuccessful completion of the program.

(4) Individuals shallShall meet all admission requirements established by thechartered program;

(F) A chartered program shall determine the appropriate level of academic or cognitiveperformance that it deems an appropriate indicator for successful completion of theprogram. At the discretion of the chartered program, applicants who do not meetthe minimum cognitive assessment score or academic performance level, as requiredin paragraph (E) of this rule, may be granted admission to a firefighter I coursesubsequent to completion of remediation.

(G) A chartered program may admit a student who is seventeen years oldof age intoa secondary or post-secondary firefighter I course provided that the student hasgraduated or is enrolled in the twelfth or final grade in a secondary school program.

(H) A chartered program may admit a student into a secondary school firefighter I coursewho is sixteen years oldof age provided that the student is enrolled in the eleventhgrade or twelfth grade in a secondary school public safety program. In the eleventhgrade:

(1) Participation shall be limited to classroom and practical skills activities associatedwith firefighter I course objectives;

(2) The student is prohibited from participation in any training involving immediatelydangerous to life and health (IDLH) environments to include any live firetraining.

(I) Firefighter I course instructors shall be appointed by the program director in accordancewith the following:

(2) Each instructor shall hold a current and valid fire instructor or assistantfire instructor certificate in accordance with Chapter 4765-21 of the OhioAdministrative Code.

(D) (D) A chartered fire training program shall use the firefighter II practical skills sheetsapproved by the executive director when conducting practical skills testing for statecertification.

(E) A chartered program shall admit only those individuals who meet the followingrequirements into a firefighter II transition course:

(1) Each instructor shall hold a current and valid firefighter II certificate in accordancewith Chapter 4765-20 of the Administrative Code.

(2) Each instructor shall hold a current and valid fire instructor or assistant fireinstructor certificate in accordance with Chapter 4765-21 of the AdministrativeCode.

(G) The training requirements listed in paragraph (A) of this rule shall commence and endwithin a consecutive twelve-month period.

(3) Individuals shallShall demonstrate a pre-determined level of cognitive proficiencyby one of the following methods:

(L) Prior to being permitted to participate in live fire training evolutions, students shallmeet the minimum student prerequisites to participate in live fire training evolutionsin accordance with "NFPA 1403" chapter 4.

(A) A training course for fire safety inspector certification shall consist of a minimum ofeighty hours and shall meet both of the following training requirements:

(1) Shall meet the "Fire Safety Inspector Course Objectives"fire safety inspectorcourse objectives as set forth in the "Fire Safety Inspector Course Packet"approved by the executive director, with advice and counsel of the committee;

(2) Shall meet the performance objectives set forth in "NFPA 1031" for fire inspectorI and II.

(B) A training course for hazard recognition officer certification shall consist of a minimumof forty hours and shall meet both of the following training requirements:

(1) Shall meet the hazard recognition officer course objectives set forth in the "HazardRecognition Officer Certification RequirementsCourse Packet" approved bythe executive director, with advice and counsel of the committee;

(2) Shall meet the performance objectives set forth in "NFPA 1031" for fire inspectorI.

(C) A chartered program shall admit only those individuals who meet the followingrequirements into a fire safety inspector or hazard recognition officer course:


(2) Individuals shallShall hold a current and valid firefighter certificate issuedpursuant to Chapter 4765-20 of the Administrative Code;


(D) In addition to the requirements for admission as set forth in paragraph (C) of thisrule, the chartered program shall require each student to be employed by one of thefollowing in order to be eligible for admission into a fire safety inspector course:

(1) The office of the state fire marshal;

(2) A firefighting agency as defined in division (A)(3) of section 9.60 of the RevisedCode;

(3) A private fire company as defined in division (A)(5) of section 9.60 of the RevisedCode that is providing fire protection in accordance with division (B), (C), or(D) of section 9.60 of the Revised Code.

(E) The training requirements listed in paragraphs (A) and (B) of this rule shall commenceand end within a consecutive twelve-month period.

(C) A fire instructor course shall be taught by a fire instructor trainer, appointed by theprogram director, under the auspices of a chartered program.

(1) The instructional methodology portion of the course may be taught by either afire or EMS instructor.

(2) The fire service training module and live fire training awareness moduleincorporated in the "Ohio Fire and EMS Instructor Curriculum" shall be taughtby a certified fire instructor.

(D) A person seeking certification as a fire instructor who holds at least a baccalaureatedegree in education may be granted credit by the program director for the forty hours

(F) A chartered program shall admit only those individuals who meet the followingrequirements into a fire instructor course:

(1) Individuals shall be at least eighteen years of age;

(2) Individuals shall possess a current and valid firefighter certificate issued undersection 4765.55 of the Revised Code and rule 4765-20-02 of the AdministrativeCode that is in good standing;

(3) In the preceding seven years, individuals shall have at least five years ofexperience as a certified firefighter. Experience as a firefighter in another state,the District of Columbia, a United States territory, or any branch of the UnitedStates military may be used to fulfill this requirement, as approved by theexecutive director;

(4) Individuals shall have passed the knowledge examination as set forth in rule4765-21-05 of the Administrative Code at the firefighter II level;

(5) Individuals shall meet all admission requirements established by the charteredprogram.

(G) A chartered program shall admit only those individuals who meet the followingrequirements into an assistant fire instructor course:

(1) Individuals shall be at least eighteen years of age;

(2) Individuals shall possess a current and valid firefighter certificate issued undersection 4765.55 of the Revised Code and rule 4765-20-02 of the AdministrativeCode that is in good standing;

(3) In the preceding seven years, individuals shall have at least five years ofexperience as a certified firefighter. Experience as a firefighter in another state,the District of Columbia, a United States territory, or any branch of the UnitedStates military may be used to fulfill this requirement, as approved by theexecutive director;


(4) Individuals shall have passed the knowledge examination as set forth in rule4765-21-05 of the Administrative Code at the firefighter I or firefighter II level;

(5) Individuals shall meet all admission requirements established by the charteredprogram.

(H) A course for live fire instructor training shall be a minimum of twenty-four hours andshall meet the course objectives as set forth in the "Live Fire Training OperationsCourse."

(I) A live fire instructor course shall be taught by a live fire instructor trainer, appointedby the program director, who meets the minimum instructor requirements as set forthin the course curriculum.

(J) A chartered program shall admit into a "Live Fire Training Operations Course" onlythose individuals who meet the admission requirements as set forth in the coursecurriculum.

(K) The executive director shall consider relevant education, training, or service completedby the holder of a certificate to practice as a member of the armed forces of the UnitedStates, the Ohio national guard, the Ohio military reserve, the Ohio naval militia, orthe national guard of any other state or a reserve component of the armed forces ofthe United States in determining whether the holder of a certificate to practice hasmet the experience and educational requirements for a certificate to teach as set forthin paragraph (A) of this rule.

(a) The instructional methodology portion of the course, as set forth inparagraph (A)(1)(a) of this rule, may be taught by either a fire instructortrainer or fire safety inspector instructor trainer appointed by a charteredfire training program, or an EMS instructor trainer, appointed by theprogram director of an accredited EMS training program.

(5) A person seeking certification as a fire instructor who holds at least a baccalaureatedegree in education may be granted credit for the portion of instructor courseset forth in paragraph (A)(1)(a) of this rule.

(a) Credit shall not be given for completion of the instructional methodsexamination.

(b) Individuals shall be directed to the division for prior approval.

(6) A chartered program shall admit only those individuals who meet the followingrequirements into a fire instructor course:

(a) Shall be at least eighteen years of age;

(b) Shall possess a current and valid firefighter certificate issued under section4765.55 of the Revised Code and rule 4765-20-02 of the AdministrativeCode that is in good standing;

(c) In the preceding seven years, individuals shall have at least five years ofexperience as a certified firefighter. Experience as a firefighter in anotherstate, the District of Columbia, a United States territory, or any branchof the United States military may be used to fulfill this requirement, asapproved by the executive director;

(7) The executive director shall consider relevant education, training, or servicecompleted by the holder of a certificate to practice as a member of the armedforces of the United States, the Ohio national guard, the Ohio military reserve,the Ohio naval militia, or the national guard of any other state or a reservecomponent of the armed forces of the United States in determining whetherthe holder of a certificate to practice has met the experience and educationalrequirements for a certificate to teach as set forth in paragraph (A) of this rule.

(1) An assistant fire instructor course shall be taught by a fire instructor trainerappointed by the program director, under the auspices of a chartered program,and shall consist of the requirements as set forth in paragraphs (A)(1)(c) to (A)(1)(e) of this rule.

(2) A chartered program shall admit only those individuals who meet the followingrequirements into an assistant fire instructor course:

(a) Shall be at least eighteen years of age;

(b) Shall possess a current and valid firefighter certificate issued under section4765.55 of the Revised Code and rule 4765-20-02 of the AdministrativeCode that is in good standing;

(c) In the preceding seven years, individuals shall have at least five years ofexperience as a certified firefighter. Experience as a firefighter in anotherstate, the District of Columbia, a United States territory, or any branchof the United States military may be used to fulfill this requirement, asapproved by the executive director;

(d) Shall have passed the knowledge examination as set forth in paragraph (E)of rule 4765-21-05 of the Administrative Code;

(e) Shall meet all admission requirements established by the chartered program.

(C) Live fire instructor course:

(1) A course for live fire instructor training shall be a minimum of twenty-fourhours, shall be taught under the auspices of a chartered program, and shall meetthe course objectives as set forth in the "Live Fire Training-Operations LevelCourse."

(2) To be eligible to deliver the "Live Fire Training-Operations Level Course,"a chartered program shall hold a live fire instructor classification issued inaccordance with rule 4765-24-02 of the Administrative Code and shall meetthe "Live Fire Training-Operations Level Course" prerequisites as set forth inthe "Live Fire Training-Operations Level Course" curriculum.

(3) A live fire instructor course shall be taught by a live fire instructor trainer,appointed by the program director, who meets the minimum instructorrequirements as set forth in the "Live Fire Training-Operations Level Course"curriculum.

4765-24-17 Fire instructor, live fire instructor, and fire safety inspectorinstructor trainers.


(A) Fire instructor, live fire instructor, and fire safety inspector instructor courses, asset forth in rules 4765-24-15 and 4765-24-16 of the Administrative Code, shallbe provided under the auspices of a chartered program and shall be taught by aninstructor trainer appointed by the program director in accordance with this rule.

(B) The program director shall ensure that the fire instructor trainer meets all of thefollowing:

(1) Holds a valid fire instructor certificate, that is in good standing, issued under rule4765-21-03 of the Administrative Code;

(2) Has at least three years of educational experience that includes demonstrableability in teaching, developing lesson plans and course materials, managingclassroom resources, and managing and evaluating students;

(3) Demonstrates effective oral and written communication skills;

(4) Has completed an instructor trainer orientation.

(C) The program director shall ensure that the live fire instructor trainer meets all of theprerequisite requirements as set forth in the "Live Fire Training Operations Course-Operations Level Course."

(D) The program director shall ensure that the fire safety inspector instructor trainer meetsall of the following:

(1) Holds a valid fire safety inspector instructor certificate, that is in good standing,issued under rule 4765-21-03 of the Administrative Code;

(2) Has at least three years of educational experience that includes demonstrableability in teaching, developing lesson plans and course materials, managingclassroom resources, and managing and evaluating students;

(3) Demonstrates effective oral and written communication skills; and

(4) Has completed an instructor trainer orientation.

(E) The program director assumes responsibility to select and maintain instructor trainersbased upon documented evaluation of acceptable performance review.

(F) The program director who is also an instructor trainer shall have documented evaluationof acceptable performance review conducted by the program director's supervisor.

(G) The chartered program shall notify the division, in writing, whenever there is anychange in instructor trainers.

(H) The chartered program shall maintain written or electronic documentation ofcompliance with this rule.

4765-24-20 Written examination administration requirements.


(A) A chartered program shall be permitted to administer the state certification examination,if the chartered program meets or exceeds the following requirements:

(1) Has a current and valid charter;

(2) Has a designated computer lab;

(3) Has a signed "Written Testing Agreement" with the executive director that meetsboth of the following:

(a) The agreement shall be for the current charter cycle;

(b) Any changes in the content or signature authority shall require a newlyexecuted "Written Testing Agreement."

(4) Meets all requirements set forth in rule 4765-24-03 of the Administrative Code.

(B) Examination proctor requirements:

(1) The program director designee shall proctor the written examination;

(2) The proctor shall not hold a firefighter, fire safety inspector, hazard recognitionofficer, fire instructor, EMS provider, or EMS instructor certification. If theprogram director holds a firefighter, fire safety inspector, hazard recognitionofficer, fire instructor, EMS provider, or EMS instructor certification thenthe program director shall designate a non-certificate holder to proctor theexamination, and the program director shall not be present in the examinationroom.

(3) The proctor shall be present in the examination room for the entire duration ofthe examination.

(C)(B) The programProgram director responsibilities:

(1) Shall ensure the integrity and security of all written examinations;The programdirector shall designate proctors to administer state written certificationexaminations;

(3) The program director shall ensure the integrity and security of all writtenexaminations;

(3)(4) ShallThe program director shall ensure that only qualified candidates who havecompleted all certification eligibility requirements are permitted to sit for theexaminations;

(4)(5) ShallThe program director shall immediately report to the executive directorany potential compromise or threat of compromise of the examination process;

(5)(6) ShallThe program director shall ensure that a proctor is present in theexamination room for the duration of the examination;

(6)(7) ShallThe program director shall ensure that the examination room is conducivefor testing, including but not limited to, adequate heating, cooling, ventilation,lighting, and is free from excessive noise and distraction;

(7)(8) ShallThe program director shall ensure that the examination facility hasadequate restroom facilities and adequate parking within reasonable distanceto the facility;

(8)(9) ShallThe program director shall ensure that the examination room will be setup and ready for use prior to the scheduled examination time;

(10) If the program director holds a firefighter, fire safety inspector, hazardrecognition officer, fire instructor, EMS provider, or EMS instructorcertification then the program director shall designate a non-certificate holderto proctor the examination, and the program director shall not be present in theexamination room.

(C) Examination proctor requirements:

(1) A proctor, designated by the program director, shall administer all writtenexaminations;

(2) The proctor shall be trained in the state examination process and shall befamiliar with all registration, security, and access procedures for testing andtest operation, as set forth by the division;

(3) The proctor shall not hold a firefighter, fire safety inspector, hazard recognitionofficer, fire instructor, EMS provider, or EMS instructor certification.

(4) The proctor shall be present in the examination room for the entire duration ofthe examination.

(9)(5) ShallThe proctor shall not permit anyone other than the proctor and studentsin the examination room;

(10)(6) ShallThe proctor shall ensure that no personal electronic devices including,but not limited to, computers, tablets, or laptops are used for administering theexamination;

(11)(7) Shall The proctor shallensure that a firefighter, fire safety inspector, fireinstructor, hazard recognition officer, fire safety inspector instructor, EMSprovider, or EMS instructor is not present during the examination unless theindividual is sitting for the examination as part of the course requirements;

(12)(8) ShallThe proctor shall ensure that no unauthorized electronic devicesincluding, but not limited to, personal laptops, cell phones, flash drives, andtablets are permitted in the examination room or used during the examinationprocess;

(13)(9) ShallThe proctor shall ensure each student is advised of the examinationappeal process.

(10) The proctor shall immediately report to the program director any potentialcompromise or threat of compromise of the examination process;

(D) A certification examination appeal shall be filed by the student to the executive directorwithin five days of the examination date. The appeal shall be in writing and shallinclude:

(1) Name of examinee;

(2) Contact information;

(3) Specific examination taken;

(4) Date, time, and location of examination;

(5) Basis for the appeal;

(6) Signature of the examinee.

4765-24-21 Practical skills examination administration requirements.


(A) A chartered program shall be permitted to administer the state practical skills testingexamination for firefighter, and fire safety inspector, and hazard recognition officercertification, if the chartered program meets or exceeds the following requirements:

(1) Has a current and valid charter;

(2) Meets all requirements set forth in rule 4765-24-03 of the Administrative Code.

(B) When administering state certification examinations, the chartered program shall meetall of the following:

(1) The program director of the chartered program shall ensure the integrity andsecurity of all practical skills examinations;

(2) The program director or designated skills coordinator shall supervise the practicalskills examinations;

(3) The program director or designated skills coordinator shall be responsible for theadministration and set up of the practical skills examination;

(4) The program director or his or designated skills coordinator shall ensure practicalskills stations are set up prior to the scheduled examination time;

(5) The program director shall immediately report to the executive director anypotential compromise of the examination process;

(6) The program director shall allow only fire instructors who have completedthe "Practical Skills Evaluator Training Course" to evaluate students duringfirefighter practical skills examinations. Instructors shall not be permitted toevaluate practical skills examinations that are above the level of the instructor'scertificate to practice;

(7) The program director shall allow only fire safety inspector instructors whohave completed the "Practical Skills Evaluator Training Course" to evaluatestudents during fire safety inspector and hazard recognition officer practicalskills examinations. If fire safety inspector instructors are not available, fireinstructors trained as practical skills evaluators, who are also fire safetyinspectors, may be used as fire safety inspector and hazard recognition officerpractical skills evaluators, provided that the fire instructor has a minimum ofthree years active experience as a fire safety inspector;

(8) The program director shall ensure that all practical skills evaluators receive annualpractical skills evaluator refresher training;

(9) The program director or designated skills coordinator shall not permit leadinstructors in the firefighter, or fire safety inspector, or hazard recognitionofficer training course to evaluate any student on the specific skillsexaminations that were taught by the instructor;

(10) The program director shall ensure the safety of the students by providingequipment, supplies, apparatus, and facilities that meet the performanceobjectives for firefighter I and firefighter II of the "NFPA 1001" for allfirefighter practical skills examinations;

(11) The program director shall ensure the safety of the students by providingequipment, supplies, and apparatus that meet the performance objectives forfire safety inspector of the "NFPA 1031" for all fire safety inspector practicalskills examinations;

(12) The program director shall ensure each student is advised of the examinationappeal process.

(C) The program director, or designated skills coordinator, and skill evaluators shall ensurea candidate is not permitted to directly observe another candidate during the practicalskills examination.

(D) A state certification examination appeal shall be filed by the student to the programdirector within five days of the examination date. The appeal shall be in writing andshall include:

(1) Name of examinee;

(2) Contact information;

(3) Specific examination taken;

(4) Date, time, and location of examination;

(5) Basis for the appeal;

(6) Signature of the examinee.

(E) The program director shall report all appeals of the state certification examination tothe executive director within five days of receipt.

4765-25-01 Definitions.


As used in this chapter and Chapters 4765-20 to 4765-24 of the Administrative Code:

(A) "Affiliation" means the department or agency where an Ohio certified firefighter, firesafety inspector, hazard recognition officer, or fire instructor works, in either a paidor volunteer status, using the Ohio certificate. It does not include special events suchas festivals or camps, or general employment where a certificate holder mymay alsowork.

(B) "Affiliation agreement" means a written agreement between a chartered program andany person that sets forth the roles and responsibilities of the parties, is signed by theindividuals with authority to sign contracts, and provides for any of the following:

(1) The use of specified equipment necessary for firefighter, fire safety inspector,hazard recognition officer, or instructor courses;

(2) The use of facilities not owned or leased by the chartered program;

(3) The use of a certified fire instructor, live fire instructor, or fire safety inspectorinstructor, not employed by the charter, to evaluate the ten hours of supervisedteaching for fire instructor or fire safety inspector instructor students.

(C) "Armed forces" means the armed forces of the United States, including the army, navy,air force, marine corps, coast guard, or any reserve components of those forces; thenational guard of any state; the commissioned corps of the United States public healthservice; the merchant marine service during wartime; such other service as may bedesignated by congress; or the Ohio organized militia when engaged in full-timenational guard duty for a period of more than thirty days.

(D) "Assistant fire instructor" means an individual who holds a certificate to assist in theinstruction of firefighter training courses under the auspices of a fire instructor andthrough a chartered program, issued by the executive director pursuant to section4765.55 of the Revised Code and Chapter 4765-21 of the Administrative Code.

(E) "Authorizing official" means any person who owns or maintains responsibility on behalfof an individual, corporation, trust, partnership, or an association for the facilities,equipment, instructors, managers, and other employees of the chartered program.

(F) "Certificate of course completion" means the document provided by a charteredprogram that verifies a student has successfully completed all course requirements,including passing all of the chartered program's written and practical skills

examinations for certifications issued pursuant to Chapters 4765-20 and 4765-21 ofthe Administrative Code.

(G) "Certificate to teach" means a certificate permitting an individual to provide instructionas a fire instructor, assistant fire instructor, live fire instructor, or fire safety inspectorinstructor, issued by the executive director pursuant to section 4765.55 of the RevisedCode and Chapter 4765-21 of the Administrative Code.

(H) "Charter" or "fire charter" means a certificate issued to a training institution to offerfirefighter, fire safety inspector, hazard recognition officer, or instructor courses,issued by the executive director pursuant to section 4765.55 of the Revised Code andthis chapterChapter 4765-24 of the Administrative Code.

(I) "Chartered program" means any organization or institution that has been issued a charterby the executive director, in accordance with section 4765.55 of the Revised Codeand this chapterChapter 4765-24 of the Administrative Code, to offer firefighter, firesafety inspector, hazard recognition officer, or instructor courses.

(J) "Committee" means the firefighter and fire safety inspector training committee of thestate board of emergency medical, fire, and transportation services created in sections4765.04 and 4765.55 of the Revised Code.

(K) "Computer lab" means a cluster of networked computers that are available for studentsto sit for the written certification examination as set forth in the "Written TestingAgreement."

(L) "Distance learning" means a training course which is taught in real-time and isinteractive between the student and the entity offering the course. Distance learningeducation takes place when an instructor and a student or students are separatedby physical distance and utilizes technology often in concert with face-to-facecommunication to bridge the instructional gap.

(M) "Division" means the division of emergency medical services within the Ohiodepartment of public safety.

(N) "Drop back" is an option available to a fire safety inspector applicantcertificate holder,who may drop back to a hazard recognition officer level of certification during acertification cycle or at the time of renewal.

(O) "Emergency vehicle operations course" or "EVOC" is a course consisting of a minimumof sixteen hours that focuses on familiarizing participants with terminology, drivingskills, and liability issues that relate to the operation of a fire department vehicle.The course objectives, as approvedestablished by the executive director, have beendesigned to meet, and shall be consistent with, the general knowledge requirements,

general skill requirements, and job performance requirements specified in "NFPA1002: Standard for Fire Apparatus Driver/Operator Professional Qualifications"and "NFPA 1451: Standard for a Fire and Emergency Service Vehicle OperationsTraining Program." The course objectives can be found in the "Emergency VehicleOperations Course ObjectivesPacket." The course is a qualification requirement forOhio firefighter I and firefighter II certification.

(P) "Evolution" is defined by the national fire protection association as a set of prescribedactions that result in an effective fireground activity or is defined as a planned trainingsequence intended to develop knowledge, skills, and competency and ensure safetyduring the training.

(P)(Q) "Executive director" means the individual appointed by the director of public safety,pursuant to section 4765.03 of the Revised Code, to serve as the chief executiveofficer of the state board of emergency medical, fire, and transportation services andas the executive director of the division of emergency medical services.

(Q)(R) "Federal emergency management agency" or "FEMA" is an agency of theUnited States Department of Homeland Security, initially created by PresidentialReorganization Plan No. 3 of 1978 and implemented by two Executive Orders onApril 1, 1979.

(R)(S) "Fire department instructors conference" or "FDIC" is an annual conference andexhibition organized by the "PennWell" corporation and held in Indiana.

(S)(T) "Fire instructor" means an individual who holds a certificate to teach firefightertraining courses, issued by the executive director pursuant to section 4765.55 of theRevised Code and Chapter 4765-21 of the Administrative Code.

(T)(U) "Fire-rescue international" is the annual conference and exposition of the"International Association of Fire Chiefs" or "IAFC."

(U)(V) "Fire safety inspector" means an individual certified by the executive directorpursuant to section 4765.55 of the Revised Code and Chapter 4765-20 of theAdministrative Code to perform fire safety inspector duties as set forth in Chapter3737. of the Revised Code.

(V)(W) "Fire safety inspector instructor" means an individual who holds a certificate toteach fire safety inspector courses, issued by the executive director pursuant to section4765.55 of the Revised Code and Chapter 4765-21 of the Administrative Code.

(W)(X) "Firefighter" means an individual who holds a certificate as a volunteer firefighter,firefighter I, or firefighter II, issued by the executive director pursuant to section4765.55 of the Revised Code and Chapter 4765-20 of the Administrative Code.

(X)(Y) "Good reputation" or "good standing" means:

(1) An individual is not the subject of an investigation or disciplinary action by anyfederal, state, or local government agency or has not been denied a license orcertificate or had a license or certificate restricted, suspended, or revoked byany public agency or licensing agency; or

(2) An entity, organization, or institution that is in compliance with all federal, state,and local regulations as applicable to its operations, or is not currently underinvestigation by any agency of the federal, state, or local government, or hasnot been denied any necessary licenses or certificates, or had such licenses orcertificates restricted, suspended, or revoked.

(Y)(Z) "Hazard recognition officer" means an individual certified by the executive directorpursuant to section 4765.55 of the Revised Code and Chapter 4765-20 of theAdministrative Code to perform fire and life safety inspection duties. A hazardrecognition officer certificate does not meet the requirements as set forth in Chapter3737. of the Revised Code, and therefore, a hazard recognition officer certificateholder shall not be granted authority afforded a fire safety inspector certificate holder,including the authority to issue citations or notice of violations.

(Z)(AA) "Hazardous materials awareness and operations course" is a course consistingof a minimum of twenty-four hours that is approved by the chartered programand is consistent with the requirements of "NFPA 1072" related to the minimumrequirements in terms of professional core competencies for hazardous materialsawareness and operations.

(AA)(BB) "Immediately dangerous to life or health" or "IDLH" means any condition thatwould pose an immediate or delayed threat to life, cause irreversible adverse healtheffects, or interfere with an individual's ability to escape unaided from a hazardousenvironment.

(BB)(CC) "Instructional methods examination" means the examination developed by thedivision and approved by the executive director that covers teaching systems, as setforth in Chapter 4765-21 of the Administrative Code.

(CC)(DD) "Instructor" means an individual who holds a certificate to teach as a fireinstructor, live fire instructor, assistant fire instructor, or fire safety inspectorinstructor, issued by the executive director pursuant to section 4765.55 of the RevisedCode and Chapter 4765-21 of the Administrative Code.

(DD)(EE) "Instructor trainer" means a fire instructor, live fire instructor, or fire safetyinspector instructor that has been appointed by a chartered program's authorizing

official or program director to teach fire instructor, live fire instructor, or fire safetyinspector instructor courses under the auspices of a charter.

(FF) "International fire service training association" or "IFSTA" is an association thatidentifies areas of need for training materials and fosters the development andvalidation of training materials for the fire service and related areas.

(EE)(GG) "Job performance requirements" or "JPRs" describe a specific job task, listingthe items necessary to complete the task successfully, and define measurable orobservable outcomes and evaluation areas for the specific task.

(FF)(HH) "Knowledge examination" means the written portion of the initial, reciprocity,and reinstatement examinations, as set forth in ChaptersChapter 4765-20 and Chapter4765-21 of the Administrative Code.

(GG)(II) "Lead instructor" means an individual who holds a certificate to teach as a fireinstructor, live fire instructor, or fire safety inspector instructor and is delegated by theprogram director to be in charge of designated classroom or practical skills portionsof a fire training course.

(HH)(JJ) "Live fire instructor" means an individual who holds a certificate to teach livefire training, under the auspices of a chartered fire training program, issued by theexecutive director pursuant to section 4765.55 of the Revised Code and Chapter4765-21 of the Administrative Code.

(II)(KK) "National domestic preparedness consortium" or "NDPC" provides trainingto emergency responders throughout the United States and its territories under acooperative agreement among the U.S. department of homeland security, the federalemergency management agency, and other partners.

(JJ)(LL) "National fire academy" is operated and governed by the United States fireadministration as part of the U.S. department of homeland security from a campusin Maryland.

(KK)(MM) "National fire protection association" or "NFPA" is an international nonprofitorganization which sets the nationally accepted standards for research, training, andeducation for all aspects of firefighting and the fire service.

(LL)(NN) "Offsite location" means a location where the majority of didactic training fora course is conducted, if not at the fixed geographic location where the charteredprogram is operated.

(MM)(OO) "Online education" means a training course delivered by correspondence,telecommunication, internet, web-based media, or combination of media, and mayinclude a short period of on-campus attendance.

(NN)(PP) "Personal alert safety system" or "PASS" is a device that issues an alarm signalingthat a firefighter needs assistance.

(OO)(QQ) "Personal protective equipment" or "PPE" consists of a full ensemble ofprotective clothing, plus a "self-contained breathing apparatus" or "SCBA" and a"personal alert safety system" or "PASS" device.

(PP)(RR) "Practical skills evaluator" means a fire instructor or fire safety inspectorinstructor that has successfully completed the "Practical Skills Evaluator TrainingCourse" under the auspices of the chartered program.

(QQ)(SS) "Practical skills evaluator refresher training" is a program, approved by theexecutive director, developed using form "EMS 1260" and conducted through thechartered programs on an annual basis, designed to ensure the skills evaluators areconducting evaluations safely according to the current standards as determined bythe division.

(RR)(TT) "Practical skills examination" means the practical skills portion of the initial,reciprocity, and reinstatement examinations, as set forth in this chapterChapter4765-20 and Chapter 4765-24 of the Administrative Code.

(UU) "ProBoard" or "national board on fire service professional qualifications" accreditsorganizations that use the NFPA's professional qualification standards and operatesa certification registry.

(SS)(VV) "Program director" means the authorizing official or that person designated bythe authorizing official of a chartered program to oversee the administration andoperation of a fire charter.

(TT)(WW) "Reinstatement" is the process by which a holder of a firefighter certificate,fire safety inspector certificate, hazard recognition officer, instructor certificate, or acharter, issued by the executive director may regain a certificate or charter that hasexpired, was voluntarily surrendered, or has been revoked.

(UU)(XX) "Restrict" means to preclude a certificate holder from engaging in a particularconduct or activity, to impose conditions on the manner in which such conduct oractivity may be performed, or to require the certificate holder to abide by specificconditions in order to continue functioning under the holder's certificate.

(VV)(YY) "Revocation" means the loss of a certificate issued under section 4765.55 of theRevised Code for at least one year from the date on which the executive director'sorder revoking the certificate was journalized.

(WW)(ZZ) "Self-contained breathing apparatus" or "SCBA" means a device worn byrescue workers, firefighters, and others to provide breathable air in an "ImmediatelyDangerous to Life or Health" (IDLH) atmosphere.

(XX)(AAA) "Skills coordinator" means an individual designated by the program directorto be in charge of the administration, set up, and supervision of practical skillsexaminations.

(YY)(BBB) "Veteran" means any person who has completed service in the armed forces,including the national guard of any state, or a reserve component of the armed forces,who has been discharged under honorable conditions from the armed forces or whohas been transferred to the reserve with evidence of satisfactory service.

(A) "Courage to be Safe: Sixteen Life Safety Initiatives Course" or "Courage to Be Safe"course (October 2015) is based on the "National Fallen Firefighters Foundation's""Everyone Goes Home Program" and is a component of the Foundation's "16Firefighter Life Safety Initiatives." (B) "Emergency Vehicle Operations Course ObjectivesPacket" or "EVOC Packet" orform "EMS 0210" (July 2017April 2019) provides theis a course objectives, asapproved by the executive director, for the emergency vehicle operations course,which consistsconsisting of a minimum of sixteen hours that focuses on familiarizingparticipants with terminology, driving skills, and liability issues that relate to theoperation of a fire department vehicle. The course objectives, established by theexecutive director, have been designed to meet, and shall be consistent with, thegeneral knowledge requirements, general skill requirements, and job performancerequirements specified in "NFPA 1002: Standard for Fire Apparatus Driver/OperatorProfessional Qualifications" and "NFPA 1451: Standard for a Fire and EmergencyService Vehicle Operations Training Program." The course is a qualificationrequirement for Ohio firefighter I and firefighter II certification. (C) "Exemption Request for Continuing Education for Fire Certificates" or form "EMS1103" (January 2018) is made available to certificate holders who wish to request thatthe executive director waive part of or all of the continuing education or instructionalrequirements needed to renew. (P)(R) "Firefighter, Fire Safety Inspector, or Hazard Recognition Officer InitialApplication" or form "EMS 0053" (January 2018) is the application for a firefighter,fire safety inspector, or hazard recognition officer certification, issued by theexecutive director. The application is made available through an online portalaccessed at chartered fire training programs by an applicant who has been verified bya program director as meeting all training requirements to apply for a firefighter, firesafety inspector, or hazard recognition officer certification.

(Q)(S) "Firefighter, Fire Safety Inspector, or Hazard Recognition Officer RenewalApplication" or form "EMS 1104" (January 2018) is made available to a holder of afirefighter, fire safety inspector, or hazard recognition officer certificate who wishesto renew the certificate and can be accessed at the division's renewal website at https://services.dps.ohio.gov/EMSProviders.

(R)(T) "Firefighter Reciprocity Application" or form "EMS 0081" (January 20182019) ismade available to an applicant who wishes to be issued a firefighter certificate by theexecutive director, based on training received from another state or a branch of theUnited States military. (S)(U) "Firefighter Reciprocity Packet" or form "EMS 5917" (JanuaryApril 20182019) ismade available to a potential applicant who wishes to be issued a firefighter certificateby the executive director, to document training received from another state or abranch of the United States military. The packet is available to applicants seekingreciprocity and can be accessed at the division's forms and applications website athttp://www.ems.ohio.gov/forms.aspx.

(T) "Firefighter Training Course Objectives & Recommended Hours Guide" or form "EMS0118" (January 2018) is made available to Ohio-chartered fire training programs toprovide recommended hours for course objectives and performance objectives bycertificate level and can be accessed at the division's forms and applications websiteat http://www.ems.ohio.gov/forms.aspx.

(U)(V) "Hazardous Materials Awareness and Operations Course ObjectivesPacket" orform "EMS 0205" (May 2017April 2019) is a course consisting of a minimum ofsixteen hours that is approved by the chartered program and is consistent with therequirements of "NFPA 1072" related to the minimum requirements in terms ofprofessional core competencies for hazardous materials awareness and operationsand can be accessed at the division's forms and applications website at http://www.ems.ohio.gov/forms.aspx.

(V)(W) "Hazard Recognition Officer Certification RequirementsCourse Packet" or form"EMS 02110311" (May 2017April 2019) sets forth the admission requirements,qualifications for certification, course objectives and recommended hours, andknowledge and skill objectives required to be taught in a hazard recognition officercourse, as approved by the executive director. This course isrequired for instructors or assistant instructors who provide instruction in live firetrainingcourse consisting of a minimum of twenty-four hours approved by theexecutive director that provides students with the necessary knowledge and tools toprepare and conduct live fire training evolutions. The course includes an in-depthanalysis of "NFPA 1403: Standard on Live Fire Training Evolutions," addressingevolutions at acquired structures; gas-fired training buildings; non-gas fired trainingbuildings; and exterior props, vehicle fires, and exterior class B fires.
