1.01 (I) By submission of the bid, each bidder certifies, and in the case of a joint bid each party thereto certifies as to his own organization, that in connection with the bid:

A. (i) The prices in the bid have been arrived at independently, without consultation, communication, or agreement, for the purpose of restricting competition, as to any matter relating to such prices with any other bidder or with any competitor;

B. (ii) Unless otherwise required by law, the prices which have been quoted in the bid have not knowingly been disclosed by the bidder, prior to opening, directly or indirectly to any other bidder or to any competitor; and

C. (iii) No attempt has been made or will be made by the bidder to induce any other person or firm to submit or not to submit a bid for the purpose of restricting competition.

1.02 (II) Each person signing the bid shall certify that:

A. (i) He is the person in the bidder’s organization responsible within that organization for the decision as to the prices being bid and that he has not participated, and will not participate, in any action contrary to (I) (i) through (I)(iii) above; or

B. (ii) He is not the person in the bidder’s organization responsible within that organization for the decision as to the prices being bid but that he has been authorized to act as agent for the persons responsible for such decision in certifying that such persons have not participated, and will not participate, in any action contrary to (I)(i) through (I)(iii) above, and as their agent shall so certify; and shall also certify that he has not participated, and will not participate, in any action contrary to (I)(i) through (I)(iii) above.

1.03 Bidder certifies that all iron and steel products used in the project for the construction, alteration, maintenance, or repair of a public water system are produced in the United States in compliance with Section 436. (a) – (f) of H. R. 3547, “The Consolidated Appropriation Act, 2014”.

NOTES:

1. Approval of bids shall be at discretion of Owner.

2. Any contractor that is awarded one of three contracts included in this project may become ineligible to receive award for other two remaining contracts.

3. Number of services shown and quantities associated with each service type are for bidding purposes only. Final payments for services will be based on actual quantities measured in the field.

4. Contingency bid items will only be used as necessary and as authorized through written approval by engineer on a case‐by‐case basis for individual service replacements.

ARTICLE 6 – TIME OF COMPLETION

6.01 Bidder agrees that the Work will be substantially complete and will be completed and ready for final payment in accordance with Paragraph 15.06 of the General Conditions on or before the dates or within the number of calendar days indicated in the Agreement.

6.02 Bidder accepts the provisions of the Agreement as to liquidated damages.

2. Completion of Remaining Work: After Substantial Completion, if Contractor shall neglect, refuse, or fail to complete the remaining Work within the Contract Times (as duly adjusted pursuant to the Contract) for completion and readiness for final payment, Contractor shall pay Owner $500 for each day that expires after such time until the Work is completed and ready for final payment.

3. Liquidated damages for failing to timely attain Substantial Completion and final completion are not additive and will not be imposed concurrently.

SPECIAL PROVISIONS

SEGMENTAL CONCRETE BLOCK WALL This work shall be constructed in accordance with Section 522 of the Standard Specifications. This item may or may not be utilized under this contract pending individual site determination at time of pre‐construction site inspection. Work shall consist of furnishing and constructing the retaining wall system, as specified to match existing lines, grades, and dimensions determined upon removal of existing retaining wall system. Subject to approval by Owner, Engineer, and in cases where work is on private property, the Property Owner. This work shall be measured for payment in cubic yards according to Article 503.21 of the Standard Specifications. This work will be paid for at the contract unit price per square foot for Segmental Concrete Block Wall. EXPLORATORY EXCAVATION Prior to the commencement of any work being completed on each water service replacement site, the contractor shall perform exploratory excavation to confirm water service line material is lead. Contractor shall be responsible for coordinating with J.U.L.I.E. for utility location marking prior to any exploratory digging. If the water service line material is determined to be lead, the payment for EXPLORATORY DIGGING shall be considered loan eligible and shall be completed under the contract unit price per lump sum. If the water service line is determined to be a material other than lead, the payment for EXPLORATORY DIGGING shall not be considered loan eligible. Cost for restoration including seeding, fertilizer, erosion control blanketing, and topsoil shall be incidental when the service line is proven not to be lead. The payment for this non‐participating work shall be completed by the City of Rockford at the unit pricing set forth in this contract per lump sum. END SECTION
