The following additions, deletions, or modifications shall become part of the Contract Documents for this Project: ADDENDUM NUMBER TWO REVISIONS TO THE SPECIFICATIONS: ITEM NO. 1 – CONTRACT

Replace Page 135 and Page 136 with the attached REVISED Page 135 and REVISED Page 136.

RESPONSE TO RFIs: QUESTION NO. 1 – 8" Corrugated HDPE irrigation conduit is indicated in L1, detail A/L1

indicated 4" SCH 40 PVC Irrigation conduit. Please clarify size and material for the conduit at this position.

RESPONSE: The note on sheet L1 is correct and Detail A/L1 on sheet C3 is incorrect. The

irrigation conduit called out in Detail A should be for 8” Corrugated HDPE. QUESTION NO. 2 – Please clarify if irrigation conduit will be installed as shown in Irrigation

Plan (L-1) or Plan & Profile Plan (L2 & L3). Irrigation plans show different sleeve symbols and different sizes, while Plan & Profile Plan show only (1) 8" HDPE irrigation conduit.

RESPONSE: The irrigation conduits should be installed as shown in sheets L1-L3 for all 8”

HDPE irrigation conduit, and per sheets C10-C13 for all 4” PVC irrigation conduit underneath driveways.

QUESTION NO. 3 – Please clarify if irrigation conduit will be installed as shown in Irrigation

Plan (L-1) or Construction Detail C10, C11, C12 & C13

RESPONSE: The irrigation conduits should be installed as shown in sheets L1-L3 for all 8” HDPE irrigation conduit, and per sheets C10-C13 for all 4” PVC irrigation conduit underneath driveways.

QUESTION NO. 4 – Does landscape contractor have to provide Irrigation water meter as

shown in LI-1?

RESPONSE: The City of Exeter will provide the irrigation 1” water meter at no charge to the Contractor. The Contractor will be responsible for making arrangements with the City and paying the charges for installation of the irrigation 1” water meter as specified in the technical specifications.

QUESTION NO. 5 – Who will handle the Traffic Control Plans?

RESPONSE: Contractor shall develop and submit traffic control plans for review and approval.

QUESTION NO. 6 – Are detours allowed?

RESPONSE: One lane must always remain open for each direction of traffic. Contractor can phase the project work so that this can be achieved.

QUESTION NO. 7 – Will sewer lines need patch paving?

RESPONSE: The whole pavement section (pavement, base, and subgrade) is being redone. If temporary patching is required for traffic/safety purposes, contractor shall include costs for such patching in the price of the work.

QUESTION NO. 8 – Will access to businesses need to be maintained?

RESPONSE: Access to businesses will need to be maintained. As stated above, the contractor can phase the project work so that this can be achieved.

QUESTION NO. 9 – Per Bid Item #31 Relocate Sewer Lift Station, and per Section 3 Relocate

Sewer Lift Station in the Technical Section, Subsection 3.12 Payment, it states “Payment for furnishing and installing wastewater pumps …”. However, on Plan Sheet U5/38 of 55, states “Pump Materials Supplied by Shape Inc. and Installed by others.” Does the Contractor furnish and install the pumps or does someone else?

RESPONSE: The Contractor is responsible for purchasing the pump materials from Shape

Inc. and installing the pump materials. QUESTION NO. 10 – How does the trench patching of the 18” RCP Storm Drain in the alley

alongside R & N Market and the street crossing at Belmont Road get paid by?

RESPONSE: Payment for trench patching is included in the contract unit price per cubic yard (CY) paid for Class 2 AB and per TON paid for HMA (Type A).

QUESTION NO. 11 – Will native material be acceptable for pipe backfill (other than the areas

where the SD pipe has less than 24 inches of cover)?

RESPONSE: Trench backfill and compaction recommendations were provided by BSK on page 7 (pdf page 11) in their draft Geotechnical Engineering Investigation Report, see attached.

QUESTION NO. 12 – Please provide installation detail for HDPE pipe irrigation conduit.

RESPONSE: Please refer to the irrigation conduit and sleeve detail attached.

QUESTION NO. 13 – Do you have coring information available on what the existing structural sections are that we need to remove (i.e. Visalia Road, parking lots, etc.)?

RESPONSE: Boring locations with copies of the log of borings for each location are provided

in the attached “Boring Table” on sheet X3. QUESTION NO. 14 – Per Bid Item# 59 – Class 5 Aggregate Subbase – 3,623 cy, in referencing

the Caltrans 2018 Standard Specifications and the project specifications, I cannot find a Class 5 specification or any required gradations. Please clarify.

RESPONSE: Per BSK’s geotechnical report, import fill materials to be used as aggregate

subbase must be free from organic materials or deleterious substances. The contractor is to work with the City to verify the proposed import fill materials are in conformance with these recommendations prior to importing to the Site. Imported fill soils must be non-hazardous and be derived from a single, consistent soil type source conforming to the following criteria: Plasticity Index: < 10 R-Value greater than 50 Maximum Particle Size: 2 inches Percent Passing #4 Sieve: 60 - 100% Percent Passing #200 Sieve: 20 - 40% Low to Very Low Corrosion Potential: Soluble Sulfates < 1500 ppm Soluble Chlorides < 200 ppm

QUESTION NO. 15 – Is there a drawing for the irrigation backflow preventer.

RESPONSE: See the attached irrigation backflow preventer detail. QUESTION NO. 16 – Drainage System 3 extends into what appears to be a private lot. What is

the structural section that will need to go back after the installation of the pipe?

RESPONSE: Drainage System 3 extends across the alley behind RN Market and intercepts an existing SDMH. Per the City of Exeter Engineering Standard ST-4 – Typical Alley Section (see attached), the structural section shall be a minimum of 2” AC, 4” Class 2 AB, 6” compacted sub-base.

QUESTION NO. 17 – Please provide a detail for the connection of the proposed 8-inch sewer

pipe to the existing 8-inch sewer pipe once the existing sewer lift station is demoed (approximately STA 26+56 Belmont).

RESPONSE: The existing sewer lift station manhole is to be protected in place. The proposed

8-inch sewer pipe will intercept this manhole as shown on the profile provided on sheet U4. The existing lift station pump equipment will be removed and the bottom of the manhole will be filled with concrete as noted. Construction Note [7] on sheet U4 is amended as follows:

[7] EXISTING SEWER LIFT STATION IS TO BE PROTECTED AND FUNCTIONING DURING INSTALLATION OF NEW SEWER LIFT STATION. REMOVE EXISTING SEWER LIFT STATION PUMP EQUIPMENT ONCE NEW SEWER LIFT STATION IS FUNCTIONAL AND AS DIRECTED BY THE ENGINEER.

QUESTION NO. 18 – Can you please tell me the existing thickness of the Asphalt Concrete per

the boring log on sheet 4 of the plans?

RESPONSE: See Question No. 13’s response above. CLARIFICATIONS: ITEM NO. 1 – WORK HOURS

Working hours shall be 7:00 am to 3:30 pm Monday through Friday.

ITEM NO. 2 – SCE INSPECTIONS AND POWER UP

All SCE infrastructure has to be completely installed and signed off by SCE inspector prior to starting the 30-working day power up period. Contractor shall incorporate this 30-working day period in their project schedule.

ITEM NO. 3 – TULARE COUNTY BUILDING PERMITS

A Tulare County Building Permit is required for this project because all electrical panels will need to be tagged by the County Building Inspector.

ITEM NO. 4 – LONG LEAD ITEMS

Submittals for long lead items shall be submitted to the City for review and approval within 15 working days of notice to proceed being issued.

ARTICLE III - Contractor shall indemnify and hold harmless City, its officers, employees, agents and volunteers from and against all liability, loss, damage, expense, and cost (including, without limitation, reasonable legal counsel fees, expert fees and all other costs and fees of litigation) of every nature arising out of or in connection with Contractor’s negligence, recklessness, or willful misconduct in the performance of work hereunder, or its failure to comply with any of its obligations contained in this Agreement, except such loss or damage caused by the active negligence or willful misconduct of the City. It is expressly understood and agreed that the foregoing provisions are intended to be as broad and inclusive as is permitted by the law of the State of California and will survive termination of this Agreement.

The Contractor shall continuously protect City property, including work under construction, from damage, loss, or liability of any kind to persons or property arising in connection with the contract, direct or indirect, including that arising from rainfall, flood waters, and other action of the elements and all acts of third parties.

This indemnity and hold harmless provision, insofar as it may be adjudged to be against public policy, shall be void and unenforceable only to the minimum extent necessary so that the remaining terms of this indemnity and hold harmless provision may be within public policy and enforceable.

In an emergency affecting the safety of life or limb, work site, or any property, the Contractor is hereby permitted and directed to act at their discretion to prevent such threatened loss of injury, and in the event any instructions are given by the City of EXETER in any emergency, the Contractor shall unconditionally comply therewith.

ARTICLE IV – INSURANCE With respect to the performance of work under this agreement, the Contractor shall maintain and shall require all of its subcontractors to maintain insurance as described below.

General Liability Contractor shall maintain commercial general liability insurance with coverage at least as broad as Insurance Services Office form CG 00 01, in an amount not less than five million dollars ($5,000,000) per occurrence, $10,000,000 aggregate, for bodily injury, personal injury, and property damage, including without limitation, blanket contractual liability and coverage for explosion, collapse and underground property damage hazards. If a general aggregate limit applies, either the general aggregate limit shall apply separately to this project/location or the general aggregate limit shall be twice the required occurrence limit. A combination of a general liability policy and excess liability policies may be utilized to achieve these limits. Contractor’s general liability policies shall be primary and shall not seek contribution from the City’s coverage, and be endorsed using Insurance Services Office form CG 20 10 to provide that City and its officers, officials, employees, and agents shall

be additional insureds under such policies. An endorsement providing completed operations to the additional insured, ISO form CG 20 37, is also required.

Auto Liability Contractor shall provide auto liability coverage for owned, non-owned, and hired autos using ISO Business Auto Coverage form CA 00 01, or the exact equivalent, with a limit of no less than five million dollars ($5,000,000) per accident.

Workers’ Compensation Contractor shall maintain Workers’ Compensation Insurance (Statutory Limits) and Employer’s Liability Insurance with limits of at least one million dollars ($1,000,000). Contractor shall submit to City, along with the certificate of insurance, a Waiver of Subrogation endorsement in favor of City, its officers, agents, employees, and volunteers.

Worker's Compensation insurance with statutory limits, and employer's liability insurance with limits of not less than $1,000,000 per accident. Contractor acknowledges the provisions of the State Labor Code requiring every employer to be insured against liability for worker’s compensation, or to undertake self-insurance in accordance with the provisions of that code, and certifies compliance with such provisions.

Contractor shall furnish properly executed certificates of insurance to City prior to commencement of work under this agreement, such certificates shall:

a. Clearly evidence all coverage required above, including specific evidence of a separateendorsement naming the City as an insured;

b. Indicate whether coverage provided is on a claims made or occurrence basis; and

c. Provide that such insurance shall not be materially changed, terminated, or allowed toexpire except on 30-days prior written notice to City’s Purchasing Division, Attention:

City Administration Office 100 N. C Street

EXETER, CA 93221.

Such insurance shall be maintained from the time work first commences until completion of the work under this Agreement if an occurrence policy form is used. If a claim made policy is used, coverage shall be maintained during the contract term and for a period extending 5 years beyond the contract date. Contractor shall replace such certificates for policies expiring prior to completion
