The State ProjectDirector, Sarva ShikshaAbhiyan,Bangalore‐N.T.Road,K.R.Circle,Bangalore‐560060,invitesTendersintwo‐tendermode,i.e.TechnicalandFinancial,fromeligible Tenderers for providing services of Data Entry Operators to the Sarva ShikshaAbhiyan,N.T.Road,Bangalore‐01.

1.PRE‐QUALIFICATIONCRITERIATheTendererwhointendtoparticipateshallmeetthefollowingqualifyingrequirements:(a)TechnicalCriteria(i) The prospective Tenderer (i.e. Facility Management Agency) should have

successfully carried out Data Entry Operators services in anyorganization/establishment for not less than 100, persons/users on a normalworkingdayinasingleunitforacontinuousperiodoftwoyearsduringthelastthreeyears.

(ii) TheannualvalueofsinglelargestcontractataunitshouldbenotlessthanRs.50lakhsperannumonadailyoperation.

(iii) Forthepurposeofcalculating'valueofwork'ofafacilitymanagementagency,the

value of operating an industrial/academic institution/establishment will beconsidered.

(iv) Thetimeperiodofthreeyearsshallbereckonedason31.3.2015(v) Tenderer shall not be under a declaration of corrupt and fraudulent practices

issuedbyGovernmentofKarnataka.(vi) Tenderershouldhavebeeninexistenceforatleast3years.(vii) TenderershouldpreferablyhavebeenincorporatedinKarnataka.Ifincorporated

elsewhere,shouldhavenecessarypermission/licensetooperateinKarnataka.(viii) Servicepersonnelemployedshouldbeabove18yearsofage.(ix) PriorexperienceofservicestoGovernment,PSUswillbeanaddedadvantage(x) AllTenders should include theTechnicalandFinancial requirement information

(xi) Applications shouldbe accompaniedby copies ofRegistration certificatesunder

Income Tax, Service Tax, Provident Fund, Employees State Insurance and anyotherstatutoryrequirements.

(xii) The Tenderers are responsible for employee insurance including medical

coverage.SSAhasnoliabilityinthisconnection.(xiii) TendersshouldbeaccompaniedbycopiesofIncomeTaxandServiceTaxReturns

forthelast3years.(xiv) TendersshouldbeaccompaniedbycopiesofthelatestreturnsofPFandESI.

(b)FinancialCriteria:

TheannualturnoveroftheTendererduringthelastthreeyearsshouldnotbelessthanRs.50/=lakhsperannum(RupeesFiftylakhsonly).

2.GENERALTERMSANDCONDITONS(a) The Tenderer shall submit documentary evidence in support of the above

prequalification criteria. Tendererswith all information and supporting documentsbywayofcopiesofworkordersandauditedBalanceSheets,includingProfit&LossStatement,AnnualTurnover Statement, latest IncomeTaxReturns, etc. to establishtheircredentialsandtrackrecord for fulfillingtheexperience, financialandrankingsystemrequirements,alonewillbeconsidered.

(b) Forthepurposeofascertainingtheexperienceandfinancialcriteria, theexperienceandfinancialcriteriaoftheTendererentityalonewillbetakenintoconsideration.

(c) Thereshallnotbeanycaseorchargeunderinvestigation/enquiry/trialagainstthe

Tendereror convicted in a Court of Law or suspended/blacklisted by anyorganizationonanygrounds.

(d) SSA reserves the right to use in‐house information for assessment of capability of

Tenderer.ThedecisionofSSAregardingthetenderwillbefinalandbinding.(e) If the performance of the Tenderer is/has been found to be unsatisfactory for any

reason,whatsoever,inanyorganizationincludingSSA,thenSSAreservestherighttorejectthetenderssubmittedbysuchTendereratanypointoftime.

(f) JointVentures/Consortiumbasedoffersshallnotbeaccepted.(g) Tender document can be downloaded from the websitehttp://eproc.karnataka.gov.in

(h) The Tenderer has to ensure that the tender document is strictly as per the orderindicatedinthemasterindex.

(i) Tenderdocumentcompletedinallrespectsalongwithsupportingdocumentsshallbesubmitted on‐line up to 17.30Hrs. on 24.07.2015. The Technical Offers shall beopenedon29.07.2015at11.00 hours.Theshort‐listed tenderswillbeconsideredforopeningofFinancialTenderon05.08.2015at12‐00noon. If theabovedayofopeninghappenstobeaclosedholidayforSSA,it isimpliedthattheopeningofthetenderswillbeheldonthenextworkingdayatthetimestipulatedasabove.

(j) Tenderer'spre‐site inspection,queriesanddiscussioncanbemadeanytimeduring

workinghours(between3.00to5.00pm)fromtheofficeofSarvaShikshaAbhiyan.Furtherdetailsinthisregardarehighlightedinthesection"InstructiontoTenderer".

(k) RequestforsendingtheTenderdocumentbypostorCourieroranyothermodeshallnotbeentertained.Telex/E‐mail/Faxtendersshallnotbeaccepted.

(l) Tenderer shall ensure submission of complete information/documents at the first

instanceitself.SSAreservestherighttocompletetheevaluationbasedonthedetailsfurnished by the Tendererwithout seeking any subsequent additional information.Tendersnot incompliancewithtenderconditionsorwithincompleteinformation/documentsareliableforrejection.

(m) Issuance of tender or submission of tender by itself shall not amount to pre‐

qualificationorentitletheTenderertoparticipateinthetendering.(n)SSAshallnotberesponsibleforanycostsorexpensesincurredbytheTendererinconnectionwiththepreparationofTender.

(n) Canvassinginanyformbytheagencydirectlyorindirectlyorbyanyotheragency/

personontheirbehalf,mayleadtodisqualificationoftheirtender.(o) Clarification, ifany,canbeobtainedfromtheAdministrationsectiononallworking

INSTRUCTIONSTOTENDERER[(GeneralConditionsofContract(GCC)]

1.Generalprovisions1.1DefinitionsUnlessthecontextotherwiserequires,thefollowingtermswheneverusedinthiscontracthavethefollowingmeanings;a) “ApplicableLaw”meansthelawsandanyotherinstrumentshavingtheforceoflawin

India,astheymaybeissuedandinforcefromtimetotime;

b) “Contract”meansthecontractsignedbytheparties,towhichthesegeneralconditionsofcontract(GC)areattached;

c) “EffectiveDate”meansthedateonwhichthiscontractcomesintoforceandeffectpursuantofClauseGC2.1.

d) “ContractPrice”meansthepricetobepaidfortheperformanceoftheservices,inaccordancewithclause6;

e) “GC”meanstheseGeneralconditionsofcontract;

f) “Government”meanstheGovernmentofKarnataka;

g) “LocalCurrency”meansIndianRupee;

h) “SSA”meansSarvaShikshaAbhiyanSamithi‐Karnataka

i) “SPD”meansStateProjectDirector

j) “SPO”meansStateProjectOffice”

k) ”Member”incasetheAgency/Firmconsistsofajointventureofmorethanoneentity,means any of these entities, and “Members”means all of these entities; “Member inCharge”meanstheentityspecifiedintheGCtoactontheirbehalfinexercisingalltheFirmrightsandobligationstowardstheclientunderthiscontract.

l) “Party”meanstheclientortheAgencyasthecasemaybe,andpartiesmeansbothofthem;

m) “Personnel”meanspersonshiredbytheTenderersandassignedtotheperformanceoftheservicesoranyparthereof;

n) “Services”meanstheworktobeperformedbytheTendererspursuanttothiscontractasdescribedinTermsofReference.

1. GENERALCONDITIONSOFCONTRACT

YouareinvitedtosubmityourTechnicaltenderandFinancialtenderseparatelyfor "PROVIDING DATA ENTRY OPERATORS SERVICES TO THE SARVA SHIKSHAABHIYAN AT N.T.ROAD, K.R.CIRCLE, BANGALROE" for a period of 12 months. The'Scope of Work/Services' is out lined under the same title in a later section of thisdocument. The TENDER documents shall remain the exclusive property of the SSAOfficewithoutanyrighttotheTenderertousethemforanypurposeexcepttenderingandforusebysuccessfulTendererwithreferencetothework.

2. TENDERDOCUMENTTender document is available in the Karnataka Government web‐sitehttp://eproc.karnataka.gov.inandcanbedownloaded.

3. ONETENDERPERTENDEREREach Tenderer shall submit only one tender (i.e., Technical and Financial tender).TendererwhosubmitsorparticipatesinmorethanoneTenderwillbedisqualified.

4. TENDERVALIDITY TheTendershallremainvalidforacceptanceforaperiodof4(four)monthsfromtheduedateofsubmissionoftender.TheTenderershallnotbeentitledtomodify,vary,revokeorcanceltheirtenderduringthesaidperiod.IncaseoftheTenderermodifying,varying,revokingorcancelingthetender,theTenderershallforfeittheEarnestMoneyDepositpaid.ThevalidityofthetendershallbeextendedasandwhenrequiredfortheperiodasrequestedbytheSSAOfficeinwriting.

5. AMENDMENTTOTENDERINGDOCUMENT TheSSAOfficemayforanyreason,whetheratitsowninitiativeorinresponsetotheclarificationrequestedbytheprospectiveTenderer, issueamendment intheformofaddendum/corrigendumeitherduringtheperiodofissueoftenderdocumentandsubsequenttoreceivingthetenders. Any addendum / corrigendum thus issued shall become part of the TenderDocument and the Tenderer shall submit "Original" addendum corrigendum dulysignedandstampedintokenofacceptance.Foraddendum/corrigendumissuedduringthe tendering period, Tenderer shall consider the impact of such addendum /corrigenduminthetender. For addendum /corrigendum issued subsequent to receiving the tenders,Tenderershallfollowtheinstructionsissuedalongwithsuchaddendum/corrigendum.

6. CLARIFICATIONSREQUESTEDBYTENDERERS:

AlthoughthedetailspresentedinthetenderingdocumentconsistsofConditionsof

Contract, Scope ofWork/Services, Specifications and have been compiled with in allreasonable care, it is the Tenderer's responsibility to ensure that the informationprovidedisadequateandclearlyunderstood.

TheTenderer shall examine theTenderDocument thoroughly in all respect and ifany conflict, discrepancy, error or omission is observed, the Tenderer may requestclarificationduringthepre‐bidmeetingtobeheldpriortotheTenderClosingDate.

Such clarification requests in writing, shall be addressed to the State ProjectDirector,SarvaShikshaAbhiyan,NrupatungaRoad,K.R.Circle,Bangalore‐01.

7. CHECKLISTFORSUBMISSIONOFTENDERIn order to ensure that the Tenderer complete the tender, a check list forsubmission of various documents details in "Technical & Financial Tender, has beenenclosedasAnnexure‐2.TheTendererintheirowninterest,arerequestedtofillthechecklistandsubmititalong with the tender for ready reference. In case of incomplete submission, SarvaShikshaAbhiyan,Bangalorewill not beunder anyobligation to give theTenderer anopportunitytomakegoodsuchdeficienciesandSarvaShikshaAbhiyanofficemayatitsowndiscretiontreatsuchtendersasincompleteandnotconsiderthesameforfurtherevaluation.

8. MODEOFSUBMISSIONOFTENDERTENDERshallbesubmittedine‐procurementportalonlyintwoBids.PART‐I:TECHNICALBIDPART‐II:FINANCIALBID

Part‐Iof the tenderdocument shall contain all pre‐qualification, i.e.,the Technical details as mentioned in Annexure‐2, under the heading "Pre‐QualificationRequirement".

Part ‐ IIof the tenderdocument shall contain information regarding theratestobequoted. AnyconditionsmentionedbytheTendererinPart‐IIshallnotbetakenintoaccountandifinsistedupon,thetendershallbeliableforrejection.

9. TENDERSUBMISSION.TenderdocumentscanbedownloadedfromTheTenderersshouldensurethattheiroffers areuploadedat e‐procurementportalwithin the stipulateddate and time. SSAshallnottakeresponsibilityifthetendersarenotuploadedattheaboveportalwithindue date and time and the tenders uploaded after the date and time stipulated forreceipt of tenders are liable to be rejected. No request for extension of time forsubmissionoftendershallbeconsidered.

10. EARNESTMONEYDEPOSIT(EMD)10.1EarnestMoneyDepositofRs.93,500(RupeesNinetyThreeThousandFiveHundredrupeeonly)shallbedepositedwiththeTender.10.2TheEMDshallbepaidthroughe‐procurementwithanyofthefollowingmodes:a)DebitCard,b)CreditCard,c)NEFT(NationalElectronicFundTransfer)andd)OTC(Over‐the‐Counterpayment‐throughICICIBank).Note:EMDshallbepaidthroughonlineonly.10.3TenderswithouttheEMDwillberejected.10.4NointerestshallbepayableontheEMDfurnished.

10.5 If theTendererafter submitting the tender, revokes theofferormodifies the termsand conditions thereof during the validity of the offer, except where the SSA Office hasgivenopportunitytodoso,theEMDshallbeliabletobeforfeited.10.6IntheeventofwithdrawaloftheInvitationtoTenderbytheSSAOffice,theEMDpaidwiththetenderwillbereturnedtotheTendererwithinaperiodof8weeks.10.7 In theeventof the successfulTenderer's failureor refusal to sign theagreementorfurnishthesecuritydeposit,theearnestmoneydepositshallbeforfeitedwithoutprejudiceSSAOffice’sreservestherighttorecoveranyfurtherlossordamageincurredorcausedinconsequencethereof,fromtheTenderer.10.8 TheEMDshallbereturnedtotheunsuccessfulBidderswithinaperiodoffour(4)weeks from the date of issuing the work order to the Successful Bidder. The EMDsubmitted by the Successful Bidder shall be released upon furnishing the PerformanceSecurityintherequiredformandmannerasstipulatedintheAgreement.10.9 TheEMDshallbeforfeitedinthefollowingcases:a) IftheBiddermodifiesorwithdrawstheProposal;b) IftheBidderwithdrawstheProposalduringtheintervalbetweentheProposaldue

dateandexpirationperiodoftheProposalValidityperiod;c) If the Successful Bidder fails to provide the Performance Security within the

stipulatedtimeoranyextensionthereofprovidedbytheSSAofficed) IfanyinformationordocumentfurnishedbytheBidderturnsouttobemisleadingor

untrueinanymaterialrespect;e) IfthesuccessfulBidderfailstoprovidethesuitablecandidateswithinthestipulated

time.f) Incase of SSA office finds that the performance of the bidder is not to the

expected quality, then the State Project Director, SSA reserves the right ofcancelationofthecontractwithoutgivinganyreason.

11. TECHINCALDISCUSSIONSTechnicalDiscussionswiththeTenderershallbearranged,ifneeded.TheTenderer

shall depute their authorized representative(s) attending the discussions and sign theminutesofmeetingonbehalfofhisorganization.Theauthorizedrepresentativesmustbecompetentandempoweredtosettlealltechnicalissues.12. COMPLIANCETOTENDERREQUIREMENT

SSA expects the Tenderer to comply with requirement of tendering documentwithoutanydeviation.Inanycase,noexceptionordeviationshallbeaccepted.Deviationon clauses, if felt necessary, should be furnished in the technical tender itself as per theenclosedformat.SSAshallnottakecognizanceofanydeviationstipulatedelsewhereinthetender.13. TENDEREVALUATIONCRITERIA13.1TenderingistheresponsibilityoftheTendererandnorelieforconsiderationcanbe

given for errors and omissionsmade by the Tenderer in advertently or otherwise.Tenderwithincompleteinformationisliableforrejection.

13.2 The Tenderer, who intends to participate shallmeet the qualifying requirement asmentionedinnoticeinvitingtender.

13.3Tendersnotmeetingthequalifyingrequirementsshallbesummarilyrejected.13.4TendersofthoseTendererwhicharefoundtobemeetingthequalifyingrequirement,

shallbetakenupfordetailedevaluation.13.5 In case the tenderdoesnot fully complywith the requirementofTenderdocument

and in case the Tenderer continues to stipulate exceptions and deviations to theclausesofTenderdocumentandifthesameisnotacceptabletoSSA,thenthetenderwillberejected.

13.6Proposeddeploymentofresourceslikemanpowershallbecompliedwithaspertherequirementsspecifiedandwillbecompletedpriortothecommencementofwork.

13.7 Performance of Tenderer onworks executed / under execution shall be taken intoconsiderationbeforeselectingtheTendererforopeningoftheirfinancialpart.

13.8 The Tenderer shall not mention their Financial terms/ rates anywhere in theTechnical (Part‐I) part of the tender. If Tenderer specifies or quotes Financialterms/ratesTenderintheTechnical(Part‐I)partofthetender,thentheiroffershallberejectedsummarily.

14. PROPOSALOFTHETENDERER:

TheTenderershallarrangetheirtenderinthefollowingorder:14.1 PART‐ITECHNICALPART:(a) Tenderingdocumentdulyuploadedinallrespects(b) Documentsinsupportofpre‐qualifyingrequirementsasperAnnexure‐2,(c) EarnestMoneyDepositofRs.93,500(Rs.NinetyThreeThousandFiveHundredrupeeonly)throughonline.

(d) ServiceTaxRegistrationCertificate(e) DetailsofTechnical/SkilledManpowerproposedtobedeployed‐inaseparateannexure(f) PowerofAttorneyinthenameofthepersonwhohassignedthetenderincaseiftheowneroftheCompanyisunabletosignthedocumentforanyunavoidablereasons.(g) AnnualTurnoverStatementfor2012‐13,2013‐14,2014‐15(h) DetailsaboutESI(i) DetailsaboutEPF(j) DetailsaboutLabourLaws(k) DetailsaboutLocalbodiesregistration(l) Otherstatutorydetails,ifany.

14.2 PART‐II‐FINANCIALPART

The Financial Part of tender shall be submitted as given in Annexure‐7. Financial

tender shall contain only Financials quoted by the Tenderer. The tender quote of thebidderswhoquote 0%as service chargeswill not be considered.Applicable income taxwillbedeductedasperprevailingrulesagainstthebillssubmitted.ProfessionaltaxwillbedeductedasperPTrules.15. TENDERER'SRESPONSIBILITYFORQUOTATION

Although the details presented in this tender document have been compiled with,with all reasonable care, it is theTenderer responsibility to ensure that the informationprovidedisadequateandclearlyunderstood.16. EVALUATIONOFFINANCIALTENDERS16.1. The financial tenders of only those Tenderer shall be considered for opening and

evaluationwhosetenderisdeterminedtobetechnicallyandcommerciallyacceptabletoSSA.EvaluationoffinancialtendersshallbetakenuptodeterminethecompetitiveFinancialsofthetechnicaltendersandincludethefollowing:

Financialtenderscontainingoverwriting/erasuresinthequotedratesshallbeliable

for rejection. Cuttings and overwriting shall be avoided. However, in case anycuttingisunavoidablethesameshallbeattestedbythesignatoryofTender,failingwhichsuchFinancialtendersshallbeliableforrejection.

OnarrivingatthefinalevaluatedFinancialsofallTenderer,anyuncalledforlump

sum/percentage/oradhocreduction,ifany,offeredbytheTendererafterthelastdate of submission of Financials or rebates offered at any place shall not beconsideredforthepurposeofevaluation.However,suchreduction/rebatefromtheTenderer, who is finally selected, shall be taken into account while issuing finalorder.

16.2.SSAreservestherighttonegotiateonthequotedFinancials.

17. CONTRACTDOCUMENT17.1 The Tenderer, whose tender has been accepted by SSA, shall enter into formal

agreementwithSSAatthedateandplacetobenotifiedbytheSSAOffice.17.2 Contract documents for agreement shall be prepared after award of works as

intimatedtothesuccessfulTendererandbyaLetterofAcceptancebytheTenderer.Until the final contract documents are prepared and executed, the TenderingdocumenttogetherwiththeannexeddocumentsandTenderer'sacceptancethereofshall constitute a binding contract between the successful Tenderer and the SSAOffice. Contract documents to be signed between State Project Director, SSA andsuccessfulTenderer,shallconsistoffollowing:

Agreementonstamppaperofappropriatevalue LetterofAcceptance DetailedLetterofAward. OriginalTenderingdocumentdulysignedbytheTenderer. AddendumissuedtoTenderer,ifanydulysignedbytheTenderer.

18. AWARDOFWORK

The Tenderer, whose tender is accepted by SSA, shall be issued with a Letter ofAcceptance prior to expiry of tender validity. Tenderer, shall confirm Acceptance byreturningasignedcopyoftheLetterofAcceptance.SSAshallnotbeobligedtofurnishanyinformation / clarification / explanation to the unsuccessful Tenderer as regards non‐acceptanceof their tenders.Except for refundofEMD tounsuccessfulTenderer, theSSAOfficeshallcorrespondonlywiththesuccessfulTenderer.

KARNATAKA,BANGALORE.1.BACKGROUND:The Sarva Shiksha Abhiyan Samithi ‐ Karnataka is a registered society which isimplementingthecentrallysponsoredprogrammeofSarvaShikshaAbhiyan(SSA)toattainthegoalofUniversalizationofelementaryeducationinallthedistrictsofKarnatakastateforwhichfundsaresharedbetweentheGovernmentofIndiaandStateGovernment.2.OBJECTIVES:SarvaShikshaAbhyanSamithi,Karnataka,isimplementingtheprogramme“SarvaShikshaAbhiyan”inKarnatakathroughitsStateOffice.Themainobjectiveofthisschemeisuniversalisation of Elementary Education. 3. REPLACEMENT:

1. It is mandatory that the Agency should replace the services of the DEO’s whoseservices are found to be unsatisfactory by this office and provide suitable andequivalentreplacementwithinsevendaysofinformationbytheauthorizedofficialoverphoneoremail.IftheAgencyfailstoproviderequirednumberofManpowerinthestipulatedperiod,Rs.1000/‐perperson/daywillbeleviedupontheAgencyaspenalty.

2. TheAgency should also replace the service ofDEO’swhoquit the service orwhofailstoattendtheofficeworkregularlyonallworkingdays.Thoseservicesshouldalsobereplacedimmediatelyuponnoticefromtheauthorizedofficialoverphoneoremail.Failingwhich,afterthreedays,Rs.1000/‐perperson/daywillbeleviedupontheAgencyaspenalty.

4. SECURITYDEPOSIT: PerformanceSecurityamountasperprevailingrules(5%ofthetotalannualacceptedtenderamount)shouldbesubmittedtotheSSAOfficebythesuccessfulTendererbeforegettingtheworkorder.5. DURATIONOFCONTRACT5.1 The duration of contract shall be for a period of 12 (Twelve) months only. The

scheduledcommencementdateofcontractshallbefromthedateasindicatedintheMOU.

5.2TheTenderershallbeallowedaperiodof7daysfromthedateofsingingtheMOUtodeploytheDEO’stoSSAOffice.

5.3Notwithstandinganythingcontainedinanyotherclause, theSSAOfficereservesthe

right to terminate the contract due to any failure on the part of the Tenderer indischarging their obligations under the contract or in the event of their becominginsolventorgoingintoliquidation.ThedecisionoftheSSAOfficeaboutthefailureonthepartoftheTenderershallbefinalandbindingontheTenderer.

5.4TheTenderershallgivepriornoticeof3(Three)months toSSA for terminationof

contract.

5.5TheSSAOfficeshallalsohave,withoutprejudicetheotherrightsandremedies,theright,intheeventofbreachbytheTendererofanyofthetermsandconditionsofthecontract, or due to the Tenderer's inability to perform as agreed for any reasonwhatsoever, to terminate the contract forthwithandget theworkdone for theun‐expiredperiodofthecontractattheriskandcostoftheTenderer,andrecoverlosses,damages,expensesorcoststhatmaybesufferedorincurredbytheSSAOffice.ThedecisionoftheStateProjectDirector,SSAaboutthebreach/failureonthepartoftheTenderer shall be final and binding on the Tenderer and shall not be called intoquestion.

5.6TheStateProjectDirector, SSA, also reserves the right to terminate the contract at

any timeduring its currencywithout assigningany reason thereonbygiving threemonths notice in writing to the Tenderer at their last known place of residencebusiness and the Tenderer shall not be entitled to any compensation by reason ofsuch termination. The decision of the State Project Director, SSA,under this clauseshall be final, conclusive and binding on the Tenderer and shall not be called intoquestion.

7.7TheStateProjectDirector,SSA,onexercising theright to terminate thecontractas

above,theTenderershallwithdrawtheservicesoftheDataEntryOperatorsatSSAoffice,withinseven(7)daysfromthedateofofficialtermination.Atthesametime,before withdrawal, the Tenderer should make good of the damages’/loses, if any,causedbytheDEO’satSSAoffice.

6. LABOURLAWS,PROVIDENTFUND,ESI6.1 The Tenderer shall obtain necessary license from the Licensing Authority under the

ContractLabour(Regulation&Abolition)Act,1970andtheCentralRulesframedthereunderandproducethesametoSSA,intheTenderdocument.

6.2 The Tenderer shall not undertake or execute or permit any other agency or sub‐TenderertoundertakeorexecuteanyworkontheTenderer'sbehalfthroughcontractlabour except under and in accordancewith the license issued in that behalf by theLicensingOfficerorotherauthorityprescribedundertheFactoriesActortheContractLabour (Regulation & Abolition) Act, 1970 or any other applicable law, rule orregulation.

6.3 TheEPFratesshouldbeasper theGOI,Ministryof labourandemployment letternoEDL1/24/amendment scheme/2014 Dated 29.08.2014 has to be noted andincorporated.

6.4 The Tenderer shall complywith the provisions of ESI Act and Scheme framed thereunderwith regard toallhisDataEntryOperators involved in theperformanceof theContract, and shall deduct employee's contribution from the remunerationof eachofthe employees and shall deposit the same together with employer's contribution ofsuchtotalremunerationpayabletotheemployeesintheappropriateaccount.Tendererisrequiredtosubmitdocuments/challanstowardsproofofremittancetowardsESIfortheDEO’sengagedforthisworkalongwitheveryRAbill.

6.5 TheTenderershouldcomplywiththerelevantprovisionsoftheEmployeesProvident

FundAct.TheTenderershouldpromptlydepositP.F.deductionoftheeligiblecontractemployees plus the / employers' contribution to the RPFC. For this purpose agencymust submit a certificate in their Bill that PF amount has been deducted from theeligibleemployeesandalongwiththeemployerscontributionhasbeendepositedwithR.P.F.C.Insupportofthis,theagencymustfurnishthechallanreceiptforthepaymentmade to RPFC. All supporting documents / records should bemade available by theTenderertotheOfficeofSSAwhencalledfor.

6.6 AllliabilitiesoftheContract,remunerationandotherstatutoryobligationsinrespectofthe persons engagedby theTenderer shall be borne by theTenderer. In viewof theprovisions of the ESI Act, PF Act and other Acts, the Tenderer shall take necessarystepstocoveritsemployeesunderthesaidenactments/andshallsubmitproofofsuchcompliancetoSSAofficemonthly,oratanydateuponsuchrequest,asmaybemadebySSAofficetotheTenderer.

6.7 The provision of EPF&MPAct, 1952 and theRules / Schemes there under shall beapplicabletotheTendererandtheDateEntryOperatorsengagedbyhimforthework.

7.REMUNERATIONTODATAENTRYOPERATORS1. Sarva Shiksha Abhiyan intends that the candidates posted to work as Data Entry

Operators in the State Project Office should be paid the minimum consolidatedremunerationofRs.11000/‐

2. TheAgencyshallberequiredtopaythemonthlypaymentto thecandidatesasaboveand the Agency can quote their price bids keeping in view of the applicable servicecharges.

3. The Agency will be solely responsible for the provision for any facilities to the

candidatesunderanyofthelawsundertheConstitutionofIndia.4. ThepaymentfortheDataEntryOperatorsforeverycompletedmonthshouldbepaid

onorbefore5thdayof themonthdirectly totheBankAccountof theconcernedDataEntryOperator andnecessary proof of the same should be submitted alongwith thebills.

5. ThenecessaryTaxdeductionswillbeeffectedinthebillsasperrules.

6. Leave facility of One day per each calendar month is allowed to the Data EntryOperators.

7. TheyhavetobeprovidedProvidentFund&Otherstatutorybenefitsaspertheexisting

rulesoftheStateGovernment/CentralGovernmentasapplicable.8. TheTenderershallmakepaymenttotheDEO’sdeployedbyhimonthescheduleddate.

TheTendererhastomaintaintheECsstatement(aquittance)forthepaymentmadetothe personnel deployed as DEO’s. The copy of above proof shall be / enclosed alongwithmonthlyrunningbills.

TheTenderershallbesolelyresponsible todisburseremunerationduepayableto the personnel deployed as DEO’s promptly by 5th day of every month. If theTendererfailstopaytheremunerationtoDEO’swiththerelevantstatutoryprovisions,SSA Office would impose a penalty of Rs.1000/‐day for all the delayed days. Thispenalty period would be for a maximum of 10 days. Beyond this period, SSA officewouldconsiderofcontinuingtheContract.

9. The Tenderer should submit copies returns filed before EPF and / ESI of monthly

remittancestotheSSAOffice,by10thofsubsequentmonthalongwithmonthlyrunningbillsandsubmittheAttendance/ECsstatement(aquittance)fortheDEO’sengaged.

10. The Tenderer shall, whenever required by the SSA Office or Government Officials

authorized under the Statutes, produce for inspection, all forms, registers and otherdocumentsrequiredtobemaintainedundervariousstatutes.

8. PENALTIESFORNON‐REMITTANCEOFPF&ESICONTRIBUTION

Inthecaseofdelay/default inpaymentofcontributionunderESISchemeandEPFScheme besides the recovery of the amounts due by the Tenderer towards theircontribution,penalinterestand/ordamagesasmaybeleviedbytheESIorPFAuthorities,a penalty of 20% of the above amount would also be levied and recovered from theirrunningbills. Intheeventofcessationofthecontractduetoanyreasonwhatsoever, theSecurityDepositwillberefundedonlyafterduesatisfactionasregardsthepaymentofESIandEPFduesbytheTenderer.9. GOVERNMENTANDLOCALRULES

Theapprovalfromanyauthorityrequiredasperstatutoryrulesand/regulationsofCentral/StateGovernmentshallberesponsibilityoftheTenderer.10. FIRSTAID

TheTenderershallprovidenecessaryFirstAidFacilitiestohispersonnel.11. GENERAL11.1TheTenderer shall furnish inwriting the list ofpersons tobedeployedbyhim.He

shallnotengagepersonsbelow18yearsofage.

11.2IfanyoftheworkersemployedbytheTendererisfoundindulginginactssubversiveofdiscipline,thesamewillbebroughttotheknowledgeoftheTendererandheshallarrangeforreplacementofsuchpersonnel.

12. ARBITRATION12.1 Ifanydisputearisingoutof thiscontractshallbesettledasper theArbitrationand

ConciliationAct1996.12.2 In theeventofanydisputeas to the interpretationofanyof theseprovisions, such

disputeshallbesettledthroughmutualnegotiationsorbyappointingasoleArbitratormutuallyagreeduponoranArbitratorfrompanelofArbitratorsofIndianCouncilofArbitration.

12.3IntheeventofareferencemadetoanArbitrator,thedecisionoftheArbitratorshall

befinalandbindingonboththepartiesofthisagreementandshallnotbecalledintoquestion.

12.4 Subject as aforesaid, the Arbitration & Conciliation Act, 1996, shall apply to the

arbitration proceedings under this clause and such arbitration shall take place inBangalore.

12.5TheCostsofandinconnectionwitharbitrationshallbedecidedbytheArbitratorat

hissolediscretion,whomaymakeasuitableprovisionforthesameinhisAward.13. CONSTITUTIONOFTHETENDERER

TheTenderershallnotchangethecompositionduringthecurrencyofthecontractwithoutthepriorapprovaloftheSSAOffice.AnyhappeninglikeDeath!Resignationofanypartner/director/membershallbeintimatedwithin3workingdaysofsuchhappening,inwriting,toSSABangalore.

Onreceiptof suchnotice, theSSAOffice reserves the righteither to terminateor

continuethecontract.Intheeventofanydispute,legalorotherproceedingsbyanypartyor parties concerning the constitution or composition of the Tenderer, the SSA Officereserves the right to take suchnecessary action as it deems fit, including terminationofcontractandwithholdingpaymentsdueoraccruedtotheTenderer.14. SUBLETTINGTheTenderer shall not sublet, transfer or assign the contract or anypart thereofwithoutthepriorwrittenapprovaloftheSSAOffice.15. LAWSGOVERNINGTHECONTRACT TheContractwillbegovernedbytheLawsofIndiainforcefromtimetotimeandasamendedormadefromtimetotime.

16. COMPLIANCEOFSTATUTORYPROVISIONS16.1 The Tenderer shall comply with the provisions of the Minimum remuneration Act

(Central/ State), if applicable and as applicable, Contract Labour (Regulation &Abolition)Act,1970readwiththeCentralContractLabour(Regulation&Abolition)

Rules.1975,ESIAct,1948EmployeesProvidentFundandMiscellaneousProvisionsAct,1952,andanyother lawapplicable for theemploymentofContractServicesasamendedfromtimetotime.

16.2 The Tenderer shall be solely responsible to comply with all Acts, Laws, Rules and

Regulations, as may be applicable from time to time in respect of running of theservices and shall pay all taxes, debts and/or levies as may be levied by theappropriate Government/local bodies and other authorities in this regard, and theTenderer shall indemnify the SSA Office against all claims, loss, damage and coststhereofincaseofanybreachofanyoftheseActs,Laws,RulesandRegulations.

16.3 The Tenderer shall have separate ESI/ EPF code number on their own name and

ensurepromptpaymentandsubmissionofrelatedreturnsontimetotheauthoritiesconcerned and produce documentary evidence to that effect. The Tenderer shouldhave separate EPF and ESI Code numbers for DEO’s. The Tenderer should ensureremittanceofEPFandESI,totherespectiveaccountsoftheindividualDEO’s.SSAreservestherighttochecktherecords.

16.4TheTendererhas tosubmit toRLC'sOfficeby January/ Julyofeveryyear InForm
