PUBLIC UTILITIES COMMISSION OF THE STATE OF CALIFORNIA ENERGY DIVISION

SUBJECT: Establishment of the California Consumer Privacy Act Memorandum Account Pursuant to Decision 19-09-026

In compliance with Decision (D.)19-09-026, Southern California Edison Company (SCE) hereby submits for approval by the California Public Utilities Commission (Commission) the following changes to its tariffs. The revised tariffs are listed on Attachment A and are attached hereto.

PURPOSE

The purpose of this advice letter is to establish Preliminary Statement Part N.64, the California Consumer Privacy Act Memorandum Account (CCPAMA) in accordance with D.19-09-026. SCE will record and track the incremental Operations and Maintenance (O&M) expenses and capital-related revenue requirements associated with capital expenditures for the implementation of California Consumer Privacy Act of 2018.

BACKGROUND

On March 29, 2019, SCE filed Application (A.)19-03-025 to seek authority from the Commission to establish a memorandum account to record and track incremental costs related to compliance with the California Consumer Privacy Act of 2018 (CCPA). The CCPA established by Assembly Bill (AB) 375 and Senate Bill (SB) 1121 was signed into law on June 28, 2018. The effective date of the legislation is January 1, 2020. The CCPA requires utilities upon a consumers’ request, to disclose what data it collects about consumers, to whom their data was disclosed to, provide consumers’ the right to opt out and request deletion (subject to exceptions) of their data.

On September 16, 2019, the Commission issued D.19-09-026, which authorized SCE to establish a memorandum account. Pursuant to Ordering Paragraph (OP) 1 of D.19-09-026, SCE shall submit a Tier 1 advice letter to establish a memorandum account to record and track incremental costs to implement the California Consumer Privacy Act of 2018. The costs may be reviewed for recovery in SCE’s next General Rate Case (GRC) or other ratemaking application. The effective date of the memorandum account shall be March 29, 2019.

PROPOSED TARIFF CHANGES As discussed above, and in accordance with OP 1 of D.19-09-026, this advice letter establishes Preliminary Statement Part N.64, California Consumer Privacy Act Memorandum Account (CCPAMA), to record and track the incremental O&M expenses and capital-related revenue requirements associated with capital expenditures for the implementation of California Consumer Privacy Act of 2018. No cost information is required for this advice letter. This advice letter will not increase any rate or charge, cause the withdrawal of service, or conflict with any other schedule or rule. TIER DESIGNATION

Pursuant to D. 19-09-026, OP 1, this advice letter is submitted with a Tier 1 designation.

EFFECTIVE DATE SCE respectfully requests that this advice letter become effective October 1, 2019, which is the same date as submitted. NOTICE

N. MEMORANDUM ACCOUNTS (Continued) 64. California Consumer Privacy Act Memorandum Account (CCPAMA)

1. Purpose:

The purpose of the California Consumer Privacy Act Memorandum

Account (CCPAMA) is to track incremental costs related to compliance with the California Consumer Privacy Act of 2018 (CCPA), which was signed into law in June 28, 2018. The CCPAMA is effective as of March 29, 2019.

2. Operation of the CCPAMA

SCE shall maintain the CCPAMA by making monthly entries:

a. A debit entry equal to costs required to comply with the CCPA, including, but not limited to:

i. incremental SCE labor,

ii. non-labor costs such as employee training, licensing, and mailing and printing costs, and

iii. technology-related costs.

b. A debit entry equal to the capital-related revenue requirement, which includes depreciation expense, return on rate base at the currently authorized rate of return on rate base and applicable taxes, such as income and ad valorem taxes; and

c. An entry to record interest expense calculated by applying the Interest Rate to the average monthly balance in the CCPAMA.

3. Disposition Procedures:

The disposition of any amounts tracked in the CCPAMA that are incremental to

amounts recovered in SCE’s GRC or any other account shall be established by a Commission decision issued in a subsequent GRC or other ratemaking application.
