Assistant Climate Minister, Greg Combet introduced a Bill to Federal Parliament in March that will require office building owners to disclose their building’s energy rating and lighting efficiency to prospective buyers and tenants The Building Energy Efficiency Disclosure Bill will mean owners of large commercial office buildings – and head tenants sub letting office space – have to provide prospective purchasers and tenants with a building energy efficiency certificate containing the relevant information. Mandatory disclosure obligations will apply to office space covering 2,000 square metres or more. Failure to comply with the proposed disclosure requirements would carry a maximum penalty of $100,000 and misuse of energy information could lead to a maximum two year jail term. “Penalties aside, the proposed legislation is set to change commercial buildings and the way they manage energy use,” comments AE Smith’s CEO, Andrew Permezel, who believes management of existing buildings via retrofitting, service and maintenance will be required to simply remain competitive during the sale or lease process. The Regulatory Impact Statement (RIS) for the Bill says it’s reasonable to estimate there’s a 20 – 30% gap between the average energy performance of the sector and the best performing buildings.

Decades of drills and dance have helped develop strong discipline and team work skills for Karen Kratzmann from the Brisbane AE Smith Service team Participating in Dance Drill sport since the age of five, Brisbane’s Karen Kratzmann’s Dance & Drill team - the Celtic United Precision Drill team - won first place in both the “Set Drill Routine” and the “Precision Drill Routine” in the Australian National Titles for Drill & Dance in April. Competing in four events, Karen’s team also placed 3rd and 4th in their other routines; improving on their result in Sydney last year. AE Smith’s Brisbane Payroll and Administration Assistant, Karen has been involved in the sport for 25 years – a past time that she describes as being dominated by discipline and working as a team. “The practice, discipline and focus on team work from Dance Drill sport is something that translates to my role at AE Smith – it means I focus on how our branch can work to the best of its ability to work as a team”. “Very soon, key decision influencers typically associated with a building sale or lease will also include energy efficiency,” comments Permezel, who adds that six, seven and eight star buildings or equivalent will become the new standard in the future. With so many existing commercial buildings around Australia not NABERS rated (a requirement for building energy efficiency certificates under the new legislation), AE Smith predicts a “rush” on assessment, certification as well as putting in place appropriate retrofit actions to help make commercial buildings more efficient and commercially attractive. “For very practical reasons, it’s important to allow enough time to collate base building data to assess the performance of your building,” adds Permezel, who sites that NABERS ratings require 12 months of continuous data as part of the strict validation and verification protocols. “The introduction of mandatory disclosure will also see current standards of energy efficiency become the norm in Australia,” says Doug Binns General Manager of AE Smith’s newly launched business division. Recently, AE Smith launched Emerald Sustainable Performance – a dedicated energy services business that’s aimed at helping building owners and property managers improve the environmental performance of buildings.

With increasing pressure on owners and operators, Binns believes the time is right to set in place long term strategies for reducing energy use and developing better efficiencies for their building assets: “Energy efficiency is set to become a key selection criteria by tenants and property professionals weighing up the pros and cons during the sale or lease of a building,” comments Binns who envisages a time when buildings with the equivalent of six, seven and even eight stars on the existing NABERS rating scale becomes the standard in the future. “To simply remain competitive with your building asset in the future, far reaching energy efficiency measures will need to be put into place,” adds Binns. While many owners and asset managers are looking to attain their NABERS rating or increase energy efficiencies to prepare for mandatory disclosure legislation, concern is growing around the cost of making such changes. “We’re hearing from building owners concerns over the cost of becoming more energy efficient, but simple and cost effective steps can be put into place to improve a NABERS rating or increase the efficiency of energy use,” says Doug Binns. AE Smith’s very own Stuart Gibson has become the first Australian to finish in the top 12 of the famously gruelling Marathon des Sables running across the Sahara Desert Gibson finished the 250km race in 11th place overall in a time of 25 hrs 31 mins 45 secs on April 19 – losing 18% of his body weight in the process. Gibson’s initial quest was to finish in the top 50, but he far exceeded this goal to become the highest placed Australian in the history of the 25 year long event. Ironically, Gibson’s day job as a Senior Mechanical Engineer for AE Smith sees him design commercial air conditioning systems that ensure comfortable indoor temperatures – a stark contrast to the heat and hellish conditions of the Sahara Desert. In preparation for the Marathon des Sables (MDS), Gibson trained by running between 150km and 180km a week. Gibson was also provided with sponsorship by AE Smith in support of his amazing endurance quest. The challenging endurance race is held each year in the heart of the Sahara Desert, where daytime highs can reach a searing 50 C and night-time lows can plunge to 3 C. This year’s field was the largest ever, with 1031 runners from 43 different countries competing. Competitors ran 250km in just six days. This equates to running a marathon each day in one of the harshest environments on the planet. Runners have to be completely self- sufficient by carrying all of the food and equipment they need to run 250kms in six days, with the exception of a limited ration of race-supplied water that is strictly limited to nine litres per person per day. Gibson also raised $2000 for AE Smith’s nominated charity Ronald McDonald House in his run. “AE Smith really encourages personal fitness as a company and their support of my preparation for the MDS event has been tremendous,” says Stuart. Not one to rest on his laurels... On May 15, after racing 100km across the Blue Mountains National Park, Stuart Gibson (above right) crossed the finish line in equal first place with Andrew Lee to smash the North Face 100 ultra marathon in an astonishing record breaking time of 9 hrs 54 mins 19 secs. This is the first time anyone, anywhere in the world has broken the 10 hr mark for 100 km racing in a North Face 100 event. AE Smith’s Peter Kinsella has been appointed Vice President of international peak body - the Chartered Institution of Building Services Engineers (CIBSE) in London. Peter is the first person from outside of the UK to be appointed a CIBSE Vice President; a role that complements his existing position as the CIBSE Regional Chairman of Australia and New Zealand. His appointment comes at a time when there’s increasing global recognition of the role that buildings can play in reducing a nation’s energy requirements and resultant carbon emissions; and an understanding that lessons learnt from case studies or research in one part of the world can also provide valuable information in other regions of the globe. “The building services industry has slowly been shifting its focus from considering only the lowest initial cost to genuine consideration of the efficiency, comfort and sustainability of the building. Part of this can be attributed to the increased awareness and adoption of rating schemes and part due to the higher prevalence of Public Private Partnerships (PPP) projects, but it’s certainly seen as a good move for the industry and should provide building owners and their occupants with better performing buildings,” comments Peter. With over 10 years at AE Smith leading the Victorian engineering team, Peter is also a Green Star Accredited Professional, a director of ARBS and a NEBB Certified Professional. Peter Kinsella, Engineering Manager of AE Smith Construction Victoria, has been appointed Vice President of the world wide peak body - the Chartered Institution of Building Services Engineers (CIBSE) As the international professional body for the building services profession, CIBSE has a membership of over 17,000 in 87 countries. Kinsella’s appointment as the one of two Vice Presidents complements his role of Regional Chairman for Australian & New Zealand for the same organisation. Also referred to as CHP, or Combined Heat and Power, cogeneration is the use of a heat engine to simultaneously generate both electricity and useful heat from the same fuel (see diagram left). Trigeneration sees an additional step incorporated, with the energy from the same source utilised to also produce cooling through the introduction of high efficiency absorption chillers (see diagram left). Robinson says that while cogeneration itself is not particularly new, there has been a significant increase in acceptance and integration of the technology into Australia’s commercial building market over the past three years. He attributes that largely to factors including rising electricity prices, improvements in absorption chiller technology and – importantly – an increased focus on environmental ratings on all new and future projects. “Environmental ratings are becoming a critical factor in decision making for prospective tenants,” he says. “What we’ve seen with King George Central and Leighton HQ, for example, is a high number of quality tenants being attracted to the development very early, based on the project’s ability to deliver strong NABERS and Green Star Ratings.” “It adds to AE Smith’s recent successes delivering a part cogeneration package for the new Leighton HQ in Brisbane – where building services systems have been designed to achieve the highest quality energy efficiencies,” adds Ashley. Doug Binns, General Manager of AE Smith Emerald Sustainable Performance, says that while cogeneration can seem “a bit like black magic” to some, it is essentially a process of harnessing the wasted energy that results as a by-product of power generation. That ‘waste heat’ is then converted into usable energy through cogeneration or trigeneration, increasing the overall efficiency of the system and resulting in both financial and environmental benefits. “This is also a very sustainable solution in terms of Greenhouse Gas emissions, as there is a high level of fuel substitution between coal-fired electricity off the grid and the natural gas for the ‘cogen’ engine,” says Binns. While conventional thermoelectric systems convert only about one third of the fuel energy into electricity, with the rest lost in the form of heat, cogeneration allows more than 80% of the fuel's energy to be converted into usable energy, reducing emissions from commercial buildings and achieving marked improvements in both NABERS Energy and Green Star Ratings. According to Binns, additional environmental advantages include a dramatic reduction in CO2 production, estimated at up to 50% relative to the same delivered energy produced by electricity from coal. “With the imminent introduction of the Federal Government’s Mandatory Disclosure legislation (see page 2 for more information), the environmental performance of commercial properties will be paramount, and we are in a position to deliver real results for our clients in terms of energy efficiency and overall environmental performance,” he says. AE Smith has been appointed by Thiess Degrémont Joint Venture to deliver all mechanical services for stage one the $3.5 billion Victorian Desalination Project The Project is the largest seawater desalination plant currently being developed in Australia and represents the largest public sector investment in water infrastructure in Australia’s history. It will supply up to 150 gigalitres (GL) of water a year to Melbourne, Geelong and, via other connections, South Gippsland and Western Port towns, with the capacity to upgrade to supply up to 200 GL in future. The Project’s production capacity represents approximately one third of Melbourne’s annual water usage from a source that is entirely independent of rainfall. As of November 2009, the Project is the world’s largest Public Private Partnership (PPP) project undertaken in the last 12 months. The Project will be delivered by the AquaSure consortium, comprising Degrémont SA, Suez Environnement, Thiess Pty Ltd and Macquarie Group, in partnership with the Capital Projects Division of the Department of Sustainability and Environment. Partner of First Choice for Desalination

Desalination turns sea water into drinking water by removing the salt and other impurities through a treatment process. The water produced for Melbourne will need to meet strict Australian Drinking Water Guidelines and Department of Human Services requirements. Melbourne Water’s preliminary design for the plant includes tunnels under the coast to move the seawater to the plant and an 85 kilometre pipeline to connect the plant to the water supply network. Healthy body and mind creating great workplaces AE Smith’s Brisbane office is turning to a fitness program to help boost morale, develop team work and encourage work-life balance. “It’s all very well for companies to say they encourage work life balance, but AE Smith really make that happen,” says Martin Ross, Manager, Special Projects - who’s spearheading the Combat Conditioning program for the AE Smith Brisbane Construction team. Twenty six employees are participating in regular training sessions that focus on team based exercises, delivered by corporate physical conditioning experts, Executive Excellence. Some sessions involve coaching from ex SAS and military personnel. “Improving our fitness really helps increase energy levels both at work and home,” adds Martin, who believes a fit body and mind also helps deal with challenges faced in the workplace. But it’s not just within the AE Smith office where Martin is seeing the benefits of this strategy: “Our teams are definitely working better together, so they bring this collaborative and united approach to our customers,” adds Martin, who believes the fitness program is helping shape a positive and energetic corporate culture amongst the Brisbane AE Smith team. The Combat Conditioning program offered to AE Smith Brisbane employees is amongst several other health and fitness initiatives being support by AE Smith around the country. AE Smith is bursting with pride at the recognition garnered by two of its plumbing apprentices in the recent Awards Night at Holmesglen College of TAFE in Melbourne Held on May 13th, the Awards Night saw 1st Year Apprentice, Steven Cole (above centre) awarded Best Certificate II Mechanical Services 2009 in the trade of plumbing, while AE Smith 3rd Year Apprentice, David Jones (above right) took home the award for Best Second Year Mechanical Plumbing Apprentice 2009, also in the trade of plumbing. Both David and Steven were recruited by AE Smith from the pre-apprenticeship program at Holmesglen in 2008 and 2009 respectively, after having completed work experience on a range of projects with the company as part of the program. Both were in their twenties when they decided to pursue their interest in the mechanical services industry, having previously been involved in other careers. AE Smith completes re-launch of its successful CZH2 series AE Smith has continued to build on it’s very positive safety record this year with the lowest ever incidence of injury rates, and a continuation of the positive behaviour that is demonstrated in the volume of ‘near miss’ events reported. “Hearing about ‘near miss events’ is a breath of fresh air, says National Safety Manager,” Danny O’Reilly, “It give us the opportunity to build these events into a learning opportunities and that in turn assists us to prevent any reoccurrence at any of our workplaces across Australia. When AE Smith has the direct responsibility for 700+ employees and hundreds more consultants and subcontractors we see that every opportunity to avert risk to our health and safety is a big one.” In 2006, AE Smith launched the Commitment to Zero Harm (CZH) program which involved a presentation being delivered to every employee that was targeted at triggering a change in our attitude towards safety. In CZH, every employee was asked to identify and commit to an initiative that would improve their safety, and that of their mates, in the workplace. This program has proved to be the cornerstone to the progress that has been achieved in workplace health and safety in AE Smith to date. However, keeping everyone’s focus on the continuous improvement aspects of “their health and safety” is a major challenge. In the previous edition of Cool Breeze we indicated that there was to be a follow-up to the initial CZH program.

The Pedal Power Generator Race collectively produced more than 7,500 watt hours over the course of the conference. What turned into a highly competitive battle to generate the most watt hours per race was ultimately won by representatives from Thylacine Cycles, closely followed by Lend Lease. In addition to AE Smith’s innovative pedalling initiative, the Green Cities Conference called on delegates for urgent action, with attendees moving on from last year’s world financial woes to focus instead on developing strategies around renewable energy. The focus of the conference also turned to looking beyond the performance of individual buildings to a broader vision of sustainable communities, with keynote speaker and US green building expert, Jerry Yudelson summing up the biggest challenge currently facing sustainable buildings in the title of his address: “If it doesn’t perform it isn’t green.” “Underperformance destroys the validity of the green building promise,” he said. “Why should governments put faith in green buildings without evidence of their performance?” “Without performance reporting we don’t know anything. What gets measured gets managed,” Yudelson said. Australian experts agreed that building performance is a pressing problem and considerable improvement is needed, with GBCA’s chief executive, Romilly Madew, emphasising: “We have to act now. There is no excuse any more for new developments not to.” AE Smith CEO, Andrew Permezel said the adventurous Pedal Power initiative highlighted AE Smith’s commitment to urgent action on environmental sustainability issues, while also emphasising the importance of these issues to a broader audience through an approachable and attention-grabbing installation. “We know the pathway to an energy efficient future is going to be an uphill challenge for all businesses and industries,” Mr Permezel said. AE Smith draws on pedal power to highlight Green Cities messages AE Smith again stepped up this year to support the 2010 Green Cities Conference, held at the Melbourne Convention and Exhibition Centre on February 22nd and 23rd. Australia’s pre-eminent annual conference focusing on sustainability for the built environment, the Green Cites Conference is a joint initiative of the Green Building Council of Australia (GBCA) and the Property Council of Australia (PCA) and explores new ideas in sustainable building, forges connections and launches new products and technologies. As a major sponsor of the event for the third year running, AE Smith this year asked more than 200 employees, clients and friends to swap their business suits for bike wear to highlight the importance of energy efficiency to Green Cities delegates in a series of virtual cycling ‘races’. Dubbed the AE Smith Pedal Power Generator Race, the inaugural concept aimed to spotlight the effort required to be energy efficient by encouraging people to help generate power via a special bicycle generator station, which operated throughout the two day conference. Pitting teams of four against one another in a series of exercise bike battles, AE Smith undertook to not only provide a Business Centre & Internet Cafe for the major green event, but to create the power to run it by harnessing the watt hours generated by the more than 30 teams.

This program, titled CZH2, was commissioned by AE Smith CEO Andrew Permezel and was directed at extending the pace of change to our attitude to the extent that it would preclude us from accepting anything less than 100% when it come to systems, culture, and behaviours in relation to safety. The feedback from the sessions that were delivered to all employees, and many of our customers and subcontractors was extremely positive and the success of the CZH2 program is largely due to the contribution of the main presenter, Fred Delahunty. Through Fred’s experiences, gained from a lifetime in the electrical maintenance industry in pulp and paper mills in New Zealand, he was able to demonstrate the pitfalls of poor culture in the workplace, and the graphic results that come to bear when a company’s systems and culture denigrate to the point where critical failures result in injuries and human damage. Fred’s awareness of practical situations, coupled with his genuine interest in improving everyone’s attitude were tremendous assets to this program. CZH2 took the path of establishing links to the initial CZH program, flagging the areas in which we have triumphed, and clearly identifying the areas which we still need to improve. AE Smith’s reputation for delivering high quality projects from design phase to final commissioning has resulted in a unique contract with John Holland Constructions A new coal loading system at Abbot Point in Bowen, Queensland that required specialist ventilation systems is the latest project of the South East Queensland AE Smith Construction team that saw them involved from initial design and construction through to installation on site. Contracted by John Holland Constructions on behalf of the Ports Corporation of Queensland, AE Smith’s design brief was to design and install a ventilation system for the coal loader’s electrical switch room and transformer room that could be maintained at a constant temperature. “The electrical switch room contains all the equipment to drive every operating function of the loader, so maintaining a constant temperature to ensure nothing over heats and fails was a vital component of the project,” says AE Smith Project Manager, Michael O’Farrell. AE Smith was also involved in the assembly process of the coal loader, which was created from scratch in a ship building yard in Brisbane, with all of the components for the machine delivered to a holding yard and fully assembled on site.

The Pedal Power Generator Race collectively produced more than 7,500 watt hours over the course of the conference. What turned into a highly competitive battle to generate the most watt hours per race was ultimately won by representatives from Thylacine Cycles, closely followed by Lend Lease. In addition to AE Smith’s innovative pedalling initiative, the Green Cities Conference called on delegates for urgent action, with attendees moving on from last year’s world financial woes to focus instead on developing strategies around renewable energy. The focus of the conference also turned to looking beyond the performance of individual buildings to a broader vision of sustainable communities, with keynote speaker and US green building expert, Jerry Yudelson summing up the biggest challenge currently facing sustainable buildings in the title of his address: “If it doesn’t perform it isn’t green.” “Underperformance destroys the validity of the green building promise,” he said. “Why should governments put faith in green buildings without evidence of their performance?” “Without performance reporting we don’t know anything. What gets measured gets managed,” Yudelson said. Australian experts agreed that building performance is a pressing problem and considerable improvement is needed, with GBCA’s chief executive, Romilly Madew, emphasising: “We have to act now. There is no excuse any more for new developments not to.” AE Smith CEO, Andrew Permezel said the adventurous Pedal Power initiative highlighted AE Smith’s commitment to urgent action on environmental sustainability issues, while also emphasising the importance of these issues to a broader audience through an approachable and attention-grabbing installation. “We know the pathway to an energy efficient future is going to be an uphill challenge for all businesses and industries,” Mr Permezel said. AE Smith has been appointed by Thiess Degrémont Joint Venture to deliver all mechanical services for stage one the $3.5 billion Victorian Desalination Project The Project is the largest seawater desalination plant currently being developed in Australia and represents the largest public sector investment in water infrastructure in Australia’s history. It will supply up to 150 gigalitres (GL) of water a year to Melbourne, Geelong and, via other connections, South Gippsland and Western Port towns, with the capacity to upgrade to supply up to 200 GL in future. The Project’s production capacity represents approximately one third of Melbourne’s annual water usage from a source that is entirely independent of rainfall. As of November 2009, the Project is the world’s largest Public Private Partnership (PPP) project undertaken in the last 12 months. The Project will be delivered by the AquaSure consortium, comprising Degrémont SA, Suez Environnement, Thiess Pty Ltd and Macquarie Group, in partnership with the Capital Projects Division of the Department of Sustainability and Environment. The water produced for Melbourne will need to meet strict Australian Drinking Water Guidelines and Department of Human Services requirements. Also referred to as CHP, or Combined Heat and Power, cogeneration is the use of a heat engine to simultaneously generate both electricity and useful heat from the same fuel (see diagram left). Trigeneration sees an additional step incorporated, with the energy from the same source utilised to also produce cooling through the introduction of high efficiency absorption chillers (see diagram left). Robinson says that while cogeneration itself is not particularly new, there has been a significant increase in acceptance and integration of the technology into Australia’s commercial building market over the past three years. He attributes that largely to factors including rising electricity prices, improvements in absorption chiller technology and – importantly – an increased focus on environmental ratings on all new and future projects. “Environmental ratings are becoming a critical factor in decision making for prospective tenants,” he says. “What we’ve seen with King George Central and Leighton HQ, for example, is a high number of quality tenants being attracted to the development very early, based on the project’s ability to deliver strong NABERS and Green Star Ratings.” “It adds to AE Smith’s recent successes delivering a part cogeneration package for the new Leighton HQ in Brisbane – where building services systems have been designed to achieve the highest quality energy efficiencies,” adds Ashley. Doug Binns, General Manager of AE Smith Emerald Sustainable Performance, says that while cogeneration can seem “a bit like black magic” to some, it is essentially a process of harnessing the wasted energy that results as a by-product of power generation. That ‘waste heat’ is then converted into usable energy through cogeneration or trigeneration, increasing the overall efficiency of the system and resulting in both financial and environmental benefits. “This is also a very sustainable solution in terms of Greenhouse Gas emissions, as there is a high level of fuel substitution between coal-fired electricity off the grid and the natural gas for the ‘cogen’ engine,” says Binns. While conventional thermoelectric systems convert only about one third of the fuel energy into electricity, with the rest lost in the form of heat, cogeneration allows more than 80% of the fuel's energy to be converted into usable energy, reducing emissions from commercial buildings and achieving marked improvements in both NABERS Energy and Green Star Ratings. According to Binns, additional environmental advantages include a dramatic reduction in CO2 production, estimated at up to 50% relative to the same delivered energy produced by electricity from coal. “With the imminent introduction of the Federal Government’s Mandatory Disclosure legislation (see page 2 for more information), the environmental performance of commercial properties will be paramount, and we are in a position to deliver real results for our clients in terms of energy efficiency and overall environmental performance,” he says. AE Smith’s very own Stuart Gibson has become the first Australian to finish in the top 12 of the famously gruelling Marathon des Sables running across the Sahara Desert Gibson finished the 250km race in 11th place overall in a time of 25 hrs 31 mins 45 secs on April 19 – losing 18% of his body weight in the process. Gibson’s initial quest was to finish in the top 50, but he far exceeded this goal to become the highest placed Australian in the history of the 25 year long event. Ironically, Gibson’s day job as a Senior Mechanical Engineer for AE Smith sees him design commercial air conditioning systems that ensure comfortable indoor temperatures – a stark contrast to the heat and hellish conditions of the Sahara Desert. In preparation for the Marathon des Sables (MDS), Gibson trained by running between 150km and 180km a week. Gibson was also provided with sponsorship by AE Smith in support of his amazing endurance quest. The challenging endurance race is held each year in the heart of the Sahara Desert, where daytime highs can reach a searing 50 C and night-time lows can plunge to 3 C. This year’s field was the largest ever, with 1031 runners from 43 different countries competing. Competitors ran 250km in just six days. This equates to running a marathon each day in one of the harshest environments on the planet. Runners have to be completely self- sufficient by carrying all of the food and equipment they need to run 250kms in six days, with the exception of a limited ration of race-supplied water that is strictly limited to nine litres per person per day. Gibson also raised $2000 for AE Smith’s nominated charity Ronald McDonald House in his run. “AE Smith really encourages personal fitness as a company and their support of my preparation for the MDS event has been tremendous,” says Stuart. “Very soon, key decision influencers typically associated with a building sale or lease will also include energy efficiency,” comments Permezel, who adds that six, seven and eight star buildings or equivalent will become the new standard in the future. With so many existing commercial buildings around Australia not NABERS rated (a requirement for building energy efficiency certificates under the new legislation), AE Smith predicts a “rush” on assessment, certification as well as putting in place appropriate retrofit actions to help make commercial buildings more efficient and commercially attractive. “For very practical reasons, it’s important to allow enough time to collate base building data to assess the performance of your building,” adds Permezel, who sites that NABERS ratings require 12 months of continuous data as part of the strict validation and verification protocols. “The introduction of mandatory disclosure will also see current standards of energy efficiency become the norm in Australia,” says Doug Binns General Manager of AE Smith’s newly launched business division. Assistant Climate Minister, Greg Combet introduced a Bill to Federal Parliament in March that will require office building owners to disclose their building’s energy rating and lighting efficiency to prospective buyers and tenants The Building Energy Efficiency Disclosure Bill will mean owners of large commercial office buildings – and head tenants sub letting office space – have to provide prospective purchasers and tenants with a building energy efficiency certificate containing the relevant information. Mandatory disclosure obligations will apply to office space covering 2,000 square metres or more. Failure to comply with the proposed disclosure requirements would carry a maximum penalty of $100,000 and misuse of energy information could lead to a maximum two year jail term. “Penalties aside, the proposed legislation is set to change commercial buildings and the way they manage energy use,” comments AE Smith’s CEO, Andrew Permezel, who believes management of existing buildings via retrofitting, service and maintenance will be required to simply remain competitive during the sale or lease process. The Regulatory Impact Statement (RIS) for the Bill says it’s reasonable to estimate there’s a 20 – 30% gap between the average energy performance of the sector and the best performing buildings.
