No. 429786-T) 1 AGENCY AGREEMENT  AN AGREEMENT made the day of  20 BETWEEN Hwang Investment Management Berhad (Company No. 429786T), a company incorporated in Malaysia and having its registered office at Level 8, Wisma Sri Pinang, 60 Green Hall, 10200 Penang and its business address at Suite 11-01, 11 th  Floor, Menara Keck Seng, 203 Jalan Bukit Bintang, 55100 Kuala Lumpur (hereinafter called “the Company” ) of the one part and __________ NRIC No/Passport No. of (hereinafter called “the Consultant”) WHEREAS :-  A. The Company is approved or otherwis e licensed t o establish unit trus t funds (hereinafter referred to as the “Trust Fund”) where the Trust Fund or the units in respect of the Trust Fund have been or shall have been duly approved by the Securities Commission and other regulatory authorities in Malaysia. B. The Consultant is registered with and authorised by the Federation of Investment Managers Malaysia ("FiMM") as a person dealing in unit trusts to market and/or distribute units. C. The Company is desirous of appointing the Consultant, a nd the Consultant is desirous of being appointed as a non- exclusive consultant for the Company for the marketing and distribution of units comprised in the Trust Fund (hereinafter collectively called “the Units” and individually called “a Unit”) subject to the following terms and conditions.  NOW IT IS HEREBY AGREED as follows :- 1. Appointment of Consultant The Company hereby appoints the Consultant and the Consultant hereby accepts the appointment to act as a non- exclusive consultant for the Company to market and/or distribute the Units and to canvass for sales of the Units. The Consultant agrees and undertakes to use his best endeavours to maintain and increase the sale of the Units and to represent properly the interests of the Company. All sales by the Consultant shall be made on such terms and conditions as the Company shall from time to time stipulate. 2. Company Representative  Any notice, instruction, consent, authority or discretion required by this Agreement to be given or exercised by the Company may be fully and effectively given or exercised on behalf of the Company by any one of the following persons namely, a Director, the Chief Executive Officer, the Chief Sales Officer, the Head of UTCB and an Attorney of the Company for the time being (hereinafter collectively called “the Company Representatives and individually “a Company Representative”).  3. Compliance with Regulations The Consultant shall be deemed to have knowledge of the contents of the Prospectus, Information Memorandum (hereinafter called “the Offering Documents”) and the Trust Deed entered into by the Company with the respective Trustees in respect of the Trust Fund and their supplement (if any) and shall maintain knowledge of, and comply with all applicable laws, rules and regulations governing the unit trust industry, including but not limited to the Minimum Standards for Registration of Persons Dealing in Unit Trusts and the Code of Ethics and Standards of Professional Conduct issued by the Securities Commission as set out in Schedule 1 hereto. 4. Conflict of Interest The Consultant shall not, without obtaining the prior consent in writing of the Company, be directly or indirectly involved in distribution, marketing or otherwise interested or concerned or associated in or with any other unit trust scheme or other form of investment scheme save and except for the Trust Fund. 5. Authorisation Card The Consultant shall at all times have in his possession a valid card issued by FiMM (hereinafter called “the Authorisation Card”) and the Consultant shall disclose to a prospective investor that he is registered with FiMM to market and distribute the Units, and shall also produce his Authorisation Card to identify himself. The Consultant shall use the Authorisation Card only for the purpose of identifying himself as a consultant of the Company and not for any other purpose. 6. Advertisements The Consultant shall not publish or circulate any information, advertisement, pamphlet or other form of printed material or via electronic devices concerning the Company, the Trust Fund or the Units (hereinafter called "Advertising and/or Promotional Materials") unless they have been approved by the Company and the Securities Commission. The Consultant shall only use Advertising and/or Promotional Materials supplied by the Company and the Consultant shall not amend, alter, modify, delete, add or caused any such acts to be done to the same. 7. Rebates and Reductions The Consultant shall not directly or indirectly offer or pay or caused to be paid or allow any rebate or discount or make any inducement whatsoever in relation to the marketing and/or distribution of the Units unless otherwise authorised by the Company. The Consultant shall not make any misrepresentation or inaccurate or false statements for the purpose of inducing any person to purchase any Unit or for any other purpose whatsoever. UTC Code: Rank:

AGENCY AGREEMENT

 AN AGREEMENT made the day of   20 BETWEEN Hwang Investment Management Berhad (Company No.

429786T), a company incorporated in Malaysia and having its registered office at Level 8, Wisma Sri Pinang, 60 Green Hall, 10200

Penang and its business address at Suite 11-01, 11th Floor, Menara Keck Seng, 203 Jalan Bukit Bintang, 55100 Kuala Lumpur

(hereinafter called “the Company”) of the one part and __________

(hereinafter called “the Consultant”) 

WHEREAS :-

 A. The Company is approved or otherwise licensed to establish unit trust funds (hereinafter referred to as the “Trust Fund”)

where the Trust Fund or the units in respect of the Trust Fund have been or shall have been duly approved by theSecurities Commission and other regulatory authorities in Malaysia.

B. The Consultant is registered with and authorised by the Federation of Investment Managers Malaysia ("FiMM") as aperson dealing in unit trusts to market and/or distribute units.

C. The Company is desirous of appointing the Consultant, and the Consultant is desirous of being appointed as a non-exclusive consultant for the Company for the marketing and distribution of units comprised in the Trust Fund (hereinaftercollectively called “the Units” and individually called “a Unit”) subject to the following terms and conditions.  

NOW IT IS HEREBY AGREED as follows :-

1. Appointment of ConsultantThe Company hereby appoints the Consultant and the Consultant hereby accepts the appointment to act as a non-exclusive consultant for the Company to market and/or distribute the Units and to canvass for sales of the Units. The

Consultant agrees and undertakes to use his best endeavours to maintain and increase the sale of the Units and torepresent properly the interests of the Company. All sales by the Consultant shall be made on such terms and conditionsas the Company shall from time to time stipulate.

2. Company Representative Any notice, instruction, consent, authority or discretion required by this Agreement to be given or exercised by the

Company may be fully and effectively given or exercised on behalf of the Company by any one of the following personsnamely, a Director, the Chief Executive Officer, the Chief Sales Officer, the Head of UTCB and an Attorney of theCompany for the time being (hereinafter collectively called “the Company Representatives and individually “a Company

Representative”). 

3. Compliance with Regulations

The Consultant shall be deemed to have knowledge of the contents of the Prospectus, Information Memorandum

(hereinafter called “the Offering Documents”) and the Trust Deed entered into by the Company with the respectiveTrustees in respect of the Trust Fund and their supplement (if any) and shall maintain knowledge of, and comply with all

8. Professional ConductThe Consultant shall at all times act with honesty, dignity and integrity. The Consultant shall conduct all his dealings with

care, skill and diligence, and shall avoid any aggressive and offensive sales practices. The Consultant shall take allreasonable steps to give the prospective investor information in a comprehensive, full and fair manner to assist him inmaking a balanced and informed decision, ensure as far as possible that the Trust Fund scheme proposed is suitable to

the needs and not beyond the resources of the prospective investor and to provide prompt, efficient and continuousservice to his clients and their beneficiaries.

9. Payment All monies received by the Consultant on behalf of the Company shall be remitted in full immediately to the Company or tobe credited directly to the Company’s account through any bank authorised by the Company to receive such payment on

its behalf. The Consultant shall have no authority whatsoever to collect or receive money or to issue receipts in respect

thereof unless otherwise authorised in writing by the Company.

10. Consultant’s Covenants The Consultant hereby covenants with the Company as follows :-

10.1 to familiarize himself with the provisions of the Trustee Act 1949, Securities Commission Act 1993 and anysubsidiary legislations there under and any amendment, re-enactment or recertification of such Acts orsubsidiary legislations;

10.2 to comply with all statutory and regulatory requirements (whether or not having the force of law) applicable tohim (including but not limited to the Guidelines on Marketing and Distribution of Unit Trusts and the Code ofEthics and Standards of Professional Conduct issued by the Securities Commission and any amendment or

revision thereof and such rules and regulations in relation to the Trust Fund);

10.3 to market and/or distribute Units with the prospectus of the relevant Trust Fund;

10.4 to inform the Company forthwith of any information received by him which is relevant to the sale or purchase of

the Units or is likely to affect the business of the Company;

10.5 to undergo training and attend sales seminars as and when specified or required by the Company and tocomplete the said training;

10.6 to comply with the provisions of the Trust Deed and Offering Documents where applicable;

10.7 at all times to act honestly and to work diligently to protect and promote the interests of the Company;

10.8 at all times diligently and use reasonable best efforts to promote and procure sales of the Units by appropriate

means;

10.9 to observe the rules, guidelines and instructions issued by the Company from time to time in relation to the

marketing and/or distribution of the Units and to comply with any code of ethics and standards of professionalconduct that may be issued by the Company;

10.10 in communicating information on loan financing for Units, to provide full and frank disclosure without omittingany material fact, to only release factual information and to explain clearly the risks of leveraging to theprospective investor and, to the best of his ability, ensure that the prospective investor understands the risks

before investing;

10.11 to promptly notify the Company of and deliver to the Company all applications for the purchase and any other

type of dealings in relation to the Units but shall have no authority to confirm the Company's acceptance of suchapplications and other type of dealings in relation to the Units as aforesaid;

10.12 to promptly pay all fees, subscriptions and payments levied by the Company, FiMM and regulatory authorities.

11. Negative Covenants

The Consultant shall not:

11.1 incur any liability or debt in the name of the Company;

11.2 make or alter or discharge any contracts or agreements in the name of the Company;

11.3 make any kind or form of representations or give any warranties and/or undertakings or indemnities whetherdirectly or indirectly in relation to the Trust Fund unless otherwise authorised by the Company in writing;

11.4 negotiate or enter into contracts agreements or transactions on behalf of the Company unless otherwiseauthorised by the Company in writing;

11.5 delegate and/or appoint any person to perform any of the duties and obligations of the Consultant without theprior consent of the Company;

11.6 market and/or distribute units without an Offering Document of the relevant Trust Fund;

11.7 misrepresent his qualifications or that of the Company, or the Trust Fund and/or its characteristics, and the past

investment performances of the Trust Fund;

11.8 make any false, misleading, inaccurate, exaggerated or unwarranted statement or claim or omit a material factor any forecasts of future events or do or caused to be done or omit to do any act, the omission of which is likely

to expose the Company to any liability whatsoever;

11.9 do any act or make any statement which may bring the Trust Fund or the Company or any other company or

society or entity into disrepute or to make libelous or slanderous statements against any person or company;

11.10 describe himself as consultant or representative of the Company except as expressly authorized by this

 Agreement;

11.11 encourage, directly or indirectly the sale of Units through loan financing.

12. ConfidentialityThe Consultant shall treat this Agreement and the contents hereof and all applications for the sale and purchase

transactions of the Units and all other transactions pertaining to the  Units and such other information relating to theCompany, the Trust Fund, the investor(s) or the unitholder(s) and their account(s) confidential. The Consultant shall not inany way use such information for his personal or another person's gain, nor shall he at anytime during the subsistence of

this Agreement or after its termination disclose reveal divulge such information to any person whosoever unless the priorwritten consent of the Company has been obtained.

13. Remuneration

13.1 In consideration of the Consultant procuring from an investor an application for the purchase of Units in the

Trust Fund which is accepted by the Company and PROVIDED ALWAYS THAT there is no cancellation of thesale, the Company shall pay the Consultant commission and other incentives in accordance with theRemuneration Scheme as specified in Schedule 3 and any amendments thereto made by the Company and

notified to the Consultant to be in force from time to time. For avoidance of doubt, the Company shall reservesthe rights in its absolute discretion to reject in whole or in part such application submitted by the Consultant forand on behalf of the investors.

13.2 The Consultant shall cease to be entitled to any commission, incentive or other payment under this Agreementor accruing on any sale effected through him upon the termination of this Agreement.

13.3 Notwithstanding clause 13.1, in the event of any cancellation of any sale (whether or not due to the investorexercising his Cooling-Off right) effected through the Consultant resulting in the refund of any payment or

installments to the investor of the Units, the Consultant shall refund to the Company any remunerationcommission and/or other incentive which he has received in respect of such a sale within 7 days fromnotification by the Company. The Company is hereby authorised by the Consultant to make deduction from the

Consultant's commission account for such amount as is necessary.

14. Postal and Other Charges

The Consultant shall pay all charges and expenses for postage of letters and transmission of parcels posted ortransmitted by him and all charges of every nature or kind incidental to the performance of his obligations and functionshereunder.

15. Sales Promotion MaterialsThe Company shall supply the Consultant with such number of advertising/promotional materials as the Company

considers reasonably sufficient with a view to promoting sales of the Units. The costs and expenses of suchadvertising/promotional materials shall be borne by the Consultant.

16. Directives

The Company shall be entitled to issue circulars and directives to the Consultant relating to the activities by theConsultant or his conduct and the Consultant shall observe and comply with such circulars and directives at all timesduring the term of this Agreement.

17. Maintenance of RecordsThe Consultant shall keep full and accurate record and statement of all transactions in such books and/or documents and

in such manner as the Company and/or the regulatory authorities of Malaysia may from time to time require. TheConsultant shall make available such books and/or documents at all times for inspection by the representatives of theCompany or such person or persons as are authorised by the Company and shall immediately upon any demand from

time to time made by the Company and/or the regulatory authorities of Malaysia deliver such books and/or documents tothe Company and/or the regulatory authorities of Malaysia (as the case may be). The Consultant shall immediately upon

the termination of this Agreement deliver the books/or documents into the possession and custody of the Company.

18. Termination18.1 This Agreement shall be terminated immediately :-

18.1.1 upon the death of the Consultant; or

18.1.2 upon the Consultant becoming mentally unsound in such a manner as to render the Consultantincapable of carrying out or performing his duties, responsibilities or requirements as contemplatedhereunder; or

18.1.3 in the event the Consultant is de-registered or is not duly registered and authorised by the FiMM tomarket distribute and/or sell the units; or

18.1.4 upon the Company becoming insolvent.

18.2 Notwithstanding the above, the Company shall be entitled at its sole absolute discretion to terminate this Agreement and/or suspend the service of the Consultant with immediate effect by notice in writing to the

Consultant :-

18.2.1 upon the Consultant committing an act of bankruptcy or being adjudicated bankrupt or declared a

bankrupt or entered into any composition or arrangement with his creditors;

18.2.2 upon the breach of any of the provisions of this Agreement by the Consultant;

18.2.3 upon the Consultant failing to satisfy the Minimum Standards for Registration of Persons Dealing inUnit Trusts issued by the Securities Commission;

18.2.4 upon the Consultant failing to comply with all the provisions of the Code of Ethics and Standards ofProfessional Conduct;

18.2.5 upon the failure of the Consultant to meet the training, production or other requirements in respect ofthe Consultant’s operations which may be stipulated by the Company from time to time; or  

18.2.6 upon the Consultant sharing or giving a rebate on his commission (or part thereof) with any personwithout prior written consent of the Company.

18.3 This Agreement may also be terminated :-

18.3.1 by either party giving the other not less than fourteen (14) days notice in writing of its/his intention toterminate this Agreement whether with or without cause; or

18.3.2 by mutual agreement in writing,

without prejudice to the rights and obligations of either party against the other for any antecedent breach

accrued or incurred prior to such termination.

18.4 Upon the termination of this Agreement for whatsoever reason, the Consultant shall deliver to the Company his

 Authorisation Card and all monies, documents and other effects and property belonging to the Company orrelating to the performance of the obligations and functions of the Consultant hereunder and the Consultantshall no longer identify himself as the Consultant of the Company.

19. Lien and Set OffThe Consultant hereby irrevocably agrees and authorises the Company to withhold (at the Company’s absolute

discretion) all or any part of sums payable by the Company to the Consultant under this Agreement and may apply thesame towards the settlement of such indebtedness due from the Consultant to the Company. For the avoidance of doubt,the Company shall have a first lien upon all sums payable by the Company to the Consultant under this Agreement to

secure any indebtedness from the Consultant to the Company and may apply such sums directly towards the liquidationof such indebtedness and the setting off shall not create a cause of action against the Company.

20. TenureThis Agreement shall commence from the date hereof and shall remain in force and effect until terminated in accordancewith clause 18 hereof or by operation of law.

21. Entire Agreement This Agreement and the schedules hereto and amendments thereto notified in writing by the Company to the Consultantto be in force from time to time contain the entire agreement and understanding between the Company and the

Consultant with respect to all matters which are referred to and supersedes and cancels any and all previous agreementswritten or otherwise whatsoever between the parties hereto.

22. VariationThe Company shall be entitled by notice in writing to the Consultant to vary the provisions of this Agreement and theschedules hereto. Such variations shall come into force from the date stipulated in such notice as being the effective date

of such variations.

23. Acquiescence

Knowledge or acquiescence by the Company hereto of the breach of any covenants and undertakings ormisrepresentation herein contained shall not operate as or be deemed to be a waiver of such covenants, undertakings,

warranties, representations or any of them and notwithstanding such knowledge or acquiescence, the Company shall beentitled to exercise its rights under this Agreement and to require strict performance by the Consultant of the terms andconditions herein.

24. Relationship and IndemnityThe relationship between the Company and the Consultant shall be strictly that of principal and consultant and not that ofemployer and employee Provided Always that the Consultant shall not act as consultant of the Company, save as in the

manner expressly authorised by this Agreement and/or agreed in writing by the Company. The Consultant agrees toindemnify and keep indemnified the Company against any losses, damages, costs, claims demand and expenses(including legal cost on client and solicitors basis) whatsoever arising from or in connection with a breach of this

 Agreement by the Consultant or the appointment by the Company hereunder.

25. Limitation to the Agency Notwithstanding anything to the contrary contained in this Agreement, the appointment of the Consultant under this

 Agreement as consultant for the Company to sell Units shall only extend to such Units in so far only as the Consultant isauthorised to act as an consultant for the Company in the sale thereof.

26. Notices Any notice or consent required to be given under this Agreement shall be in writing and may be served personally or bypost or telex or facsimile transmission addressed to the party at its/his address shown on the first page of this Agreement

or such other address as may from time to time be notified in writing by the addressee to the other party. Any such noticeshall be deemed to have been given when

(a) if hand delivered when delivered;

(b) if sent by post two (2) days after the same has been posted notwithstanding that it may have been returned by

the post undelivered; and

(c) if given by telex or facsimile transmission at the same time as it is despatched.

Each party shall give notice to the other of any change of its/his address at the earliest possible opportunity.

27. Compliance with Personal Data Protection Act 2010 (“Act”) 

27.1 The Consultant hereby confirms that he has read and understood the Manager’s Privacy Notice in Schedule 2herein and unconditionally consents to the processing of his personal data in accordance to the said Privacy

Notice.

27.2 The Consultant shall ensure that it fully complies with the provisions of the Act and shall only process personal

data of investors to fulfil its obligation under this Agreement.

27.2 The Consultant will indemnify and keep indemnified the Manager against all claims, demands, actions,proceedings, damages, charges, costs and expenses (including legal costs and expenses) which may bebrought against the Manager in respect of or in any way arising out of or in connection with:(a) a breach by the Consultant of this clause; or

(b) a claim that the Manager is in breach of the Manager's obligations under the Act as a result of anyaction or omission by the Consultant.

28. Severability Any term condition stipulation covenant or undertaking hereof which is illegal prohibited or unenforceable shall beineffective to the extent of such illegality prohibition or unenforceability without affecting invalidating or impairing the

remaining provisions hereof.

29. Non-assignability

This Agreement is personal to the Consultant who shall not be entitled to assign his rights and obligations hereunder toany person whomsoever.

30. SuccessorsThis Agreement shall be binding on the successors in title and assigns of the Company. This Agreement and all rightsunder it may be assigned or transferred by the Company.

31. Clause HeadingsThe headings are for reference only and shall not affect the interpretation of this Agreement.

32. CostsThe costs of preparation and stamping of this Agreement shall be borne by the Consultant.

33. Governing LawThis Agreement shall be governed by and be construed in accordance with the laws for the time being in force in

Malaysia.

34. Time 

Time is the essence of this Agreement.

35. InterpretationIn this Agreement where the context so permits, the singular shall include plural and the masculine shall include thefeminine and neuter genders and vice-versa.

Schedule 1

CODE OF ETHICS ANDSTANDARDS OF PROFESSIONAL CONDUCT 

INTRODUCTION1 The unit trust industry is centrally premised on the concepts of trust and faith. It is imperative that an industry which deals

with the public's savings be operated and administered with the highest degree of ethics and professionalism.

2 Persons registered to deal in unit trusts ("registered persons") must therefore possess a sense of responsibility, integrity

and professionalism in marketing and distributing units.

3 To promote and maintain the highest of ethical and professional standards, the Securities Commission has set out a Code

of Ethics and Standards of Professional Conduct to guide and aid registered persons in the marketing and distribution ofunits.

4 The Code of Ethics and Standards of Professional Conduct form the minimum standards of conduct  expected ofregistered persons and are intended to be a guide to ascertaining whether a registered person is acting in a manner whichcontinues to satisfy the Minimum Standards for Registration.

5 The Code of Ethics and Standards of Professional Conduct are intended to support management companies in theirefforts to uphold proper standards and do not in any way restrict the companies from formulating more comprehensive

sets of rules in maintaining ethical and professional standards if they so desire.

CODE OF ETHICS

1 Registered persons are to be guided in their conduct by the general principles contained herein. The principles are asfollows:-

(a) Honesty, dignity and integrity 

 A registered person should at all times strive to act with honesty, dignity and integrity. He should conduct

himself and should encourage others to market and distribute units in a professional and ethical manner that willreflect credit on himself, fellow registered persons and the industry.

In particular, the registered person must not misrepresent or recklessly represent:-

(i) his qualifications or that of the management company he represents;

(ii) the products and/or its characteristics offered by the management company he represents; and

(iii) the past investment performances of the unit trust scheme he is marketing.

Conduct which is dishonest would include any omission of a material fact. A material fact may be defined as

one which would cause the customer to appreciate that the scheme is different from that actually represented tohim.

(b) Fair dealing

 A registered person should at all times deal in a fair and equitable manner. Aggressive and offensive salespractices should be avoided.

(c) Good faith

 A registered person should always deal with good faith and with the best of intentions. The investor is to betreated with respect and should be given full disclosure of all information pertinent to his investment decision.

STANDARDS OF PROFESSIONAL CONDUCT 

1 Registered persons must observe the following standards of conduct :-

(a) Compliance with rules and regulations 

 A registered person should maintain knowledge of, and comply with, all applicable laws, ru les and regulati onsgoverning the unit trust industry, including these Code of Ethics and Standards of Professional Conduct.

Further, the registered person should deal with the regulatory authorities in an open and cooperative manner,and should disclose such information as is reasonable and appropriate.

(b) Use of Authorisation Card 

 A registered person must, on contact with a prospective investor, disclose that he is a person registered to

market and distribute units and thereafter produce his Authorisation Card issued by the Federation ofInvestment Managers Malaysia (FiMM) to identify himself. The use of other cards (not issued by the FiMM) isstrictly prohibited.

PRIVACY NOTICE

Prior and/or upon commencement of business relationship and/or at any time thereafter, Hwang Investment ManagementBerhad may collect your personal data for purposes of provision of services you have requested.

For the purpose of this Privacy Notice, the term “personal data” has the meaning prescribed by the Personal Data Protection Act 2010 (“Act”) as follows:-

“Personal Data” means any information in respect of commercial transactions, which:-(a) is being processed wholly or partly by means of equipment operating automatically in response to instructions given for

that purpose;

(b) is recorded with the intention that it should wholly or partly be processed by means of such equipment; or(c) is recorded as part of a relevant filing system or with the intention that it should form part of a relevant filing system,that relates directly or indirectly to a data subject who is identified or identifiable from that information or from that and other

information in the possession of a data user, including any sensitive personal data and expression of opinion about the datasubject but does not include any information that is processed for the purpose of a credit reporting business carried on by acredit reporting agency under the Credit Reporting Agencies Act 2010.

We are committed to maintain the confidentiality, security and integrity of the personal data supplied by you. In line with the Act, this Privacy Notice aims to highlight the manner we deal with your personal data and the choices available to you to

access or limit our access to your personal data.

1. The types of personal data collected and processed by us may include information such as:-

•  Your name, nationality, date of birth, identity card/passport number, gender, resident status, marital status, address,

contact number, email address, number of dependants, occupation details, income range, net worth, liability andsource of fund/income;

•  Your personal data from regulators and governmental agencies; and•  Such other relevant information which we may require in order to provide you with our services/products.

2. We collect your personal data for the following purposes:-•  To assess your application for our services/products;•  The provision of services/products requested by you including management of your investment and for facilitating

daily operational processes;•  To keep you informed of new products or services offered by us or our related, associated or affiliated companies by

way of marketing/advertisement/promotional materials, emails or calls;

•  To comply with legal or regulatory requirements or as directed by regulatory or government bodies;•  For risk profiling and conducting money laundering and terrorism financing checks and other background checks;•  To create directories or database whether for publication or not;

•  To attend to your enquiries and generally to enable resolution of a concern or complaint;•  For delivery of notices and statements; and•  For such other purposes that is incidental or ancillary or in furtherance to the above purposes.

(collectively “the Purposes”) 

The personal data collected will be retained by us for the duration permitted/required under Malaysian law, which may extend

to periods after termination of your contractual relationship with us.

3. We collect your personal data from various sources, including but not limited to:-

•  Information you have provided us;•  Information from third parties (such as your authorised representatives, your financial adviser, your agent, your bank,

if funds are transferred to and from of your bank account); and

•  Information in the public domain.

4. We maintain the security of your personal data as follows:-

•  We maintain adequate security control systems to safeguard the confidentiality and security of your personal data;•  Access to your personal data by our staff is strictly on a need-to-know basis; and•  Where we appoint third party service providers, agents or contractors to provide services to us, we ensure that these

third parties observe similar security measures as adopted by us.

5. We may disclose your personal data to:-

•  Our directors, officers and authorised representatives for purposes relating to your application and use of ourservices/products;

•  Our related, associated or affiliated companies;

•  Regulatory bodies such as Bank Negara Malaysia, Securities Commission, Bursa Malaysia Securities Berhad,clearing house and other regulatory bodies which have oversight over us and our activities;

•  Any third party service provider, agent or contractor who have been appointed by us to provide services to us

whether in or outside Malaysia subject to sufficient security controls over the information;•  Our auditors, lawyers, consultants and other advisors;•  Parties authorised by you; and

•  Any other party to whom such disclosure is required by law or regulatory requirement or pursuant to a Court ordernotwithstanding that any such persons may be outside Malaysia, for any of the above Purposes or any other purposefor which your personal data was to be disclosed at the time of its collection or any other purpose directly related toany of the above Purposes.

6. Your rights and choices•  You have the right to access and request for correction of your personal data which is inaccurate, incomplete or not

updated.•  For the above purposes, please contact the personnel whose details are given in the contact information below. In

accordance with the Act:-

(a) we may charge a fee for processing your request for access; and(b) we may refuse to comply with your request for access or correction.

•  If you do not wish to receive marketing/advertisement/promotional materials from us, you have the right to request

that we stop contacting you or sending you marketing/advertisement/promotional materials. Such request may bemade via email to the contact personnel named below.

•  It is obligatory that you supply us with the personal data requested by us. If you choose not to supply us with your

personal data or withdraw or limit the use of your personal data, we may reject your application for the

services/products requested or we may not be able to continue providing you with the services/products you haverequested.

By providing to us your personal data, you hereby consent to the processing of your personal data in accordancewith all of the foregoing.

7. Amendments and Contact•  You will be notified of any material amendments to this Privacy Notice. Such notification may be mailed to you and

2. Kami mengumpul data peribadi anda untuk tujuan-tujuan yang berikut:-•  Untuk menilai permohonan anda untuk perkhidmatan-perkhidmatan / produk-produk kami;•  Penyediaan perkhidmatan-perkhidmatan / produk-produk yang diminta oleh anda termasuk pengurusan

•  Untuk memaklumkan anda tentang produk-produk atau perkhidmatan-perkhidmatan baru yang ditawarkan olehkami atau syarikat-syarikat berkaitan, bersekutu atau bergabung dengan kami melalui bahan-bahan, e-mel-e-

mel atau panggilan-panggilan pemasaran / pengiklanan / promosi;•  Untuk mematuhi keperluan undang-undang atau peraturan atau sebagaimana yang diarahkan oleh badan-

badan kawal selia atau kerajaan;

•  Untuk pemprofilan risiko dan melakukan penilaian kredit, pengubahan wang haram dan pemeriksaanpembiayaan keganasan dan pemeriksaan latar belakang yang lain;

•  Untuk mencipta direktori atau pangkalan data sama ada disiarkan atau tidak;

•  Untuk menjawab persoalan anda dan secara amnya untuk menyelesaikan kemusykilan atau aduan;•  Untuk menghantar notis-notis dan penyata-penyata; dan•  Untuk apa-apa tujuan-tujuan lain yang bersampingan atau berkaitan atau lanjutan kepada tujuan-tujuan di atas.

Data peribadi yang dikumpul akan disimpan oleh kami adalah untuk tempoh yang dibenarkan / dikehendaki di bawah undang-

3. Kami mengumpul data peribadi anda daripada pelbagai sumber, termasuk tetapi tidak terhad kepada:-

•  Maklumat yang diberi oleh anda;•  Maklumat daripada pihak ketiga (seperti wakil-wakil anda, penasihat kewangan anda, ejen anda, bank anda,

 jika ada transaksi wang berkenaan dengan bank tersebut), analisis perdagangan dan rekod-rekod transaksi;

•  Maklumat daripada domain awam.

4. Kami mengekalkan keselamatan data peribadi anda dengan cara-cara yang berikut:-•  Kami mengekalkan sistem kawalan keselamatan yang mencukupi untuk melindungi privasi dan keselamatan

data peribadi anda;

•  Akses kepada data peribadi anda oleh kakitangan kami dihadkan kepada dasar asas perlu-tahu; dan

•  Sekiranya kami melantik pembekal perkhidmatan pihak ketiga, ejen atau kontraktor untuk menyediakanperkhidmatan kepada kami, kami akan memastikan bahawa pihak ketiga ini mematuhi langkah-langkah

keselamatan yang sama seperti yang diterima pakai oleh kami.

5. Kami mungkin mendedahkan data peribadi anda kepada :-

•  Pengarah-pengarah, pegawai-pegawai dan wakil-wakil kami untuk tujuan yang berhubungan denganpermohonan dan penggunaan perkhidmatan- perkhidmatan / produk-produk kami oleh anda;

•  Syarikat-syarikat berkaitan, bersekutu atau bergabung dengan kami;•  Badan-badan kawal selia seperti Bank Negara Malaysia, Suruhanjaya Sekuriti, Bursa Malaysia Securities

Berhad, gedung penjelasan dan badan-badan kawal selia yang lain yang mempunyai pengawasan ke atas

kami dan aktiviti-aktiviti kami;•  Mana-mana pembekal perkhidmatan pihak ketiga, ejen atau kontraktor yang telah dilantik oleh kami untuk

memberikan perkhidmatan kepada kami sama ada di dalam atau di luar Malaysia tertakluk kepada kawalan

keselamatan yang mencukupi ke atas maklumat itu;•  Juruaudit, peguam, perunding dan penasihat lain kami;•  Pihak-pihak yang diberi kuasa oleh anda; dan

•  Mana-mana pihak lain yang kepadanya penzahiran itu dikehendaki oleh undang-undang atau keperluan kawalselia atau menurut suatu perintah Mahkamah

walau apa pun pihak-pihak yang dinyatakan mungkin berada di luar Malaysia, untuk mana-mana Tujuan-tujuan di atasatau apa-apa tujuan yang lain yang baginya data peribadi anda hendak dizahirkan pada masa pengumpulan atau mana-mana tujuan lain yang berkaitan secara langsung kepada mana-mana Tujuan-tujuan di atas.

6. Hak-hak dan pilihan-pilihan anda

•  Anda mempunyai hak untuk mengakses dan meminta pembetulan maklumat peribadi anda yang tidak tepat, tidaklengkap atau tidak dikemas kini.

•  Bagi tujuan-tujuan di atas, sila hubungi kakitangan yang butir-butirnya diberi dalam maklumat hubungan di bawah.Mengikut Akta ini:-(a) kami boleh mengenakan bayaran untuk memproses permintaan anda untuk akses;

dan(b) kami boleh menolak permintaan anda untuk akses atau pembetulan.

•  Jika anda tidak mahu menerima bahan-bahan pemasaran / iklan / promosi dari kami, anda mempunyai hak untukmeminta supaya kami berhenti menghubungi anda atau menghantar bahan-bahan pemasaran / iklan / promosi

kepada anda. Permohonan seperti itu boleh dibuat melalui e-mel kepada kakitangan seperti yang disenaraikan dibawah.

•  Ia adalah wajib untuk anda membekalkan kami dengan data peribadi yang diminta oleh kami. Jika anda memilihuntuk tidak membekalkan kami dengan data peribadi anda atau menarik balik atau menghadkan penggunaan data

peribadi anda, kami mungkin menolak permohonan anda untuk perkhidmatan-perkhidmatan / produk-produk yangdiminta atau kami mungkin tidak mampu untuk terus menyediakan anda dengan perkhidmatan-perkhidmatan /produk-produk anda diminta.

Dengan membekalkan kami dengan data peribadi anda, anda dengan ini bersetuju kepada pemprosesan data peribadianda selaras dengan semua perkara di atas.

7. Pindaan dan Maklumat Perhubungan•  Anda akan dimaklumkan mengenai sebarang pindaan material kepada Notis Privasi ini. Pemberitahuan itu mungkin

dihantar kepada anda dan menjadi sebahagian daripada penyata bulanan kami kepada anda, dimaklumkan kepadaanda melalui e-mel dan/atau diakses melalui laman web kami di www.hwangim.com. Jika anda terus menggunakanperkhidmatan-perkhidmatan / produk-produk kami, anda dianggap telah bersetuju untuk menerima apa-apa
