COMMUNITIES Status of Non Compliance Issues with Department of Environment Heritage Protection Executive Summary: This briefing note outlines actions being taken for Council’s Sewage Treatment Plants and Waste Disposal Facilities that are currently not complying their Environmental Authority conditions. Transitional Environment Programs (TEP) are currently in place for (4) four of the sewage treatment plants and two have been prepared for the Emerald and Blackwater landfills. The TEPs establish a legal agreement with the Department of Environment and Heritage Protection for Council to achieve compliance over a few years through an approved program of improvement works.

GOVERNANCE Council Policies for Adoption Executive Summary: The Local Government Act 2009 sets out the role of Council and gives local governments flexibility in how they make decisions and deliver services. Developing, adopting and reviewing policies is a prime responsibility of the Council under the Local Government Act 2009. The role includes setting local laws and the adoption of policies in the interest of public within the Local Government Area. Policy documents (policies, procedures, guidelines) will be reviewed according to scheduled review timetables. Changes to relevant legislation and or Council’s goals or operations are examples of circumstances that can trigger a requirement to review a policy document prior to its normal review date. Council’s Governance Framework ensures policies:

are developed in a consultative, comprehensive and consistent manner

underpin and support Councils strategic objectives as articulated in the Corporate Plan/Community CH2022 Plan

provide a clear understanding of the Council and management responsibilities in policy development and review

ensure consistency with and meet the compliance requirements of legislation

are consistent with Council’s Vision, Mission and Values.

COUNCIL POLICY

Workplace Bullying and Harassment Policy

POLICY NUMBER: DEPARTMENT: Corporate Services

EFFECTIVE DATE: UNIT: Organisational Development

1.0 Purpose and Scope

The purpose of this policy is to provide a safe and healthy work environment for all employees and contractors by detailing Council’s commitment to a workplace free of bullying and harassment.

The policy applies to all employees of the Council whether full-time, part-time or casual workers. The policy also applies to all contractors, consultants, volunteers or temporary staff that might be considered workers within the Council’s work environment.

The policy applies to all Council activities during normal work and after hours. It applies to all Council functions and Council sponsored functions. It also applies to conferences and client events where the Council employee or worker may be deemed to be representing or have a connection with the Council.

This policy does not form part of any employee’s contract of employment nor does it form part of a contract for service.

4.0 Policy Statement

Council is committed to ensuring a healthy and safe workplace that is free from bullying and harassment and affirms the rights of individuals to be treated fairly and with respect. Workplace harassment is unacceptable and will not be tolerated under any circumstances. Bullying and all forms of personal harassment including those of a sexual or racial nature can seriously harm working conditions and have legal, ethical and financial implications for the Council. Any incidents of bullying and harassment will be regarded extremely seriously by Council and can be grounds for disciplinary action which may include dismissal. Workplace bullying is repeated, unreasonable behaviour, directed towards a worker or a group of workers that creates a risk to health and safety. It includes both physical and psychological risks and abuse. ‘Repeated behaviour’ refers to the persistent nature of the behaviour and can refer to a range or pattern of behaviours over a period of time (for example, verbal abuse, unreasonable criticism, isolation and subsequently being denied opportunities – i.e. a pattern is being established from a series of events). ‘Unreasonable behaviour’ means behaviour that a reasonable person, having regard to all the circumstances, would expect to victimise, humiliate, undermine or threaten another person. Bullying behaviours can be direct or indirect. These include but are not limited to:

Direct Bullying Indirect/Upward Bullying

abusive, insulting or offensive language

spreading misinformation or malicious rumours

behaviour or language that frightens, humiliates, belittles or degrades, including over criticising, or criticism that is delivered with yelling or screaming

displaying offensive material

inappropriate comments about a person’s appearance, lifestyle, their family or sexual preferences

teasing or regularly making someone the brunt of pranks or practical jokes

interfering with a person’s personal property or work equipment, or

harmful or offensive initiation practices.

unreasonably overloading a person with work, or not providing enough work

setting timeframes that are difficult to achieve, or constantly changing them

deliberately excluding or isolating a person from normal work activities

withholding information that is necessary for effective work performance

not cooperating with other team members or not cooperating with directions by the manager.

obstructing a manager so that tasks or projects aren’t completed.

refusing to accept direction from the manager.

being rude or perhaps being obtuse, which may not be considered rude but might be considered an obstruction to listening to the manager

Appropriate management using reasonable management practices is not bullying. Examples of reasonable work practices include:

setting reasonable performance goals, standards and deadlines in consultation with workers and

after considering their respective skills and experience

allocating work fairly

fairly rostering and allocating working hours

transferring a worker for legitimate and explained operational reasons

deciding not to select a worker for promotion, following a fair and documented process

informing a worker about unsatisfactory work performance in a constructive way and in accordance

with any workplace policies or agreements

informing a worker about inappropriate behaviour in an objective and confidential way

implementing organisational changes or restructuring

performance management processes.

Workplace harassment takes many forms. Basically, it is any behaviour which is unacceptable to the recipient and which creates an intimidating, hostile or offensive environment for work. This can be particularly serious if the harasser is in a position of organisational power in relation to the person harassed. Any behaviour which shows lack of respect and which creates an atmosphere in which people feel uncomfortable and unwelcome can constitute harassment. A single act of harassment is sufficient to give rise to a complaint. Harassment in the workplace is an action obvious or indirect, physical or verbal that is aimed at another employee.

Types of harassment include:

Teasing;

Telling of racist jokes

Intimidation of other workers

Derogatory reference to another's country of origin

Petty humiliation

Impede or deride the efforts of a person with a disability within the workplace

Unwelcome physical touching

Sexual or suggestive comments, jokes or innuendo

Unwelcome requests for sex

Intrusive comments about a person's private life

The display of sexually explicit material such as posters or pictures including on a computer screen

Unwanted invitations (sexual or other inappropriate invitations)

Staring or leering

Sex based insults or taunts

Offensive communications, including telephone calls, letters, faxes and email.

If a worker believes they are being harassed, or wishes to make a report about another employee being harassed they should contact the Manager Organisational Development. A copy of the Grievance Procedure, which will outline the processes available for the employee and management to follow, is available on Council’s Intranet.

5.0 Policy Review

All policies will be reviewed annually or when any of the following occur:

Relevant legislation, regulations, standards and policies are amended or replaced; and

Other circumstances as determined from time to time by the Chief Executive Officer/Executive

Leadership Team/Managers.

COUNCIL POLICY

Community Donations, Grants and Sponsorships

POLICY NUMBER: DEPARTMENT: Communities

EFFECTIVE DATE: UNIT: Community & Customer Services

1.0 Purpose and Scope

The purpose of the Council’s Community Grants Policy is to provide financial assistance to local community groups and organisations that make positive contributions to the quality of life in the local government area. The policy covers all community donations, grants and sponsorships in relation to Council support for community groups and organisations. The policy also covers any budget allocations made in relation to discretionary funds.

2.0 Reference Local Government Regulation 2012

3.0 Definitions Council means Central Highlands Regional Council Donation means a one off or reoccurring contribution, can be financial or in-kind support. The contribution is not subject to a delivery of a direct benefit for Council or community in exchange for the donation. Grant means a one off or reoccurring contribution where the recipient is required to undertake some kind of deliverable that will benefit the community. Sponsorship means a one off or reoccurring contribution, can be financial or in-kind support. Council expects negotiated benefits such as positive recognition in exchange.

4.0 Policy Statement

Council will provide donations, grants and sponsorships that assist in meeting the Corporate and Operational Plan objectives and deliverables. This includes building and strengthening, increased sharing and participation and the general well-being of the community and will therefore be in the public interest. The main areas to be targeted by this policy are:

Developing the capacity and sustainability of organisations or innovative programs to meet the needs of members and the community. Examples of programs in this area are but not limited to training programs for club committees, volunteer programs and initiatives to gain new members or sponsors.

Support the acquisition or upgrading of facilities and equipment (excluding personal-use items). Examples of programs in this area are but not limited to storage sheds, extra lighting, upgraded amenities and shade.

Providing donations towards services that deliver improved community services to the Council area or region.

Providing sponsorships to events and activities that provide opportunities for community participation and sharing.

4.1 Mayor’s Discretionary Fund

The Council will make an annual budget allocation to the Mayor’s Discretionary Fund in relation to

community donations, grants and sponsorships. That fund must be administered in accordance with the

legislated requirements, this policy and any related procedure.

4.2 Types of Applications The program will cover: Donation, Grants or Sponsorships to Community, Sport and Recreation Groups and Organisations. 4.3 Program Limits The following limits are applied per application: Donation, Grants, Sponsorships $5000.00 Mayor’s Discretionary Fund $ 500.00 4.4 Assessment Criteria 4.4.1 Donations, Grants and Sponsorships Criteria The application must:

contribute to the target are set out in this policy; and

directly support a demonstrated need within the community;

provide a direct or indirect benefit for residents in the community;

The applicant must:

demonstrate the ability to meet current financial obligations and include quotes, budget and financial statements;

demonstrate that attempts have been made to raise funds from other sources;

must make at least a 10% monetary or in-kind contribution towards the cost.

The following criteria may exclude an application:

where the organisation owes a debt to Council or has not adequately acquitted previous funding The following criteria will exclude an application:

where the organisation has access to funds generated internally from permanently licensed premises or onsite gaming machines;

where an organisation is of a political nature.

4.4.2 Mayor’s Discretionary Fund Criteria The application must:

Time frames for the deliverable required under any approved applications.

The meeting was opened at 11.40am Proposed Councillor and Executive Leadership Team Workshops Executive Summary: At the Leadership and Governance Committee Meeting of 15 June 2016, a report to the Committee recommended that the Seechange proposal be accepted for conducting Councillor and Executive Leadership Team workshops which were originally recommended as part of the Councillor Induction Program. A copy of the Leadership and Governance Standing Committee Meeting Report of 15 June is included as Attachment 1.

After considering the Report and accompanying Seechange proposal, the Committee requested officers to obtain two additional quotes from other consulting organisations to undertake the workshops along similar lines and scope as the Seechange proposal.

Two further quotes have been sourced by the Acting Executive Manager Governance (Adrian Grant): Resolution: Cr Brimblecombe moved and seconded by Cr Nixon “That Central Highlands Regional Council engage Winners at Work to deliver training to the Councillors and Executive Leadership Team on the foundations for a united and cohesive team to enable delivery of successful outcomes for the quoted price of $15,691.50 including goods and services tax, plus flights and accommodation.” LGSC 2016 / 07 / 27 / 007 Carried (5-0)

EXECUTIVE SUMMARY:

The progress and achievements of the 2015-2016 Operational Plan activities during the fourth quarter of the 2015-2016 financial year are detailed in the attached report. The Operational Plan 2015-2016 was adopted by Council on 29 July 2015 and this performance report completes the reporting for the 2015-2016 Operational Plan.

RECOMMENDATION:

That the Committee receive the Operational Plan Performance Report for the fourth quarter of the 2015-2016 financial year in accordance with Section 174 of the Local Government Regulation 2012.

INTRODUCTION

The purpose of this report is to provide an update on the progress made during the fourth quarter of the year and to identify the outcomes of the 2015-2016 Operational Plan. There were 151 measures identified in Council’s Operational Plan for 2015-2016 and 17 carried over measures from 2014-2015 Operational Plan.

BACKGROUND:

In accordance with the Local Government Regulation 2012, Council must review implementation of the Operational and Corporate Plans. Attached is a document outlining progress between 1 April 2016 and 30 June 2016.

COMMENT:

The Operational Plan is designed to measure implementation of the Corporate Plan outcomes and strategies and to ensure appropriate resources are allocated to priority areas. The overall performance (including carried over activities) against the Operational Plan activities has been measured and overall progress is identified in the following chart.

The 57 activities that are incomplete and 4 behind target that remain outstanding have been mapped to identify whether the activities are included in the 2016-2017 Operational Plan. Of these:

44 of the activities have been included for reporting in the 2016-2017 Operational Plan; 14 activities have not been included in the 2016-2017 Operational Plan; 3 activities behind target have been presented as no longer relevant, these include:

o 4.4.2 - Investigate self funding option for insurance cover for flooding events – General Manager Infrastructure and Utilities

o 4.4.5 - Develop 5 Year Strategy for Disaster Preparedness – General Manager Infrastructure and Utilities

o 7.2.3 - Through the Corporate Services Business Improvement Team, improve the efficiency and effectiveness of business processes delivered to the organisation – General Manager Corporate Services

It is proposed to discuss with the Leadership and Governance Standing Committee the 3 activities presented as no longer relevant to determine actions to be taken in regard to these activities.

It is proposed that the 2016-2017 Operational Plan be amended to include the 14 activities to ensure they are captured and finalised. The amended plan will be presented to Council for adoption at the 15 August 2016 General Council meeting.

Further analysis of the overall performance against the Operational Plan has been undertaken to measure progress by departments (including CHDC) and this is illustrated in the chart below.

RISK MANAGEMENT ASSESSMENT:This risk management analysis pertains to the context of Council supporting the recommendation and implementing same.

Risk:Council must discharge its responsibilities in a manner that is consistent with its annual operational plan. Council, by adopting this recommendation, ensures that projects and expenditure linked to the operational plan are assessed at regular intervals of not more than 3 months.

Operational:Reporting and tracking of project performance on a quarterly basis.

Strategic:Documents the 2015-2016 contribution towards achieving our Strategic Goals as stated in the Corporate Plan 2013-2018.

The Operational Plan and Quarterly Reports are public documents that are published on Council’s website. Importance is placed on updating the community on the progress of the projects listed in the operational plan.

CONSULTATION / ENGAGEMENT:

The Performance Report has been prepared following consultation with the Whole of Management Team. The final report will also be published on Council’s website to enable the Community to understand Council’s progress on achieving the Corporate Plan outcomes.

CONCLUSION:

It is recommended that the Operational Plan Performance Report for the fourth quarter of the 2015-2016 financial year be received as tabled in finalisation of the 2015-2016 Operational Plan.

Introduction

Welcome to the fourth quarterly review of the 2015-2016 Operational Plan. The plan outlines the activities and services that we, as an organisation, will deliver this financial year. This quarterly report demonstrates how the organisation delivered its annual work program from 1 April 2016 to 30 June 2016. The quarterly report complies with the Local Government Regulation 2012 that states:

‘… the Chief Executive Officer is to present a written assessment of the local government’s progress towards implementing the annual operational plan at meetings of the local government held at regular intervals of not more than three months.’

The structure of the report is by key priority consistent with the Corporate Plan 2013-2018; the council’s key strategic planning document. There are seven key priorities: Strong, Vibrant Communities; Building and Maintaining Quality Infrastructure; Supporting Our Local Economy; Protecting Our People and Our Environment; Proactive, Responsible Leadership; Strong Governance; and A Workplace of Excellence.

Delivering the priorities

The Central Highlands Regional Council’s operational plan is a key plan for the region. It translates our priorities and services that are set out in our five-year corporate plan into measurable actions for the financial year. Progress is reported to the council and the community quarterly and is available on our website. Reporting over the four quarters of the financial year provides the opportunity for council to respond more effectively to significant changes in its operating environment. Whether they are social, economic, environmental, workplace health and safety, public safety or internal changes that affect the organisation’s capacity to deliver on its promised actions. Status legend: Colour-coded traffic light is indicative of the progress of each action.

Message from the CEO – Scott Mason

The fourth quarter of the year has now passed and the organisation continues on its journey to become

more efficient and effective.

By reviewing our performance this quarter, we can demonstrate how responsive we are to the current

economic environment while continuing to focus on improving our customer service.

The achievement of an annual Operational Plan requires balancing the needs and wants of our community for today and into the future, minimising the financial impact on ratepayers, maximising the services delivered and ensuring the financial sustainability of council. The council’s achievements against the actions of the Operational Plan for the fourth quarter show 94 completed projects with 57 activities carried over for re-evaluation and completion in the 2016-2017 financial year.

The achievements are of differing scale and impact, but nevertheless we remain proud of our effort and

commitment to ensure the community has a great place to live and work; for not just today, but for the

future.

The following is a summary of the fourth-quarter achievements against the 2015-2016 Operational Plan:

• Completion of Arcadia Valley pave and seal $14M project.

• Delivery of 90 per cent of capital budget for roads.

• Business case development for Emerald Flood Protection Scheme awarded to Aecom.

• New Street evacuation route

o Water and sewer relocation almost complete.

o Construction contract awarded to local company, Simon Contractors.

• Completion and adoption by council on 14 June 2016 of the Total Asset Management Plan and the Recreational Facilities Asset Management Plan.

• Ongoing support and attention provided to local Community Reference Groups in the development of individual action plans by 31 December 2016.

• Recruitment of new Coordinator for Libraries and the development of a Libraries Services (Strategic) Plan 2016-2021 (post service level review reform commenced 2014-15).

• Presentation and ongoing planning and consideration towards the construction of a new regional landfill consistent with the Waste Reduction and Recycling Plan.

• Adoption in principle pf the Central Highlands Regional Council Housing Strategy.

• Completion of planning health check internal self-assessment adopted by council on 14 June 2016 – improved previous 2013 score of 22/102 to 83/102 as at 30 June 2016.

• Funding submitted under the National Stronger Regions fund for Black Gully sewerage treatment plant and Emerald Airport improvements.

• Airport tourism advertising finalised. Exterior advertising installed with brochure racks and a television installed within the terminal building.

• Progressing work on the Gregory Highway intersection project. Tender awarded and work should commence in Quarter 1 of the next financial year.

• Asset management plans for all classes of council assets have been finalised and adopted including a policy, strategy and roadmap for the integration of asset management practices into council operations as core business.

• Continued advancement of technology with the video-conferencing now installed into the council chambers and video live-streaming ready for use in August 2016.

• Implementation of appropriate succession planning continues with the trainees, cadets and apprentices programs developed.

• Ongoing activities as part of the Central Highlands Marketing Strategy 2015 in partnership with Central Highlands Development Corporation including: a refit of tourism information at the airport; promotion of the Great Inland Way in Caravanning Australia magazine; commencement of community walking tours in Emerald; a new tourism column in the CQNews.

• A Memorandum of Understanding with key performance indicators was prepared and accepted by the regional tourism authority, Capricorn Enterprise.

• The Regional Communications Strategy continued to be implemented including the commencement of a regular mayor’s column in the CQ News fortnightly.

This quarterly report is the final performance report on the 2015-2016 Operational Plan and measures 151

activities across council’s seven strategic priorities. Sixty four per cent of the activities have been

completed.

Budget alignment

The 2015-16 Operational Plan is aligned with the council budget by ensuring that all income and expenditure in the 2015-16 Budget is allocated to the relevant programs within the Plan.

Appropriate financial management systems are maintained to enable reporting at various levels of detail from transaction level to strategic priority level.

Native Title Update

EXECUTIVE SUMMARY: To ensure Council is provided with regular status updates on Native Title Claims and Determinations within the Central Highlands Regional Council area, a monthly update will be provided to the Leadership and Governance Standing Committee.

As part of the 2016 Councillor Induction Program, Councillors attended a presentation by Oliver Gilkerson, Gilkerson Legal on the pending Native Title Claims and Determinations within CHRC area, and the process undertaken by Local Governments when entering into an Indigenous Land Use Agreement (ILUA) on 13 June 2016.

The following report provides updates in relation to the following Native Title Claims:

1. Barada Barna People – QUD380/20082. Barada Kabalbara Yetimarala #1 – QUD383/20133. Bidjara People #6 – QUD216/20084. Bidjara People #7 – QUD644/20125. Iman People #2 – QUD6162/1998

DETAIL:

Native title is the traditional laws and customs of Aboriginal People in relation to land and waters.

In 1992, the High Court of Australia in its Mabo Decision found that Aborigines and Torres Strait Islanders have their own traditional laws about land, rivers and seas pre-dating European settlement. It decided that Australia’s common law recognises and protects native title wherever it continues to survive.

Traditional laws may differ between Aboriginal groups. Generally, native title has been described as a “bundle of rights”.

Before European settlement, traditional laws would have entailed the right to exclusive possession, occupation, use and enjoyment of an Aboriginal group’s traditional land. However in many parts of Queensland, the historical effects of European settlement have eroded away the exclusivity.

In such cases, what is left is a bundle of rights. These include - a right to reside on an area, a right to hunt and fish on an area, a right to conduct ceremonies on an area, a right to take certain resources from an area etc. There can however still be some parcels of land, such as some unallocated State land, where exclusive possession native title still survives.

Native title is related to, but is legally different from Aboriginal cultural heritage. Cultural heritage comprises objects and areas of particular cultural or historical significance to Aboriginal People. It may exist on areas where native title has been Extinguished or there is otherwise no native title. Aboriginal cultural heritage is protected by the law in a completely different way.

Council is party to a local government ILUA of which 0.62% of Central Highlands Regional Council area is affected by the claim. The notification period for registration of the claim closes on 25 August 2016. The ILUA will formally take affect shortly after that date.

Council is required to start discussions with the other local government parties (Isaac Regional Council and Mackay Regional Council) about establishing the ILUA Consultative Committee under Part 5 of the ILUA.

• The claim is mid-way through the Federal Court process with the Council as a respondent party.• The claim was recently amended to reduce the claim area and change the applicants.• Council is not yet substantially involved in the claim process and a draft local government ILUA has not

yet been tabled.

• The claim was listed before Justice Collier on 19 July 2016.• The attached map illustrates extent of area involved in the claim (1.96% of CHRC area affected by claim).• Barada Kabalbara Yetimarala #1 lawyer spoke of history and issues. The connection research will not be

completed until March 2017. • Justice Collier decided the parties needed to discuss and prepare a more detailed timetable than that

proposed. She directed parties to do so and adjourned the matter until 17 August 2016.

3 - Bidjara People #6 – QUD216/2008 4 - Bidjara People #7 – QUD644/2012

Both claims were mid-way through the Federal Court process. Council is a respondent party to both claims. There are unresolved claim overlaps.

This led to an application being made to strike out the claims.

05/07/2016

Justice Jagot made a decision on the hearing of interlocutory applications seeking to dismiss both Bidjara#6 and Bidjara#7 claims. Her Honour made orders summarily dismissing both claims.

Justice Jagot relied on an earlier finding (arising from the trial about an area between overlapping groups including Bidjara) that there is no evidence that there is a continuing Bidjara society.

Justice Jagot found that the continuation of the Bidjara #6 and Bidjara #7 claims would be an abuse of process given these claims are made by the same group.

Bidjara may seek to appeal the decision, with 14 days to file a notice of appeal. It is anticipated that other overlapping claims with Bidjara claims will now be listed for directions hearings –

including Wangan & Jangalingou People, Gaangalu Nation People, Western Kangolou and Gungarri #4 and the Court will be keen to progress these claims

The Federal Court have advised that the Court’s Bidjara file has been closed. A new file will be opened if there is an appeal. The dismissal of the Bidjara #6 and #7 claims means that:

Under the Native Title Act 1993 (the NTA), the Bidjara People are no longer a registered claim group and therefore are no longer entitled to notices under the NTA future act regime.

Under the Aboriginal Cultural Heritage Act 2003 (Qld) – if there is still another registered claim group for the relevant area, then Council must only deal with that group.

A letter has been drafted to be sent to the Bidjara People advising of the effect of the court order dismissing the claim on the Emerald Flood Mitigation Project and future projects.

5 - Iman People #2 – QUD6162/1998

• The Federal Court convened a final hearing to make a native title determination with the consent of all parties on 23 June 2016.

• Council is a respondent party to the claim and Council’s minimal interests (0.29%) in the claim area are recognised in the determination orders.

• A local government ILUA covering that part of the claim in Council’s local government area was registered on 14 September 2015. Other local government parties are Banana Shire Council, Maranoa Regional Council and Western Downs Regional Council.
