4. APPROVAL OF MINUTES: May 10, 2016
Motion by Starrett, seconded by Lenert to approve the minutes. Minutes of May 10, 2016 were approved by voice vote of 24-0.

A. PRESENTATIONS/DISCUSSION
Distinguished Budget Presentation Award (Rita Kruse, Illinois Government Finance Officers Association)
Ms. Rita Kruse, on behalf of the Illinois Government Finance Officers Association, presented its Distinguished Budget Presentation Award to Kane County Asst. Finance Director Erica Waggoner for satisfying nationally-recognized guidelines for effective budget presentation and commitment to excellent governmental budgeting. Finance Dir. Onzick and Finance Committee Chairman Hoscheit also shared positive commendations.
Chairman's Short Program
Chairman Lauzen prefaced his short program by discussing how important it is for the County Board to be accountable to its 532,000 constituents of Kane County by reporting and communicating accurate and credible information to them. Specifically, he reviewed four news articles written by Daily Herald reporter, Jim Fuller, and proceeded to correct and clarify them one by one -- May 11, 2016, "Get ready to pay to recycle your own TV"; May 13, 2016, "The County Board put local taxpayers on the hook for funding child support enforcement efforts by the State's Attorney's Office"; May 19, 2016, "Liquor license battle for Hideaway likely headed to court"; and a statement made in a May 25, 2016 article, "As a result of freezing a property tax levy, including not the new growth, the result is not that people who built new homes during the freeze are shouldering less of a tax burden than neighbors with older property."

Member Allan stressed the importance of the county's drug court program because it allowed individuals to restart their lives and save their families and their communities. Riverboat funds and general fund dollars have been placed into the program. Allan spoke about the positives of the two-year program and the fact that a number of recent graduates of the program mentioned that Gateway Foundation "saved their lives." Member Haimann also added that the program saves approximately $5M to $6M of taxpayer money.

Member Frasz shared his comments in opposition of the resolution, one of which was that the law was a 1930’s-era law and required taxpayers to pay a 15% to 25% premium on public projects as opposed to shopping the

free market for the best vendor/price. Approving it would translate to higher taxes at a time when the county was trying to maintain its frozen tax levy while smaller townships and governments were having difficulty providing basic services. While he believed the resolution would not fail, he did want to raise awareness. In response, Mr. Dahl shared the positives of having a prevailing wage in place and what would happen if the wage was repealed or lowered, i.e., millions in government revenue would be lost, an influx of out-of-state contractors would be brought to the region, and veteran-owned businesses could close. As to the 15% to 25% premium added, Mr. Dahl discussed there was no “true” study that reflected that information and proceeded to cite three studies (from 1989, 1994 and 2008) that discuss why prevailing wage decrease costs. Further discussion among the board followed in support and against the prevailing wage resolution.

Chairman Lauzen stated he was advised by Asst. State’s Atty. Niermann that there was an issue with the current composition of the Legal Affairs & Claims Committee and that Section 2-193 of the County Code reads:
“The Legal Affairs/Claims Committee shall be a subcommittee of the County Board Executive Committee and shall consist of four (4) members thereof appointed by the chairman of the County Board, with the advice and consent of the county board, and a chairman who shall be the Chairman of the County Board.”
Members Auger, Martin, and Scheflow were thanked for their service on the committee. The chairman entertained a motion that Members Kurt Kojzarek and Bill Lenert be appointed to the Legal Affairs & Claims Committee.

9. SPEAKERS (Non-Agenda Items)
(Hoscheit & Auger leave 10:38 a.m.) Ms. Janis Jasper, an Algonquin resident, recalled she was before the board last month seeking answers to her questions regarding the Longmeadow Parkway toll bridge. She reviewed some of the answers she received from KDOT staff Tom Rickert and thanked him for the quick response. Ms. Jasper proceeded to discuss that about a month ago she read a Daily Herald news article regarding some comments made by Chairman Lauzen regarding the Longmeadow project. In response, she wrote two letters to the editor, one of which was published in the Daily Herald shortly thereafter, and the other she proceeded to read to the Board. She said she questioned what the chairman meant when he said, “that the purpose of the toll bridge-part of the Longmeadow project was to make McHenry County pay for their use of the project.” She calculated it would take McHenry County residents to drive
thousands of times across the bridge to come close to what Kane County residents would be contributing to the project. In the end, she summarized that after the county determines the bonds they will be issuing for construction of the project, Kane County taxpayers will most likely be paying for those too. And because the bridge is located in the northern part of the county, most Kane County residents would probably never use the bridge.
This meeting was adjourned at 10:45 AM upon motion by Haimann, seconded by Dahl. Motion carried unanimously.

That part of the Northwest Quarter of Section 18, Township 41 North, Range 8 East of the 3rd
Principal Meridian, described as follows: commencing at a point in the North line of Section 18,

Summary:
It was determined that significant cost savings could be achieved by bidding out a new eCitation system within the Circuit Clerk's Office. Electronic citation is a software system that allows law enforcement officers the ability to enter and validate citation information from a mobile data computer in their patrol car and which also provides a means to import the data in the law enforcement's record management system and the County's court management system eliminating the need for 3 manual data entry steps which eliminates human input errors. The chosen system can be easily integrated with the County's New World Financial System and the Tyler Court Case Management System. Since not all agencies currently have the necessary hardware to implement this, this resolution will authorize those who are ready to go forward namely, North Aurora, Carpentersville, St. Charles, Pingree Grove and East Dundee. It is anticipated that as other agencies have the needed hardware, the contract will be amended to bring those agencies into the system. A new resolution will need to be approved by the County Board to approve any amendments. The total cost as outlined in the RFP was $75,000, and ITD is asking for a not-to-exceed cost of $80,000 which includes $5,000 contingency for unforeseen project-related costs. The bidder chosen to provide this system based on scoring criteria was Brazos Technology/Tyler Technology Corporation.

AUTHORIZING CONTRACT FOR ELECTRONIC CITATION SOLUTION
WHEREAS, electronic software allows law enforcement officers the ability to enter and validate citation information from a mobile data computer in their patrol car and provides a means to import the data into the law enforcement record management system and court management system eliminating the need for manual data entry; and
WHEREAS, an RFP was issued for a new eCitation system with three respondents
providing bids; and WHEREAS, a contract with the selected vendor for those agencies who have the required
hardware and the ability to process mobile citations can be licensed at this time and include: North Aurora, Carpentersville, St. Charles, Pingree Grove, and East Dundee; and
WHEREAS, after review, the Circuit Clerk’s Office has determined that the most responsible
bidder was Tyler/Brazos in the amount of Seventy-Five Thousand Dollars ($75,000). NOW, THEREFORE, BE IT RESOLVED by the Kane County Board that the County
authorize the Chairman of the Kane County Board to execute an agreement with Brazos Technology/Tyler Technology Corporation for an amount not to exceed Eighty Thousand Dollars ($80,000) which includes the bid cost of $75,000 plus other project-related contingency costs of $5,000.

Summary:
BNSF is expanding the Eola rail yard within the City of Aurora. The City is issuing the Stormwater Permit for the project and BNSF has identified their detention and compensatory storage on a parcel of land located in unincorporated Kane County. Because the project is being completed and permitted by the City of Aurora, we recommend the SSA, as required by the Stormwater Ordinance, be established by the City as any maintenance issues that may arise will be handled by the City.

APPROVING ESTABLISHMENT OF SPECIAL SERVICE AREA BY THE CITY OF AURORA FOR THE BNSF EOLA YARD IMPROVEMENTS
WHEREAS, the City of Aurora is a Certified Community under Article XI of the Kane County Stormwater Management Ordinance; and
WHEREAS, BNSF has proposed improvements to the Eola Railway Yard within the
corporate limits of the City of Aurora with a detention facility and compensatory storage basin located within an easement on a parcel of land in unincorporated Kane County (Document 2015K028417, a part of PIN 15-13-376-001) ; and
WHEREAS, pursuant to the provisions of Article VII, Section 7, Part (6) of the 1970
Constitution of the State of Illinois (the "Constitution") and the "Special Service Area Tax Law", 35 ILCS 200/27-5, et seq (2003) "a municipality may create a special service area within a municipality and the unincorporated area of a county or within another municipality when the county or other municipality consents to the creation of the special service area"; and
WHEREAS, in accordance with the Kane County Stormwater Management Ordinance,
Article VI - Long Term Maintenance Section 9-131, a special service area is required to be established as a" backup vehicle in the event that the person designated by the applicant as having primary maintenance responsibility fails to adequately carry out its duties."

Summary:
Pending final approval anticipated on 5/20/2016, the Illinois Housing Development Authority (IHDA) is expected to award $551,640.96 (five hundred fifty-one thousand, six hundred forty dollars and ninety-six cents) in federal Neighborhood Stabilization Funds to the Kane County Office of Community Reinvestment. The funds are from the third round of HUD’s Neighborhood Stabilization Program which is referred to as “NSP3”. The award will help finance the redevelopment of approximately four vacant/foreclosed homes in the City of Elgin’s Southwest Area Neighborhood. The neighborhood was identified by IHDA as having a high number of home foreclosures and was, therefore, determined to be a priority area for the NSP3 Program. Kane County’s NSP3 award will be matched with $363,075 (three hundred sixty-three thousand, seventy-five dollars) from Habitat for Humanity of Northern Fox Valley, which will help implement the award. A large portion of the NSP3 award will be received and expended during County Fiscal Year 2016, and the attached resolution amends the county’s budget to reflect the revenue and expenses expected during the fiscal year.

WHEREAS, said funds are known as “NSP3” funds and will be utilized to finance the

This resolution authorizes Kane County's participation in the National Association of Counties (NACo) Prescription Discount Card Program. The prescription discount card can be offered to all Kane County residents and permits holders of the card to receive a discount on prescription drugs at participating pharmacies. The card can be used by any Kane County resident who does not have prescription drug coverage or has a need for prescription drugs that are not covered by insurance. NACo operates the program as a turn-key operation by providing cards and marketing materials. There is no cost to either the Kane County Board for participating in the program or to residents for using the card. Kane County will receive a $1 marketing fee on all prescriptions that are filled using the card.

WHEREAS, Kane County is a member of the National Association of Counties (NACo); and WHEREAS, as a NACo member, Kane County has an opportunity to participate in the
NACo’s Live Healthy Prescription Discount Card Program; and WHEREAS, the Prescription Discount Card Program will help Kane County residents who
do not have prescription drug coverage or are struggling financially to pay out of pocket for their prescriptions by helping residents save money on prescriptions at an average savings of 24%; and
WHEREAS, there is no cost to Kane County or to the residents for using the Prescription
Discount Card. Residents simply use the card and it can be used to cover the entire family; and WHEREAS, the discounts are negotiated directly with participating pharmacies, over 68,000
pharmacies participate in the program and it is used by county residents in more than 1,400 counties; and
WHEREAS, Kane County has the option to receive a marketing fee reimbursement of $1 per
prescription filled for a county resident that receives a discount using his or her prescription discount card.
NOW, THEREFORE, BE IT RESOLVED the Kane County Board authorizes Kane County’s
participation in the NACo Prescription Discount Card Program and choose to receive the $1 per filled prescription marketing fee and authorizes the execution of a contract to make the program available to Kane County residents. The Kane County Finance Director is directed to set up an account to receive the marketing fee, which will be used for purposes designated by the County Board.

Since 2005, Kane County has been the lead entity of the Kane-Elgin HOME Consortium, a city-county partnership formed for the purpose of receiving federal HOME Investment Partnership Program funds from the U.S. Department of Housing and Urban Development. Annually, the Consortium receives approximately $600,000 (Six hundred thousand dollars) under the HOME Program (Fund 402). HOME funds are used to provide housing rehabilitation assistance to area homeowners, down payment and closing-cost assistance to first-time home buyers, and financing for the development of affordable homeowner and rental housing. Under the HOME Program, the Consortium must be renewed every three years. The attached resolution authorizes the execution of a new Consortium Agreement with the City of Elgin for Federal fiscal years 2017-2019.

WHEREAS, HOME funds are used to address housing needs in the City of Elgin, the
twenty-four municipalities that participate in the Kane County Community Development Program, and unincorporated Kane County; and
WHEREAS, the term of the current Consortium Agreement is for a three-year period and will
expire at the end of Program Year 2016 on May 31, 2017; and WHEREAS, it is necessary at this time to execute a new Consortium Agreement in order to
renew the Kane-Elgin HOME Consortium and to continue participation in the HOME Program; and WHEREAS, the residents of Kane County and the City of Elgin will benefit from the renewal
of the Kane-Elgin HOME Consortium. NOW, THEREFORE, BE IT RESOLVED that the Kane County Board Chairman and/or the

AUTHORIZING AGREEMENTS WITH KANE COUNTY MUNICIPALITIES FOR ANIMAL CONTROL AGREEMENTS
WHEREAS, the County of Kane ("Kane County") is a body politic and corporate duly organized and existing under the Constitution and laws of the State of Illinois; and
WHEREAS, pursuant to Article VII Section 10 of the Constitution of the State of Illinois and Section 3 of the Illinois Intergovernmental Cooperation Act, 5 ILCS 220/3 (2006), units of local government are authorized and empowered to enter into agreements to obtain and share services and to exercise jointly or transfer any powers or functions not prohibited by law; and
WHEREAS, Kane County has heretofore provided certain services to municipalities within or partly within Kane County with respect to animal control, pursuant to the Illinois Animal Control Act, 510 ILCS 5/1 et seq; and
WHEREAS, Kane County pursuant to the Animal Control Act, 510 ILCS 5/ 1 et seq. (the "Act") has certain rights, duties and obligations with respect to rabies control and registration of dogs and cats on a county-wide basis, and also has primary responsibility for animal control activities within unincorporated Kane County; and
WHEREAS, the Municipalities have the primary responsibility for animal control activities within their corporate limits; and
WHEREAS, certain municipalities lying within or partly within Kane County desire to contract with the County to discharge these responsibilities; and
WHEREAS, Metro West Council of Government has facilitated negotiations between Kane County and the various municipalities of the County interested in contracting for animal control services.
WHEREAS, pursuant to Kane County Board Ordinance 13-116, passed May 14, 2013, Kane County is ready, willing and able to contract with the municipalities of Kane County to provide them with animal control services, including but not limited to pick-up of animals running at large, sick or injured dogs and small, wild mammals such as skunks, raccoons, and bats and providing housing and adoption services for animals in its custody to the best of its ability.

public-private partnership agreement. The assessment will determine the number of direct and
indirect jobs created with the development and operation of the facility, the economic multiplier
effect from food hub purchases from farmers and facility revenues, and the fiscal impact of

WHEREAS, Kane County has determined a need for a detainee telephone and video visitation system; and
WHEREAS, the Kane County Board and Inmate Calling Solutions, LLC (IC Solutions)
entered into an agreement dated June 15, 2012, for the management of detainee telephone/video visitation system; and
WHEREAS, the parties desire to amend the provisions of the agreement effective June 15,
2016 (a copy of which is on file with the County Clerk's Office). NOW, THEREFORE, BE IT RESOLVED by the Kane County Board and the Chairman
thereof is authorized to enter into a one (1) year extension of the current contract term with Inmate Calling Solutions, LLC to commence on June 15, 2016 until June 14, 2017.

Summary:
This resolution is for a food provider for the Juvenile Justice Center. There is a need for adequate food supplies and proper nutritional values for all residents in the facility. Bids were solicited to hire a new food provider since the current contract with three (3) food providers expires July 31, 2016. Sysco Chicago Inc. was the low bidder and is a current provider. This is a one year contract with three (3) one (1) year renewal options to extend. There is currently $135,000.00 in the JJC line item for food. Last year, food resolution 15-197 was approved for $173,476.68. At that time, the JJC felt as though the difference could be absorbed in the budget and would return to ask for funding in the fall if needed. It appears as though the JJC will be able to make it through the current year without asking for additional funding to cover the food line item. This new resolution is for $179,477.57. This is $6000.89 more than the approved resolution 15-197, from last year. It appears that the JJC may again, be able to possibly absorb the overage elsewhere in the budget. The JJC is requesting to attempt to absorb the additional cost elsewhere in the budget, with the understanding that if additional funding is needed, that request would be presented in the fall. This is a request for the approval of the award of this contract to Sysco Chicago Inc. for a one year term for the amount of $179,477.57.

WHEREAS, bids were solicited to food providers for providing Breads, Milk, Meat & Chicken, Dry Goods and Bulk Food & Miscellaneous Supplies to the Juvenile Justice Center; and
WHEREAS, the lowest responsible bidder was Sysco Chicago Inc; and
WHEREAS, adequate funds have been budgeted for these purchases in fund 001.430.436.60230.
NOW, THEREFORE, BE IT RESOLVED by the Kane County Board that the Chairman
thereof is hereby authorized to enter into a one (1) year contract with Sysco Chicago Inc. The contract term shall be for one (1) year starting August 1, 2016, through July 30, 2017, or date of contract execution, with three (3) one (1) year renewal options. Expenditures to be charged to 001.430.436.60230, which has been budgeted for One Hundred Seventy-Nine Thousand, Four Hundred Forty-Seven Dollars and Fifty-Seven Cents ($179,477.57)

Summary:
Through an agreement with the Kane County Regional Superintendent of Schools, the Chief Judge of the Sixteenth Judicial Circuit, St. Charles School District No. 303 and the County of Kane, educational services are provided for the residents of the Juvenile Justice Center. The educational services at the Juvenile Justice Center have been provided by the Regional Superintendent since the opening of the Juvenile Justice Center. APPROVAL OF AGREEMENT TO PROVIDE EDUCATIONAL SERVICES AT THE KANE COUNTY JUVENILE JUSTICE CENTER
WHEREAS, the Kane County Regional Superintendent of Schools (“Regional
Superintendent”), the Chief Judge of the Sixteenth Judicial Circuit (“Chief Judge”), St. Charles
School District No. 303 (“School District”), and the County of Kane (together “Participants”), have all
expressed a desire to provide educational services for residents of the Kane County Juvenile
Justice Center (“JJC”) pursuant to the provisions of the Agreement to Provide Educational Services
at the Kane County Juvenile Justice Center (“Agreement”); and
WHEREAS, the County of Kane must provide educational services at the JJC pursuant to
55 ILCS 75/2.1; and
WHEREAS, educational services at the JJC have been provided by the Regional
Superintendent in cooperation with the Chief Judge and Court Services since the opening of the
JJC; and
WHEREAS, the Participants agree the Regional Superintendent should continue to be
responsible for the educational services at the JJC; and
WHEREAS, School District desires the Regional Superintendent continue to provide
educational services at the JJC; and
WHEREAS, the Regional Superintendent, School District, and the Chief Judge shall agree
to be responsible for certain duties with respect to said educational services pursuant to the terms
and provisions of the Agreement; and
WHEREAS, it is anticipated the costs of operating said educational program shall be
covered by reimbursements from the State; and
WHEREAS, the Participants have determined it is in their respective best interests to enter
into the Agreement to provide said educational services to the residents of the JJC. The term of
this agreement shall be for a period of three (3) years, commencing on July 22, 2016 and ending
July 22, 2019. This agreement shall be reviewed to determine continuance at the end of three (3)
years.
NOW, THEREFORE, BE IT RESOLVED by the Kane County Board that the Regional
Superintendent is hereby authorized to operate said educational services at the JJC, including, but
not limited to, hiring necessary teaching personnel.
BE IT FURTHER RESOLVED by the Kane County Board that the Chairman of the Kane
County Board be directed and is hereby authorized to enter into the Agreement, to be reviewed at
the end of three years.

Summary:
Summary: This is an annual resolution that is required by the property tax code to authorize the Chairman to appoint additional members to the Board of Review to assist the full three-member Board with the task of hearing property assessment complaints in a timely manner. To qualify for such appointment, a person would need to have passed an examination administered by the Illinois Department of Revenue and have "experience and training in property appraisal and property tax administration" as required by 35 ILCS 200/6-5. Please note that this resolution does not actually make the appointments, but authorizes the County Board Chairman to make the appointments. If approved, the Chairman could appoint some or all of the following residents who meet these qualifications and have expressed an interest in serving in this capacity: Michelle Abell, Aurora; Carlo Capobianco, West Dundee; James R. APPOINTING ADDITIONAL MEMBERS TO BOARD OF REVIEW
WHEREAS, the Illinois Property Tax Code requires that the Board of Review in every County under township organization consist of three members, regardless of parcel county or workload (35 ILCS 200/6-5, et seq.); and
WHEREAS, the Kane County Board of Review holds numerous hearings on assessment
complaints each year and must complete its work in a timely manner so that real estate tax bills can be mailed on time; and
WHEREAS, the Kane County Treasurer reports that cost of late real estate tax bills can
exceed $10,000 per day; and WHEREAS, the Illinois Property Tax Code provides that in such circumstances, a County
Board may declare by resolution that the number of complaints filed with a Board of Review creates an "emergency situation" and causes the need for additional members of the Board of Review so that it may complete its work in a timely manner; and
WHEREAS, the Illinois Property Tax Code provides when the County Board adopts such a
resolution, the Chairman of the County Board may appoint additional qualified members to the board of review to hold separate hearings on complaints.
NOW, THEREFORE, BE IT RESOLVED that an emergency situation, as defined by the
Illinois Property Tax Code, exists for the 2016 taxable year and the Chairman of the County Board may appoint additional qualified members to the Board of Review to hold separate hearings on complaints so that the Board of Review may complete its work in a timely manner.

APPROVING ADOPT-A-HIGHWAY PROGRAM APPLICANTS
WHEREAS, the Illinois Highway Code of the Illinois Compiled Statutes (605 ILCS 120/1 et seq.) provides for the establishment of Adopt a Highway Programs by counties and various units of government throughout the State of Illinois to support anti-litter efforts by allowing groups of private citizens to adopt a segment of highway for the purpose of litter and refuse collection; and
WHEREAS, the County has enacted and otherwise established, pursuant to Kane County Board Ordinance No. 13-267, the Kane County Adopt-A-Highway Program in conformance with the Illinois Highway Code, which program is intended to assist the County in its efforts to remove refuse and litter from County highway right of way and otherwise beautify the County Highway System; and
WHEREAS, those groups whose names are set forth in the list below (a copy of which is on file in the office of the Kane County Clerk) have submitted applications for participation in the Kane County Adopt-A-Highway Program; and
WHEREAS, each of the groups’ applications have been reviewed and approved by the County Engineer of Kane County and have subsequently been approved by the Transportation Committee of the Kane County Board; and
WHEREAS, the approval of the applicants for participation in the Kane County Adopt-A-Highway Program will facilitate the County’s litter collection efforts on County highways and will aid in the beautification of all County highways whether in urban or rural areas of the County.

Summary:
The Kane Kendall Council of Mayors receives federal transportation planning funds to perform various planning and programming activities for Kane County, Kendall County and a portion of southeast Dekalb County. The Chicago Metropolitan Agency for Planning (CMAP) directs these funds to the Kane County Division of Transportation in order that the County may continue to provide transportation planning staff to the Kane Kendall Council of Mayors and CMAP for regional coordination and planning activities. Primary staff for the Council of Mayors and CMAP coordination include: Tom Rickert - Executive Director Jennifer Becker - Council Director & County Transit Planner/Ride in Kane Manager Patrick Knapp - Regional Planning Liaison & County Bicycle/Pedestrian Planner Jackie Forbes - Regional Planning Liaison Our regional planning staff facilitates strategic participation by local officials in the region's transportation process as required by the federal FAST Act and the Regional Planning Act. Staff also supports the Council of Mayors by providing Surface Transportation Program (STP - over $8 Million annually) and Congestion Mitigation and Air Quality (CMAQ) program development and monitoring, and provides general liaison services, technical assistance, and communications assistance. The agreement is for July 1, 2016 to June 30, 2017.

APPROVING AN AGREEMENT FOR TRANSPORTATION PLANNING ACTIVITIES AND REGIONAL PLANNING LIAISON SERVICES
WHEREAS, the Council of Mayors Program of the Chicago Metropolitan Agency for Planning (CMAP) was established to provide a forum for early public involvement and partnerships in regional transportation planning efforts, to provide federal programming assistance to local agencies, and to assist with project development at the local and regional level in northeastern Illinois; and
WHEREAS, CMAP’s Kane Kendall Council of Mayors is comprised of duly elected local officials as defined in the Federal Highway Acts of 1970, 1973, and 1976, the Surface Transportation Assistance Acts of 1978, 1982, 1987, the Intermodal Surface Transportation Efficiency Act of 1991, the Transportation Equity Act for the 21st Century, the Safe, Accountable, Flexible, and Efficient Transportation Equity Act, the Moving Ahead for Progress in the 21st Century Act, and Fixing America's Surface Transportation Act (FAST) which Council of Mayors represent thirty-seven (37) municipalities in Kane, Kendall and southeast DeKalb Counties; and
WHEREAS, the Kane Kendall Council of Mayors receives federal transportation funds through CMAP which it utilizes to retain professional staff assistance from the County of Kane in order to provide effective planning liaison with various regional planning and transportation agencies, to supply professional technical assistance to local units of government in order to develop and administer an annual Surface Transportation Program of over Eight Million Dollars ($8,000,000) and to perform planning and programming activities for the region; and
WHEREAS, the Kane Kendall Council of Mayors desires to continue to receive professional staff assistance from the County of Kane and requests that the County of Kane by and through the Kane County Division of Transportation continue to employ transportation planning professionals to provide said assistance; and
WHEREAS, it is deemed to be in the best interests of the residents of Kane County that the County of Kane enter into an agreement for regional planning liaison services with CMAP (a copy of which is on file in the County Clerk’s office).
NOW, THEREFORE, BE IT RESOLVED that the Chairman of the Kane County Board is hereby authorized to execute an agreement with the Chicago Metropolitan Agency for Planning (CMAP) for FY2017 Regional Planning Liaison Services.

Summary:
As part of the ongoing Kane County Road Improvement Impact Fee Ordinance update, the County held a Public Hearing on April 19th for public consideration of the proposed 2015 and 2026 Land Use Assumptions. The materials presented at the Public Hearing included several boards explaining the Ordinance update process, tables showing the household, population and employment data by township, and maps showing density data by Traffic Analysis Zones (TAZs) boundaries. The Land Use Assumptions were developed based upon CMAP’s 2040 socioeconomic data adopted in October 2014 and CMAP’s 2015 estimates. CMAP is the regional agency responsible for developing regional forecasts. 19 attendees were present at the hearing, representing the County Board, muncipalities, developers and public. Based upon consideration of the comments received, the Impact Fee Advisory Committee, County staff and our consultant team modified the 2026 Land Use Assumptions as presented at the Public Hearing by approximately 4% lower for household and population, and 3% lower for employment based on using best fit curve analysis to account for near-term growth trends. On May 11, 2016, the Impact Fee Advisory Committee unamimously agreed to:
· Accept the modified land use assumptions, and · to forward a recommendation to the County Board to adopt the modified Land Use
Assumptions Thereafter, in accordance with State Statute 605 ILCS 5/5-901, the unit of local government (the County Board) shall have not less than 30 days nor more than 60 days to approve, disapprove or modify by ordinance or resolution the Land Use Assumptions proposed at the Public Hearing and the recommendations made by the Impact Fee Advisory Committee. Staff request consideration to approve, disapprove or modify the 2015 and 2026 Land Use Assumptions presented at the Public Hearing and to further consider the recommendation from the Impact Fee Advisory Committee to accept the modified land use assumptions.

ADOPTING THE LAND USE ASSUMPTIONS ASSOCIATED WITH THE IMPOSITION OF IMPACT FEES
WHEREAS, the Road Improvement Impact Fee Law (605 ILCS 5/5-901 et. seq.) requires the adoption of land use assumptions to be utilized to develop the Comprehensive Road Improvement Plan associated with the imposition of road improvement impact fees; and
WHEREAS, the Road Improvement Impact Fee Law requires the Kane County Board to
approve, disapprove, or modify by resolution the land use assumptions proposed at the public hearing held to consider land use assumptions and the recommendations made by the Kane County Road Improvement Impact Fee Advisory Committee in relation to said land use assumptions; and
WHEREAS, the County has heretofore on April 19, 2016, conducted a public hearing on the
proposed Land Use Assumptions in the manner provided and required by law; and WHEREAS, the Advisory Committee has approved and recommended the adoption of the
modified land use assumptions as required by statute. NOW, THEREFORE, BE IT RESOLVED by the Kane County Board that the modified Land
Use Assumptions for year 2015 through the year 2026 as attached are hereby approved and adopted for the development of the Comprehensive Road Improvement Plan required for the imposition of road improvement impact fees.

Summary:
The Randall Road at Weld Road / US 20 intersection improvement Phase I study has
determined the preferred alternative to be a free flow right-turn ramp from northbound Randall
Road to eastbound US 20. An auxiliary lane is proposed along US 20 to accommodate the
merging traffic from the proposed access ramp and the existing eastbound loop ramp traffic with
eastbound US 20 through traffic. The auxiliary lane widening has resulted in the need for a
retaining wall to minimize impacts to the adjacent frontage road, Weld Road, and to Otter Creek.
In particular, the retaining wall adjacent to Otter Creek is in excess of 10 feet in height and
therefore requires a Type, Size and Location (TS & L) study to be reviewed and approved by
the IDOT Central Office Bureau of Bridges and Structures.

WHEREAS, the County of Kane is authorized by law pursuant to 605 ILCS 5/5-801 (1992) to acquire by negotiated purchase or eminent domain proceedings, real property for highway purposes; and
WHEREAS, the County of Kane has exclusive jurisdiction over Kane County Highway No. 78,
also referred to as Bliss Road, within the boundaries of the County of Kane; and WHEREAS, the County of Kane deems it necessary and appropriate to improve the Bliss
Road Bridge over Blackberry Creek; and WHEREAS, Bliss Road Bridge over Blackberry Creek and the planned improvements have
been surveyed, laid out and projected over certain lands situated in Kane County, Illinois. It is deemed by the County of Kane that certain parcels of land, and in particular those parcels described herein as Exhibits A, B and C (which are on file with the County Clerk of Kane County and incorporated herein, and made a part hereof), located within the limits of the County of Kane, should be acquired by negotiated purchase or eminent domain proceeding for highway purposes.
NOW, THEREFORE, BE IT RESOLVED by the Kane County Board:
1. That it is hereby determined by the County Board of Kane that the property described
herein in Exhibits A, B and C be used, occupied and improved for highway purposes in a manner
necessary and convenient for public use.
2. That it is further hereby determined that it is necessary and proper that the County of Kane

3. That the County Engineer of the County of Kane or his duly authorized representative are
hereby authorized, empowered and directed to negotiate, for and on behalf of the County of Kane, with
any and all owners of the property described herein or with any other individual possessing an interest
therein for the purchase thereof upon such terms and conditions as shall be approved by the
Transportation Committee of the Kane County Board.

4. In the event the County of Kane is unable to agree with the owner, (or owners), or any other
party having an interest in the land(s) described herein, regarding the compensation to be paid for said
property, then to the extent allowed by law, the County of Kane shall institute proceedings to acquire

the State of Illinois. The County of Kane hereby directs its attorney to institute eminent domain
proceedings in a court of competent jurisdiction to acquire title to and possession of the real property in

AUTHORIZING THE USE OF JOINT ADULT DRUG COURT GRANT FUNDS AND CONTRACTS WITH GATEWAY FOUNDATION, LUTHERAN SOCIAL SERVICES AND
WOODRIDGE INTERVENTIONS
WHEREAS, the Kane County Drug Rehabilitation Court has received a grant from the Substance Abuse and Mental Health Services Administration (SAMHSA) for Three Hundred Twenty Thousand Three Hundred and Sixty-Five Dollars ($320,365) for year two of the grant, to enhance programming for non-violent offenders with substance dependence and co-occurring (substance dependence accompanied by a mental health diagnosis) with issues by providing supplementary services; and
WHEREAS, receipt of said grant will require entering into contract for residential substance
abuse treatment services with Gateway Foundation, Aurora at the rate of Three Hundred and Fifty Dollars ($350) per diem, Lutheran Social Services, Elgin at the rate of Two Hundred and Forty Dollars ($220) per diem and Woodridge Interventions, Woodridge at the rate of One Hundred and Fifty Dollars ($150) per diem with the total expenditure being no more than Two Hundred Sixty-Two Thousand Eight Hundred Forty-Two Dollars ($263,842) for all three together.
NOW, THEREFORE, BE IT RESOLVED that the Kane County Board authorizes use of joint
Adult Drug Court Grant funds to enter into contracts with Gateway Foundation, Lutheran Social Services and Woodridge Interventions. The County Board Chairman thereof be, and herby is, authorized to accept the contracts between the Kane County Adult Drug Court of year two February 28, 2016 through February 28, 2017 for the amount of, not to exceed Two Hundred Sixty-Three Thousand Eight Hundred Forty-Two Dollars ($263,842).

Summary:
This resolution is done annually to establish the prevailing wage rates for laborers, mechanics and other workers employed on public works projects in the locality of Kane County. Any and all revisions of the prevailing wage rates, by the Department of Labor of the State of Illinois, shall superseded the June determinations and apply to any public works projects. Attached is the resolution for the establishing the Kane County prevailing wage rates in compliance with the Prevailing Wage Act and summary of July 2015 wage rates. These rates require committee approval to establish the County prevailing wage rate.

ESTABLISHING KANE COUNTY PREVAILING WAGES 2016
WHEREAS, the State of Illinois has enacted "an Act regulating wages of laborers,
mechanics and other workers employed in any public works by the State, County, City or any public
body or any political subdivision or by anyone under contract for public works,"820 ILCS 130/0.01
et. seq., as amended (hereinafter referred to as "the Act"); and
WHEREAS, the aforesaid Act requires that the County of Kane investigate and ascertain
the prevailing rate of wages as defined in said Act for laborers, mechanics and other workers in the
locality of said County employed in performing construction of public works, for said County; and
NOW, THEREFORE, BE IT RESOLVED by the County Board that:
Section 1: To the extent and as required by "the Act", the general prevailing rate of
wages in this locality for laborers, mechanics and other workers engaged in construction of public
works coming under the jurisdiction of Kane County is hereby ascertained to be the same as the
prevailing rate of wages for construction work in this County as determined by the Department of
Labor of the State of Illinois as of June of the current year, a copy of that determination being
attached hereto and incorporated herein by reference. As require by said Act, any and all revisions
of the prevailing rate of wages by the Department of Labor of the State of Illinois shall supersede
the Department's June determination and apply to any and all public works construction undertaken
by Kane County. The definition of any terms appearing herein which are also used in aforesaid Act
shall be the same as in said Act.
Section 2: Nothing herein shall prohibit the County of Kane from investigating and
ascertaining the prevailing rate of wages for categories of workers not expressly covered by the
published determination of the Department of Labor, nor prohibit incorporating those rates so
ascertained into the published determination of the Department of Labor, provided that those rates
ascertained by the County shall be clearly indicated as such.
Section 3: Kane County and/or its authorized representatives shall have the power and
authority to request and receive any and all information or documentation, which would substantiate
proper payment under this resolution. The contract recipient shall supply the requested
documentation or information to Kane County or its designee within five working days of the receipt
of the request. Failure to comply with the request for information or documentation will be construed
as a material breach of the contract enabling the County to terminate the contract, seek forfeiture of
any performance bond, and proceed with any other remedy against the contractor at law or in
equity.
Section 4: Nothing herein contained shall be construed to apply said general prevailing

rate of wages as herein ascertained to any work or employment except public works construction of
Kane County to the extent required by the aforesaid Act. the aforesaid Act requires that the County
of Kane investigate and ascertain the prevailing rate of wages as defined in said Act for laborers,
mechanics and other workers in the locality of said County employed in performing construction of
public works, for said County.
Section 5: The County Clerk shall publicly post or keep available for inspection by any
interested party in the main office of the County Clerk this determination or any revisions of such
prevailing rate of wages. A copy of this determination or of the current revised determination of
prevailing rate of wages then in effect shall be attached to all contract specifications.
Section 6: The County Clerk shall mail a copy of this determination to any employer and
to any association of employers and to any person or association of employees who have filed their
names and addresses, requesting copies of any determination stating the particular rates and the
particular class of workers whose wages will be affected by such rates.
Section 7: The County Clerk shall promptly file a certified copy of this Resolution with
both the Secretary of State Index Division and the Department of Labor of the State of Illinois.
Section 8: The County Clerk shall cause to be published in a newspaper of general
circulation within the area a copy of this Resolution, and such publication shall constitute notice that
the determination is effective and this is the determination of this public body. (See attached rates.)

The grouting, cleaning, and polishing of all classes of tile, whetherfor interior or exterior purposes, all burned, glazed or unglazedproducts; all composition materials, granite tiles, warning detectabletiles, cement tiles, epoxy composite materials, pavers, glass,mosaics, fiberglass, and all substitute materials, for tile made intile-like units; all mixtures in tile like form of cement, metals, andother materials that are for and intended for use as a finished floorsurface, stair treads, promenade roofs, walks, walls, ceilings,swimming pools, and all other places where tile is to form a finishedinterior or exterior. The mixing of all setting mortars including butnot limited to thin-set mortars, epoxies, wall mud, and any othersand and cement mixtures or adhesives when used in the preparation,installation, repair, or maintenance of tile and/or similar materials.The handling and unloading of all sand, cement, lime, tile,fixtures, equipment, adhesives, or any other materials to be used inthe preparation, installation, repair, or maintenance of tile and/orsimilar materials. Ceramic Tile Finishers shall fill all joints andvoids regardless of method on all tile work, particularly andespecially after installation of said tile work. Application of anyand all protective coverings to all types of tile installationsincluding, but not be limited to, all soap compounds, paper products,tapes, and all polyethylene coverings, plywood, masonite, cardboard,and any new type of products that may be used to protect tileinstallations, Blastrac equipment, and all floor scarifying equipmentused in preparing floors to receive tile. The clean up and removal ofall waste and materials. All demolition of existing tile floors andwalls to be re-tiled.

Landscaping work falls under the existing classifications for laborer,operating engineer and truck driver. The work performed by landscapeplantsman and landscape laborer is covered by the existingclassification of laborer. The work performed by landscape operators(regardless of equipment used or its size) is covered by theclassifications of operating engineer. The work performed bylandscape truck drivers (regardless of size of truck driven) iscovered by the classifications of truck driver.
MATERIAL TESTER & MATERIAL TESTER/INSPECTOR I AND II
Notwithstanding the difference in the classification title, theclassification entitled "Material Tester I" involves the same jobduties as the classification entitled "Material Tester/Inspector I".Likewise, the classification entitled "Material Tester II" involvesthe same job duties as the classification entitled "MaterialTester/Inspector II".

APPROVING SETTLEMENT OF CLAIM ND IL CASE NO. 15 CV 9250
WHEREAS, there is currently pending in the United States District Court for the Northern District of Illinois the matter of Prison Legal News v. County of Kane, et al., 15 CV 9250 (the “Litigation”); and
WHEREAS, the parties to the Litigation have agreed it is in the best interests of all parties to
settle the Litigation and all other known and unknown claims of Plaintiff in that action and to avoid the costs associated with protracted litigation; and
NOW, THEREFORE, BE IT RESOLVED by the Kane County Board, that it hereby approves
settlement of the aforementioned matter, Prison Legal News v. County of Kane, et al., Case No. 15 CV 9250, in the amount of Seventy-Five Thousand Dollars ($75,000), inclusive of attorneys’ fees and costs, to be paid as per the settlement agreement agreed to by the parties, in exchange for a full release of known and unknown claims, which are existing as of the date of the execution of a settlement agreement, and which may be asserted by Prison Legal News against the County of Kane, its elected officials, including the Kane County Sheriff, and their respective employees, representatives and agents.
BE IT FURTHER RESOLVED by the Kane County Board that the Chairman of the Kane
County Board or a representative of the Kane County State’s Attorney’s Office is hereby authorized and delegated the authority to sign any and all settlement documents in the aforementioned matter consistent with the terms set forth herein.
