The foundation National Anti Doping Agency of Germany (NADA) is the relevant institution for clean sport in Germany. It works nationally and internationally to promote fairness, transparency and equal opportunities for all athletes. Its tasks comprise implementation of a standardised testing programme for Germany, execution of education and doping preven-tion measures, issuing Therapeutic Use Exemptions and answering medical inquiries, providing legal advice for federa-tions and athletes, as well as international cooperation. NADA thus essentially contributes to preserving value in sports.

In July 2002, NADA was founded with a festive act in the Old City Hall of Bonn and has been recognised by the foundati-on supervisory authority on 21st November in the same year. Since then, it has been pursuing its valuable mission and supports the athletes who honestly pursue their sport. As a non-profit foundation under public law, financed according to the stakeholder model, it is an independent body. NADA opposes doping in sports nationally and internationally alike. For the future of sport. For Germany as a sport nation. For clean athletes, for transparent success and honest results.

FOR CLEAN PERFORMANCE – this is NADA’s vision. This is what brought the initiative „GIVE EVERYTHING, TAKE NOTHING“ to life. It serves as a platform for everyone who wants to commit to the cause of clean sport.

ENSURING EQUAL OPPORTUNITIES TOGETHER

The year 2018 has once again proven that the work of our National Anti Doping Agency of Germany remains indispensable for a socially shared vision of equal opportunities in clean competitions. In September 2018, the Russian Anti-Doping Agency (RUSADA) was declared compliant again after a lengthy clarification and decisi-on-making process in one of the biggest doping scandals in sports history. Since not all the criteria laid down by the World Anti-Doping Agency (WADA) for this re-approval were implemented, the clean athletes in particular were once again disappointed and the credibility of a control system based on the principle of equal treatment was questioned. Clean athletes suffer from the decisions in anti-doping management that directly affect them in their everyday training and competition. The work of a National Anti-Doping Organisation (NADO), which is also compre-hensibly independent for them, is therefore essential and particularly important for fair competition. NADA Germany is still committed to eliminating manipu-lative ways of influencing the testing system and conflicts of interest.

Politicians should engage and contribute to international anti-doping management. In Germany, this cooperation has enabled the criminal law basis of the Anti-Doping Act to be established. The recent cases in Seefeld (Austria) and Erfurt illustrate how profitable this cooperation is. As the athletes are at the centre of NADA‘s anti-doping work, their involvement in committees and decisi-on-making processes of national and international anti-doping work is essential. NADA supports the initia-tives of clean athletes to clearly describe their rights in WADA‘s Athletes Rights Charter and efforts to improve independent anti-doping work worldwide. NADA continues its uncompromising commitment to a fair doping-free sport in the service of clean athletes. The Supervisory Board considers it its duty to continue to support NADA Germany to the best of its ability on its way to promoting and preserving the values of sport in the future.

Optimised control planningBased on the International Standard for Testing and Investigations (ISTI) and the WADC, respectively, as well as current scientific research, test planning was scienti-fically described and optimized within the department. In- and out-of-competition tests, which were previous-ly managed separately, are now bundled according to sport and discipline. Under the keyword „interla-cing“, the individual sporting development of athletes inside and outside the competition can thus be observed and assessed more effectively, area-wide and specifi-cally by the respective NADA test planning experts.

Re-Analyses of long-term stored samplesIn 2018, the department Testing Programme re-analysed all long-term stored samples of 2011 and 2012. The samples were re-analysed for long-term metaboli-tes of the anabolic steroids oxandrolone, dehydrochlo-romethyltestosterone, metandienone and stanozo-lol as well as selected SARMs*, available peroxiso-me proliferator-activated receptor gamma agonists and effect-like substances, selected HIF* complex stabili-sers as well as GHRPs*, GHSs* and GnRHs*. Among the 560 analysed samples of German athletes from out-of- and in-competition, no evidence of the presence of any of the above-mentioned prohibited substances was found according to the latest analytical methods.

International exchangeThe department can rely on the advice of high-level representatives from (applied) science, research, theory and practice to develop innovative test models within the framework of regular commission meetings. In additi-on, international experts from the field of „test planning“ met for the first time in Bonn in 2018 at the invitation of NADA to shed light on current challenges, critically assed the different issues and developed solutions. In particu-lar, the focus was on the scientific advancement of the testing systems. Innovative approaches from the areas of „performance monitoring“, „risk assessment“, „sampling equipment/matrices“ and other essential topics of test planning were transferred into practice and proven.

International cooperationIn cooperation with the responsible international profes-sional federations, NADA carried out the tests during the competitions at the World Triathlon Series in Hamburg, the Shorttrack European Championship in Dresden and the Wheelchair Basketball World Championship in Hamburg, among others in 2018. In the summer of 2018, NADA also coordinated the control activities for the cycling stage race „Deutschland Tour“ with the participa-tion of international elite cyclists. In 2018, tests of German athletes also took place during stays abroad in Australia, Austria, Belgium, Denmark, Ethiopia, France, Great Britain, Czech Republic, Greece, Hungary, Italy, Japan, Liechtenstein, Mexico, New Zealand, Norway, Poland, Portugal, Russia, Sweden, South Africa, Spain, Switzer-land, Thailand, the Netherlands and the United States of America.

LEGAL MATTERS

Results management and disciplinary proceedingsIn 2018, NADA‘s legal department initiated 69 results management proceedings for possible violations of anti-doping regulations. Of these, NADA initiated arbitra-tion proceedings before the German Arbitration Institute (DIS) in 21 cases. Eight of the proceedings initiated by NADA have so far resulted in a sanction. In 20 cases, NADA filed a complaint with the responsible public prosecutor‘s office.

New and updated standardsSince April 1st, 2018, the new WADA code compliance standard has been in force. This will make it possible in future for WADA to pronounce clear and unambiguous consequences against organisations and countries that do not implement the WADC requirements. Furthermore, the standard for data protection was adapted to the requirements of the General Data Protection Regulation (GDPR) as well as the changes made by WADA to the International Standard for the Protection of Privacy and Personal Information (ISPPPI).

WADC review processIn order to meet current requirements, the World Anti- Doping Code (WADC) will be revised for the year 2021. To this end, WADA established a two-year, multi-stage revisi-on process. The stakeholder consultation phase began in 2018. NADA has also submitted proposals for amendments that deal in particular with clarifications to improve the implementation of the existing regulations.

Evaluation of the NADCOn behalf of NADA, the Institute for Sports Law of the German Sports University Cologne conducted a fact- based evaluation of the National Anti-Doping Code (NADC) 2015. The results were presented in a panel discussion at the 8th Cologne Sports Law Evening. At the beginning of 2019, NADA assigned the Institute with the continuation of the evaluation in order, among other things, to develop proposals for the optimisation of the daily application of the NADC.

Cooperation with Sportradar AGIn the future, NADA will cooperate with Sportradar AG within the scope of its Intelligence & Investigations work. Sportradar supports NADA in the area of investigation and determination of doping relevant facts by investigative measures, especially in the areas of network research and case analyses as well as due diligence, risk and compli-ance analyses.

International CooperationIn March 2018, NADA‘s Intelligence & Investigations team participated in a WADA meeting on „Anti-Doping Investi-gation“ in Helsinki, Finland. Representatives of National Anti-Doping Organisations, international sports associa-

tions, INTERPOL and WADA exchanged views on current innovations in investigative work.

„SPEAK UP“ - NADA‘s whistleblower systemOnly five whistleblower systems worldwide work with an encryption technique and maintain the anonymity of the whistleblower during further contact. The „SPEAK UP“ whistleblower system of NADA is one of them. This result was published by Leeds Beckett University in the report „Global Whistleblowing Landscape for Reporting Doping in Sport“ on behalf of WADA.

NADA held its fourth workshop for investigative authorities in Bonn in November 2018. Around 40 public prosecutors and investigators from customs authorities, the Federal Criminal Police Office, the state offices of criminal investigation and individual police stations came together to exchange experiences.

Advisory and information servicesWithin the framework of daily telephone consultation hours, the medical department advised on a total of 1,081 enquiries regarding doping-free treatment possibilities in the event of illness and health complaints. In addition, the medical department published the German translation of WADA‘s Prohibited List, the NADA „MediCard“ as well as the „Example List of Permitted Pharmaceuticals“. The medical database NADAmed and the e-learning program-me for medical personnel complement the department‘s range of information.

Training seriesThe department strengthened the skills of pharmacists, doctors and medical staff with nationwide presentations in order to sustainably support them in their role for clean sport. In 2018, NADA‘s medical department attended further training courses for pharmacists at the Regional Chamber of Pharmacists for Saxony and the Pharma-cists‘ Chamber of Saxony-Anhalt as well as at PHOENIX Pharma SE in March 2019. The department also provided information at medical and physiotherapist conferences of the German Olympic Sports Confederation (DOSB), the German Athletics Federation (DLV), the Olympic Centre Rhineland and the Association of Physicians in Germany (Verbandärzte Deutschland e.V.).

PREVENTION

Evaluation of NADA‘s prevention programmeBetween August 2015 and December 2017, the Institute for Pedagogy of the German Sports University Cologne evaluated the activities and offerings of NADA‘s preven-tion programme „TOGETHER AGAINST DOPING“. As a result, development potentials as well as recommenda-tions for action were expressed, which support NADA‘s prevention experts in the further development of NADA‘s target groups.

ADO-Workshop in BonnIn 2018, NADA organised a two-day workshop for the first time in Bonn for the anti-doping officers (ADOs) of the federations within the DOSB, during which the role of the ADO in anti-doping work was discussed.

Public relationsIn press briefings and conferences in 2018, NADA pro-vided further information on its anti-doping work. The annual press conference in Berlin in June 2018 focused on the presentation of the annual figures. During the journalists‘ workshop in October 2018, NADA gave the participants insights into its work to support their media coverage. In the concluding discussion round, Claudia Bokel (FairSport), Benjamin Cohen (International Testing Agency), Dr. Matthias Kamber (former Antidoping Swit-zerland) and Dr. Andrea Gotzmann (NADA) dealt with the topic „Anti-doping work put to test - how can trust be regained?“.

At a joint press conference in the German House at the Olympic Winter Games in PyeongChang (South Korea) in February 2018, NADA Germa-ny and NADA Austria stand up for a globally independent anti-doping work.

Under the slogan „My pearls are clean“, the athletics campaign focused on the physically strenuous and sweat-inducing training before the Euro-pean Championships.

Initiatives for clean sportWithin the framework of the European Championships in Athletics, the European Championships in Para-Athletics and the World Championships in Wheelchair Basketball, NADA, together with athletes and the support of the DLV and the German National Paralympic Committee (DBS), set a sign for equal opportunities and clean performance with two campaigns in the summer of 2018. Two videos and several blog entries by the athletes were a central part of the campaign. With the information booth of the initiative „GIVE EVERYTHING, TAKE NOTHING“ NADA offered again a platform to promote clean sports.

Business Development and Financial SituationIn the fiscal year 2018, NADA implemented a quality management system for the certification of itself. TÜV Hessen certified NADA according to DIN EN ISO 9001 in the area of application „Promotion, implementation and coordination of anti-doping work in Germany by means of suitable sports science, educational, social, medical and legal measures“. Furthermore, NADA implemented measures for the continuous optimisation of data protec-tion and data security, among other things by implemen-ting corresponding software solutions.

The fiscal year ended with a positive result of € 5 thousand. As in the previous year, the lack of financial support for the economy was compensated by the predominant financing of the Federal Government and the fundamen-tal participation of sport. Thus, stable financing of the foundation‘s tasks is currently guaranteed.

jointly contributed € 479 thousand to the financing of doping prevention. Sport made a contribution of € 2,829 thousand.

The total operating budget amounted to around € 9.7 million. Included are federal funds in the amount of around € 2.2 million, which were passed on to the WADA- accredited laboratories in Cologne and Kreischa for the financing of research and analysis purposes.

In the area of property management, NADA acquired a further property at Platz der Vereinten Nationen 7 in order to relieve the spatially tense situation in the two offices at Heussallee 28 and 38.

As of December 31, 2018, NADA had 32 full-time employees and seven part-time employees as well as six em- ployed on a part-time basis.

NADA took part in the WADA Symposium entitled „Shaping the Future of Clean Sports“ as well as the INADO Workshop „A Tale of Two Codes (2015, 2021)“ in Lausanne in March 2018. NADA is also a member of the group of establis-hed NADOs who have been working to improve global anti-doping work to protect clean athletes since 2015. The so-called CEO Leaders Group met three times in 2018 and, as part of the discussions, proposed changes to promote clean sport worldwide. The exchange with various NADOs, such as colleagues from Austria, Switzerland and Kazakhstan, continu-ed to be part of NADA‘s international activities.

International bodiesDr. Andrea Gotzmann has been appointed to the Indepen-dent Member Federations Sanctions Panel of the International Weightlifting Federation (IWF). The panel is responsible for monitoring the anti-doping work of the IWF member federations and imposing appropri-ate sanctions in the event of non-compliance with the rules. Furthermore, last year Dr. Lars Mortsiefer was elected Chairman of the Advisory Group on Legal Issues of the Monitoring Group in the Council of Europe. The Monitoring Group of the Council of Europe monitors the implementation of the anti-doping rules and represents European interests vis-à-vis WADA. As a member of the WADA Education Committee, Dominic Müser, Head of NADA‘s Prevention Department, played a key role in shaping the new International Standard for Education.

Representatives of leading NADOs met in 2018 in Bonn (January 2018), London (June 2018) and Paris (October 2018, picture) to work for the uni-form implementation of the anti-doping rules worldwide.

At a meeting at the White House in Washington D.C. (USA), representati-ves of athletes and NADOs called for a reform of WADA to strengthen its independence and thus regain confidence in anti-doping work worldwide. NADA‘s CEO Dr. Andrea Gotzmann also attended the meeting.

As a member of WADA‘s Laboratory Expert Group, Dr. Andrea Gotzmann attended a meeting of the expert group in London (UK) in June 2018.

Dr. Maira Bakasheva (Director AntiDopingKAZ), Dr. Andrea Gotzmann and Dr. Detlef Thieme (Director of the Institute for Doping Analytics and Sports Biochemistry Dresden in Kreischa, IDAS) agreed on more intensive coope-ration in the fields of doping prevention, doping control systems as well as analytics and research.

In October 2018, Dr. Martin Vaso (Chief Human Resources & Services Of-ficer) and Alexis Weber (Head of Medical & Anti-Doping) of the internatio-nal football federation FIFA were guests at the NADA office for an exchange on topics such as the testing programme in German football and doping prevention issues.

In February 2018, Dominic Müser was part of WADA‘s Athlete Outreach Team at the Olympic Winter Games in PyeongChang (South Korea) to raise awareness for clean sports among athletes and support staff on site.

Summary of the reportHerewith I certify an existing data protection management system according to the requirements of the valid Federal Data Protection Act 2018 (new) and the General Data Protection Regulation (GDPR) as an externally appointed data protection officer of the National Anti Doping Agency of Germany.

The National Anti Doping Agency Germany has undergo-ne an admission based on BSI Basic Protection and has implemented the recommendations for action.

In particular, the following areas will be implemented in the DSMS data protection management system:

• Order processing according to Art 28 DSGVO / §62 BDSG• Procedural directories according to Art 30 DSGVO / §70 BDSG • Appropriate information procedure according to Art 15 DSGVO / §34 BDSG • Technical organisational measures according to Art 32 DSGVO • Privacy policy • Data protection employee sensitisation

Data Protection in GermanyEU data protection has so far been rather ineffective. This was also due to the lack of sanctions. With the 25.5.2018 penalties of up to 20 million Euro or up to 4 percent of the worldwide annual turnover threaten - whichever is higher. Factors, such as the gravity and duration of an infringe-ment, the number of people affected and the deliberate-ness should be taken into account in the level of penalties.

In future, affected parties can complain about possible infringements to the national data protection authority or the new EU-data protection committee.

The implementation of the new legal requirements was implemented at the National Anti Doping Agency of Germany on 25 May 2018.

NADAjus databaseThe NADA database NADAjus for the administration of sensitive and particularly sensitive data on the legal basis of the WADC and the NADC derived from it in connection with the Anti-Doping Act did not show any disturbances, conspicuities, erroneous accesses or even data losses in the reporting period.

The use and publication practice is carried out in close coordination with the responsible data protection supervi-sory authority on the part of NADA.

Procedure log So far, the procedure directories have been created in the areas:

• IT• Administration / Secretariat• Accounting department• Office Communication / Office / Writing Department

Further process directories are being created. Existing process directories are maintained continuously.

Data protectionThe data protection officer Dr. Ralf Schadowski is the responsible external data protection officer. He is personally ISO 17024 certified in the area of data protec-tion and is therefore continuously monitored.

He supports the National Anti Doping Agency of Germany with 35 data protection specialists from his team who, depending on the specialist, also have current training levels.


Fulfilment of information dutiesThe data protection information for websites and portals has been adapted to the requirements.

Data erasure conceptData will be deleted or blocked after the legal basis has ceased to exist or after a consent has been revoked, depending on the technical possibilities. Deletion instruc-tions can also be found in the procedural indexes. The implementation of the deletions still has to be organi-sed to a large extent.

Rights of data subjectsThe appropriate information procedure has been pre- pared, the process has been established and the template for possible requests for information has been drawn up.

No requests for information have yet been received.

Data security incidentsThere were no reportable data protection incidents or IT security incidents in the reporting period.

Order processing agreementsAll relevant service providers within the meaning of con- tract processing pursuant to Art. 30 DSGVO were contrac-tually fixed and randomly inspected.

The technical and organisational measures pursuant to Art. 32 of the DSGVO were examined and approved as a minimum guarantee of compliance with the accountability obligations pursuant to Art. 5 of the DSGVO.

Training providedThe employees of NADA were subjected to a data protec-tion employee sensitisation (BDSG, TKG, SGB, EU DSGVO).

Prior data protection checks of essential processesThe data protection officer will be requested if necessary, for example:

• Infrastructure enhancements• Operation of IT solutions• Data protection requests from athletes• Privacy requests from employees• Data protection requests from other third parties

Information securityThe responsible body was subjected to a BSI basic protection audit and recommendations for action were implemented.

NADA has appointed a neutral external IT security officer.In the reporting period, there were no relevant IT disrup-tions or violations of information security.

PerspectiveIn 2019, the data protection work at the National Anti Doping Agency of Germany will be continued.

NADA‘s OmbudsmanThe former rower and Olympian Prof. Roland Baar acted as an independent ombudsman for anti-doping matters until June 2018.

He died unexpectedly and suddenly at the age of 53. Roland Baar was an important confidante for NADA and the athletes seeking advice. He was an important combatant for clean sport and has done essential work for confidence in anti-doping work. With great respect and shared grief with his family, NADA said goodbye.
