Aside from the bills affecting your interests that are discussed in detail below, some of the primary topics were: 1) Medicaid expansion, which was supported by the Governor, but ultimately defeated in the House; 2) Non-discrimination language, which ultimately also failed in the House; 3) Several measures dealing with balance budget amendments and constitutional conventions, and; 4) The appropriate amount of funds in ‘rainy day’ accounts. While Management Council met this past Friday, March 7, to finalize interim topics for the various committees, the final list will likely not be out until sometime later this week. We will present a brief summary of the interim topics at the end of March, at which time the dates of meetings should also be available. A table, which includes links to all enrolled acts (bills approved, vetoed, or awaiting action by the Governor) follows this narrative. On this table, bills which are discussed in the narrative are highlighted yellow. Bills, Files and Resolutions that passed the 63 rd Wyoming Legislature HB0008 Landowner indemnification. Amends the definition of ‘innocent owner’ to include a surface owner if a pipeline is the source of contamination on the property, and the surface owner is not involved in the installation, operation or maintenance of the pipeline. HB0009 Alternative fuel taxation. Creates road fuel tax for alternative fuels, such as Compressed Natural Gas (CNG), which will be taxed by the Gasoline Gallon Equivalent, and Liquefied Natural Gas (LNG), which will be taxed by its Diesel Gallon Equivalent. There is also a requirement for all-electric vehicles to pay $50 per year for a road tax decal, during registration. One of the difficulties in taxing CNG and LNG is that the ‘rack’ as used in the gasoline and diesel tax statutes is not a terminal in the case of CNG and LNG, but rather the retail dispenser. We did seek removal of some unfavorable language regarding labeling which occurred, but were unsuccessful in removing the definition of E-85 and ethanol, which are already defined in the gasoline tax statute, with a differing definitions. Another issue likely to be addressed during the interim is calibration and certification of metering devices for CNG and LNG; this is addressed in separate statutes, and will likely be addressed in the agriculture committee during the interim, as the agriculture committee has jurisdiction over weights and measures. HB0033 Worker’s compensation premiums-experience modification. Currently, worker’s compensation premiums are based on claims experience and cannot be increased or decreased more than 65% in a given year, based on the previous years’ experience. Beginning in calendar year 2017, the rate charged an employer can be adjusted, up or down, by no more than 85%, based on the number and cost of claims made. HB0052 Sales tax exclusion-related business entities. Leases or sales of tangible personal property between related business entities, where 80% of ownership is common to both entities, will not be charged sales or use tax on such sales or leases. These types of leases and sales have become more widely used, due to increased capital gains taxes under the Affordable Care Act. The General Session of the 63rd Wyoming Legislature began on January 13, 2015, and concluded on March 7, 2015, with 257 bills and resolutions introduced in the House, and 153 files and resolutions introduced in the Senate. HB0053 Minerals to value added products program. Will allow the Wyoming Business Council (WBC) to consider contracts to supply 20% of the feedstock for a plant which will produce value added mineral products, including minerals to liquid fuels or other value added products, but does not include a facility where 50% or more of the facility’s revenue is derived from the generation of electricity. There is considerable detail of the requirements place on the WBC prior to entering into a contract to supply up to 20% of the feedstock at a predetermined price. HB0056 Wyoming Food Freedom Act. Exempts farm to end consumer sales of certain foods from licensure, certification and inspection. The bill defines ‘informed end consumer’ (IEC), as one who is the last purchaser of any product, who does not resell the product, and has been informed that the product is not licensed, regulated or inspected. The transaction must be direct between producer and IEC, used only for home consumption, occur only in Wyoming, not involve interstate commerce, not involve meat except poultry and poultry products or live animals intended for slaughter. ‘Not potentially hazardous food’ as defined in W.S. 35-7-110(a)(xxx) shall not be required to be labeled, licensed, regulated or inspected if sold at a farmers market or sold directly from producer to IEC. Effective 3/3/15. HB0064 UCC-title I and VII revisions. This bill brings the Uniform Commercial Code in Wyoming into the era of electronic bills of lading and warehouse receipts. Among the memorable phrases in this revision to the UCC are the definition of ‘Record’ which now means information that is inscribed on a tangible medium or that is stored in an electronic or other medium and is retrievable in perceivable form…i.e., something I can read. Article VII is the portion that deals with document of title, such as warehouse receipts. HB0070 Omnibus water bill-construction. Details the water construction projects to be started and/or completed during the upcoming year. This bill is seen annually, after creation by the Water Development Commission, review by the Select Water, and committee hearing in the same manner as any other bill. It includes construction or modification of rural, municipal or irrigation water systems, and also includes weather modification projects. Irrigation districts with projects included in this bill include Big Horn Canal, Casper Alcova, Dull Knife, Goshen, Hill, Midvale, Shoshone, Wheatland, and Wind River. HB0085 Motor vehicle passing bicycles. The driver of a motor vehicle overtaking and passing a bicycle, which is operating lawfully, proceeding in the same direction shall, when space allows, maintain at least a three (3) foot separation between the right side of the driver's motor vehicle, including all mirrors and other projections from the motor vehicle, and the bicycle. HB0106 Nonconsensual towing services. Requires WYDOT to adopt rules for nonconsensual towing of vehicles, including a rotation list, and a requirement that firms wishing to be on the rotation list file a summary rate disclosure document with WYDOT. Although this addresses some concerns that the trucking industry had with towing charges for large equipment, look for additional interim study on this topic. HB0108 Trespass-landowner liability. Codifies duty of landowner to a trespasser, quite similar to the Restatement 2nd of Torts, in that a landowner owes no duty to a trespasser, except as to attractive nuisances to trespassing children. A landowner owes a duty not to ‘willfully or wantonly injure a trespasser.’ The motivation behind this bill was concern that a case in Wyoming could prompt a court to use the Restatement 3rd of Torts, which has a much higher duty of care for landowners relative to trespassers. HB0128 Notice requirements special district elections. There was some ambiguity in the day requirements on deadlines for special district elections; this bill clarifies that all such deadlines which are ten days or less are counted using business days rather than calendar days.

HB0181 Speeding penalties in 80 mile per hour zone. This bill extends the $5/mph above the posted speed limit to areas with 80 mph zones, up to 5 mph above the posted limit, as the law currently is for areas with speed limits of 65 and 75 mph. Also, remember that there is an additional fine for any driver exceeding the speed limit by 6 or more mph, in a vehicle weighing above 26,000 GVWR, of $300 (in W.S. 31-5-301(b)), and in addition if the vehicle is a commercial vehicle (see discussion on SF0029), there is an additional fine of $100 for exceeding a speed limit by 6 or more mph (in W.S. 31-18-704). HB0212 Workers compensation-claim apportionment. Allows an employer to apply for a determination of experience modification, if an injury to an employee was caused, by a preponderance of the evidence, by a third party, in which case, the injury will not be charged to the employer’s account. Any such determination is only usable for ratemaking purposes, and is not admissible in any civil litigation. HB0228 Subdivision-family exception. Extends the subdivision exemption for families to trusts controlled by either the grantor, or a business entity or trust controlled 80% or more by individuals related by blood or marriage. This was an amendment to existing statute, W.S. 18-5-303. Other portions of this statute remain intact, such as grantee must have owned 5% interest in the entity for at least five years continuously before the date of the sale or gift. HJ0001 Regulation freedom. Urges Congress to forward the following amendment to the U.S. Constitution to the States for approval: "Whenever one quarter of the members of the United States House of Representatives or the United States Senate transmits to the president their written declaration of opposition to a proposed federal regulation, it shall require a majority vote of the House of Representatives and the Senate to adopt that regulation." The sponsors, Representative Winters and Senator Bebout, of this resolution represent a county where the local Farm Bureau forwarded this resolution to WYFBF, where it was approved, who forwarded the resolution to American Farm Bureau Federation, where this resolution was adopted last January. HJ0006 Wyoming local food production. This is a ‘feel good’ resolution that encourages production and consumption of local food… SF0004 Dry bean research. Creates a dry bean commission, funded by a refundable checkoff, initially 0.34% collected from final settlement to a grower, and a 0.17% match by the handler first purchasing the beans. The commission consists of four growers and two handlers, initially appointed by the Governor, then on the expiration of initial terms, elected by mail by growers and handlers. The commission may change the level of assessment after July 1, 2017, but may never increase the total above 1% of settlement, and the proportion must remain 2/3 from the grower, 1/3 from the handler. The intention is to use the money for research regarding varieties, agronomic practices and end use qualities of any species of dry bean. This bill, as most other listed unless otherwise noted, is effective July 1, 2015. SF0009 Right to farm. Strengthens the existing Wyoming Right to Farm and Ranch Act (W.S. 11-44-101 et seq). The only remaining alternative to strengthen this act is to make it part of the state constitution. Effective immediately. SF0011 Selling to junk dealers-ID required. Requires junk dealers to record the license plate number of the person’s vehicle, and their driver’s license number or other similar identification if they are selling more than $50 worth of items to a junk dealer. Promoted as a mean to discourage theft. SF0012 Trespassing to collect data. County prosecutors have been unable to prosecute simple trespass without viewable signage. This bill establishes trespass to collect data as a crime, similar to trespass to violate game laws, in that no signage is required; the party is required to know whether they are on private or state property when collecting resource data, and must have

permission from the landowner, lessee, or agent of owner, or an otherwise legal right to enter the private land to collect resource data. Penalties are up to 1 year imprisonment and/or fine of not more than $1,000 for a first offense, and imprisonment not less than ten day or more than one year and/or a fine of not more than $5,000 for subsequent offenses. Any data collected in violation of this law cannot be used in any civil, criminal or administrative action aside from prosecution of this offense, or civil action against the trespasser (see SF0080), and all such data in possession of any governmental entity shall be expunged, nor considered in any agency action. Effective 3/5/15. SF0016 Controlled substances. Our concerns were that red phosphorus, ammonium nitrate, and ammonium sulfate, along with sulfuric acid, were listed in the controlled substance precursor list in this bill as initially adopted by the Senate. These portions were deleted by the House, and remained out of the final version concurred to by the Senate. Effective 3/4/15. SF0029 Motor vehicle driver’s license exemptions. This bill removed the non-commercial class A and B driver’s licenses in Wyoming, and establishes a “Z” endorsement on a class C driver’s license, which allows the holder to operate non-commercial vehicles over 39,000 GVWR throughout the state of Wyoming. Current holders of class A or B non-commercial licenses, or class A or B CDLs may ‘grandfather’ into this new endorsement. Those holding a class C license must complete a written test to obtain the Z endorsement, and must either have an affidavit from someone holding the same or higher class license, or take a skills test. This will allow a farmer or rancher, his family or employees to operate a heavy vehicle solely for farm use. Under MAP-21, such a license would allow operation in nearby states, as long as the vehicle is within 241 kilometers of the registration address of the vehicle, and it has state-sanctioned visible identification as a farm vehicle (see SF0137). Those seeking to operate in nearby states should ascertain that this driver’s license will be valid in those states; we believe that it will be valid in Montana, Nebraska, Colorado, Utah, Idaho, but we are not certain with regard to North and South Dakota or Kansas. We also believe that the Z endorsement will eliminate the need for medical certificates or drug and alcohol testing program, as is currently required for CDL holders. Also, no person under the age of 18 may operate any vehicle over 26,000 GVWR; anyone over the age of 18 can legally operate a non-commercial vehicle or combination of vehicles with a GVWR under 39,001 pounds. Effective 7/1/15. SF0032 Small employer group health insurance. This act makes it optional for small employer carrier to offer coverage to employee’s dependents. SF0034 Interstate Mining Compact commission membership. Makes Wyoming a full member of the Interstate Mining Compact Commission. Effective 2/25/15. SF0043 Wyoming Telecommunications Act Revisions. This revision primarily update the act due to changes in the Federal Universal Service Fund; the primary concern for us was retaining affordable landline service at remote farm and ranch steads. SF0051 Water development-amendments. This act allows the Water Development Commission to accept grants from Federal entities for water development; specifically for the Upper Colorado River Basin Fund Memorandum of Agreement, and the Colorado River Basin States Salinity Control Program. It also changes the name of the ‘inflation’ fund for Level III state water project to the ‘contingency’ fund. Effective immediately upon Governor’s signature or failure to take action. SF0055 Omnibus water bill-planning. This act is brought every session of the legislature, which begins planning on water projects, both Level I reconnaissance, for new development and for rehabilitation, and Level II feasibility, also for new development and for rehabilitation. Level I studies are slated for the following irrigation districts: Deaver and LeClair. Level II studies are planned for Dry Creek Irrigation District, Heart Mountain Canal Rehabilitation, Big Sandy Enlargement, Clear Creek Storage, Greybull Valley Irrigation District, Meeks Cabin Dam, Middle Piney Reservoir, New Fork Lake Dam, Nowood River Storage, both Alkali Creek and Meadowlark Lake, Shell Valley Leavitt Reservoir. There is also a study that was suspended, the North Fork Shoshone Water Supply study. Effective as per SF0051.

SF0056 Study on management of public lands. This act obliges the Office of State Lands and Investments to study the costs, conduct an economic analysis and develop a proposed plan for the State to manage select Federal lands in Wyoming. The study will not consider Federal lands administered by the Park Service, Departments of Defense or Energy, by the Bureau of Indian Affairs, Congressionally designate wilderness areas, national conservation areas, or by the U.S. Fish and Wildlife Service. Effective immediately upon Governor’s signature or failure to take action. SF0070 Cooperative electric utility rate adjustment-notice. This act changes the notice requirement for electric cooperatives. Previously, a 30 day notice was required for any rate change. Under this act, the 30 day notice requirement only applies to rate increases. Effective 2/25/15. SF0080 Trespassing to collect data-civil cause of action. A companion act to SF0012; this allows the aggrieved party to sue for civil damages, in the case of trespass to collect resource data. Along with consequential and economic damages proximately caused by the trespass, a successful claimant shall be awarded litigation costs, which include court costs, expert witness fees, along with costs for depositions and discovery, reasonable attorney fees, reasonable cost of identifying the trespasser, obtaining service of process, and successfully effecting collection of any judgment against the trespasser. Effective as per SF0056. SF0095 Speed limits. WYDOT is detailed to study which state highways could safely have a 70 mph speed limit, and to do so in a manner similar to implementation of the 80 mph speed limit on sections of Wyoming Interstate highways. SF0126 Water quality. This act requires WYDEQ to develop water quality standards which recognize that no water quality standard can supersede or abrogate any valid water right. This bill resulted from several streams that have been listed as impaired, due to a lack of flow because of a lawful diversion upstream. SF0137 Farm license plates. This act requires county treasurers to issue ‘FARM’ tags for license plates on trucks and trailers, upon request, by any farmer or rancher, when the vehicle is solely used for transportation of farm goods, to or from the farm. This resolves an issue where some county treasurers would not issue farm tags for any vehicle over 26,000 GVWR. Such tags are required, if one wishes to operate a farm vehicle(s) with a ‘Z’ endorsement, including neighboring states. We have been assured that WYDOT will also issue these tags to those with apportioned plates, when asked. Failed Bills, Files and Resolutions HB0018 Drone Protection Act. This bill would have limited law enforcement and regulatory use of drones to situations where a warrant had been obtained, or exigent circumstances exist. Our concern was not with law enforcement use, but rather use by regulatory agencies. Passed the house and failed ‘do pass’ in senate judiciary committee. The sponsor will likely bring this bill back during the 2016 Budget Session. HB0084 Conservation district levy. This bill would have allowed conservation districts to, via election, collect up to one mill of additional property tax to fund water projects. Failed in Committee of the Whole in the first house. This will likely be an interim topic in the agriculture committee. HB0121 Article V convention limitations. This would have set parameters for appointment and constraints on Wyoming delegate(s) to an Article V convention. While the bill passed both houses (after some interesting times in the senate, especially being heard by the rules committee), the house felt the appointments should be made by the entire legislature, while the senate

believed that management council of the legislature should choose delegates. Very likely to be reintroduced in the house in 2016, as the house version received nearly 75% affirmative vote (2/3 of elected members required to introduce a non-budget bill during the budget session). The Senate Rules Committee (only second to the Journal committee where bills go to die) considered five bills including HB0121. One of these items, HJ0001 Regulation Freedom, was enacted, the other three failed, HB0075 Balanced Budget Compact died in the rules committee, HJ0004 Balance budget amendment resolution (see HJ0004 below) failed in the senate on third reading, and SJ0004 Constitutional convention died in rules committee. HB0202 EPA equipment requirements-tax exemption. This bill would have exempted sales and use taxes on additional equipment purchased by an electrical generation station for the sole purpose of meeting EPA requirements implemented after January 1, 2014. Although the bill failed passage in house revenue, this topic will likely come up during interim and the upcoming budget session. HJ0004 Balanced budget amendment resolution. Was amended nearly to death in the senate, where it failed on third reading. The concerns of many members was retaliation by the Federal government by withholding PILT funds (Payment In Lieu of Taxes), federal mineral royalties. SF0014 Asset forfeiture-2. This act, which ultimately passed both houses was vetoed by the Governor, and the senate (the originating house) failed to override the veto. Look for the bill to come back in subsequent sessions, until passage into law. SF0122 Vision 2020. Would have created a task force to evaluate the volatility of state revenues, and arrive at a model that would allow the legislature to select the size of ‘rainy day’ accounts which are used to mitigate revenue risk. This bill passed the senate and died in house revenue committee. Some iteration of this concept will be back during the upcoming budget session. SJ0004 Constitutional convention. This was the final resolution offered that would have called an Article V convention for amending the Constitution of the United States. It was heard in senate rules, where the president of the senate was the deciding vote against ‘do pass’.

We will be forwarding another report at the end of March 2015, detailing any further vetoes by the Governor of bills that passed the legislature, along with interim topics for standing committees, and any firm dates for committee meetings. The budget session of the 63rd Wyoming Legislature is set to convene on February 8, 2016, will likely meet for 19 days, and must adjourn by March 10, 2016.
