The events of 16 June 1976 riots that saw Hector Pietersen lose his life in Soweto, continued the following day in Alex and this led to about 19 people losing their lives, but less is said about this. Japie Mangoeng Vilankulu and Toto Sikhosana were among the Alexandrians who died on 17 June 1976. On Tuesday 17 June 2014, the DA joined in celebrating the memory of all those who lost their lives on that dreadful day, in particular, they honoured the memory of Alex born Japie Vilankulu who died at the age of 23. This year, the DA leadership, together with the Vilankulu family and DA activists visited Japie’s grave at the Marlboro cemetery where the Vilankulu’s family held a ritual to pay respect to their late son. Speaking on behalf of the Vilankulu’s family was Sylvia Mvundlela Vilankulu who is the niece of the late Japie, expressed her heartfelt gratitude to all those who attended. “It brings me great joy that people came in numbers to honour the memory and the sacrifices made by you and all those who fought beside you for the liberation of our nation”. Sylvia said with great pride. Among other things, Sylvia also told one of Alex Pioneer’s reporters that the City of Joburg has agreed to name a Street in Alex after him. “I am very much ecstatic that there will be a Street in Alex named after my uncle”, what more could we ask for,” Sylvia added. An Alex Pioneer reporter tried to make contact with the City of Joburg Speaker; Councillor Connie Bapela to validate the information we had received. Team UD Trucks took first place at the inaugural John

Robbie Invitational in support of Crime Line, which was held at the Country Club Johannes-burg in Woodmead on Thursday. 94.7 Highveld Stereo’s, Darren Simpson and Sky-net’s teams came in sec-ond and third respectively. Daniel Slabbert of the South African Disabled Golf Asso-ciation (SADGA) was nearest to the pin, while Henk Roets of team Minopex received the prize for the longest drive. Crime Line is an anonymous crime tip-off service which was launched in 2007 as a tool for members of the public to blow the whistle on crime. The proceeds of the golf day will go towards the recently established Crime Line Foun-dation Trust in a bid to con-tinue and broaden the efforts

of the tip-off service in curb-ing crime in South Africa. Talk Radio 702 breakfast host, John Robbie, an avid sup-porter of Crime Line, gave his name to the golf day, which will now be an annual event on the CSI calendar. John also led his own team on the course, which in-cluded Samsung Vice-Pres-ident, George Ferreira and golf pro, Nico van Rensburg. Hilarity ensued as Simpson tweeted that he sent a tip-off to Crime Line’s 32211 SMS number which read: “Dear Crime Line. I would like to report a crime. I have solid evidence that John Rob-bie is cheating in his Golf Day. Please resolve this before 5pm today. Place of Crime is Country Club Johannesburg,” he texted tongue-in-cheek. National Police Commis-sioner, General Riah Phiyega attended the prize-giving cer-emony, following an amazing day of golf and fine weather, to pledge her support in strength-ening the partnership between the South African Police Ser-vice (SAPS) and Crime Line. She thanked the business com-munity for their generous sup-port of the golf day, saying that “safety and security is not just a policing issue, it is a soci-etal issue and concerns us all.” During the prize-giving DSTV announced that it would do-nate R1-million in airtime for Crime Line, while Ministry of Illusion in turn pledged that it would assist with the production of a TV advert. Abramjee in turn called on

Kaizer Chiefs coach Stuart Baxterrefused to concede that the title is all but lost following his team's 1-0 loss to Mpumalanga Black Aces on Wednesday at FNB Stadium in Johannesburg.The loss meant Chiefs dropped down to sec-ond, three points adrift of Mamelodi Sundowns, as they beat Bloemfon-tein Celtic 1-0 in Pretoria."No its not all lost," said Baxter."But we are making it dif-ficult for ourselves, aren't we? South African youth remember the Soweto Riots on this signifi cant Public Holiday

June 16th is a public holiday in South Africa commem-orating the start of the Soweto Riots of 1976, sparked off by a government edict that all instruction in black schools would be delivered in Afrikaans. The iconic picture of Hector Pieterson, a black schoolchild shot by the police in Soweto near Johannesburg during a peaceful process march, brought home the brutalities of the Apartheid regime to many people within and outside of South Africa. In the weeks that followed over 700 people - mostly youth - were killed.

Youth Day could be a confl ict-ridden date, but instead it serves to remind South Africans of the importance of its youth and brings across the message that something like “the Soweto riots” should never happen again. The nation recalls the events of 16 June 1976 in Soweto, and remembers the heroism of our young people who took on the might of the apartheid state, in pursuit of free-dom, equality and human rights. We pay tribute to the youth of 1976 who endured the might of the apartheid government and also remember Hector Petersen, who became a symbol of the student uprising and quest for freedom and a better life.

The bravery of our youth during those diffi cult times pushed our country closer to freedom and democracy which we fi nally achieved in 1994. We also pay a fi t-ting tribute to generations of youth in the past decades.

The memorial service attended by many of Eddie Zondi’s fans as well as family members, friends and celebrities began at 11am on Thursday morning 19 June 2014. SABC acting CEO Tian Olivier described the fallen radio personality as ‘one of the greatest talents’ the country has ever had, adding that Zondi was a professional who took his craft seriously.Gospel/Jazz singer Judith Sephuma paid tribute to the DJ with a rendition of Bette Midler’s classic ‘The wind

beneath my wings’.Also honouring the memory of “Bra Eddie” was the Jaziel brothers who sang one of their award wining songs “Ngeke ngize ngiphinde”. Guests also took a trip down memory lane as tapes of the Radio legend chatting to callers were played.With Nomathemba Madumo and Ernest Pillay as programme directors, the memorial service of Eddie was effi ciently directed. Colleague and long-time friend Wilson B Nkosi was among those who spoke

about the legacy Eddie left behind. “Indeed the nation is at a loss.” Said Nkosi, you will forever be missed, he concluded overwhelmed with great emotion. Eddie Makhosonke Zondi died at the age of 47 on Monday after complaining of chest pains. His funeral took place on Sunday the 22nd June. The service began at the UJ Soweto Campus from 8am after which the procession left for the West-Park Cemetery.“Hamba kahle Bra Eddie”

Hundreds of people took part in the June 16 Memorial March in Johannesburg. They were walking from the Morris Isaacson School to Phefeni High as part of youth day celebrations to commemorate those of the class of 1976 who were killed during the march against the use of Afrikaans as a medium of instruction in schools.The march was a partnership between Metro FM and the Gauteng government. It’s was led by the Premier David Makhura. The 7km walk retraced the

Hundreds march in memory of ‘76 victimssteps of the class of 1976.The group stopped briefl y at a bridge in Mofolo in remembrance of the speech delivered by one of the hero’s Tsietsi Mashinini at the very same spot 38 years ago.The marchers, mostly

youth, were clad in their school uniforms and traditional regalia.The walk ended at the Phefeni high school where a candlelight memorial was held as well as the l aunch of free Wi-Fi at the school.

The Independent Electoral Commission is in the dark about chairman Pansy Tlakula’s intention to take a leave of absence while she takes her appeal to the Constitutional Court.The Electoral Court on the 18th of June recommended that a parliamentary committee sack her.Tlakula’s lawyer, Leslie Mkhabela, reportedly said

The University of Cape Town (UCT) has been ranked the

top South African university and one of the top 10 universities in the BRICS countries, which include Brazil, Russia, India, China and South Africa.According to the QS World University

Rankings, UCT is ranked in ninth place in the world.Of the top 100 institutions, eight were from South Africa and also include the University of Witwatersrand, Stellenbosch University and the University of Pretoria.UCT’s spokesperson Mologadi Makwela says,

“Our position in the BRICS rankings is signifi cant because Africa needs to be on the agenda of the developing world. We operate in a world in which knowledge is the main currency and there are plans to improve Africa’s participation in this.”

Capitec has joined the family of banks which

have launched a mobile application, but has taken a different route from the norm.On Wednesday, the bank announced the launch of its mobile banking application which can be accessed on feature phones as well as smartphones.The Android application is 2.45MB, similar when compared to other banking groups’ apps, and Capitec says that the platform offers security.“The Capitec Bank app also

uniquely offers security via the phone and not the SIM card in the phone, substantially increasing security and removing SIM swop fraud,” said Capitec.Once the application has been downloaded, customers have to go into the branch to activate it.“We realise that some clients might see the activation process as tedious and frustrating, but with the increasing amount of banking fraud, our approach was to rather create an application which is secure in order to protect our clients from

becoming targets for fraudulent activity,” said Charl Nel, Capitec head of strategic communication.The app does not yet allow users to perform prepaid purchases, but Capitec says that it will build in additional functionality soon.Capitec has 5.4 million customers and the application is expected to simplify banking.It is part of a trend where increasingly in SA, fi nancial transactions are migrating to online platforms as cellphones become ubiquitous.

Economic Freedom Fighters (EFF) leader Julius

Malema has taken NCOP speaker Thandi Modise to task over the treatment of animals on her farm.Modise has been under fi re from all quarters after a report in the Sunday Independent revealed the dire state of her North West farm, in which the SPCA had discovered dead and dying animals.According to the newspaper, the animals, which included

pigs, sheep, geese, goats and ducks, had reportedly gone without food and water for about two weeks.The 85 surviving pigs had turned to eating the dead pigs and drinking their own urine.In an interview with the City Press newspaper, Malema said Modise should “be ashamed” about the situation on the farm.“If people can’t take care of their own animals, how can they take care of the country? That is a demonstration of failure. The ANC must

be ashamed to have a leader of that stature who does not care about the wellbeing of her own animals,” he told City Press.It is not the fi rst time Malema and Modise have squared off. The EFF leader was booted out of Parliament by the NCOP speaker during the State of the Nation debate earlier this year after refusing to retract statements about the ANC in regard to the Marikana massacre.

South Africa has been considered one of the most violent countries in terms of xenophobic attacks. Lawyers for Human Rights (LHR) were disturbed by the increasing number of incidents of violence against foreign nationals in the country. On the eve of World Refugee Day on 20 June, LHR expressed deep concern about the inhumane treatment of refugees and asylum-seekers at refugee reception offices across the country. On Thursday (19 June), LHR witnessed first-hand the violence against foreign nationals outside the Marabastad reception office in Pretoria. When those attempting to renew their permits began crowding the entrance to the Home Affairs Office, security officials and police began whipping the crowd with sjamboks and used pepper spray (images attached). This is just one instance of ongoing victimisation against those attempting to document their stay in the country.

Xenophobic attacks continue to plague the country, most recently in Mamelodi, near Pretoria. While evacuating foreign nationals (as in the case of Mamelodi) may prevent imminent harm, it does little to stem the scourge of violence. In addition to immediate police intervention and criminal prosecution of perpetrators, the situation requires long-term preventative strategies that include collaboration between various departments such as social development and home affairs – actions that are critical in addressing this violence.20 June, not only marks World Refugee Day, it also marks the 40th anniversary of the coming into effect of the OAU (Organisation of African Unity) Convention Governing the Specific Aspects of Refugee Problems in Africa. This ground-breaking convention is a tool that has saved the lives of millions of people in Africa.

LHR would like to use World Refugee Day 2014 to highlight the plight of refugees and asylum-seekers in South Africa who are facing not only xenophobic violence but also other serious daily barriers in obtaining documentation formalising their stay in the country. The recent announcement of Malusi Gigaba as the new Minister of Home Affairs presents an opportunity for South Africa to re-evaluate its treatment of refugees and migrant workers, addressing the challenges in a positive and practical manner. World Refugee Day provides an opportunity for South Africa to reflect on its obligations to refugees and to recommit itself to those obligations. As a member state of the United Nations and the African Union, South Africa has pledged to protect refugees and asylum-seekers. We need to hold South Africa and all the relevant government departments accountable to this commitment.

Former president Thabo Mbeki’s 72nd birthday on June the 18th was an opportunity for South Africans to recommit to unity, the ANC said.African National Congress spokesman Zizi Kodwa said in a statement the party wished Mbeki well on his birthday, which came days after the funeral of his mother, Epainette.“As we mark [former] President Mbeki’s birthday today, it is fitting... that we continue to honour the legacy of selflessness and sacrifice bestowed upon us by generations of freedom fighters and activists who have

been at the forefront of the uninterrupted struggle of our people for over 102 years.”Mbeki embodied the struggle for democracy, which many men and women died for, Kodwa said.“We must use days such as this one, when we celebrate a revolutionary, to recommit ourselves to our historic mission to unite the African people and spearhead the struggle for fundamental political, social, and economic change.”Mbeki’s mother died in the Life St Dominic’s Hospital in East London, Eastern Cape on June 8 aged 98. Her official provincial funeral was in Dutywa on Saturday.

Thandi Modise, chairman of the National Council of Provinces, had asked Malema to withdraw a statement he made on Wednesday (18 June), in which he said the ANC had massacred the Marikana mineworkers killed in August 2012 in the North West Province.Modise ruled that the EFF leader’s remarks were “unparliamentary” because they suggested that the government had decided to kill the people of Marikana.“Honourable members, having perused Hansard, I have arrived at the conclusion that the statements made by the honourable Malema are unparliamentary and do not accord with the decorum of this house. Although members enjoy freedom of speech during the proceedings of this house, this freedom is subject to limitations imposed by the constitution and joint rules,” said Modise before ordering Malema to withdraw his massacre comments.Malema refused to withdraw the statement.He remained defiant last night and instead again tried to justify his assertion.“Chair, when people say ‘reduce crime’, you come here and say the ANC has reduced crime. And when police kill people, you don’t want us to come here and say the ANC government has killed people, that is inconsistent, honourable chair,” he said.

In a sharp exchange with a controlled Modise, Malema remained stubborn and refused to withdraw on two occasions.“I won’t do that; I am sorry I won’t do that . I maintain [that] the government of the ANC killed people in Marikana,” said Malema in his exchange with Modise.“You leave me no choice but to ask you leave the House,” she said.As he packed his belongings prior to leaving the chamber, his 25 MPs disrupted the proceedings by shouting at Modise, “reminding” her that she was premier of North West when the Marikana killings took place.“You were the premier, Thandi ... mercenaries ... murderers,” they shouted.As they marched out of the chamber, the EFF lawmakers chanted “Malema o tshela thupa (Malema is giving them a hiding)”.But this just brought more trouble down on Malema and the MPs who walked out with him.ANC MP Mamoloko Kubayi said there should be an investigation of the EFF caucus for bringing parliament into disrepute.“The rules do create the opportunity for us to do exactly as you recommend; we shall do so,” Modise said.ANC Chief Whip Stone Sizani said the behaviour of EFF MPs was “atrocious and had never been seen in the 20-year history of this democratic parliament”.

COPYRIGHT MEANS... COPYWRONGIf I can access it on my computer or mobile device I can use it, right! Well no, not really. Because the chances are it’s protected by COPYRIGHT. ENSafrica has provided this short summary of copyright law.Let’s start with the basics.

People sometime refer to copyright infringement as plagiarism, but strictly speaking 1. they’re not exactly the same thing – whereas plagiarism is a moral or ethical issue, copyright in-fringement is a legal one.

Copyright is an area of the law that protects a whole range of things referred to as 2. ‘works’. These include:Writing. Anything from a single sentence to a whole book. A short email or Tweet would • qualify. As might a newspaper headline according to a recent case.

Art. This includes paintings and drawings but also, very importantly, photo-• graphs.Music.• Sound recordings. These could be of music, but they could be of other things • like speeches. Films. This doesn’t just mean full -length feature movies, but also TV adverts • or You Tube clips.

A work will enjoy copyright provided that some work or effort went into it. It does not need 3. to be interesting, clever or ground-breaking. It can be as mundane as a fax directory or a price list.Copyright comes into existence as soon as the work is created or recorded. There is no registra-4. tion involved, except in the USA, and even there registration is not compulsory.Copyright is universal - a work created in the USA is protected in South Africa, and vice 5. versa.Copyright generally belongs to the person who created the work or to the company who em-6. ployed that person or, in some cases, to the company who commissioned that person. The owner can transfer the copyright to a third party through an assignment in writing.Copyright is an income-earning asset that can be licensed to third parties.7. Copyright lasts for a substantial period of time. In South Africa it lasts for 50 years from the 8. date on which it was created, or 50 years from the date on which the person who created it dies.The owner of the copyright has various rights. The most important of these is the right to copy 9. the work. This means that any third party who copies the work without authority infringes the copyright. There must in fact be copying – if the underlying idea has been taken and expressed in a different way this will generally not be regarded as an infringement. It’s not necessary that the whole work be copied, however, copying of a ‘substantial part’ is suffi cient. When is it a substantial part? It’s an issue of quality rather than quantity, so a single but important sentence might constitute a substantial part of a newspaper article. The owner of the copyright can obtain a court order called an interdict to stop the third party 10. who has copied it from doing so again. Big deal you say, it’s over already! But it is a big deal, because the owner can also be awarded damages (perhaps in the form of a royalty) for the unauthorised copying. And even more important, the third party who did the copying will be ordered to pay the copyright owner’s legal costs. You could involve large sums of money.And then there’s the little issue of reputational damage. It’s not good to be seen as a copier. 11. And, as more and more people and companies are fi nding out in this age of free speech and social media, there’s a good chance that the public will fi nd out.

People seemed to understand copyright better before the Internet. People understood that if they bought a book, or a newspaper, or a CD, they owned the physical thing and they had the right to do with it as they pleased - they could read it, listen to it, give it away, sell it or destroy it. Yet they also knew that they couldn’t copy it. The big fallacy is that the Internet changed all that. It didn’t. So no, you can’t simply ‘copy and paste’! Yes there are certain defences to copyright infringement. There are the so-called ‘fair use’ defences which provide, for example, that short pieces of text can be quoted for the purposes of criticism or review, or for the purposes of reporting current events, provided there is attribution. But these defences are technical and detailed and you should always obtain legal advice if you want to rely on them. There may sometimes be an argument that the person who posted the work has impliedly licensed people to use it - or that the Twitter or You Tube Terms of Use are relevant - but this again involves technical legal issues. There may possibly even sometimes be an issue involving the con-stitutional right of freedom of expression. But, as the operator of the National Lottery discovered in a recent case in which it was sued for using the PSL football fi xture list without consent, the courts are unlikely to accept this as a defence in cases of commercial use and where there is no overriding public interest in the information.But, you say, everyone does it, I’ll never get caught! Think again, it’s well known that newspapers and other publishers use ‘plagiarism-spotting’ software to trawl the net and look for examples of their texts being lifted. There’s ongoing litigation in South Africa involving Moneyweb and Media 24 which deals with the whole issue of news aggregation, and the extent to which news aggrega-tors can lift content from news providers, perhaps changing the wording slightly. Zakes Bantwini and his epic line-up of special guest artists - the legendary Judith Sephuma, Khaya Mthethwa, iFani, Bucie and Liquideep’s Ziyon - wowed the audience of this year’s Upfront with Zakes Bantwini. Hosted on Monday (16th June) at the Durban Playhouse, the annual Youth Day production was a moving and sensational tribute to 20 years of democracy and to Nelson Mandela.The show’s MC was Slikour and Bantwini’s surprise act, award-winning gospel singer Sfiso Ncwane captivated the audience with his passionate performance. Using personal narration interspersed with some of his most well-loved tracks, Bantwini’s incredibly moving performance in the first act weaved it’s way along the story of his life. He shared childhood memories and the significant influence his late mother and Nelson Mandela have had on his journey to date. Performing hits from his

latest studio-multiple-award-nominated album, The Fake Book & Real Book: My Music Bible, including “Stop Acting” and “Karolina”, Bantwini had the audience on their feet. He was later joined on stage by Ziyon from Liquideep. Together they performed their hit collaboration, “She Stole my Heart”, and Ziyon delighted the audience with his popular single, “Alone”. Soul and gospel singer Judith Sephuma also delivered a powerful performance that included well-loved “A cry. A smile. A dance”, among others. The second act featured more amazing talent in the form of Bucie and Xhosa rapper, iFani, who brought the house down. The far north-east of Joburg will also be connected to the City’s Bus Rapid Transit system with a proposed third trunk route planned to link Parktown with Sandton and Alexandra.Johannesburg’s Bus Rapid Transit system’s third phase is now in the planning stages, with the City of Johannesburg and the JDA proposing to implement a third trunk route to Alexandra and Sandton.The route will split into two sections.Section 15 of the BRT trunk route, of about 12.6 kilometres, will begin at the corner of Empire Road and Victoria Road in Parktown, proceed left at Empire Road and Clarendon Road and follow Louis Botha Avenue – which becomes Pretoria Main Road – until the intersection with Lees Street in Wynberg.Section 8 of the BRT trunk route, of about four kilometres, will connect Alexandra to Sandton, in the north-east of Joburg. It is planned to start at the corner of Pretoria Main Road and Lees Street, cross over the M1

Highway via a proposed fl yover, and continue left into Katherine Avenue then into West Street, terminating at the Sandton Gautrain Station precinct.The JDA will be conducting public consultation meetings in respect of the two proposed sections.Three transport interchanges and 10 new stations are part of the proposals. The three interchanges will be at Sandton, Alexandra and Westgate, where a number of station modules will be clustered together and there will be integration with other modes of transport, including walking and cycling.New stations are proposed for Hillbrow, Grafton/Yeoville Bellevue/KES, Louis Botha Avenue, Doll House, Balfour, Corlett, Bramley, Wynberg, Athol and Sandton City.Construction on both sections is expected to begin in January 2014 and fi nished by December 2015. In some cases, the work will require moving services such as water and/or sewage pipelines, electricity and telephone lines.

As the success of the Maimane Alfred Phiri (Map) soccer winter tournament continues to confound critics, a call has been made to hold the Alex tournament in other provinces.The call was sounded at the launch of the annual tournament which kicked-off on 31 May, with the start of the four junior categories of the tournament: the U13, 15, 17 and 20.Each age category in the juniors’ tournament has 16 teams participating, making a total of 64 teams from Alexandra competing.The seniors’ tournament also has the same number of teams, as the juniors

and seniors both play in a knockout format leading up to the fi nal. With more than 140 teams competing in the tournament, this is a huge increase from the four teams that took part at the tournament’s inception in 2001. Critics had said the tournament would not become established.The bulk of the senior teams come from Gauteng while others come from as far afi eld as Limpopo, Mpumalanga and KwaZulu-Natal. Unlike the juniors’ category which is a developmental tournament, the seniors boast prize money for the champions.Speaking at the launch, Lawrence Venkile of

sponsors Passenger Rail Agency of South Africa (Prassa), said he would like to see the day when the tournament was played nationally“I am of the view that the games have outgrown Alex,” he said. “For us to move them forward, we need to start looking at ways of turning them into a national tournament. I long for that day,” he said.
