association office bearers, that to date you have not yet handed over to the

Branch Association all the relevant documents files and Fixed Deposit Receipts

held with you.

It is seen that during the year 2005 – 2006, 2006 – 2007, you have failed to submit

the accounts to Branch Association, wherein immense irregularities were

observed in the accounts during that period. Further you were directed by the

Secretary General of Hon. Association to immediately hand over all the relevant

documents, files and fixed deposit receipt to Branch Association.

All are aware, and it is a well known truth, that you have been unanimously

removed from the post of Secy. General of AIDAA (CB) Pune, by the Members

of the All India Managing Committee in the All India Managing Committee

Meeting held on 7th June 2007 at Jhansi. The decision for your removal due to

your misbehaviour and misleading to the office bearers of the Branch

Association and HQRs Association, and also the mis-appropriation of Public

Money received from the various branch members as well as HQRs. Members.

In the same meeting it was further unanimously resolved that the CDA (O)

Branch Association of AIDAA (CB) Pune, where you were the General Secretary

of that time, be dissolved which was entirely due to your non performance, non

achievement and non co-operation, for the benefit of the Branch Association

members of CDA (O) Pune.

In the present instance too, I find no positive response from your side, whereby

you were directed by the undersigned in the capacity of the Head of the

Organisation, to immediately hand over the relevant documents, files and fixed

deposit receipt back to the organization, as you were no longer empowered to

hold the same. Now it is seen that you are not abide with the directives given by

the head of the organization. This is viewed as a very serious lapse on your part,

and holding of official documents with you in a personal capacity tantamount to

a malafide intention (as good as theft from branch association office by you)

which is harmful to the organization as a whole.

Your, this behaviour is against the norms, ethics and culture of the AIDAA (CB)

Pune, which has been viewed very seriously by the Head of the Organisation, as

the fixed deposit receipts held by you is the property of the Association. Further

your statement mentioned in your letter addressed to DACC Bank Ltd., Pune

that a court case regarding implication of financial matter is against the AIDAA

CB Pune, PCDA (O) Branch is totally false and misleading. As to date no such

case is filed by you, or anybody else regarding the financial matters of CDA (O)

Pune Branch Association in any court of law anywhere in India.

Further you should know that the Fixed Deposit Receipts held by you have

matured long back, leading to a huge loss of Bank interest amounting to

thousands of rupees. As this is a loss of public money and cause of serious

damage to the interest of the association, I am compelled to warn you, to abide

by the directives given by the head of the organization, and hand over all the

relevant files documents and Fixed Deposit Receipts to the PCDA (O) Branch

Association on or before the 15th of February 2010, failing of which I will have to

lodge a complaint with the CGDA New Delhi, as well as file a criminal case

against you, and take action against you deemed fit as per laid down norms in

the bye-laws of the AIDAA (CB) Pune.

I am to inform you that this is the final opportunity given to you by the Head

Quarters Association to rectify your misdoings, and no extra time sanction will

be given I should get the final report from the CDA (O) Branch association on the

16th of February 2010 that you have surrendered all the relevant documents to

the PCDA (O) Branch Association.

Dear Comrades, I am very happy to inform all of you that our association strength has increased considerably this year. With efforts put up by our members working in different stations. We could increase as many as 2500 members approx. this year. This is the highest increase in the membership in one year, since CCARSA Rule 1993 Check Off System was introduce. In roads in new areas : This will be first time in the history of AIDAA (CB) Pune that we could make in roads in the Fy Accounts Offices in large way. More than 750 members working at PCFA Kolkata & Bengal Group of Factories. Joined AIDAA (CB) Pune. This will be first time in the history that AIDAA (CB) Pune will be largest Association in Fy. Command with approx. membership of 1300 as against 2400 total strength of Fy Command. Membership Strength of Pune association in various Group of Fy. is as follows :

By this our strength in Fy Command will be more than 70% of total strength. Increase in the membership in other commands : This year is a very good year for our Association because only in Fy. CDA Jabalpur 55 With this increase in the membership our Association membership will cross 65% of the total strength of Department. This will definitely benefit our Association in ensuing reconstitution of III JCM i.e. C.G.D.A. Council which is to be constituted by August 2010. We expect 6 seats out of 8 seats in III JCM. As

this year we were having less time as all this development started from 16th April 2010, till next year we will see that our membership will increase in such way that in our department only our Association will be a recognized Association. And we will achieve our ultimate aim of one department one Association. Dear Comrades as all of you know that our Association membership subscription is Rs. 2/- p.m. since from August 1992. This has made our Association and Branch Association financially very weak. In our All India convention at Bangalore this issue was discussed in length. And finally resolution was passed that our Association subscription for year 2010 onwards will be Rs. 10 p.m. (i.e. Rs. 120.00 p.a.) and HQrs Quota will be 50% per member i.e. Rs. 60.00 per member per annum. In hereby direct of the Chairman / Gen. Secretary of the Branch Association to give letter to their respective Administration asking them to recover membership subscription from Pune Association members Rs. 120/- in the month of July 2010, and immediate forward HQr Quota of Rs. 60.00 per member to HQs Association. This should be done on Priority basis without further delay. Regarding all other issues and development a separate circular will be issued very soon. With warm regards,

AMENDMENT TO BYE-LAWS Article No. 3 (b) (d) DEFINITION AND

ARTICLE 10 SUBSCRIPTION

Article 3 : Definition (b & d)

(b) Govt. servant means : Any person to whom the Central Govt. Civil Services conduct Rules 1964 apply :

(d) Rules means : the Rules framed by the Central Govt. under the Central Civil

Services – Regulation of Services Association, Rules 1993. Article : 10 – Subscription The rate of Membership of All India Defence Accounts Association (CB) Pune shall be minimum Rs. 10/- p.m. i.e. Rs.120/- per annum. The same shall be deducted from the July Payroll of each year from the employee on annual basis. Annual quota of Subscription to be remitted to HQ Association shall be Rs. 60/- per member. A cheque of said amount i.e. Rs. 60/- per member per annum shall be drawn in favour of President / Secretary General A.I.D.A.A. (CB) Pune on or before 31st August of every year. Justification The subscription of A.I.D.A. (CB) Pune of Rs. 2/- p.m. per member i.e. Rs. 24/- p.a. was stated in 1992. The last 18 years of period there is considerable increase in day to day expenditure of Branch Association as well HQRs Association. The rates of printing, stationery, traveling, visit to various branches have increased in many folds. The expenditure on account of Managing Committee meeting which is to be hold at least once in a six months and expenditure on All India convention and election of HQ Association which to be hold after every two years, is huge. Taking into account all these huge expenditure Branch association as well as HQ Association were finding very difficult to manage financial affairs in last several years. In delegate session held on 12th December 2009 at Bangalore, this point was discussed and after thorough discussion, resolution in this regards was passed unanimously. 1) Auditor’s Grade in Defence Accounts Department is directly recruited with

minimum qualification of Graduate and also promoted Grade from the grade of LDC

form our department.

2) In the previous RRs in Auditors Grade minimum service is to be put up in the

Grade of LDC to be promoted as Auditor was Eight years which was recently changed to

3) Prior to implementation of VIth Pay Commission Report minimum education

qualification for the Grade of LDC was 10th

standard pass, which is now enhanced to

twelve standard pass.

4) In the RRs of the LDC in our Department nature of worked to be performed by

LDC is routine nature of work i.e. typing, dispatch of letters, coping and dispatch of

statement of accounts etc.which doesn’t required audit knowledge, drafting, knowledge

of rules & regulation etc.

5) In the present scenario in our Department above mentioned routine nature of work

is nearly vanished due to introduction of I.T. Now our LDC’s are deployed either job of

Auditor or assisting to Auditor which required drafting, knowledge of rules and

regulations and auditing all the claims which is the job of Auditor .

6) Now newly recruited LDCs having education qualification of twelve standard

passed are already well conversant with I.T. knowledge.

7) DOPT letter which mentioned regarding minimum qualification service to be put

up in each Grade Pay before promoting to next higher Grade Pay is of General Nature for

all the Govt. Department and all the Central Govt. employees and it is guideline for all

Govt. department that how much minimum service to be put up before promoting to the

next higher Grade and this is not direct order for particular category in particular

Department. Department to Department promotional avenues, promotional process in

each Grade varies and separate as per the circumstances, promotional avenues, nature of

duties and responsibility and nature of Hierarchy and therefore RRs of each grade in each

Department is separate, though nomenclature and grade is same so it will be incorrect to

implement in toto each letter of General nature. Otherwise as per DOPT letter all the staff

drawing Grade Pay of Rs. 4200/- should be in ‘B’ category, whereas in our department

Sr. Auditors though drawing Grade Pay of Rs. 4200/- are still in Group ‘C’ category.

7) Further same DOPT letter says minimum of 8 years qualifying service is to be put

up for the further promotion from the Grade of Rs. 1900/- to Grade pay of Rs. 2400/- and

further minimum 5 years qualifying service to be put for further promotion from Grade

Pay of Rs. 2400/- to Grade of Rs. 2800/-. Here they have presumed that there is

promotional Grade in the Grade Pay of Rs. 2400/- whereas in our department no such

Grade exists, so this should be applied only to all those departments where next higher

Grade in Grade Pay of Rs. 2400/- is already available.

8) At present in our Department LDCs are already deployed on job of Auditors and

they are performing better ; their education qualification enhanced from is to 12 standard

and they already conversant with I.T. knowledge, A.I.D.A.A (C.B.) Pune demands that

RRs for Auditor Grade to be changed immediately to the effect that minimum qualifying

service of five years to be successfully completed in LDC’s Grade to be promoted in

Auditor’s Grade.

As per the check of system for the year 2010 – 2011, total number of membership

strength of AIDAA (CB) Pune in main office is 310 which is 45% of total strength

whereas AIDEA (HQrs) Kolkata is having 243 members i.e. 35.26% of total strength.

Further total strength of membership AIDAA (CB) Pune in entire factory offices in all

over India is 1080 whereas Kolkata Associations having 960 members. These both the

figures shows that AIDAA (CB) Pune is having more membership strength than AIDEA

(HQrs) Kolkata.

In the ROC of PCFA Kolkata, all the eight seats are allotted to AIDEA CH (Qrs) Kolkata

previously. Continuation of same in present scenario will defeat spirit and aims of JCM.

As such ROC cannot be held by keeping away representatives of Association which is

having larger following. Giving hearing and opportunity to minor Association will be a

major injustice on larger association.

Any demand, suggestion made by minor association will not reflect true and factual

position. As such any ROC meeting with these representatives will be fruitless.

In view of above we hereby demand that ROC of PCFA (Fys) Kolkata should be

reconstituted in present situation and till such time no ROC meeting to be held with

minority Association.

DEMANDS DAY

Dear Members,

After implementation of VIth Pay Commission Report. Some of our important

demands were agreed and there was overall satisfaction amongst the DAD Staff. But we

were expecting that there were some important Demands pending with the Govt. will be

accepted and implemented immediately Further after implementation VIth Pay

Commission there is injustice and anomalies in certain categories as well as anomalies

are created. We were persuing all these mattes vigorously with Govt. and our

Department, but we have not yet received any positive response and it seems that there is

no other alternative but to opt for direct action programme to bring pressure on Govt /

Department for the redressal of our grievances at the earliest.

On 1st Jan 2011 our DA has crossed 50% mark. Previously at the time of IIIrd Pay

Commission to IVth Pay Commission and Vth Pay Commission to VIth Pay

Commission, whenever DA has crossed 50% marks it was merged with basic, by which

we got all the benefits on basic related allowances (i.e. H.R.A. etc). Though VIth Pay

Commission recommended only to increase other allowances by 25% except HRA, TPI

etc. which means 90% of Govt. employees will not get any benefit. Our Association

strongly opposed this recommendation and demands that 50% DA to be merged

with the basis w.e.f. 1.1.2011.

In view of the above circumstances and prevailing situation HQ Association

has decided to launch direct action programme which will be started by observing

Demand’s Day on 1st July 2011. Action programme like lunch hour, demonstration

wearing of black batches, handing of memorandum in mass, day long Dharna etc.

will be intimated after a specific time.

All HQ members, Chairman / General Secretaries of Branch Association are

hereby directed to give wide Publicity to this demands day programme. They should

mobilize the staff, create awareness in the staff, mentally prepare them for the long battle.

All branches are hereby directed to prepare flex boards mentioning the Chartered of

Demands and put it in the public places like entrance gate of the office, wet canteen etc.

On 1st of July 2011, staff meeting should be held in all branches in lunch hours.

Circular regarding outcome of III level JCM meeting and other development will

Sub : Vacation of D.A.D Quarters allotted to other than DAD Staff.

Respected Sir,

Recently it is brought to our notice that many of our DAD Staff applied for DAD

Quarters are not allotted quarters due to non availability of the same.

I wish to bring to your notice that in 1982-83 and even prior to that our

Association has demanded for construction of D.A.D. Residential Complex as our staff

was finding difficult to pay high rental charges to private house owners. After a long

pursuance our demand was accepted and quarters for DAD Staff were constructed at

Lullanagar and Hidayatullah Complex from DAD Budget and only for DAD employees.

In between there was no recruitment in DAD offices at Pune and as Senior Staff

Purchased their own houses, due to which some quarters were lying vacant. At that time

proposal was there from administration side that vacant quarters can be allotted to Central

Govt. employees other than DAD. At that time our Association opposed it as quarters

were constructed only for DAD staff. Further we were having apprehensions that once

the quarter are allotted to other than DAD staff, it will be very difficult to vacate when

our staff will require it. At that time, it was categorically assured us, that quarters will be

allotted to other staff only on temporary basis and it will get vacated whenever required,

in a short period. Further, it was decided also while allotting these quarters other than

DAD staff, it will be alongwith the condition and undertaking from individual that they

will vacate these quarters immediately as and when notice will serve to the individual.

Recently new recruitment is taking place in all the DAD offices at Pune. All these

new recruits are belongs to different part of India and they don’t have self

accommodation at Pune. Due to high rentals charged by Private Owner it is financially

impossible for them to stay in Private rental accommodation. So all of them have applied

for DAD quarters and after allotment of all quarters including type 1 quarter (below

entitlement) and under repair quarters, still there is waiting list of nearly 75 individuals.

This will increase day by day as recruitment process is on in all DAD offices at Pune.

Nearly before 6 to 8 months notices were served by our good office to all non

DAD Staff for vacation of quarters. After serving this notices though more than 6 to 8

months are over, yet nearly 120 quarters are not yet vacated. This will lead unnecessarily

unrest amongst the DAD staff.

We hereby request you to take this matter with appropriate highest level of the

concerned department. In this regard your personal intervention is required and will be

appreciable .

In this regard matter regarding allotment of DAD quarters to non DAD staff in

various stations was taken up in III Level JCM previously and it was assured to us by

one Chairman III Level JCM That the DAD Staff will be suffered and steps will be taken

accordingly.

In view of above our Association is strongly demands that all quarters allotted to

non DAD staff should get vacated at the earliest and same should be allotted to all the

DAD Staff already applied for it.

Sub : Request for scraping of PFRDA Bill Sir,

We submit this petition to bring to your kind notice certain aspects of the reintroduced

PFRDA Bill which will have an extremely adverse impact on the pension and retirement benefits

of the Government employees. We may also state in this connection that the contributory pension

scheme will be a drain on the exchequer.

The guiding principle adopted in determining the pay package of civil servants is to

spread out the wage compensation over a long period of time because which the wages during the

work tenure is low to enable pension payment on retirement. This make the pension a ‘deferred

wage’ which the Supreme Court has upheld as such in their landmark judgement in the case of

D.S. Nakara Vs. Union of India. As the bill does not provide implicit or explicit assurance of a

minimum pension except marked based guarantee, the civil servant even after contributing huge

sums to pension fund may end up with no annuity if the invested company become bankrupt or

the equity market crashes. Moreover the annuity which would be the pension under the new

scheme being not cost indexed will make it difficult for the pensions to make the both ends meet.

The Committee set up by the 6th CPC has concluded that the new contributory pension

scheme will increase the outflow from the exchequer from Rs. 14,284 Crores to Rs. 57088 Crores

by 2038. The Committee has also observed that the pension liability of the Government which

was 0.5% of the GDP in 2004 – 2005 under the defined benefits scheme is likely to decline if the

same is not replaced by the contributory pension scheme as envisaged in the PFRDA bill. The

committee has ultimately recommended that the existing “Pay as you go” pension which is

presently in vogue will be ideas and may be continued.

Since the new scheme is neither in the interest of the country as it increases the outflow

on account of pension liability not to the Civil Servants for it does not guarantee a minimum

pension, we appeal to you kindly cause withdrawal of the PFRDA Bill from the Parliament

immediately.

our letter mentioned above to reconstitute IV Level ROC and allot seats to AIDAA (CB)

Pune and AIDEA (HQ) Kolkata proportionately as per the membership strength of both

the Association under their Command.

As per the information received from CGDA New Delhi Office, AIDAA (CB) Pune was

having the membership strength of 296 and AIDEA (HQ) Kolkata Membership Strength

of 44 for the year 2010 – 11. Further the membership strength of AIDAA (CB) Pune for

the year 2011 - 2012 is 269 whereas the membership strength of AIDEA HQ, Kolkata is

44.

In the proportionate distribution of 8 seats AIDAA (CB) Pune should be allotted seven

(7) seats and AIDAA HQ Kolkata should be allotted only one seat.

It is surprising that CFA, BGF Ishapore has recently written letters to Shri. G.P. Datta,

Secretary General AIDEA (HQ) Kolkata and asked to send nominations for all the 8 seats

which is against the spirit of the JCM Norms and ethics. It is not understood on what

basis the said letter is issued and all the 8 seats are allotted to AIDEA (HQ) Kolkata.

We hereby lodge our strong protest for such type of bias letter issued by CFA, BGF

Ishapore. The administration should be neutral in this regard.

We hereby demand, please issue necessary instructions to CFA, BGF Ishapore to cancel

letter No.CA/BGF/61/ROC/X dt. 9.2.2012 and reconstitute IV Level ROC under CFA,

BGF allotting 7 seats to AIDAA (CB) Pune immediately.
