Culvert Pipe Material Selection in MAP-21Sec. 1525, P.L. 112-141

During its 2012 consideration of the highway reauthorization bill, MAP-21, Congress unanimously restored the ability of states to select their preferred culvert pipe based upon their state engineers’ recommendations and local prevailing

conditions. Congress, and the Federal Highway Administration, recognized that states are most qualified to select safe and sustainable culvert pipe infrastructure, putting this engineering decision back into the hands of engineers.

When Congress was writing the 2005 surface transportation bill that is now known as SAFETEA-LU, language was added by the Conference Committee which was intended to encourage competition in the procurement of culvert pipe. Unfortunately, the unintended impact of that language was to force States to open their standards for culvert pipe to include, in some cases, products previously rejected by the state’s engineers rather than allowing the states to continue to rely on sound engineering principles, safety considerations, and proven performance.

WHY WAS IT NECESSARY TO CHANGE THE LAW?

In January 2013, DOT published a final rule in the Federal Register. A copy is available online at http://www.gpo.gov/fdsys/pkg/FR-2013-01-28/pdf/2013-01583.pdf.

HAS U.S. DOT IMPLEMENTED THE LAW?

HOW HAVE THE STATES REACTED TO THE NEW LAW?A recent AASHTO survey of State DOTs shows an overwhelming favorable opinion of Section 1525. Of the States that responded to the survey, 75% found the provision beneficial and 25% were either unaware of the law or had not made a judgment. No State responded in the negative.

The natural flow of rainwater across the landscape in small streams often intersects with roads, railroad tracks, and man-made trails. Unless the flow of water is properly funneled beneath the road, the storm water runoff will soon accumulate and spill over the road. A culvert is a pipe that serves as a conduit for this water, carrying it, by gravity, not pressure, below the road to the other side where the water can resume its natural flow. It is, essentially, an underground bridge made of concrete or some other type of material. Culverts are an essential feature of federally-funded interstate highways. A properly selected culvert pipe will, despite the constant exposure to the elements, have a useful lifespan of 100 years. This “Life Design” will prevent premature failure of the roadway surface.

WHAT IS A CULVERT AND HOW IS IT USED IN HIGHWAY PROJECTS?

Section 1525 of MAP-21, “State Autonomy for Culvert Pipe Selection,” directed the U.S. Secretary of Transportation to ensure that States have the autonomy to determine – without any federal interference – the type of culvert pipe material to be used for highway projects within their borders.
