An Act Establishing a Medical and Educational Institution to Address, Among Others, Both
Medical and Educational Needs of Persons with Special Needs and isabilities!"
Section 1. Title.-This act shall be known as #he Special Education and Medical S$stem ofthe Philippines!"
Title I
Declaration of Principles
Section 2. Declaration of Principles-the State recognizes the rights and the privileges that
should be granted to persons with special needs and disabilities, as well as its responsibility to
protect and provide these persons with quality and proper education. The grant of the rights and
privileges for Persons with special needs and Disabilities shall be guided by the following
principles
!a". Persons with special needs and Disabilities have the sa#e rights as other people to
take their proper place in society. They should be able to live freely and as independently as
possible. This #ust be the concern of everyone the fa#ily, co##unity and all govern#ent and
non$govern#ent organizations Persons with special needs and Disabilities% rights #ust never be
perceived as welfare services by the &overn#ent.
(b). Education of children and adults with special needs and disabilities,
as a part of unied educational system is realized pursuant to this law and
special laws by which preschool, elementary, general, secondary, andvocational education.
States Parties should ensure that:

co#pulsorypri#ary education, or fro# secondary education*
+. dults with special needs and disabilities have access to general tertiary
education, vocational training,adult educationandlifelong learning*
-. Persons with special needs and disabilities receive the necessary support, within the
general education syste#, to facilitate their effective education* and
. /ffective individualized support #easures are put in place to #a)i#ize acade#ic and
social develop#ent.

!c" The 0aw requires #edical care providers to #ake their services available in an accessible
#anner to all Persons with Special 1eeds and Disabilities
'. 2ull and equal access to their health care services and facilities* and+. 3easonable #odifications to policies, practices, and procedures when necessary to #ake
health care services fully available to Persons with special needs and disabilities, unlessthe #odifications would funda#entally alter the nature of the services
!d". To facilitate integration of Persons with special needs and disabilities into the
#ainstrea# of society, the State shall advocate for and encourage respect for these persons. The
State shall e)ert all efforts to re#ove all social, cultural, econo#ic, environ#ental and attitudinal
barriers that are pre4udicial to persons with special needs and disabilities.
Section 3-Coverage: This ct shall covers all persons with special need and disabilities, to the
e)tend herein provided, depart#ents, offices and agencies of the 1ational &overn#ent or non$
govern#ent organization involved in the attain#ent of the ob4ectives of this ct.
Title II
Definition of Terms
Section . Definition of Terms: !or purposes of this "ct# these terms are defined as follo$s:
!a". Disa%led Personsare those suffering fro# restriction of different abilities, as a
result of a #ental, physical or sensory i#pair#ent, to perfor# an activity in the #anner or withinthe range considered nor#al for a hu#an being*
!b". Disa%ilit& shall mean!'" a physical or #ental i#pair#ent that substantially li#its
one or #ore psychological, physiological or anato#ical function of an individual or activities of
such individual* !+" a record of such an i#pair#ent* or !-" being regarded as having such an
i#pair#ent*
!c". 'andicaprefers to a disadvantage for a given individual resulting fro# an
i#pair#ent or a disability, that li#its or prevents the functions or activity, that is considered
nor#al given the age and se) of the individual*
!d". Persons $ith Special (eeds are persons $ith physical, #ental, and sensory
disability* behavioral disorders* serious chronic diseases* e#otional disorders* co#bined
disorders* children ill for a long ti#e, and other children who encounter difficulties in learning
who need education by the educational progra# with ad4usted tuition and additional professional
help, or by a special curriculu#.

Title III
The )edical and *ducational Institute for Persons $ith Special (eeds or Disa%ilit&
Section +. The Institute and Its )andate.This act shall create The 5edical nd /ducational
6nstitute 2or Persons 7ith Special 1eeds or Disability. The 6nstitute shall provide quality
education together with the proper #edical attendance needed by persons with special needs or
disability to help the# i#prove their condition, to be #ore productive, to help the# be #ore
socially involved, and to help the# realize their strengths and talents in order to build in the#
self$worth and confidence.
Section ,. %ective of *ducation. 8b4ectives of education of persons with special needs and
disabilities are
'" Providing of equal possibilities of education for all persons with special needs and
disabilities*
+" Providing of respective conditions which enable opti#al develop#ent*
-" Ti#ely orientation and inclusion in respective curriculu#*
" 6ndividual approach*
9" Preservation of balance of physical, intellectual, e#otional and social develop#ent*
:" 6nclusion of parents in the process of habilitation, rehabilitation and education*;" (ontinuity of curriculu#*

!nurse and physiotherapist" in special institution #ay be a person that co#pleted at least a
relevant high school and has the necessary e)perience in har#ony with the act on syste#ization.
Section 0. The Curriculum:
/ducation of persons with special needs and disabilities according to the curriculu# with
ad4usted i#ple#entation and additional professional assistance is i#ple#ented individually, in
special groups or classroo#s in school, respectively special institutions through a 4oint teaching
process in individual courses with other students or 4oint participation in e)tracurricular activities
of school, respectively through the instruction in so#e courses they attend with their peers fro#
neighboring school.
Scope and #anner of i#ple#enting additional assistance is deter#ined by a decision on
orienting the children with special needs, in har#ony with the curriculu#.
Special Curriculum
/ducation of children and adult with special needs who cannot be educated in school,
owing to necessary support and close connection of education, habilitation and rehabilitation, is
i#ple#ented in special institutions.
Curricula
/ducation of children with disorders in behavior and personality are i#ple#ented on
basis of curriculu# with ad4usted i#ple#entation and additional professional assistance,
pursuant to regulations on ele#entary and secondary education, provided that it has not been
otherwise defined by this law.
Individual Curriculum
Preschool institution, school, respectively special institution shall adopt individual
curriculu# for persons with special needs, with the opinion of the >ureau for /ducational
Services, in cooperation with a parent within -? days as of the ad#ition of child. The individualcurriculu# shall deter#ine for#s of educational work for educational fields, respectively
teaching sub4ects, way of i#ple#enting the additional professional assistance, possibility of
passing a#ong the progra#s, ad4ust#ent in organization, assess#ent of knowledge, #arking of
knowledge, achieve#ents and advance#ent of children, as well as schedule of school lessons.

tea# co#posed of teachers, professional associates of preschool institution, school or special
institution, with participation of parents. 6ndividual curriculu# #ay be changed throughout a
year, or ad4usted in har#ony with advance#ent in child@s develop#ent.
