Her Majesty, by and with the advice andconsent of the Senate and House of Commonsof Canada, enacts as follows:

SHORT TITLE

1. This Act may be cited as the Parliamen-tary Budget Officer Act.

PARLIAMENT OF CANADA ACT

2. Subsection 75(4) of the Parliament of

Canada Act is replaced by the following:

(4) The officers, other than the ParliamentaryLibrarian and the Associate ParliamentaryLibrarian, and the clerks and servants who are

authorized by law and required for the service ofthe Library may be appointed in the mannerprescribed by law to hold office during pleasure.

3. Section 78 of the Act is replaced by the

following:

78. The Parliamentary Librarian, the Associ-ate Parliamentary Librarian and the otherofficers, clerks and servants of the Library areresponsible for the faithful discharge of theirofficial duties, as defined, subject to this Act, byregulations agreed on by the Speakers of thetwo Houses of Parliament and concurred in bythe joint committee referred to in section 74.

4. Section 79.1 of the Act is replaced by

79.1 (1) There is hereby established theposition of Parliamentary Budget Officer, theholder of which is an officer of Parliament.

(2) The Governor in Council shall, bycommission under the Great Seal, appoint aParliamentary Budget Officer after consultationwith the leader of every recognized party in bothHouses of Parliament and approval of theappointment by resolution of those Houses.

(3) In order to be appointed under subsection(2), a person must, at the time of his or herappointment,

(a) be able to understand English and Frenchwithout the aid of an interpreter and toexpress himself or herself clearly in bothofficial languages;

(b) have experience and knowledge of thefederal budget process; and

(c) have an appropriate educational back-ground, including a graduate degree ineconomics, finance or accounting.

(4) The Parliamentary Budget Officer shallbe paid the remuneration and expenses set bythe Governor in Council.

(5) The Parliamentary Budget Officer holdsoffice during good behaviour for a term of sevenyears, but may be removed for cause by theGovernor in Council at any time on address ofthe Senate and House of Commons.

(6) The Parliamentary Budget Officer iseligible to be reappointed, in accordance withsubsection (2), for one or more terms of up toseven years.

(7) Six months prior to the expiration of theserving Parliamentary Budget Officers term,the Governor in Council shall confirm theappointment of a new Parliamentary BudgetOfficer or the reappointment of the serving

Parliamentary Budget Officer, in accordancewith subsection (2), to take effect upon theexpiration of the serving Parliamentary BudgetOfficers term.

79.1 (1) Est cr le poste de directeurparlementaire du budget, dont le titulaire esthaut fonctionnaire du Parlement.

(2) Le gouverneur en conseil nomme ledirecteur parlementaire du budget par commis-sion sous le grand sceau, aprs consultation duchef de chacun des partis reconnus des deuxchambres du Parlement et approbation parrsolution de ces chambres.

(3) Pour tre nomme en vertu du paragraphe(2), une personne doit :

a) avoir une comprhension du franais et delanglais sans laide dun interprte ainsi quela capacit de sexprimer clairement dans lesdeux langues officielles;

b) avoir une exprience de travail et des

connaissances dans le domaine du processusbudgtaire fdral;

c) avoir fait des tudes pertinentes, notam-ment tre titulaire dun diplme dtudessuprieures en conomie, en finance ou encomptabilit.

(4) Le directeur parlementaire du budgetreoit la rmunration et les indemnits fixespar le gouverneur en conseil.

(5) Sauf rvocation motive par le gouver-neur en conseil sur adresse du Snat et de laChambre des communes, le directeur parlemen-taire du budget exerce ses fonctions titreinamovible pour un mandat de sept ans.

(6) Le mandat du directeur parlementaire dubudget est renouvelable, conformment auparagraphe (2), pour une ou plusieurs priodesmaximales de sept ans.

(7) Six mois avant lexpiration du mandat dudirecteur parlementaire du budget en poste, legouverneur en conseil confirme la nominationdun nouveau titulaire ou le renouvellement dumandat du titulaire en poste, conformment au

paragraphe (2). La nomination ou le renouvel-lement prend effet lexpiration du mandat dutitulaire en poste.

(8) If the Parliamentary Budget Officerceases to hold office, the Governor in Councilshall appoint a new Parliamentary BudgetOfficer, in accordance with subsection (2), nolater than six months after the cessation ofoffice.

(9) A Parliamentary Budget Officer ceases tohold office when he or she

(a) is removed for cause by the Governor inCouncil on address of the Senate and Houseof Commons;

(b) resigns;

(c) dies; or

(d) is otherwise incapacitated.

(10) The Parliamentary Budget Officer shallengage exclusively in the functions and dutiesassigned to his or her office under this Act orany other Act of Parliament and may not holdany other office under Her Majesty or engage inany other employment for reward.

79.11 The Parliamentary Budget Officer hasthe rank of a deputy head of a department of theGovernment of Canada and has the control andmanagement of the office of the ParliamentaryBudget Officer.

5. (1) Section 79.2 of the Act is renum-

bered as subsection 79.2(1).

(2) Paragraph 79.2(1)(a) of the Act is

replaced by the following:

(a) provide independent analysis, on his orher own initiative or when requested to do sounder this section, to the Senate and to theHouse of Commons about the state of thenations finances, the estimates of the govern-ment, the direct and indirect costs related togovernment programs, the financial cost ofany proposal that relates to a matter overwhich Parliament has jurisdiction and anyother aspect of the national economy;

(3) Section 79.2 of the Act is amended by

adding the following after subsection (1):

(10) Le directeur parlementaire du budget seconsacre lexercice des fonctions que luiconfre la prsente loi ou toute autre loifdrale, lexclusion de toute autre charge auservice de Sa Majest ou de tout autre emploirtribu.

79.11 Le directeur parlementaire du budget arang dadministrateur gnral de ministre; ilest, ce titre, responsable de la gestion de sonbureau.

5. (1) Larticle 79.2 de la mme loi devient

le paragraphe 79.2(1).

(2) Lalina 79.2(1)a) de la mme loi est

remplac par ce qui suit :

a) de fournir au Snat et la Chambre descommunes, de sa propre initiative ou surdemande en vertu du prsent article, desanalyses indpendantes de la situation finan-cire du pays, des prvisions budgtaires dugouvernement, des cots directs et indirectslis des programmes gouvernementaux, ducot financier de toute mesure proposerelevant des domaines de comptence duParlement ainsi que de tout autre aspect delconomie nationale;

(3) Larticle 79.2 de la mme loi est

modifi par adjonction, aprs le paragraphe

(1), de ce qui suit :

(2) The Parliamentary Budget Officer shallreport annually to the Senate and the House ofCommons on the discharge of his or hermandate, calling attention in the report toanything that he or she considers to be ofsignificance and of a nature that should bebrought to the attention of the House ofCommons or the Senate.

(3) Any analysis, research, estimate or reportthat is prepared by the Parliamentary BudgetOfficer pursuant to subsection (1) or (2) shallimmediately be made available to the public andto all members of the Senate and the House ofCommons.

(4) Section 79.3 of the Act is replaced by

the following:

79.3 (1) Except as provided by any otherAct of Parliament that expressly refers to this

subsection, the Parliamentary Budget Officer isentitled, by request made to the deputy head of adepartment within the meaning of any ofparagraphs (a), (a.1) and (d) of the definitiondepartment in section 2 of the FinancialAdministration Act, or to his or her equivalent,or to any other person designated by that deputyhead or his or her equivalent for the purpose ofthis section, to free and timely access to anydata, information, records, explanations andassistance that the Parliamentary Budget Officerconsiders necessary to fulfil his or her respon-sibilities under section 79.2.

(1.1) Where the deputy head of a departmentor his or her equivalent or designate refuses toprovide the data, information, records, explana-tions or assistance requested under subsection(1), the Federal Court shall, if it determines thatthere is no ground to refuse to provide the data,information, records, explanations or assistance,order the deputy head of the department or hisor her equivalent or designate to provide thedata, information, records, explanations orassistance, subject to such conditions as the

Court deems appropriate.

(2) Subsection (1) does not apply in respectof any data, information, records or explana-tions

au prsent paragraphe, le directeur parlemen-taire du budget a le droit, sur demande faite ladministrateur gnral dun ministre, au sensdes alinas a), a.1) ou d) de la dfinition de ministre larticle 2 de la Loi sur lagestion des finances publiques, ou au titulairedun poste quivalent, ou toute personnedsigne par cet administrateur gnral ou cetitulaire pour lapplication du prsent article,dobtenir, gratuitement et en temps opportun,tous les renseignements, les donnes, lesdossiers, les explications et lassistance quilestime ncessaires pour sacquitter de sesresponsabilits au titre de larticle 79.2.

(1.1) Dans le cas o ladministrateur gnraldun ministre, le titulaire dun poste quivalentou la personne dsigne refuse de fournir lesdonnes, les renseignements, les dossiers, lesexplications ou lassistance demands au titredu paragraphe (1), la Cour fdrale, si elleconclut quaucun motif ne justifie le refus,ordonne, aux conditions quelle juge indiques, ladministrateur gnral, au titulaire ou lapersonne dsigne de fournir les donnes, lesrenseignements, les dossiers, les explications ou

lassistance demands.

(2) Le paragraphe (1) ne sapplique pas auxdonnes, renseignements, dossiers ou explica-tions qui, selon le cas:

(a) that are information the disclosure ofwhich is restricted under section 19 of theAccess to Information Act or any provisionset out in Schedule II to that Act; or

(b) that are contained in a confidence of theQueens Privy Council for Canada described

in subsection 69(1) of that Act, unless thedata, information, records or explanation arealso contained in any other record, within themeaning of section 3 of that Act, and are notinformation referred to in paragraph (a).

(4) No grounds other than those described insubsection (3) shall be relied upon to authorize arefusal to provide the data, information, records,explanations or assistance requested.

6. (1) Subsection 79.5(1) of the Act is

replaced by the following:

79.5 (1) The Parliamentary Budget Officermay, in carrying out the work of the office of theParliamentary Budget Officer, enter into con-tracts, memoranda of understanding or otherarrangements.

(1.1) The Parliamentary Budget Officer mayemploy any officers and employees and mayengage the services of any agents, advisers andconsultants that the Parliamentary BudgetOfficer considers necessary for the properconduct of the work of the office of theParliamentary Budget Officer.

(2) Subsections 79.5(3) and (4) of the Actare repealed.

7. The Act is amended by adding the

following after section 79.5:

79.6 (1) Prior to each fiscal year, theParliamentary Budget Officer shall cause to beprepared an estimate of the sums that will berequired to pay the charges and expenses of theoffice of the Parliamentary Budget Officerduring the fiscal year.

(2) The estimate referred to in subsection (1)shall be considered by the Speaker of the House

of Commons and then transmitted to thePresident of the Treasury Board, who shall layit before the House of Commons with theestimates of the Government for the fiscal year.

6. (1) Le paragraphe 79.5(1) de la mme

loi est remplac par ce qui suit :

79.5 (1) Le directeur parlementaire du bud-get peut, dans le cadre de lexercice de sesactivits, conclure des contrats, ententes ouautres arrangements.

(1.1) Il peut sassurer les services despersonnes membres du personnel, mandatai-res, conseillers ou experts quil juge nces-saires lexercice de ses activits.

(2) Les paragraphes 79.5(3) et (4) de lamme loi sont abrogs.

7. La mme loi est modifie par adjonc-

tion, aprs larticle 79.5, de ce qui suit :

79.6 (1) Avant chaque exercice, le directeurparlementaire du budget fait dresser un tatestimatif des sommes affecter au paiement desfrais de son bureau au cours de lexercice.

(2) Ltat estimatif est examin par leprsident de la Chambre des communes puis

transmis au prsident du Conseil du Trsor, quile dpose devant la Chambre des communesavec les prvisions budgtaires du gouverne-ment pour lexercice.
