Legislative (John) – Ongoing legislative actions – The letters to Rep. Dorothy Hukill with regards to her re-introducing helmet legislation/law in Florida must have worked, no word on her sponsoring bill. For more infor-mation, see the legislative updates in this newsletter.

Safety (Mike) – Volusia school district request Abate’s assistance in teaching Motorcycle safety. Need people to getMotorcycle Safety Awareness Program (MSAP) certified. Made motion to purchase TV w/DVD player for instruc-tional videos. Need to get information on MSAP training.

CUTR, working for Florida DHSMV and FDOT, is trying to analyze motorcyclist views on man-datory helmets and our reaction to being told we should all wear reflective vests. Have fun; try not to write any-thing naughty. As mentioned in the 2014 Florida Motorcycle Assessment by NHTSA prepared by Florida Depart-ment of Transportation Safety Office and Center for Urban Transportation Research (CUTR) University of SouthFlorida, DHSMV and FDOT think we should all wear reflective clothing. To infer that motorcyclists are not visi-ble to automobile drivers and bear responsibility for not being visible is ludicrous. I find that comparable to tellinga rape victim she is responsible because she wore something provocative. BMW riders are into reflective motorcy-cle gear. Harleys have flamboyant paint jobs and chrome. After taking the survey, I sent another email to CUTRand was answered by the head honcho himself.Thanks for your feedback John. I’m passing this along to the survey coordinator,Dr. Chanyoung Lee.Thanks!Center for Urban Transportation Research (CUTR)University of South FloridaPhone: (813) 974-2049Fax: (813) 974-5168Email: [email protected] suggested that if you think that reflective vest will make a difference (I do not), then perhaps DHSMV (with em-ployees as registered lobbyist) get a law passed that if someone hits a motorcyclist, wearing a FDOT approvedvest, then they get charged with reckless driving. That charge can bring 30 days jail time or probation. Of courseABATE will not endorse this. We have been trying to get enhanced penalties for years, for ALL motorcyclists. Beaware that vests can have logos on them, my company issued vest does. This can open up a lot of issues. Hopeful-ly they would ask for ABATE’s input. Many interesting ideas get written into BAD legislation. Example: the pop-ping wheelies and flipped up license plate laws that was pushed through (sponsored by the now Lt. Governor (.Our lobbyist, Doc Reichenbach, was able to get the confiscation portion taken out, put it took several sessions tofix the vertical license plate problem.

Here are our State motorcycle issues:

The DHSMV is disassociating itself from ABATE of Florida. They are pushing for helmet laws again and it could get nasty.Entrenched bureaucracies also do not like citizen oversight. All unused safety money can be transferred to the DHSMV generalfund. The DHSMV was not doing anything until ABATE was able to administer a portion and did something. ABATE hastried to get an accounting on what they spend. In the past, we even asked some of our friendly legislators for help (Sen. TonyHill). When we administered the funds, ABATE had to file paperwork.

2000 was the year we got the Florida Helmet law changed.

Who do you think you are blaming society’s problems on motorcyclists?

Well, we are going to try to make them understand. The average citizen, Joe Six Pack, Ms. Soccer mom and SuzyCream cheese think that if they have wear a seatbelt, we should wear a helmet. Seat belts are now non-intrusive andwork. Helmets do not.

If you know boaters, ask them how they would feel with mandatory life jackets to be worn law. There are many drowningdeaths. Ask a bicyclist about a mandatory helmet law. In 2012 there were 6425 bicycle crashes, of which 116 bicyclists died.Of those fatalities, 14 bicyclists were wearing helmets. The 2002 DHSMV Traffic Crash Facts states: “While the use of pro-tective equipment by motorcyclists and their passengers is expected to be more effective in preventing incapacitating and fatalinjuries, the inclusion of all types of bodily injuries for motorcyclists and passengers fails to show the true effect of safety hel-met use. The data for bicyclists and their passengers are more supportive of the use of helmet.” Here is Mark Lanes response:Dear John -Thanks for the note. Florida now requires bike helmets for riders under 16, one of 21 states with a child helmet law.No state now requires helmets for adult riders although two foreign nations do. I very much doubt Florida wouldwant to be the first place in the US to try it. Even people in the cycling community are split on the possible effects ofadult helmet laws. The Australian bicycle helmet law is very unpopular and it's still unclear whether it actually re-duces injuries. It does seem to discourage people from cycling, though. Myself, I don't leave home without one,but would like to see more money andtime spent on raising awareness about helmets rather than experimenting with a strict helmet law that would provepolitically unworkable.Thanks for reading,Yours,Mark LaneMark Lane

Doc has reported that Sen. Hukull will not be sponsoring the mandatory motorcyclehelmet bill. However, there has been no response to Bobby C or my letters. I have re-ceived a reply from State Rep. Travis Hutson district 24. I sent him our NHSTA myths factsheets #1 and #2. His response was “I cannot make any promises at this time. However,you present a compelling argument and I will take all facts into consideration”. I hadhope for something better.

LAWMAKERS OUTLINE SCHEDULE LEADING UP TO SESSIONFlorida lawmakers will return to the Capitol on Nov. 18 for an organizational session to swear in

members and to formally install Sen. Andy Gardiner, R-Orlando, as Senate president and Rep. Steve Crisafulli,R-Merritt Island, as House speaker. The choice of Crisafulli remains contingent on him winning re-election Nov. 4in House District 51. Schedules released by the chambers also show that lawmakers will not hold committeemeetings in December, though there will be training for new House members the week of Dec. 8. Committeeswill meet the week of Jan. 5, the week of Jan. 20, the week of Feb. 2, the week of Feb. 9 and the week of Feb.16. The 2015 session will start March 3.

STATE SETS SIX MAJOR ROAD PROJECTS FOR 2015Six large road projects throughout Florida, with a combined cost of $806.7 million, have been formally moved tothe front of the state's Five Year Work Program. The change means work on the projects, some of which hadn'tbeen scheduled to begin until after 2020, will start in 2015, a state Department of Transportation spokesmansaid. The projects, mostly involving reconstruction and adding lanes, are on U.S. 41 in Charlotte County; Inter-state 75 in Hernando County; State Road 30 in Bay County; Interstate 295 in Duval County; Interstate 95 in Volu-sia County; and State Road 821 in Miami-Dade County. The work in Volusia County, to six-lane a 14-mile stretchof I-95, is the most expensive at $255 million. "These projects will enhance our infrastructure to support com-merce, decrease commute times and make our roads safer for families," Gov. Rick Scott said in a preparedstatement Thursday. This gives the DHSMV employees that are registered lobbyists, an advantage. Mark Lanewrote that the I4 corridor is a deciding factor in State election.

NEARLY HALF OF HOUSE DISTRICTS DECIDEDThe winners of almost half of the 120 Florida House seats have already been decided --- or are all but decided. Af-ter Tuesday's primary elections, 46 seats have been won, either by candidates running unopposed or by candidateswho emerged from the primaries without opposition in the November general election. Meanwhile, another 13 can-didates will face only write-in opponents in November, virtually assuring election. Those candidates include DougBroxson; Alan Williams; Elizabeth Porter; Charles McBurney; Bruce Antone; Ed Narain; Julio Gonzalez; Dane Ea-gle; Heather Fitzenhagen; Bobby Powell; Hazelle Rogers; Kristin Jacobs. Also facing only a write-in candidate inNovember will be the winner of the too-close-to-call House District 15 primary between Jacksonville RepublicansJay Fant and Paul Renner.

SENATE LIKELY TO SEE LITTLE CHANGE IN NOVEMBERWith incumbents dominating their opponents in Tuesday's primaries, the Florida Senate likely will see little turnoverin the November elections. Half of the 40 Senate seats were up for election this year. Eight incumbents were unop-posed, and Senate Majority Leader Lizbeth Benacquisto, R-Fort Myers, assured herself of another term by winninga primary in Southwest Florida's District 30. Also, three incumbents, Rockledge Republican Thad Altman, BrandonRepublican Tom Lee and Miami Gardens Democrat Oscar Braynon, are almost guaranteed of winning another termbecause they face write-in candidates in November. Of the remaining eight seats, only five incumbents --- St. Au-gustine Republican John Thrasher, St. Petersburg Republican Jeff Brandes, Stuart Republican Joe Negron, Orlan-do Democrat Geraldine Thompson and Delray Beach Democrat Maria Sachs --- have major-party opposition.Meanwhile, Altamonte Springs Republican David Simmons and Orlando Democrat Darren Soto will face opponentswithout party affiliation, while Clearwater Republican Jack Latvala will be challenged by a Libertarian.

POWER OF INCUMBENCY ON DISPLAY IN PRIMARIESTuesday was a good night to be an incumbent lawmaker. Incumbent members of Congress and the Legislaturewon 28 of 29 primary races, with only first-term state Rep. Ricardo Rangel, D-Kissimmee, losing his seat. The mar-gins of victory also show the power of incumbents, with 25 of the 28 receiving 60 percent or more of the votes intheir contests. As another indication, all eight of the congressional incumbents who faced primary challenges re-ceived at least 70 percent of the votes.

MRF 14NR37 - EPA sends ethanol regulations to White House 28 August 2014

The Environmental Protection Agency (EPA) sent its final regulations to the White House for Presidential approval,the Motorcycle Riders Foundation (MRF) reports. This is the final step in the approval process before the mandatecan be revealed. Last year, the EPA proposed that the amount of ethanol to be produced by refiners actually be re-duced over previous years. This plan to reduce the amount of ethanol to be produced by refiners sent shockwavesthrough the energy community. Petroleum users lauded the proposal as a step in the right direction. The MRF testi-fied at an EPA hearing on the proposal in favor of more study on the effects that E-15 can have on the componentsof a motorcycle. The MRF is also actively supporting legislation to end the sale of E-15 fuels until a comprehensive,scientific study is conducted by an independent agency. To date the EPA has only tested the higher ethanol blend'stail pipe exhaust emissions, no testing was done on the power train of a motorcycle itself before the blend was ap-proved. The proposal was by far one the most controversial ever put forth by the EPA and received over 340,000public comments. While the EPA announced the White House review they did not release whether any changeswere made to last year's proposal to lower the amount of ethanol that needs to be produced. The EPA will releasethe final rule after the White House and other federal agencies weigh in. The White House has 90 days to review theproposal and issue a response. The Motorcycle Riders Foundation will keep you informed on this issue.
