animals, in terms of the provisions of the Prevention of Cruelty to Animals

Act (PCA) 1960 and Rules thereunder

CONSTITUTIONAL AND STATUTORY PROVISIONS & FUNCTIONS

Article 48: The State shall endeavour to organise agriculture and animal

husbandry on modern and scientific lines and shall, in particular, take steps

for preserving and improving the breeds, and prohibiting the slaughter, of

cows and calves and other milch and draught cattle.

Article 48 A: The State shall endeavour to protect and improve the

environment and to safeguard the forests and wild life of the country

Article 51A makes it a fundamental duty of every citizen to protect and

improve the natural environment including forests, lakes, rivers and wild

life, and to have compassion for living creatures.

The Prevention of Cruelty to Animals (PCA) Act 1960

ANIMAL WELFARE BOARD OF INDIA (AWBI)

A statutory advisory body established in 1962 to promote

animal welfare in the country (u/S 4 of the PCA Act, 1960)

Board is constituted every three years (u/S 5)

Existing Board from Mar 2014 to Feb 2017; consists 22

members

Main activities of the Board:

Recognition provided to over 3000 animal welfare organizations

Release of grants-in-aid under various animal welfare schemes

Inspection of Slaughter Houses

Publication of newsletter and pamphlets

Conducting trainings of Honorary Animal Welfare Officers and seminars on various aspects of animal welfare

SCHEMES UNDER AWBI

1. Gaushalas/Shelter Houses Scheme for looking after

animals (one time up to Rs. 22.5 lakh/shelter) i.e. up to

90% of the project cost

2. Animal Birth Control & Immunization of Stray Dogs

(up to Rs. 445/dog)

3. Ambulance Scheme to provide Services to Animals in

Distress (up to Rs. 4.5 lakh/ambulance) i.e. up to 90% of

the project cost

4. Scheme for Relief To Animals During Natural

Calamities and Unforeseen Circumstances.

5. Plan Scheme (up to Rs. 5 lakh/year/shelter) depending

upon number of animals.

Established u/S 15(1) of the PCA Act 1960

Mandate: to take all measures to ensure that animals

are not subjected to unnecessary pains or

suffering before, during or after performance of

experiments on them

The present Committee consists of 23 members (10

officials and 13 non-officials)

The Committee approves research protocols of

experiments on animals

Scope of Operation:

a) To bring untapped Academic and Bio-medical Research organizations

in the country under the ambit of CPCSEA by registering them

b) Till date 1617 establishments are registered with CPCSEA and efforts

are being made to register the establishment which are not yet

registered

Laboratory Animals Day’ on 24 April 2015)

• Made the processes of registration and renewal of registration/

reconstitution of IAEC online

• Framing of the Guidelines for the Reuse and Rehabilitation of

Dogs

• Revisiting of the Guidelines on Animal Houses

• Release of sticker on Animal Welfare

National Institute of Animal Welfare (NIAW)

Foundation laid on 16 Jan 1999; became operational in 2006

Mandate:

To assist in implementing the statutory requirements of the Act

To aid in improvement of Animal Welfare through public

outreach, research and education

To run degree & diploma courses in Animal Welfare and create

professionally competent manpower to man zoos, municipality,

slaughter houses and veterinary hospitals

Only weekly/fortnightly certificate courses are being conducted so

far

Jawaharlal Nehru University has been identified to run Animal

Welfare courses at NIAW campus (MoA signed on 29.06.2016 for 5

years)

Amendment to the Prevention of Cruelty to Animals Act, 1960

The fines prescribed in the Act are very meager

Demand for increasing the penalty to deter cruelty against

animals

Amendment will enhance penalty for infliction of unnecessary

pain or suffering on animals and enable participation of animals

at events held traditionally as a part of customs or culture in

different part of the country.
