INTRODUCTIONThe Department of Public Safety is responsible for maintaining a safe environment on the properties of the University of Michigan-Flint. The department’s primary goals are:
•Todeter,detectandrespondtocriminalactivityoncampusandnearcampus
•Toassiststudents,faculty,staff,andvisitorstothecampuswithsecurityrelatedproblems

TheDPSisaprofessional,full-servicelawenforcementagencywiththeresponsibilitytoprovidepoliceservicestoourcampuscommunity24hoursadayand365daysayear.Wearecommittedtoestablishingapartnershipwiththecommunitytoaddresssafetyconcerns,reducecrimeandimprovequality-of-life.
This report is part of our on-going effort to inform you of the safety programs and services available to the University ofMichigan-Flint community, the crimes that are reported to our police and security personnel,and thestepsyoucan take tomaintaina safeandsecurecampus. It also isprovidedasour compliancedocumentascalled forunder theJeanneCleryDisclosureofCampusSecurityPolicyandCampusCrimeStatisticsActaswellastheannualFireSafetyReportasrequiredbytheHigherEducationOpportunityAct.
The DPS takes the commission of crimes against our students, faculty, staff and a visitor seriously andaggressively responds to and investigates reported crimes. We collaborate with other law enforcementagencies and campus groups to reduce crime on campus.
Wecollaboratewithother lawenforcementagenciesandcampusgroups to reducecrimeoncampus.Weoffer free educational opportunities such as but not limited to Rape Aggression Defense training (RAD),alcohol awareness sessions, active shooter and lock down educational sessions and bicycle/pedestriansafetyclasses.Wearecommitted toengagingourcommunityandourdepartmenthas takena leadershiprole in sponsoring and organizing events such asTouch-A-Truck and a three on three “Stop theSilence”basketball tournament.Wewelcomeyou to visit our departmentwebsite and consider participating in oneof our personal safety sessions or community events. Preventionisthebestremedyforcrime;therefore,allofusmustensurethatourpersonsandpropertyaresecureandprotected.Ourgoal is todevelopandmaintaina responsible, vigilantandcaringpopulationofinvolvedpeoplewhoreportsuspiciousandunlawfulbehaviorimmediatelytotheDPS.Jointheefforttohelpkeepourcampussafeandreportcriminalactivityandsuspiciousbehavior.Safetyiseveryone’sresponsibility.

EMERGENCY SERVICESTheDepartmentofPublicSafety(DPS)maintainsacommunicationsoffice,open24hoursaday,seven-days-a-week,atthevisitor’sentrancetotheMillStreetParkingDeck.Theadministrativeofficeislocatedin theHubbardBuilding and is openMonday throughFriday during regular office hours.DPSpatrolscampusbuildings,parkinglots,ramps,andallothercampusgrounds.Patrolsareconductedbyofficerson foot, inmotor vehicles, bicycle, or carts.Thepatrols are supplementedby closed circuit televisioncamerasstrategicallylocatedthroughoutcampus.Patrolsofthecampusareconducted24hoursaday,seven-days-a-week.DPS maintains security and police employees on the staff. The security employees assist with themany service functions of the department and the prevention of crime through patrols and preventive techniques.Thepoliceemployeesaredeputizedassworn,licensedpoliceofficerswhoenforcelawsandmakearrestswhenasituationcallsforsuchaction.TheUniversityofMichigan-FlinthasawrittenMemorandumofUnderstandingwiththeCityofFlintPoliceDepartment.When a UM-FLINT student is involved in an off-campus offense, police officers may assist with theinvestigationincooperationwithlocal,state,orfederallawenforcement.FlintPoliceroutinelyworkandcommunicatewithcampusofficersonanyserious incidentsoccurringon-campusor in the immediateneighborhood and business areas surrounding campus.

REPORTING PROCEDURESStudents, faculty, staff, community members and guests are encouraged to contact the DPS toaccurately and promptly report criminal activity or other emergencies on campus. In response tothesereports,anofficerwillbedispatched,the incidentwillbedocumented,andtheDPSwillconductan investigation. The investigation will allow the DPS through the Uniform Crime Reporting System,either theuniversity or court, and theplan for preventionof further occurrences.The incidentsdocumentedby the DPS will be forwarded to the Michigan State Police to be included in the computation ofstatistical information collected through the Uniform Crime Reporting System. This information is thenforwardedtotheFederalBureauofInvestigationforthecompilingoffederalstatistics.CrimesshouldbereportedtotheDPSforinclusionintheannualsecurityreportandtoaidinprovidingtimelywarningnoticesto thecampuscommunity.Campuscrimes,arrestandreferralstatistics includethose reported to DPS, designated campus officials (including but not limited to directors, deans,department heads, human resources staff, judicial affairs, advisors to students/student organizations,athleticcoaches),andlawenforcementagencies.

Ifyouwitnessacrime,suspiciousperson,orsuspiciousincidentcontacttheDPSatonce.Yourawarenessand input are essential to campus crime prevention.Ifanincidentoccursoffcampus,theDPSwillassistyouincontactingtheappropriateagency.TheDPS prepareswritten reports for all criminal activities, aswell aswritten reports for vehicle andpersonal accidents. Copies of incident reports, for insurance purposes, may be obtained from theadministrative office of Public Safety. The DPS is designated as the department responsible for compiling datafortheCleryActreport.The University of Michigan-Flint will, in an effort to provide timely notice to the UM-Flint community,provideanalert in theeventofseriouscriminal incidentwhichmayposeaseriousoron-going threattomembersofthecommunity.ThisincludesanyCleryActcrimeswhichareconsideredtorepresentaserious or continuing threat to students and employees. Typically,timelywarnings(CrimeAlerts)arewrittenbytheDirectorofPublicSafety,ordesigneeandtheyareapprovedanddistributedbytheofficeofUniversityRelations.Timely warnings (Crime Alerts) may be distributed to the UM-Flint community via e-mail, postingson bulletin boards and exterior building doors, social media or person to person, depending on theseriousnessof the incident. Updatestoanyparticularcasewhichwarrantedatimelywarningmaybesent via e-mail or social media. Eachyear,ane-mailnotificationismadetoallenrolledstudents,facultyandstaffthatprovidethewebsiteaddress toaccess this report.Copiesof this reportalsomaybeobtainedat theDepartmentofPublicSafetyintheHubbardBuildingat602MillSt.orbycalling(810)762-3335.Allprospectivestudentsandemployeesareinformedinapplicationand/ororientationpacketsofthereport’sexistenceandthewebsiteaddresswhereitcanbefound.
Voluntary Confidential Reporting and Anonymous Reporting ProceduresInformation on criminal activitymay be reported anonymously by calling the University of Michigan’sAnonymousTipLineat1-800-863-1355.CrimeStoppersalsohasaFlintareapolicetiplineat(1-800)422-5245.Allreportswillbeinvestigated.Becausepolicereportsarepublicrecordsunderstatelaw,DPScannothold reports of crime in confidence.Campus “Professional Counselors” such as Counseling, Accessibility, and Psychological Services(CAPS)staff,whenactingassuch,arenotconsidered tobeacampussecurityauthorityandarenotrequiredtoreportcrimesfor inclusionintotheAnnualSecurityReport.However,asamatterofpolicy,they are encouraged to inform persons being counseled of the procedures to report crimes on a voluntary basisfor inclusionintotheannualcrimestatistics.Aprofessionalcounselor isdefinedasanemployeewhoseofficial responsibilities includeprovidingpsychological counseling tomembersof theUniversitycommunity andwho is functioningwithin the scope of his or her license or certification or under thesupervision of a professional counselor.Personswhoarevictimsofacrimeanddonotwant topursueactionwithin theUniversity systemorthe criminal justice system still may want to consider making a confidential report. With permission,theDirectorofDPSorhisdesigneecan filea reporton thedetailsof the incidentwithout revealingavictim’sidentity.Thepurposeofaconfidentialreportistocomplywiththevictim’swishtokeepthematterconfidential,whiletakingstepstoensurethefuturesafetyofthevictimandothers.Withsuchinformation,the University can keep accurate records of the number of incidents involving students, determinewherethereisapatternofcrimewithregardtoaparticularlocation,method,orassailant,andalertthecampuscommunitytopotentialdanger.TheseconfidentialreportsofcrimescanbegiventoanyCampusSecurityAuthority,suchasaUniversityHousingstaffmember,coach,DivisionofStudentAffairsstaff,

and advisors to students and student organizations. Reports filed in this manner are counted anddisclosed in the annual crimes statistics for the institution, however, identifying information remainsanonymous.ReportingofSexualmisconductmaybemade towww.umflint.wec/forms/sexual-misconduct-incidents-form.htm. The University may not be able to address fully reports received from anonymous sources unless sufficient information is furnished to enable the University to conduct a meaningful and fair investigation.TheUniversitywill,however,takewhateverstepsitdeemsappropriateinthebestinterestsoftheoverallUniversitycommunity,consistentwiththeinformationthatisavailable.IfconfidentialityisrequestedbytheComplainantortheRespondent,oriftheComplainantrequeststhattheComplaintnotbepursued,theUniversitywilltakeallreasonablestepstocomplywiththisrequests.InsituationswhereaComplainantrequestsprivacy,theUniversity’sabilitytoinvestigateandrespondtotheallegationsmaybelimited.IftheComplainantrequeststhattheUniversitynotinvestigateand/ortheoffender isunknown, theUniversityTitle IXCoordinatorwilldetermine ifan investigation iswarranted,in consultation with the Assistant Vice Chancellor for Student Affairs and the Institutional Equity andDiversityConsultant.TheUniversitywillevaluatetherequestfornoinvestigationinthecontextofitsresponsibilitytoprovideasafeandnondiscriminatoryenvironmentforallstudents.TheUniversitywillconsiderthefollowingfactorswhendeterminingwhetheritcanmaintainconfidentiality:theseriousnessoftheallegedharassment;theageofthestudentharassed;whethertherehavebeenothercomplaintsorreportsagainsttheRespondent;andtherightsoftheRespondenttoreceiveinformationabouttheaccuserandtheallegationsifaformalproceedingwithsanctionsmayresult.TheUniversitywillensurethattheComplainantorRespondent’sidentitywillonlyberevealedonaneed-to-knowbasis.Whenareportofsexualmisconductisfiled,theComplainant, theRespondent,andall identifiedwitnesseswhoarenamed in the investigation,willbenotifiedoftheUniversity’sexpectationofconfidentiality.
JEANNE CLERY DISCLOSURE OF CAMPUS SECURITYPOLICY AND CAMPUS CRIME STATISTICS ACTThe “JeanneCleryDisclosure ofCampusSecurityPolicy andCampusCrimeStatisticsAct,” requirescolleges and universities to distribute an annual report to all current students and employees. The reportmustalsobeprovidedtoanyprospectivestudentoremployeeuponrequest. Thewebsiteandbooklet contain information regardingcampussecurityandpersonal safety includingtopicssuchas:crimeprevention,firesafety,universitypolicelawenforcementauthority,crimereportingpolicies, disciplinary procedures and other matters of importance related to security and safety oncampus. They also contain information about crime statistics for the three previous calendar years concerning reported crimes that occurred on campus; in certain off-campus buildings or property ownedor controlled by theUniversity ofMichigan-Flint; andonpublic propertywithin, or immediatelyadjacent to and accessible from the campus. The Public Safety website is located at www.umflint.edu/safety and the annual security report can be located at http://www.umflint.edu/safetyreport.The Department of Public Safety maintains a daily crime log that records criminal incidents reported to us. This logisavailableforinspectionatthePublicSafetydispatchofficelocatedintheMillStreetparkingstructure.

POLICIES FOR PREPARING ANNUAL CRIME STATISTICSThechartonpage8containsthenumberofreportedcrimesonthecampusforthepastthreeyears.Thestatisticsare for thecalendaryearJanuary1 toDecember31exceptwherenoted.Theprocedure forgatheringannualcrimestatisticsinvolvescollectingreportsofcrimefromtheDepartmentofPublicSafety,localpolice,theOfficeofStudentLifeandcampussecurityauthoritiesforbuildingsownedorcontrolledby the University of Michigan-Flint and used for educational purposes.The DPSmaintains a liaison with the City of Flint Police Department to obtain and record incidentsreported through theCityofFlintPoliceDepartment thatoccurredonpropertyownedorcontrolledbyUM-Flint.The DPS includes security considerations in the maintenance of campus facilities via regular communications with Facilities & Operations. The campus is maintained in a manner to minimizehazardoussituations.TheDepartmentofPublicSafetycommunicatesphysicalsafetyconcernssuchasburnedoutlightsormalfunctioningdoorlockstoFacilitiesandOperations.

Aggravated AssaultAn unlawful attack by one person upon another for the purpose of inflicting severe or aggravatedbodilyinjury.Thistypeofassaultusuallyisaccompaniedbytheuseofaweaponorbymeanslikelytoproducedeathorgreatbodilyharm.(Itisnotnecessarythatinjuryresultfromaggravatedassaultwhenagun,knife,orotherweaponisusedwhichcouldandprobablywouldresultinseriouspersonalinjuryifthecrimeweresuccessfullycompleted.)ArsonAnywillfulormaliciousburningorattempt toburn,withorwithout intent todefraud,adwellinghouse,publicbuilding,motorvehicleoraircraft,personalpropertyofanother,etc.BurglaryThe unlawful entry of a structure to commit a felony or theft. TheUniversityofMichigan-Flint,iscommittedtoprovidingasafe,healthylearningcommunityforallitsmembers.TheUniversityrecognizesthattheimproperandexcessiveuseofalcoholandotherdrugsmayinterferewiththeUniversity’smissionbynegativelyaffectingthehealthandsafetyofstudents,facultyandstaff.Problemssuchasvandalism,assault,harassment,anddisruptionofsleepandstudyspaceincreaseinrelationtomisuse.It isduetotheharmcausedbyexcessiveandillegalusethattheUniversityhasavested interest inestablishingpolicies toprohibitunlawfulbehavior,andsanctions toaddresspolicyviolations by members of the UM-Flint community.
Under the Drug Free Workplace Act of 1988 and the Drug Free Schools and Communities Act Amendments of 1991,theUniversityisrequiredtohaveanalcoholandotherdrugpolicyanddistributethispolicyannuallytoallemployeesandstudents.ThispolicymustoutlinetheUniversity’sprevention,educationand interventionefforts,andconsequences thatmaybeappliedbyboth theUniversityandexternal authorities for policy violations. The law also requires that individuals be notified of possiblehealthrisksassociatedwiththeuseandabuseofalcoholandotherdrugs,andsourcesofassistanceforproblems that may arise as a result of use.
Alcohol and Other Drugs Policy Employees, students, and campus visitors may not consume, possess, distribute, or be under theinfluenceofnon-prescriptiondrugsand/oralcoholicbeveragesonuniversityproperty,withthefollowingexception: 1.Universityfunctionsatwhichuseofalcoholisapproved.

Ifalcoholistobepresentatanevent,thepreferredmethodofservingalcoholistouseacatererorholdtheeventatasiteprovidedbyavendorwho is licensed tosellandservealcohol. If thesemethodsarenotpossible,thenextbestoptionistorequestthatguestsofagebringareasonableandlimitedamountofalcoholthatonlytheywillpersonallyconsumeattheevent.Schools,departments,unitsandadministrativeofficesasappropriateareexpectedtoencouragestudentorganizationcompliancewiththeseexpectationsand recommendations.
University Sanctions Students: The University has established expectations for non-academic student conduct under the

External SanctionsFederal laws impose significant criminal penalties for the unlawful possession, use, manufacture ordistributionofalcoholandillicitdrugs.Thesepenaltiesincludefinesand/orimprisonment.
Alcohol: Under Michigan law it is illegal for anyone under the age of 21 to purchase, consume orpossess,orhaveanybodilycontentofalcohol.A first timeconvictionmay result ina fine,substanceabuse education and treatment, community service and court-ordered drug screenings. There is alsoa provision for possible imprisonment or probation for a second or subsequent offense. Use of falseidentificationbyminors inobtainingalcohol ispunishablewithafine, lossofdriver’s license,probationand community service.
Individuals can be arrested/convicted of operating a vehicle while intoxicated with a blood alcoholconcentration(BAC)levelat.08orhigher.Ifastudentisunder21,thereisa“zerotolerance”lawinthestateofMichiganandanybloodalcohol levelof.01orhighercanleadtoaminorinpossession(MIP)ticketandaswellasbeingcitedforoperatingavehiclewhileintoxicated.Thisisinadditiontosuspensionof driving privileges in the state of Michigan.
Medical Amnesty:Tobetterensure thatminorsatmedical riskasa resultofalcohol intoxicationwillreceive prompt and appropriatemedical attention, in 2012, the State ofMichigan adopted amedicalamnestylawtoremoveperceivedbarrierstocallingfororseekinghelp.Michiganlawcontinuestoprohibitaminor frompurchasing,consuming,orpossessing,orattempting topurchase,consume,orpossessalcoholandfromhavinganybodilyalcoholcontent.Thenewlawcreatesanexemptionfromprosecutionforthefollowing:Aminor(undertheageof21)who,afterconsumingalcohol,voluntarilypresentedhimselforherselftoahealthfacilityoragencyfortreatmentorobservation,includingmedicalexaminationandtreatmentforanyconditionasaresultofsexualassault(asdefinedinMichiganlaw).Anyminor(undertheageof21)whoaccompaniedaminor(undertheageof21)who,afterconsumingalcohol,voluntarilypresentedhimselforherselftoahealthfacilityoragencyfortreatmentorobservation,includingmedicalexaminationandtreatmentforanyconditionasaresultofsexualassault(asdefinedinMichiganlaw).Any minor (under the age of 21) who initiated contact with law enforcement or emergency medicalservicespersonnelforthepurposeofobtainingmedicalassistanceinconnectionwithalegitimatehealthcare concern.The university maintain the discretion to refer the individual for appropriate educational intervention(s).

Drugs: Unlawful possession, use, or distribution of alcohol or illicit drugs may lead to a referral tothe appropriate local, state, and/or federal authorities for prosecution for amisdemeanor or a felony,depending on the nature of the offense. The sanctions for such offenses may include fines and/orimprisonment.
Theillegalsale,possessionanduseofalcoholicbeveragesareprohibitedoncampusand inUM-Flintfacilities.DepartmentofPublicSafetyofficersenforceStateunderagedrinkinglawsandlocalordinanceson campus. The possession, use and sale of illegal drugs are prohibited on campus and inUM-Flintfacilities.DepartmentofPublicSafetyofficersenforceStateandFederaldruglawsoncampus.
Employee Reporting Requirement UndertheDrug-FreeWorkplaceActof1988,inadditiontotheotherrequirementsofthispolicy,afacultyor staff member who works in any capacity under a federal grant or contract must notify his or heruniversitysupervisorordepartmenthead,inwriting,ofhisorherconvictionforaviolationofanycriminaldrugstatuteoccurringintheworkplacenolaterthanfivecalendardaysaftersuchconviction.Thisappliesto direct charge employees and to indirect charge employees who perform any support or overheadfunctions related to the grant. The supervisor or department head must then promptly report the violation totheGeneralCounsel’sOffice.
Distribution of Policy Acopyofthispolicystatementwillbedistributedtoallfaculty,staffandstudentsannuallyviae-mailatthebeginningoffallandwintersemester.
Review of University Prevention Program and Policy Biennially the university shall review its “Alcohol andOtherDrugsPreventionProgramandPolicy” todetermineeffectivenessandimplementchanges,ifneeded,andtoensurethattheuniversity’sdisciplinarysanctions are consistently enforced.

Policy: Exceptasotherwiseprovidedbelow,employeesareprohibitedatanytimewhileonanypropertyowned,leased,orotherwisecontrolledbytheuniversity,orelsewhereinthecourseoftheiremploymentwith the university, from possessing or discharging any firearm; possessing or using any explosiveoranyknife,swordormachetehavingablade longer than four (4) inchesor, in thecaseofaknifewithamechanismtolockthebladeinplacewhenopen, longerthanthree(3) inches;orpossessing,dischargingorusinganyotherdangerousweapon.Employeesarealsoprohibitedatany timewhileonanypropertyowned,leasedorotherwisecontrolledbytheuniversity,orelsewhereinthecourseofemployment,frompossessinganychemicaloranyotherdangeroussubstanceorcompoundwiththeintentofcausinginjurytoanother.TheprohibitionsinthisStandardPracticeGuideapplyregardlessofwhethertheemployeehasaconcealedweaponpermitor isotherwiseauthorizedbylawtopossess,discharge or use any such device.
The prohibition in the previous paragraph does not apply:
a)toapeaceofficerwhoisamemberoftheuniversity’sDepartmentofPublicSafety,whoisregularlyemployedbytheuniversity,andwhohasbeenauthorizedbytheDirectoroftheDepartmentofPublicSafetytocarryweaponsasoutlinedbyDepartmentofPublicSafetypolicy; or
b)toanemployeeauthorizedbytheuniversitytopossessorusesuchadeviceduringthetimewhentheemployeeisengagedinworkfortheuniversityrequiringsuchadevice;or
c)during the time when the device is worn as part of a military or fraternal uniform inconnectionwithapublicceremony,paradeortheatricalperformance;or
d)whentheDirectoroftheDepartmentofPublicSafetyhaswaivedtheprohibitionbasedonextraordinarycircumstances.Anysuchwaivermustbe inwriting,signedby theDirector,and must define its scope and duration.
TheDirectoroftheDepartmentofPublicSafetymayimposecertainrestrictionsuponindividualswhoareotherwiseauthorizedtopossessorusesuchdevicespursuanttotheprecedingparagraphwhenthe Director determines such restrictions are appropriate under the circumstances.
II. Regulations:Employeeswhoviolatethispolicymaybesubject todiscipline,uptoandincludingdischarge.

c)whensomeonepossessesorusessuchadeviceaspartofamilitaryorsimilaruniformorcostumeinconnectionwithapublicceremonyorparadeortheatricalperformance;
d)whensomeonepossessesorusessuchadeviceinconnectionwitharegularlyschedulededucational,recreationalortrainingprogramauthorizedbytheUniversity;
e)when someone possesses or uses such a device for recreational hunting on propertywhichhasbeendesignatedforsuchactivitybytheUniversityprovidedsuchpossessionanduseisinstrictcompliancewithapplicablelaw;or
f)whentheDirectoroftheUniversity’sDepartmentofPublicSafetyhaswaivedtheprohibitionbasedonextraordinarycircumstances.Anysuchwaivermustbeinwritingandmustdefineits scope and duration.
2.TheDirectoroftheDepartmentofPublicSafetymayimposerestrictionsuponindividualswhoareotherwiseauthorizedtopossessorusesuchadevicepursuanttoSubsection(2)whentheDirectordetermines that such restrictions are appropriate under the circumstances.
Section5.ViolationPenalty.ApersonwhoviolatesthisArticleXisguiltyofamisdemeanor,anduponconviction,punishablebyimprisonmentfornotlessthanten(10)daysandnomorethansixty(60)days,orbyfineofnotmorethanfiftydollars($50.00)orboth.

SEXUAL HARASSMENT (2)It is the policy of the University of Michigan to maintain an academic and work environment free ofsexualharassmentforstudents,faculty,andstaff.Sexualharassmentiscontrarytothestandardsoftheuniversitycommunity. Itdiminishes individualdignityand impedesequalemploymentandeducationalopportunitiesandequalaccesstofreedomofacademicinquiry.SexualharassmentisabarriertofulfillingtheUniversity’s scholarly, research, educational, and servicemissions. It will not be tolerated at theUniversity of Michigan.
Sexual harassment violates theUniversity’s long-standing policy against discrimination on the basis ofsex.Sexualharassmentisalsoillegal.ItisprohibitedintheemploymentcontextbyTitleVIIofthe1964CivilRightsAct,intheeducationcontextbyTitleIXoftheEducationalAmendmentsof1972,and,inbothemploymentandeducationcontexts,byMichigan’sElliot-LarsenCivilRightsAct,adoptedin1976.
AclaimunderthispolicymaybebroughtbytheUniversityorbyafaculty,staff,orstudentmemberoftheUniversitycommunitybasedontheconductofanyUniversityemployee.ComplaintsbasedonconductbystudentswhoarenotalsoemployeesoftheUniversityareaddressedintheStatementofStudentRightsandResponsibilities,which isadministeredby theOfficeofStudentConflictResolution.Personswholodgesexualharassmentcomplaintsorparticipateintheinvestigationofsuchacomplaintareprotectedfromretaliation(e.g.adverseactionorconsequences)forthoseactions.Retaliationwillnotbetoleratedat the University of Michigan.
Sexual harassment can be a very seriousmatter having far-reaching effects on the lives and careers ofindividuals.Intentionallyfalseaccusationscanhavesimilarimpact.ApersonwhoknowinglyandintentionallyfilesafalsecomplaintunderthispolicyissubjecttoUniversitydiscipline.Bothapersonwhosexuallyharassesanother,andapersonwhoknowinglyandintentionallyfilesafalsecomplaintunderthispolicy,aresubjecttoUniversity discipline.
Anindividualmayengageinconductofasexualnaturethatmaynotbesufficientlysever,persistentorpervasive toconstitutesexualharassmentasdescribedbelow,but isnonetheless inappropriate.Suchconduct also will not be tolerated by the University, is prohibited by the University and is subject todiscipline up to and including termination of employment.
Definition of Sexual HarassmentFor the purposes of determining whether a particular act or course of conduct constitutes sexualharassmentunderthispolicy,thefollowingdefinitionwillbeused:
Unwelcomesexualadvances,requestsforsexualfavors,andotherverbalorphysicalconductofasexualnatureconstituteharassmentwhen:
1.submissiontosuchconductismadeeitherexplicitlyorimplicitlyatermorconditionofanindividual’semployment,education,livingenvironment,orparticipationinaUniversityactivity;
2.submissiontoorrejectionofsuchconductbyan individual isusedasthebasis forora factor indecisionsaffecting that person’s employment, education, livingenvironment, or participation in aUniversity activity; or
3.suchconducthasthepurposeoreffectofunreasonablyinterferingwithanindividual’semploymentoreducationalperformanceorcreatinganintimidating,hostile,offensive,orabusiveenvironmentforthatindividual’semployment,education,livingenvironment,orparticipationinaUniversityactivity.

Response and ProceduresPrevention and Education. TheUniversityiscommittedtopreventingandeliminatingsexualharassmentof students, faculty, and staff. To that end, this policy will be published on the University’s web site.Information regardingsexualharassmentand thispolicywillbe included inorientationmaterials fornewstudents, faculty,andstaffandmadeavailable in theOfficeof InstitutionalEquityandotherappropriatelocationsoneachcampus.Inaddition,appropriateeducationalsessionswillbeconductedbytheUniversityonanongoingbasisto(1)informstudents,faculty,andstaffaboutidentifyingsexualharassmentandtheproblemsitcauses,(2)advisemembersoftheUniversitycommunityabouttherightsandresponsibilitiesunderthispolicy,and(3)trainpersonnelintheadministrationofthispolicy.
Assistance with Sexual Harassment Concerns. The Office of Institutional Equity is responsible forensuringandmonitoringtheUniversity’scompliancewithfederalandstatenondiscriminationlaws.However,adiscrimination-freeenvironmentistheresponsibilityofeverymemberofthecommunity.TheUniversitycantakecorrectiveactiononlywhenitbecomesawareofproblems.Therefore, the University encourages persons who believe that they have experienced or witnessed sexual harassment to come forward promptly with their inquiries, reports, or complaints and to seek assistance within the University.Individualsalsohavetherighttopursuealegalremedyforsexualharassmentinadditiontoorinsteadofproceedingunderthispolicy.
Confidential Counseling. Informationaboutorassistancewithsexualharassment issuesmaybeobtainedfrom a variety of University resources. Prior to or concurrent with lodging a sexual harassment complaint,individualsmay find ithelpful toconsultwithacounselororotherwiseseekassistance.The followingofficesprovideadviceandsupporttoindividualswhobelievetheyareexperiencingsexualharassment.AllinformationsharedwiththeseofficeswillremainconfidentialtotheextentpermittedbylawandUniversitypolicy.DiscussionswithrepresentativesoftheseofficeswillnotbeconsideredareporttotheUniversityregardingtheproblematicbehaviorandwillnot,withoutadditionalactionbythecomplainant,resultininterventionorcorrectiveaction.

Investigation and Investigation Procedures. The University will handle sexual harassment complaintsconsistentlywithproceduralguidelinesdevelopedtoensurepromptandequitableresolutionofsuchcomplaints.ComplainantsandRespondentswillbegivencopiesoftheproceduralguidelines,andtheguidelineswillalsobemadereadilyavailabletotheUniversitycommunity.Thematterwillthenproceedtoinvestigationorotherformsofeffectiveandfairreview.TheinvestigationorreviewmaybeperformedbytheOfficeofInstitutionalEquity,orjointlywithanotheroffice,asdeterminedbyOIE.
The purpose of an investigation,whichwill include interviewing the parties andwitnesses, is to gather andassessevidence.During the courseof an investigation, the investigatingofficewillwork collaborativelywithotherappropriateUniversityoffices.Forexample,ifafacultymemberisinvolvedinacomplaint,theOfficeofInstitutionalEquitywouldgenerallyworkcollaborativelywith theOfficeof theProvost; theappropriateDean,DirectororDepartmentHead;andAcademicHumanResources.Ifastaffmemberisinvolvedinthecomplaint,theOfficeofInstitutionalEquitywouldworkcollaborativelywithStaffHumanResources,thesupervisor,theUnitHumanResourcesRepresentativeandotherappropriatedepartmentandUniversityofficials.Possible outcomes of an investigation are (1) a finding that the allegations are not warranted or could notbe substantiated, (2) a finding that the allegations are substantiated and constitute sexual harassment orinappropriatebehaviorand,ifso,(3)referraltotheappropriateadministrativeauthorityforcorrectiveaction.
Corrective Action. Correctiveactioncouldincludearequirementnottorepeatorcontinuetheharassingorretaliatoryconduct,areprimand,denialofmeritpayincrease,reassignment,suspensionandtermination.Theseverityof thepunishmentwilldependon the frequencyandseverityof theoffenseandanyhistoryofpastdiscriminatoryor retaliatoryconduct.A findingofsexualharassmentmaybecause for theseparationof theoffendingpartyfromtheUniversity,inaccordancewithUniversityprocedures,including,forqualifiedfaculty,theproceduressetforthinRegents’Bylaw5.09.EveryeffortwillbemadetoassureUniversity-wideuniformityofsanctions for similar offenses.
University Action. The University may assume the role of a complainant and pursue a report or complaint of sexualharassment,eitherinformallyorformally.TheUniversitymayrespondtocomplaintsorreportsbypersonsexternaltotheUniversitycommunityaboutallegedsexuallyharassingconductbyUniversityemployees.IftheaccusedisafacultymembertowhomRegents’Bylaw5.09applies,theProvostorexecutiveauthorityoftherelevantunitmayinitiatetheproceduresofBylaw5.09atanystageintheprocess,ifthecircumstancesindicatethatsuchactioniswarranted.
Reporting Requirements. ToassureUniversity-widecompliancewiththispolicyandwithfederalandstatelaw,theOfficeofInstitutionalEquitymustbeadvisedofallreportedincidentsofsexualharassmentandtheirresolution.TheOfficeofInstitutionalEquitywillmonitorrepeatedcomplaintswithinthesameunitoragainstthesameindividual,whereidentified,toassurethatsuchcomplaintsareappropriatelyhandled.
Retaliation. STUDENT SEXUAL MISCONDUCT POLICYIntroduction
The University of Michigan-Flint (“University” or “UM-Flint”) values civility, dignity, diversity, education,equality,freedom,honesty,andsafety,asdescribedintheStatement of Student Rights and Responsibilities,andisfirmlycommittedtomaintainingacampusenvironmentfreefromsexualharassment,sexualassault,andotherformsofsex-baseddiscrimination(collectivelyreferredtointhispolicyassexual misconduct).Sexual misconduct jeopardizes the mental, physical, and emotional welfare of our students, as well asthe safety of our community. Sexual misconduct diminishes students’ individual dignity and impedestheiraccesstoeducational,social,andemploymentopportunities.Itcanpermanentlyimpactstudents’livesandmaycauselastingphysicalandpsychologicalharm.Sexualmisconductviolatesourinstitutionalvaluesand its presence in the community presents a barrier to fulfilling the University’s scholarly, research,educational, and services missions. Sexual misconduct, therefore, will not be tolerated at the Universityof Michigan-Flint and is expressly prohibited. Anyone who is aware of sex-based misconduct bya university student should promptly report by taking the appropriate steps to reduce or eliminatetheharassment,preventitsrecurrence,andaddressitseffects.
This policy provides information regarding the University’s prevention and education efforts related tostudent sexual misconduct, as well as how the university will proceed once it is made aware ofallegations of student sexual misconduct in keeping with our institutional values and to meet our legalobligations under Title IX and other relevant laws. The university community will bemade aware of thispolicy through: publication on the university’s Division of Student Affairs website, institutional equitywebsite,andDPSwebsite;annuale-mailnotifications to faculty, staffandstudents;distributionatannualresidence hall meeting, educational programs and workshops; and the Annual Campus Security Report.
Nothing in this policy will be interpreted to violate individual constitutional rights of expression, toinfringe upon academic freedom, or to compromise the university’s education mission. Offensivespeech alone in not legally sufficient to establish a violation of this policy. The expressive conductmust constitute sexual misconduct as defined within this policy for a violation to occur. Sexualmisconduct, however, is not a legally protected expression or a proper exercise of academic freedom.
DEFINITIONS
A. ViolationsSexual Misconduct-umbrellatermusedtoencompassunwantedorunwelcomeconductofasexualnaturethat is committedwithout valid consent, including sexual assault, sexual harassment (including stalking),andotherformsofsex-baseddiscrimination.Menorwomencanengageinsexualmisconduct,andsexualmisconduct can occur between people of the same or different sexes. Sexual misconduct can includeboth intentional conductandconduct that results innegativeeffects.Sexualmisconduct canalso includeretaliationinconnectionwiththeComplainant’sallegationsunderthispolicy.

Sexual Assault - unwanted or unwelcome touching of a sexual nature, including hugging, kissing,fondling, oral sex, anal or vaginal intercourse, or other physical sexual activity that occurs withoutvalid consent.
Sexual Harassment - unwelcome sexual advances, requests for sexual favors, and other verbal orphysicalconductofasexualnatureif:1)submissiontosuchconductismadeeitherexplicitlyorimplicitlyasatermorconditionofanindividual’seducation,livingenvironment,employment,orparticipationinauniversity-relatedactivity;2)submissiontoorrejectionofsuchconductbyanindividual isusedasthebasis forora factor indecisionsaffecting that individual’seducation, livingenvironment,employment,or participation in a university-related activity; or 3) such conduct has the purpose or effect ofunreasonablyinterferingwithanindividual’seducationalperformanceorcreatingaintimidating,hostile,offensive, or abusive environment for that individual’s education, living environment, employment, orparticipation in a university-related activity. Sexual harassmentmay occur via various communicationdevices,viasocialmediaorviatheinternet.Conductreportedassexualharassmentwillbeevaluatedby considering the totality of the particular circumstances, including the nature, frequency, intensity,location, context, and duration of the alleged behavior. Although repeated incidents generally createa stronger claim of sexual harassment, a serious incident, even if isolated, may violate this policy.Examples of sexual harassment include, but are not limited to: unwanted sexual statements;unwanted personal attention (e.g., cyber-stalking); unwanted physical or sexual advances that wouldconstitutesexualassault(asdefinedinthispolicy);electronicrecording,photographing,ortransmittingintimate or sexual utterances, sounds, or images without the knowledge and consent of all partiesinvolved; touching oneself sexually for others to view; and voyeurism (e.g., spying on otherswhoareinintimateorsexualsituations).
Stalking -anyunwantedcontactbetweenaRespondentandtheirtargetofasexualorromanticnaturethat directly or indirectly communicates a threat or places the target in fear. This includes but is not limitedto:followingaperson;repeatedandunwantedtelephonecalls;makingrepeatedandunwantedcontact by e-mail or on social media sites (e.g., Twitter, Facebook); or leaving gifts for their target.
Intimate Partner Violence -unwantedorunwelcomed touchingofasexualnatureoruseofphysicalviolence,coercion,threats,intimidation,isolation,stalking,orotherformsofemotional,sexualoreconomicabuse directed towards a partner in an intimate relationship, such as domestic violence and datingviolence.This includesanybehaviors that intimidate,manipulate,humiliate, isolate, frighten, terrorize,coerce,threaten,blame,hurt,injure,orwoundsomeone.Intimatepartnerviolencecanbeasingleactorapatternofbehaviorinrelationships.Intimatepartnerrelationshipscanincludebothshortorlong-termrelationships(currentor former)betweenpersons intendedtoprovidesomeemotional/romanticand/orphysical intimacy.

B. GeneralComplainant - An individual who reportedly experiences sexual misconduct, regardless of whetherthat individualparticipates in thedisclosureor reviewof that reportby theuniversityatanypoint.TheuniversitymayassumetheroleofaComplainant.
Consent-Clear,freelygiven,andunambiguousagreementtoengageinaparticularactivity.Consentcannotbeprocuredbytheuseofphysicalforce,compellingthreats,intimidatingbehaviororcoercion.Apersonwhoisincapacitatedorwhoisunabletogiveconsentduetoageoranintellectualand/orotherdisability cannot validly give consent.Eitherpartyatanypointcanwithdrawconsent.Moreover,consenttoengageinonesexualactivity,orpastagreement toengage inaparticularsexualactivity,cannotbepresumed toconstituteconsent toengageinadifferentsexualactivityortoengageagaininsexualactivity.Forthepurposesofthispolicy,theissueiswhethertheaccusedstudentkneworshouldhaveknownthattheactivityinquestionwasnotconsensual,basedonareasonablepersonstandard.
Coercion - Unreasonable pressure for sexual activity. Continued pressure beyond the point whensomeonehasmadeitclearthattheydonotwanttoengageinsexualbehavior.
Force-Useofphysicalviolenceand/orimposingonsomeonephysicallytogainsexualaccess.Forcecanalsoincludethreats,intimidation(impliedthreats),andcoercionthatareusedtoovercomeresistance.
Incapacitated-Lackingthephysicaland/ormentalabilitytomakeinformedandrationaljudgments.Thislackofabilitycanhaveavarietyofcauses,includingbutnotlimitedto,sleep,alcohol,drugs,blackouts,orflashbacks.
Investigator/Institutional Equity and Diversity Consultant-AUniversityofMichigan-FlintemployeewhoreviewsandinvestigatesreportsofsexualmisconductunderthisPolicyinsupportoftheworkoftheDivisionofStudentAffairs.OntheUniversityofMichigan-FlintCampus,theInvestigatoristheInstitutionalEquityandDiversityConsultant(213UniversityPavilion,303E.KearsleyStreet,Flint,MI48502-1950.Phone 810-237-6517) or designee. SCOPE OF POLICYForpurposesofthispolicy,sexualmisconductencompassesarangeofbehaviorsthatcreateahostileeducationalenvironment,includingsexualassaultandsexualharassment.IndividualswhoareconcernedaboutinappropriatestudentbehaviorregardlessofwhethertheactionsmayviolatethispolicyshouldstillreporttheseincidentstotheAssistantViceChancellorforStudentAffairs,359UniversityCenter,303E.KearsleyStreet,Flint,MI48502-1950.Phone(810)237-6649.Thispolicyapplies tosexualmisconduct that iscommittedbyauniversitystudentoraparticipant inauniversityprogramwheneverthatsexualmisconductoccurs:
• IntheCityofFlint;•Onuniversity-controlledproperty;•InconnectionwithaUniversityorUniversity-recognizedprogramoractivity;or•WhentheconductoccursoutsideofthecityofFlintoroutsideofUniversity-controlled property and poses an obvious and serious threat of harm to any member(s) of the university community.
This policy does not cover:• Sexualmisconductreportedlycommittedbyfacultyorstaff.Suchmisconductwillcontinueto beaddressedinaccordancewithSPG201.89-0.•Sexualmisconductcommittedbyathirdpartythatisnotaffiliatedwiththeuniversity.
Individualsubjectedtosexualmisconductbythirdpartiesnotaffiliatedwiththeuniversitymaystillutilizeuniversityresourcesandtheuniversitywillattempttotakepromptactiontoeliminatetheharassmentandpreventitsrecurrence;however,theuniversity’sresponseagainsttheaccusedmaybelimited.Attheuniversity’sdiscretion,thispolicyandrelatedprocessesmayalsoapplytoreportedviolationsofotheruniversitypoliciesif,intheuniversity’sjudgment,thoseotherallegationsaredirectlyrelatedtothereportedsexualmisconduct.
REPORTINGTheuniversityiscommittedtoprovidingacampusenvironmentfreefromsexualmisconduct.Therefore,if theuniversity finds that ithasenough informationorbecomesawareofpossible incidentsofsexualmisconduct, it may proceed with the investigation even if no formal complaint has been filed or theindividualsinvolvedareunwillingtocooperate.

Theuniversityencourages the reportingofsexualmisconduct touniversityofficials.Reportsofsexualmisconduct to university officials may be made by:
• Apersonwhobelievestheyexperiencedsexualmisconduct;or•Apersonwhohasinformationthatsexualmisconductmayhavebeencommittedbya university student or a participant in a university program.
Third-Party Reporting.Thirdpartieswhoarenotaffiliatedwiththeuniversityandwhobelievetheyhaveexperiencessexualmisconductbyastudentorwhohaveinformationthatsexualmisconductmayhavebeencommittedbyauniversitystudentoraparticipantinauniversityprogram,maybringtheircomplaintagainstthestudenttotheuniversitybycontactingtheAssistantViceChancellorforStudentAffairs,359UniversityCenter,(810)237-6649.
Mandatory Reporting for Certain University Officials. Any faculty or staff whose roles includeresponsibility for the safety and security of any part of the university community, and those whoseknowledgeofapossibleviolationcouldbeimputedtotheuniversity,musttimelyforwardallinformationto theAssistantViceChancellor forStudentAffairs, in addition to other reporting obligations such asdirectreportingtolawenforcement.ExamplesofindividualswhomayreceivereportsofstudentsexualmisconductandwhoarerequiredtoforwardthemtotheAssistantViceChancellorforStudentaffairsincompliancewiththisPolicyincludeCampusSecurityAuthorities(e.g.,regents,executiveofficers,deans(includingassociateandassistantdeans),departmentchairs,supervisors,academicadvisors,directorsandcoordinatorsofanyundergraduateandgraduateprograms,coaches,residentadvisors,sponsorsofsponsoredstudentorganizations,andDepartmentofPublicSafetystaff).AllreportsshouldbemadetotheAssistantViceChancellorforStudentAffairs,359UniversityCenter,(810) 237-6649.Reportsmayalso bemade to the InstitutionalEquityOffice, 213UniversityPavilion,(810)237-6517.
Anonymous Reports.Anonymousreportsofviolationsofthispolicymaybemadetowww.umflint.edu/wec/forms/sexual-misconduct-incidents-form.htm. The university may not be able to address fully reports received from anonymous sources unless sufficient information is furnished to enable the university to conductameaningfulandfairinvestigation.Theuniversitywill,however,takewhateverstepsitdeemsappropriate inthebest interestof theoveralluniversitycommunity,consistentwiththeinformationthatis available.
Confidentiality Concerns.IfconfidentialityisrequestedbytheComplainantortheRespondent,oriftheComplainantrequeststhattheComplaintnotbepursued,theuniversitywilltakeallreasonablestepstocomplywith thisrequest. InsituationswhereaComplainantrequestsprivacy, theuniversity’sability toinvestigateandrespondtotheallegationsmaybelimited.IftheComplainantrequeststhattheuniversitynot investigateand/or theoffender isunknown, theUniversityTitle IXCoordinatorwilldetermine ifaninvestigationiswarranted,inconsultationwiththeAssistantViceChancellorforStudentAffairsandtheInstitutionalEquityandDiversityConsultant.Theuniversitywillevaluatetherequestfornoinvestigationinthecontextofitsresponsibilitytoprovideasafeandnon-discriminatoryenvironmentforallstudents.Theuniversitywillconsiderthefollowingfactorswhendeterminingwhetheritcanmaintainconfidentiality;theseriousnessoftheallegedharassment;theageofthestudentharassed;whethertherehavebeenothercomplaintsorreportsagainsttheRespondent;andtherightsoftheRespondenttoreceiveinformationabouttheaccuserandtheallegationsifaformalproceedingwithsanctionsmayresult.

TheuniversitywillensurethattheComplainantorRespondent’sidentitywillonlyberevealedonaneed-to-knowbasis.Whena reportofsexualmisconduct is filed, theComplainant, theRespondent,andallidentifiedwitnesseswhoarenamedintheinvestigation,willbenotifiedoftheuniversity’sexpectationofconfidentiality.
Timing. To promote timely and effective review, the university strongly encourages Reporters andComplainantstomakereportsofpossiblesexualmisconductassoonaspossiblebutwithin180calendardays. If reports are made after 180 days of the incident, the Assistant Vice Chancellor for StudentAffairsand the InstitutionalEquityandDiversityConsultant, inconsultationwith theUniversityTitle IXCoordinator,willdeterminetheappropriateuniversityresponse,whichmayincludeaninvestigation.Thelapseof timemaymake itmoredifficult togatherrelevantandreliable informationandpreventsimilarmisconduct.
Intentionally Filing a False Report. The university understands that sexualmisconduct is often notwitnessedbyothersand that reportsof sexualmisconductarenotalwayssubstantiatedbyevidence.Therefore, individuals should not be discouraged from reporting sexual misconduct under this policysimply because there is a lack of evidence. However, anymember of the university community whoknowinglyfilesafalsecomplaintorprovidesfalseinformationunderthispolicyorintentionallymisleadsuniversityofficialswhoareinvestigatingorreviewingacomplaintofallegedsexualmisconductissubjectto disciplinary action.
Reports to Local Law Enforcement.Theuniversityencouragesthosewhobelievetheyexperiencedasexualassaultoranyothercrimetofileareportwithlocallawenforcement.Universitystaffisavailable,upon request, to assist the individual in making the report. Collection and preservation of evidencerelatingtoareportedsexualassaultisessentialforlawenforcementinvestigationsinparticular,sopromptreportingtolawenforcementisespeciallycritical.
Respect for Medical Amnesty Law.Theuniversity’sprimaryconcern is forstudenthealth,wellness,andsafety.Sometimesstudentsarereluctanttoseekhelpafterexperiencingsexualmisconduct,ormaybereluctanttohelpotherswhomayhaveexperiencedsexualmisconduct,becausetheyfearbeingheldresponsiblebytheuniversityorlawenforcementforunderagealcoholconsumptionorprovidingalcoholto an underage individual. Students should not be reluctant to report instances of sexualmisconductbecause they fear being charged with other policy violations or criminal prosecution. The State ofMichiganhasadoptedamedicalamnestylawtoencourageunderageindividualstocallorseekpromptandappropriatemedicalattention.This lawprovidesamnesty fromprosecution foralcoholpossessionorconsumptionforunderageindividualswhoreportexperiencingsexualmisconductorwhoassistthosewhoreportexperiencingsexualmisconduct.

Michigan law continues to prohibit underage individuals from purchasing, consuming, or possessing,or attempting to purchase, consume, or possess alcohol and fromhaving any bodily alcohol content.Michigan law, however, includes an exemption from prosecution of an underage individual for thefollowing:
• Voluntarilyaccessingahealthfacilityoragencyfortreatmentorobservationafterconsuming alcohol;•Accompanyinganunderageindividualwhovoluntarilyaccessesahealthfacilityoragencyfor treatment or observation after consuming alcohol; and•Initiatingcontactwithlawenforcementoremergencymedicalservicespersonnelforthe purposeofobtainingmedicalassistanceinconnectionwiththeirownpersonalconsumptionof alcohol or consumption by others.
Confidential Reporting.Thosewhowishtoaccessconfidentialassistanceorresources,ortoexplorereporting options without initiating further action from the university, should contact Counseling,Accessibility,andPsychologicalServices(CAPS),264UniversityCenter,(810)762-3456.
UNIVERSITY RESPONSE PROCEDURE
A. Interim MeasuresOncea reportofsexualmisconducthasbeenmade to theuniversity, informationwillbe forwarded totheDepartmentofPublicSafety(DPS)toensureappropriatedistributionofuniversity-widewarningsandmaintenanceofaccurate statistics, the InstitutionalEquityandDiversityConsultant, and theAssistantViceChancellor forStudentAffairs.Theuniversitywillalsooffer theappropriatesupportservicesandnotificationof institutionalpoliciestotheComplainantandtheRespondent.Theuniversitywill taketheappropriatestepstopreventand/oraddressretaliatoryconductfollowingareport.
TheDivisionofStudentAffairsmayalsoimplementinterimmeasures,asneededtoprotectthestudentsinvolvedandthelargeruniversitycommunity.Interiminterventionsmayincludeseparationoftheparties’academic and living situationsor other interventions theAssistantViceChancellor forStudentAffairsandtheInstitutionalEquityandDiversityConsultantdeemappropriate,inconsultationwiththeUniversityTitleIXCoordinator.Thesemeasuresmaybekeptinplaceuntiltheendofanyrevieworappealprocess.Failure to abide by the interim interventions is a violation of this policy and may lead to additional disciplinary actions.
B. Grievance Process1. Investigation.Theinvestigatorwilldeterminethemosteffectivemethodofreviewingtheconcerns raisedbythereportedsexualmisconduct.Inallcases,theuniversitywillrespondtothereportina prompt, thorough, procedurally fair, andeffectivemanner.Upon receipt of a report, the university willstrivetocompleteitsinvestigationwithinsixty(60)calendardays.
In most cases, the Investigator will conduct a fact-finding investigation, which includes meeting separately with the Complainant, Respondent, and pertinent witnesses, and reviewing and analyzing other relevant information. Occasionally, a different or less formal response tothereportmaybewarranted.

2. Support Person(s).At any time during the course of an investigation, the Complainant and the Respondent may both provide a written statement, and other supporting material, regarding the matter under review.During the investigative process, theComplainant and theRespondentmay alsohaveasupportperson(s)presentatanymeetingwiththeInvestigator.Thesupportperson(s) may not participate directly in the investigative process, but may be present to provide support totheComplainantorRespondent.
3. Concurrent Law Enforcement Investigations.In theevent thataComplainant filesa reportwith locallawenforcement,theuniversitywillnotdelayitsowninvestigationnorwillitdelaytakingstepsto protecttheComplainantorcampuscommunitythroughinterimmeasures.However,ifnecessary,the university may schedule the fact-finding portion of its investigation in a manner that does not hinder law enforcement’s evidence gathering. If the Respondent requests a reasonable delay of the resolution process until external proceedings are resolved, the university will evaluate the circumstances of the case (including the length and impact of the delay on the Complainant and community, and the integrity of the resolution process) before determining whether it will grant the request. Standards for criminal investigations are different from the standards for violationunder this policy, and therefore theuniversity is not required to rely on lawenforcement reportsand/oractionstomakedecisionsunderthispolicy.Theuniversityis,however,committedto appropriate coordination with its Department of Public Safety and with local law enforcement.
4. Standard of Proof.TheInvestigator’sfindingswillbemadeusingthepreponderance of the evidence standard. This standard requires that the information supporting each finding bemore convincing thantheinformationofferedinoppositiontoit.Underthisstandard,individualsarepresumednotto have engage in the conduct reported unless a preponderance of the evidence supports a finding that sexualmisconductoccurred.
5. Investigation Findings and Outcome Notification.In most cases, when an investigation is conducted,theInvestigatorwillprepareawrittenreportattheconclusionoftheinvestigation.Before thereportisfinalized,theparticipatingComplainantandRespondentwillbegivenanopportunityto reviewtheirownstatement. The Investigator’s written report will contain, at a minimum: 1) summary of the complaint; 2) investigator’s findings,and3)summaryof the investigator’s rationale insupportof the findings. TheInvestigator’sreportandfindingsmustbereviewedandapprovedbytheUniversityTitleIXCoordinator. Theuniversity’swrittenfindingswillthenbemadeavailabletotheStudentConductOfficerandthen simultaneously to theparticipatingComplainantandRespondent, in themannerand to theextent appropriate to honor due process and privacy considerations. The university neither encourages nor discourages the subsequent disclosure or sharing of the written notification by either party. IncaseswhereaComplainantand/orRespondenthaschosennot toparticipate intheuniversity’s reviewofthesexualmisconductallegationbutdesirestobenotifiedoftheoutcome,theuniversity maynotify theComplainant. IfaComplainanthasexpressedadesire, inwriting,not tobenotified of the outcome, the university will honor that decision and will not send the notification.

C. Sanctions.If theRespondent is found to have committed the alleged sexualmisconduct, the universitywill takefurther action to prevent the recurrence of that misconduct and remedy its effects.
The Assistant Vice Chancellor for Student Affairs or Student Conduct Officer will meet with theRespondent todiscusssanctions.TheAssistantViceChancellor forStudentAffairswilldetermine theappropriatesanctionsandinformtheRespondentinwritingwithinfifteen(15)universitybusinessdays.Thesanctionsappliedtostudentsfoundresponsibleforsexualmisconductaredesignedtoeliminatethemisconduct,prevent its recurrence,and remedy itseffects,whilehonoring theuniversity’seducationalmission. Sanctions may also serve to promote safety or to deter students from future threatening or harmful behavior. Some behavior is so harmful to the university community or so deleterious to the educationalprocessthatitmayrequiremoreserioussanctions,suchasremovalfromuniversityhousing,specificcoursesoractivities,suspensionfromtheuniversityorexpulsion.Dual Roles.WhentheRespondentholdsarolewithintheuniversityinadditiontothatofastudent(e.g.student-employee),thesanctionsmayapplytoallrolesheldbythestudentprovidedthereisasufficientnexusbetweentheallegedconductandthepositionheldbythestudent.Ifthestudent’sallegedsexualmisconductoccurredintheiremploymentcapacity,thereviewandsanctioningprocesswillbecompletedaccordingtoSPG201.98-0.Ifthestudent-employeeisfoundtohaveengagedinsexualmisconductafterthatreview,thestudent-employeemaybesubjecttosanctionbothinconnectionwiththeiremploymentand their student status, as appropriate, under applicable processes and in accordance with anyprocedures set forth in any applicable collective bargaining agreement.
D. Appeal Process.Either party may appeal the sanctions imposed. Given the personal and sensitive nature of thesecircumstances, and out of the respect for the rights of all participants, a review of thematter will beefficientandnarrowlytailored.
1. Grounds for Review.A party may only seek review of the sanctions on the following grounds: a) Amaterialdeviationfromtheproceduresaffectstheoutcomeofthecase; b) Thereisnewandrelevantinformation,withreasonablediligenceandeffort,thatwas unavailable at the time of the investigation and resolution that could reasonably affect the outcome;and/or c) The sanctions are not appropriate or proportionate to the determined violation(s).
Torequestareview,thepartymustsubmitawritten appealtotheAssistantViceChancellorforStudentAffairswithin ten (10)universitybusinessdaysof thenotificationofdecision regardinganysanctions.TheAssistantViceChancellor forStudentAffairsmaymodify the ten (10)-day limitation periodwhenreasonable.
Bothpartieswillbenotifiedifeitherpartysubmitsanappealandwillbeinformedofthegroundsoftheappeal.Apartymaysubmitashortwrittenresponsetotherequestforappealwithinfive(5)universitybusiness days of the notification.

2. Procedure.Iftheappealsatisfiestherequirementslistedabove,thematterwillbereviewedbythe Faculty Student Concerns Committee as described within the Statement of Student Rights and Responsibilities. In a closed session, the Faculty Student Concerns Committee will review the matter based on the relevant considerations identified in the request for appeal. The Faculty Student Concerns Committee may conclude that there are no relevant issues of concern and, therefore,recommendthattheStudentConductOfficeraffirmthesanctions. IftheFacultyStudentConcernsCommitteeidentifiesissuesofconcern,thecommitteewillprovide the Student Conduct Officer with one of the following recommended actions and any additional instructions or recommendations it deems appropriate under the circumstances:
• Iftherewasamaterialdeviationfromprocedure,remandthemattertotheUniversityTitleIX Coordinatorand/orInvestigatorwithcorrectiveinstructionsfromtheFacultyStudentConcerns Committee;• Ifnewly-discoveredinformationappearsrelevant,referthemattertotheUniversityTitleIX CoordinatorandtheoriginalInvestigatortodeterminewhetheranymodificationmayneedto be made to the original investigative report; or• Ifthesanctionsappearinappropriateordisproportionate,alterthesanctionsaccordingly.
The Faculty Student Concerns Committee will prepare a written report in response to any appealwithinten(10)universitybusinessdaysofreceivingtheappeal.
TheViceChancellorforStudentAffairsmayacceptormodifytherecommendationsmadebytheFacultyStudentConcernscommittee.TheViceChancellorforStudentAffairs’finaldecisionwillbemadeavailabletotheparticipatingpartiessimultaneously,totheextentappropriatetohonordueprocessandprivacyconcernswithin five (5)universitybusinessdaysof receiving theFacultyStudentConcernsCommittees’ report.
PROTECTION AGAINST RETALIATIONThe universitywill take appropriate steps to ensure that a personwho in good faith participates in asexualmisconduct investigationor resolution, or assists others indoing so, or is accusedof violatingthispolicywillnotbesubjectedtoretaliation.Thisprotectionexistsevenifacomplaint isdismissedortheRespondent is not found tohaveviolated thispolicy.Theuniversitywill takeappropriate steps toensure that all participants in an investigation are treated fairly. Anyonewho believes that he or sheisexperiencing retaliation isstronglyencouraged to report thisconcernusing thesameprocedure forreportingpossiblesexualmisconductunderthispolicy.
RELATED INFORMATIONEducation and Training.Theuniversitywillensurethatallemployeeswhoareinvolvedinprocessing,investigating,orresolvingcomplaintsofsexualmisconductreceiveappropriatetraining.TheInstitutionalEquity and Diversity Consultant and the Division of Student Affairs will coordinate educationalprogrammingfortheuniversitycommunitytominimizesexualmisconductbystudentsandtoinformtheuniversity community regarding the university’s policies and procedures for responding to such behavior.

Resources and Roles. Members of the university community are encouraged to contribute to the prevention, intervention, and effective response to student sexual misconduct. All membersof the community may play a role in building a safe and just educational environment by:
• Modelinghealthyandrespectfulbehaviorinpersonalandprofessionalrelationships;• Increasingpersonalawarenessofwhatconstitutessexualmisconduct;• Speakingoutagainstanti-socialbehaviorthatservestoencouragesexualmisconductorto discourage reporting;• Developingthenecessaryskillstobeaneffectiveandsupportiveallytosurvivorsofsexual misconduct;• Interveninginsituationsthatcanleadtosexualmisconductandrelatedbehavior;and• Interruptinganincidentofsexualmisconductwhenitissafetodoso.

Crime Prevention and AwarenessTheDepartmentofPublicSafetydiscussescrimeprevention,personalsafety,andtheftpreventionduringnew student and transfer orientation sessions. DPS offers Rape Aggression Defense System (RAD)training and alcohol/drug awareness training several times a year. RAD training is a comprehensivecoursethatbeginswithawareness,prevention,riskreductionandavoidance,whileprogressingontothebasicsofhands-ondefensetraining.CertifiedRADinstructorswillteachthecoursesprovided.Alcohol/drug awareness training includes identifying the effects of alcohol/drugs, legal issues and resourcesavailable.Drunkdrivingsimulationsprovidehandsonapproachtothistrainingsession.

TheDepartment of Public Safety participates in forums and programs in the residence hall to explainUniversity security, public safety, and fire safety measures and procedures at UM-Flint. Members oftheDepartmentofPublicSafetyconductcrimepreventionandgeneralsecurityandsafetyawarenesspresentationswhenrequestedbyvariouscommunitygroups, includingstudentsandemployeesof theUniversity.During thesepresentations, the following information is typicallyprovided:crimepreventiontips; statistics on crime at UM-Flint; active shooter training; fire safety information; information regarding campussecurityproceduresandpractices,includingencouragingparticipantstoberesponsiblefortheirownsecurity/safetyandforthesecurity/safetyforothersoncampus.Duringthe2013calendaryear,DPSconducted60eventsandpresentations.Programsincludedinformationregardingalcoholeducation,firesafety,personalsafety,andcrimepreventionfortheUM-Flintcommunity.EnvironmentalHealth&Safety,GeneseeEarlyCollegeProgram,EarlyChildDevelopmentCenter,Women’sEducationalCenter andResidentialLifeparticipatedinand/orconducted30+educationalprogramsforstudentsandemployees.The programs conducted by these offices included general crime prevention and security awarenessprograms, such as safety education forums, programs and discussions about topics such as alcoholabuse, domestic violence, self-defense, fire safety, emergency response and evacuation procedures,sexualassaultprevention,andtheftprevention.

1) Identifiesdomesticviolence,datingviolence,sexualassaultandstalkingasprohibited conduct; 2) DefinesusingdefinitionsprovidedbothbytheDepartmentofEducationaswellasstatelaw whatbehaviorconstitutesdomesticviolence,datingviolence,sexualassault,andstalking; 3) DefineswhatbehaviorandactionsconstituteconsenttosexualactivityintheStateof Michiganand/orusingthedefinitionsofconsentfoundintheStudent Code of Conduct if statelawdoesnotdefineconsent; 4) Providesadescriptionofsafeandpositiveoptionsforbystanderintervention.Bystander intervention means safe and positive options that may be carried out by an individual or individualstopreventharmorintervenewhenthereisriskofdatingviolence,domestic violence,sexualassaultorstalking.Bystanderinterventionincludesrecognizingsituations ofpotentialharm,understandinginstitutionalstructuresandculturalconditionsthatfacilitate violence,overcomingbarrierstointervening,indenturingsafeandeffectiveintervention options,andtakingactiontointervene;

Personal Injury Reports.Ifyouorsomeoneyouknowisillorinjuredonuniversityproperty,contacttheDepartment of Public Safety via any blue light emergency telephone or university telephone. APublicSafetyemployeewillbedispatchedtoperformbasicfirstaidandwillcallforfurtherassistance,ifneeded.

Students are issued only parking permit validation persemester. The parking permits are transferable from car to car. There is no additional fee to receiveastudentparkingpermit.

Fire Alarms and Extinguishers. In the event of a fire, an alarm will sound throughout the affectedbuilding. If you hear an alarm, vacate the building immediately. Never use an elevator during a firealarm.Ifyoudiscoverafire,nomatterhowsmall,activatethenearestfirepullbox,andthencontacttheDepartment of Public Safety. Do not try to fight a fire yourself unless you are properly trained to use a fire extinguisherandthefireissmallandcontained.Afterevacuatingthebuilding,stayclearofthebuilding.Allowroomforfire-fightingequipmenttomaneuveraroundthebuildingasnecessary.
Fire extinguishers aremaintained by theDepartment of Public Safety. If you discharge or observe adischargedfireextinguisher,contactthedepartment.Thefireextinguisherwillbereplacedwithaproperlyfilledextinguisher.

The University of Michigan-Flint Department of Public Safety must be contacted for any fire that is reportedoncampus.Aftertheinitialresponseismadeandtheareaissafe,DPSwillmakerecordoftheincident.IfamemberoftheUniversityofMichigan-Flintcommunityfindsevidenceofafirethathasbeenextinguished,andthepersonisnotsurewhethertheDepartmentofPublicSafetyhasalreadyresponded,the community member should immediately notify DPS to investigate and document the incident.
Thesereportsaswellasanyitemidentifiedbyafiredrillorvisualobservationwillbeusedtoimprovefiresafetyoncampus.These improvementsmay includeadditional training,equipmentorconstructionneededtoimprovefiresafety.Barringanyunforeseencircumstances,therearenofutureimprovementsnecessary at this time.

TheUniversityonlyhasoneResidenceHall-FirstStreetResidenceHallandeachsuiteandallpublicareasinthebuildingareequippedwithsmokedetectorsandawatersprinklersystem.Tamperingwithfiresafetyequipmentplacesthelivesofeveryoneindanger.Tamperingwithormisuseofthefirealarmsystem, fire extinguishers, or any other fire safety equipment is prohibited and subject to immediatesuspensionfromHousingandResidentialLife,referraltotheUniversityConductOfficer,aswellaslegalaction and fines.
Fireandevacuationdrillsareperformedoncepermonthinthehousingunitoncampus.Allresidentsarerequiredtoevacuatethebuildingortakeshelterduringthedrill.DepartmentofPublicSafetypersonnelwill monitor and assist in the coordination of the drill activities. Drills provide UM-Flint an excellentopportunitytopracticeouremergencypreparednessandevaluatetheeffectivenessoftheplan.Exercisesanddrillscouldincludeavarietyofscenariosinvolvingfire,hazardousmaterials,medicalemergencies,bombthreats,andtornadowarnings.
MembersoftheUniversityofMichigan-Flintcommunityreceivefiresafetyeducationduringnewstudentand employee orientations.

In the event of a Tornado WARNING, the Department of Public Safety will notifyall residence hall occupants to immediately seek protective shelter in the Murchie Science Building.WatchesareissuedbytheNationalSevereStormForecastCentertoindicatewhenandwhereseverethunderstormsand/ortornadoesaremostlikelytooccur.Aseverthunderstormwatchimpliesthatstormsmaydeveloptosufficientstrengthstoproducelargehailand/ordamagingwinds.Atornadowatchmeansthat conditions are favorable for the occurrence of both tornadoes and severe thunderstorms.WarningsareissuedbytheNationalWeatherServiceofficeswhenSevereThunderstormsorTornadoesare indicated by radar or reported by trained spotters or other reliable sources.SevereThunderstormisdefinedbytheNationalWeatherServiceofficesasaseverethunderstormhavingwindsof58m.p.h.ormore,orhail3/4ofaninchindiameterorlarger. IF A TORNADO WARNING IS ISSUED:
•Quicklygatherinsmallgroupsof3-4peopleandusethe“buddysystem”whilepromptlymoving to the Murchie Science Building for shelter.•TakedirectionfromyourRAorprofessionalstaffmembers.•Seekshelterundersturdyorheavyfurniture,tablesordeskonthefirstfloor.•Avoidelevators,topfloorsofbuildings,areaswithglasswindowsordoors,largeopenspaces, andunsecuredobjects.•Assistindividualswithknownmobility,hearing,visualdisability,orotherconcernstothenearest shelterarea.Ifyoucannotgetthemintothesheltersafely,notifytheDepartmentofPublicSafety.•Iftimepermits,takeaflashlight,radioorcellulartelephonewithyou.•IdentifyandreportanymissingpersonstotheDepartmentofPublicSafety.•TheDepartmentofPublicSafetywilladviseyouwhenitissafetoreturntoyourfloorand/orsuites.
