Proceedings of the Central Executive Committee Meeting of AOE & AEA held on 07.07.2018 in Pollachi
The State Level Central Executive Committee Meeting of Association of Engineers and Assistant Engineers’ Association was held in K.K.G. Thirumana Mandapam, Pollachi by 10.30A.M. on 07.07.2018. Er.P.Krishnamoorthy, President, AOE presided over the meeting and conducted the proceedings. Er.M.Dhanasekaran, General Secretary, AEA on behalf of parent body and Er.P.Muthuchamy, President, AOE Pollachi Branch on behalf of host branch welcomed the gathering.
Er.P.Muthuchamy, President AOE, Pollachi Branch, Er.K.Appusamy, Secretary AOE, Pollachi Branch, Er.D.Jayakumar, President AEA, Pollachi Branch, Er.D.Rajan, Secretary AEA, Pollachi Branch and Er.R.Jeyakumar, President, AEA, Parent body were also present in the meeting.
In the presidential address Er.P.Krishnamoorthy, President, AOE briefly stated the effect of G.O.Ms.No.173 dt.04.07.2018 in which the 7 number of I.A.S., officers have been appointed to monitor “KUDIMARAMATHU” work. Regarding pay issue, the stand of Government over Judgment of High Court by which the aggrieved G.O.Ms.No.328 quashed was also explained.
The way in which the Chief Engineer and Special Chief Engineer promotion panel achieved was also explained in his address.
Er.K.Anbu, General Secretary, AOE briefed the activities of our Association on the subjects in the Agenda as follows.
VIIth Pay Commission Hon’ble High Court Judgment order – further course of action
Recruitment of AEs (Civil and Electrical) Promotion in respect of 2007 batch Assistant Engineers and Court
cases Financial position of Association. Construction of Poriyaalar Ramalingam Illam at Chennai and
meeting out of funds for construction. Any other Subjects raised by the members.
7th Pay Commission – Course of Action The General Secretary, AOE informed that our Association has obtained
favorable Judgment in the case filed against G.O.Ms.No.328. He also informed that we are in the move to meet the Hon’ble Chief Minister to explain the current status after quashing the G.O.Ms.No.328 and request him to issue a fresh Government Order through which the 7th pay shall be implemented to us. He also explained the importance of the Pay case which is coming for final hearing in the Supreme Court which is expected to come in the 1st week of August 2018. Recruitment of Assistant Engineers every year :-
The General Secretary, AOE informed that notification for recruitment to the post of 120 numbers of Assistant Engineers (Civil) would be issued from TNPSC shortly.

Promotion Panels :- (i) Assistant Executive Engineer Panel (Civil)
The General Secretary, AOE informed that our Association is continuously pursuing the 2007 batch Assistant Engineer promotion panel with the Engineer-in-Chief (WRO), Chief Engineer (General) PWD for sending the proposal of name panel of Assistant Executive Engineer (Civil) immediately after adopting present Service Rule, and Court orders. Also requested Chief Engineer (General) to obtain the legal opinion in respect of 21 Technical Assistants who were appointed as Assistant Engineers through by-transfer.
(ii) Promotion panel of Assistant Executive Engineer to Executive Engineer (civil) :-
The General Secretary, AOE informed that Executive Engineer estimate of vacancies for 78 numbers is approved by the Government. The name panel will be sent as early as possible. The promotion and postings of the remaining 11 persons in the approved panel is expected in 2nd week of this month.
(iii) Superintending Engineer Panel (civil) :- The General Secretary, AOE informed that the name panel of the SE for 53 numbers is in active consideration of the Government.
(iv) Promotion of 2007 batch Assistant Engineers and court cases:- Er.D.Jeyakumar, president, AEA clearly explained about the promotional
issues regarding 2007 Assistant Engineers as requested by the General Secretary, AOE. (v) Financial Position :-
Er.D.Rajeswarbabu, Treasurer, AOE presented financial position of our Association in the CEC and also requested the members to contribute more for legal funds since we are in a position to meet the pay case in Supreme Court.
The Treasurer, AOE listed out the financial position of the Association and requested the branches to clear the Subscription which are due for the year 2018 and also requested the members to contribute more legal fund. Re-Construction of Poriyaalar Ramalingam Illam :-
Er.K.Karunanithi, Secretary, ENGIBEF to submit the proposal regarding Construction / Rennovation of Poriyaalar Ramalingam Illam to the CEC.
Er.K.Karunanithi, Secretary, ENGIBEF, presented two types of proposals for the construction of Poriyaalar Ramalingam Illam. One is for Renovation and Rehabilitation which estimated as Rs.90 lakhs and another for New Construction with estimate of Rs.1.60 Crores and requested the CEC member to give their valuable suggestions.
Er.S.Karthikeyan, Resident Engineer, AOE briefed about the Financial Status of Poriyaalar Ramalingam Illam and the need for Re-construction of Illam. Enhancement of Financial & Administrative Powers of our Engineers :-
Er.V.Rajakumar, Personal Affairs, AOE briefed about the Enhancement of Financial and Administrative power of our Engineers and explained about the problem in pay fixation for Superinteinding Engineers and Executive Engineer after quashing G.O.Ms.No.328.

Any Other Subjects :- (i) The General Secretary, AOE requested the Engineer-in-Chief (WRO) and Chief
Engineer (General) PWD and the Principal Secretary to Government, Public Works Departments to take necessary action for getting permanent sanction of Circles and Divisions.
(ii) The General Secretary, AOE requested the Govt. and the Engineer-in-Chief (WRO) and Chief Engineer (General) PWD to send the proposals to have Treasury Power to the Executive Engineers of PWD, to speed up the works and avoid the unnecessary paper work.
(iii) The General Secretary, AOE explained the further course of action of the TNEF regarding Pay Issues.
(iv) The General Secretary, AOE also explained the merits and demerits of G.O.Ms.No.173, which enables the I.A.S. to monitor “KUDIMARAMATHU” works.
Er.S.Gopalakrishnan, Treasurer, ENGIBEF briefed the financial position and membership status of the ENGIBEF Scheme. The Treasurer ENGIBEF also requested the CEC Members to take necessary follow up action to enroll more members in ENGIBEF Modified Phase IV Scheme.
Er.K.Punithavel, Jt. Secretary-Office Administration, AOE briefed the Federation activities regarding 7th Pay Commission and the importance of active participation in the Federation activities for welfare of our Engineering Community.

It was resolved to request Hon’ble Chief Minister, the mentor of our Public
Works Department, to issue the New Government Order as the Hon’ble High Court has quashed the G.O.328 to have a 7th Pay Matrix benefits on par with others.
2. It was resolved to request the Hon’ble Chief Minister, to reunite/merge the 156 year old traditional Department of PWD, and to allow the PWD to function as one department under two wings viz., Water resources Organisation and Buildings Organization, as is the case now.
3. It was resolved to request the Engineer-in-Chief, WRO and Chief Engineer (General) PWD, to expedite the promotion panel for the 2007 batch of Assistant Engineers (as G.O.155 which is impedement to promotion is going to be finalised before the end of this month in the Hon’ble High Court).
4. It was resolved to request the Hon’ble Chief Minister to recruit only graduate Engineers at Section level through Tamil Nadu Public Service Commission.
5. It was resolved to request the Hon’ble Chief Minister to set up Engineering Reforms Commission to enhance the welfare of Public Works Department and Engineers.
6. It was resolved to represent the Tamil Nadu Public Service Commission to recruit 120 Assistant Engineers (Civil), in order to execute the works with no shortage of Assistant Engineers in the Public Works Department immediately.
7. Resolved to request the Government not to grant Extension of services or Re-appointment to the retiring Chief Engineers of PWD.
8. Resolved to thank Central & State Governments for formation of Cauvery Management Authority & Board to release water to Tamil Nadu. It is also resolved to watch and provide assured water with no intervention of politically vested organization to render justice to Tamil Nadu.
9. Resolved to request the Government to give appropriate instruction for the senior I.A.S. officers who have been nominated to monitor the “KUDIMARAMATHU” works for removal of bottlenecks faced by the field engineer if any to carry out the works smoothly and speedily.
10. Resolved to request the Government to create the Legal Cell in every regions of Buildings and WRD.

Sir, The Staff Rationalisation Committee in the questionnaire sent to all Heads of Departments has requested their views on introducing e-offices so as to increase efficiency and productivity of the Department. In this connection, this Association is of the view that even though some initiatives have been made in this regard for file and data management through Enterprise Information Management System, the need for providing video conferencing facilities to hold Inter-Regional conference will have better effect in the administration which will avoid unnecessary travelling time thereby enable the concerned Chief Engineers and Superintending Engineers of Water Resources Department and Public Works Department, Buildings to concentrate more on work for better productivity.
We also remember that such video conferencing facilities were made available in Water Resources Department during the implementation of WRCP the World Bank and video conferences between Regional Chief Engineers and Engineer-in-Chief, Water Resources Department, were stated to have been implemented during those days. But, these facilities were not continued for many reasons of not known.
We, therefore request that such video conferencing facilities may kindly be permitted to be made available at all Regional Offices and Engineer-in-Chief offices of Water Resources Department and Public Works Department Buildings for implementing the e-governance effectively.

We invite a kind attention to the Government Orders cited where in IAS officers are appointed to monitor the “Kudimaramath” and desilting works carried out by, Water Resources Department of Public Works Department. In this connection we wish to bring the following to kind notice of the Hon’ble Chief Minister of Tamil Nadu.
Public Works Department having 158 years old history in carrying out construction and maintenance of large Irrigation dams, Canals under the stewardship of eminent Engineers both before and after independence.
The powers and the functions of Public Works Department Engineers are codified in Public Work code and every category from Assistant Engineer to Chief Engineer are clearly bound by the coded rules.
Already there is effective Supervising mechanism for these works from Assistant Executive Engineer to Chief Engineer level in the department and Principal Secretary is conducting periodical review meetings at Government level.
The appointment of so many IAS officers to monitor the “Kudimaramath” works and desilting works carried out by Public Works Department is unnecessary since it involves duplication of the powers and functions of our Public Works Department Engineers which will demoralise the working of Engineers of Public Works Department. It is also an encroachment of technical authorities by administrators.
In view of the above we request our Hon’ble Chief Minister to kindly reconsider the above appointment of IAS officers and cancel the Government orders cited for better implementation of the above schemes. We also assure our Hon’ble Chief Minister that the schemes read in the reference would be completed to the expectations of the Government.

ORDER: In the Government order first read above, orders were issued enhancing the Maternity Leave from 180 days to 270 days to married woman Government servants, with less than two surviving children which may be spread over from the pre-confinement rest to post-confinement recuperation, at the option of the woman Government servant. In the Government Order second read above. Instruction under rule 101 (a) of the Fundamental Rules have been amended.
2. However instances have come to the notice that some women Government servants were denied Maternity Leave for the second delivery since they have two surviving children already because of the twin births during their first delivery and also favourable orders are obtained from the courts in this regard.
3. The Government, after careful consideration of the above and the petitions received requesting to sanction Maternity Leave for second delivery to women Government Servants who had already given birth to twins during their first delivery, order that Maternity Leave shall be granted to a woman Government Servant with less than two surviving children, and that in cases where the individual gave birth to twins in a delivery, maternity leave shall be granted for one more delivery.
4. Necessary amendments to the Fundamental Rules will be issued, separately.

The Engineer-in-Chief (Buildings), Chief Engineer (Buildings), Chennai Region and Chief Engineer (General), Public Works Department has also stated that for identification of new sand quarries in southern Tamil Nadu and to look after the sand quarry operations at Madurai, Sivagangai, Ramanathapuram, Theni, Virudhunagar, Thoothukudi, Tirunenveli and Kanyakumari districts, it is necessary to form a new division with head quarters at Madurai with four sub divisions. He has also requested for redeployment of the Irukkankudi Reservoir Project Sub Division I, Arupukottai under the control of Irukkankudi Reservoir Project Division, Virudhunagar to Vaippar Basin Division, Virudhunagar to carry out the balance works and to maintain the records of the Irukkankudi Reservoir Project Division, Virudhunagar. He has further stated that a total expenditure of Rs.3.10 lakh for the redeployment will be met out from the contingencies. 4. ORDER: In Government Order first read above, administrative sanction was accorded for implementation of the “Kudimaramath-Water bodies Restoration with Participatory Approach” on a pilot basis for the year 2016-17 at an estimated cost of Rs.100 crore along with procedures for implementation of the project. 2. In the Government Order second read above, Administrative Sanction was accorded to take up 1511 Kudimaramath works at an estimated cost of Rs.328.95 crore. The Kudimaramath works are formulated by the Water Resources Department and will be implemented by entrusting the works to the farmers organization / council/ Ayacutdars / Users Association as per the procedures laid down for Kudimaramath schemes. 3. 2. The Engineer-in-Chief, Water Resources Department is requested to carry out the desilting works comprehensively, in a systematic manner so that all the channels in each stretch of the River/Canals are desilted completely within a week’s time in order to convey the water for irrigation till the tail end of the ayacut during the current irrigation season. He is also requested to instruct the concerned Water Resources Department officials in the above divisions to furnish the list of Desilting works being executed and to work in close co-ordination with the above Monitoring Officers.
3. The respective Collectors shall also monitor the work by involving the Revenue Divisional Officers / Deputy Collectors as Zonal officers to monitor these works at the field level. In respect of irrigation systems in the other districts in the State, the concerned Districts Collectors shall monitor the desilting works by involving the Revenue Divisional Officers / Deputy Collectors as Zonal officers.
4. The Additional Chief Secretary / Commissioner of Revenue Administration shall co-ordinate the work of the Monitoring Officers and District Collectors as well as the Monitoring Officers appointed for Kudimaramath works.
