Happy New Year everyone! For those that are interested, here is a brief progress report by the Elk River Chain of Lakes (ERCOL) Lake Level committee.

1. Overall, we are very pleased with the overall progress of the Lake Level project! Everything is going well. But before we start, we want to thank everyone who has helped out in 2019 on this work - it is truly amazing the progress we have made and what we have been able to achieve with your help!!! We still have much to do, but we can look back on 2019 and be proud of what was accomplished. So thanks to the following people who hav ed us out in 2019:

2. Antrim County Board of Commissioners approved $77,375 in funding for the Hydrology study on September 19, 2019 to go along with the $287,000 that the USACE is spending on the project. This should fully fund on 3 year hydrology study (including survey work).

3. USACE completed survey work on the main channel of the ERCOL all the way up to Six Mile Lake in October, 2019. This is significantly more than they were anticipating to be able to achieve, which reduces the amount of third party contract survey work that needs to be done).

4. Mark Stone (Antrim County Operator of Dams) has sent out a request for bids to do the remaining survey work that needs to be completed to support the Hydrology Study. This will cover work that was not part of the scope of work that the USACE did, including bridges and dams on the main channel and the Cedar River and Rapid River tributaries. Bids are expected in by early February, 2020 and we expect to get approval by the Antrim County BOC at the February 20 board meeting. This survey work would occur in the spring, 2020 (anticipated).

5. Fred Sittel (of Friends of Clam Lake and the Three Lakes Association) and his team of volunteers wrapped up work for 2019 measuring the water levels of several lakes in the ERCOL (Six Mile, St Clair, Ellsworth, Wilson, Intermediate, Bellaire, Clam and Torch, plus at the dam in Bellaire). This was done manually on a daily basis from April through October by this great group of volunteers. This will help in development of the Hydrology model and has already proved very illuminating in showing how our lakes vary in level across the period measured.

6. We have purchased & received 10 automated data loggers to continue and enhance our lake level measurement program mentioned above. Fred is hard at work preparing these for installation in the lakes in April, 2020 once the lakes are ice free. 7. Work on the Hydrology Model by the USACE will commence later in 2020, after the survey work is completed (the surveys are the data required to build the model). 8. As part of the lake level project, we are looking for a volunteer who is interested and has some expertise in weather & weather data collection. This is part of our desire to collect more accurate weather data for the ERCOL as a data feed for the Hydrology study. Also approved by the Antrim County Board of Commissioners in September, were modified operating guidelines for the dam on the Intermediate River in Bellaire. These were implemented immediately. They were developed with the help of the Lake Level committee and the Intermediate Lake Association. While the modified guidelines will not solve all of the upper chain flooding issues, they will help, as we feel was demonstrated this fall. They are:

• During the summer when controlling at 607.15 feet, the lower lake level action point will be 607.00 feet. This means that the lake level will be allowed to drop to 607.00 feet before action is taken to raise the lake level by reducing water flow over the dam at Bellaire.

• As part of the process to draw the lake level down to the winter level of 606.54 feet by November 1, the lower lake level action point will be 606.84 feet from Labor Day to September 30 and will be 606.54 from October 1 to October 30. Again, this means that the lake level will be allowed to drop to the action point before action is taken to raise the lake level by reducing water flow over the dam at Bellaire.

• During the winter when controlling at 606.54 feet, the lower lake level action point will be 606.54 feet.

• As an aid to boat removal from the Intermediate River upstream of the Bellaire Dam (there is a boat ramp just upstream of the Bellaire Dam which boat owners use), the Operator of Dams may decrease the flow through the Bellaire Dam for certain coordinated periods (like a weekend) to ensure there is adequate water in the river. This is not viewed as impacting the above guidelines.

WASlilNGTON- Landowners won a closely watched property rights victory at the Supreme Court Friday·Jn a ·c;as� that centered on a cemetery.

After holding two oral arguments over four months, the justices ruled that a Pennsylvania woman whose land was used for access to an old burial ground can seek compensation In federal court. The 5-4 opinion was written by Chief Justice John Roberts, with conservative justices behind him and liberal justices opposed.

"A property owner has a claim for a violation of the Takings Clause as soon as a government takes his property for public use without paying fur It,. Roberts said. "The property owner may sue the government at that time In federal court.,.

. The decision overrules a portion of a Supreme Court precedent that In tum was based on other cases dating to the late 1800s, which Associate Justice Elena Kagan noted in her dissent.

Noting that Associate Justice Stephen Breyer earlier this term criticized the court's conservatives for overturning precedent by wondering "Which cases the court will overrule next," Kagan added: ''Well, that didn't take long. Now one may wonder yet again."

The decision represents a victory fur conservative and libertarian groups opposed to government tal<ings. During the second oral argument in January, Associate Justice Samuel Alita had accused the local government of seeking nhome-court advantage" in state court.

1) Booking Fees a. Cancellation: The $2 fee will be charged for all reservation made in the software, it is

Campspot’s recommendation to incorporate that amount into any cancellation fees charged by Barnes Park. This will be reflected in the updated policies that I have been working with Eileen Wallick to update and will be presented to the Board for Approval when completed.

b. Fees for Add-Ons: Campspot charges additional reservation fees for rental items only, (i.e. canoe, tent, golf carts, etc.) and does not charge anything toward the sale of items in the point-of-sale portion of the program

2) Technical Support The reason technical support is not called out in the agreement is that Campspot does not charge anyone for technical support. Whereas the $0.00 Initial Set-Up was unique for Antrim County and the $0.00 Monthly Fee refers to our choice to charge $2.00 for every reservation. Further, the no-cost technical support remains assured as they are only able to recoup monies if the software is being used and functioning correctly.

I have met this week with Ms. Wallick to begin updating policies and filling out information for the Campspot service. It is our intention to do a soft launch this spring, having the Barnes Park staff use the software exclusively and advertise (and encourage) the acceptance of credit cards. If everything goes to plan, a hard launch will be planed for early to mid-summer. It will be at this time that we will utilize the County website, Facebook, flyers and word-of-mouth to advertise the new system in the most appealing way.

The Michigan Veterans Affairs Agency (MVAA) is providing training reimbursement to ensure county veterans service officers receive the required annual continuing education unit (CEU'S) on veteran's benefits, laws and procedures. The funds will be used to reimburse the County for training costs associated with county service officers attending training in Michigan.

Pursuant to the Antrim County Travel Policy, the employees attending training receive reimbursement from the County out of the Veterans Affairs travel line item expenses paid with their own personnel funds. I then complete the MY AA Travel and Expense Form and submit to the MY AA with the original detailed receipts, etc. The MY AA will then release the appropiiate funds to the Antrim County Treasurer to be credited to the General Fund.

The training that will furnish our CEU's for the year of 2020 is being held April 14th- Apiil

17th in Frankenmuth. The MV AA asks that they receive our reimbursement application no laterthan March 22nd. That said, I request the approval of the following motion:

Application Instructions for the Michigan Veteran Affairs Agency's

County Training Reimbursement Program

General:

The Michigan Veterans Affairs Agency (MVAA) is providing training reimbursement to ensure county counselors receive the required annual Continuing Education Units (CEU's) on veteran's

benefits, laws and procedures.

Funds will be used to reimburse the county for training costs associated with county counselors

attending training in Michigan. The training must meet the minimum requirements of the

USDVA's Office of the General Counsel.

Application Process and Deadlines:

Applications will be accepted for consideration starting February 3, 2020. We ask that you

complete the MVAA County Training Reimbursement Application (Attachment C) and submit any supporting documents as soon as possible but no later than 30 days prior to attending the

training event. Applications will not be accepted after August 1, 2020.

The Reimbursement Application and any supporting documentation should be scanned and

submitted via email to Stefanie MacDonald at [email protected].

Reimbursable Expenses:

All expenses are subject to the limits set forth in the State of Michigan Standardized Travel

Regulations and department policy.

• Lodging:

o Will only be authorized for those who must travel at least 50 miles from their work

address to the training location (100 miles round trip).

o Lodging for the night prior to training is authorized for those who must travel over

four hours to the training location.

o Reimbursement for lodging will be at the official State rate of $85 per night; must

have a valid receipt. (See Attachment B)

• Mileage:

o If a county vehicle is not available, personal vehicle travel expenses will bereimbursed at the official State standard mileage rate of $0.34 per mile.

o If two or more county counselors travel together in the same vehicle, only one will

be reimbursed for mileage.

o If a county counselors travel is less than SO miles from training, and the training is

not being held in the same city as their official work location, they will be

reimbursed for their daily mileage to and from training.

o Mileage will be verified from the traveler's work address to and from the training

location using MapQuest (at the shortest distance computed).

• Meals:

o Must have an original, unaltered, itemized receipt with date, time, amount, vendor

name, vendor address and a general description of the items.

o Only single meal items intended for consumption during the meal period are

reimbursable.

o Meal tips (maximum 20%) are allowed only with sit-down meals and must be

indicated on the receipt.

o Reimbursement for meals will be at the State rate (See Attachment B).

o Eligibility for the reimbursement of meals, when the duration of travel includes a

partial day or days, will be determined in accordance with the schedule described

in the Michigan Standardized Travel Regulations.

• Registration fees for training; must have a valid receipt.

• Standard parking and tollway fees; must have a valid receipt.

• Note: Credit card charge slips will not serve as adequate documentation for expenses.

Non-Reimbursable Expenses:

• Alcoholic beverages or receipts that include alcohol (even if crossed out)• Mileage, meals or lodging in the same city as official work location• Meals Included in the costs of registration fees• Complementary or Continental breakfasts supplied by site vendor• Guests meals• Meals supplied by event sponsors• Handwritten receipts• Grocery store receipts• Mileage to and from home

Expense Reimbursement Process:

In order to receive reimbursement for authorized travel, the county must submit a Travel

Expense and Reimbursement Form (Attachment D) and scanned copies of all original

supporting documents such as hotel receipts, detailed meal receipts, receipts for other

allowable expenses and MapQuest verified mileage. The Travel Expense and Reimbursement

Form must be filled out electronically, correctly completed (see example form Attachment E},

signed and dated.

The Travel Expense and Reimbursement Form and all supporting documentation must be

scanned and submitted via email to Stefanie MacDonald at [email protected] within

two weeks of completing the training event.

Attached you will find the Letter of Intent to apply for the FY20 CVSF Grant. If you have already submitted a Letter of Intent for FY20 and received confirmation, you do not need to resubmit.

Submitting a Letter of Intent is mandatory to secure your space for funding. The Letter does not bind you to any legal contract or obligate you to apply. However, if you choose not to apply after submitting a Letter of Intent, please let us know as soon as possible as this may impact per capita disbursements to counties that do complete the application process.

Over 6 million in grant dollars have been made available to the 83 Michigan counties through the Michigan Veterans Affairs Agency. Consistent with our discussions with the Michigan Association of County Veterans Counselors, Michigan Association of Counties and members of the Legislature we want to stress that the goal and intent of these grant dollars are to enhance and improve county veteran service operations in an effort to connect more veterans to their benefits and provide consistent access to services throughout the state. Grant awards will consist of an upfront base payment of $50,000.00 and per capita amounts will be paid on a reimbursement basis.

You MUST submit the Letter of Intent to be eligible to receive any of the grant funding. Total grant dollars (base payment plus per capita amounts) will be calculated and communicated to each county as soon as possible after all Letters of Intent are received.

Letters of Intent are due no later than 12:00 p.m. EST on Friday, January 17, 2020.

A FY20 timeline for the CVSF Grant has been created for your reference and can be found on the following page. Please print and keep a copy for your records. The Grant Guidelines will be sent in a separate email by Friday, February 10, 2020.

SUMMARY AND BACKGROUND

The Michigan Veterans Affairs Agency (MVAA) is accepting applications for fiscal year (FY) 2019 County Veteran Service Fund grants (PA 210 of 2018). AVAILABLE FUNDING

The total disbursement for each grant shall be determined by combining the following amounts:

(a) A base amount of $25,000.00.

(b) A per capita amount according to the number of veterans residing in each county. The amount in this subdivision shall be determined by dividing the amount remaining in the fund after accounting for all disbursements under subdivision (a) by the total number of veterans residing in this state and multiplying the resulting dollar amount by the number of veterans residing in the county receiving the grant. Population figures for veterans residing in this state and in each county of this state shall be obtained from the most recent (2017) Geographic Distribution of VA Expenditures (GDX) Report published by the United States Department of Veterans Affairs.

(c) If the amount remaining in the fund after accounting for all disbursements under subsection (a) is less than the amount obtained by multiplying $1,000.00 by the number of counties receiving grants, the Michigan Veterans Affairs Agency shall not perform a calculation under subsection (b) and shall not disburse the portion of grant funds described under that subsection.

There is no cost sharing or match required.

Funding is provided on a reimbursement basis. Reimbursements will be made on a quarterly basis.

TIMELINE

September 17, 2018 - Applications or an Intent to Apply must be submitted to [email protected] by 3:00 PM Eastern Time. Applicants are encouraged to submit applications early.

September 28, 2018 – Awards announced for those counties that have applied for a grant and a confirmation for those counties that submitted an intent to apply.

Counties electing to submit an Intent to Apply in lieu of an application packet must submit the Intent to Apply form (see attached) by the application submission date and time. An Intent to Apply informs the MVAA that the county will submit an application packet no later than December 1, 2018. The MVAA will process applications received between September 21, and December 1, within 5 to 10 business days.

DEFINITIONS

For this funding opportunity, below is a list of commonly used terms as defined by Public Act 210 of 2018.

(a) “Accredited veteran service officer”: an individual who has met the qualifications for accreditation under 38 USC 5904 and 38 CFR 14.629.

(b) “County veteran service fund” or “fund”: the county veteran service fund created within the state treasury. (c) “PIV card”: a personal identity verification card issued by the United States Department of Veterans Affairs. (d) “Veteran service operations”: assistance and programming to meet the needs of veterans in this state. Veteran

service operations include, but are not limited to, providing advice, advocacy, and assistance to veterans, servicemembers, dependents, or survivors by an accredited veteran service officer to obtain United States Department of Veterans Affairs health, financial, or memorial benefits for which they are eligible.

ELIGIBILITY

Eligibility is limited to Michigan counties.

ELIGIBILITY CRITERIA

To be eligible to receive a grant, a county department of veterans’ affairs must satisfy the following;

(a) Maintain a minimum level of county funding for veteran service operations equal to the level of county funding for veteran service operations for the preceding fiscal year.

(b) Establish remote access to the United States Department of Veterans Affairs computing systems and require county veteran service officers to obtain a PIV card.

(c) Submit quarterly reports to the Michigan Veterans Affairs Agency in accordance with the reporting requirements detailed in this document.

(d) Provide no less than 20 hours per week toward veteran service operations.

(e) Submit financial reports to the Michigan veterans affairs agency on a quarterly basis, demonstrating that the county department of veterans’ affairs expended the grant funds received directly and solely on veteran service operations during the period of the report.

GRANT FOCUS AREAS

(a) Submissions should focus on enhancing veteran service operations as defined. Priority will be given to

applications that seek to establish a new County Department of Veterans Affairs, increase existing hours dedicated to veteran service operations, and assist veterans with applying for emergency grants from the Michigan Veterans Trust Fund.

(b) Other requests will be considered on a case-by-case basis. Applicants will be notified if their proposal is not approved and afforded an opportunity to submit an amended or new application. It should be noted that submitting an amended or new application may delay the start date of the project.

APPLICATION

Applications for this grant require the submission of a project narrative, a budget justification and narrative, and a copy of the county’s FY18 budget for the organizational structure that provides assistance to veterans and/or family members.

PROJECT NARRATIVE

All applicants must include a detailed narrative describing:

(a) the county’s current organizational structure that provides assistance to veterans and/or family members;

(b) existing veteran services operations to include the type and number of claims submitted;

(c) additional internal programs that assist veterans;

(d) and how the grant funds will be used.

BUDGET JUSTIFICATION AND NARRATIVE

All applications must have a detailed budget justification and narrative that supports the requested funding. The Budget Justification and Narrative explains how the costs were calculated and must tie directly back to the Project Narrative.

Charges to the project for items such as salaries must conform to the written policies and established practices of the applicant organization.

Travel expenses charged to the grant cannot exceed the State of Michigan approved travel rates.

COUNTY BUDGET

All applications must include a detailed FY18 budget for the organizational structure that provided assistance to veterans and/or family members. For most counties, this will be their county department of veterans’ affairs. Counties that do not currently provide assistance to veterans and/or family members are exempt from this requirement.

POST AWARD

All grantees will need to be registered to do business with the State of Michigan. Registration is available at the following website: www.michigan.gov/SIGMAVSS.

REPORTING REQUIREMENTS

Within 10 days of the end of each quarter, grant recipients shall submit the following reports:

(a) An updated county department of veterans’ affairs budget and invoice for expenses incurred during the quarter.

• Submitting budget reports for reimbursement start with an approved budget. Reimbursements will be made on a quarterly basis. All reimbursable expenses must be incurred during the grant award cycle. Requests for reimbursement for activities/services prior to the award of after the close of the award WILL NOT be reimbursed.

• Reimbursement for salaries/fringe benefits will need to be supported by submitting certified signed time sheets by both the employee and employee supervisor.

• Quarterly Financial Reports demonstrating the expenditure and division of grant funds and county funds, must be signed by the applicant organization’s Chief Financial Officer.

(b) A Quarterly Activity Report that identifies the number and types of claims submitted during the reporting period.

(c) A Quarterly Progress Reports that shall include:

• Major tasks completed in the previous quarter.

• Work to be accomplished in the next quarter.

• Identify what conditions, if any, which currently do or may in the future present challenges to county being able to fulfill terms of grant application or an affirmative statement that are no such challenges known or anticipated.

Reimbursement of expenses is dependent on the receipt of all reporting requirements listed above.

Reporting templates will be provided to grant recipients with the Notice of Award.

PROJECT/BUDGET AMENDMENTS

You must receive prior authorization from MVAA before making a project or budget revisions. Revisions made without prior approval will be not be reimbursed.

MONITORING

All grant recipients will be subject to grant monitoring and performance, including data collection. Standardized templates will be provided. Budget, progress and activity reports will be required quarterly. Grant and performance monitoring will be conducted by the Michigan Veterans Affairs Agency. If the Michigan Veterans Affairs Agency

determines, by audit or otherwise, that a county department of veterans’ affairs expended the grant funds received for purposes other than veteran service operations, the Michigan Veterans Affairs Agency shall reduce the grant disbursement provided to the county department of veterans’ affairs in the succeeding fiscal year by an amount equal to the total of all amounts improperly expended.

1. Action Request/Suggested Motion To authorize Antrim Conservation District to revise the Household Hazardous Waste Fee Schedule to include a suggested donation for all participant, and to charge a fee of $5 for printers, fax machines, radios, and TVs and monitors under 30 inches, and $15 for anything over 30 inches. 2. Background and Current Situation – Concisely include pertinent facts, dates, etc. Last year’s Household Hazardous Waste fee schedule included a charge of $1 for every pound over 100 lbs. and a $1 charge per gallon of latex paint. That fee schedule was developed to try to make the unloading more efficient than the previous year and to keep participant fees about the same as the prior year (2018 = $5457). The result was that unloading WAS more efficient and participant fees stayed about the same as the previous year (2019 = $6138). The events were successful in attracting double the number of participants and the amount of waste brought in. 3. Goal – Why the action is necessary; What is the specific target or outcome desired? Our goal is to get the participants in and out of the line within 15 minutes in 2020. While we did become more efficient, we anticipate the need to be even more efficient in 2020 to offset the increased number of participants. We will also be sure to have more volunteers on hand than last year. Separating and counting the latex paint cans was confusing for the volunteers and slowed down the lines and weighing the loads over 100 lbs was the next greatest slow down. In order to maintain participant fees and increase efficiencies, we are proposing to charge for electronics at the 2020 events so that we can keep the fees consistent with the new electronics recycling grant program which will collect electronics on one Saturday during the other nine months of the year. Fees will be $5 for printers, fax machines, radios, and TVs and monitors under 30 inches, and $15 for anything over 30 inches. 4. Financial – Budget-related information 2019 Gross HHW disposal costs were approximately 62,375. Grants for tires and pesticides offset HHW costs by $7,000 and participant fees were $6,138 for a net estimated cost of $49,237 in 2019. 2020 Estimated sponsorships, participant fees, donations & grants include: Grants: $7,000 Sponsorships: $3000 Electronics (10,000 lbs): $4000 Suggested donations (650 cars): $4000 Total fees = $11,000 Estimated NET 2020 HHW cost = $44,000* *Assuming # of participants and volume does not increase significantly. 5. 6. Policy Implications Keeping Household Hazardous Waste event fees consistent with electronic recycling fees, the participants will have less confusion. Including some payment and/or suggested donation makes people realize there is a price tag associated with recycling and disposal, and (hopefully) to think about buying the smallest quantities possible when making new purchases of chemicals and paints. 7. Plan – Timeline with who, what, where, and how The new fees and schedule will be provided to all township and village clerks, advertised in the newspapers and updated on the County and the Conservation District web pages. HHW events will be further advertised by the four chambers of commerce representing Antrim County. 8. Alternative Plan Alternative options include:

1. Keep the fee structure the same as 2019. 2. Keep the events completely free – no suggested donation. 3. No fees, but do suggest a donation. 4. Add on the electronics fee to the 100 lbs weight over fee and latex paint fee.

1. Action Request/Suggested Motion To authorize the Chairman of the Board of commissioners to sign the contact with Amalgam Services, as budgeted, for Geographical Information System (GIS) services for the Antrim Co 9-1-1 Center as budgeted.

2. Background and Current Situation – Concisely include pertinent facts, dates, etc. The 9-1-1 Center has had the need for accurate GIS information since 2006 when Antrim County acquired map plotting software for 9-1-1 calls. At that time there was no suitable GIS information available for Antrim County. The initial map building project was quoted around $100,000. At that time the Antrim County GIS Department was just starting and did not have the resources available to supply the necessary GIS maps. The 9-1-1 Board then chose to stay in house by using a 9-1-1 employee to collect the GIS data. It took nearly a year to collect the needed GPS information to construct the 9-1-1 maps. The streets layer was a game changer in terms of finding a person’s location in an emergency. Prior to that callers had to give turn by turn instructions from major intersection with accurate descriptions of their residence. A more accurate “points layer” was added in roughly 2011. Points (using a Global Positioning System [GPS]) appear above each home which greatly increased the location accuracy even more so than the streets layer provided. Now, callers who cannot communicate where they are, can be found even faster. The points layer however created an issue with how responder boundaries are used in the system. A small group home owners with long driveways may not get the correct responder recommended for that call. A new responder boundary layer needs to be created to account for long driveways. The responder boundary layer will based on the parcel boundary. The street maps were also updated bi-weekly by the same 9-1-1 employee. That employee was promoted to a position that no longer allows the time to keep the maps updated as they should be. As of yet no other 9-1-1 employee has been able to grasp the necessary technical skills needed for the 9-1-1 GIS maps. The maps are still very accurate but fall below the NENA standard of accuracy of 90. The maps are now two years old and need to be updated. 3. Goal – Why the action is necessary; What is the specific target or outcome desired? The primary goals are to;

1. Bring the 9-1-1 street layer, point’s layer and the Peninsula Fiber Network (PFN) Master Street and Addressing Guide (MSAG) data up to a base line where the data matches across all three data bases, above 99%.

2. Create a base line response for each responder based on parcels instead of streets.

A secondary goal will be to have the data updated either weekly or as needed to keep the data base up to date and above 95%. A third goal is to train another 9-1-1 employee with the skills needed to keep the maps updated with in the County.

AGREEMENT BETWEEN AMALGAM LLC AND ANTRIM COUNTY

Antrim County NG911 GIS Maintenance Service

This Agreement is entered into on the date of signature by Antrim County,

located at 207 East Cayuga Street in Bellaire, Michigan 49615 and Amalgam LLC, located at 809 East Bennett Street in Mount Pleasant, Michigan 48858, and (collectively referred to as the “Parties”).

The purpose of this Agreement is to specify the responsibilities of the parties

related to “NG911 GIS Maintenance Service”. Antrim County maintains multiple 911 datasets in GIS format. The maintenance of GIS layers is required to retain value through the currency and accuracy of the layers. Antrim County will contract GIS maintenance to Amalgam LLC to ensure accuracy and currency of the GIS layers. In consideration of the mutual promises herein and benefits received, it is hereby agreed by Amalgam LLC and Antrim County as follows:

1. Project Overview:

Amalgam LLC will provide GIS maintenance to Antrim County 911. Maintenance shall be performed on an as needed basis determined by Antrim County in order to maintain information accuracy and currency.

2. Project Schedule: This Agreement shall be in effect until terminated according

to the terms in section 10 of this agreement. 3. Responsibilities of Amalgam LLC:

A. Amalgam LLC will conduct all GIS maintenance using ArcGIS software. B. Amalgam LLC will provide mapping deliverables in ESRI Shapefile

format or ESRI Geodatabase format.

C. Amalgam LLC will maintain a close working relationship with Antrim County.

4. Responsibilities of Antrim County:

A. Antrim County will work with Amalgam LLC to undertake the objectives of this project.

B. Antrim County will provide GIS changes in a written or electronic format

C. Antrim County will review all deliverables for accuracy and report any omissions or errors to Amalgam LLC.

D. Antrim County will maintain a close working relationship with Amalgam

LLC 5. Payment:

• Antrim County agrees to pay Amalgam LLC $50.00 per hour to perform 911 GIS edits.

• Amalgam LLC will invoice Antrim County upon satisfactory completion of project tasks.

• Antrim County will issue payment based on the invoice. Checks will be

issued within thirty days of receipt and will be mailed to Amalgam LLC, 809 E. Bennett St., Mt Pleasant, MI 48858.

6. Change of Project Fee Due to Revisions: Any revisions to the agreed upon

Project by Antrim County, after the execution of this Agreement could result in an increase in the Project Fee. In the event Antrim County wishes to revise the original Project, Antrim County shall submit the revised proposal to Amalgam LLC in writing. Amalgam LLC shall then have five (5) business days to provide Antrim County with an updated Project Fee, if applicable. If the updated fee is acceptable to Antrim County, then Antrim County shall sign the updated proposal, which shall become an amendment to this Agreement. In the event Antrim County does not accept the updated Project Fee, then Amalgam LLC shall continue to perform under this original, un-amended, Agreement.

7. Representations of Amalgam LLC: Amalgam LLC represents that it shall

make every effort to ensure that the final Project is technically accurate, based on the information provided to Amalgam LLC by Antrim County.

8. Representations of Antrim County: Antrim County represents that it shall be

responsible for providing all necessary data, materials or information which Amalgam LLC will need to complete the Project with technical accuracy. Antrim County acknowledges that Amalgam LLC is not responsible for, nor shall it be held liable for any data, materials, or information, which Antrim County has

supplied to it, which are not accurate or are false, which Amalgam LLC has relied upon for completion of the Project.

9. Indemnification: Amalgam LLC shall indemnify and hold harmless Antrim

County, its elected officials, board members, officers, employees, agents, and representatives from any and all claims, demands, losses, causes of action, damage, lawsuits, judgments, including attorneys’ fees and costs, arising out of, or relating to, Amalgam LLC’s services under this Agreement. Antrim County shall indemnify and hold harmless Amalgam, LLC, to the extent of the law, against any and all claims, actions, suits, damages, judgments, charges, costs, or expenses, if materials or information supplied by Antrim County to Amalgam LLC to be used to perform services are found to be faulty or, if such materials or information are the intellectual property of a third party.

10. Termination of Agreement: This Agreement may be terminated with thirty

(30) days written notice by either party. If terminated, Antrim County agrees to immediately pay Amalgam LLC for completed work already provided under this agreement.

11. Other Agreements: This Agreement constitutes the entire agreement between

the parties, and all prior discussions, agreements, and understanding, whether verbal or in writing, and are hereby merged into this Agreement.

12. Amendment or Modification of this Agreement: This Agreement may be

amended or modified only by a written instrument of the Parties. 13. Assignment: This Agreement may not be assigned by either Party without the

prior written consent of the other Party. 14. Force Majeure: Amalgam LLC shall not be deemed to be in default or

otherwise responsible for delays or failures in performance resulting from acts of God, acts of war or civil disturbance, epidemics, accidents, governmental action or inaction, fires, earthquakes, unavailability of labor, strikes or other labor difficulties, materials, power or communication, acts of terrorism, or other causes beyond Amalgam LLC reasonable control.

15. Independent Contractor: The relationship between Amalgam LLC and Antrim

County shall at all times and to the full extent recognized by law be that of an independent contractor. Antrim County understands and acknowledges that

16. Choice of Law: This Agreement has been drafted under the laws of the State

of Michigan, and such state law shall control with regard to any dispute hereunder.

Action Request/Suggested Motion To approve hiring Byce & Associates to conduct an information session on the Facilities Master Plan at for the Board of Commissioners at a cost of $3,000, and that the Finance Director be directed to make the appropriate budget amendment with revenues to come from the General Fund – fund balance.

Background and Current Situation – Concisely include pertinent facts, dates, etc. The Facilities Master Plan is an in depth study and evaluation of the County’s current facilities with the inclusion of different options for addressing needs and deficiencies in the future. The study was conducted and the resultant plan was written by Byce & Associates. At a work session of the Board on February 7, 2020 the Board requested that the County Administrator get a quote from Byce and Associates for providing a presentation on their findings and answering any of the Board’s questions. 3. February 14, 2020 TO: Antrim County Board of Commissioner FR: Pete Garwood, County Administrator RE: Administrator’s Report – February 20, 2020 ADMINISTRATION RELATED MATTERS: 1. Fee Structure for GIS Data: Jeremy Scott, Deputy Administrator, has been working with Ms. Weston. He

has studied the statutory formula that a municipality must use when developing the fee structure and reviewed the history of past data requests. Even though there is a formula, there remains some assumption that are subjective. We will be bringing a recommendation to the Board by May at the latest.

2. Broadband, County Project: I had a phone conversation with Eric Grandstaff from the Northern Lakes Economic Alliance. We discussed grant opportunities that may be available. According to Mr. Grandstaff, there is a grant program with a submission deadline of the end of March. However, a project must be shovel ready to be considered. Mr. Grandstaff indicated there will be other opportunities both from the State and the Federal level and having those discussions now in preparation for future opportunities would be a wise move. To pursue broadband funding opportunities it will take research of opportunities, organization of stakeholders in the County and individual communities, meetings, grant writing, and possible commitment of funds. This all will take staff time. I would like to know if it is the consensus of the Board to move in this direction or at least explore moving in this direction. If so, we will figure out a way to make time for the initiative.

3. Land Purchase and Sale Policy: We are targeting the presentation of a draft policy for July. NO UPDATE 4. Zettel vs Antrim County (State Mandated Foreclosure Process): We continue to wait for a decision by the

Michigan Supreme Court in the Rafaeli v. Oakland County case.

The case filed in Federal Court is called, Grainger, Jr. v. County of Antrim, et al. Once again the plaintiff attorney is trying to get the case classified as a class action suit. The plaintiffs’ attorney in the Wayside Church, et al v. VanBuren County et al filed a motion. However, this case is not presently consolidated with the case of Wayside Church et al. v. VanBuren County et al, so the demand by the “Wayside Plaintiffs". An objection was filed by our attorney on December 3, 2019.

Sherry Comben, Treasurer, requested direction from the County legal counsel and the attorney appointed by the MMRMA to represent Antrim County and others regarding the Zettel case for the future foreclosure administration. Both agreed that we should continue to follow State law for the administration of the foreclosure process. We have not received additional updates.

HUMAN RESOURCES (HR) RELATED MATTERS:

5. County Employment Opportunities: The bulletin board outside the HR Office lists the current openings at the County. − Finance Director – FT: Bradley Rizzo will begin work on February 24. − Antrim County Transportation Driver – Irregular PT: Position will remain open until filled. Reference

checks on a candidate are occurring now. − Antrim County Transportation Mechanic – Regular PT: Position will remain open until filled. − Animal Control Officers – Irregular PT: Interviews occurred, but two positions remain open until filled. − Marine Patrol Officers – Seasonal: Positions are currently posted until March 2.

6. Employee Trainings/Workshops: We are working to schedule Debbie Rochester, Benefit Education

Specialist with MERS to provide retirement planning in the upcoming weeks.

7. Employee Performance Reviews: The Human Resources Director has investigated other evaluation tools and has two sample drafts for consideration. The two evaluation tools were reviewed by department heads and elected officials at the October 16 meeting - the group had a definite favorite.

At a past Board meeting, the Board indicated a desire to see a performance evaluation tool for the Administrator and Finance Director (direct reports to the Board). On January 10, Pete Garwood, Administrator, sent drafts of an evaluation tool and a review process to the Board for its review and discussion in February with a target of implementation in March. At the January 16 Board meeting, mention was made of other evaluation tools. Sheryl Guy provided sample evaluation tools to the HR Director that she had received from various counties. The Health Department evaluation tool was also received.

Stephanie Murray, HR Director and I met and reviewed the different evaluation tools which are attached to the Board packet.

FINANCE RELATED MATTERS: 1. Finance Department: As stated earlier in the report, Brad Rizzo will start on Monday February 24. Corinna

Hervey, Accounting Consultant, will continue to assist as a consultant to Mr. Rizzo as he becomes familiar and comfortable with the position. We will continue to evaluate the role Ms. Hervey plays and the extent of the need for her services.

2. Budget Amendments - Wages and Salary Adjustment: The Budget amendment information for the wage

and salary adjustments were tabled at the last meeting. As we still do not have a Finance Director and are working on making sure the adjustments are accurate, the budget amendment information will not be ready today, but will be for the March 5 meeting.

HEALTH & PUBLIC SAFETY (H&PS) RELATED MATTERS: 8. Michigan Indigent Defense Commission (MIDC): A meeting has been scheduled with Paul Jarboe,

Attorney-Administrator, on February 19 to work through logistics of responsibilities that will be handled by his office and by our office moving forward.

9. Housing Program: Northwest Michigan Community Action Agency has taken over new projects and has spent the budget with existing submitted applications. They will be adding people with needs to a waiting list. The Deputy Administrator continues to work through old and existing cases.

10. Statewide 911 Outage: The 3.5 hour 911 outage on January 31 was due to a partially failed piece of

redundant equipment sending out corrupted information causing additional failures and creating a loop that consumed PFN bandwidth.

11. ACT Fund Balance 2021: The most recent audited fund balance for Antrim County Transportation (ACT)

was $409,828. The current cash control as of February 14, 2020 is $360,663.

12. Opioid Litigation Update: NO UPDATE

BUILDINGS, LANDS, & INFRASTRUCTURE (BLI) RELATED MATTERS: 13. Facilities Master Plan: As a result of the strategic work session led by John Amrhein and Beth Prykucki of

Michigan State University Extension (MSUE), and as directed, I contacted Byce and Associates to get a cost and discuss their availability to provide an additional information session for the Board. A proposal from Byce & Associates is attached. They have also indicated they would be available on the day of the March 19 Board meeting.

14. Barnes Park Reservations/ Accepting Credit Cards: See memo from Deputy Administrator attached to the Board packet.

15. LED Lighting: Work on the County building is complete. Savings and expansion to other buildings can be

explored at the end of the month. No final invoice has been received. 16. Pete Wilks Property: Upon contacting DNR Officer Andrea Albert, there is little that she can do as current

laws only pertain to State land. Mike Meriwether has communicated with the people involved and is submitting an action item for the next Board meeting requesting that we adopt the State’s regulation on hunting blinds. The State's regulation has been submitted to legal counsel for review. My initial review indicates it will need to be tailored for use by Antrim County.

17. County Building Security: A committee of department heads and elected officials met twice (September

24 and October 11, 2019) to review the updated information and discuss other security related issues. The security plan, Fire and Emergency Plan, the paging procedure for when an erratic individual is at your office counter were discussed. The paging procedure and the Fire and Emergency Plan will be integrated and presented at the next department head/elected official meeting in early 2020. The Maintenance and IT Directors met with the Deputy Administrator on January 31 to finalize a security plan (doors and cameras) and have begun getting quotes for a proposal to be presented to the board in the coming months. Roll out of the implementation would likely take place in the spring of 2020. There are grant opportunities with MMRMA the Deputy Administrator will be working on this project and has started filling out the paperwork. Once solid quotes are in we will bring the grant application to the board for approval to submit.

18. County Building Generator Project: Specs for the generator have been finalized and the first quote has been submitted from a preferred vendor under the Sourcewell program.

19. Finance Director Office Space: The Deputy Administrator was tasked with utilizing current County building space efficiently. He identified the office across from HR as an excellent fit for the incoming Finance Director. The move would consolidate available space for efficiency and future opportunities while also moving the new Director closer to Human Resources, Administration, and the Board Room. The timing is ideal during the transition and would be at no cost to the County. The office space on the first floor will be returned to the previous use as a meeting room.

20. Wall Heaters – County Building: Five heaters for the stairwells of the County building have been ordered.

Since it is a custom order, it is anticipated the units will arrive the latter part of March. NO UPDATE 21. Vacant Lot – Bank Building: The lawn restoration of the vacant lot will be addressed in the spring after the

snow melt. NO UPDATE CONTRACTS/AGREEMENTS:

GOAL #1 -Address Topics of Immediate Concern

Respond to request by Leslie Meyers, Antrim County Emergency Planning Coordinator, to participate on

Local Emergency Planning Committee, requested.

Request approval to work through Otsego Conservation District to utilize Scrap Tire funding from EGLE.

GOAL# 2 - Raise Awareness

o Prepared 2 interview and articles of Farmer Spotlight from Farmers Market for our

o HHW - Confirmed all dates and sites for 2020 with vendors and host sites

o Winter Farmers Market was begun on November 13. Six to seven vendors have been

As unbelievable as it may seem, 201 ';) has come and gone in the blink of an

eye and is officially in the books. This year has not been without its

challenges (as is always the case with invasive species management), but all

in all 201';) has been a year of productivity and rewarding work.

In 201';), the CAKE CISMA received 4 grants and two grant

extensions to fund invasive species related projects in our four county

service area. In February, we received an extension from the Michigan

Invasive Species Grant Program to continue our cost-sharing and strike

team program. In May, we received funding from the Dole Family

Foundation to survey the Elk River Chain of Lakes' ';)0 miles of shoreline

for invasive phragmites and purple loosestrife, with treatment to follow

next year. In July, we were awarded funding from the USDA's National

Forest Service through the Great Lakes Restoration Initiative to conduct

survey and treatment for invasive shoreline species on Beaver and Hog

Islands. In September, we received an extension to an MISGP grant to fund

invasive species interns on Beaver Island for the summer of2020. In

November, we were awarded funding for Black-swallow wort control and

education in the City of Petoskey by the Petoskey and Harbor Springs Area

Community Foundation. In December, we were awarded continued

CISMA funding by the Michigan Invasive Species Grant Program. Thanks

to these funders, we have been and continue to be a public resource for the

counties of Charlevoix, Antrim, Kalkaska and Emmet.

These ongoing projects, while diverse in scope and geography, all

have one commonality: they were designed at their core to preserve the

ecological integrity ofNorthern Michigan's native habitats. Whether it be a

public education event on the shores of Lake Michigan on the value of the

eastern hemlock tree, a phragmites treatment on some remote kettle lake in

Kalkaska, or spot spraying knapweed on Beaver Island to protect Pitcher's

thiscle habitat, CAKE is dedicated to the protection of Northern

Michigan's native ecology and the preservation of its natural heritage.

CAKE will carry this conviction into the New Year, and we are grateful for

all our partners who assist us in our mission to protect the natural

resources, economy, and human health in Northern Lower Michigan

through collaborative outreach and management of invasive species. Thank

you all!
