Contrary to what was published by The Billboard which alsodelves into this industry, among many others, and which appearsin their July 24, 1943 issue, page 61, and contradicts what waspublished in their July 3, 1943 issue, page 59, we are now cold-ly, calmly and analytically reporting on OPA’s ^ximum Price Reg-ulation 429, news of which we had been holding in abeyance sincereading of it on July 15th, due to the fact that we were await-ing a more complete interpretation of this ruling to come out of

Washington (as happens in almost all new OPA regulations) beforeeven advising our many subscribers of its reference to this in-

dustry.

THIS IS THE PICTURE. The Office of Price Administration in releasing ]\fcximum

Price Regulation 429 proves that whoever wrote this regulation simply tacked the

words ’’coin operated vending machines” onto this regulation as an afterthought at

the end of a long list of items which include, shovels, wheelbarrows, hatchets, etc.

Thruout this entire regulation OPA contradicts every possible belief that the mem-bers of this ’’service” industry come under this regulation referring to used consum-er’s durable goods.

The Cash Box has always, and will always, continue to bring to this industrymessages as they apply to this industry and this industry only. Not just reportstaken from some publicity release. Not just snap judgments. Not just a statement

Follow along with us carefully. The OPA is interested in preventing inflation-ary prices to the consumer not only of new goods, but by this new regulation of cer-tain ’’used” durable goods, too. The coin machines industry has NOT inflated prices to

the consumer. Pin games still sell amusement for a 50 coin to the consumer. Merchan-dising machines selling cigarettes or candy or peanuts continue to sell within ceil-

ing price to the consumer. A scale still weighs the consumer for a 10 coin. And so

on and so forth down the line. Therefore the ’’consumer” (as we understand him to be

as far as this industry is concerned) is NOT paying any inflated prices. And this,

therefore, complies with the General Ifoximum Price Regulation covering consumer’sgoods and services.

The Billboard inferred that the operator was the "consumer'’ and therefore mach-ines that would be sold to him would come under this regulation. We do not know wherethey obtained this interpretation. There is no such interpretation as far as OPA is

concerned as yet in existence. If they stuck their noses into the hornet* s nest and

asked questions (provided they know the ins and outs of this industry and what to askso as to understand what this industry requires) and have thereby obtained an inter-

pretation from Prentiss M. Brown, Chief Administrator of OPA direct from his Washing-ton headquarters, the trade should and would like to know all about it.

The operator, as far as this industry is concerned, is a WHOLESALER. This is in

accordance with OPA f s own interpretation of a "wholesaler" as reproduced herein in a

former paragraph and as repeated here, "A sale at wholesale is a sale to a person whobuys for the purpose of reselling the goods, rather than for use." That is exactlywhat the operators in the coin machines industry do. They buy for RESELLING. They re-

sell the goods they buy to the public on the basis of a 1# or 5# or even 10# or 25#or 50# installment payment plan. Furthermore, they are not selling "goods" - they areinstead actually selling a "service". An amusement service. Music, etc,, etc., etc,

(Remember that many rulings made by OPA have fallen by the wayside and that a greatirany amendments have also had to be made to certain regulations for OPA did not andstill does not completely understand the inner workings of a great many industries,especially this one.;

We are of the belief that the reasoning which is being presented here will standup. It is the true picture of the merchandising set-up in this industry regardlessof how peculiar it may seem to the average business man connected with any other in-

dustry where wholesalers, retailers and consumers, such as in those industries sell-ing hatchets, wheelbarrows, shovels, etc,, to which this new regulation refers. Butin the coin machines industry (after the product leaves the factory) the whole mer-chandising set-up is composed of wholesalers and WHOLESALERS ARE EXCEPTED FROM THISREGULATION.

The distributor (when the factories are producing new machines) can be consid-ered the "chief-wholesaler". The jobber may be the "sub-chief wholesaler" . The op-erator is the "basic wholesaler". Each one buys for the purpose of eventually resell-ing. The distributors for the purpose of reselling toother distributors, jobbers andoperators. The jobbers for reselling* The operators for reselling, too, and with theretailer as his partner, the operator (for a short time) resells on a peculiar in-stallment basis to the public (the "consumer") his amusemnt or vending service.

To completely assure himself (after September 1, 1943) the seller of a machinecan write across the bill of sale "FOR RESALE", This, in itself, is a very pertinentfact. A machine shipped to someone a thousand miles away (or even 10 miles away) CANBE FOR RE-SALE. Eventually that person would resell it, OPA may try to prove thatthe operator is the "consumer" or may even so declare and let this industry proveotherwise. The burden of proof will have to rest on whether the operator can be theconsumer when, after a period of time has elapsed, he resells the machine he originallypurchased (not trades it in) . In that case the operation of the machine (v/ith theretailer as his partner) and provided that the machine is considered legal by thecourts in that district, could be considered the same as in storage-as it would for theretailer or wholesaler during the interim when it was being operated prior to the timewhen the operator sold it.

OPA may rule and can rule (in an amendment to this regulation) that if the op-erator buys the machine and places it on a location for a certain definite period oftime (30 or 60 or 90 days) he is to be considered the "consumer" and when he "resells"the machine, after that period, he then becomes a "wholesaler". But, that would becontradicting themselves on the idea of what a wholesaler is, according to OPA's ownversion of a wholesaler. The federal government issues its license for machines tothe location owner. They do not, by this action, recognize the operator. Therefore,according to this judgment, the operator must, be a wholesaler for he is bringing some-thing to the retailer who is the one recognized in this instance as the vender of aservice.

By this line of reasoning the reader will understand how complicated the entiresituation becomes when OPA in any fashion whatsoever attempts to classify the operatoras the "consumer". In this industry, and looking at it from the standpoint of what a

wholesaler is in all other industry, the operator is a "wholesaler" of a service, pureand simple. Another thing, MPR-429 as we stated before, refers to "consumer* s useddurable goods" which can bo purchased (such as a hatchet or a wheelbarrow or a shovelamong other products mentioned in this regulation) and can actually bo "used". Butin the case of a coin machine there is nothing that can be "used" on this same basis,as a hatchet or shovel or wheelbarrow. The coin machine simply vends a service. There-fore, by any stretch of the imagination, the coin machines industry (if any price ceil-

ings are to be set) will have to come under regulations adopted for a special sorviccindustry of this kind and not for a durable goods industry, especially in view of thefact that wholesalers are excluded as in the case of this regulation 429,

Our suggestion is not to get flustered* As yet there has been no interpretationas to wh^t this regulation has to do v/ith coin machines from the standpoint that it el-

iminates wholesalers. Since many maintain that this industry is entirely composed of

wholesalers a great many problems will yet arise prior to any interpretation beingissued by OPA from its Washington headquarters. Local offices of OPA may be giving

interpretations of their own, because they may have been approached by many men in

this industry since the appearance of this first item about MPR-429 in The Billboardand may even have caused many complications* But these local interpretations, if the

picture is brought to the local OPA offices as it is presented here, will, to say the

least, be varied and confusing. The best thing for the men in this industry to do at

this time is to await the interpretation which will come out of Washington’s OPA head-

quarters .

We have come a long way in the coin operated machines industry and have seen a

great many puzzling problems come and be solved by the ingenuity and the intelligenceof the men engaged in this industry. We have complete faith in these men. We believethat once again they can point the way (and this time probably to OPA) that if OPA is

so intent on creating ceiling prices for this industry (which hasn’t inflated its

charges to the public one bit) that it create that ceiling for prices as of September

1, 1943 (not of March 1942) and that this remain the ceiling from now until the war is

won. OPA is definitely not out to work a hardship on this or any other industry. It

was created for a very fine and definite purpose. It can continue its work moresuccessfully and keep men’s minds from evasions and mischievous courses by cooperatingv/ith an industry to the fullest possible extent - and that is just what OPA wants to

do*

Back in our June 29, 1943 issue we mention that OPA v/as seeking "Advisory Boards"from all industries. We asked that this industry get together to appoint such aboard to v/ork with OPA for the benefit of this industry. This should have been in-stantly done. But, like all other matters in this business, it seems that to get mostbusy coinmen together, one must do so with a lot of other ideas in view prior to

gaining the necessary attention to do the right thing at the right and preventativetime.

Again we believe this to be the time to remind this industry of something thatis a desperate need and for which The Cash Box has been crusading for many, many longmonths. A National Coin Machines Board of Trade could most definitely have preventedthis scare. Such an organization would instantly have contacted OPA’s Washingtonheadquarters and have obtained an interpretation if this v/as at all necessary. ANational Coin lfe.ch.ines Board of Trade would have been on the ground floor and wouldhave, in all probabilities, eliminated any fright because that would be its job. Thatis why this industry so sorely needs a National Coin Machines Board of Trade. Suchan organization v/ould probably have been called in by OPA as an "Advisory Board" evenprior to placing the words "coin operated' vending machines" into this regulation.Once again The Cash Box strongly urges the members of this industry to get togetherthru this, its confidential weekly, and arrange to create a National Coin tfechinesBoard of Trade for its future better welfare.
