CB / PJC Trevor phoned on behalf of Little Burning Mountain advising they would like to participate in the FW on 30th July and again the next week after that. He spoke with PJC concerning the W/Comp certificate and advised he would check the dates it covered and the actual form of cover that it offered. Trevor also questioned who the consultant was(RW Corkery) and was given their number and contact name. He indicated he actually wanted to speak to Mike Sutherland (Alkane) as he was aware they were the developers of the project. Trevor was given the Alkane Dubbo office number as per white pages.

CB Cherie phoned Jodie (unavailable) and then the office. CB returned call and Cherie expressed her concern that the project was becoming very political and that they were having difficulty with the other organisation (Little Burning Mountain) At this stage she is still organising the w/comp however is now reluctant to provide representatives as it is becoming difficult. Cherie requested that Jodie perhaps phone Valda when she returns to office on Monday. If Cherie is unable to organise a sites officer for Thursday (hopefully Tom Peckham) she will try to organise two sites officers from PHLALC for the MLA survey the following week. Cherie is hoping that the situation 'cools off' as she expressed she doesnt wish to have to deal with the issues/harassment.

CB phoned Trevor to confirm if the sites officers were organised and to request a copy of LBM's Certificate of Currency. Apparantly their w/comp expires Monday 3/8 however Trevor indicated he would send a receipt that recognised payment and I also advised that he send the Certificate of Currency for the previous year as it is valid for a slight period after expiry and this would be evidence that they actually held a policy. Trevor advised he would be organising sites officers over the weekend and if they could arrange for 6? then he would contact Rob Clegg and advise him it was unnecessary for him to participate.

CB Cherie phoned to advise that unfortunatly PHLALC are unable to provide any sites officers for the survey. She has been unable to reach Tom Peckham, Sharni Hando will not be able to participate due to other work commitments and Ken Robinson had informed Cherie he would be participating on behalf of Little Burning Mountain. OzArk did however receive a copy of PHLALC Workers Compensation Certificate of Currency which expires March 2010.

CB phoned Trevor who advised he was in the process of organising the sites officers for Wednesday. He advised that he would send through a copy of the Certificate of Currency for LBM which expires on Wednesday. Lloyd Walker (their insurance co.) is closed for bank holiday today and Trevor also said he would send through a copy of the receipt of payment when the new policy was paid. When queried as to why he was organising more than the allocated four people he said it was just a number and at the meeting it was decided so as not to aggravate people that 6 representatives would undertake the survey. As OzArk have only been authorised to take four people (incl. Rob Clegg) I did attempt to phone Trevor back to advise that he would need authorisation to organise more, left msg to phone back on his mobile.

CB Trevor phoned to advise that he had organised 5 sites officers for the survey. I said he would need authorisation for the 5th one as we were only authorised to take four, and as we are not paying the invoice it would be best if he authorised this. I also said that the four that we were taking included Robert Clegg so it was necessary that he make the call to advise Rob positions had been filled by other organisations. I also said that it was great that the numbers were organised however we would need to see the Certificate of Currency before anyone could participate. Trevor said he would fax their most recent one to OzArk wthin the hour (he phoned @ 2.02pm- OzArk mobile 0400 041 999)

JB Trevor called to note he had 5 reps coming. I asked him if he had confirmed it with Mike Sutherland that the additional number was ok as I was not authorized to up the number. He noted he head spoken to Mike S about additional number but that Mike had advised that TR needed to discuss that issue directly with OzArk who are the consultants running the heritage assessment. I then said that OzArk are only authorised to take 4 fieldworkers and that one position was already filled by the WCE rep. Trevor was very unhappy about that situation and believes that the WCE rep has no right to operate within PH TO boundaries. I noted to Trevor that I was not able to discriminate based on that and that as a registered stakeholder WCE had been offered a position and I didn’t think it appropriate that OzArk retract that offer. I noted that if Indigenous community reps / groups have issues with each others rights to speak for country that conversation has to happen directly between them and not through OzArk and that my need as a consultant is to remain impartial and follow the DECC ICCR process and as clearly and transparently as possible. Unfortunately my mobile battery went flat before the conversation ended and although I had noted it may, Trevor did not call back on the OzArk landline as I had advised him to.

Trevor Robinson was present with a video camera to record the incident and demand that Rob Clegg not participate in the survey. Attempting to hold OzArk responsible and reason that we should have told Rob he could not participate Jodie explained our position and indicated that as part of the ICCR process OzArk must remain a neutral party. Subsequent to all the ill will Rob Clegg left and did not participate in the survey. LBM had four reps available.

Jodie, as I mentioned last week I had a visit from Dorothy and Diane Stewart who are direct descendents of Michael Mickey who was born in 1851 at Bulgandramine. He was a labourer and station hand (and boxer according to Dot). He died and was buried in Wellington cemetery in 1925. Michael Mickey waqs married to Mary Ann Peck who was born in 1842 in Tomingley. Mary Ann Peck was buried in Wellington in 1943 (lived for 90 years). These two descendents wish to be included in all cultural heritage consultations regarding the Tomingley Gold Projected. Jodie, I met with Dot Stewart today and explained what was discussed at the Peak Hill Heritage consultation last week. Dot had some strong views on Gaynor Macdonald’s work on the Bogan River Wiradjuri Anthropological Report (Federal Court NG 6001 of 1995) - Claimant and genealogical information. The Stewart family barely rates a mention and yet the Stewart sisters are direct descendents of Michael Mitchell Mickey (born 1851 Tomingley died Montefiores 1925) and Mary Ann Peck (born 1842 in Tomingley died in 1932 in Wellington). Dot told me today that she believes that she will be able to get back the breast plate that Michael Mickey (Labourer, stationhand, occasional boxer) wore. I wildly speculate that if he went by the name Mitchell that perhaps Thomas Mitchell may have used his services when exploring the Bogan and gave him the breast plate. Dot does not have any stories of Bulgandramine or Tomingley as she was raised on the mission in Wellington and stolen to Fairbridge Farm (Molong) where she remained with her sister Diane until the early 1970s. Dot does want to be involved in future archaeological work around TGP because of her strong connection to her ancestors land. Dot has a new mobile number 0435 843 324.’

does not want to touch the tree (superstitious?) but was quite relaxed about the bark removal. He does not know anybody who could do the job but thought that Uranai’s grave tree (Molong?) was touched up recently. Someone in OEH surely must be able to assist? Cheers Mike'
