NOTICE is given in terms of Regulation 54 of the regulations gazetted in Government Notice No. R543 promulgated under 24(5), 24M and 44 of the National Environmental Management Act, 1998 (Act No. 107 of 1998) to all interested and affected parties (I&APs) that Hayes Lemmerz (Pty) Ltd proposes to replace existing bulk melters and chip melter with a reverberatory furnace on its current site in Alrode, Gauteng. At present aluminium is alloyed off-site and delivered in ingots to Hayes Lemmerz. Hayes Lemmerz proposes to alloy the aluminium onsite and subsequently feed molten aluminium alloy directly to the wheel manufacturing process, this will result in significant energy and logistical savings.

In terms of Section 24(5) of the National Environmental Management Act: 1998, and the regulations promulgated there under, a Basic Assessment (BA) process is required to undertake the proposed activity, in terms of activity 28 of Government Notice No. 544 of 18 June 2010. This process will also be used to inform an application for conversion of Hayes Lemmerz registration certificate in terms of the Atmospheric Pollution Prevention Act (Act 45 of 1965) (APPA) to an Atmospheric Emissions Licence in terms of the National Environment Management: Air Quality Act (Act 39 of 2004) (NEMAQA). INTRODUCTION & BACKGROUND EScience Associates (ESA) was appointed by Hayes Lemmerz to undertake an environmental Basic Assessment (BA) process for the replacement of existing aluminium bulk melters and chip melter with reverberatory aluminium melter(s) at their Alberton premises. Hayes Lemmerz produces aluminium wheel rims and is a supplier to major vehicle manufacturers. The replacement will allow Hayes Lemmerz to melt and alloy aluminium onsite, and subsequently feed hot molten alloy directly into the manufacturing process. This will improve the overall energy efficiency and cost effectiveness of their operations.

PURPOSE OF THIS DOCUMENT

Environmental BA aims to ensure effective compliance and governance concerning the environment, while simultaneously focusing on key issues such as stakeholder empowerment, and providing access to relevant and concise information to enable informed decision making, on the part of both the proponent and the authorities. This Background Information Document (BID) provides introductory information to Interested and Affected Parties (I&AP’s) with respect to the BA process for Hayes Lemmerz aluminium melter(s). The proposed activities will be undertaken at the Hayes Lemmerz Botha Street premises in Alrode, Alberton. The BID also serves as an invitation to register as an I&AP and participate as a stakeholder throughout the BA processes. This would include the opportunity to, review all reports generated, and/or to submit comments during the process. Your comments and your participation will assist in identifying any environmental issues related to the proposed projects so that these may be taken into cognisance in the BA. Hayes Lemmerz have appointed EScience Associates (Pty) Ltd. (ESA) to facilitate and manage the required BA processes. PROJECT DESCRIPTION Hayes Lemmerz has elected to have a reverberatory aluminium melter(s) erected and operated onsite in order to produce hot aluminium alloy for direct feed to the wheel manufacturing process. At present aluminium is alloyed off-site and delivered in ingots to Hayes Lemmerz. Melting and alloying the aluminium onsite and subsequently feeding molten aluminium alloy directly to the wheel manufacturing process will result in significant energy and logistical savings. The proposed melter(s) will replace the capacity of the existing bulk melters and chip melter currently in operation at the site.

National Environmental Management: Air Quality Act (Act 39 of 2004) (NEMAQA) on 31 March 2010. Hayes Lemmerz APPA certificate remains valid for a period of 4 years after that date, however the organisation must apply for conversion to an Atmospheric Emissions Licence (AEL) under the new act within 3 years (i.e. before 31 March 2013). The intended melter(s) is a listed activity in terms of regulations promulgated under S21 of the Act, and thus would require amendment of the AEL, to reflect the alteration to Hayes Lemmerz activities. The listed activity is Sub-Category 4.4 Secondary aluminium production, and applies to all installations for the secondary production of aluminium through the application of heat. An Air Quality Impact Assessment will be undertaken to determine the impact of the plant in relation to gazetted ambient air quality limits and acceptable air quality limits and/or guideline where none are gazetted. This is in accordance with the requirements of the organisations duty to care as per Section 28 of NEMA and in support of Environmental Authorisation in terms of the National Environmental Management Act (Act 107 of 1998) (NEMA) as well an application for atmospheric emissions licence as required by NEMAQA. The study encompasses:

1. Identification of potentially significant emission sources and pollutants 2. Emissions measurements for prescribed pollutants 3. Quantification of point source and fugitive emissions and development of an

emissions inventory 4. Background emissions quantification in terms of industrial and households

contributing sources in the vicinity 5. Air quality impact assessment through dispersion modelling

Hayes Lemmerz is located on ERF A0800200001470, No. 3 Botha Street, Alrode Extension 2, Alberton; Johannesburg, Gauteng. Refer to Figure 2: Hayes Lemmerz Site Location.

LEGAL & REGULATORY FRAMEWORK In terms of Regulation 20 of the regulations gazetted in Government Notice No. R 543 of 18 June 2010 promulgated in terms of Section 24(5), 24M and 44 of the National Environmental Management Act (Act No. 107 of 1998), the so called NEMA 2010 BA Regulations, Basic assessment must be applied to an application if the authorisation applied for is in respect of an activity listed in Government Notice No. R. 544 of 2010. The establishment of this new aluminium smelter only “triggers” 1 listing in terms of Government Notice R544, of 18 June 2010. The following listing applies: Listed activity No. 28: “The expansion of or changes to existing facilities for any process or activity where such expansion or changes to will result in the need for a permit or license in terms of

national or provincial legislation governing the release of emissions or pollution, excluding where the facility, process or activity is included in the list of waste management activities published in terms of section 19 of the National Environmental Management: Waste Act, 2008 (Act No. 59 of 2008) in which case that Act will apply.” Atmospheric Emissions Licence Environmental legislation applicable to air quality includes:

the Atmospheric Pollution Prevention Act (Act 45 of 1965) (APPA), the National Environmental Management Act of (Act 107 of 1998) (NEMA), and the National Environmental Management Air Quality Act (Act 39 of 2004)

(NEMAQA). It must be noted that NEMAQA will completely repeal APPA in the near future. In terms of Section 61(2)(C) the holder of a registration certificate must, within the first Three years of the date when Section 60 of NEMAQA comes into force, lodge a renewal application in terms of section 47 with the licensing authority of the area in which the activity for which the certificate was issued is carried out. The renewal effectively will convert the APPA registration certificate to an Atmospheric Emissions Licence (AEL). It is intended that the Basic Assessment will inform that application for Hayes Lemmerz. Duty to Care Section 28 of the National Environmental Management Act (Act 107 of 1998) places a duty on every person to identify any significant pollution or degradation (historic and potential) caused by the person to the environment. Reasonable measures must then be taken to prevent the pollution from occurring, continuing or recurring. Such measures include:

investigate and assess risks attached to employees’ work and the manner in which their task must be performed, in order to avoid causing significant pollution or degradation of the environment

cease, modify or control any act, activity or process causing pollution or degradation

contain or prevent the movement of pollutants or the cause of degradation eliminate the source of the pollution or degradation remedy the effects of pollution.

The Basic Assessment Process The proposed operation is a listed activity in terms of GNR 544 promulgated under Section 24(5), 24M and 44 of the National Environmental Management Act, No. 107 of 1998, the so called NEMA 2010 EIA Regulations, 18 June 2010. WHAT IS A BASIC ASSESSMENT? The proposed establishment of an aluminium alloy smelter is a listed activity in terms of Government Notice No. R 544 promulgated under Section 24(5), 24M and 44 of NEMA, the so called NEMA 2010 EIA Regulations. The Basic Assessment (BA) process can be summarized as follows:

PUBLIC PARTICIPATION PROCESS

The public participation process during a BA may consist of some or all of the following activities:

NOTIFICATION of Interested and Affected Parties (I&AP’s) regarding the BA process, consultation activities and availability of reports and decisions by the authorities, using a variety of mechanisms.

FOCUS GROUP MEETINGS with relevant sectoral groups (groups of role players with similar interest, such as the tourism and agricultural sector, local government, etc.).

PUBLIC MEETINGS that will be advertised (dependant on the nature and extent of comments received on the application). These will provide I&AP’s with information and opportunities to record concerns, issues and suggestions, as well as to identify other I&AP’s.

COMMENT PERIODS (30 calendar days) will be communicated review BA Reports in order to provide registered I&AP’s with the opportunity to review and comment on the information compiled through the BA process.

Everyone has the right to be involved in decisions that may affect them. Participation by I&AP’s is in all stakeholders’ interest because:

o It provides opportunities for I&AP’s and the authorities to obtain clear, accurate and understandable information about the expected environmental and socio-economic impacts of the proposed development.

o It provides members of the public with the opportunity to voice their concerns and to raise questions regarding the project.

o It provides I&AP’s with the opportunity to suggest ways for reducing or mitigating any negative impacts of the project, and for enhancing its benefits.

o It will enable the project proponent to consider the needs, preferences and values of I&AP’s in their decisions.

o It provides opportunities for the clearing up of misunderstandings about technical issues, resolving disputes and reconciling conflicting interests.

o It is vital for ensuring transparency and accountability in decision-making. o It contributes toward maintaining a healthy, vibrant democracy.

You are important to the process and we urge you to participate by registering as an Interested or Affected Party (Registration Form attached). The sharing of information forms the basis of any stakeholder engagement process and offers I&AP’s the opportunity to become actively involved in the project from the outset. It also plays an important role in the understanding of environmental investigations, as input from I&AP’s helps to ensure that all potential issues are considered in the BA.
