Dear Mr. Bevers:
Thank you for providing the Ministry of Tourism, Culture and Sport (MTCS) with the Notice of Commencement for your project. MTCS’s interest in this Environmental Assessment (EA) project relates to its mandate of conserving Ontario’s cultural heritage, which includes:
Archaeological resources, including land-based and marine;
Built heritage resources, including bridges and monuments; and,
Cultural heritage landscapes. Under the EA process, the proponent is required to determine a project’s potential impact on cultural heritage resources. Please note that the Standards and Guidelines for Conservation of Provincial Heritage Properties (S&G), prepared pursuant to Section 25.2 of the Ontario Heritage Act (OHA), came into effect on July 1, 2010. All Ontario government ministries and public bodies that are prescribed under Ontario Regulation 157/10 must comply with the S&Gs. They apply to property that is owned or controlled by the Crown in right of Ontario or by a prescribed public body. While some cultural heritage resources may have already been formally identified, others may be identified through screening and evaluation. Aboriginal communities may have knowledge that can contribute to the identification of cultural heritage resources, and we suggest that any engagement with Aboriginal communities includes a discussion about known or potential cultural heritage resources that are of value to these communities. Municipal Heritage Committees, historical societies and other local heritage organizations may also have knowledge that contributes to the identification of cultural heritage resources. Archaeological Resources Your EA project may impact archaeological resources and you should screen the project with the MTCS Criteria for Evaluating Archaeological Potential and Criteria for Evaluating Marine Archaeological Potential to determine if an archaeological assessment is needed. MTCS archaeological sites data are available at [email protected]. If your EA project area exhibits archaeological potential, then an
It is the sole responsibility of proponents to ensure that any information and documentation submitted as part of their EA report or file is accurate. MTCS makes no representation or warranty as to the completeness, accuracy or quality of the any checklists, reports or supporting documentation submitted as part of the EA process, and in no way shall MTCS be liable for any harm, damages, costs, expenses, losses, claims or actions that may result if any checklists, reports or supporting documents are discovered to be inaccurate, incomplete, misleading or fraudulent. Please notify MTCS if archaeological resources are impacted by EA project work. All activities impacting archaeological resources must cease immediately, and a licensed archaeologist is required to carry out an archaeological assessment in accordance with the Ontario Heritage Act and the Standards and Guidelines for Consultant Archaeologists. If human remains are encountered, all activities must cease immediately and the local police as well as the Cemeteries Regulation Unit of the Ministry of Government and Consumer Services must be contacted. In situations where human remains are associated with archaeological resources, MTCS should also be notified to ensure that the site is not subject to unlicensed alterations which would be a contravention of the Ontario Heritage Act.
archaeological assessment (AA) should be undertaken by an archaeologist licenced under the OHA, who is responsible for submitting the report directly to MTCS for review. Built Heritage and Cultural Heritage Landscapes The MTCS Criteria for Evaluating Potential for Built Heritage Resources and Cultural Heritage Landscapes should be completed to help determine whether your EA project may impact cultural heritage resources. The Clerk for the City of Burlington can provide information on property registered or designated under the Ontario Heritage Act. Municipal Heritage Planners can also provide information that will assist you in completing the checklist. The draft MTO Ontario Heritage Bridge Guidelines for Provincially Owned Bridges screening criteria have also been established for cultural heritage evaluation of bridges under the Class EA for Provincial Transportation Facilities. A Cultural Heritage Evaluation Report (CHER) is used to determine the cultural heritage value or interest of a potential Provincial Heritage Property. If potential or known heritage resources exist, MTCS recommends that a Heritage Impact Assessment (HIA), prepared by a qualified consultant, should be completed to assess potential project impacts. Our Ministry’s Info Sheet #5: Heritage Impact Assessments and Conservation Plans outlines the scope of HIAs. Please send the HIA to MTCS and the City of Burlington for review, and make it available to local organizations or individuals who have expressed interest in review. Environmental Assessment Reporting All technical heritage studies and their recommendations are to be addressed and incorporated into EA projects. Please advise MTCS whether any technical heritage studies will be completed for your EA project, and provide them to MTCS before issuing a Notice of Completion. If your screening has identified no known or potential cultural heritage resources, or no impacts to these resources, please include the completed checklists and supporting documentation in the EA report or file. Dear Cameron Bevers and Brent Gotts,
In our initial review, we have confirmed that Hydro One has high voltage transmission facilities within your study
area. At this point in time we do not have enough information about your project to provide you with meaningful input
with respect to the impacts that your project may have on our infrastructure. As such, this response does not
constitute any sort of approval for your plans and is being sent to you as a courtesy to inform you that we must be
consulted on your project.
In addition to the existing infrastructure mentioned above, the affected transmission corridor may have provisions for
future lines or already contain secondary land uses (i.e. pipelines, water mains, parking, etc). Please take this into
consideration in your planning.
Please allow the appropriate lead-time in your project schedule in the event that your proposed development impacts
Hydro One infrastructure to the extent that it would require modifications to our infrastructure.
In planning, please note that developments should not reduce line clearances or limit access to our facilities at any time
in the study area of your Proposal. Any construction activities must maintain the electrical clearance from the
transmission line conductors as specified in the Ontario Health and Safety Act for the respective line voltage.
The integrity of the structure foundations must be maintained at all times, with no disturbance of the earth around the
poles, guy wires and tower footings. There must not be any grading, excavating, filling or other civil work close to the
structures.
We reiterate that this message does not constitute any form of approval for your project. Once more details about your
plans are known and it is established that your development will affect Hydro One facilities including the rights of way,
please submit your plans to:

Dear Sir / Madam: The Ontario Ministry of Transportation (MTO) has retained WSP to undertake a Preliminary Design and Class Environmental Assessment (Class EA) Study for the Queen Elizabeth Way (QEW) from the north end of the Burlington Skyway to Guelph Line and Highway 403 from QEW to Grindstone Creek, in the City of Burlington. The scope of work for the study is expected to include: improvements to the QEW and Highway 403 through the Freeman Interchange; rehabilitation/widening/replacement of bridges in the study area; drainage improvements; illumination improvements; preparing concept designs for a new transitway from west of Brant Street on the 407 ETR and connecting to the Aldershot GO Station; and, a carpool lot near the Plains / Fairview Interchange. Hi Alexandra, The Aldershot GO Station had been previously examined as a potential terminus for the transitway during a previous study undertaken by MTO back in 2005. This EA Study will mostly focus on protecting land for a conceptual transitway corridor along the south side of Hwy 403, rather than looking at details of the service connection. That said, it is our intention to have the conceptual transitway corridor tie into the existing road network as close as possible to the Aldershot GO Station, so as to minimize the use of surface streets by transit vehicles. Hi Alexandra, At this point, the Project Team is not expecting any of the proposed works on Hwy 403 to directly impact the Aldershot GO Station, although some works may be proposed along Waterdown Road itself. As part of the EA Study, MTO is undertaking the conceptual design of a bus transitway along the south side of Hwy 403 from the QEW/403/407 Freeman Interchange westerly to the Aldershot GO Station. Essentially, this will be a continuation of the 407 transitway which MTO is proposing throughout the GTA between Burlington and Hwy 35/115. The “tie-in” point at the western end of the transitway has not yet been determined, but it is assumed that it will connect via a T-intersection into an extension of the service road which currently runs through the Aldershot GO Station. As you may be aware, the area to the east of the GO Station has several environmental constraints which will influence our final transitway alignment. requesting project proponents to self-assess if their project:
1. Will interact with a federal property and/or waterway by reviewing the Directory of Federal Real Property,
available at at www.tbs-sct.gc.ca/dfrp-rbif/; and
2. Will require approval and/or authorization under any Acts administered by Transport Canada* available at
http://www.tc.gc.ca/eng/acts-regulations/menu.htm.
Projects that will occur on federal property prior to exercising a power, performing a function or duty in relation to that
project, will be subject to a determination of the likelihood of significant adverse envionrmental effects, per Section
67 of the Canadian Environmental Assessment Act, 2012.

• Aeronautics Act – Transport Canada has sole jurisdiction over aeronautics, which includes aerodromes and all

towers, would be examples of projects that must be assessed for lighting and marking requirements in
accordance with the CARs. Transport Canada also has an interest in projects that have the potential to cause
interference between wildlife and aviation activities. One example would be waste facilities, which may attract

QEW – Alternative 1 • Burlington is supportive of the proposed HOV lane extension
from Guelph Line to North Shore Blvd.
• There is concern around the potential for congestion at the
QEW/North Shore Blvd. Interchange.
• Burlington would like the study team to consider an exit
from the eastbound QEW to Brant Street.
• Vehicles travelling eastbound on the QEW and destined for
Brant Street north of the QEW/403 now use local roads
(Plains Road East, Fairview Street), despite these trips being
inter-regional in nature.
• Potential for conflict with the Freeman SWM pond, East
Rambo SWM Pond and various watercourses and drainage
features.
• A major source of congestion within the study area that has
not been addressed in the display boards provided is the
westbound traffic that occurs near the QEW/403
interchange at Guelph Line. This location is problematic
given that there is a significant amount of weaving that
occurs as a result of the QEW/403 split that occurs
immediately west of Brant Street.

We appreciate that the City of Burlington took the time to submit comments on the alternatives presented at Public Information Centre #1. In response to some of your comments: “Burlington would like the study team to consider an exit from eastbound QEW to Brant Street”, QEW Alternatives 1 and 2 and Hwy 403 Eastbound Alternatives 1 and 2.
- An exit to Brant Street was considered during the development of alternatives, however it is not technically feasible as there is insufficient spacing between adjacent interchanges.
“There is concern around the potential for congestion at the QEW / North Shore Blvd. interchange.” – QEW Alternatives 1 and 2.
- As part of this study, a future conditions traffic operations analysis of the alternatives is being completed to help identify and refine improvement alternatives, and is one of many factors that will be considered in the assessment and evaluation of alternatives to identify the preferred alternative. .
Comments noting potential for conflict with surrounding stormwater management facilities, various watercourses and drainage features. – All alternatives.
- The project team acknowledges that some improvement alternatives may impact an existing drainage and stormwater management facilities. The project team appreciates the City reaching out in this regard, and a meeting took place on June 19th, 2018 with the Project Team and City staff in regards to drainage and stormwater management and included discussions on transportation planning.
“A major source of congestion within the study area that has not been addressed in the display boards provided is the westbound traffic that occurs near the QEW/403 Interchange at Guelph Line. This location is problematic given that there is a significant amount of weaving that occurs as a result of the QEW/403 split that occurs immediately west of Brant Street.” – QEW Alternatives 1 and 2
- The existing QEW/Highway 403 existing congestion issues are due in part to the lack of lane balance at the split; four lanes on QEW split to two lanes to QEW Niagara and two lanes to Highway 403, resulting in a lot of weaving. The Highway 403 / Freeman Westbound Alternatives (1A, 1B, 2A, 2B, 3A and 3B) propose to mitigates this issue by providing an additional westbound lane on QEW from Guelph Line to Highway 403, in order to develop an either/or lane at the QEW/403 split.
“Burlington was not aware of capacity constraints on the eastbound QEW to westbound 403 ramp that warrants a widening” – Highway 403 / Freeman Westbound Alternative 1B.
- Traffic analysis conducted as part of this study has shown that the existing eastbound QEW to westbound 403 loop ramp is currently operating at capacity. As this study is planning for transportation needs to 2041, increased traffic volumes are forecasted. Thus, additional capacity is recommended for the eastbound QEW to westbound Highway 403 movement and incorporated into all Highway 403 / Freeman Westbound alternatives, except Alternative 1A.

Your other comments will also be taken into consideration in the assessment and evaluation of the shortlist of alternatives and development of the preferred alternative. The next step in the study is the evaluation of the shortlist of alternatives shown at PIC #1. The shortlist evaluation will be completed to a higher level of detail than the long-list screening shown at PIC #1 and will consider evaluation criteria including, but not limited to; natural environment impacts, socio-economic impacts (including noise and air quality), cultural environment impacts, traffic performance, staging impacts and cost. Consultant Project Manager WSP Canada Group Limited In our preliminary assessment, we have confirmed that Hydro One has existing high voltage Transmission facilities within your study area. At this point in time we do not have enough information about your project to provide you with meaningful input with respect to the impacts that your project may have on our infrastructure. As such, this response does not constitute any sort of approval for your plans and is being sent to you as a courtesy to inform you that we must be consulted on your project. In addition to the existing infrastructure mentioned above, the affected transmission corridor may have provisions for future lines or already contain secondary land uses (i.e. pipelines, watermains, parking, etc). Please take this into consideration in your planning. Also, we would like to bring to your attention that should (QEW and Highway 403 Freeman Interchange) result in a Hydro One station expansion or transmission line replacement and/or relocation, an environmental assessment (EA) will be required as described under the Class Environmental Assessment for Minor Transmission Facilities (Hydro One, 2016). This EA process would require a minimum of 6 months to be completed and associated costs will be allocated and recovered in accordance with the Transmission System Code. Furthermore, to complete an EA it can take from 6 months (to complete a Class EA Screening Process) to 18 months (to complete a Full Class EA Process) based on the level of assessment required for the EA. In order to achieve speedy completion of the EA, Hydro One will need to rely on studies and/or reports completed as part of the EA for your project. Please allow the appropriate lead-time in your project schedule in the event that your proposed development impacts Hydro One infrastructure to the extent that it would require modifications to our infrastructure. In planning, please note that developments should not reduce line clearances or limit access to our facilities at any time in the study area of your Proposal. Any construction activities must maintain the electrical clearance from the transmission line conductors as specified in the Ontario Health and Safety Act for the respective line voltage. Hydro One Networks Inc. (HONI) has reviewed and is prepared to provide a conditional approval for MTO’s request of
acquiring a strip of parcel, being PIN 070870014 LT owned by HONI as part of access road (Jobs Lanes).
HONI’s conditional approval is based on review of the following drawings, subject to the the following site specific and
general conditions and MTO’s acknowledgement of these conditons.
1. A preliminary design drawing subtitled 2016-E-0005 QEW and Highway 403 (Freeman) Interchange PD and
EA, Plan and Cross-section of Highway 403 Improvements adjacent Hydor One Transmission Station, prepared
by WSP, dated May 2020.
2. Revised Drawing#3, Hydro One Aerial Crossing Highway 403 – West of Interchange 16+117 & 16+137, MTO’s
Project of Freeman Interchange – Burlington Highway 403 &QEW, prepared by T2 Utilites, dated July 2020.
Site Specific Conditions:
The requested parecel will be sold on the basis of “as is and where is”.
The sale is subject to an Engineering and Review fee in amount of $1,250.00 + HST and a sale
consideration which will be established based on HONI’s Rates and Charges (we will advise when MTO
is ready to proceed).
The lands sale should not impede or impact HONI’s access to the Burlington Transformer Station.
The requested parcel may be impacted by road salting. MTO needs to address it on its own.
Hamilton Conservation Authority has imposed some restriction related to the Jefferson Salamander in the
area. MTO has to address this matter on its own.
No lighting and landscaping has been presented to HONI for review. Detailed Lighting and landscaping
drawings must be submitted for appoval, if applicable.

All underground installations must be capable of withstanding the weight of heavy construction
equipment. Loading that may occur: mobile crane with counterweights in place – 267kN per tandem axle
(dual wheel, 1.53m. axle spacing, 360mm. tires).
General Conditions:
Scope of Approval
This approval applies only to the plans, drawings and documents submitted by MTO/T2UE/WSP to date.
Any revisions to the proposal must be reviewed and approved by Hydro One prior to construction.
Any future proposal on the subject land, including but not limited to, modified use of the present
proposal, must be submitted to Hydro One for review and approval.
Horizontal Clearance Around Hydro One Structures
A 3.0 meter radius around Hydro One structures must be left unpaved for access to tower footings if
necessary.
Hydro One requires 15 meters of clearance on all sides around its transmission structures as measured
from the tower legs in order to carry out maintenance operations. This clearance must be maintained at
all times, and no storage or staging activities should occur within this area during construction.
Vertical Clearance
Construction equipment and personnel working underneath the Hydro One conductors must satisfy
OSHA clearance requirements.
All proposed works on the corridor are subject to adequate overhead transmission line clearance from the
high voltage conductors to the proposed ground elevations. These clearances must be verified by a Hydro
One Lines Technician prior to approval of any secondary land use proposal.
Corridor Conditions and Access
No grading/excavation work is to be carried out using heavy machinery within 10 metres of the tower
footings. Hydro One may permit grading/excavation work within 10 meters of the tower footings
provided this work is carried out by hand or by using a Vacuum truck (VAC) system.
Access to Hydro One facilities must not be obstructed at any time during construction, or after the
proposed facilities are in service. The site must be kept free of all debris and equipment which could
prohibit access to Hydro One facilities.
Hydro One requires a minimum of 6 meter-wide route longitudinally along the corridor to access each
transmission structure. The access route should not have a slope greater than 10%. If MTO fails to
maintain the required access route, they will be liable for any costs incurred by Hydro One in regaining
access to perform maintenance or repairs.
No fill material must be placed on the Hydro One corridor, except with prior approval from Hydro One.

If MTO performs any construction activity within 10 meters of any transmission structures, they must
install temporary orange snow fence erected 3 meters around tower footprint. This fence must be
maintained in an upright position for the duration of construction.
All underground utilities have to be designed to allow for vehicular traffic to pass over. Type of vehicles
to be accommodated includes large utility vehicles and cranes.
Storm Water Management
The proposal shall not interfere with the natural drainage patterns or result in standing water anywhere on
the affected stretch of the Hydro One corridor.
MTO will be held liable for any damage to Hydro One facilities, as a result of flooding or standing water
caused by the proposal.
Any proposed catch basins on the Hydro One corridor must be located within a paved roadway.
Safety & Security
MTO is responsible for maintaining security of the site and for the safety of the people working within the
corridor.
Liabilities
MTO will assume all liability associated with this secondary land use proposal.
In the case of Hydro One emergency work, MTO may be required to suspend their operations without
notice until Hydro One crews have completed the emergency work.
Any relocation, modification or repair of Hydro One facilities as a result of the proposal will be carried
out by Hydro One at MTO’s expense.
MTO is responsible for arranging all underground locates prior to digging, auguring or performing any
excavation works on the Hydro One corridor.
Hydro One is not responsible for any damages or injuries resulting from the effect of adverse weather
conditions. This would include any damages or injuries from ice falling from structures or conductors as a
result of an ice storm.
Hydro One may, at its sole discretion, interrupt MTO’s occupation of the transmission corridor at any
time during construction or post construction, to perform maintenance or emergency repairs. Hydro One
will not be liable for any damages suffered by MTO due to this interruption.
Prohibited Activities
Buildings are not permitted on the transmission corridors. This prohibition includes, but is not limited to,
temporary structures such as tents and construction trailers.
There shall be no storage of any material on the Right of Way (“ROW”) without permission of Hydro
One. Any debris on the ROW shall be removed on an ongoing basis.

There shall be no storage or tipping of garbage dumpsters on the ROW.
There shall be no storage or dispensing of gasoline, or any other combustible substance, on the Hydro
One ROW.
MTO is responsible for arranging underground locates prior to digging or auguring any holes, or
performing any excavation works on HONI’s property.
Please be advised this conditional approval is applicable for two years from the date of this letter after which these
matters will be subject to review and revision based on prevailing circumstances.
Further, this conditional approval does not constitute a final approval to proceed with your proposal. Final approval
will be provided when MTO provided detailed engineering drawings to HONI and HONI has reviewed and satisfied
with, as well as an Agreement of Purchanse and Sale is fully executed by both parties.
Cameron, you indicated in the email of Septermber 29, 2020 that the QEW and Highway 403 (Freeman)
Interchange project is beyond MTO’s current 5-year capital expenditure plan. You will be talking to MTO’s
Property Section to explore an possibility of advance purchase. Upon hearing back from you, we will take
actions for the next step.
At this point, we would ask you to arrange and have a signing authority acknowledge this letter, and return a
